Excelsior Correspondent JAMMU, Sept 5: High Court has stayed the Government order whereby State Dental Council was constituted in terms of Section 21 of the Dentists Act, 1948. The stay was granted in a petition filed by Dr Bhupinder Singh and others. Advocate Parag Sharma appearing for the petitioners submitted that in a previous round of litigation, High Court by virtue of judgment and order dated May 6, 2017 had directed the State to hold the elections and constitute the Dental Council within two months. "However, much before the process of election could be ini- tiated and completed, the Government passed the order dated May 31, 2017 constituting the State Dental Council in terms of Section 21 of the Dentists Act, 1948", he further submitted. He vehemently urged that the order impugned was per se illegal inasmuch as without con- ducting an election in terms of J&K Dental Council (Election) Rules, 1997 as ordered by the High Court, the respondents could not have constituted the State Dental Council. After hearing the counsel for the petitioners, Justice Dhiraj Singh Thakur stayed the opera- tion of impugned order. Excelsior Correspondent SRINAGAR, Sept 5: Strongly rejecting Jammu and Kashmir for- mer Governor Jagmohan's demand for removal of Article -35 -A, sen- ior Congress leader and former Minister Tariq Hameed Karra has said that a hostile situation was being created deliberately across the country against the special sta- tus of the Jammu and Kashmir and the latest seminar and documentary release was part of that nefarious design . In a statement, Karra said that RSS and BJP were working over- time to create a wedge between the people of Jammu and Kashmir and rest of the country to gain political mileage and Article 370 was being used as a tool to achieve that desire of the saffron brigade. He added that a well thought out plan has been worked out by BJP and RSS to use the Kashmir Issue for garner- ing support in the upcoming Gujrat and other State Assembly elections and people like Jagmohan were part of that game plan. The former minister reminded Jagmohan of his 'misrule' and 'mis- adventures' he practiced as a part of his experiments with the people of the Jammu and Kashmir as Governor of the State. He reminded Jagmohan that he too was appoint- ed as Governor by the Presidential order and said if Jagmohan was so concerned about the 'legality' of the Article 35-A and knew the 'provi- sions introduced through the consti- tutional Order of 1954 were done unconstitutionally,' why did not he make attempts to abrogate then? He said BJP has purchased a section of media also to propagate its designs and create a situation of rhetoric and hostility in the country only to fulfill its designs. The meeting was attended by Financial Commissioner, Revenue, Lokesh Jha, Principal Secretary, Agriculture Production, Sandeep Kumar Naik, Principal Secretary Finance, Navin Kumar Choudhary, Principal Secretary to Chief Minister, Rohit Kansal, CGM NABARD, S K Majumdar and other officers of Finance, Agriculture Production, Revenue and other allied departments. During the meeting, the Chief Secretary was told that the insurance scheme has already been kicked off with more than 86000 farmers insuring their crops such as Maize, Paddy, Oilseed and Mango in Jammu region while the scheme hasn't been launched in Kashmir divi- sion where the insurance compa- nies are quoting very high pre- mium. According to officials, a pri- vate insurance firm has sought award cost of Rs 326 crore for one calendar year covering Maize, Paddy, Oilseed, Apple and Saffron crops in three dis- tricts of Ganderbal, Budgam and Kupwara alone with total sum assured of Rs 1027 crore. "There's no way the State will go ahead with the tender (of private firm) unless the funda- mentals are settled. We must first establish a standardized cost of production and scale of finance for crops grown in both Jammu and Kashmir regions, such as Maize and Paddy, to understand the disparity in pre- miums," the Chief Secretary said. He directed the officials to compile the list of incidences of crop damage or production in Jammu and Kashmir and also suggest an ideal or possible rate of premium, "We can also con- sider involving central insurance companies for a period of two years. The state will write to the Centre to extend the deadline of the scheme," he said. DDC orders action against 62 unauthorized absent employees Excelsior Correspondent SRINAGAR, Sept 5: District Development Commissioner (DDC) Kupwara Khalid Jahangir today ordered action against 62 Government employees, who were found unauthorized absent. On the instructions of Khalid Jahangir, DDC Kupwara, a team headed by Assistant Commissioner (Rev) Kupwara conducted a surprise inspection of the various Government offices in Kupwara. The offices inspected include CEO's Office Kupwara, ACD's Office Kupwara, BDO's Office Kupwara, Municipal Committee Kupwara, REW's Office Kupwara PHE Division Kupwara and Irrigation Division Kupwara. During the inspection, 62 employees were found unautho- rizedly absent from their offices. Amidst beating of drums and singing of Bhajans in praise of Lord Ganesha, these Shobha Yatras were taken out from differ- ent parts of the Jammu region and passed through adjoining areas before immersion of Lord Ganesha idols with proper rituals. Elaborate arrangements were made by local administration for smooth Ganesh Visarjan