HE: Dr. B. 0. Choate - The following is levier from the Attorney Gen-eral vrith referenoe to the right io revoke a mdical lioense when a new trialhas been granted by the Supreme Court and said trial appears to be pendingfor an indefinite time:

"Under the Statute, ~. S. 90-14, the State Board has the power to revoke orrescind a lioense aft'er due notice and hearing if it finds a physician licens-ed by it has been guilty of grossly immora3. oonduct or producing or attempt-ing to produce oriminal abortion and for other oauses set out in this Statute.This ab5ion oan be taken independent of any conviction of a physician forperforming a criminal abortion. The Statute, however, provides that; the lic-ense of a physician may be revoked if suoh physioian has been convicted in anycourt, State or lederal, of any felony or other criminal offense involvingmoral turpitude.

"Your Board could not act upon that part of the Statute just mentioned untilthe conviction has become final. The faot that Dr. Choate has obtained a new

trial leaves this part of the Statute inapp3. icable to him unless and unti. l he

is again convicted and this becomes a fina3. )udgment. As stated, however, theBoard of Medical Examiners have a right to proceed after notice and take suoh

aoti. on as may be found appropriate independent of a convicti. on in the criminalcase. I can furnish you with a copy of the reco rd of the evidence taken in thecase in which hs was convioted whioh oould be used for the purpose of obtainingthe testimony of witnesses who have knowledge of the faots. "

The following letter under date of Ootober 17th, 1949 from Dr. James M.

Northington was presented to the board:

"I venture to call your attentior. to the enclosed letter in the hope of havingaotion taken by your board in consonance with the message herein conveyed. Itseems to me that an ancient university such as that at Riga must provide eduoa-tion of the first order and that such education is what is desired on the partof doctor„desirous of ministering to the health needs of the people of thestate. I hope you will let me liow at your earliest oonvenienoe what the de-& ision of your board is in this matter. "

Dr. R. B. McFwight moved that 3atter from Dr. Northington be aooepted asinform- tion. This motion was duly seconded and passed unanimously.

Dr. Pau3. G. Parker moved that the president familiarize himself with theIdaho Medioal Praotice Act and that he report at the next meeting of the boardas to whether the same compares favorably with that of North Carolina, Thi. smotion was du3. y seconded and passed unanimously.

The date for the next meeting of the Board of Medioal Examiners was setfor Monday, May 1st, at the Carolina Hotel, Pinehurst, North Carolina, thesame to be held during the meeting of the North Carolina State Board of Medi-cal Examiners'

The date for the annual written examination was set for June 18-22nd, atthe Sir Yfa3.ter Hotel, Raleigh.

The board directed the secretary to invite the members of the Board ofedioal Examiners to be elected in May to attend the June meeting for the

purpose of indoctrination.

RE: Dr. Norman Hornstein - Dr. Ivan Prooter advised the board cf a visitfram Ben Dixon MacNei. ll, who resides at Ha .teras. Mr. MaoNeill stated that Dr.Hornstein was rendering a service on the Outer Banks as he was the only phvsi-cian available, but that his personality was not favorable. The board resolv-ed that Norman Hornstein's position remain status duo.

PZ: Dr. |Valter Joel - The matter of licensure for Dr. Joel~ graduate ofthe University, of Cologne, in order that he might go to the Community Hospital,'Wilmington, as a pathologist was again presented to the board,

The following is letter of November 4th from Dr. T. T. Sinclair, Jr. , Pres-ident of the New Hanover County Medical Society&

"I have no personal knowledge of Dr. Joel. But, have been assooiated withCommunity Hospital for the past four years in the capacity of radi. ologist. Thishospital is a looal hospital for negroes, with a bed capacity of 100 beds. Theyare associated with Duke Hospital set-up and, of course, reoeive, County andCity funds also for irdigent patients.

