International Flight Plans Flight plan required—A flight plan for flights into international and foreign airspace must be submitted to and received by air traffic control facilities at least one hour before entering the ATC region. Advance notice—The flight plan provides advance notice of foreign airspace penetration. (For some foreign states, the flight plan is the only advance notice required; for others, it checks against previously granted permission to enter national airspace.) Before departure—Leave a complete itinerary and time schedule of the flight with others directly concerned, keep them advised of the flight’s progress, and instruct them to contact the nearest U.S. embassy or consulate if there is any doubt as to the safety of the flight. Filing outside the United States—In a foreign country, inquire how to transmit flight plan information to pertinent en route and destination points. Notification must be made by calling 888/CAN-PASS (888/226-7277) two to 72 hours in advance of arrival. Pilots and passengers are still required to carry the necessary personal identification, immigration, and aircraft documents. Application—United States citizens, resident aliens, and Canadian citizens may apply for participation in the CANPASS program by completing a CANPASS application form. Special Reporting RequirementsGeneral

Private aircraft entering the United States from south of theMexican border or Pacific, Gulf of Mexico, or Atlantic coastlinesmust comply with special reporting requirements.

How to complyAdvance notice—Upon return to the United States from theSouthern Hemisphere (south of 30 degrees north latitude and eastof 86 degrees west longitude on the Atlantic and Gulf coasts, andalso south of 33 degrees north latitude and west of 86 degrees westlongitude on the Pacific Coast), provide advance notice of arrivalto U.S. Customs at a designated airport that is nearest to the pointof crossing the U.S. border or coastline.Inspection—Private aircraft must land at the designated airportfor Customs and Border Protection (CBP) inspection andprocessing unless the aircraft has been exempted from thisrequirement. These airports offer free service 24 hours a day,Monday through Saturday. This landing requirement does notapply to private aircraft that have not landed in a foreign place orthat are arriving directly from Puerto Rico.Time of notification—Provide advance notice of arrival at leastone hour prior to crossing the U.S. coastline or border. Moreadvance notice may be required during other than regularbusiness hours.Notification information—Must include:

1. Aircraft registration number.2. Name of pilot in command.3. Place of last departure.4. Estimated time and location of border/coastline crossing.5. Name of U.S. airport of first landing.6. Number of U.S. citizen passengers.7. Number of resident and nonresident alien passengers.8. ETA.

How to provide notification—Contact Customs via telephone andinclude an ADCUS notice in your flight plan. However, the ADCUSnotation in the flight plan does not guarantee that Customspersonnel will receive the ETA notification. ETA notification isyour responsibility. It is therefore strongly suggested that youadvise Customs of your ETA by telephone to ensure they havebeen notified, and that you ask for the name and badge number ofthe Customs official.ADIZ penetration notice—When not arriving from a foreignlocation but crossing the boundary of the air defenseidentification zone (ADIZ), you are required to give air trafficcontrol a 15-minute penetration notice. File a defense visual flightrules (DVFR) flight plan, and contact Customs via telephone atleast one hour prior to crossing the border or coastline.Note: See Chapter 5, Section 6, of the Aeronautical InformationManual (AIM) for detailed information on ADIZ operations andboundaries.

U.S. Customs and Immigration Requirements and Regulations

Outbound travelCustoms clearance—Pilots and passengers on nonrevenue flightsare normally not required to clear Customs when leaving theUnited States. However, certain countries require Department ofState and Department of Commerce validated licenses and pre-clearances.Customs declaration—Declare currency in excess of $10,000.Nonresident alien—All nonresident aliens must clear U.S.Citizenship and Immigration Services (USCIS) prior to departure.Resident alien—All resident aliens must carry an AlienRegistration Card for presentation to U.S. Immigration uponreentering the United States.Certificate of registration (personal effects)—Customs officialsmight question any personal articles of foreign manufacture (suchas cameras, hunting and fishing gear, or any item that may beconstrued as having been purchased abroad). Before departure:

1. Register these items with Customs.2. Fill out Customs Form 4457, “Certificate of Registration for

Personal Effects Taken Abroad.”3. Bring several copies of the form along to the foreign port of

entry.4. Show this certificate to Customs officers each time the items

are declared.Note: It is not mandatory to file this form, but it can eliminateunnecessary duties, delays, and disagreements upon return to theUnited States.

