The development application recuests a Development Permit for Reconfiguring a Lot (Boundary
Realignment). Under the provisions of the Burdekin Shire Planning Scheme is Code Assessable,
The land the subject of the applica~on is identified as being within the Rural Zone under the Burdekin Shire
Planning Scheme.
The land subject to this application comprises a total area of 116.99 hectares. The land is curren~y
improved by sugar cane farms. A Smart Map has been included to demonstrate the exis~ng cadastral
pattern of the subject land.
Approval of the Development Applica~on will authorise a Development Permit for Reconfiguring a Lot to
realign the existing property boundaries. In summary, the proposed reconfiguration as illustrated on
proposal plans attached to this application, comprises of:

lhe current laneowners wish to ratonalise their existing land holdings by realigning the property boundaries.
~ is the Applicanfs intent to create proposed lots 11 and 12 to contain Mure dwellings while proposed lot
13 will continue to be used for rural pursuits (intensive agriculture - sugarcane).
While the proposed Reconfiguraton of a Lot (Boundal’{ Realignment) creates two (2) allotments which are not consistent with the preferred minimum allotment area for the Rural Zone, the proposal does not create
any additional new allotments. Furthermore, the proposal consolidates all of the agricultural land into a
single large allotment, which contributes to ensuring that agricultural lane is protected and maintained.
As Council is aware, the part of Robins Road where proposed Lot 11 is located, is not a bitumen road, but a
formed gravel road. ~ is noted that Council have previously advised that there will not be a requirement to
undertake works to bitumen the rest of Robins Road to the trontage of proposed Lot 11 as part of the
proposed Reconfiguraton of a Lot (Boundal’{ Realignment).
Overall, it is considered that the proposed development achieves the overall objectives sought by the
applicable Planning Scheme codes.
REFERRAL AGENCIES
The Integrated Development Assessment Process incorporates a referral process, established through the
Sustainable Planning Regulation 2009, enabling relevant state agencies to have input in the assessment
process. A review of Schedule 7 of the Sustainable Planning Regulation 2009 against the proposed
development indicates that there are no referral agencies applicable to this applicaton.
CONCLUSION
With the provision of reasonable and relevant conditions, we consider that Council are able to approve the
proposed reconfiguraton on the following grounds:
. lhe proposed boundal’{ realignment does not increase the total number of allotments in the
locality; . lhe proposal will not flagment the existing viable rural industl’{ that occurs on the site; . lhe proposal is consistent with the character of the area and the boundal’{ realignment will not
change the existing use of the land; . lhe proposal is of a scale ane nature that contributes to the proper and orderly development of
the locality; and . lhe proposed development does not intend to modify existing land contours, therefore ensuring
that overland ftow paths do not direc~y or indirec~y cause nuisance to a downstream or adjoining
property.
