Recommendations for Council action:

1. DIRECT the Bureau of Street Services (BSS) to establish a pilot shopping cart recovery program in Council District 12.

2. INSTRUCT the BSS to report to the Public Works and the Personnel Committees in six months on the status of the pilot program.

3. NOTE and FILE the June 23, 2005, July 21, 2005, and October 19, 2005 reports from the BSS, and the September 28, 2005 report from the City Administrative Officer (CAO), inasmuch as the BSS will report back in six months with an analysis of the results of the pilot program and a final recommendation on the resources needed for a Citywide shopping cart recovery program.

Fiscal Impact Statement: The CAO reports that the actions recommended above do not require an appropriation of funds. There is no additional General Fund impact. The BSS will use existing budgeted resources to implement a pilot program in Council District 12 to remove shopping carts abandoned in the public right-of-way. '

SUMMARY

In a report dated June 23, 2005, the BSS gives background information on shopping cart recovery program in the City of San Jose. The Bureau states that Los Angeles Municipal Code (LAMC) Section 41.45 calls for a $50 fine for violation of the City shopping cart regulations. Furthermore, LAMC Section 41.45, which applies primarily to marked carts belonging to businesses, restricts recovery of the carts to "authorized recovery agents" pursuant to California Business and Professions Code Section 22435.10-22435.13.

The BSS proposes amending the LAMC to model the shopping cart recovery program after the City's Illegal Sign Enforcement and Removal Program. The Bureau suggests requiring shopping cart owners to tag their carts for identification purposes, formulate a plan to prevent the removal of carts from their premises, and develop a retrieval plan for abandoned carts. In addition to this, the BSS proposes increasing the fine for failure to remove carts from the public right-of-way as well as a fine for the possession of carts in the public right-of-way. Finally, the Bureau notes that a Shopping Cart Enforcement Program in the Investigation and Enforcement Division of the BSS should be established.

The Bureau maintains that amending the LAMC will create a targeted program to rid City streets of abandoned carts. The SSS also notes that a staff increase of 10 positions and equipment consisting of four trucks for cart collection will be needed. The Bureau reports that a proposed recovery fee and permit fee structure can be developed to recover the cost for the shopping cart recovery program. The Bureau recommends that prior to initiating a Citywide program for shopping cart recovery, a pilot program utilizing existing SSS resources should be explored. The Bureau notes that the program should cover a six month period and can take place in Council District 12.

In a report dated September 28, 2005, the CAO reports that the SSS would report back to the Council at the conclusion of the pilot program with the resources needed for a Citywide program. Initial estimates from the BSS indicate that 10 additional staff (one Senior Street Services Investigator, eight Maintenance Laborers, and one Management Assistant) may be needed to implement a Citywide shopping cart recovery program. The approximate cost for the staff is $500,000 annually.

In a report dated October 19, 2005, the BSS reports that the Bureau discussed the proposed pilot shopping cart recovery program with the California Grocers Association (CGA). The Bureau notes that the CGA supports the proposed pilot program and will work with the Bureau on the notification procedures for their member stores in the affected area.

At a regular meeting held on October 19, 2005, the CAO representative provided an overview of its September 28, 2005 report to the Personnel Committee. The SSS representative then responded to various related questions from the Committee members. After offering the opportunity for public comment, the Personnel Committee concurred with the Public Works Committee, requested that the Personnel Committee be included in the report back on the status of the pilot program in six months, and to note and file the June 23, 2005, July 21, 2005, and October 19, 2005 reports from the BSS, and the September 28, 2005 report from the CAO, inasmuch as the SSS will report back in six months with an analysis of the results of the pilot program and a final recommendation on the resources needed for a Citywide shopping cart recovery program.

On November 8, 2005, the Budget and Finance Committee concurred with the Personnel Committee. This matter is now submitted to Council for its consideration.

At a regular meeting held on July 22, 2005, representatives from the BSS gave a presentation to the Public Works Committee on the proposed pilot program for shopping cart recovery. After a brief discussion, the Committee approved the recommendations of the BSS. This matter is now submitted to Council for its consideration.

