The Minute of the Meeting of 30 May 2014 had been circulated. DECISION APPROVED and signed by the Chairman. LICENSES ISSUED UNDER DELEGATED POWERS 2. There had been circulated copies of a list detailing the Civic Government and Miscellaneous Licences issued under delegated powers between 21 May 2014 and 12 June 2014. The Legal and Licensing Services Manager provided further details in relation to questions from Members regarding a Pet Shop - Renewal for Tropical Fish. DECISION NOTED. HEARING TO CONSIDER RENEWAL OF TAXI DRIVER’S LICENCE – MR L MACHIN 3. With reference to paragraph 3 of the Minute of 30 May 2014, there had been circulated copies of an application submitted by Mr Lee Machin for the Renewal of a Taxi Driver’s Licence. The Legal and Licensing Services Manager explained that Mr Machin had previously been granted a Taxi Driver’s Licence for 6 months with the requirement for him to attend a future Committee meeting on renewal. Mr Machin was present at the meeting and apologised to the Committee for his non attendance at the previous meeting and explained that it had been an emergency admission of his daughter to Hospital which had prevented him from attending. The Legal and Licensing Services Manager advised that there had been no issues raised over the past 6 months. DECISION AGREED that the application from Mr Machin for the renewal of a Taxi Driver’s Licence be granted for one year. PRIVATE BUSINESS DECISION AGREED under Section 50A(4) of the Local Government (Scotland) Act 1973 to exclude the public from the meeting during consideration of the business detailed in the Appendix to this Minute on the grounds that they involved the likely disclosure of exempt information as defined in paragraph 14 of Part 1 of Schedule 7A to the aforementioned Act. SUMMARY OF PRIVATE BUSINESS Minute. 1. The Committee approved the Private Section of the Minute of Meeting of 30 May 2014. The meeting concluded at 9.40 a.m.

DECISIONAPPROVED and signed by the Chairman.

LICENSES ISSUED UNDER DELEGATED POWERS2. There had been circulated copies of a list detailing the Civic Government and Miscellaneous

Licences issued under delegated powers between 21 May 2014 and 12 June 2014. The Legaland Licensing Services Manager provided further details in relation to questions from Membersregarding a Pet Shop - Renewal for Tropical Fish.

DECISION NOTED.

HEARING TO CONSIDER RENEWAL OF TAXI DRIVER’S LICENCE – MR L MACHIN3. With reference to paragraph 3 of the Minute of 30 May 2014, there had been circulated copies of

an application submitted by Mr Lee Machin for the Renewal of a Taxi Driver’s Licence. Consideration of Application for Grant of Taxi Driver Licence

1 PURPOSE AND SUMMARY

1.1 This report advises Members (a) of the outcome of an appeal to theSheriff of their decision to refuse an application for the grant of aTaxi Driver Licence by David Richardson and (b) that they arerequired to consider the application of new.

1.2 The Committee refused the application at their meeting on 24 January 2014on the grounds that the applicant was not a fit and proper person to holdsuch licences.

1.3 The applicant appealed to the Sheriff who considered the matter and SheriffP Paterson issued Judgement on 20 March 2014 ordaining the Committee toconsider of new the application.

2 RECOMMENDATIONS

2.1 I recommend that the Committee:- (a) Note the outcome of theAppeal and (b) Determine the application in the light of theaccompanying documentation.

3 BACKGROUND

3.1 David Richardson submitted an application on 22 November 2013 to theCouncil for the grant of a Taxi Driver Licence. The redacted applicationaccompanies this report as appendix 1.

3.2 In accordance with the Civic Government Act 1982, the application wascopied to the Chief Constable, Police Scotland who stated that he could notsupport the application on the basis the applicant was not a fit and properperson in the light of the convictions as recorded per the police nationalcomputer. A copy of the Police report dated 19 December 2013 is appendedhereto as appendix 2 for consideration by Members.

3.3 The matter came before the Committee on 24 January 2014 when on amajority vote of 4 - 3 the application was refused on the grounds that theapplicant was not a fit and proper person.

3.4 The applicant’s solicitor submitted a request for a Statement of Reasonswhich was issued on 14 February 2014.

3.5 An appeal was served on the Council on 19 February 2014 by theapplicant’s solicitors.

3.6 The Appellant was granted Legal Aid to conduct the appeal.

3.7 Following a preliminary hearing on procedure before Sheriff P Paterson inSelkirk Sheriff Court on 20 March 2014 the Appeal was granted andremitted to the Council for determination of the application afresh.

.3.8 Accordingly to comply with the Court Judgement, Members are now

required to consider and determine the application.

4 IMPLICATIONS

4.1 Financial

There are no costs attached to any of the recommendations contained inthis report.

4.2 Risk and MitigationsShould the Committee fail to reconsider and determine the application theCouncil, as Licensing Authority will be in breach of a Court Order. By dealingwith the matter in accordance with this report the Court Order isobtempered.

4.3 EqualitiesNo policy decisions are required in the subject matter of the report

4.4 Acting SustainablyAs the subject matter of this report deals with obtempering a Court Orderthis is not a relevant consideration.

4.5 Carbon ManagementThere are no effects on carbon emissions.

4.6 Rural ProofingThis is a new or amended policy or strategy matter.

4.7 Changes to Scheme of Administration or Scheme of DelegationNo changes require to be made to either Scheme.

5 CONSULTATION

5.1 It is not appropriate or necessary for the report to be subject to Councilconsultation as the matter refers to the determination of a statutoryobligation of the Licensing Authority of an application.