Inbound travelCustoms airports—All aircraft entering the United States mustland at a U.S. Customs and Border Protection airport. Theseairports are referred to as “designated,” “international,” “landingrights,” and “user fee” airports. They are listed in the followingdirectory of “U.S. Customs and Border Protection Airports.”Advance notice of arrival—Pilots must provide advance notice ofestimated time of arrival (ETA) to Customs. (It is the ultimateresponsibility of the pilot to ensure that Customs is properlynotified.) Customs and immigration inspection—Pilots and passengersmust clear U.S. Customs and Immigration inspection.Customs declaration—Declare any articles acquired abroad.Include items brought home for another person, any articleintended for sale or use in business, alterations or repairs madeabroad, and gifts received while abroad. Remember to declarecurrency in excess of $10,000.Duty and tax—Items may be subject to duty and internal revenuetax.Exemptions—Returning residents are allowed certain exemptionsfrom paying duty on items obtained while abroad. Theseexemptions are described in a booklet titled Know Before You Go,published by the Department of the Treasury, U.S. CustomsService. Call AOPA’s Pilot Information Center to obtain a copy.Note: Customs Declaration Form (used for travel inbound or outbound)is available at www.aopa.org/members/files/travel/customs/7507.pdff(AOPA members only access).

How to provide advance notice of ETAAdvise Customs—Advise Customs of your ETA by telephone andflight plan. Normally, one-hour advance notice (based on the timethe CBP officer receives the notification and not on the time thatthe flight plan or message is filed or transmitted by the pilot) issufficient. Failure to do so violates Customs regulations and willresult in a severe penalty (see “Fines”).Telephone numbers—Customs telephone numbers are includedin the following listings of “U.S. Customs and Border ProtectionAirports” or in the U.S. Customs Guide for Private Pilots[www.cbp.gov/xp/cgov/toolbox/publications/travel]. A 24-hournational emergency number is available in the event you cannotreach Customs at your intended airport of arrival; telephone800/973-2867.ADCUS—You may also advise Customs of your ETA by adding theabbreviation “ADCUS” (advise Customs) to the “remarks” sectionof your flight plan.

Landing rights airportsA landing rights airport is an airport (other than a designatedairport, international airport, or user fee airport) at which flightsfrom a foreign area are given permission by U.S. Customs andBorder Protection (CBP) to land. In addition to providingadvance notice of arrival, pilots must obtain specific permissionto land at a landing rights airport before intended use. Except forshort flights, advance notice of arrival may be transmitted to CBPin the ADCUS section of flight plans at airports where flightnotification service is available. These notices will be treated asan application for permission to land, although the pilot is stillultimately responsible for ensuring that CBP is properly notified.Landing rights may be denied if inspection service cannot beprovided.

User fee airportsA user fee airport is an airport designated by U.S. CBP whereflights from a foreign area may be granted permission to land.Private aircraft operators using designated “user fee” airports arefrequently required to reimburse the airport operator for the costsassociated with processing their arrivals. These costs may well runfrom $100 to $300 or more per arrival.

Changed destinationPermission—If you need to change the intended airport ofdestination en route, obtain permission from Customs.Confirmation—Receive definite confirmation from Customspermitting a change before altering the airport of destination.Without this permission, you may not legally land at an airport notspecified in your flight plan.How to obtain permission/confirmation—Contact ATC or FSSpersonnel and ask them to relay the message to Customs and togive notification when Customs confirms the request.

HoursService hours—Free service is gererally provided from 8 a.m. to 5 p.m.,Monday through Sunday, including holidays. Tours of duty at airports,however, are based on the need for service and are altered at someairports to coincide with schedule changes and peak work loads.Note: Prior to departure, contact the Customs officer in charge at theU.S. airport of intended return to ascertain the hours during whichfree service normally can be expected.

OvertimeFee—Private aircraft will be processed free of overtime charges byU.S. CBP. However, other inspection agencies (U.S. Department ofAgriculture, Centers for Disease Control, and U.S. Immigration andNaturalization Service) may charge overtime for services providedafter regular working hours.

U.S. CBP aircraft user fee decalProcessing fee—$25 per calendar year. This fee must be paid inadvance. Submit form CF 339-A with payment to U.S. CBP, DecalProgram Administrator, P.O.Box 382030, Pittsburgh, PA 15250-8030.Receipt/decal—Upon payment, you will receive a receipt and adecal to be displayed on the aircraft 18 inches aft of the pilot’sdoor.