SUBJECT: PROPOSED SHOPPING CART RECOVERY PROGRAM CF #04-0840

The Bureau of Street Services has discussed the proposed pilot Shopping Cart Recovery Program with representatives of the California ~rocers Association (CGA). The CGA is supportive of the .planned pilot and will work with the Bureau of Street Services on the notification procedures for their member stores in the affected area.

PROGRAM HIGHLIGHTS:

• Pilot program area will cover the boundaries of Council District Twelve;

• The Bureau of Street Services will use existing resources to obtain data on the frequency of shopping cart abandonment and additional resources needed, if any, to create a Citywide recovery program;

• The Bureau will conduct weekly inspections_ of the pilot area; notify the responsible businesses of the location of carts left on the public right-of-way, and request removal within twenty-four hours of notice.

• Carts not removed within twenty-four hours will be subject to removal by City crews; impounded carts will be held at a City facility. The Bureau will give the owners of impounded carts their location, also informing them of the thirty-day period to claim them. Carts not claimed after thirty days will be either recycled or destroyed.

The pilot program will provide weekly inspections of areas with a high frequency of abandoned car complaints in Council District Twelve. The Bureau will maintain a record of referrals for removal to California Shopping Cart Recovery., Follow' up inspections will be performed to determine the percentage removed within twenty-four hours of referral. In cases where the cart has no identifiable ownership information and is not part of a homeless encampment, the Investigator will refer the abandoned cart to the Street Maintenance Division of the Bureau of Street Services for removal.

Those carts associated with the homeless will be removed in accordance with established City homeless encampment removal policies and procedures. The Bureau of Street Services will report back to the Public Works Committee in six months with an analysis of the results of the program and

Shopping Cart Recovery Program

In response to shopping carts abandoned in the public right-of-way, the Bureau of Street Services (BSS) released a report in June 2005 recommending a six-month pilot program in Council District 12 .

. The pilot program would use existing resources to remove shopping carts in the public right-of-way and BSS would report back to the Council at the conclusion of the pilot program with the resources needed for a citywide program. Initial estimates from BSS indicate that 10 additional staff (one Senior Street Services Investigator, eight Maintenance Laborers, and one Management Assistant) may be needed to implement a citywide Shopping Cart Recovery Program (Program). The approximate cost for the staff is $500,000 annually.

The proposed Program uses an ordinance from the City of San Jose as a model. The major components of the proposed Program include:

• Submittal of a plan by all businesses using carts that would detail preventive measures for removal of carts from the business property and procedures for retrieval of abandoned carts;

• Establishment of a fee for the review and approval of the plan; and, • Consideration of an increased fine for failure to remove carts from the public right-of-way.

BSS indicates that cost recovery from fees is preferred over a fine system. Establishment of a fee for cost recovery does not require the creation of a new adjudication system to process hearings that would be associated with a fine system. At this time, BSS has not proposed a structure for the collection of fees. When BSS reports back to the Council on the results of the pilot program it will identify the required resources for a Citywide Program and also address a cost recovery program and a proposed fee structure. ,. ,,,,

SUBJECT: CF 04-0840 - PROPOSED SHOPPING CART RECOVERY PROGRAM

The City currently has an ordinance related to the enforcement of the California Shopping Recovery Act. Los Angeles Municipal Code Section 41.45 calls for a $50.00 fine for violation of City shopping cart regulations.

This current shopping cart ordinance primarily applies to marked carts belonging to businesses. Recovery of carts is restricted to an "authorized recovery agent" pursuant to California Business and Professions Code Section 22435.10-22435.13.

CITY OF SAN JOSE SHOPPING CART RECOVERY PROGRAM

City enforcement personnel can enforce shopping cart regulation for permitted businesses. The City of San Jose requires all businesses using shopping carts or laundry carts to submit a plan to prevent removal of carts from their property and gain approval of that plan from city regulators. Failure to submit or follow the approved plan is a violation of ordinance.

