PARLIAMENT OF INDIA RAJYA SABHA SECRETARIAT DEPARTMENT-RELATED PARLIAMENTARY STANDING COMMITTEE ON SCIENCE & TECHNOLOGY, ENVIRONMENT & FORESTS SUGGESTIONS/VIEWS ON ``THE BIOTECHNOLOGY REGULATORY AUTHORITY OF INDIA BILL, 2013’’ **** ``The Biotechnology Regulatory Authority of India Bill, 2013’’ as introduced and pending in Lok Sabha has been referred to the Department-related Parliamentary Standing Committee on Science & Technology, Environment & Forests, headed by Dr.T. Subbarami Reddy, M.P., Rajya Sabha for examination and report. 2. Modern biotechnology is recognised globally as a rapidly advancing science wherein advanced molecular techniques and processes are employed to develop useful products, processes and services in areas of agriculture, human and animal, healthcare, environment management and industry. Biotechnology industry in India has been growing at an average annual rate of twenty to thirty per cent during the last five years and its turnover exceeded Rs. 20,440.00 crores approximately. There are, however, public concerns in respect of organisms and products derived from modern biotechnology on human, animal and environmental safety. Various coun- tries have developed regulatory mechanisms to ensure safe and responsible use of biotechnology organisms are products. But in India, activities and processes involv- ing the genetically engineered organisms and product thereof, are broadly regulat- ed under the `Rules for Manufacture, Use/Import/Export and Storage of hazardous Micro organisms / Genetically Engineered organisms or cells 1989’ notified under the Environment (Protection) Act, 1986 and the guidelines published by the Department of Biotechnology. But despite the aforesaid rules and guidelines, India has experienced a number of challenges. A Task Force on the Application of Agriculture Biotechnology constituted by the Ministry of Agriculture in 2003 recom- mended establishment of an autonomous, statutory and professionally-led National Biotechnology Regulatory Authority which was supported by the other Task Force on recombinant pharma constituted by Ministry of Environment & Forests in 2004. 3. In pursuance of the recommendations of the above Task Foreces, this Bill aims inter-alia at establishing an independent statutory regulator to be known as the Biotechnology Regulatory Authority of India, to regulate research, transport, import, manufacturer and use of organisms and products of modern biotechnology to pro- mote the safe use of modern biotechnology by enhancing the effectiveness and effi- ciency of robust regulatory procedures. 4. The Committee has decided to invite Memoranda containing views/suggestions from individuals/organisations interested in the subject matter of the bill. 5. Those desirous of submitting Memoranda to the Committee may send their writ- ten Memoranda either in English or Hindi to Shri Alok Chatterjee, Director, Rajya Sabha Secretariat, Room No. 005, Ground Floor, Parliament House Annexe, New Delhi-110 001. Those who are willing to appear before the Committee for oral evidence besides submitting the Memoranda may indicate so. However, the Committee’s decision in this regard shall be final. The Memoranda submitted to the Committee would from part of the records of the Committee and would be treated as confiden- tial and would enjoy privileges of the Committee. The Committee will have full right on Memoranda received. It may or may not use those Memoranda while preparing the report. 6. A PIL was on Monday filed intheCalcuttaHighCourt seek-ing intervention in the probeinto the alleged rape andkilling of a college student inBarasat on June 6.

The petition urged thecourt tosetupaSpecial Inves-tigation Team (SIT) to probethe case under the monitoringof the High Court. The casewill come up for hearing onTuesday.

On June 6, the college stu-dent was allegedly raped and

murderedbylocalyouthswhileshe was returning home. Aftertheincident,WestBengalFoodMinister Jyotipriya Mallickwenttothevillagebutprotestinglocals forced him to leave. Theresidents continued their agi-tation for a few days demand-ingpunishmentoftheculprits.

The state government,meanwhile, has handed overtheprobeto theCID.ThePILsought an order to stop theCID investigation.

Meanwhile, residents ofKamdunivillagehit thestreetson Monday to protest againstthe alleged rape-murder.

