Subject: Guma Pasauri limestone mine of Mls Monnet Ispat & Energy Ltdlocated at Villages Guma&Pausari, District Baloda Bazar,Chhattisgarh (252.552 Ha)- regarding TOR.

The Proposal reference No. IA/CG/MIN/30145/2015 was received in theMinistry on 18.08.2015. The Proposal is to determine the Terms of Referencefor which the proponent had submitted information in the prescribed format(Form-l) along with Pre-feasibility report.

2. The Proposal of Guma Pasauri limestone proposed By M/s MonnetIspat& Energy Ltd located at villages Guma & Pausari, district Baloda Bazar,Chattisgarh. The mining lease area is 252.552 ha, the proposed production ofwith a maximum rated capacity of 1.3 MTPA. The Geographical Co- ordinatesfor the mine site are Latitude - 21°35'10.9" to 21°36'22.9" N Longitude -82°03'17.2" to 82°04'33.2" E The mine site falls on Survey of IndiaToposheet No. 64K/2.

3. Total Mine lease area is 252.S52ha.lt will be a new open cast mine.Limestone will be used for captive use in Company's cement plant. Mining willbe mechanized open-cast method adopting a system of benches. WaterRequirement is 132cum/day. Total geological reserves are 117.24 MT andproved mineable reserve is 69.96 MT. The waste water generated within themine lease would be the sanitation waste water which would be disposed in

septic tanks. The waste generated will be mainly sub grade and Lateritictopsoil/waste. The total waste generated during plan period will be about1.390 MT and 6.996 MT in the mine life period. It was reported by pp thatthere is Reserve Forest 2.10 Km Dhabbadih, Latwa 12.2 km. Expected cost ofthe Project is Rs. 140Cr. No Court case is pending against the Project.

4. The proposal was considered in the EAC meeting held duringSeptember 22-24, 2015 wherein the Committee noted that there is a canalpassing through the lease area and a pond is located on the southernboundary. The habitation is adjacent to mine lease boundary and villagerswould be using these water resources. The Committee was of the view thatlooking to the sensitivity of the mining lease the TOR cannot be prescribedand suggested the PPto look for alternatives.

5. The PP submitted an online request for reconsideration of the projectafter modifying their proposal. This was considered in the meeting heldduring January 20-22, 2016 wherein the PPsubmitted following points:

(a) There are no ponds on south side of the mine lease area within 900 m.(b) The total ML area is not forest, as mentioned in MoEFs letter dated

06.11.2015. Only 25.071 ha revenue forest land is present within totallease area.

Cc) The PP informed that it is not possible to look for alternative site sincemineral occurrence is site spectre. The mine lease area is dulysanctioned by the Government of Chhattisgarh. The said mine wasallotted based on the feasibility of the proposed cement plant in thenearby area for which Detailed Project Report has already beenprepared, land-water survey completed and application for landacquisition, Railway siding, water allocation has also been submitted toconcerned authorities. Application for acquisition of private and govt.land falling within the mine area has also been submitted with theconcerned authority. Now, finding mine in the nearby vicinity is notpossible as the other available mineral bearing areas have already beenallotted to other companies.

Cd) Several promising limestone leases in the surrounding area havealready been allocated in the form of mining lease & PL to variouscompanies such as Ambuja, Ultratech, Emami, Lafarge, Shree Cementetc. surrounding the Gaitra mine lease, which were shown on a map bythe PP.

Ce) Considerable progress has been made on various aspects of this minesuch as grant of lease, approval of mining plan, completion of DGPSsurvey, application for land aquisition. Gram Sabha under Forest RightAct has been conducted successfully and necessary consent from thevillagers has been obtained for diversion of 25.071 ha revenue forestland.

(f) Progress for the cement plant has also been made w.r.t DPRpreparation, land-water survey completion and application for landacquisition, Railway siding, water allocation to concerned authorities.

6. The PP revised the earlier proposal. PP highlighted the major changeswhich are as under:

(a) To protect the villages outside the ML, the earlier proposed green beltof 7.5 m width has been increased to 45 m. Thus, increasing the barrierbetween the lease and the village by creating a buffer.

