1. JACKClevelandCasinowillofferaBadBeatPromotionforallTexasHold’emgamesandwillconsistofa

primarytier,asecondarytierandatertiarytier.• Theprimarytierwillincrementdailyat$200,thesecondarytierat$200andthetertiarytierat

$100.• Whentheprimarytieriswon,itwillresetwiththesecondarytier,thesecondarytierwillreset

withthetertiarytierandthetertiarytierwillresetat$15,000.• Eachtieramountwillbepostedinthepokerroombyapproximately5:00pmdaily.• Whenthebadbeatiswon,thepostedamountswillbeadjustedimmediately.

2. Thispromotionwillbefundedfromthepokerpromotionalfundaccount.Ifdepleted,JACKClevelandCasinoMarketingDepartmentwillprovidethefundsneededwithoutrecoursetothepokerpromotionalfundaccount.

3. Theminimumqualifierwillbe“QuadDeuces”(2-2-2-2)orbetterbeaten.4. AllliveactionTexasHold’emgamesthatcontributetothepokerpromotionfundaccountareeligible.5. Thebadbeatwillbepaidoutinthefollowingmanner:

• 40%oftheprimarytierwillbeawardedtotheplayerwiththesecond-highestrankedhand,20%totheplayerwiththehighestrankedhandandtheremaining40%willbesplitevenlyamongsttheremainingeligibleplayers.

• Iftwoeligibleplayersremain,theremaining40%willbesplitevenlyamongstthem.6. Thebadbeatwillbeverifiedinthefollowingmanner:

• Thedealerwillnotifythepokersupervisorandthegamewillpauseforverificationpurposes.• Thesupervisorwillverifythequalifyinghandsandnotifysurveillance.• Thedealerwillsetupthedeckandverifyitbyspreadingallcardsface-uponthetablewiththe

communityboardcardsandthecardsofbothqualifyinghandsseparately.• Thegamewillcommenceoncesurveillancehasverifiedthebadbeat.

7. Onlythoseplayerswhoweredealtahandatthetablewherethebadbeatwaswonareeligible.8. Allhandsmustbeplayedtotheshowdownandallcardsmustbeturnedface-uponthetable.9. Thetwoplayersholdingthehighestandsecond-highestrankedqualifyinghandsmustusetwocards

withexactlythreecommunityboardcards.10. Toqualifyfor“Quads”theplayermusthavebeendealtanypair.11. Ifmultiplebadbeatsarewonatthesametime,surveillancewillbenotifiedtodeterminewhichone

wasdealtfirstbywhichtablehaddealtthefirstcard.Theprimarytierwillbeawardedtothebadbeatthatwasdealtfirstandthesecondarytierwillbeawardedtothebadbeatthatwasdealtsecond.

12. Inadditiontothebadbeat,playersareeligibleforanyhighhandpromotion.13. Allpayoutswillberoundeduptothenearestwholedollarandwillbepaidoutofthepokerroomcage.14. Aminimumnumberof2playersarerequiredwithaminimumof$10inthepottoqualify,which

includesthehouseandpokerpromotionalrake.

15. Adeadhand,fouleddeck,switchedcards,orunverifiablehandmaynullifythehighhand.• Afouleddeckisdefinedasadeckthatisfoundtohaveotherthanthepropercardsornumber

ofcards.• Averifiablehandisdefinedaswhenbothholecardsareturnedface-uponthetable.Ifatany

timetheplayer’scardsleavethetable,thehandisunverifiable.16. Anybadetiquette,excessivecomments(tabletalk)orsuspectplaywillnotbetoleratedandmay

nullifythebadbeat.17. Mustbe21yearsorolderwithvalidphotoidentification(driver’slicense,military,passportorstate)to

receiveprize.IfnotaU.S.citizen,avalidpassportorresidentaliencardisrequired.Voidiflessthan21yearsofage.

18. Winnermustprovidevalidphotoidentificationtoclaimapokerpromotionalaward.Accountingwillbenotifiedofeachunclaimedaward,whichwillinclude:winner’sname,address,loyaltycardnumber,date,dollaramountofaward,applicabletaxwithholdingsandtaxidentificationnumberifavailable.

19. Anyunclaimedawardwillbeheldinsafekeepingforaminimumof180daysfromthedateoftheaward.Anyunclaimedawardheldinsafekeepingformorethanthedesignated180dayperiod,willbeprocessedannuallybytheFinanceteamforremittancetothestateinaccordancewithChapter169oftheRevisedCode.

20. Aplayerwhoisbannedorexcludedbythestatewillhavetheirawardremittedtothestateandthenescortedoffpremises.AplayerwhoisbannedorexcludedbyJACKClevelandCasinowillreceivetheirawardandthenescortedoffpremises.Forbothinstances,anOCCCagentandSecuritywillbenotified.

21. MustprovideaClubJACKCard,whichareavailableforfreeatClubJACK.22. Prizesarenon-transferableandthewinnerisresponsibleforallapplicablefeesandtaxes.23. AlldecisionsregardingtheinterpretationofeligibilityrulesforthispromotionliewithJACKCleveland

CasinotooperatethepromotionwithintheapprovedrulesfromtheOhioCasinoControlCommission.24. Managementreservestherighttorefuseservicebasedonaplayer’sbehavior,dress,orhygiene

withoutexplanation,obligation,orshowcause.25. Managementmaycancelormodifythispromotionatanytime,foranyreason,uponapprovalfromthe

OhioCasinoControlCommission.Anymodificationshallnotalterorchangeanypreviousaward.Allchangesandmodificationswillbepostedinthepokerroom.

26. Theaccountingdepartmentwillkeepacompleterecordoftherulesandallamendmentstotherules,includingcriteriaforwinning,namesofplayer’s,prizesawardedandprizewinnersforatleasttwoyearsandshallbemadereadilyavailabletotheOhioCasinoControlCommissionuponrequest.

27. JACKClevelandCasinoandallitsaffiliatedandsubsidiarycompaniesarenotliableforinjuriesorlossesarisingorresultingfromparticipationinthepromotionandarenotliableforanyactsoromissionsbyemployees,whethernegligentorwillfulintheconductofthepromotion.

28. Byparticipatingplayersagreetofollowtheserules.Refusaltodosomayresultindisqualification.29. Afullsetofhouseandpromotionalrulesareavailabletoplayersuponrequest.