"The nsw administrator Frank B, Adair has been with them for the past year andhas been suooessful in improving both the physical plant and the medical ser-vices rendered. Hs is a well trained and very industrious administrator andis very anxious to get ths hospital fully approved. The only hold up naw isin scouring adequate patho3. ogical help. Because of its small size and result-ing weal economioal situat;ion they are unable to support a full time pathologist.If suoh a thing as a limited license could be issued this might be the solutionto the prob3. em, but I do not know whether such a license oould be issued. The

RE: Dr. J. H. Crawford - The secretarv reported that the books of thsBoard of Medioal xaminers vrere subpoenaed bv the Colliers Publishing Campanyfor the trial of Crawford vs Colliers Publishing Campany in the Federal Court,Asheville, North Carolina, Deoember 5-6th, 1949. Mrs. Louise J. McNeill,Assistant Seoretary, took said records of the board to this tria3. ~

Dr. Crawford, who is now 83:,ears of age, took offense at an article pub-lished by Colli.ers Publishing Campany and instituted suit ~

The minutes of the Board of Medical Waminers revealed the following:

AttorneVs for Colliers Publishing Campany obtained a photostatic cop~ ofthe record in Jackson Count;y showing that Dr. J. H. Crawford was conviotedJanuary 14t'h, 1929 of practicing medicine without a 3.icense. A3.so that DrCrawford in 1929 was allowed to register vrith the clerks of court in severalcounties under the Grandfather Clause. However, an aot eras passed in 1921 pro-hibiting anv further registrati. on under the Grandfather Clause. RE: Dr. Bernard Tilton - The secretary reported that Dr, Tilton was grant-ed license to practicd msdicine by vi.rtue of endorsement of credentials on the23rd day of November, 1949, as a result. of the majoritv of all members of theboard voting by letter, after expressed apology on the part of Dr. Tiltonforhis violation of the Medical Practioe Act and further as a result of ths appealon the part of physicians in his cammunity and also of the Raven County MedicalSociety.

The following letter under date of Deoember 19th, 1949, signed bv thspresident and secretary of the board, was sent t'o the editor of the NorthCarolina Medioal Journal for publications

"There has been much confusion in the past in reference to the interpretationof ths North C rolina laws (Medica3. Praotioe Act} oonoerning permission to prac-tice medicine within the state. This permission has been misinterpreted inmany different oases. Individual physiciqns, espeoially, and at; times seore-taries of local county medical societies, have felt that they oould indirectlygrant permission to a nsw physician to praotice medicine at least temporarily.

"This, of course, is an erroneous interpretation of the law and has oaused much

oanfusion at times, embarrassment and loss of temper on the part of praotitionersand other citizens of the state.

"The North Carolina Medical Practice Act specifically states that any person who

diagnoses or attempts to diagnose, who treats or attempts Co treat, operate orattempt Co operate on, or prescribe for or administer Co, or profess to treatany human ailment, physical or mental, or any physical injury Co or deformitgof another person, is practicing medicine. If that person does not possess anindividual license granted by the State Board of Medical Examiners, he is .violat-ing the laws of Che state and is liable to conviction of a misdemeanor. "

HE: Dr. S. 'V. Flemi~n - The following is letter under date of October 17th,1949 fram R. 7i'. Craft, Ghairmn of Che Forsvth County Board af Gommissiorers:

"Dr. S. 7«. Fleming who was employed by the Forsyth County Board of Commissionersin June of this year as Assistant Co Dr. T. F. Uestal, Superintendent and MedicalDirector of Che Forsyth County Hospital, voluntarily resigned on August 13, 1949.Four or five nurses at the County Hospital accused Dr. Fleming of having beenintoxioated while on duty at the hospital. These charges were thoroughly in-vestigated bZ. Che Gounty Commissioners and sixteen affidavits were obtained fromsome of the personnel' of the hospital, former patients, and others, who set forthin their sworn statements that they had never seen Dr. Fleming when in theiropinion he was intoxicated, or under the influence of intoxicating beverages.5'e Beard also obtained affidavits from highly reputable, looal physicians whodid work at Che Gounty Hospital while Dr. Fleming was employed, these physiciansstating in their opinion the hospital was well managed and under proper adminis-tration.1'I

The Grand Jury of Forsvth County made a special investigation of conditions atthe Forsyth County Hospital and submitted a report stating that the people ofZorsyth County should be proud of the institution, the report making no mentionof' Dr. Fleming being intoxicated and, as a matter of faot, did not mention Dr,Fleming's name in the report ~

""~'Ie feel that the accusations brought against Dr. S. ~& ~ Fleming were most un-fortunate and, in our opinion, not substantiated. He is in our opinion a splen-did young man and, still merits Che confidence we placed in him while he was em-ployed by our Board of Commissioners.

"V e understand, that Dr. Fleming will be eligible to take an examination to begiven by the State Board of Medical Examiners at its regular meeting, and wewish for him muoh suooess, and trust that these aoousations will not be heldagainst him by the Board of Medioal xaminers. "