(b) No mining shall be done within a distance of 50 meter from theVillage/structure and control blasting technique shall be adopted withina distance of 300 meter from the village/structure.

(c) A safety zone of 45 m has been left around the canals and roads. Thiswas earlier not proposed for plantation but wUI now be plantedcompletely. Thus, the increase in plantation will increase bufferingcapacity of safety zone

(d) A through and through road has been left undisturbed to access theponds and canals

(e) Although three small ponds are Situated outside the ML area, PP istaking sufficient precautions as safety barrier of more than 50 m andplantation on the barrier.

(f) The PP explained that due to the above changes, the company hasincreased the plantation from earlier proposed 18.0 ha to 98.43 ha asper revised proposal.

(g) In the process of increasing safety zones, 12.35 mill.T (17.70/0 ) ofreserves will be lost to the PP. Life of mine has been reduced by 5years.

7. In addition PP submitted that specific measures shall be followed toensure that no damage occurs due to blasting. Blasting shall not be donewithin a distance of 50 m from the building, structures, etc. Controlledblasting techniques shall be adopted between 50-300 m from any villagehouses, structures, canal, etc. Ground vibration shall be kept within thepermissible limit of PPV as per DGMS norms. Whenever required, moist sandshall be used as the stemming materials and hole shall be blasted with propermuffling to arrest fly rocks. The PP proposed extra measures such as leavingwider than stipulated safety zones, plantation, controlled blasting, and supplyof water from mine sump to village ponds during mining if required, lining ofponds, leaving drainage and canals undisturbed and leaving public roadsundisturbed.

8. However, Committee was of the view that the area is agriculturally richwith 3 m deep fertile top soil and water bodies in the lease area forming anideal wetland ecosystem. The submissions of the PP that cement plant is atthe advance stage of development does not make it compulsive for theCommittee to prescribe the TOR to the project as limestone is easily available

mineral and pp shall look for some other site/source for procuring thelimestone. Based on the information furnished and presentation made by theProject Proponent and discussions held, the Committee rejected the proposalfor prescribing the TOR.

9. The proposal was examined in the Ministry and it is noted that land usepolicy is in the domain of State Government and herein this case, LOI formining is already granted by the State Government. The EACrecommendation to reject TOR on the ground that this is a fertile land andthere are water bodies nearby is not a substantive ground. There are manymining operations in fertile land and policy for conversion of land use regulatethis. The Ministry therefore prescribes the following TORs for undertakinqdetailed EIA study:

1) Year-wise production details since 1994 should be given, clearly statingthe highest production achieved in anyone year prior to 1994. It mayalso be categorically informed whether there had been any increase inproduction after the EIA Notification 1994 came into force, w. r.t. thehighest production achieved prior to 1994.

2) A copy of the document in support of the fact that the Proponent is therightful lessee of the mine should be given.

3) All documents including approved mine plan, EIA and Public Hearingshould be compatible with one another in terms of the mine lease area,production levels, waste generation and its management, miningtechnology etc. and should be in the name of the lessee.

4) All corner coordinates of the mine lease area, superimposed on a HighResolution Imagery/toposheet, topographic sheet, geomorphology andgeology of the area should be provided. Such an Imagery of theproposed area should clearly show the land use and other ecologicalfeatures of the study area (core and buffer zone).

5) Information should be provided' in Survey of India Toposheet in1: 50,000 scale indicating geological map of the area, geomorphology ofland forms of the area, existing minerals and mining history of the area,important water bodies, streams and rivers and soil characteristics.

6) Details about the land proposed for mining activities should be givenwith information as to whether mining conforms to the land use policy ofthe State; land diversion for mining should have approval from Stateland use board or the concerned authority.

7) It should be clearly stated whether the proponent Company has a welllaid down Environment Policy approved by its Board of Directors? If so,it may be spelt out in the EIA Report with description of the prescribedoperating process/procedures to bring into focus anyinfringement/deviation/violation of the environmental or forest norms/conditions? The hierarchical system or administrative order of theCompany to deal with the environmental issues and for ensuringcompliance with the EC conditions may also be given. The system ofreporting of non-compliances / viola,tions of environmental norms to the


Board of Directors of the Company and/or shareholders or stakeholdersat large, may also be detailed in the EIA Report.

