Chairman's remarks and related question s

President Strangway noted that the report of the Task Force o n

Continuing Education had been distributed to Deans, Department Heads an d

Members of Senate and that he looked forward to receiving comments on the

recommendations contained in the report .

President Strangway drew Senate's attention to the task force bein g

formed by Vice-President Gellatly to develop a policy for recycling issue s

on campus for consideration by the Board of Governors .

President Strangway referred to significant changes that had been mad e

at the UBC Press and assured Senate that the Press was not closing down .

Dr . Elder asked if the Senate Budget Committee would be reporting on th e

advice it is giving the President on the UBC Press .

The President responded that he would be pleased to have tha t

information included in the Budget Committee Report which would probably be

available in the spring .

Candidates for Degree s

Lists of candidates for degrees, as approved by the various Facultie s

and Schools, were made available for inspection by Senate members prior t o

the meeting .

In presenting the list of awards, Dr . Cook, Chairman of the Committee ,

drew attention to the National Scholarships which will provide up to te n

awards of $6,500 each to outstanding students entering UBC from hig h

schools throughout Canada .

Conditions of acceptance of Student Award s

The following report had been circulated :

"(a) Conditions of Acceptance of Student Award s

Over the years, a succession of Senate Committees on Studen tAwards have grappled with the terms of awards which include no nacademic restrictions . On many occasions, Senate has referre dawards back to the Committee for further consideration .

Background

In 1979, the Ad Hoc Committee on Awards and Scholarship srecommended that Senate accept the following :

"Donors of university awards are strongly encouraged to provid efunds on an unrestricted basis to enable the university t omaintain flexibility in respect to changes in programs and othe rcircumstances. While not encouraging such awards, the universit ywill accept affirmative action awards which support students i ncertain programs, of a particular sex, or of a particular minorit ygroup . These awards shall be subject to the regulations of th eHuman Rights Act of British Columbia ."

Background (continued )

In 1980, Senate adopted the following statement . This statemen tcurrently appears in awards publications and materials directedtoward donors, and serves as the guideline for the Awards Offic estaff :

"The University prefers to administer awards that are mad eavailable without restrictions deemed to be discriminatory . I twill administer awards that define, in terms acceptable to Senate,the eligibility of students to receive the award . Senate maydecline awards containing criteria that it deems to be contrary t othe interests of the University as an academic institution . "

The Committee believes that a stronger statement is necessary . InSeptember the following statement was circulated to Deans an dothers for comment .

Awards should be free of criteria based on persona lcharacteristics such as race, ancestry, place of origin, colour ,ethnic origin, sex, creed, age, marital status, family status ,sexual orientation or handicap . Notwithstanding the above, th eUniversity may from time to time establish awards which ar especifically intended to improve participation of certain group sof students .

The Committee reviewed the comments received and modified th eoriginal proposal, incorporating terminology consistent wit hcurrent federal and provincial legislation .

Recommendation

The Committee unanimously recommends that the following statemen tbe adopted by Senate :

Awards should be free of criteria based on persona lcharacteristics such as race, national or ethnic origin, colour ,religion, political belief, sex, family or marital status, sexua lorientation, age, or mental or physical disability . This does notpreclude the University from establishing awards designed t oincrease the participation of disadvantaged individuals or group sincluding those who are disadvantaged on the grounds mentione dabove . "

Definition of Scholarship Standin g

Many of the entrance scholarships which we now offer are eithe rrenewable or come with some form of guarantee of support so lon gas the student's academic record is satisfactory . Although theSenate has approved a minimum average of 75% for scholarships, our

requirements for renewals or guarantees are higher . Several ofthe awards refer to scholarship standing, however, we have neve rspecifically defined the term .

Recommendation

The Committee recommends that the following statement, whic hconfirms the current practice, be included in the Calendar .

Scholarship standing - Where scholarships are renewable orinclude a guarantee of continuing support subject to the studen tmaintaining scholarship standing, this shall be interpreted a smeaning that a student must successfully complete at least 90% o fa full program of study with an overall average of at least 80% ,or standing in the top 10% of his/her year and faculty .

