    This Agreement is made up of Part A (the School’s offer) and Part B (the Caregivers’ acceptance).

    This Agreement is made between The Peninsula School ACN 004 451 192 trading as Peninsula Grammar and referred to in this document as the “School” and the Caregivers named in Part B.

    D E F I N I T I O N S “Administration Charge” means the fee specified in the Regulations and set out in the Fee Statement and charged in accordance with clause 7 where fees remain unpaid at the end of thirty (30) days after the date of issue of an account

    “Agreement” means this Agreement, and any subsequent variations as advised in writing between the School and the Caregivers. The Caregivers shall be deemed to have consented to such variations if those variations are:

    a. not substantial; or

    b. substantial, but the Caregivers do not exercise their rights within the prescribed period, pursuant to clause 18 of this Agreement.

    “AGSV” means the Associated Grammar Schools Victoria.

    “Airport Transfer” means the fee charged by the School for each trip where a student is transported to or from Melbourne Tullamarine Airport.

    “Billing Dates” means the issue date of the accounts for Fees which are charged in two instalments per year with monthly accounts for any other supplementary charges not otherwise charged. The billing dates are the dates specified annually in the Regulations and set out in the Fee Statement.

    “Boarding Fees” means the fees specified in the Regulations and set out in the Fee Statement for boarding facilities provided by the School to the Student where applicable.

    “Boarder Retreat Fee” means the fee payable for the yearly retreat to be attended by the student.

    “Capital Development Levy” is the annual fee set out in the Regulations and set out in the Fee and Statement and charged per family by the School to create funds to be used by the School to maintain and develop the School’s grounds and facilities.

    “Caregivers” means the person or persons named as “Caregivers”, “whether parents, guardians or other relationship and unless advised otherwise in writing are the person or persons authorised to deal with the School on all issues relevant to the student and the student’s enrolment at the School. Each Caregiver to this Agreement is deemed to be a Financial Caregiver unless notification in writing to the contrary is provided to the School and agreed to by the School in writing.

    “CRICOS Provider No.” means the identifying number allocated to the School by the Commonwealth Register of Institutions and Courses for Overseas Students referencing the School as a registered provider of courses of study to Overseas Students.

    “CRICOS Code” means the code allocated to a registered program offered to international students studying in Australia on student visas.

    “Discount” means any discount allowed in relation to the Fees including Family Discount, bursaries or any other fee reduction referred to in the Regulations from time to time.

    “DOHA” means the Department of Home Affairs and any successor department responsible for immigration matters and for matters arising from the ESOS Act

    “Enrolment Fee” means the non-refundable and non-transferable fee as set out in the Regulations and Fee Statement and paid when an Application to Register for Enrolment is completed with the School.

    “Entrance Fee” means the non-refundable and non-transferable fee specified in the Regulations and Fee Statement payable upon the Student’s acceptance into the School and enrolment.

    “ESOS Act” means the Education Services for Overseas Students Act 2000 as amended from time to time.

    “Excursion Levy” means the compulsory fee charged to a boarding student to cover the costs of all compulsory excursions for the student in the boarding house.

    “Extra Subject” means a subject not included in the prescribed curriculum.

    “Family Allowance” means the family discount referred to in clause 6.

    “Fees” means any amount charged to the Financial Caregivers by the School, including, without limitation, Enrolment Fees , Entrance Fees, Tuition Fees, Boarding Fees, Boarder Retreat Fees, Excursion Levies, Airport Transfers, Homestay Fees, Withdrawal Fees, stationery charges, Capital Development Levy, Uniform Shop charges, camp and excursion fees, administration charges, Extra Subject fees, Software Licensing fees, transport fees, VET fees, TOPSA fees, Parents’ Association contributions, PDP fees, Holding Fees, Health Insurance Fees, additional charges for integration aides or special services not met by government funding and any other annual compulsory charges and optional charges as specified in the Regulations.

    ” Fee Statement” means the International Students Enrolment and Fee Statement published annually and based on the fees set out in the Regulations. The Fee Statement for the current year is attached to this Agreement as Schedule A.

    “Financial Caregiver” means the person or persons named as Caregiver with the financial responsibility for payment of all Fees to the School. Unless otherwise notified to the School in writing it is acknowledged that the Financial Caregiver is authorised to deal with the School on all issues both financial and non-financial relevant to the Student and the student’s enrolment at the School.

    ENROLMENT TERMS AND CONDITIONS

    It is further acknowledged that each Caregiver to this Agreement is a Financial Caregiver unless notification in writing to the contrary is provided to the School and the School agrees in writing.

    “Funding” means the funding provided by the Australian Government to schools in respect of students enrolled in Australian schools.

    “Health Insurance Fees” means the fees levied by the School in relation to overseas student health cover required to be organised by the School in accordance with clause 3.5 of this Agreement.

    “Holding Fee” means the non-refundable, non-transferrable Fee that is payable in accordance with clause 8 to reserve an enrolment place for a student in circumstances of a leave of absence by the Student or where the Student has confirmed enrolment but has delayed commencement at the School.

    “Homestay” means the accommodation alternative to the School’s boarding facilities provided through an external provider.

    “International Students Refund Policy” is the policy as published by the School from time to time relating to the School’s obligation to pay a refund of all or part of the Fees pursuant to Standard 3 of the National Code of the ESOS Act.

    “National Code” means the National Code of Practice for Providers of Education and Overseas Training to Overseas Students made under subsection 33 (1) of the ESOS Act.

    “Net Annual Fee” means the total of the Tuition Fees and Boarding Fees as specified in the Regulations and set out in the Fee Statement less any scholarship or discount if applicable.

    “Non-financial Caregiver” means a person or persons named as Caregiver who is authorised to deal with the School in relation to all matters pertaining to the Student and the Student’s enrolment but who does not have the financial responsibility to the School for payment of any Fees save as otherwise might be notified in writing.

    “Notice” means a notice given in writing by the Caregivers to the Principal.

    “OSTF” means the Overseas Student Tuition Fund set up under the Education Services for Overseas Students (TPS Levies) Act 2012.

    “Parents’ Association” means The Peninsula School Parents Association.

    “PDP” means Personal Development Program.

    “Previous School” means any school, including kindergartens, that the Student has attended.

    “Principal” means the Principal of the School at any given time or his/her authorised representative.

    “Privacy Policy” means the School’s Privacy Policy, as published on the School’s website and revised from time to time.