The key to reducing abandoned shopping carts is requiring the industry to take responsibility for preventing removal. New technology and improvement in security features for shopping carts are being used to deter removal of carts from the parking area of stores in other areas. The San Jose Ordinance requires the following:

City o(San Jose Abandoned Cart Prevention Plan

Under the Ordinance, retail or other commercial uses providing cart service (1) will be required to submit and Abandoned Cart Prevention Plan to the City of San Jose annually. This Plan shall set forth a program to ensure that carts are not removed from their premises and a retrieval plan if they are removed. Each business owner shall be required to file an initial plan at the beginning of the program and pay a plan review fee. A business may request an exemption.from the annual plan requirement if it is able to demonstrate to the satisfaction of the City the ability to prevent carts from leaving the site and no carts are found abandoned after the exemption is granted. If the best management plan or physical devices to prevent cart removal are found to be ineffective, however, the exemption may be rev(!ked and the plan requirement with corresponding fee requirement reinstated.

Each Abandoned Cart Prevention Plan shall, at a minimum, contain the following components:

• The name of the business; • An inventory of carts; • The installation of cart signage; • The customer and community outreach and notification plan; • Identification of best management plan or physical devices preventing loss; • Identification of authorized agent for retrieval including company information; • Employee training plan on Abandoned Cart Prevention Plan

The identification of business address contact information, the names of persons responsible for implementing the plan and information on who and how to contact the appropriate individuals to resolve any plan issues or violations. Plans that are incomplete will be rejected and, if not resubmitted with the required information in a timely manner, be subject to Administrative Remedies for failure to comply. Failure to retrieve carts within the specified 24-hour period shall constitute a violation of the plan."

The proposed Shopping Cart Ordinance is an abatement ordinance, similar to the City's Illegal Sign Enforcement and Removal Program, and it requires shopping cart owners to tag or identify where the carts originate. The owners will have to formulate a plan to prevent removal of the shopping carts from their premises and also plan for retrieval of abandoned shopping carts.

The Bureau of Street Services (BSS) requests approval of various actions to modify the Los Angeles Shopping Cart Ordinance to address the same blight concerns covered in the sample ordinance from the City of San Jos~. Specifically, the following is proposed:

• Amend the Los Angeles Municipal Code (LAMC), Section 41.45 to include A provision to require all shopping carts to be plainly marked with the name and address of the owner;

• Increase the fine for failure to remove carts from or the possession of carts on the public right-of-wey: I

• Consider funding for a Shopping Cart Enforcement Program in the Investigation and Enforcement Division of the Bureau of Street Services.

The BSS proposes an amendment to the LAMC that will create a targeted program to rid City streets of abandoned carts. To support a Shopping Cart Enforcement Program, the BSS requests a staffing increase for the program of 10 positions with an associated direct cost of approximately $517 ,335 and equipment consisting of four trucks for field collection personnel. The proposed recovery fee and permit fee structure is anticipated to provide cost recovery for the program.

The fee recovery method is preferred over a fine system in that it does not require the creation of a new adjudication system to handle hearings required by State law when a municipality imposes administrative fines. It also allows the City to tie program costs to fines and permits.

The BSS recognizes the financial impact of the proposed fully staffed City wide program and as an alternative recommends that an initial program is launched for a six month period program utilizing existing resources to capture the costs and measure the effectiveness of reducing the proliferation of shopping carts on the public right-of-way. The program will provide weekly inspections of areas with a high frequency of abandoned cart complaints in Council District Twelve. The Bureau will maintain a record of referrals for removal to California Shopping Cart Recovery. Follow up inspections will be performed to determine the percentage removed within 24 hours of referral. In cases where the cart has no identifiable ownership information and is not part of a homeless encampment, the Investigator will refer the abandoned cart to the Street Maintenance Division of the BSS for removal.