8) Issues relating to Mine Safety, including subsidence study in case ofunderground mining and slope study in case of open cast mining,blasting study etc. should be detailed. The proposed safeguardmeasures in each case should also be provided.

9) The study area will comprise of 10 km zone around the mine lease fromlease periphery and the data contained in the EIA such as wastegeneration etc. should be for the life of the mine / lease period.

10) Land use of the study area delineating forest area, agricultural land,grazing land, wildlife sanctuary, national park, migratory routes offauna, water bodies, human settlements and other ecological featuresshould be indicated. Land use plan of the mine lease area should beprepared to encompass preoperational, operational and post operationalphases and submitted. Impact, if any, of change of land use should begiven.

11) Details of the land for any Over Burden Dumps outside the mine lease,such as extent of land area, distance from mine lease, its land use, R&Rissues, if any, should be given.

12) A Certificate from the Competent Authority in the State ForestDepartment should be provided, confirming the involvement of forestland, if any, in the project area. In the event of any contrary claim bythe Project Proponent regarding the status of forests, the site may beinspected by the State Forest Department along with the Regional Officeof the Ministry to ascertain the status of forests, based on which, theCertificate in this regard as mentioned above be issued. In all suchcases, it would be desirable fop representative of the State ForestDepartment to assist the Expert Appraisal Committees.

13) Status of forestry clearance for the broken up area and virgin forestlandinvolved in the Project including deposition of net present value (NPV)and compensatory afforestation (CA) should be indicated. A copy of theforestry clearance should also be furnished.

14) Implementation status of recognition of forest rights under theScheduled Tribes and other Traditional Forest Dwellers (Recognition ofForest Rights) Act, 2006 should be indicated.

15) The vegetation in the RF / PF areas in the study area, with necessarydetails, should be given.

16) A study shall be got done to ascertain the impact of the Mining Projecton wildlife of the study area and details furnished. Impact of the projecton the wildlife in the surrounding and any other protected area andaccordingly, detailed mitigative measures required, should be workedout with cost implications and submitted.

17) Location of National Parks, Sanctuaries, Biosphere Reserves, WildlifeCorridors, Ramsar site Tiger/Elephant Reserves/(existing as well asproposed), if any, within 10 km of the mine lease should be clearlyindicated, supported by a location map duly authenticated by ChiefWildlife Warden. Necessary clearance, as may be applicable to such

projects due to proximity of the ecologically sensitive areas asmentioned above, should be obtained from the Standing Committee ofNational Board of Wildlife and copy furnished.

18) A detailed biological study of the study area [core zone and buffer zone(10 km radius of the periphery of the mine lease)] shall be carried out.Details of flora and fauna, endangered, endemic and RET Species dulyauthenticated, separately for core and buffer zone should be furnishedbased on such primary field survey, clearly indicating the Schedule ofthe fauna present. In case of any scheduled- I fauna found in the studyarea, the necessary plan alongwith budgetary provisions for theirconservation should be prepared in consultation with State Forest andWildlife Department and details furnished. Necessary allocation of fundsfor implementing the same should be made as part of the project cost.

19) Proximity to Areas declared as 'Critically Polluted' or the Project areaslikely to come under the 'Aravali Range', (attracting court restrictions formining operations), should also be indicated and where so required,clearance certifications from the prescribed Authorities, such as theSPCB or State Mining Dept. Should be secured and furnished to theeffect that the proposed mining activities could be considered.

20) Similarly, for coastal Projects, A CRZ map duly authenticated by one ofthe authorized agencies demarcating LTL. HTL, CRZ area, location of themine lease w.r.t CRZ, coastal features such as mangroves, if any,should be furnished. (Note: The Mining Projects falling under CRZ wouldalso need to obtain approval of the concerned Coastal ZoneManagement Authority).