    “Regulations” means the document headed ‘Fee Statement - International Students 2019’, which is issued annually and amended from time to time. Current version is provided as Schedule A in this agreement.

    “School” means The Peninsula School Limited ACN 004 451 192/ABN 28 004 451 192, trading as Peninsula Grammar School, CRICOS CODE: 00333A of 20 Wooralla Drive, Mount Eliza, Victoria 3930, Australia.

    “School Rules” means obligations as to conduct as set out in the Student Record Book and school website, including, without limitation, “The Code of Behaviour for the Students of Peninsula Grammar”, “School Rules”, “Bullying Prevention and Intervention Policy”, and “Uniform Regulations”, as amended, and as otherwise advised, by the School from time to time.

    “Software Licensing Fee” means the fee set out in the Regulations and Fee Statement charged to cover all licensing costs associated with School-used software.

    “Student” means the person named as the Student in this Agreement and the Application to Register for Enrolment.

    “Student Default” means an event of default by the Student as set out in the School’s Default Policy (International Students).

    “Term” means one of the four designated periods of the school year. The dates of each Term are published by the School annually.

    “TOPSA” means The Old Peninsula School Association.

    “TPS” means The Tuition Protection Service (TPS) being the Australian Government scheme to assist international students whose education providers are unable to fully deliver their course of study by ensuring that students are able to either complete their studies in another course or with another education provider or receive a refund of their unspent tuition fees.

    “Transport Fees” means the Fee for transport services provided by the School to the student as set out in the Regulations and Fee Statement

    “Tuition Fees” means the fees specified in the Regulations and Fee Statement and which are charged in two instalments per year on the Billing Dates

    “VCE” means the Victorian Certificate of Education

    “VET” means Vocational Education Training

    I N T E R P R E TAT I O NIn this Agreement:

    Where there is a reference to the discretion of the Principal, the Principal in exercising discretion shall have regard to the best interests of the School’s student body, its staff and its community;

    A reference to the singular includes the plural and vice versa and a reference to a gender includes the other gender; and

    If there is more than one Caregiver, this Agreement binds them jointly and each of them severally.

    T E R M S A N D CO N D I T I O N S

    1. COURSE DESCRIPTION/BACKGROUND INFORMATION/CONTACT DETAIL REQUIREMENTS

    1.1 This Agreement is entered into in good faith by all parties.

    1.2 The School offers secondary school education to international students who have completed at minimum Year 9 or its equivalent in their home county. Upon entry the Student must be a minimum of 14 years of age by 30 March of the academic year. The School offers the VCE which qualifies the Student for entry into tertiary level courses.

    1.3 The Student will generally complete their course of study on site at the School. The Student may elect to complete a VET unit as part of their VCE. In some instances, a VET subject may be required to be completed at another institution.

    1.4 The School’s academic year usually commences at the beginning of February and ends at the beginning of December. There are two school semesters for secondary level students and a total of four terms.

    1.5 The Caregivers will at the time of enrolment advise the School of any matter relating to the Student which may affect:

    a. the intellectual, physical or social development of the Student; or

    b. the School’s ability to educate the Student including, without limitation, any disability, physical or intellectual impairment, mental illness, psychological issue or relevant family circumstances.

    1.6 If there is any subsequent change to this information, the Caregivers will promptly inform the School.

    1.7 The Caregivers acknowledge that this information is required by the School to assess the educational, developmental, physical and social needs of the Student. The Caregivers acknowledge that the Principal may refuse to enrol, or may terminate the enrolment of the Student if in order to participate or derive substantial benefit from the School’s educational program the Student requires or would require special services or facilities which in the opinion of the Principal :

    i In the circumstances it would be unreasonable for the School to provide; or

    ii even after the provision of such special services or facilities, the Student could not participate in or derive substantial benefit from the School’s educational program.

    1.8 If this information is not provided or is inadequately disclosed to the satisfaction of the School, the Principal may in his/her absolute discretion decline to enrol the Student or terminate the Student’s enrolment.

    1.9 The Caregivers and/or the Student will immediately notify the School, via the Student’s CareMonkey profile or otherwise in writing to the School:

    1.9.1 of any changes to the medical details and/or contact details for the Student including residential address, email address and contact telephone numbers including mobile phone numbers;

    1.9.2 of any changes to the contact details for the Caregivers including employment details, business address, residential address, email address and contact telephone numbers;

    1.9.3 of any changes as to who to contact in the event of an emergency, within seven days of any change.

    1.10 The School is required by law to request confirmation of current address and contact details in writing for each student (and parent or legal guardian if a student is under 18 years of age) at least every six months. The School’s preferred method for confirming contact details in this regard is via email.

    1.11 The Caregiver and the Student acknowledge that their obligation to notify the School of any change in address and contact details as set out in clause 1.9 is required to ensure that any notifications sent by the School advising of visa breaches are sent to the Students’ current address.

    1.12 The Student must be enrolled under the name specified in the Student’s birth certificate. If the Student does not have a birth certificate, the Student must be enrolled under the name specified in the Student’s passport. A copy of the Student’s birth certificate or passport must be provided by the Caregivers at the time of enrolment. No change to the Student’s name or gender will be accepted by the School unless the School is provided with legal documentation authorising the change.

    2. ENTRANCE FEE

    2.1 The Entrance Fee is payable by the Financial Caregivers on the signing of this Agreement.

    2.2 The Caregivers acknowledge that the Entrance Fee will not be offset against other Fees.

    3. CONTINUED ENROLMENT CONDITIONS

    3.1 The Caregivers acknowledge that it is an express condition of enrolment that the Student and the Caregivers comply with the School Rules. The Caregivers agree to share a mutual obligation with the School in supporting the Student’s compliance with the School Rules.

    3.2 The Caregivers agree that continued enrolment of the Student is subject to compliance by the Student and the Caregivers with the School Rules and is at the absolute discretion of the Principal, having regard to the best interests of the other students, staff and the School community.

    3.3 The Caregivers further agree and acknowledge that the Principal has the absolute right to dismiss or suspend the Student from the School for unsatisfactory attendance, conduct or performance, or failure by either the Student or Caregivers to obey the School Rules or for any other reason considered by the Principal to be reasonable in all the circumstances.

    3.4 Without limiting the generality of the foregoing, the Caregivers acknowledge that the Principal has the absolute right to dismiss or suspend the Student owing to the failure by the Student to behave in a socially acceptable manner outside School hours.

