The States Parties to the present Covenant,Considering that, In accordance with the principles proclaimed In the Charter

of the United nations, recognition of the Inherent dignity and of the equal andinalienable rights of all moabers of the human family is the foundation of freedom,justice and peace in the world.

Recognizing that these rights derive frcn the Inherent dignity of the humanperson.

Recognizing that, in accordance with the Universal Declaration of HumanRights, the ideal of free human beings enjoying freedom from fear and want canonly be achieved if conditions are created whereby everyone may enjoy his economic,social and cultural rights, as well as his civil and political rights.

Considering the obligation of States under the Charter of the United Nationsto promote universal respect for, and observance of, human rights and freedoms.

Realizing that the individual, having duties to other individuals and to thecommunity to which he belongs, is under a responsibility to strive for thepromotion and observance of the rights recognized in the present Covenant,

Agree upon the following articles:

PART T

Article 11. All peoples have the right of self-determination. By virtue of that

right they freely determine their political status and freely pursue theireconoraic, social and cultural development.

2, All peoples may, for their own ends, freely dispose of their naturalwealth and resources without prejudice to any obligations arising out ofinternational economic co-operation, based upon the principle of mutual benefit,and international law. In no case may a people be deprived of its own means ofsubsistence.

5. The States Parties to the present Covenant, including those havingresponsibility for the administration of Non-Self-Governing and Trust Territories,shall promote the realization of the right of self-determination, and shall respectthat right, in conformity vith the provisions of the Charter of the United Mations.

PART IIArticle 2

1. Each State Party to the present Covenant undertakes to take steps,individually and through international assistance and co-operation, especiallyeconomic and technical, to the maximum of its available resources, vith a view toachieving progressively the full realization of the rights recognized in the presentCovenant byall appropriate means, including particularly the adoption oflegislative measures.

2. The States Parties to the present Covenant undertake to guarantee thatthe rights enunciated in the present Covenant vill be exercised without discriminationof any kind as to race, colour, sex, language, religion, political or other opinion,national or social origin, property, birth or other status.

5. Developing countries, with due regard to human rights and their nationaleccnoTjy, . determine to what extent they would guarantee the economic rightsrecognized in the present Covenant to non-nationals.

Article 3The States Parties to the present Covenant undertake to ensure the equal right

of men and women to the enjoyment of all economic, social and cultural rights setforth in the present Covenant.

Article kThe States Parties to the present Covenant recognize that, in the enjoyment

of those rights provided by the State in conformity with the present Covenant, theState may subject such rights only to such limitations as are determined by lawonly in so far as this may be compatible with the nature of these rights and solelyfor the purpose of promoting the general welfare in a democratic society.

1, Nothing in the present Covenant may be interpreted as implying for anyState, group or person any right to engage in any activity or to perform anyact aimed at the destruction of any of the rights or freedoms recognized herein,or at their limitation to a greater extent than is provided for in the presentCovenant.

2. No restriction upon or derogation from any of the fundamental humanrights recognized or existing in any country in virtue of law, conventions,regulations or custom shall be admitted on the pretext that the present Covenantdoes not recognize such rights or that it recognizes them to a lesser extent.

PART IIIArticle 6

1, The States Parties to the present Covenant recognize the right to work,which includes the right of everyone to the opportunity to gain his living bywork which he freely chooses or accepts, and will take appropriate steps tosafeguard this right.2. The steps to be taken by a State Party to the present Covenant toachieve the full realization of this right shall include technical and vocationalguidance and training programes, policies and techniques to achieve steadyeconomic, social and cultural development and full and productive employmentunder conditions safeguarding fundamental political and economic freedoms to theindividual.

Article 7The States Parties to the present Covenant recognize the right of everyone

to the enjoyment of Just and favourable conditions of work, which ensure, inparticular:

(a) Remuneration which provides all workers, as a minimum, with:

(i) Pair wages and equal remuneration for work of equal value withoutdistinction of any kind, in particular women being guaranteedconditions of work not inferior to those enjoyed by men, withequal pay for equal work;

(ii) A decent living for themselves and their families in accordancewith the provisions of the present Covenant;

(b) Safe and healthy working conditions;() Equal opportunity for everyone to be promoted in his employment to an

appropriate higher level, subject to no considerations other than those ofseniority and competence;

(d) Rest, leisure and reasonable limitation of working hours and periodicholidays with pay, as well as remuneration for public holidays.

Article 81, The States Parties to the present Covenant undertake to ensure:(a) The right of everyone to form trade unions and join the trade union

of his choice, subject only to the rules of the organization concerned, for thepromotion and protection of his economic and social interests. No restrictionsney be placed on the exercise of this right other than those prescribed by lawand which are necessary in a democratic society in the interests of nationalsecurity or public order or for the protection of the rights and freedoms ofothers;

(b) The right of trade unions to establish national federations orconfederations and the right of the latter to form or join internationaltrade-union organizations;

(c) The right of trade unions to function freely subject to no limitationsother than those prescribed by law and which are necessary in a democraticsociety in the interests of national security or public order or for theprotection of the rights and freedoms of others;

(d) The right to strike, provided that it is exercised in conformity withthe laws of the particular country.

2. This article shall not prevent the imposition of lawful restrictions onthe exercise of these rights by menbers of the armed forces or of the police orof the administration of the State.

5. Nothing in this article shall authorize States Parties to theInternational Labour Organisation Convention of 1 9 ^ concerning Freedom ofAssociation and Protection of the Right to Organize to take legislative measureswhich would prejudice, or apply the law in such a manner as would prejudice,the guarantees provided for in that Convention.

Article 9The States Parties to the present Covenant recognize the right of everyone

to social security, including social insurance.

Article 10The States Parties to the present Covenant recognize that:1. The widest possible protection and assistance should be accorded to the

family, which is the natural and fundamental group unit of society, particularlyfor its establishment and while it is responsible for the care and education ofdependent children. Marriage must be entered into with the free consent of theintending spouses.

2. Special protection should be accorded to mothers during a reasonableperiod before and after childbirth. During such period working mothers shouldbe accorded paid leave or leave with adequate social security benefits.