Yatras. Special prayers were held by peo- ple on the occasion. An impressive Shobha Yatra was taken out by the devotees of Luxmi Narayan Temple at Dhakki Sarajan today to bid adieu to Lord Ganesha (Bappa), who was installed in the temple since Ganesh Chaturthi. BJP State vice president Yudhvir Sethi was espe- cially invited by Jammu Swarankar Association and Maratha Swarankar Association, who had made elaborate arrange- ments for the Shobha Yatra before Ganesh Visarjan in river Tawi. JKJCCI delegation raises LoC trade issues with Governor Excelsior Correspondent SRINAGAR, Sept 5: A delega- tion of Jammu and Kashmir Joint Chamber of Commerce and Industries (JKJCCI), led by its Joint President Rakesh Gupta, called on Governor N.N Vohra at the Raj Bhavan here today. The delegation appealed for Governor's urgent intervention in restoring trade on the Poonch- Rawalakot route which has remained suspended for the past over 8 weeks, leading to large loss- es to the traders. For making this trade more transparent and accountable the del- egation suggested steps being taken for the vacation of stay on Government's order of 31-05-2017 which prescribed measures to streamline the trade; revisiting the application of GST on LoC trade so that LoC trade is taxed at a minimal percentage which too can be reim- bursed on the same pattern as applies to the incentives being given for the promotion of industry in J&K; in the light of the recent NIA raids, corrective measures need to be taken to ensure that there is no nexus between the various agencies and the unethical traders at the LoC points; to ensure against emergence of vested interests no officer of any agency posted at the LoC Trade Facilitation Centre should continue for more than 6 months at a stretch. The delegation said that a dedicated authority for management of LoC trade should be established to streamline and enhance the trade; setting up a hassle free single win- dow system for the trade; e-com- merce and digitization of LoC trade so that real time monitoring and evaluation of this barter trade can be done; enhancement of security infrastructure including installation of CCTV cameras, full body truck scanners, X-ray machines etc and banking facility be put in place instead of the present barter system with the currency medium to be decided mutually by both countries. Karra ridicules Jagmohan’s demand on Art 35-A SWD Secy has poor understanding of JJ Act: DB Excelsior Correspondent SRINAGAR, Sept 5: High Court today came down heavily on Commissioner Secretary Social Welfare Department and observed that he has poor understanding of Juvenile Justice Act and its Rules. After perusal of the status report of Commissioner Secretary SWD, High Court returned the same and said the same is inadequate and does not address the issues and concerns in terms of Juvenile Justice (Protection and Care of Children) Act and its Rules. High Court on last date also had said the affidavit filed does not specify the requirements envisaged in Juvenile Justice Act for orphanages and directed for filing of fresh affidavit indi- cating there-in the plan of action to meet all deficiencies. Today when the fresh affi- davit was placed before the Division Bench of Chief Justice Badar Durrez Ahmad and Justice Ali Mohammad, the same was out-rightly rejected and returned. The DB granted final two weeks for overcoming the deficiencies. DB said that once the Act has been in place and the Rules made thereunder, then Government cannot take excuse of non-availability of funds. Even on last date of hearing Commissioner Secretary (SWD) was taken to task by the court for his failure to appear before it. Court had directed the Commissioner Secretary to file his affidavit by next date indi- cating there-in the action of plan to meet the deficiencies in Orphanage homes across the State. After hearing CPO Ashish Rathore with Senior PO M A Almansoor and PO Arvind Manhas for the Police whereas Advocate Rajesh Gupta for the doctor, CJM observed, "it is true that bail is rule but jail is excep- tion. However, present case falls within the exception because the profession of doctors is a very sacred one". "If the doctors themselves indulge in such type of crimes the faith of the general public particularly the women folk shall be shaken. There is no rea- son to implicate the accused by the prosecutrix in false case", the court further said while rejecting the bail application. Meanwhile, City Judge Jammu extended the police remand of Dr Bodh Raj Kundal till September 9. JAMMU, Sept 5: ChiefJudicial Magistrate JammuAshwani Sharma today rejectedthe bail application of Dr BodhRaj Kundal, Head of NeurologyDepartment of GovernmentMedical College Jammu, who isaccused of molesting a patient.

After hearing CPO AshishRathore with Senior PO M AAlmansoor and PO ArvindManhas for the Police whereasAdvocate Rajesh Gupta for thedoctor, CJM observed, "it is truethat bail is rule but jail is excep-tion. However, present case fallswithin the exception because theprofession of doctors is a verysacred one".

"If the doctors themselvesindulge in such type of crimesthe faith of the general publicparticularly the women folkshall be shaken. There is no rea-son to implicate the accused by

the prosecutrix in false case",the court further said whilerejecting the bail application.

Meanwhile, City JudgeJammu extended the policeremand of Dr Bodh Raj Kundaltill September 9.