    3.5 The Caregivers acknowledge that the Student is required to hold valid Australian private health insurance whilst enrolled at the School. The Caregivers agree that the School will arrange appropriate private health insurance which will be charged on the Student’s billing account on enrolment at the School and otherwise as appropriate.

    3.6 The Student acknowledges that they have responsibilities to:

    i ensure their passport and student visa are valid at all times and that visa conditions are observed;

    ii meet the terms of this written agreement with the School;

    iii inform their Welfare Supervisor and International Program Co-ordinator if they change address;

    iv maintain satisfactory course progress;

    v comply with the School’s Attendance Policy and all School Rules;

    vi maintain the approved accommodation, support and general welfare arrangements;

    vii obtain written approval for any overnight stay or travel which is not accompanied by an approved adult such as Homestay provider or relative from the Welfare Supervisor, a copy of which must be sent to the International Program Co-ordinator;

    viii complete the School’s International Student Leave Form which must be submitted to the International Program Co-ordinator where the Student wishes to engage in school holiday arrangements that involve travel within or outside Australia, As the School is ultimately responsible for student welfare during their schooling years, it reserves the right to refuse unsuitable travel arrangements

    and that failure to maintain the above obligations will result in the Student being reported to the Australian Immigration authorities and risk their visa being cancelled.

    4. CAREGIVERS’/STUDENTS’ RIGHTS AND RESPONSIBILITIES

    4.1 The School will proceed and act on the basis that each Caregiver has equal rights and responsibilities in relation to the Student and will rely on the authority of any of the Caregivers in connection with matters concerning the Student unless either:

    i the School is supplied with a Court Order or written authorisation signed by the Caregivers which provide otherwise; or

    ii the Principal in his/her sole discretion is satisfied in all of the circumstances that there is a good reason to vary the arrangement and has advised the Caregivers in writing of his/her intention to do so; or

    iii the School is satisfied in all the circumstances that there is reason to act on one Caregiver’s instructions and not the other.

    4.2 The Caregivers represent to the School that they are the sole legal guardians of the Student and are authorised to enrol the Student at the School. If this situation changes, the Caregivers will immediately provide a Notice detailing the change, in addition to written consent from any other legal guardian of the Student to the Student’s enrolment, or continued enrolment.

    4.3 Where a Caregiver is not the legal guardian of the Student but is a Financial Caregiver within the meaning of this Agreement, the Financial Caregiver warrants to the School his/her intention to be bound by the financial obligations of this Agreement.

    4.4 The Financial Caregivers acknowledge they are jointly and severally liable to the School for payment of the Fees and any other charges under this Agreement, regardless of the person or persons to whom the School’s account may be addressed or handled, or by whom accounts are or have been paid. This liability shall continue regardless of any changes after the date of this Agreement to the relationship between the Caregivers, or any Court Order as between the Caregivers, or any child support or other arrangements between the Caregivers.

    4.5 The Caregivers indemnify the School against any legal liability which may ensue from a misrepresentation under, or any breach of, this clause by the Caregivers.

    4.6 The School may:

    a. refuse to enrol; or

    b. suspend or terminate the enrolment of;

    the Student if the Principal has been provided with information which is considered inadequate or inaccurate regarding legal guardianship of the Student.

    4.7 A Caregiver must give a minimum of one Term’s Notice that the Caregiver is to be no longer bound by this Agreement. Any such Caregiver who is a Financial Caregiver will remain liable for all of the Fees incurred in relation to the Student for one Term after the School receives the Notice.

    4.8 Where a Financial Caregiver has notified of his/her intention to no longer be bound by this Agreement, the School reserves the right in those circumstances to either:

    i terminate the enrolment of the Student or

    ii require a replacement Financial Caregiver approved by it to be substituted in order for the enrolment to continue.

    4.9 The Caregivers acknowledge that the Caregivers and the Student are responsible for keeping a copy of this written agreement, and receipts of any payments of Fees.

    5. SCHOOL ACTIVITIES

    The Caregivers acknowledge and accept that:

    a. participation in a broad range of activities within and outside the School’s grounds, such as outdoor education, excursions, work experience, camps, AGSV and other sporting programs, and attendance at School functions is an essential part of a Student’s training, learning and involvement in the School community, and a compulsory part of the School curriculum; and

    b. existing students and new students commencing in the Pre Senior or Senior Years are required to participate in the School’s Saturday morning sports program for so long as the Student is enrolled. The Principal at his/her discretion may excuse the Student from the Saturday morning sports program in exceptional circumstances; and

    c. the cost of some of the activities referred to in clause 5 a. and b. shall incur an additional Fee payable by the Financial Caregivers. The School will advise the Caregivers of these costs.

    6. FEES

    6.1 The Fees shall be prescribed by the School and are due and payable within 30 days of the billing accounts. Payment may be made via any of the payment methods set out in the Fee Statement.

    6.2 Fees are payable in Australian dollars.

    6.3 Upon enrolment the Caregivers agree to pay six months of the Tuition Fees and six months of the Boarding Fees, if applicable, set out in the Fee Statement in advance to confirm the Student’s enrolment at the School.

    6.4 The Caregivers acknowledge that the Fees are subject to increase at any time without notice.

    6.5 Except in exceptional circumstances, the School undertakes to increase the fees only in respect of a forthcoming School year, and not in respect of the current School year. Should an increase occur, and the increase is unacceptable to the Caregivers, they may give Notice to withdraw the Student, provided this Notice is received by the School within 14 days of the notification to the caregivers of the increase. In this circumstance only, the requirement for one Term’s Notice of withdrawal under this Agreement is waived.

    6.6 Credits for or refunds of Fees will not be provided by the School and fees will not be pro rata or not levied in the event that the Student is absent from School for any period of time due to illness or for any other reason including, without limitation, that the Student does not commence School at the beginning of any Term or the Student’s departure from the School before the end of any Term.

    6.7 Notwithstanding clause 6.6 above, Tuition Fees will be applied pro rata for a new Student who commences at the School after the first day of Term 1 on the condition the student commences on the date specified in the letter of offer.

    6.8 The Caregivers shall be entitled to a family allowance if three or more of their children are enrolled at the School, as specified in the Regulations or otherwise specified by the School. The allowance shall apply from the date of commencement of the third child at the School and continue until the last student leaves the School. This allowance may be altered from time to time at the Principal’s discretion.