5. Special measures of protection and assistance should be taken on behalfof all children and young persons without any discrimination for reasons ofparentage or other conditions. Children and young persons should be protectedfrom economic and social exploitation. Their employment in work harmful totheir morals or health or dangerous to life or likely to hamper their normaldevelopment should be punishable by law. States should also set age limits belowwhich the paid employment of child labour should be prohibited and punishable\?y law.

1. The States Parties to the present Covenant recognize the right ofeveryone to an adequate standard of living for himself and his family, includingadequate food, clothing and housing, and to the continuous improvement of livingconditions. The States Parties will take appropriate steps to ensure therealization of this right, recognizing to this effect the essential importanceof international co-operation based on free consent.

2. The States Parties to the present Covenant, recognizing the fundamentalright of everyone to be free from hunger, shall take, individually and throughinternational co-operation, the measures, including specific programmes, whichare needed:

(a) To improve methods of production, conservation and distribution of foodby making full use of technical and scientific knowledge, by disseminatingknowledge of the principles of nutrition and by developing or reforming agrariansystems in such a way as to achieve the most efficient development and utilizationof natural resources;

(b) Taking into account the problems of both food-importing and food-exportingcountries, to ensure an equitable distribution of world food supplies in relationto need.

Article 121, The States Parties to the present Covenant recognize the right of

everyone to the enjoyment of the highest attainable standard of physical andmental health,

2, The steps to be taken by the States Parties to the present Covenant toachieve the full realization of this right shall include those necessary for:

(a) The provision for the reduction of the stillbirth-rate and of infantmortality and for the healthy development of the child;

(b) The improvement of all aspects of environmental and industrial hygiene;(c) The prevention, treatment and control of epidemic, endemic, occupational

and other diseases;

(d) The creation of conditions which would assure to all medical serviceand medical attention in the event of sickness.

Article 131. The States Parties to the present Covenant recognize the right of

everyone to education. They agree that education shall be directed to the flaildevelopment of the human personality and the sense of its dignity, and- shallstrengthen the respect for human rights and fundamental freedoms. They furtheragree that education shall enable all persons to participate effectively in afree society, promote understanding, tolerance Q,nd friendship among all nationsand all racial, ethnic or religious groups, and further the activities of theUnited Nations for the maintenance of peace.

2. The States Parties to the present Covenant recognize that, with a viewto achieving the full realization of this right

(a) Primary education shall be compulsory and available free to all;(b) Secondary education in its different forms. Including technical and

vocational secondary education, shall be made generally available and accessibleto all by every appropriate means, and in particular by the progressiveintroduction of free education;

{c) Higher education shall be made equally accessible to all, on the basisof capacity, by every appropriate means, and in particular by the progressiveintroduction of free education;

(d) Fundamental education shall be encouraged or intensified as far aspossible for those persons who have not received or completed the whole periodof their primary education;

(e) The development of a system of schools at all levels shall be activelypursued, an adequate fellowship system shall be established, and the materialconditions of teaching staff shall be continuously improved.

3. The States Parties to the present Covenant undertake to have respectfor the liberty of parents and, when applicable, legal guardians, to choose fortheir children schools, other than those established by the public authorities.

ArticleEach State Party to the present Coveharit which, at the time of becoming a

Party, has not been able to secure in its metropolitan territory or otherterritories under its jurisdiction compulsory primary education, free of charge,undertakes, within two years, to work out and adopt a detailed plan of actionfor the prbgressive implementation^ Vithin a reasonable number of years, to befixed in the plan, of the principi of compulsory education free of charge for all.

Al-ticle 1$1. ihe States Parties to the j resent Covenant recognize the right of

everyone:(a) to take part In cultural life;(b) To enjoy the benefits of scientific progress and its applications;(c) To benefit from the protection of the moral and material interests

resulting from any scientific, literary or artistic production of which he isthe author,

2. The steps to be taken by the States Parties to the present Covenantto achieve the full realization of this right shall include those necessary forthe conservation, the development and the diffusion of science and culture.

3. The States Parties to the present Covenant undertake to respect thefreedom indispensable for scientific research and creative activity.

li-. The States Parties to the present Covenant recognize the benefits tobe derived from the encouragement and development of international contacts andco-operation in the scientific and cultural fields.

PART IVArticle 1 6

1. The States Parties to the present Covenant undertake to submit inconformity with this part of the Covenant reports on the measures vhich theyhave adopted and the progress made in achieving the observance of the rightsrecognized herein.

2. (a) All reports shall be submitted to the Secretary-General of theUnited Nations, who shall transmit copies to the Economic and Social Council foi*consideration in accordance with the provisions of the present Covenant.

(b) The Secretary-General of the United Nations shall also transmit to thespecialized agencies copies of the reports, or any relevant parts therefrom, fromStates parties to the present Covenant which are also members of these specializedagencies in so far as these reports, or parts therefrom, relate to any matterswhich fall within the responsibilities of the said agencies in accordance withtheir constitutional instruments.

Article IT1, The States Parties to the present Covenant shall furnish their reports

in stages, in accordance with a programme to be established by the Economic andSocial Council within one year of the entry into force of the present Covenantafter consultation with the States Parties and the specialized agencies concerned.

2. Reports may indicate factors and difficulties affecting the degree offulfilment of obligations under the present Covenant.

5 . Where relevant information has previously been fumisned to theUnited Nations or to any specialized agency by any State Party to the presentCovenant, it will not be necessary to reproduce that information, but a precisereference to the information so furnished will suffice.

Pursuant to its responsibilities under the Charter of the United Nations inthe field of human rights and fundamental freedoms, the Economic and SocialCouncil may make arrangements with the specialized agencies in respect of theirreporting to it on the progress made in achieving the observance of the provisionsof the present Covenant falling within the scope of their activities. Thesereports may include particulars of decisions and recommendations on suchimplementation adopted by their competent or^ns.

Article 19The Economic and Social Council may transmit to the Ccmmiission on Human

Rights for study and general recommendation or as appropriate for information thereports concerning human rights submitted by States in accordance with articles l6and 17, and those concerning human rights submitted by the specialized agenciesin accordance with article l8.

