Court Says Woman CanSue Restau ran t for Inj ury

Can a restaurant be sued because a benchpurchased from a manufacturer breaks andinjures a customer? The Nevada SupremeCOlin says yes. in a split decision on a caseinvolving a Roundtable Pizza restaurant inCarson City .

The majority opinion allows AudreyJudson 10gel a civiltrial of her lawsuu againstRoundtable and aaatnst the manufac turer ofthe wooden bench~which snapped a few min­utes after she was sealed.

The court says the trial can go ahead. eventhough trs notlikelythat the cause ofthe breakwill ever bekno wn. The bench was tossed outby restaurantemployeesaday or IwO after theMa rch. 1985 accident.

The Supreme Court's four-to-one opinionoverturned a Carson City Distric t Coun sum­mary judgment that held Mrs. Judson offeredno evidence regarding any defect in the benchor ev idence that the restaurant didn' t act in aprudent manner in routinely checking benchesand tables.

The high court said Roundtable 's claim thatits wee kly inspections of benches was reason-

able was based only on a deposition of therestaurant manager. and there's a question offact regarding reasonableness that should bedecided by a j ury.

And the court also said the lower court erredin not allowing Mrs. Judson to rely on the legaldoct rine ofresipsa loquitur, which can be util­ized in such lawsuits if a defendant is in a betterposition to explain the cause of an acc iden t.

The legal doc trine alsoean be utilized whena defendant can be shown to be in exclusivecontrol of a bench or table or other item thatcauses hann to someone and when the acci­dent is one rhar wo uldn ' t ordinarily occurwithout some negligent act .

" It seems self-evident that a restaurant is ina better posi tion than its customers to explainthe cause of one of its seats collapsing withoutwarning," the court says."As far as selection.maintenance and inspection of its seats areconcerned, the restaurant has exclusive con­trol. Second. seats designed for use by patronsof commercial es tablishments do not ordinar­ily collapse without negligence in their con­st ruction. maintenance or use."

J ustice Cha rles Springer dissented in thecase. saying there was not hing in the record toshow that restaurant' s inspections woul d havekept the bench from breaking.

Secretary of StateOrders Study ofCorporate Laws

The Nevada Secretary of State's O ffice is inthe midst of a $50.000study of state corporatelaws and special services in order to st reamlineand update the laws.

Secretary of State Frankie Sue Del Papa.who hopes to have the report in hand by lateOctober. says some of Nevada's corporatelaws date back to territorial days and the entir ebody of corporate law never has had a fullrev iew.

She adds that in this computerized age. suc ha review is long overdue and will help to kee pNevada competitive wit h other states trying toattract new companies.

The study is designed to cull methodicallythrough all Nevada corporate laws. streamlin­ing and examining them for outdated lan­guage, for over-regulation or inefficient prac ­tices which could de lay corporation filing orslow down business activities,

"If we operate under up-to-date and modemlaws. then we can do a lotto facil itate econo­mic development in our state," says Del Papa.

The project received support from manysectors. including ban king and oil company at­torney and lobbyist John Sand e who says otherstates are changing the ir corporation lawsbecause they see the benefits tha i Nevada andDelaware have obtained in seeking out-of­slate business.

"Our corporate laws and the services pro­vided by the secretary of state have alwaysbeen favorably received by entities consider­ing a !'levade corporate dom icile.' says Sande.

"To maintain an att rac tive environment forbusiness and to respond to the rapidly chang­ing corporate world. it is essential that a care­ful analysis be perfonned to determine whatchanges in our laws and serv ices are needed:'

Even those who didn't know Bill are likely10 havehad their lives touched by him. He gavehis time and energy to the community in avariety of ways. He served as a rnember.direc­tor and president of the Greater Las VegasChamber of Commerce (LVe e ) since 1971.He filled the same vacancies in the BenerBusiness Bureau since 1969. Horan said that initially the company !ladused satellite se....-ice exclusively because ofthe low cos t. but the traders ....'ere not satisfiedwith line quality and found the transmissionde lay intolerable. Two of Montgome ry's pre­vious vendors, Data General Network Serv'·ices and RCA. went out of the private linebusiness and Horan was faced with replacing50 lines without interrupting service .

IlT was one of the majo r vendors selectedbecause of the quality of its advanced fiberoptic and microwave land-based lines andcom petitive cost. Horan said ITT is running

about s.wo less per line. per month thanAT&T. but they are willing to pay AT&T' shigher rate beca use of the need for multiplevendors.

In addit ion to COM. reliability is a key factor.Horan said the lines naveproven highl)' reli­able. In fact, all ITT network nodes are sup­ported by a variety of emergency-powergen­erators.

Basic, or any defending corporation, mayrebut the presumption by showing that theplaintiffs did not rely on the false information.The ruling shif ts the balance to the plaintiff:now the defendant must reb ut the pres ump­tion . rather than the investor provin g that hedid rely on false intelligence.

"Defendants may defeat the pres umptionby rebutting it, or by showing that the misin­format ion had no effect on the stock price."Borownz explained, "or by showing that theplaint iff would have traded anyway, despiteknow ing the informat ion was false."