    6.9 Subject to clause 7.1, if the Student is dismissed from the School under clause 3.3 or 3.4 of this Agreement, the Tuition Fees shall be payable up to and including the end of the Student’s final week at the School. A termination fee of 25% of the Net Annual Fee shall be immediately payable by the Caregivers. Charging of the termination fee is not a penalty but a calculation of the genuine economic loss incurred by the School.

    6.10 No Tuition Fee relief shall be payable by the School nor sought by the Caregivers if the Student is suspended from the School for a finite period.

    6.11 If a Student changes visa status during the course of a year (i.e. becomes a temporary or permanent resident) the full International Tuition Fees are payable for the duration of that calendar year.

    6.12 The Caregivers may choose to pay more than 50% of the Tuition Fees and/or Boarding Fees before the course commences. If the Caregivers make this choice and pay more than 50% of the Tuition fees and/or if the payments made exceed the actual Tuition Fee payable for the period,

    the Caregivers hereby authorise the school to credit the overpayment towards any other Fees payable if any, or towards the payment of the next year’s Tuition Fees without recourse to the Caregiver. Any overpayment will otherwise be refunded to the Caregivers upon request in accordance with the Refund Policy.

    7. NON-PAYMENT OF FEES

    7.1 If the Fees are not paid by the date due, the School may at its discretion:

    a. impose an Administration Charge, as prescribed by the Regulations. Charging of the Administration Charge is not a penalty for late payment, but a calculation of expenses incurred by the School in managing the outstanding account;

    b. charge interest on the balance outstanding at the rate set out and amended from time to time in the Penalty Interest Rates Act 1983.

    7.2 At the discretion of the Principal the Student’s enrolment may be suspended until all outstanding Fees in respect of the Student and any siblings of the Student for whom the Financial Caregivers are liable to pay Fees have been paid in full or until an approved payment arrangement has been entered into with the School and the Financial Caregivers are complying with that arrangement. Without limiting the foregoing, the School may in its discretion refuse to readmit the Student at the commencement of any Term if any amount of Fees in respect of the Student or any siblings of the Student for whom the Financial Caregivers are liable to pay Fees remain outstanding.

    7.3 Without limiting the foregoing, at the discretion of the Principal the Student’s enrolment may be terminated where the Fees remain outstanding for more than seven days after the due date.

    7.4 The Financial Caregivers agree that they shall be responsible to the School for any and all costs incurred by the School in recovering outstanding Fees by any means, including legal action.

    8. HOLDING FEES

    8.1 Upon receipt of a written request from the Caregivers, the Principal may in his/her discretion consent to the Student taking a leave of absence from the School. Where a leave of absence is granted to the Student for any period and the Student’s place is reserved pending their return, the Caregivers agree to pay a Holding Fee. A Holding Fee will also be payable if, at the Caregivers’ request, a confirmed place is held for the Student from the date the place is confirmed until the Student commences at the School.

    8.2 Except in exceptional circumstances, a position will not be held for a period of more than one year. The Principal may at his/her discretion agree to alternate arrangements based on individual circumstances.

    8.3 Holding Fees may not be offset against Tuition Fees upon the Student’s return to the School and are not refundable should the student fail to commence at, or return to, the School.

    8.4 Holding Fees shall be payable as specified below, and subject to alteration from time to time at the Principal’s discretion:

    a. For an absence of up to 4 weeks during a Term, or which spans 2 Terms – Full Tuition Fees are payable;

    b. For an absence from 4 weeks to less than 1 full Term - 30% of the applicable year level Tuition Fees for each week of leave, after the initial four weeks of absence for which full Fees are payable;

    c. For an absence from 1 full Term to 3 full Terms (whether during one academic year or which spans two academic years) - 30% of the applicable year level Tuition Fees per Term, for the duration of the Student’s absence;

    d. If the Student is participating in international exchange programs to which the School has consented in writing for a period of up to one year – Nil;

    e. For an absence of more than 3 Terms up to 4 full Terms (whether during one academic year or which spans two academic years) - 40% of the applicable year level Tuition Fees for the duration of the student’s absence;

    f. For an absence of more than 4 Terms – at the discretion of the Principal.

    9. TERMINATION

    9.1 A minimum of one Term’s Notice in writing is required to be given by the Caregivers to the Principal to withdraw the Student’s enrolment from the School. The Student / Caregivers’ rights to refund of fees or obligation to pay any further fees will be determined by the School in accordance with this Agreement. If the Student is to be withdrawn at the conclusion of a Term, Notice must be given no later than 3pm on the Friday of the last week of the preceding Term. If the Student is to be withdrawn part-way through a Term, Notice must be given no later than noon on the Monday in week one of the preceding Term.

    9.2 If the Student is withdrawn upon less than the minimum period of Notice specified under this clause, a termination fee of 25% of the Net Annual Fee shall be immediately payable by the Caregivers. Charging of the termination fee is not a penalty for withdrawal without notice but a calculation of genuine economic loss incurred by the School. Where a Caregiver cannot communicate in English a Notice of Withdrawal may be provided in their preferred language by an official English written translation of the same text.

    9.3 The notice requirement may be waived at the discretion of the Principal. Should a student become seriously ill or be required to return home due to exceptional circumstances of a compassionate nature (such as a death or severe illness in the family) and as a consequence can no longer continue their study, the School may refund the balance of unused fees. This fee refund is wholly at the discretion of the Principal. Appropriate evidence such as a medical certificate will be required.

    9.4 A minimum of one Term’s Notice is required to cancel the Student’s enrolment in an Extra Subject where additional costs are being incurred. In lieu of such notice, the Fee otherwise payable for the subject for a Term shall be due and payable. Charging of the cancellation fee is not a penalty but a calculation of genuine economic loss incurred by the School.

    9.5 Subject to clause 4.7, in the absence of a Court Order to the contrary, the School will not accept the Student’s withdrawal unless all Caregivers sign the Notice.