Article 20The States Parties to the present Covenant and the specialized agencies

concerned may submit comments to the Economic and Social Council on any generalrecomnendation under article 19 or reference to such general recommendation in anyreport of the Commission on Human Rights or any documentation referred to therein.

Article 21The Economic and Social Council may submit from time to time to the General

Assaably reports with recommendations of a general nature and a sunmary of theInformation received from the States Parties to the present Covenant and thespecialized agencies on the measures taken and the progress made in achievinggeneral observance of the rights recognized in the present Covenant,

The Economic and Social Council may bring to the attention of other organsof the United Nations, their subsidiary organs and specialized agencies concernedwith furnishing technical assistance any matters arising out of the reportsreferred to in this part of the present Covenant which may assist such bodies indeciding, each within its field of COTjpetence, on the advisability of internationalmeasures likely to contribute to the effective progressive implementation of thepresent Covenant.

Article 23The States Parties to the present Covenant agree that international action

for the achievement of the rights recognized in the present Covenant includessuch methods as the conclusion of conventions, the adoption of recommendations,the furnishing of technical assistance and the holding of regional meetings andtechnical meetings for the purpose of consultation and study organized inconjunction with the Governments concerned.

Article 2k

Nothing in the present Covenant shall be interpreted as inypairing theprovisions of the Charter of the United Nations and of the constitutions of thespecialized agencies which define the respective responsibilities of the variousorgans of the United Nations and of the specialized agencies in regard to thematters dealt with in the present Covenant.

Article 23Nothing in the present Covenant shall be interpreted as in^airing the inherent

right of all peoples to en^qy and utilize fully and freely their natural wealthand resources.

PART YArticle 26

1. The present Covenant is open for signature by any State Member of theUnited Nations or member of any of its specialized agencies, by any State Partyto the Statute of the International Court of Justice, and by any other StateVhich has been invited by the General Assembly of the United Nations to becomea party to the present Covenant,

2, The present Covenant is subject to ratification. Instruments ofratification shall be deposited with the Secretary-General of the United Nations.

5. The present Covenant shall be open to accession by any State referredto in paragraph 1 of this article,

U. Accession shall be effected by the deposit of an instrument of accessionwith the Secretary-General of the United Nations.

5. The Secretary-General of the United Nations shall inform all States vhichhave signed the present Covenant or acceded to it of the deposit of eachinstrument of ratification or accession.

Article 27

1. The present Covenant shall enter into force three months after the dateof the deposit with the Secretary-General of the United Nations of the thirty-fifthinstrument of ratification or instrument of accession.

2. For each Stai;e ratifying the present Covenant or acceding to it after thedeposit of the thirty-fifth instrument of ratification or instrument of accession,the present Covenant shall enter into force three months after the date of thedeposit of its own instrument of ratification or instrument of accession.

Article 28The provisions of the present Covenant shall extend to all parts of federal

States without any limitations or exceptions.

Artlple 291. Any State Party tp the presenp Cover ant may propose an amendmen]; and

file it with the Secretary-General of the United Nations. The Secretary-Qeneralshall thereupon cominunicate any proposed amendmfnts to the States Parties to thepresent Covenant vith a request that th^y notify him whether they favourconference of States Parties for the purpose qf considering c|.nd voting upon theproposals. In the event that at least pne third of the States Parties fairourssuch a conference, the Secretary-General shall convene the conference und^r theauspices of the United Nations. Any amendment e^dopted by niiajority of theStates Parties present and voting at thf conference shall be submitted to theGeneral Assembly of the United Nations for approvfil.

2. Amendments shall come into force when they have been approved theGeneral Assembly of the United Nations and accepted by a two-thirds majority ofthe States Pftrties to the present Covenant in accordance with their respecitiveconstitutional processes.

5. When amendments come into forqe they shall be binding on those StatesParties whicln have accepted them, other States Parties still being bound by theprovisions of the present Coyenant and any earlier amendment which they haveaccepted.

Article 30Irrespective of the notifications made under article 26, paragraph 5, the

Secretary-General of the United Nations shall inform all States referred to inparagraph 1 of the same artile of the following particulars:

(a) Signatures, ratifications and accessionfli under article 26;(b) The date of the ent ry into force of the present Covenant under article 2?

and the date of the entry into force of piny amendments under article 2 9 .

1. The present Covenant, of which the Chinese, English, French, Russian andSpanish texts are equally authentic, shall be deposited in the archives of theUnited Nations.

2. The Secretory-General of the United Nations shall transmit certifiedcopies of the present Covenant to all States referred to in article 26 .

IN FAITH WHEREOF the undersigned, heing duly authorized thereto by theirrespective Governments, have signed the present Covenant, opened for signatureat New York, on the nineteenth day of December, one thousand nine hundred andsixty-six.

Les Etats parties au prsent Pacte,Considrant que, conformment aux principes noncs dans la Charte des Nations

Unies, la reconnaissance de la dignit Inhrente tous les membres de la famillehumaine et de leurs droits gaux et inalinables constitue le fondement de la libert,de la Justice et de la paix dans le monde.

Reconnaissant que ces droits dcoulent de la dignit inhrente la personnehumaine,

Reconnaissant que, conformment la Dclaration universelle des droits del'homme, l*idal de l'tre humain libre, libr de la crainte et de la misre, ne peuttre ralis que si des conditions permettant chacun de jouir de ses droitsconomiques, sociaux et culturels, aussi bien que de ses droits civils et politiques,sont cres.

Considrant que la Charte des Nations Unies impose aux Etats l'obligation depromouvoir le respect universel et effectif des droits et des liberts de l'homme.

Prenant en considration le fait que l'individu a des devoirs envers autrui etenvers la collectivit laquelle il appartient et est tenu de s'efforcer de promouvoiyet de respecter les droits reconnus dans le prsent Pacte,

Sont convenus des articles suivEints :

PREMIERE PARTIEArticle premier

1. bus les peuples ont le droit de disposer d'eux- mmes. En vertu de pedroit, ils dterminent librement leur statut politique et assurent librement Ipurdveloppement conomique, social et culturel.