(c) Wesbrook Scholars - for the information of Senat e

When Senate approved the creation of the Wesbrook Scholars lastJanuary, there was some discussion about excluding students in th eFaculty of Graduate Studies, while including students i nprofessional programs . Following the announcement of the firs twinners, the Committee surveyed the Deans to ensure that th eapproved terms were appropriate . The response was overwhelminglyin support of the approved terms and consequently graduat estudents will not be considered as candidates for the Wesbroo kScholar designation.

During the course of the survey of Deans, the reference containe din the terms of the Sherwood Lett Memorial Scholarship and other sto "students in professional programs" was questioned . Th eCommittee agreed that this term was misleading and has amended thedescriptions of the relevant awards to delete the reference t oprofessional programs and replace the reference with terminolog ywhich indicates that the awards are open to students i nbaccalaureate programs and the Faculties of Law, Medicine an dDentistry . "

Dean Lusztig stated that he had gone through the awards currently liste d

in the Awards and Financial Aid Calendar and found none to b e

discriminatory in an offensive way . He suggested that if the curren t

statement which reads The University prefers to administer awards . . . "

could be changed to "The University only administers awards . . ." this would

address any problem that arises . He did not feel it was productive t o

issue a statement which goes against affirmative action and against th e

support of disadvantaged students .

Dr . Hickling pointed out that the provisions of the recommendation wer e

based on the assumption that the University ought not to appear to len d

support either directly or indirectly to sentiments, however well meant ,

that flow contrary to the Canadian Charter of Rights and Freedoms or th e

provincial Human Rights Act . He stated that the choice of specifi c

grounds of discrimination included in the first sentence of th e

recommendation are drawn directly from the Canadian Charter of Rights and

Freedoms and the provincial Human Rights Act . The second sentence affirm s

the legitimacy of affirmative action programs .

Some members of Senate found the wording of the statement confusing . I t

was suggested that the personal characteristics listed were so broadl y

based that when linked with the affirmative action statement it appeare d

to indicate that everyone was disadvantaged .

Dr . Birch responded to Dean Lusztig's question as to whether the proble m

could be solved by amending the existing statement . He stated tha t

affirmative action is discriminatory, although positively so, and th e

intent of the proposed statement is to say the University will consider

accepting awards, the terms of which are discriminatory if that had a

positive intent . Therefore Dean Lusztig's suggestion does not go fa r

enough if the intention is to permit or encourage affirmative action .

In response to a question, Dr . Cook stated that if Senate wished to

refer the recommendation back to the Committee, the Committee would see k

advice as to how disadvantaged groups might be identified and what kind o f

a routine review of those so listed would take place .

With the permission of Senate, Mr . Byron Render, Director of Awards an d

Financial Aid, responded to queries concerning the administration of th e

awards and the receipt of donor money in terms of the difference it woul d

make to donors giving their money under the new policy as opposed to th e

existing policy . Mr . Render explained that one of the implici t

assumptions in the recommendation is that the University should be

developing awards which provide a greater degree of flexibility than i t

currently has, and that the University should provide opportunities fo r

academic restrictions rather than personal ones . He stated that ther e

were a number of awards which, at the time they were established, wer e

clearly intended to support disadvantaged groups such as women in Law, an d

although last year there were more women than men in First Year Law, i n

the Law profession itself women may still be under-represented . The

problem is at what point does the University appear to be discriminatin g

against this group . If the program were effective over time the

conditions would be equalized and the Committee did not want to have to g o

back to donors to request a change in the terms of the award .

Mr . Hender thought that most donors understood the principles, and th e

Committee felt that the proposed policy would not be a major barrier t o

new donations . The Committee was trying to focus on the needs of the

University rather than the wishes of the donor, and to develop long ter m

strategies in order to respond to needs over time .

It was suggested that, given the fact that over time the definitions o f

which groups are disadvantaged tend to change, it should be stipulate d

that all donations made for scholarships have all their conditions remove d

after a designated period of time .

Dr . Birch agreed that this would be a useful provision in the writing o f

bequests and granting of gifts . He pointed out, however, that the

University frequently receives bequests after the donor has died and th e

University would therefore have to seek a variance of the trust before i t

could accept the bequest .

After further discussion, the motion was put and lost .

In response to a query, Mr . Hender explained that the current practic e

was to make evaluations on a degree program basis, for example, students in

Fine Arts are ranked in the top 10% of students in Third or Fourth Yea r

Fine Arts and Family and Nutritional Sciences is based on its own unit, s o

the degree code is used rather than the Faculty itself . It was agreed

that the words " . . .and degree programs" be added in order to clarify th e

procedure .