    9.6 The School may terminate this Agreement and cancel the enrolment of the Student upon provision of seven days written notice if:

    9.6.1 The Caregivers and or the Student are in default of the terms of this Agreement including but not limited to where:

    a. The Student has not arrived in Australia and commenced their course on the Start date and the Student has not previously withdrawn from the course, provided the School has not failed to start or provide the course on the Start date;

    b. The Student withdraws from the course either before or after the Start date;

    c. The School refuses to provide or continue providing the course to the Student as a result of one or more of the following events:

    i The Student or Caregivers fail to pay all or part of the Fees which are due;

    ii The Student breaches a condition of their student visa; and/or

    iii The Student’s misbehaviour, provided the School has accorded the Student natural justice before refusing to provide or continue providing the course on the grounds of this default.

    9.6.2 In its absolute discretion the School considers it appropriate to do so.

    10. REFUND OF FEES

    10.1 The School will provide a refund to or in relation to the Student in the circumstances set out in the School’s International Students Refund Policy and in accordance with the obligations imposed on the School by the ESOS Act as applicable.

    10.2 Tuition Fees and Boarding Fees will be refunded in full if the visa application is unsuccessful or the Student is unable to commence for any other reason. The School must be supplied with the relevant letter of visa/rejection from DOHA.

    10.3 Where the Student has commenced the course, the School will be entitled to retain the Net Annual Fees for one Term should the Student withdraw without providing one Term’s written notice as set out in clause 9.1 and subject to clause 9.2. and will otherwise refund unspent Fees.

    10.4 Any bank charges incurred by the School in making the refund will be borne by the Student / Caregivers.

    10.5 If the Student is unable to commence at the School, the Fees paid pursuant to clause 6.3 will be refunded less any monies paid by the School on behalf of the Student including but not limited to Health Insurance Fees.

    10.6 No refund is payable where the Student’s enrolment is cancelled for:

    a. any of the Student default reasons set out in clause 9.6.1.c including the Student’s visa being cancelled by the relevant immigration department, misbehaviour by the Student or failure by the Student or Caregivers to pay Fees.

    b. failure of the Student to maintain satisfactory course progress as outlined in the International Student Orientation handbook;

    c. failure of the Student to maintain satisfactory attendance;

    d. failure to maintain approved welfare and accommodation arrangements.

    10.6 Refunds payable pursuant to clauses 10.2, 10.3 or 10.5 will be paid by the School within 4 weeks after receiving a written claim from the Student or Financial Caregiver.

    10.7 If the School is unable to provide a course in full to the Student after commencement for a reason which is the fault of the School, the Student / Caregivers will be offered full refund of the Fees then paid to date with respect to that course. The School may also offer the Student enrolment in an alternative course in which case the Student / Caregivers may choose whether they prefer a refund of Fees or to accept a place for the Student in the alternative course. If the Caregivers prefer to accept the place for the Student In the alternative course, written confirmation of the acceptance of the alternative course must be provided to the School.

    10.8 In the event that an Extra Subject ceases to be provided after it starts and before it is completed, the School will endeavour to arrange for another subject to be provided to the Student as an alternative.

    10.9 Should the alternative course of study/ Extra subject be acceptable to the Student, no refund of Fees for the original enrolment will be made by the School, nor will any additional fees be charged to the Student / Caregivers for the alternative program/ subject.

    10.10 Refunds payable pursuant to clauses 10.7 or 10.8 will be paid within two weeks of the course or Extra Subject ceasing to be provided by the School.

    10.11 Any claim for a refund must be made in writing to the Principal.

    10.12 The School will provide a statement explaining how a refund amount has been calculated.

    10.13 The Caregivers agree to pay any outstanding debts to the School and authorise any outstanding debts to be deducted from the refund.

    10.14 All refunds will be paid in Australian Dollars to the same Financial Caregiver that initially made the payment of the Fees.

    10.15 If the Student / Caregivers wish to contest any decision by the School in relation to a request for a refund, the Student / caregivers may access the dispute resolution mechanism set out in clause 19 of this Agreement. This agreement, and the availability of complaints and appeals processes do not remove the right of the Student / Caregivers to take action under Australia’s consumer protection laws.

    10.16 If the School is unable to provide a refund or a place in a suitable alternative course, the TPS Director will seek to place the Student in a suitable alternative course. If this is not possible, the Caregivers may be eligible for a refund as calculated by the TPS Director via OSTF.

    11. SECURITY FOR PAYMENT OF FEES

    11.1 In consideration of the School, accepting the Caregivers’ application for enrolment of the Student and offering the Student a position at the School, the

    Financial Caregivers charge any interest the Financial Caregivers have now or in the future either solely or jointly or as tenants in common in any real estate to secure the repayment of any amount the Financial Caregivers owe to the School from time to time. The Financial Caregivers acknowledge the School’s right pursuant to the security hereby given to lodge a caveat on any real estate in which the Financial Caregivers have such an interest. The Financial Caregivers further acknowledge that the security hereby given will continue until the School gives a final release in respect of it.

    11.2 In further consideration of the School accepting the Caregivers’ application for enrolment of the Student and offering the Student a position at the School, the Financial Caregivers grant a security interest in all present and after acquired personal property which is owned solely or jointly by or in the possession of the Financial Caregivers from time to time to secure the payment of any amount the Financial Caregivers owe to the School from time to time. The Financial Caregivers acknowledge that the security interest granted to the School pursuant to this clause is capable of registration pursuant to the Personal Properties Securities Act 2009 (“PPSA”). The Financial Caregivers waive their right to receive notification from the School of the registration where it is registered over commercial property pursuant to S157(3) of the PPSA and acknowledge that the security interest will continue until the School gives a final release in respect of it.

    11.3 The Financial Caregivers further agree to pay the School’s legal costs and disbursements (calculated on an indemnity basis) of and incidental to the preparation, stamping and registration of the security hereby given in accordance with clauses 11.2 and/or 11.3 and its subsequent discharge or costs incurred in protecting or exercising its rights in respect of the security hereby given.

    12. TECHNOLOGY

    12.1 The Caregivers acknowledge and accept the technology requirements of the School’s curriculum including, without limitation, the requirement for all students in Years 9 to 12 to purchase a laptop or other portable computer as specified by the School.

    12.2 A software licensing fee is payable by the Financial Caregivers under the Regulations.

    13. SCHOOL UNIFORM

    The Caregivers acknowledge that the Student will be required to purchase the appropriate School uniform as set out in the Regulations

    14. VISA/FUNDING

    14.1 The Caregivers acknowledge that except in extraordinary circumstances the School will not provide its consent (written or implied) to release the student from the visa condition requiring that he or she shall continue to attend the School.

    14.2 Subject to clause 14.1 the Student cannot transfer to another education provider within six months of attending the School without an official release letter from the School.