Pour atteindre leurs fins, tous les peuples peuvent disposer librement deleurs richesses et de leurs ressources naturelles, sans prjudice des obligations quidcoulent de la coopration conomique internationale, fonde sur le principe de1*intrt mutuel, et du droit international. En aucun cas, un peuple ne pourra trepriv de ses propres moyens de subsistance.

3 . Les Etats parties au prsent Pacte, y compris ceux qui ont la responsabilitd*administrer des territoires non autonomes et des territoires sous tutelle, sonttenus de faciliter la ralisation du droit des peuples disposer d'eux-mmes, et derespecter ce droit, conformment aux dispositions de la Charte des Nations Unies.

DEUXIEME Article 2

1. Chacun des Etats parties au prsent Pacte s'engage agir, tant par soneffort propre que par l'assistance et la coopration internationales, notainment surles plans conomique et technique, au maximum de ses ressources disponibles, en vued^assurer progressivement le plein exercice des droits reconnus dans le prsenti a Le par tous les moyens app ropri s, y com pris en p articu lier l' adopti on de mesu reslOf^islatives,

Les Etats parties au prsent Pacte s*engagent assurer le droit gal qu'ontl*honnne et la femme au bnfice de tous les droits conomiques, sociaux et culturelsqui sont numrs dans le prsent Pacte.

Article ^Les Eitats parties au prsent Pacte reconnaissent que, dans la jouissance des

droits assure par l*Etat conformment au prsent Pacte, l*Etat ne peut soumettreces droits qu'aux limitations tablies par la loi^ dans la seule mesure compatibleavec la nature de ces droits et exclusivement en vue de favoriser le bien-tregnral dans une socit dmocratique.

Article ^1. Aucune disposition du prsent Pacte ne peut etre interprte comme

impliquant pour un Etat, un groupement ou un individu un droit quelconque de selivrer une activit ou d'accomplir un acte visant la destruction des droits ouliberts reconnus dans le prsent Pacte ou des limitations plus amples que cellesprvues dans ledit Pacte.

2. Il ne peut tre admis aucune restriction ou drogation aux droits fonda-mentaux de 1*homme reconnus ou en vigueur dans tout pays en vertu de lois, deconventions, de rglements ou de coutumes, sous pi^texte que le prsent Pacte ne lesreconnat pas ou les reconnat un moindre degr.

TROISIEME PARTIEArticle 6

1. Les Etats parties au prsent Pacte reconnaissent le droit au travail, quicomprend le droit qu*a toute persoime d*obtenir la possibilit de gagner sa vie paruh travail librement choisi ou accept, et prendront des mesures appropries poursauvegarder ce droit.

2. Les mesures que chacun des Etats parties au prsent Pacte prendra en vued'assurer le plein exercice de ce droit doivent inclure l'orientation et la formationtechniques et professionnelles, l'laboration de programmes, de politiques et detechnique^ propres assurer un dveloppement conomique, social et culturel constantet un plein emploi productif dans des conditions qui sauvegardent aux individus lajouissance des liberts politiques et conomiques fondamentales.

Article 7Les Etats parties au prsent Pacte reconnaissent le droit qu'a toute personne de

juir de conditions de travail justes et favorables, qui assurent notamment :a) La rmunration qui procure, au minimum, tous les travailleurs :

i) Un salaire quitable et une rmunration gale pour un travail devaleur gale feans distinction aucune; en particulier, les femmes doiventavoir la garantie que les conditions de travail qui leur sont accordesne sont pas infrieures celles dont bnficient les hommes et recevoirla mme rmunration qu'eux pour un mme travail;

ii) Une existence dcente pour eux et leur famille conformment aux dispo-sitions du prsent Pacte;

b) La scurit et l'hygine du travail;

c) La meme possibilit pour tou6 d*tre promus, dans leur travail, la cat-gorie Suprieure approprie, sans autre considration que la dure des servlceeaccomplis et les aptitudes;

d) Le repos, les loisirs, la limitation raisonnable de la dure du travail etles ohgs pays priodiques, ainsi que la rmunration des Jours fris.

Article 81, Les Etats parties au prsent Pacte s'engagent assurer :a) Le droit qu*a toute personne de former avec d'autres des syndicats et de

s'affilier au syndicat de son choix, sous la seule rserve des rgles fixes parl'organisation Intresse, en vue de favoriser et de protger ses Intrts conomiqueset sociaux. L'exercice de ce droit ne peut faire l'objet que des seules restrictionsprvues par la loi et qui constituent des mesures ncessaires, dans une socit dmo-cratique, dans l'intrt de la scurit nationale ou de l'ordre public, ou pourprotger les droits et les liberts d'autrui;

b) Le droit qu'ont les syndicats de former des fdrations ou des conidrationsnationales et le droit qu'ont celles-ci de former des organisations syndicales inter-nationales ou de s'y affilier;

Le droit qu'ont les syndicats d'exercer librement leur activit, san limi-tations autres que celles qui sont prvues par la loi et qui constituent des mesuresncessaires dans une socit dmocratique, dans l'Intrt de la scurit nationale oude l'ordre public, ou pour protger les droits et les liberts d'autrui;

d) Le droit de grve, exerc conformment aux lois de chaque pays.2. Le prsent article n'empche pas de soumettre des restrictions lgales

3. Aucune disposition du prsent article ne permet aux Etats parties laConvention de 19l*8 de l'Organisation internationale du Travail concernant la libertsyndicale et la protection du droit syndical de prendre des mesures lgislativesportant atteinte - ou d'appliquer la loi de faon porter atteinte - aux garantiesprvues dans ladite convention.

Article 9Les Etats parties au prsent Pacte reconnaissent le droit de toute personne

la scurit sociale, y compris les assurances sociales.

Article 10Les Etats parties au prsent Pacte reconnaissent que :1. Une protection et une assistance aussi larges que possible doivent tre

accordes la famille, qui est l'lment naturel et fondamental de la socit, enparticulier pour sa formation et aussi longtemps qu'elle a la responsabilit del'entretien et de l'ducation d'enfants char ge. Le mariage doit tre librementconsenti par les futurs poux.

