Comments:

The Owner is requesting to permit the construction of a pavilion, cabana, pool, and pool equipment with the above-noted variances. Development Planning staff conducted a site visit of the subject property on May 11, 2017. The property abuts an open space zone to the north and the proposed structures will be partially screened by proposed landscaping and an existing wood privacy fence along the east and west boundaries of the subject property. The proposed pavilion is open and unenclosed and complies with the height requirement of Zoning By-law 1-88. The proposal will not have adverse visual impacts on neighbouring properties. The Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable and appropriate for the development of land.

Recommendation:

The Development Planning Department recommends approval of the application.

a) The Owner and/or Applicant shall contact, directly, the Development Inspection and Lot Grading Division within the Development Engineering and Infrastructure Planning Department to obtain all necessary approvals, as applicable, for the proposed swimming pool construction and all accessory works.

b) City staff reserves the right to object or require greater setbacks if, upon detailed design review and/or pre-construction inspection, staff deems that the proposed setbacks may alter the existing grades in such a manner as to obstruct stormwater surface runoff drainage conveyance or cause any adverse effects on the subject and/or adjacent lands (i.e. nuisance ponding, flooding, scour, etc.). Final approved setbacks shall be determined per the Pool Enclosure Permit application review process in accordance with the City's accepted Lot Grading Criteria.

COMMENTS:

Alectra Utilities (formerly PowerStream) has received and reviewed the proposed Variance Application. This

review, however, does not imply any approval of the project or plan.

All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with Alectra making the work area safe. All construction work will be required to stop until the safe limits of approach can be established. In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be responsible for 100% of Alectra’s cost for any relocation work.