    14.3 The School is required to notify the appropriate government authorities as set out in the ESOS Act if a student’s enrolment is cancelled including providing details of any refund provided.

    15. WELFARE AND ACCOMMODATION REQUIREMENTS FOR STUDENTS UNDER THE AGE OF 18

    15.1 The School does not accept enrolments of international students under the age of 14.

    15.2 Students under the age of 18 are required to maintain adequate welfare and accommodation requirements as a condition of their student visa.

    15.3 Where a student under the age of 18 is not in the care of a parent or suitable relative as defined by the relevant immigration department their accommodation arrangements must be approved by the School.

    15.4 The School requires students to nominate a Welfare Supervisor who will assist in the care of the student and in communicating with parents overseas. The Welfare Supervisor must be a resident in Melbourne and be available to attend parent/student/teacher interviews. A student’s Homestay provider is not permitted to be the student’s Welfare Supervisor.

    15.5 Where the School has approved the Student’s welfare and accommodation arrangements, the Student requires bot the School’s and the Caregiver’s approval for any changes to welfare and accommodation arrangements in advance.

    15.6 Students should not arrive in Australia before the approved start date and if under 18 years of age before completing the enrolled course, should not remain in Australia without prior approval after the approved finish date.

    15.7 Students who will turn 18 years of age during the final period of their course are required to continue to reside in the approved provided approved accommodation until the completion of the course.

    16. SAFE ENVIRONMENT

    The School undertakes to use reasonable endeavours to provide a safe and secure environment for the Student and their belongings but it accepts no liability for damage, loss, theft, accident or injury that may be suffered by the Student, the Caregivers or any member of the Student’s family, which are not the direct consequence of any malicious act or omission, carelessness or negligence of any staff member of the School, or which are the direct or indirect result of the Student’s, Caregiver’s or Student’s family member’s act or omission.

    17. GOVERNING LAW

    This Agreement will be governed by the laws of the State of Victoria and all parties irrevocably and unconditionally submit to the exclusive jurisdiction of the Courts of Victoria.

    18. VARIATION TO AGREEMENT

    The Caregivers acknowledge that the School may from time to time vary the terms of this Agreement. Should the School notify the Caregivers of a substantial variation and the variation is unacceptable to the Caregivers, they may give Notice to withdraw the Student, provided this Notice is received by the School, in writing to the Principal, within 14 days of the Caregivers’ notification of the variation. In this circumstance only, the requirement for one Term’s Notice of withdrawal under clause 9.1 of this Agreement is waived.

    19. COMPLAINTS AND APPEALS

    19.1 The School’s complaint handling process is set out in their complaints policy which can be located on their website at https://www.peninsulagrammar.vic.edu.au/all-policies/all-student-policies

    19.2 The Student may discuss any complaint or student grievance with the Principal and the International Program Co-ordinator. If a dispute is not resolved between the Student and the School an independent panel can be called upon to arbitrate.

    19.3 This agreement, and the availability of complaints and appeals processes, do not remove the right of the Student / Caregivers to take action under Australia’s consumer protection laws. If the Student / Caregivers wish to lodge an external appeal or complain about a dispute decision, they can contact the Overseas Students’ Ombudsman at http://www.oso.gov.au or phone 1300 362 072. The Overseas Students Ombudsman offers a free and independent service for overseas students who have a complaint or want to lodge an external appeal about a decision made by their private education or training provider.

    20. PRIVACY POLICY

    20.1 The Caregivers acknowledge and consent to the provisions of the School’s Privacy Policy, a copy of which is available on the School’s website at www.peninsulagrammar.vic.edu.au

    20.2 The Caregivers acknowledge that the information provided by the Caregivers in this application is subject to the School’s Privacy Policy.

    20.3 The Caregivers acknowledge that information is collected on this Agreement and during enrolment in order to meet the School’s obligations under the ESOS Act and the National Code to ensure student compliance with the conditions of their visas and their obligations under Australian immigration laws generally. The authority to collect this information is contained in the ESOS Act, the Education Services for Overseas Students Regulations 2001 and the National Code. Information collected about the Student on this form and during enrolment can be provided, in certain circumstances, to the Australian government and designated authorities. In other instances, information collected on this form or during enrolment can be disclosed without the Caregivers and Students consent where authorised or required by law.

    20.4 The Caregivers acknowledge that further information about the School’s use of credit information and credit reports can be found in the Notification as to Credit Reporting Matters which is on the School’s website.

    20.5 Without limiting the generality of the foregoing and unless Notice is provided to the contrary, the Caregivers acknowledge and consent to personal information collected from the Student such as academic, sporting, cultural and personal achievements, examples of the Student’s work, student activities and other news obtained whilst the Student is participating in School events or activities being published in School publications including newsletters, magazines, advertisements, editorials, the School’s website, social media or the Independent School’s Victoria website. We will seek your consent on an annual basis using our CareMonkey system for the Students images, photographs and videos taken within the School grounds or whilst the Student is participating in school events or activities being published in School publications

    20.6 In accordance with the Privacy Act 1988 as amended (“the Act”) Financial Caregivers agree and consent that the School:

    a. May obtain credit reporting information about them from a credit reporting body (“CRB”) for the purposes of assessing this application;

    b. May obtain credit reporting information about them from a CRB for the purposes of assisting in the collection of payments which are overdue to the School by the Caregiver.

    20.7 The Financial Caregivers agree that the School may give credit reporting information to and may seek credit reporting information including credit eligibility information within the meaning of the Act from:

    a. any credit provider named on a report received from a CRB; and

    b. any existing, previous or prospective supplier of goods to the Caregivers or to any related entity of the Caregivers.

    20.8 The Financial Caregivers agree that the School may use credit reporting information obtained in accordance with these terms for the purposes of assessing this application for enrolment, determining whether action should be taken in relation to overdue accounts or any other purpose permitted by the Act.

    20.9 The Financial Caregivers authorise their bank, accountant and trade referees to release information to assist the School in considering this application.

