Needed Business.
Pursuant to n call issued by all ofthe members of .thn board of Super-visors the entire board met in theollico of the County Clerk Saturdaymorning for the purpose of appoint-ing road overseers and the transac-tion of other needed business.
Supervisor W. P. Ilaia moved thesuspension of the rules and that the
mattorof appointing the road overseers lie taken up. This motion wasseconded by T. T. Meyer and carried.
Ilaia moved the apiHrintment ofP. Witrock as road overseer for
liana. The motion was secondedby Meyer and carried.
Ilaia moved the appointment ofF. Somerfeld as road overseer forWailuku. The motion was seconded by Meyer. T. 15. Lyons movedthe appointment of Thomas Clarkas road overseer which motion wasseconded by Kauhi. The vote wasstrictly a party vote and was deeided by the chair in favor of Sotnmer- -
feld.

When the matter of the bonds forthe various ollicers came up for con-
sideration Chairman W. F. Poguegave notice that he would not servounder resolution number 82 whichmade each supervisor coresponsiblewith the road overseer of his dis- -
trict. He said that the. road work
should be in the hands of the road.overseer and that that officer shouldbe responsible to the Hoard for hisacts but that the individual super-
visors should not butt in on workof that kind.
Tho bonds of Keliinoi and Groves,were received and accepted.
A communication from CountyAttorney J. L. Coke was read andho was. excused from attendance atthe special meeting of the board.
A resolution was introduced by
. Ilaia requiring each road overseer tofile his bond and oath of oflico withthe County Clerk not later than thenext regular meeting of the board.
At this point Supervisor Lyonsregistered a kick because of the re-
ceipt of a written opinion from theCounty Attorney. He objected tothe, reading of the opinion. Chair-
man Pogue stated that he had notseen the opinion nor knew any thingof its nature. lie said that' he, asan ollicer had requested an opinionfrom the County Attorney and thathe had a right to request an opinion.Lyons said that ho objected to anymember requesting an opinion. liesaid that any opinion requestedshould be done by the. lioard andnot by a single member. At thisnovel statement there was a generalsmilo. The opinion was gotten ridof in a most unusual way. In response to your verbal requestfor an opinion from me as to thelegality of the special meeting pro-
posed to be hejd by you upon thisdate, I beg to say that assuming thefacts to be that this meeting wascalled by the Chairman of yourHoard, and not by a majority of theBoard, and further assuming it tobo that neither tlio County Clerk ofthe County of Maui, nor any deputyCounty Clerk is at present withinthe County of Maui, I am of theopinion that such meeting is notlegally called, and that the transac-tion of any business by your Hoardat such meeting would be null andvoid.
Section (Hi of the County Act provides inter alia as follows:
"Tho Hoard shall hold regularmeetings and itshall call such special meetings, asmay be necessary for tho public we-
lfare." ' ,
It clearly appears that this doesnot confer authority upon any onemember of tho Hoard the . right tocall a special meeting. All specialmeetings must be called by theHoard, and as I take" it meaning amajority of the Hoard. The call forthe meeting not being conformableto the provisions of the section justcited, no business can be legallytransacted at said meeting.
The absence of the Clerk or anydeputy, in my opinion, also wouldinvalidate the proceedings of themeeting.

Knew Him.
Rev. Dr. Edward Griffin Heckwith of llamakuapoko who died atPaia hospital during tho early mornmg of the 3rd was universally beloved for liis good works, his highcharacter, his purity of mind, hisnobility of soul.
He loved his fellowmen and theyloved him whether as teacher.preacher, or citizen.
As a citizen he loved his countrymuch, was intensely patriotic. Ik-wa-s
always desirous to exercise theright of suffrage esteeming it notonly a duty but a pleasure.
No one of his congregation canever forget the eloquence of hisThanksgiving sermons ,in praise ofhis native land; nor can any of his'auditors fail to remember hispatriotic address delivered at Paiachurch at the public reception toSenator Cullom and CongressmanIlitt.
As a teacher he was unexcelled.He was the second president ofOahu College and did much ineducating and training many of theprominent men of the Territory.