The cruxofthe issue, forthe investor as wellas for the corporation. is whether or nOI themerger discussions are indeed "material:'"That depends on the specific facts: ' Borow­itz said.

Since the land was claimed for miningpurposes from the Bureau of Land Manage­ment. Georgia Pacific had 10 insure the protec ­tion ofthe tortoises. The enure 35 acres had tofirst besecured witha six-foc rcham lim fence"with a specia l fabric at the bottom whichextended 18 inches into the ground to preventthe tortoises from digging under the fence andgaining access 10 the site where they might beharme d by the day-to-day operation of theplant perso nne l and equipment.

There were times this past year whenyou practically needed a hard hat towalk around the Umversuy of Ne­

vada. Las Vegas. Several projects launchedwithin months of each other have kepi con­struction crews busy throu ghout the cam pus.Most o f the dust has now settled, and with the:fal l semester just unde rwa y the resuil sof thei rlabor are now e ither on display or ready forope ration.

Perhaps the mo st overdue addit ion to theuniversity is the four new residence halls 10­cared between Trop icana and Harm on Road.Prior to their construction. UNLV had onlyTonopah Hall. with a max imum occupancy of240. to offer as on-campus housing to its13,000students.

Back in 1986, invitations were offered 10area archi tects. Afler an interv iew and se jec­lion process, two firms were chosen 10 col­leborare on the projecl - J~tA Architects andEngineers. "Thebuildings could have turned their backs on thehouse. which is an isolated fonn on campus,but we fell tha t because its basis was residen­rial. we co uld employ them ," The style is alsodesigned [0 co incide with proposed new fra­ternity and sorority houses. which have yet 10progress pasr ue planning stages.

Roben Ackerman. Dean of Ur-.1.v's Divi­sion of Student Services. is very pleased withthe results. " We ui ed . within the limits of ourbudget. to make the halls an attractive place 10come home to. and we knew the design wouldhave something to do with the students beingcomfortable and content.

"Aesthetically, we were looking for some­thing that set in well with the Tropicana en­trance 10 the campu s, if possible in a park-likesening , We have seven acres of land. so wewanted to give the appearance of not beingcrowded." Ackerman said.

Schocman believes the)' have accom­plished their goal of creaung a "heme-away­from-home" environme nt. "We wanted it robeimmediately inviting and positive. You're try­ing to gel people ready for the academic world.and the residence hall is their firs t encoun ter\'dth campus life. Our intent was 10 enhancethat lifestyle."

Those who would know best how to en­hance a campus-dweller's lifestyle were alsoincluded in the plannin g stages. "Early on werelied heavily on student input ," said Acker­man. " the architects went through TonopahHall and talked with its residents about whatthe)' liked and didn't like about resioeocehalls. The gardens, the low-rise structures. therecreational areas - a 101 ofthat came from thestudents." ' t wutccsra studentSI844to live inthe halls for one semester. The price includesroom, board. telephone and a 19-meal-perweek food plan.

The project was financed by selling Univer­sity of Nevada SYStCTn bonds . The architectswished they could have sold a fe..... more. "Thebudget was ourbiggest challenge, " said HarrisSharp's Ned Cole, "i t forced us into the wood­type conseucuon. We had to cut back on a 101

But there was a1so a real need 10 becornpetl­rive with the public. because there is not a bigdifference between (the cost) of a donn roomand the cost of an apartment. So we had tomaintain enough amenitie s to keep people oncampus. otherwise the buildings would beempty,"

Creating that positive environment was

another hurdle. - We attacked that by ternton­alizing the student groupings : il starts with atwo-studen t dorm. that goes 10 a four studentroom that shares bathroo m facilities. As op­posed 10 gang bathrooms. these are smaller.more personali zed alcoves. Each group of fouralso has a balcony that serves as an outdoorliving space, and thar group of four goes to agroup of sixteen per floor, and that becomes afamily nucleus.

We dropped in daylighr where we could. sothe students wouldn't fed they were locked ina cell. and created outdoor court spaces withbarbecues and volleyball, It' s a place thatallows people to socialize. nor just a place tosleep."

The completion date was also a challenge."The campus had a strong need for residenthousing and we had to track the project veryquickly to get it occupied for the fallsemester." SChocman said.

That need. according to Robert Ackerman,had existed "as long as meuniversity has beenhere. If you' re only going to draw your stu­dents from the local area. it is very difficult tobuild a major , nationally -known university.UNLV will continue to serve the people ofSouthern Nevada, but at the same time wehave to be able 10 attract people from OIherpans of the country and the world. Housingallows U$ the opponunity to do that."

Two other new names on campus this yeararc lbomas T. Beam and Howard Hughes.The 1bomas T. Beam Complex, located nexlto the Life-SCience building. is the home of thejust-completed Ho.....ard Hughes School ofEngineerin g. This one's been talked about forages. and back in 1983 the liming finallyseemed right. The projec t went Ihrough thelegislative process in 1984 and was approvedearly the next year.

While they wailed for the green light, theuniversity began working with various profes­sors and a group that became known as theEngineering Advisory Council. The Couocilwas composed of representatives from NellisAir Force Base, the power companies andether experts from the private sector.

Enter the architects. In the spring of 1985Tate & Snyder, who previously designed the