2. Une protection spciale doit tre accorde aux mres pendant une priode detemps raisonnable avant et aprs la naissance des enfants. Les mres salariesdoivent bnficier, pendant cette mme priode, d'un cong pay ou d'un cong accom-pagn de prestations de scurit sociale adquates.

3. Des mesures spciales de protection et d'assistance doivent tre prises enfaveur de tous les enfants et adolescents, sans discrimination aucune pour des raisonde filiation ou autre s. Les enfants et adolescents doivent tre protgs contrel'exploitation conomique et sociale. Le fait de les employer des travaux de natur compromettre leur moralit ou leur sant, mettre leur vie en danger ou nuire

leur dveloppement normal doit tre sanctionne par la loi. Les Etats doivent aussifixer des limites d'ge au-dessous desquelles l'emploi salari de la main-d'oeuvreenfantine sera interdit et sanctionn par la loi.

Article 111. Les Etats parties au prsent Pacte reconnaissent le droit de toute personne

un niveau de vie suffisant pour elle-mme et sa famille, y compris une nourriture,un vtement et un logement suffisants, ainsi qu' une amlioration constante de sesconditions d'existen ce. Les Etats parties prendront des mesures approprie s pourassurer la ralisation de ce droit et ils reconnaissent cet effet l'importanceessentielle d'une coopration internationale librement consentie.

2. Les Etats parties au prsent Pacte, reconnaissant le droit fondamental qu'atoute personne d'tre l'abri de la faim, adopteront, individuellement et au moyen dela coopration internationale, les mesured ncessaires, y compris des programmesconcrets :

a) Pour amliorer les mthodes de production, de conservation et de distri-bution des denres alimentaires par la pleine utilisation des connaissances techniqueset scientifiques, par la diffusion de principes d'ducation nutritionnelle et par ledveloppement ou la rforme des rgimes agraires, de manire assurer au mieux lamise en valeur et l'utilisation des ressources naturelles;

b) Pour assurer une rpartition quitable des ressources alimentaires mondialespar rapport aux besoins, compte tenu des problmes qui se posent tant aux pays impor-tateurs qu'aux pays exportateurs de denres alimentaires.

2. Les i'sures que ls Etats pal-ties au prsent Pacte prendront en vued'assurer le pl'in exercice de ce dioii devront comprendre les mesures ncessairespour assurer :

a) La diminution de la mortinatlit et de la mortalit infantilCi ainsi quele dveloppement sain de l*nfant;

b) L'amlioration de tous les aspects de l'hygine du milieu et de l'hygineindustrielle;

c) La proj>hylaxie et le traitement des maladies pidmiques, endmiques,professionnelles et autres, ainsi que lia lutte contre ces maladies;

d) La crtion de conditions prot>res assurer tous des services mdicauxet une aide mdicale en cas de maladie.

Article 131. Les Etats parties au prsent acte reconnaissent le droit de toute personne

l'ducation. Ils conviennent que l'ducation doit viser au plein panouissement dela personnalit humaine et du sens de sa dignit et renforcer le respect des droitsde l'homme et des liberts fondamentales. Ils conviennent en outre que l'ducationdoit mettre toute personne en mesure de jouer un role utile dans une socit libre,favoriser la ccmprhension, la tolrance et l'amiti entre toutes les nations et tousles groupes raciaux, ethniques ou religieux et encourager le dveloppement desactivits des Nations Unies pour le maintien de la paix.

2. Les Etats parties au prsent Pacte reconnaissent qu'en vue d'assurer leplein exercice de ce droit ;

a) L'enseignement primaire doit tre obligatoire et accessible gratuitement tous ;

b) L'enseignement secondaire, sous ses diffrentes formes, y compris l'ensei-gnement secondaire technique et professionnel, doit tre gnralis et renduaccessible tous par tous les moyens appropris et notamment par l'instaurationprogressive de la gratuit;

) L'enseignement suprieur doit tre rendu accessible tous en pleinegalit, en fonction des capacits de chacun, par tous les moyens appropris etnotamment par l'instauration progressive de la gratuit;

d) L'ducation de base doit tre encourage ou intensifie, dans touce lamesure possible, pour les personnes qui n'ont pas reu d'instruction primaire ou quine l'ont pas reue jusqu' son terme;

_e) Il faut poursu ivre activ emen t le dvel oppem ent d'un rseau scolaire tousles chelons, tablir un systme adquat de bourses et amliorer de faon continue lesconditions matrielles du personnel enseignant.

3. Les Etats parties au prsent Pacte s'engagent respecter la libert desparents et, le cas chant, des tuteurs lgaux, de choisir pour leurs enfants ds tablis-sements autres que ceux des pouvoirs publics, mais conformes aux normes minimales quipeuvent tre prescrites ou approuves par l'Etat en matire d'ducation, ez de faireassurer l'ducation religieuse et morale de leurs enfants conformment leurs propresconvictions.

tablissements d'enseignement, sous rserve que les principes noncs au paragraphe du prsent article soient observs et que l'ducation donne dans ces tablissementssoit conforme aux normes minimales qui peuvent tre prescrites par l*Etat.

Article IkTout Etat partie au prsent Pacte qui, au moment o il devient partie, n'a pas

encore pu assurer dans sa mtropole ou dans les territoires placs sous sa juridictile caractre obligatoire et la gratuit de l'enseignement primaire s'engage tabliret adopter, dans un dlai de deux ans, un plan dtaill des mesures ncessaires poraliser progressivement, dans un nombre raisonnable d'annes fix par ce plan, lapleine application du principe de l'enseignement primaire obligatoire et gratuit pourtous.

Article1. Les Etats parties au prsent Pacte reconnaissent chacun le droit :a) De participer la vie culturelle;b) De bnfi cier du progrs scientifique et de ses applications;c) De bnf icier de la protection des intrts moraux et matri els dcoulant d

toute production scientifique, littraire ou artistique dont il est l'au teur.2. Les mesures que les Etats parties au prsent Pacte prendront eu vue d'assur

le plein exercice de ce droit devront comprendre celles qui sopi ncessaires pourassurer le maintien, le dveloppement et la diffusion de la science et de la culture.