temporaries in Hawaii nei, thechildren of the Hawaiian mission,were educated by Dr. Beckwith atPunahou.
He was the minister of a churchin the .Mission District of San Fran-
cisco of tho Central Union churchof Honolulu, and of the MakawaoUnion church. As a preacher aswell as a speaker he was mosteloquent. He was simple and directin his theology and in his methodsof thought. He was not . ah ex-
ponent of the higher criticism andhad little liking for advancedphilosophical .thought as ipplied totheology.
In his beliefs he was orthodox butnot bigoted. Ho was a line type ofthe New England Puritan which hewas by birth and training. Histeitderness, his sympathy, hisehavj-t- y
for the weakness of human naturewere predominating traits of charac-ter. "With malice toward none andcharity for all" especially "appliedto Dr., Beckwith.
In his social life he exhibited thecourtesy of the old time gentleman.He was slow to anger and longsuffering. One of his most con-
spicuous qualities was his .spirituali-ty, his unshaken belief in the im-
mortality of tho soul and allChristian teachings. His more thanfour score years have been wellspent.
Dr. Beckwith was born at GreatHarrington, Mass, Nov. Kith, lS2(i.Ho had two brothers and one sister:Daniel, Morris and Martha. Daniel,tho older brother is still living inthe old homo village at the ago ofSo as is also the sister.
Morris lived for many years inthe Ilawaiiian Islands, teachingduring the early years at the RoyalSchool, in Honolulu, with hisbrother, Edward.
Dr. Beckwith graduated fromWilliams College, after which hetaught a year at West field, Mass.

fluential Church.In 1S7S the Beukwitlis returned
once more to California and wentback to the old Third Congregationalchurch. Here he built a nowchurch and dedicated it free of debt.He served his church for nine-years- ,
coming to Honolulu in 1S.S7. Atthis time Bethel church and the oldFort Street church wanted to unite.Dr. Beckwith was unanimouslycalled as Pastor.. It was Dr. Beck-with who built, the present CentralUnion Church and though it costmore than 12.ri,()00 he dedicated itfree of debt, Every man, womanand child in the congregation, hada hand in raising the. money.
Dr. Beckwith feeling the burdentwo great for him during theseyears, came to Maui in 18!) 1 andfor eleven years ho endeared himselfto all on Maui as' tho Pastor of theMakawao Union Church. Messrs.Bazata and Turner have since fol-
lowed Dr. Beek.vith as pastors ofthis church.
Dr. Beckwith was. universally be-
loved by all who knew hiin amicusfriends were legion among everynationality. His death removes oneof the land marks of our Islands.

An Important One of tho most important measures now beforeMeasure. the Legislature is tho bill introduced by Representative E. H. Carloy for the relief of the drouth stricken districtof Kula. Kula is the district of independent homes. A districtwhere many residents own their own lands and till the same and
in former years succeeded in making a comfortable living for them-
selves and their families. Here is the nucleus of a large numberof independent homes occupied by families whose in thecommunity are tixe1. and permanent. Hero were conditions that
are held up by the press as ideal. The politicians have advocatedthe assistance iy the government of various com tn unities in thehope of bringing about such conditions and even the ministers look
to this class for better citizenship.In the course of time it is found that, there is not sullicient, water
for the people In that community. The Republican party of thewhole county goes on record as favoring tho building of a pipe line
for the relief of the community. The Supervisors of the County
appropriated sufficient funds for tho purpose of having the line
surveyed and the matter was then presented to the Legislature. Ifthere is any apathyshown on the part of any member trom theCounty of Maui after the needs of the residents of that strickendistrict have been thoroughly explained such a member from eitherbranch need never attempt to run for office again in the Oounly.
The editor .of this paper was on official business in kula a yearago this month. He knows that at that time the people refused to
sell a bucket of water there for fifty cents per gallon for the horsesthat were used in making the trip to that stricken dist rict. As timewent on conditions became worse and hundreds of people w-
compelled to leave the district and their "homes and seek employ- -
ment on the plantations.If there is any sincerity in the cry for small farmers then let
every advocate of the principle be consistent and lend a hand to
help this measure through.If it costs a hundred thousand dollars nppripriate that sum.

Liauor Laws. that in effect would "make the liquor traffic
of the territory a wide open proposition.Under its provisions any one could conduct a saloon any place
for a period of a year without danger of being molested. Itsimply a scheme to make the traffic a wide open one and should beopposed by all decent citizens.
The present liquor law gives to the commissioners discressiouarypower and by this means any one who is not, thought to be a person of good character or one who will not conduct an orderly place
'of business is refused a license. It is possible that this discressionary power may be abused in which case the governor should
be appeled to and he under his oath of office should remove thefending commissioners and appoint men of hrm but broad viewon the liquor question