21) R&R Plan/compensation details for the Project Affected People (PAP)should be furnished. While preparing the R&R Plan, the relevantState/National Rehabilitation & Resettlement Policy should be kept inview. In respect of SCs /STs and other weaker sections of the society inthe study area, a need based sample survey, family-wise, should beundertaken to assess their requirements, and action programmesprepared and submitted accordingly, integrating the sectoralprogrammes of line departments of the State Government. It may beclearly brought out whether the village(s) located in the mine lease areawill be shifted or not. The issues relating to shifting of village(s)including their R&R and socio-economic aspects should be discussed inthe Report.

22) One season (non-monsoon) [i.e. March - May (Summer Season);October - December (post monsoon season) ; December - February(winter season)] primary baseline data on ambient air quality as perCPCB Notification of 2009, water quality, noise level, soil and flora andfauna shall be collected and the AAQ and other data so compiledpresented date-wise in the EIA and EMP Report. Site-specificmeteorological data should also be collected. The location of themonitoring stations should be such as to represent whole of the studyarea and justified keeping in view the pre-dominant downwind directionand location of sensitive receptors. There should be at least one


monitoring station within 500 m of the mine lease in the pre-dominantdownwind direction. The mineralog,ical composition of PMlO, particularlyfor free silica, should be given.

23) Air quality modeling should be carried out for prediction of impact of theproject on the air quality of the area. It should also take into accountthe impact of movement of vehicles for transportation of mineral. Thedetails of the model used and input parameters used for modelingshould be provided. The air quality contours may be shown on a locationmap clearly indicating the location of the site, location of sensitivereceptors, if any, and the habitation. The wind roses showing pre-dominant wind direction may also be indicated on the map.

24) The water requirement for the Project, its availability and source shouldbe furnished. A detailed water balance should also be provided. Freshwater requirement for the Project should be indicated.

25) Necessary clearance from the Competent Authority for drawl of requisitequantity of water for the Project should be provided.

26) Description of water conservation measures proposed to be adopted inthe Project should be given. Details of rainwater harvesting proposed inthe Project, if any, should be provided.

27) Impact of the Project on the water quality, both surface andgroundwater, should be assessed and necessary safeguard measures, ifany required, should be provlded.

28) Based on actual monitored data, it may clearly be shown whetherworking will intersect groundwater. Necessary data and documentationin this regard may be provided. In case the working will intersectgroundwater table, a detailed Hydro Geological Study should beundertaken and Report furnlshed. The Report inter-alia, shall includedetails of the aquifers present and impact of mining activities on theseaquifers. Necessary permission from Central Ground Water Authority forworking below ground water and for pumping of ground water shouldalso be obtained and copy furnished.

29) Details of any stream, seasonal or otherwise, passing through the leasearea and modification / diversion proposed, if any, and the impact of thesame on the hydrology should be brought out.

30) Information on site elevation, working depth, groundwater table etc.Should be provided both in AMSL and BGL. A schematic diagram mayalso be provided for the same.

31) A time bound Progressive Greenbelt Development Plan shall be preparedin a tabular form (indicating the linear and quantitative coverage, plantspecies and time frame) and submitted, keeping in mind, the same willhave to be executed up front on commencement of the Project. Phase-wise plan of plantation and compensatory afforestation should becharted clearly indicating the area to be covered under plantation andthe species to be planted. The details of plantation already done shouldbe given. The plant species selected for green belt should have greaterecological value and should be of good utility value to the local


population with emphasis on local and native species and the specieswhich are tolerant to pollution.

32) Impact on local transport infrastruCture due to the Project should beindicated. Projected increase in truck traffic as a result of the Project inthe present road network (including those outside the Project area)should be worked out, indicating whether it is capable of handling theincremental load. Arrangement for improving the infrastructure, ifcontemplated (including action to be taken by other agencies such asState Government) should be covered. Project Proponent shall conductImpact of Transportation study as per Indian Road Congress Guidelines.

33) Details of the onsite shelter and facilities to be provided to the mineworkers should be included in the EIA Report.

