The licence sets out the terms and conditions of use

The licence is designed to protect the publishers intellectual property while allowing you to fully use the material for educational purposes

It is a legal contract between you and the content provider:

– the content provider is bound to deliver the content and allow you the uses as agreed

– the content provider warrants that it owns the content it is making available to you

– that you are bound to observe and implement the terms and conditions of use

Definitions of importance

‘Authorised User’: This means that the content can be made available (by IP range or Shibboleth) to pupils and members of staff of the schoolsIt must not be made available to anyone else – to do so is a serious breach of the licence

Extracts or images taken from the resource may be shared with other ‘Authorised Users’ but not with anyone else

‘Educational purposes’ – means that you are allowed to use the content for just that – any commercial exploitation is prohibitedThat means for example:a teacher cannot include extract in learning materials that they then sell.an image or extract cannot be reproduced on a item that a school might sell

Terms and Conditions – what they mean

Authorised users (pupils and staff) may:

View

Make temporary local cache, display and download parts

Access electronically by secure authentication (in the school or at home)

Take extracts ‘cut and paste’ - provided the source is acknowledged

Incorporate extracts in learning materials – share those learning materials with other Authorised Users

Print copies

Authorised users (pupils and staff) may not:

Exploit the resource in any way for commercial gain

Take extracts with making acknowledgements

Modify

Make any part available on the open web

Make the resource available to anyone who is not an Authorised User

that’s to say issue passwords or share passwords with anyone who is not an Authorised User

What the licensee must do

Ensure that the ‘Authorised Users’ know what they can and cannot do

Ensure only ‘Authorised Users’ access the online resource

Notify the content provider if there is a breach of the licence

Issue passwords to ‘Authorised Users’

Provide valid IP addresses

Pay the annual subscription fees as set out for the term of the agreement – if payment is not made, this is a breach of the licence and access will be terminated

A word about term and termination

With the exception of The Guardian Archive all the licence agreements have a fixed term

For most of the agreements this is three years – you can join an agreement at any time during those three years

You have an opportunity to ‘opt-out’ and the end of year 1of the agreement : 31st July 2009

If you do not ‘opt-out’ then you are ‘locked in’ – that means you will be invoiced for and must pay the annual subscription fee for the term of the agreement

A word about The Guardian Archive

This licence agreement will be different

There is no ‘fixed term’

If you participate in this agreement you have a licence ‘in perpetuity’

The fee you pay – buys you rights to the content permanently – so it is a very good deal

However, you will need to pay the publisher a small annual fee for the use of its server ‘the access fee’

This annual fee is not for the content (you’ve bought it) – it is a utility charge for the service of data hosting and delivery

Why are not all licences perpetual

Online resources such as those provided by Keesings, ProQuest or Oxford University Press are continually updated

You subscription fee gives you access to the most up-to-date version – in some cases there are updates on a daily basis

In other cases – Education Image Gallery, The Times Digital Archive, the content is so valuable that the content owner will not sell perpetual licences – their business model is to ‘lease’ the content only

The Guardian Archive is by its nature not updated – the publishers model is not to ‘lease’ but to ‘sell’

How do I accept the terms and conditions of the licence agreement

On the JISC Collections for Schools website you will find a licence agreement for each of the online resources on offer

Please read the licence agreement and download a copy for your records

On the website you will find a ‘Licence Acceptance Form’

Please complete the form and send two signed copies to the address indicated and retain one copy for your records

When the ‘Licence Acceptance Form’ is received it will be verified. The schools covered by the licence agreement will be given access

The licensee will be invoiced for the first year of the agreement - and if they do not ‘opt-out’ the will be invoiced on the anniversary of the licence agreement for the term