In fact, Sarita, prior to be-ing Basant’s girlfriend, was hiswife.BothofthemarefromthesameclanintheJatcommunityfromGarorvillageinSonepat.They had eloped and got mar-ried on February 3 at an AryaSamajtemple inAmbala.

But soon the couple’sfamilies found them andbrought them back to village.The panchayat reprimandedthem for marrying from thesame clan. They nullified themarriage, called for the cou-ple’s separation and for-malised it throughadivorce ina Sonepat court.

In the time between theirmarriageanddivorce, thecou-ple had sought police protec-tion fearing threat to theirlives fromtheir families.Saritahad even sent a letter toKharkhodapolicestationstat-ing that they married eachotherof theirownvolitionandneed police protection. Butthe police never acted on it.

After the divorce, Sarita’smaternal uncle fixed her mar-riage with Sandeep ofDeepalpur village, Sonepat.Her second marriage infuri-ated Basant. Sarita’s phonerecordsreveal that shemadealast call to Basant three daysbefore her marriage on April15. She told him her uncle wasforcibly getting her married.

SHO Sonepat SultanSingh said Sarita could notcontact Basant after marriageas she did not have a phone.“She became the conspiratorin the murder of Sandeep andhismotherRoshniDevias shehad already informed Basantabout her marriage,” he said.

Singh said Sarita’s father,Rohtash, did not attend thewedding.“Heruncleallegedlydeceived Sandeep’s familyclaiming he had raised Saritasince she was two,” he said.

Basant’s father, Rajbir,confirmed that the panchayathad ordered their separation.“Theycommittedamistakeofgetting married violating clannorms. Both should have be-havedlikeabrotherandsister.The crimes they committedweretheirownact,”hesaid.

Rohtash said he never ac-knowledged both her mar-riages. “For me she died theday she eloped with Basant.The panchayat and our com-munity had already orderedoursocialboycott,”hesaid.

THE Juhu police Mon-day evening arrestedSooraj Pancholi, son

of actors Aditya Pancholi andZarina Wahab, for allegedlyabetting the suicide of actorJiahKhan.Thearrestcameaf-ter her mother, Rabiya Amin,submitted a six-page letter,purportedly written by Jiah,detailing the “difficult rela-tionship” between Jiah andSooraj.

Jiah, 25, hanged herselffrom a ceiling fan at her Juhuapartment on June 3. The lastconversation Jiah had waswith Sooraj at 10.53 pm thatday. Juhu police had recordedSooraj’s statement on June 4.

Rabiya said the familyfound the letter in Jiah’s wal-let in her room two days aftershe died. The letter states thatJiah was beaten up and forcedto abort.

“The arrest is based onRabiya’s complaint and herstatement,” said CherringDorje, DCP (Zone 9). Headded that the letter would betreated as evidence, thoughthere was no mention of the

name‘Sooraj’ anywhere in theletter.

The police initially de-tained Sooraj for over 90minutes and questioned himover the contents of the let-ter. “He has admitted to theabortion and confessed thathe hurt her physically. We ar-rested him after question-ing,” said an officer.

Sooraj said he had beenavoiding Jiah for over twomonths, but could not after apoint as she was very emo-tional, an officer said.

Rabiya on Monday toldthe police that Sooraj hadphysically and mentally tor-

tured Jiah. She said AdityaPancholi was against the af-fair, as Jiah was older thanSooraj.

“When Jiah came to Lon-don for her birthday a fewmonths ago, she had bruiseson her face. I asked her aboutit and she told me she was inlove with Sooraj. I called hersisters to the room and shebroke down,” said Rabiya.“Sheoncetoldme: ‘Heabusesme, hits me, doesn’t respectme and embarrasses me infront of his friends’. I askedher to walk out of the abusiverelationship and stop talkingto him,” she added.

Rabiya rubbished reportsthat Jiah was depressed. “Shehad no work-related prob-lems and was happy. She hadasked me to attend a film fes-tival with her when she cameto London. She had signed anEnglish film recently,” Ra-biya said.

Meanwhile, the police areawaiting the handwritinganalysis report of the letter toascertain whether its authorwas Jiah. “We will presentSooraj before court on Tues-day,”saidArunBhagat, seniorinspector.
