As you are aware, Xxxxxx’s mother sent you a letter last week. To indicate that the contents of this letter have been acknowledged and approved by Xxxxxx (the mother) as well, she has signed her name at the bottom as well. After reading the document, “the unlawful practice of social work in Ontario by CAS workers providing services to the public under false pretence” it would appear to both Xxxxxxx and myself that CAS child protection worker, Ms. Xxxxxxxxxx is breaking the law by engaging in the practice of social work without being properly qualified and registered by the Ontario College of Social Work and Social Service Workers. Xxxxxxx (mother), gave birth to our first child last Sunday. Shortly prior to the birth of our baby and now after the birth, CAS worker, Ms. Xxxxxxxxxx has threatened us and led us to believe that if we do not do as she tells us to do, then she will apprehend our new child and/or apprehend Xxxxxxx’s siblings from the maternal grandmother. Xxxxxxx and I have felt so threatened by CAS worker Ms. Xxxxxxxxxx that Xxxxxxx moved into a shelter for new mothers, Xxxxxx House, out of fear that your CAS child protection worker, Ms. Xxxxxxxxxx would apprehend our child if she did not move into Xxxxxx House as ordered by Ms. Xxxxxxxxxx. Xxxxxxx has now been forcefully separated from her family and those her love her the most and is now forced to attend courses for new mothers that she does not need because she has all kinds of family and community support already. To make matters worse, the staff at Xxxxxx House have advised Xxxxxxx (mother) that she is not permitted to leave the premises under the threat that her baby will be taken from her. Xxxxxxx has

been advised that CAS workers have told staff at Xxxxxx House that they must detain Xxxxxxx inside of their facilities. This is a violation of Xxxxxxx’s rights under section 7 and 9 of the Canadian Charter of Rights and Freedoms and a violation to the Criminal Code of Canada. Below is an excerpt from the Canadian Government Website:

In Canada, it is a criminal offence to unjustly hold anyone against their will through the use of threats, duress, force or the exhibition of force. This offence is called "forcible confinement" and is formally defined by the Criminal Code of Canada as depriving an individual of the liberty to move from one point to another by unlawfully confining, imprisoning or forcibly seizing that person.

In addition, CAS child protection worker, Ms. Xxxxxxxxxx coerced Xxxxxxx (the mother) to sign a document giving her access to confidential information. Again, this was signed out of fear. As a new father, I have now been separated from my own child and told that I must be supervised because the shelter has a policy that males are excluded and/or must be supervised. This is degrading and outright discrimination. I am being denied to see my own child because of some CAS child protection worker who thinks that she has the god given authority to tell people how to run their lives and raise their children!

Even though we have specifically requested this information, CAS worker Ms. Xxxxxxxxxx has not provided us with any information or documentation to validate her threats to apprehend our baby. In a meeting with her before the baby was born, we requested that she provide us with any of the required risk assessment or safety assessment forms that she as a CAS worker is required to fill out in accordance to Standards from the Ministry of Children and Youth Services. To date she has not provided anything to us in writing. She has been vague in providing answers and has provided nothing in writing to us. She has provided no real solutions to what appear to be her speculative personal concerns and certainly she does not put things in writing. In our opinion, her way of dealing with our family has been so unprofessional. We have no faith in your child protection workers, Ms. Xxxxxxxxxx and believe that she is abusing her power as a CAS worker. We also believe that she is breaking the law by engaging in the practice of social work in violation to the Social Work and Social Work Act (1998). We find it unacceptable that employees of the CAS who are not even qualified social workers are going around and wrecking families and are not being held accountable to any independent body such as the College of Social Work as is required under the law. While we wish to cooperate with the Society in dealing with any legitimate concerns that qualified workers may have, we don’t feel that we should have to deal with CAS workers who use threats and intimidation and who are not operating within the law.

We are therefore demanding at this time that the Children’s Aid Society of Xxxxxxxxx advise the CAS child protection worker, Ms. Xxxxxxxxxx, to stop harassing our family or contacting us any further and that the Society assign a duly qualified and registered social worker to our case. We want to deal with someone who is properly qualified and feel that we have this right. We are asking to have copies of any risk assessment or safety assessment immediately made available for us to pick up from your offices which to date, your child protection worker, Ms. Xxxxxxxxxx has refused to provide us. We would ask that any worker who is involved with our family affairs from this point forward, hold the qualifications of a social work and be registered and regulated by the College of Social Workers and Social Service Workers as is required under current law in Ontario.

If your agency’s unregistered and unregulated CAS child protection worker, Ms. Xxxxxxxxxx, continues to harass us or other members of our family, we will be filing a formal complaint against Ms. Xxxxxxxxxx and the Society with the Ontario College of Social Workers and Social Services Workers. We will also take whatever legal action to stop unregistered and unregulated workers from your Society from harassing and threatening us any further. Your response in writing would be greatly appreciated.