Dean Webber pointed out that the definition of scholarship standin g

could pose a potential problem for medical students in that more than 50 %

of students entering the M .D . program have first class standing fro m

another Faculty, many of whom have scholarships which are contingent o n

their maintaining academic standing . Clearly a significant number o f

those students would not be in the top 10% of their program .

Mr . Sender stated that the Committee had not considered that there migh t

be renewable awards in the Faculty of Medicine and suggested that thi s

matter be looked into by the Committee .

Some members were of the opinion that the proposed statemen t

discriminated against part-time students and against those student s

enrolled in 18 unit programs who take 15 units in the winter and 3 unit s

in the spring .

Dean Meisen objected to the 80% figure on the grounds that in som e

programs such as the Canada Scholars Program, once a student falls belo w

scholarship level the student cannot re-enter . He felt that a significant

number of students awarded those scholarships would be disadvantaged ,

particularly students from smaller communities where the environment i s

not as competitive as in some of the larger communities . He stated that

often in First Year Engineering the marks of these students dro p

substantially but in subsequent years the marks rise again . In hi s

opinion, a figure of 75% would be more reasonable .

Objections to the amendment were raised on the grounds that these majo r

entrance scholarships are given to first class students and if thes e

students were not first class they ought not to have their scholarship s

renewed .

In response to a query it was confirmed that the statement referred t o

all renewable scholarships, not just the major entrance scholarships .

After further discussion, the amendment was put and lost .

The motion was then put and carried .

(c) Wesbrook Scholar s

Dean Webber stated that since there were multitudinous programs in th e

Faculty of Medicine, it would be preferable to specify the LL .B . the M .D .

and the D .D .S . program . Dr . Birch suggested that since it was intende d

that only the baccalaureate program in the Faculty of Law be included i t

was unnecessary to mention the Faculty of Law .

Dean Suedfeld argued that the decision that students in the Faculty of

Graduate Studies not be eligible for the Wesbrook Scholar designation was

discriminatory and ought to be reconsidered .

Planning and Development requesting participation in a campus plan project .

Upon looking at the plan circulated, it appeared that buildings were no t

where they should be . Dr . Elder also noted that the Frank Buck Memoria l

Heritage Garden, founded in 1930 and one of the historic parts of th e

University, had been designated as the site for a new building . Dr . Elder

quoted the terms of reference of the Senate Academic Building Need s

Committee and suggested that this matter be referred to that Committee fo r

comment .

Jessie Aske Eades Prize in Nursing - A $200 prize is the gift of Mrs . J . E .Eades and was first made available in 1989, sixty years following he rgraduation from UBC . It is awarded on the recommendation of the School o fNursing to a student in the graduating class who entered the University as abasic student and obtains the highest standing for the degree of B .S .N .(Available 1990/91 Winter Session) .

Faculty Women's Club Ida Green Scholarship - A $2,000 scholarship has bee nestablished by the Faculty Women's Club in memory of Dr . Ida Mabelle Green ,LL .D . Ida Greene was a pioneer in the American Association of Universit yWomen and in the provision of graduate fellowships for women . With herhusband Cecil H . Green, Dr . Green was a major benefactor of post-secondar yeducation and the advancement of science . The award is made on th erecommendation of the Division of Health Services Planning andAdministration to a graduating student for the best paper examining curren tissues in the planning, management or administration of health servicesprograms . (Available 1989/90 Winter Session) .

MalcolmT.McEachern Prize - A $1,000 prize has been established by th eBoard of Trustees of the Vancouver General Hospital to honour Malcolm T .McEachern and to encourage leadership in health administration . As aphysician, administrator and public health official, Dr . McEachern had on emajor goal : to provide better quality care for the patient throug hincreased efficiency of hospital administration . The prize is awarded onthe recommendation of the Division of Health Services Planning andAdministration to the full-time student who presents the best managemen tproject during the summer clerkship . National Scholarships - The University of British Columbia offers up to te nawards of $6,500 each to outstanding students entering

undergraduateprograms from secondary schools in Canada .

The awards will be basedprimarily on the student's scholarly achievement .