Those carts associated with the homeless will be removed in accordance with established City homeless encampment removal policies and procedures. The BSS will report back to the Public Works Committee in six months with an analysis of the results of the program and a final recommendation of the resource needed for a regular program to regulate shopping carts City-wide. The goal of the initial program is to provide your Committee with a comprehensive report detailing program costs and effectiveness of the program. ·

Ulti..4nately, we feel that the people removing the carts from · the stores are responsible for this blight, however having the stores owners' address the issue seems· to make sense.

Another suggestion is to make personal carts available at a reasonable price for people that do not have transportation. These would be the type may seniors use and could easily be stored in their homes. Either way something must be done. The "broken window" effect will cause our neighborhoods to continue spiraling downward instead of reaching the potential that many of the law abiding residents know exists.

Councilman Zine's office has issued a call for public comment on proposed Ordinance CF-04-0840. As a San Fer.nando Valley resident, I am opposed to 'the costly/punitive retrieval program for stolen/abandoned shopping carts, which, in theory and in imple­mentation, will merely encourage the expansion of local government bureaucracy through the creation of a convoluted retrieval/punitive; fee/citation/fine certification system, which in turn will increase government regulation and taxes/or consumer prices at the affected company, and will do nothing to dull the incentive or.impede the actions of care-pilfering perpetrators.

Indeed, by shifting the financial burden/responsibility/punishment to the perceived deep pockets of·retail,stores,' (and ultimately tsxpayers/consumers) and further establishing "a full employment act" for the lucrative/connected cart-retrieval industry, Ordinance Cr-04-0840 will not, as proposed, accomplish its stated goals but merely create a re­volving do0r of theft/abAndon~ant/retrieval of the carrs.

Interestingly, a· rational approach to r.he City's problem lies a fe~ miles away in the City of Glendale, which, after extensive, painstaking ~esearch and analysis, imple-mented a plan ·of containment/control rather than perpetuating the cycle of theft/retr:i.eva.E:~ ..

Rather than City Council reinventing the shopping cart wheel, it should exhaustively review, adapt, adopt the City of Glendale's model which reqoires no new staff of city services and also includes consideration for lo\ol-income/senior shopper.s who may be"in··· need of assistance. Specifically, the City Council should:

1. By-pass the Business and Professional Code restriction on "retrieval only" by including the cart-containment/control model.in the zoning code.

2. Measure the containment needs specific to Los Angeles.

3. Implement a "business fri~ndly" / less costly (long-term), simplified 1ns.ndat:ion that offers the affected retailer options (high or low-tech) for installing cost-effec7

For the past 12 years I have lived and worked in Woodland Hills. During part of that time, I was CEO of a major real estate company in Woodland Hills. I have been active in the Woodland Hills Chamber of Commerce and a member of the Design Advisory Committee, the BID Steering Committee, and Beautification Committee in this area.

All of these roles have· contributed to my awareness of the environment in the Third District and the quality oflife that is present ... or not. I support the efforts of Councilman, Dennis Zine to address the very noticeable problem with abandon shopping carts found scattered in neighborhoods. These carts often contain trash. Even when they are empty it is like having mobile graffiti in the neighborhood.

I recently returned from a trip to the Midwest. I was in both major cities and small towns. In no instance did I see shopping carts in neighborhoods. Surely a world class city such as Los Angeles can make the large and small changes that insure t.lie high quality of life that is deserved by the individuals who live and work in Los Angeles.-

This ordinance or a similar solution must be adopted and soon. Thank you for your consideration of this communication.

I have lived in the San Fernando Valley since 1987 and I actually remember a time when not all the streets were littered with shopping carts.

Abandoned carts are not only unattractive but they pose a danger when left in the sidewalk and sometimes roll into the street. It is a common sight to see carts piled together at the curbside waiting to be reclaimed by the retailers.

There was a time when the simple posting of a sign warning shoppers not to remove the cart actually was heeded. I think that those days are gone and Unless people are penalized for stealing the carts, I do not see the "honor system" ever working again.