    20.10 The information which may be given to a credit provider is covered by Section 6N of the Act.

    21. GENERAL MEDICAL CONSENT

    21. In the event of an injury or illness to the Student, at School, travelling to or from School or while taking part in any organised School activity, the Caregivers authorise the Principal, teacher in charge of the Student and the School Health Centre Staff, where they are unable to contact any of the Caregivers or emergency contact, or it is otherwise impracticable to contact the Caregiver/s, to:

    a. administer such first aid as the Principal, teacher in charge of School Health Centre Staff may judge to be reasonably necessary;

    b. call an ambulance for the Student; and

    c. The Caregivers consent to the Student receiving such medical dental or surgical attention as may be deemed necessary by a Medical Practitioner.

    22. The Caregivers accept responsibility for any expenses arising from such first aid, ambulance, medical, dental or surgical attention.

    23. The Caregivers acknowledge that any subsequent medical consent requested via CareMonkey or otherwise, on an individual excursion form, or otherwise, exists to expedite the accessibility of medical attention and in no way diminishes the nature and scope of this consent.

    24. The Caregivers authorise School Health Centre Staff to administer over-the-counter medications such as Paracetamol, antihistamines, or general cold remedies, if they deem necessary.

    25. In accordance with Clause 1.9, and in the interests of the Student’s safety and wellbeing, the Caregivers agree to immediately update the Student’s CareMonkey Profile and advise School Health, should any medical information change in future, or if any medical or other condition arises which affects the student.

    26. In the best interests of Student Health, the Caregivers consent to being responsive to School Health requests for information (e.g. Epi-pen renewal, up to date Action Plans).

    IMMUNISATION

    27. The Caregivers accept that in some circumstances, for the safety of Student health, the School may exclude a child who is not fully immunised or who has not provided the School with an up-to-date Immunisation History Statement from the Australian Immunisation Register or its international equivalent. The School requires international students to keep their immunisation current as determined by the School’s doctor. The Caregivers hereby acknowledge that maintaining the Student’s immunisation up-to-date is a condition of enrolment at the School and hereby consent to the School’s doctor administering such vaccine or medication required to ensure the Student’s immunisation is current at all times while the Student is enrolled at the School.

    ACCEPTANCE DECLARATION

    The Caregivers jointly and individually acknowledge and declare that:

    (a) They have read and understood this Agreement, which is made up of both Part A and Part B;

    (b) They accept the offer of enrolment of the Student at the School;

    (c) The information provided in this document is accurate to the best of their knowledge, and that by providing this information they authorise the School to rely on this information whilst the Student is in the School’s care;

    (d) By completing and signing Part B of this Agreement and returning it to the School before the offer lapse date with the required payment and documentation, they agree to comply with and be bound by the terms and conditions of enrolment in this Agreement, the Enrolment and Fee Statement attached and marked Schedule A together with the Board of Directors Regulations and Fees as prescribed and amended from time to time, which all together form part of a legally binding Agreement between the Caregivers and the School.

    T E R M S & CO N D I T I O N SYour child’s enrolment is subject to the terms and conditions set out in:

    - This Fee Statement, approved by our Board of Directors and published annually on our website;

    - The Enrolment Agreement, a copy of which is provided to you upon enrolment; and

    - School Policies, which are available upon request.

    Please be aware that these terms and conditions are subject to change from time to time. You will be required to accept revisions (if any) to the Fees Statement, the Enrolment Agreement and School Policies each year. You are welcome to contact our Registrar on 9788 7702 or Business Manager on 9788 7706 if you have any questions. In signing the Enrolment Agreement you agree that subject to any agreement in writing to the contrary, all signatories will be jointly and severally responsible for all terms, conditions, fees and charges outlined in this agreement.

    1. Enrolment and Entrance Fees

    3. Annual Compulsory Charges (eg. camps/transport/capital development etc.)

    4. Optional Charges (eg. private music/sport lessons etc.)

    5. Boarding Fees (if applicable)

    1. ENROLMENT AND ENTRANCE FEES

    ENROLMENT FEE

    A non-refundable, non-transferable Enrolment Fee of $100* per student (day and boarding) is payable when an Application to Register for Enrolment is completed with the School.

    ENTRANCE FEE

    A non-refundable, non-transferable Entrance Fee of $850 is payable on acceptance into the School to cover the administrative cost of our admissions process. This is not offset against tuition fees.

    HEALTH INSURANCE

    All international students are required to hold valid Australian private health insurance during their time at the School. This will be arranged by the School and charged on the student billing account on enrolment at the School.

    The estimated cost is in the range of $700-$800 per annum and this will need to be paid at commencement at the School for the term of the enrolment.

    COMPUTER EXPENDITURE

    Students in Years 7 to 12 are required to purchase a laptop computer. The laptop needs to meet the school specifications which will be provided to students on commencement. For more information please email our Information Technology Department on [email protected].

    SCHOOL UNIFORM

    Students attending Peninsula Grammar must purchase the required school uniforms. Initial uniform purchases are made under supervision and must be paid for on the day of purchase. The estimated initial cost is $1,290* per student; however, this may vary depending on co-curricular involvement. Ongoing uniform requirements must be paid for at time of purchase.

    2. ANNUAL TUITION FEES

    Tuition Fees are charged in two instalments per year. These instalments in 2020 will be issued on 15 January 2020 and 30 July 2020. Monthly invoices will be sent for other incidental costs incurred. These are payable in full within 30 days from the issue date.

    New students to the School are required to pay six months tuition fees in advance to confirm their enrolment at the School.

    These fees are for students that are NOT Australian Citizens or students with permanent residence status that are NOT entitled to Government Grants.

    Tuition fees for International Students in 2020 are:

    For current students, fees are not pro-rata to exclude days when a student is absent from school due to illness or any other reason, nor if the student does not commence on the first day of any term. Tuition fees will be applied pro-rata for new students who commence at the School after the first day of Term 1 on the condition the student commences on the date specified in the letter of offer.

    Please note that additional minor fees and charges may be incurred in addition to those listed in this Fee Statement.

    3. ANNUAL COMPULSORY CHARGES

    CAPITAL DEVELOPMENT LEVY

    An annual Capital Development Levy of $690 per family is charged in two instalments per year. These funds are used by the School to maintain and develop the grounds and the facilities of the School.

    SOFTWARE LICENSING FEE

    A fee of $200* for students in Years 7 to 12 will be charged with billing 1 per student. This fee is to cover the licensing costs associated with school-used software and applications.

    TRANSPORT LEVY

    The Transport Levy is an annual compulsory levy for all student bus travel. This includes transport to sporting fixtures, academic excursions, outdoor education camps and off-campus lessons. Students from Years 7 to 12 incur a fee of $398 per student which will be charged with billing 1.