Deputy Sheriffships.
Honolulu, March 2. It lias beenintimated that one of the bills tohe introduced into tho House thisweek will he one to do away withthe election of deputy sheriffs,making them appointees of theSheriff of each county. It is con-
tended that as long as the deputysheriffs are to bo subordinate toand responsible to tho Sheriff theyshould be nominated by him andso appointed that he may removethem for cause without having tosecure an impeachment before theBoard of Supervisors.
If this bill passes it will meanthe throwing out of the present billto create confusion in police affairsby giving the deputy sheriffs theright to appoint the police officersserving under them, the men to beapproved of by the Sheriff, or, if
his approval is withheld, by theBoard of Supervisors. This billwould extend petty politics stillfurther into the police forces of thecounties and under such conditionsis prevail at present in Oaim v:uldthoroughly disorganize the countrypolice force.
The tendency of the presentLegislature seems to he to give theSheriffs more extended powers andlimit the powers of the deputies.Under the bills introduced into theHouse yesterday, the Sheriffs aremade wardens of the county jailsand placed in charge of all convicted persons not committed to theTerritorial penitentiary.

Waiwaioleof Wailuku, thatis being most bitterly denouncedby soms of the leading citizens ofMaui as being most detrimental tothe welfare of the laboring men ofthe county. This is bill number41. No possible good can comefrom the enactment of the bill forthe simple reason that in no casecan the laborers get their pay morefrequently nor in a shorter periodof time under tho proposed law
than they do under the presentlaw.
The bad feature of the law isthat the date set for the Joardmeetings is such that it will be animpossibility to get the pay rollsand bills in time for the boardmeetings under the proposed lawand as a consequence there will bono pay for the laborers for theouter districts such as liana andMolokai at such times as the lirstWednesday falls on or near thelirst of the month.
Maui County is composed of sevoral islands and is not so situatedin respect to r6ads and other meansof conveyance as are the othercounties. For this reason therewas a special request by the lastBoard of Supervisors for the enactment of tho law as it now stands.This request was a unanimous request by the whole, board andthrough their efforts a bill that wasfathered by Coelho was killed andthe present law was enacted.
Just why Waiwaiolo .came tolend his name to such a viciousscheme is hard to see. It is notthought here that RepresentativeWaiwaiole either drew up, or fater- -
ed tho bill as one of his own measurers but that it is more likelythat he has introduced the bill atthe request of some. one whom hebelieved to be a friend when rife amatter of fact it is a caso of thehand of Esau but the voice ofJacob.

publican County Central Commit-tee of the County of Maui was heldat the Republican Headquarters atWailuku; County of Maui, on the10th day of January, 1907, for alike purpose, at which were presentby invitation members of theBoard of Supervisors and Heads ofDepartments of tho County ofMaui and other prominent citizens,at which meeting the Hon. W. J.Coelho acted as Secrotary; and
Whereas at said meeting, a reso-

Whereas, it appears from the actrecently passed by the Legislaturenow in session that the honorable tomembers thereof have not beenproperly informed of the nature ofsaid recommendations, from the onefact that the said act so passedutterly fails to attain the object in-

Whereas, the main object desired in said recommendations was toprovide sulllcient time between theclosing day of each month and thedate ol the subsequent meeting toenable the ollicials in the variousoutlying districts, some of themresiding on separate islands, pro-
perly to prepare reports of workand expenditures, and to make outand have signed payrolls and bills,and
Whereas, under the present actthis is ivbgolutely impossiblo whenthe da to of the meetings of theBoard of Supervisors falls, as it ofnow frequently does, and hereafterwill, on the first, second, third. infourth or fifth day of the month,owing to the great distance to be orovercome, with uncertain modes oftravel, and infrequent mail servicefor the outlying districts, and
Whereas Wednesday is the mostconvenient day of the week forsaid meetings, on account of thetune of the regular steamers fromthe outlying districts; and
Whereas, it is impracticable forthe Board of Supervisors of theCounty of Maui to meet oftener onthan oncb in each month for thereason that then, in such event, theSupervisors from the Districts ofMolokai and liana would "be roquired practically to maintaintheir residences at the County seat,contrary to the provisions of section 17, Chapter 7, of Act 89 Session Laws of 1905; and
Whereas, the temporary expedi'ent adopted by the Board of Super'visors of the County of Maui ofclosing the fiscal month on tli25th day of each month, while imperative under the present Act, isnot satisfactory in that it leads tomuch confusion in preparing reports, payrolls, and bills and re issults in niuehtllssatisfaction amonglaborers, as well as annoyance to ofthose supplying materials to theCounty.
Now Therefore, Be it resolved by onthe Board of Supervisors of theCounty of Maui, in 'regular sessionassembled, that the llonorablomembers of the Senate and theHouso of Representatives and HisExcellency tho Governor of theTerritory of Hawaii be and theyhereby are respectfully petitioned ofto prepare, pass and sign, respec-tively such an Act or an amend-ment