I strongly support the idea being considered by the City Council regarding shopping carts being removed from the stores premises and being left in front of someone's front yard. This has happened to me, many times, we come home from work and a shopping cart somehow appears in front of my house. We need to start somewhere - I think people should be fined for removing these carts. ·

And I have another issue I'd like to mention: what about people who post garage/moving sales on polls and never go back to remove them. The address is always on the sign why can't they get a citation too. I think if they post the signs then they should be held responsible for going back and removing them after their sale is over. Let's try to limit the eyesores while driving down the street.

I have resided at the corner of Corbin and Oxnard in Tarzana for the past twenty seven years. It seems that almost every month a shopping cart is left on this corner. On many occasions I have attempted to contact the owners of the carts to request that they be picked up; however my calls have been disregarded. Just last week I placed a cart in my van and returned it to the Ross Store on Ventura.

I have been an elected member of the Tarzana Neighborhood Council and in my experience I have found this to be a serious matter that needs to be addressed.

I often call a 800 # to have shopping carts picked up from my neighborhood. As the block captain for Neighborhood Watch, I tend to be the one who actually makes the call to get things cleaned up on my street. I have found that if I do not call, they do not get picked up. It would be nice if there were a better way to manage shopping carts, so I would not always be responsible for calling. Any changes to current practice would be appreciated.

I see there may be a solution to this, Ordinance CF-04-0840.

I am writing this letter in strong support for the proposed Ordinance CF - 04-0840 currently being considered by The Los Angeles City Council to address illegal removal of shopping carts which adversely affect the quality of life in our City. Several factors to take in consideration in creating an ordinance to observe the already written law: 1) Higher prices are reflected in merchandise to offset damaged, lost or stray carts costing well over $250 each. 2) Currently used as portable trash cans. 3) When contract vendors retrieve carts indiscriminately left on streets, to add insult to injury, trash is then discarded onto streets. 4) They have become environmental and safety hazards scattered throughout our streets, recreational centers and more.

Instead of just presenting a problem, it is important to create a viable alternative in creating a solution. In discussing this concern with commercial businesses, they have attempted to attach expensive electronic devices to prevent removal from areas, but are stripped from the cart. Perhaps they might offer an incentive program to purchase · individual personalized shopping carts. ·

It is long overdue that market and store owners be required to take the responsibility of not allowing their shopping carts off of their property. Recommendations for Council action, pursuant to Motion (Smith - Zine):

1. REQUEST the City Attorney to prepare and present, in 60 days, an ordinance requiring all businesses operating in the City that provide more than 1 O shopping carts, as defined in the California Business and Professions Code (CBPC) Section 22435, to their customers, to do the following as requirement for obtaining their annual business license·:

a. Submit, with their annual business license application/renewal form, a copy of a certified, valid contract with a cart retrieval company that is licensed to do business in the City of Los Angeles. The cart retrieval company must guarantee pickup within 24 hours of notice. If a business does not send a copy of a certified, valid contract, the City will fine the business $1,000 per month, per location, until the violation is corrected; business license renewals will be denied to locations with unpaid violations.

b. Within six months of the effective date of the new ordinance, clearly identify all carts (per CBPC 22435.1) with the name of the store (including store number if applicable), and a telephone number to call for retrieval.

c. Within six months of the effective date of the new ordinance, post signage near customer exits and near parking area exits of the store and on the carts stating to their customers, that unauthorized removal, use, or possession, of shopping carts is a misdemeanor, under - Section 41.45 of the Los Angeles Municipal Code.

2. INSTRUCT the Office of Finance, the City Administrative Officer (CAO), and the Chief Legislative Analyst (CLA) to report in 60 days on the feasibility of this ordinance, and any costs to the City that might be associated with its implementation.

3. INSTRUCT the Bureau of Street Services (BOSS), with the assistance of the City Attorney and any other appropriate department, to report back on the amount of a citation necessary for the City to receive a full cost recovery for enforcement of the ordinance by any and all agencies, including but not limited to BOSS, the Department of Building and Safety (DBS), and the Department of Transportation (DOT). The citation would be issued to the owners of the abandoned shopping carts that are left on City streets, sidewalks, public parking lots, parkways or other properties, 48 hours after being reported to the cart retrieval company or the City.