    VCAA FEES

    Students completing a VCE subject will be required to pay Victorian Curriculum Assessment Authority (VCAA) fees each year. These fees are published by the VCAA each year and will be charged as an incidental cost on the billing account.

    BOOKLISTS

    Students will be required to purchase textbooks, online materials stationery and calculators depending on year level and subject selection. Booklists will be prepared and distributed by the School each year. The estimated cost is in the range of $400-$600* per annum.

    PERSONAL DEVELOPMENT PROGRAM (PDP)

    Students from Years 7 to 8 are expected to participate in our Personal Development Program, which includes the Cadets program as an option. The activities offered within PDP incur estimated costs between $20-$500 depending on the activity selected. A cost schedule will be provided at the time students are requested to select their activity preferences and these will be charged twice per year.

    CAMPS

    Students in Years 7 to 10 are expected to attend compulsory outdoor education camps. Camp fees are charged as an incidental cost on the billing account.

    ** All camp fees include a food component which includes GST.

    Our camp cancellation policy is available from the School upon request and will be provided with a CareMonkey notification. All camps are required to be booked and paid in advance and no refund can be provided, but the School has a student travel insurance policy in place. This insurance policy has terms and conditions that may qualify for a refund and the School can provide a copy of the policy and assist with claims.

    4. OPTIONAL CHARGES

    VOCATIONAL EDUCATION TRAINING (VET)

    The VET program is an optional program for VCE students that involves a more practical hands-on approach to learning. For new enrolments into this program in 2020, the School will contribute the first $830 of the cost of the program each year with the remainder charged to the billing account. Additional charges may be incurred for course specific materials.

    TOPSA (THE OLD PENINSULA SCHOOL ASSOCIATION)

    This is a one-off charge of $325 for Life Membership to TOPSA, our alumni, to be charged with billing 2 for all Year 12 students. Year 12 students who leave the School prior to billing 2 and Year 10 and 11 students, who leave during 2020, will be offered the option of Life Membership to TOPSA.

    MUSIC – PRIVATE INSTRUMENTAL LESSONS

    Music fees will be billed each semester in advance in billing 1 and billing 3. Please contact the Music Department on 9788 7733 for further information on costs and enrolment.

    LEARNING SUPPORT

    Additional fees may apply if extensive support from the Department of Learning Support is required. Costs will be discussed in advance if such support is required.

    5. BOARDING FEES

    Peninsula Grammar offers boarding facilities for both domestic and international students. Boarding Fees are charged in addition to annual tuition fees. Boarding places are limited and only available from Years 7 to 12.

    In certain circumstances, the Boarding House may remain open during the September School Holidays. Additional fees and charges may be incurred.

    BOARDER RETREAT

    In addition to compulsory year level camps. Boarding students are required to attend a yearly retreat. This incurs a yearly charge of $550*, which will be charged on billing 1.

    EXCURSION LEVY

    A compulsory excursion levy fee of $300* for boarding students will be charged with billing 1 per student. This fee covers the cost of all compulsory excursions for students in the Boarding House.

    AIRPORT TRANSFERS

    Airport transfers may be arranged by the School for students returning to and from the School and Melbourne Tullamarine Airport. For students travelling between the School Boarding Houses and Melbourne Tullamarine Airport a fee of $83* per student will be incurred each way. This will be charged as an incidental charge on the student billing account. Additional charges will be incurred for transfer between Melbourne Tullamarine Airport and Homestay venues.

    HOMESTAY

    Homestay may be selected as an alternative to the School’s boarding facilities. Homestay is provided through an external provider and all charges will be charged to the student billing account. For more information, please contact the Admissions Office on 9788 7702 or email [email protected].

    LIVING COSTS

    The Australian government Department of Home Affairs calculates the following to be a guide to basic annual living costs for those seeking to reside in Australia:

    PAYMENT BY BPAY

    The School encourages the use of BPay. This is an easy and secure method of paying fees. Please contact your participating financial institution for terms and conditions. Our biller code and your reference number appear on your account.

    PAYMENT OF YEARLY TUITION FEES

    If annual tuition fees (and boarding fees, if applicable) for 2020 are paid in full before 31 December 2019, a 2.5% discount will apply. Late payments will not attract a discount.     PAYMENT BY CREDIT CARD

    The School accepts payment by EFTPOS as well as MasterCard and Visa. Payment by credit card can be made:

    Online at www.peninsulagrammar.vic.edu.au. Go to MENU (top left corner) and scroll to the bottom of the drop down menu for School Fee Payments.

    PAYMENT BY CASH OR CHEQUE

    Cheques are payable in $AUD to The Peninsula School, 20 Wooralla Drive, Mt Eliza Vic 3930. Cash payments of up to $2,000 may be made at the School Business Office. Cash payments in excess of $2,000 must be directly deposited into the School Bank account at the NAB bank using a deposit slip and quoting your Peninsula Grammar Account Number. Please refer to your monthly invoice for account details.

    R E F U N D P O L I CYThe School will provide a refund in line with the School Policy and as required under the ESOS Act.

    W I T H D RAWA L A N D L AT E F E E S

    WITHDRAWAL

    A minimum of one term’s written notice is required to withdraw a student’s enrolment from the School. This withdrawal notification must be provided in writing to the Principal. If the student is to be withdrawn at the conclusion of a term, notice must be given no later than 3.00pm on the Friday of the last week of the preceding term. Where the required notice is not provided a late notice of withdrawal fee of 25% of the annual tuition and, where applicable, boarding fee is payable.

    LATE FEES

    Any late payments will incur an administration charge of $300* for every 30 days the payment is overdue.

    Where a tuition fee account is in arrears, the student is not permitted to incur additional costs by participating in non- curriculum elective activities.

    Our collection activities will pursue all avenues, including legal action to recover outstanding debt to the School.

    L E G A L M AT T E R SIf legal matters arise which affect your child’s enrolment (including changes to guardianship or access), or which may impact upon your child’s education, you are required to promptly advise the Principal in writing. Hard copies of relevant legal documentation must also be provided. Unless advised otherwise, the School will proceed on the basis that both parents have equal parenting rights in relation to the student, and that both parents are jointly and severally liable for payment of fees and charges. Unless provided with legal documentation to the contrary, the School will not accept an enrolment, nor a withdrawal of enrolment, unless consent of both parents is provided.