Your Chairman has requested anopinion from mo relative to the fol-
lowing questions.Can a Supervisor legally act as
Road Overseer under the provisionsResolution No. 82 passed at the
last meeting of your Board, eitherthe District of Makawao where a
Road Overseer has been appointedin the several Districts wherein a
road" overseer has not been appoint-ed? I would answer all these questions in the negative, and I take itthat the District of Makawao is inthe same position that the other,Districts are at the present time, by
reason of the fact that although aroad overseer was appointed, suchoverseer could not up to the presenttime assume the duties of his office

solution No. 82 provides, that be-
fore entering the duties of his office,each olficial shall give bond to theCounty, the sufficiency of whielshall be approved by the Board ofSupervisors. No such bond havingbeen given, and approved by theBoard to the present date, the over-- .seer appointed for the District ofMakawao could not legally act assuch under the law. It then followsthat no road pverscor is qualified toact within the County of Maui, andthat this state of affairs has existedsince the adoption of said Resolution No. 82. And the office of RoadOverseer created by said' Resolution
vacant 'throughout the County.This would leave no one in charge
a very important department ofthis County if the Supervisors by
the general authority conferred upthem by the County Act and by
the further authority conferred by
the resolution above referred to donot give them the right to carry onthe maintenance of the roads duringsaid period.
It seems to me that it would be avery serious and peculiar condition
affairs if no one would have theauthority to act during a contingency
this nature.Could it be contended that in a
case where a road absolutely necessary to public travel become washedout or impassable in some othermanner that no one could turn ahand to repair this road nnd puttho same in condition to be used by
tho public.I do not believe that this is the
case and I am of the opinion thatthe Supervisors of their respectivedistricts have authority. to carry onthe road work, not as road overseer,but as Supervisor of the County,until road overseers are appointedand qualified.
I would suggest that the clauso inResolution No. 82 providing that
bonds of the officials be approv-ed by tho Board of Supervisors bechanged, and that such bonds bemade approvable by some othercounty official for the reason thatthe Board might not bo in sessionwhen these bonds arc submitted andthe oHice then would have to re-
main vacant until nnother meetingtho Board, which might greatly
delay the road overseers in takingoffice, ,

Road overseer Groves reportedthat but two laborers under himwanted their pay oftener than once
month.The sanding of tho road in tho
Makawao district was authorized.A telephone was ordered put in
for the road overseer's foreman inthe Makawao district and one in theliana district.
The matter of a county telephonesystem for the island of Molokai wasdiscussed. The question of installing a line frolirKaunukakai to Wai- -
alua for the exclusive use of thocounty ollicials is what is desired.The distance that the line will have-t-
be built is about twenty miles.The County Engineer was instruct-ed to prepare specifications for thenext meeting.
A communication from the Gover-
nor stating that it is practically im-
possible to allow any prisoners here
at this time for use on the publicroads was received. The Governorstated however that in about sixmonths from now, on completion ofthe volcano road, that it would pro-
bably be possible to grant the request.The board authorized the leasing
of the offices over the bank for theuse of the County Engineer and theroad clerk. The offices formerlyused by the County Engineer will beused by the County Attorney.
The meeting adjourned in ampletime for the supervisors for a dis-
tance to get to their respectivesteamers.
Rains Brings
ProsperityLahaina Rejoices as Rain

The late rains have done wondersfor Lahaina district. The reeivoirs,ditches and streams of Pioneer plan-
tation are still full of water. Hun-
dreds of dollars are saved now whichin a dry season would have beenspent in pumping. Tons and .tonsof cane are rushed down the flumesfor long distances by tho force ofwater. The plantation never lookedbetter.
Beyond this plantation the twocattle ranches show signsof a revival'of living beef and bone. Tho bigllonolua ranch is green again andthe three thousand' head of cattle aregetting in good condition. On ac-
count of abundance of water, careand the extent of the ranch, veryfew cattle suffered in llonolua dur-ing the. past dry season.
Mr. It. C. Searle manager of thellonolua ranch is now taking off hiscoffee crop. High wages and cheapcoffee have ruined many plantationsin Hawaii but Mr. Searle is not theman to throw up an industry thatmay yet pay handsomely. Ho hasone hundred and twelve acres nowred with beautiful large berries. His,mill is one of the most modern inthe islands. He aimcs at producingfirst class coffee which he ships '.