3. Les Etats parties au prsent Pacte s'engagent respecter la libert indis-pensable la recherche scientifique et aux activits cratrices.

k. Les E tats parties au prsent Pacte reconnaissent les bienfaits qui doiventrsulter de l'encouragement et du dveloppement de la coopration et des contactsinternationaux dans le domaine de la science et de la culture.

QUATRIEME PARTIEArticle 16

1. Les Etats parties au prsent Pacte s'engagent prsenter, conformment auxdispositions de la prsente partie du Pacte, des rapports sur les mesures qu'ils aurontadoptes et sur les progrs accomplis en vue d'assurer le respect des droits reconnusdans le Pacte.

2. a) Tous les rapports sont adresss au Secrtaire gnral de l'Organisationdes Ifetions Unies, qui en transmet copie au Conseil conomique et social, pour examen,conformment aux dispositions du prsent Pacte.

b) Le Secrtaire gnral de l'Organisation des Nations Unies transmet galementaux institutions spcialises copie des rapports, ou de toutes parties pertinentes desrapports, envoys par les Etats parties au prsent Pacte qui sont galement membresdesdites institutions spcialises, pour autant que ces rapports, ou parties de rapports,ont trait des questions relevat de la comptence desdites institutions aux termesde leurs actes constitutifs respectifs.

Article 171. Les Etats parties au prsent Pacte prsentent leurs rapports par tapes, selon

un programme qu'tablira le Conseil conomique et social dans un dlai d'un an compterde la date d'entre en vigueur du prsent Pacte, aprs avoir consult les Etats partieset les institutions spcialises intresses.

2. Les rapports peuvent faire connatre les facteurs et les difficults empchaces Etats de s'acquitter pleinement des obligations prvues au prsent Pacte.

3 , Dans le cas o des renseignements ce sujet ont dj t adresss l'Organisation des Nations Unies ou une institution spcialise par un Etat partieau Pacte, il. ne sera pas ncessaire de reproduire lesdits renseignements et une rfreprcise ces renseignements suffira.

Article 1 8En vertu des responsabilits qui lui sont confres par la Charte des Nations Uni

dans le domaine des droits de l'homme et des liberts fondamentales, le Conseilconomique et social pourra conclure des arrangements avec les institutions spcialisen vue de la prsentation par celle-ci de rapports relatifs aux progrs accomplis quan l'observation des dispositions du prsent Pacte qui entrent dans le cadre de leursactiv its. Ces rapports pourront comprendre des donnes sur les dcisions et recommandations adoptes par les organes comptents des institutions spcialises au sujet decette mise en oeuvre.

Article 19Le Conseil conomique et social peut renvoyer la Commission des droits de l'hom

aux fins d'tude et de recommandation d'ordre gnral ou pour information, s'il y a liles rapports concernant les droits de l'homme que communiquent les Etats conformmentaux articles 1 6 et 17 et les rapports concernant les droits de l'homme que communiquenles institutions spcialises conformment l'article I 8 .

Article 20Les Etats parties au prsent Pacte et les institutions spcialises intresses

peuvent prsenter au Conseil conomique et social des observations sur toute

reconanandation d*ordre gnral faite en vertu de l'article 19 ou siu* toute mentiond*une recommandation d'ordre gnral figurant cfans un rapport de la Cpomiiion d6;cdroite de 1*homme ou dans tout document mentionn dans ledit rapport.

gnrale des rapports contenant des reconmandations de caxactre gnral et un rsumdes renseigneinents reus des Etats parties a,u prsent Pacte et des instdtutionsspcialises sur les mesures prises et les pro prs accomplis en vue diassurer 3erespect gemral des droits reconnus dans le prsent B&cte.

Article 22Le Conseil conomique et social peut porter l'attention des aui^re? organec de

l'Organisation des Nations Unies, de leurs organes subsidiaires et des institutionsspcialises intresses qui s*occupent de fournir une assistance teclmique toutequestion que soulvent les :rapports mentionns dans la prsente partie du prsentPacte et qui peut aider ces organismes se prononcer, chacun dans sa propie sphrede comptence, sur l'opportunit de mesures Internationales propres contribuer lamise en oeuvre effective et progressive du prsent Pacte*

Article 23Les Etat^ parties au prsent Pacte convleruient que les mesures dtordre international

destines assurer la ralisation des droits reconnus dans ledit Pacte comprennentnotaflwient la conclusion de conventions, l'adoption de reccpmandationsi, la fournitured'une assistemce techftique et l'organist loa, en liaison avec les gQuvs=rnemente int-resss, de runions rgionales et de runions techniques aux fins de onsultaiicns etd'tudes.

droit inhrent de tous les peuples profiter et user pleinement et librement deleurs richesses et ressources naturelles.

CINQUIEME PARTIEArticle 26

1, Le prsent Pacte est ouvert la signature de tout Etat Membre del'Organisation des Nations Unies ou membre de l'une quelconque de ses institutionsspcialises, de tout Etat partie au Statut de la Cour internationale de Justice,ainsi que de tout autre Etat invit par l'Assemble gnrale des Nations Unies bdevenir partie au prsent Pacte.

2. Le prsent Pacte est sujet ratification et les instilments de ratificatiseront dposs auprs du Secrtaire gnral de l'Organisation des Nations Unies.

3 Le prsent Pacte sera ouvert l'adhsion de tout Etat vis au paragraphe du prsent article

11-. L'adhsion se fera par le dpt d'un instrument d'adhsion auprs duSecrtaire gnral de l'Organisation des Nations Unies.

5. Le Secrtaire gnral de l'Organisation des Nations Unies informe tous lesEtats qui ont sign le prsent Pacte ou qui y ont adhr du dpt de chaque instrumentde ratification ou d'adhsion.

Article 271. Le prsent Pacte entrera en vigueur trois mois aprs la date du dpt auprs

du Secrtaire gnral de l'Organisation des Htions Unies du trente-cinquime instrumentde ratification ou d'adhsion.

2. Pour chacun des Etats qui ratifieront le prsent Pacte ou y adhreront aprsle dpSt du trente-cinquime instrument de ratification ou d'adhsion, ledit Pacteentrera en vigueur trois mois aprs la date du dpt par cet Etat de son instrumentde ratification ou d'adhsion.