34) Conceptual post mining land use and Reclamation and Restoration ofmined out areas (with plans and with adequate number of sections)should be given in the EIA report.

35) Occupational Health impacts of the Project should be~oticjpated and theproposed preventive measures spelt out in detail. Details of pre-placement medical examination and periodical medical examinationschedules should be incorporated in the EMP. The project specificoccupational health mitigation measures with required facilitiesproposed in the mining area may be detailed.

36) Public health implications of the Project and related activities for thepopulation in the impact zone should be systematically evaluated andthe proposed remedial mea ures should be detailed along withbudgetary allocations.

37) Measures of socio economic significance and influence to the localcommunity proposed to be provided by the Project Proponent should beindicated. As far as possible, quantitative dimensions may be given withtime frames for implementation.

38) Detailed environmental management plan (EMP) to mitigate theenvironmental impacts which, should inter-alia include the impacts ofchange of land use, loss of agricultural and grazing land, if any,occupational health impacts besides other impacts specific to theproposed Project.

39) Public Hearing points raised and commitment of the Project Proponenton the same along with time bound Action Plan with budgetaryprovisions to implement the same should be provided and alsoincorporated in the final EIA/EMP Report of the Project.

40) Details of litigation pending against the project, if any, with direction/order passed by any Court of Law against the Project should be given.

41) The cost of the Project (capital cost and recurring cost) as well as thecost towards implementation of EMP should be clearly spelt out.

42) A Disaster management Plan shall be prepared and included in theEIA/EMP Report.

43) Benefits of the Project if the Projectis implemented should be spelt out.The benefits of the Project shall clearly indicate environmental, social,economic, employment potential, etc.


44) Besides the above, the below mentioned general points are also to befollowed: -

a) All documents to be properly referenced with index and continuouspage numbering.

b) Where data are presented in the Report especially in Tables, theperiod in which the data were collected and the sources should beindicated.

c) Project Proponent shall enclose all the analysis/testing reports ofwater, air, soil, noise etc. using the MoEF&CC/NABL accreditedlaboratories. All the original analysis/testing reports should beavailable during appraisal of the Project.

d) Where the documents provided are in a language other than English,an English translation should be provided.

e) The Questionnaire for environmental appraisal of mining projects asdevised earlier by the Ministry shall also be filled and submitted.

f) While preparing the EIA report, the instructions for the Proponentsand instructions for the Consultants issued by MoEFvide O.M. No. J-11013/41/2006-IA.II(I) dated 4th August, 2009, which are availableon the website of this Ministry, should be followed.

g) Changes, if any made in the basic scope and project parameters (assubmitted in Form-I and the PFR for securing the TOR) should bebrought to the attention of MoEF&CCwith reasons for such changesand permission should be sought, as the TOR may also have to bealtered. Post Public Hearing changes in structure and content of thedraft EIA/EMP (other than modifications arising out of the P.H.process) will entail conducting the PH again with the reviseddocumentation.

h) As per the circular no. J-110'll/618/2010-IA.II(I) dated 30.5.2012,certified report of the status of compliance of the conditionsstipulated in the environment clearance for the existing operations ofthe project, should be obtained from the Regional Office of Ministryof Environment, Forest and Climate Change, as may be applicable.

i) The EIA report should also include (i) surface plan of the areaindicating contours of main topographic features, drainage andmining area, (ii) geological maps and sections and (iii) sections of themine pit and external dumps, if any, clearly showing the landfeatures of the adjoining area.

10. The EIA report should also include (i) surface plan of the area indicatingcontours of main topographic features, drainage and mining area, (ii)geological maps and sections and (iii) sections of the mine pit and externaldumps, if any, clearly showing the land features of the adjoining area.

11. The prescribed TORs would be valid for a period of three years forsubmission of the EIA/EMP reports, as per the O.M. No. J-11013/41/2006-IA.II(I) dated 07.11.2014.


12. After preparing the draft EIA (as per the generic structure prescribed inAppendix-Ill of the EIA Notification, 2006) covering the above mentioned.lssues, the proponent will get the public hearing conducted and take furthernecessary action for obtaining environmental clearance in accordance with the