• 4. INSTRUCT the CLA, after one year of the effective date of the ordinance, to survey each Council Office and Certified Neighborhood Council on the effectiveness of the new ordinance and to report back to Council. If the abandoned shopping cart problem still exists, instruct the CLA to prepare a Request for Proposals (RFP) for a contract for citywide cart retrieval service to supplement the existing businesses' individual contracts. The cost of this contract will be offset by a fee paid for by all businesses that provide more than 10 shopping carts, as defined in the CBPC (Section 22435); such fee to be recommended to Council by the CLA. This contract shall also include a provision that any carts retrieved and found to be from businesses outside the City limits, require that those businesses pay a fine and a fee for retrieval of the abandoned cart.

Fiscal Impact Statement: Neither the CAO nor the CLA has completed a financial analysis of this report.

SUMMARY

On April 28, 2004, Council referred Motion (Smith - Zine), relative to illegally removed and abandoned shopping carts and related matters, to the Public Works Committee for consideration. The subject Motion reports that throughout the communities of Los Angeles, illegally removed and abandoned shopping carts on public and private property are a source of visual blight and constitute a nuisance. City Council Offices receive numerous calls a week from constituents reporting abandoned carts. They can obstruct pedestrian and automobile traffic in the public right of way, creating potential hazards to the health and safety of the general public.

The Motion further reports that some stores already have policies and procedures in place to deter the illegal removal of carts, including identification, signage, contracts for cart retrieval services, and electronic wheel locking systems. While these are all positive steps, as a whole they have so far been proven ineffective. Some shopping cart retrieval contractors have been known to steal the carts from a store in order to increase cart retrieval profits. Furthermore, the electronic wheel locking system is only an effective deterrent in about 3 out of 4 carts. Therefore, the City should take action to eliminate the visual blight caused by illegally removed shopping carts and to ensure the safety and well being of its residents by comprehensively addressing this issue.

Under the CBPC, Sections 22435 through 22435.7, municipalities have the authority to enact "illegally removed shopping cart" ordinances to address stores that use shopping carts. The County of Los Angeles has already contracted for cart retrieval services in the unincorporated areas of the County from a licensed, bonded company.

The Motion recommends that Council request the City Attorney to prepare and present, in 60 days, an ordinance requiring all businesses operating in the City that provide more than 10 shopping carts, as defined in the CBPC (Section 22435), to their customers, to do the following as requirement for obtaining their annual business license:

Finally, the Motion recommends that after one year of the effective date of the ordinance, Council instruct the CLA to survey each council office and certified neighborhood council on the effectiveness of the new ordinance and to report back to Council. At a special meeting held June 25, 2004, the Public Works Committee Chair discussed this matter with City staff and recommended that Council approve the recommendations contained within Motion (Smith - Zine). This matter is now submitted to Council for its consideration.

I do not live in the city of Los Angeles anymore, but I am so upset I must comment to each and every one of you on this ordinance that you wish your City Attorney to draft regarding:

SHOPPING CARTS.

I remember when people would steal shopping carts from markets in Los Angeles and I would tell my children that that was wrong and sometimes we would offer to carry groceries for elderl)l_ people so they would NOT steal market baskets. t. '>JO<") Then, the stealing of shopping markets, off of their\fnv~te property, became Dan everyday thingO. No one thought 2 things about if. So the markets then hired people who went around to collect their private property. It provided employment for some people but at the same time re-enforced the fact that removing private property from the markets or other shopping stores was an okay thing. Just merely accepted. .

Ordinary hard working law abiding citizens in the cities of the LA basin do find it appalling. And wlien these same stolen shopping carts find their way into the LA River or Ballona Creek or the flood control channel, as is often the case, it is appalling and demonstrates a total disregard for property.