Article 2 8Les dispositions du prsent Pacte s'appliquent, sans limitation ni exception aucune,

toutes les units constitutives des Etats fdratifs.

Article 291. Qtout Etat parti e au prsent Pact e peut prop oser un amende ment et en dpose r

le texte auprs du Secrtaire gnral de l'Organisation des Nations Uni es. LeSecrtaire gnral transmet alors tous projets d'amendements aux Etats parties auprsent Pacte en leur demandant de lui indiquer s'ils dsirent voir convoquer uneconfrence d'Etats parties pour examiner ces projets et les mettre aux voix. Si untiers au moins des Etats se dclarent en faveur de cette convocation, le Secrtairegnral convoque la confrence sous les auspices de l'Organisation des Nations Unies.Tout amendement adopt par la majorit des Etats prsents et votants la confrenceest soumis pour approbation l'Assemble gnrale des Nations Unies.

Ces amendements entrer - vigueur lorsqu'ils ont t app3x>uvs par l'Assembgnrale des feitions Unies et accepts, conformment leurs rgles constitutionnellesrespectives, par une majorit des deux tiers des Etats parties au prsent Pacte.

3 Lorsque ces amendements entrent en vigueur, ils sont obligatoires pour lesEtats parties qui les ont accepts, les autres Etats parties restant lis par les dispsitions du prsent Pacte et par tout amendement antrieur qu'ils ont accept.

Article 30Indpendamment des notifications prvues au paragraphe 5 de l'article 26, le

Secrtaire gnral de l'Organisation des Nations Unies informera tous les litats vissau paragraphe 1 dudit article :

a) Des signatures apposes au prsent Pacte et des instrument^ de ratificationet d'adhsion dposs conformment l'article 26;

b) De la date laquelle le prsent Pacte entrera en vigueur confonnment ^l'article 27 et de la date laquelle entreront en vigueur les amendements prvus l'article 29.

Article 311. Le prsent Pacte, dont les textes anglais, chinois, espagnol, franais et

ri-spe font galement foi, sera dpos aux archives de l'Organisation des iations Unies2. Le Secrtaire gnral de l'Organisation des Nations Unies transmettra une

copie certifie conforme du prsent Pacte tous les Etats viss l'article 26.EN FOI DE QUOI les soussigns, dment autoriss par leurs Gouvernements respectif

ont sign le prsent Pacte, qui a t ouvert la signature New York, ledix-neuf dcembre mil neuf cent soixante-six.

Los Estados Partes en el presente Pacto,Considerando que, conforme a los principios enunciados en la Carta de las Naciones

Unidas, la libertad, la justicia y la paz en el mundo tienen por el reconocimiento dela dignidad inherente a todos los miembros de la familia humana y de sus derechos igualese inalienables.

Reconociendo que estos derechos se desprenden de la dignidad inherente a la personahumana,

Reconociendo que, con arreglo a la Declaracin Universal de Derechos Humanos, no puederealizarse el ideal del ser humano libre, liberado del temor y de la miseria, a menos quese creen condiciones que permitan a cada persona gozar de sus derechos econmicos, socialesy culturales, tanto como de sus derechos civiles y polticos.

Considerando que la Carta de las Naciones Unidas impone a los Estados la obligacin depromover el respeto universal y efectivo de los derechos y libertades hvunanos.Comprendiendo que el individuo, por tener deberes respecto de otros individiios y de lacomunidad a que pertenece, est obligado a procurar la vigencia y observancia de los derechosreconocidos en este Pacto,

Conviene en los artculos siguientes:PARTE I

Artculo 11. Todos los pueblos tienen el derechode libre determinacin. En virtud de este

derecho establecen libremente su condicin poltica y proveen asimismo a su desarrollo econ

PARTE IIArtculo 2

1. Cada uno de los Estados Partes en el presente Pacto se compromete a adoptarmedidas, tanto por separado como mediante la asistencia y la cooperacin internacionales,especialmente econmicas y tcnicas, hasta el mximo de los recursos de que disponga, paralograr progresivamente, por todos los medios apropiados, inclusive en particular la adop-cin de medidas legislativas, la plena efectividad de los derechos aqu reconocidos.

2. Los Estados Partes en el presente Pacto se comprometen a garantizar el ejerciciode los derechos que en l se enuncian, sin discriminacin alguna por motivos de raza, colorsexo, idioma, religin, opinin poltica o de otra ndole, origen nacional o social, posi-cin econmica, nacimiento o cualquier otra condicin social.

3. Los pases en vas de desarrollo, teniendo debidamente en cuenta los derechoshumanos y su economa nacional, podrn determinar en qu medida garantizarn los derechoseconmicos reconocidos en el presente Pacto a personas que no sean nacionales suyos.

Artculo 3Los Estados Partes en el presente Pacto se comprometen a asegurar a los hombres y a

las mujeres igual ttulo a gozar de todos los derechos econmicos, sociales y culturalesenunciados en el presente Pacto.

Artculo kLos Estados Partes en el presente Pacto reconocen que, en el ejercicio de los derechos

garantizados conforme al presente Pacto por el Estado, ste podr someter tales derechosunidamente a limitaciones determinadas por ley, slo en la medida compatible con la natu-raleza de esos derechos y con el exclusivo objeto de promover el bienestar general en unasociedad democrtica.

Artculo 31. Ninguna disposicin del presente Pacto podr ser interpretada en el sentido de

reconocer derecho alguno a un Estado, grupo o individuo para emprender actividades orealizar actos encaminados a la destruccin de cualquiera de los derechos o libertadesreconocidos en el Pacto, o a su limitacin en medida mayor que la prevista en l.

2, No podr admitirse restriccin o menoscabo de ninguno de los derechos humanosfundamentales reconocidos o vigentes en un pas en virtud de leyes, convenciones, regla-mentos o costumbres, a pretexto de que el presente Pacto no los reconoce o los reconoceen menor grado.

PARTE IIIArtculo 6

1. IJOS Estados Partes en e] presente Pacto reconocen el derecho a trabajar quecomprende el derecho de toda persona de tener la oportunidad de ganarse la vida mediante untrabajo libremente escogido o aceptado, y tomarn medidas adecuadas para garantizar estederecho.

