APPLICANT: SIB GRASSO

Please be advised that we act on behalf of Mr Sib Grasso, with regard to the above mentioned

development application.

This applica~on has been prepared to seek approval from Burdekin Shire Council for the Reconfigura~on of

a Lot of the following land:

ADDRESS PROPERlY DESCRlPfION SITE AREA

Robins Road, Brandon Lot 5 on SP286602 39.72 ha

Sexton Highway, Brandon Lot 6 on SP286602 38.43 ha

Sexton Highway, Brandon Lot 7 on SP286602 3B.84 ha

To enable Council’s considera~on, please find enclosed the following documents;

Two (2) copies of IDAS applica~on forms 1 & 7; Two (2) copies of proposal plans 55911 /OOBA, prepared by Brazier Motti Ply LId;

. Two (2) copies of Certificate of Ti~es; Two (2) copies of a Smart Map; and

. The Applicants payment of $1 ,215.00, being Council’s application fee.

The development application recuests a Development Permit for Reconfiguring a Lot (Boundary

Realignment). Under the provisions of the Burdekin Shire Planning Scheme is Code Assessable,

The land the subject of the applica~on is identified as being within the Rural Zone under the Burdekin Shire

Planning Scheme.

The land subject to this application comprises a total area of 116.99 hectares. The land is curren~y

improved by sugar cane farms. A Smart Map has been included to demonstrate the exis~ng cadastral

pattern of the subject land.

Approval of the Development Applica~on will authorise a Development Permit for Reconfiguring a Lot to

lhe current laneowners wish to ratonalise their existing land holdings by realigning the property boundaries.

~ is the Applicanfs intent to create proposed lots 11 and 12 to contain Mure dwellings while proposed lot

13 will continue to be used for rural pursuits (intensive agriculture - sugarcane).

While the proposed Reconfiguraton of a Lot (Boundal’{ Realignment) creates two (2) allotments which are not consistent with the preferred minimum allotment area for the Rural Zone, the proposal does not create

any additional new allotments. Furthermore, the proposal consolidates all of the agricultural land into a

single large allotment, which contributes to ensuring that agricultural lane is protected and maintained.

As Council is aware, the part of Robins Road where proposed Lot 11 is located, is not a bitumen road, but a

formed gravel road. ~ is noted that Council have previously advised that there will not be a requirement to

undertake works to bitumen the rest of Robins Road to the trontage of proposed Lot 11 as part of the

proposed Reconfiguraton of a Lot (Boundal’{ Realignment).

Overall, it is considered that the proposed development achieves the overall objectives sought by the

applicable Planning Scheme codes.

REFERRAL AGENCIES

The Integrated Development Assessment Process incorporates a referral process, established through the

Sustainable Planning Regulation 2009, enabling relevant state agencies to have input in the assessment

process. A review of Schedule 7 of the Sustainable Planning Regulation 2009 against the proposed

development indicates that there are no referral agencies applicable to this applicaton.

CONCLUSION

With the provision of reasonable and relevant conditions, we consider that Council are able to approve the

proposed reconfiguraton on the following grounds:

. lhe proposed boundal’{ realignment does not increase the total number of allotments in the

locality; . lhe proposal will not flagment the existing viable rural industl’{ that occurs on the site; . lhe proposal is consistent with the character of the area and the boundal’{ realignment will not

change the existing use of the land; . lhe proposal is of a scale ane nature that contributes to the proper and orderly development of

the locality; and . lhe proposed development does not intend to modify existing land contours, therefore ensuring

that overland ftow paths do not direc~y or indirec~y cause nuisance to a downstream or adjoining

property.

114. Applicant’s declaration

~ By making this application, I declare that all information in this application is true and correct (Note: it is unlawful to provide false or misleading information)

Notes for completing this form

. Section 261 of the Sustainable Planning Act 2009 prescribes when an application is a properly-made application.

Note, the assessment manager has discretion to accept an application as properly made despite any non-

compliance with the requirement to provide mandatory supporting information under section 260(1)(c) of the

Sustainable Planning Act 2009

Applicant details

. Where the applicant is not a natural person, ensure the applicant entity is a real legal entity.

Question 1

. Schedule 3 of the Sustainable Planning Regulation 2009 identifies assessable development and the type of

assessment. Where schedule 3 identifies assessable development as "various aspects of development" the

applicant must identify each aspect of the development on Tables A, Band C respectively and as required.

Question 6

. Section 263 of the Sustainable Planning Act 2009 sets out when the consent of the owner of the land is required for

an application. Section 260(1)(e) of the Sustainable Planning Act 2009 provides that if the owner’s consent is

required under section 263, then an application must contain, or be accompanied by, the written consent of the

owner, or include a declaration by the applicant that the owner has given written consent to the making of the

application. If a development application relates to a state resource, the application is not required to be supported

by evidence of an allocation or entitlement to a state resource. However, where the state is the owner of the

subject land, the written consent of the state, as landowner, may be required. Allocation or entitlement to the state

resource is a separate process and will need to be obtained before development commences.

Question 7

. If the premises is listed on either the Contaminated Land Register (CLR) or the Environmental

Management Register (EMR) under the Environmental Protection Act 1994 it may be necessary to

seek compliance assessment. Schedule 18 of the Sustainable Planning Regulation 2009 identifies

where compliance assessment is required.

Question 11

. The Building and Construction Industry (Portable Long Service Leave) Act 1991 prescribes when the portable long service leave levy is payable. . The portable long service leave levy amount and other prescribed percentages and rates for calculating the levy

are prescribed in the Building and Construction Industry (Portable Long Service Leave) Regulation 2002.