WHY ARE WE ALLOWING OUR STANDARDS TO SLIDE SO FAR DOWN THAT WE NOW THINK IT IS THE FAULT OF THE STORES THAT THESE BASKETS ARE TAKEN. AND YOUR CITY COUNCIL MEMBERS NOW THINK THAT THE STORES OUGHT TO DO LOTS OF DTHINGSO TO IDENTIFY THEM AND MAKE SURE THATlHEY ARE RETURNED.

Tirroughout the communities of Los Angeles, illegally removed abandoned shopping carts on public and private property are a source of visual blight and constitute a nuisance. City Council Offices receive numerous calls a week from constituents reporting abandoned carts. They can obstruct pedestrian and automobile traffic in the public right of way, creating potential hazards to the health and safety of the general public. , : i

locking systems. While these are all positive steps, as a whole they have so far been proven ineffective, as can be seen by driving through our communities. Some shopping cart retrieval contractors have been known to steal the carts from a store in order to increase cart retrieval profits. Furthermore, the electronic wheel locking system is only an effective deterrent in about 3 out of 4 carts. Therefore, the City should take action to eliminate the visual blight caused by illegally removed shopping carts and to ensure the safety and well being of its residents ·by comprehensively addressing this issue.

Under the California Business and Professions Code, Sections 22435 through 22435.7, municipalities have the authority to enact "illegally removed shopping cart" ordinances to address stores that use shopping carts. The County of Los Angeles has already contracted for

I THEREFORE MOVE that the City Council request the City Attorney to prepare and present, in 60 days, an ordinance requiring all businesses operating in the City of Los Angeles that provide more than 10 shopping carts, as defined in the California Business and Professions Code (Section 22435), to their customers to do the following as a requirement for obtaining their annual business license:

• Submit, with their annual business license application/renewal form, a copy of a certified, · valid contract with a cart retrieyal company that is licensed to do business in the City of Los Angeles. The cart retrieval company must guarantee pickup within 24 hours of notice. If a business does not send a copy of a certified, valid contract, the City will fine the business $1,000 per month, per location, until the violation is corrected; business license renewals will be denied to locations with unpaid violations.

• Within six months of the effective_ date of the new ordinance, clearly identify all carts (per BP Code 22435.1) with the name of the store (including store number if applicable), and a telephone number to call for retrieval.

• Within six months of the effective date of the new ordinance, post si~age near customer exits and near parking area exits of the store and on the carts stating to their customers, that unauthorized removal, use, or possession, of shopping carts is a misdemeanor, under

I FURTHER MOVE that the City Council instruct the Office of Finance, the CLA, and the CAO to report in 60 days on the feasibility of this ordinance, and any costs to the City that might be associated with its implementation.

I FURTHER MOVE that the City Council instruct the Bureau of Street Services with the assistance of the City Attorney and any other appropriate department, to report back on the amount of a citation necessary for the City to receive a full cost recovery for enforcement of the ordinance by any and all agencies, including but not limited to Street Services, Building and Safety and The Department ofTransportation.-The--citation would be issued to the owners of the abandoned shopping carts that are left on City streets, sidewalks, public parking lots, parkways or other properties, 48 hours after being reported to the cart retrieval company or the City.

I FURTHER MOVE that after one year of the effective date of the ordinance, the City Council instruct the CLA to survey each council office and certified neighborhood council on the effectivenes,s of the new ordinance and report back to the City Council. If the abandoned shopping cart problem still exists, instruct the CLA to prepare a Request for Proposals for a contract for citywide cart retrieval service to supplement the existing businesses' individual contracts. The cost of this contract will be offset by a fee paid for by all businesses that provide more than 10 shopping carts, as defined in the California Business and Professions Code (Section 22435); such fee to be recommended to the City Council by the Chief Legislative Analyst. · This contract sh:all also include a provision that any carts retrieved and·found·to be from businesses outsid~ the City limits, require that those businesses pay a fine and a fee for retrieval of the abandoned cart.