2. Entre las medidas que habr de adoptar cada uno de los Estados Partes en el present.Pacto para lograr la plena efectividad de este derecho deber figurar orientacin y formocic^nt^cnicoprofesional, la preparacin de programas, normas y tcnicas encaminadas a conseguir "desarrollo econmico, social y cultural constante y la ocupacin plena y productiva, en condiciones que garanticen las libertades polticas y econmicas fundamentales de la persona humar>

Artculo 7Los Estados Partes en el presente Pacto reconocen el derecho de toda persona al go^" de

condiciones de trabajo equitativas y satisfactorias que le aseguren en especial:a) Una remuneracin que proporcione como mnimo a todos los trabajadores:

i) Un salario equitati vo e igual por trabajo de igual valor, sin distinc iones deninguna especie; en particular, debe asegurarse a las mujeres condiciones detrabajo no inferiores a las de los hombres, con salario igual por trabajoigual;

ii) Condic iones de existen cia dignas para ellos y para sus familias conforie alas disposiciones del presente Pacto;

b) La seguridad y la higiene en el trabajo;c) Igual oportunidad para todos de ser promovi dos, dentro de su trabajo, a la cate-

gora superior que les corresponda, sin ms consideraciones que los factores de tiempvO deservicio y capacidad;

d) El desca nso, el disfrute del tiempo libre, la limitacin razonable de las horas detrabajo y las vacaciones peridicas pagadas, as como la remuneracin de ios das festivos.

Artculo 81. Los Estados Partes en el presente Pacto se comprom eten a garan tizar:a) El derec ho de toda persona a fundar sindicatos y a afiliarse al de su elec cin ,

con sujecin vnicamente a los estatutos de la organizacin correspondiente, para promovery prot eger sus intereses econmicos y sociales. No podrn imponerse otras restricciones alejercicio de este derecho que las que prescriba la ley y que sean necesarias en una sociedaddemocrtica en inters de la seguridad nacional o del orden piblico, o para la proteccin delos derechos y libertades ajenos;

b) El derecho de los sindicatos a formar federaciones o confederaciones nacionales yel de stas a fundar organizaciones sindicales internacionales o a afiliarse a las mismas;

c) El derecho de los sindicatos a funcionar sin obstculos y sin otras limitacionesque las que prescriba la ley y que sean necesarias en una sociedad democrtica en intersde la seguridad nacional o del orden pvblico o para la proteccin de los derechos y liber-tades ajenos;

d) El derecho de huelga, ejercido de conformidad con las leyes de cada pas.2. El presente artculo no impedir someter a restricciones legales el ejercicio de

tales derechos por los miembros de las fuerzas armadas, de la polica o de la administracidel Estado.

5. Nada de lo dispuesto en este artculo autorizar a los Estados Partes en elConvenio de la Organizacin Internacional del Trabajo de 1 9 ^ relativo a la libertad sindicy a la proteccin del derecho de sindicacin a adoptar medidas legislativas que menoscabenlas garantas previstas en dicho Convenio o a aplicar la ley en forma que menoscabe dichasgarantas.

Artculo 9Los Estados Partes en el presente Pacto reconocen el derecho de toda persona a la segu

ridad social, incluso al seguro social.Artculo 10

Los Estados Partes en el presente Pacto reconocen que:1. Se debe conceder a la familia, que es el elemento natural y fundamental de la

sociedad, la ms amplia proteccin y asistencia posibles, especialmente para su constitu-cin y mientras sea responsable del cuidado y la educacin de los hijos a su cargo. Elmatrimonio debe contraerse con el libre consentimiento de los futuros cnyuges.2. Se debe conceder especial proteccin a las ma res durante un perodo de tiemporazonable antes y despus del parto. Durante dicho perodo, a las madres que trabajen seles debe conceder licencia con remuneracin o con prestaciones adecuadas de seguridadsocial.

3. Se deben adoptar medidas especiales de proteccin y asistencia en favor de todoslos nios y adolescentes, sin discriminacin alguna por razn de filiacin o cualquier otracondicin. Debe protegerse a los nios y adolescentes contra la explotacin econmica ysocial. Su empleo en trabajos nocivos para su moral y salud, o en los cuales peligre suvida o se corra el riesgo de perjudicar su desarrollo normal, ser sancionado por la ley.Los Estados deben establecer tambin lmites de edad por debajo de los cuales quede prohi-bido y sancionado por la ley el empleo a sueldo de mano de obra infantil.

Artculo 11 1. Los Estados Partes en el presente Pacto reconocen el derecho de toda persona a

un nivel de vida adecuado para s y su familia, incluso alimentacin, vestido y viviendaadecuados, y a una mejora continua de las condiciones de existencia. Los Estados Partestomarn medidas apropiadas para asegurar la efectividad de este derecho, reconociendo aeste efecto la importancia esencial de la cooperacin internacional fundada en el libreconsentimiento.

2. Los Estados Partes en el presente Pacto, reconociendo el derecho fundamental detoda persona a estar protegida contra el hambre, adoptarn, individualmente y mediante lacooperci6n internacional, las medidas, incluidos programas concretos, que se necesitenpara:a) Mejorar los mtodos de producci6n, conservacidn y distribucin de alimentosmediante la plena utilizacidn de los conocimientos tcnicos y cientficos, la divulgacinde principios sobre nutricin y el perfeccionamiento o la reforma de los regmenes agrariosde modo que se logre la explotacin y la utilizacin ms eficaces de las riquezas naturales;

b) Asegurar una distribucin equitativa de los alimentos mundiales en relacin conlas necesidades, teniendo en cuenta los problemas que se plantean tanto a los pases queimportan productos alimenticios como a los que los exportan.

Artculo 12] Los Estados Partes en el presente Pacto reconocen el derecho de toda persona aldisfrute del ms alto nivel posible de salud fsica y mental.2. Entre las medidas que debern adoptar los Estados Partes en el Pacto a fin de

asegurar la plena efectividad de este derecho, figurarn las necesarias para:a) La reduccin de la mortinatalidad y de la mortalidad infantil, y el sano desa-

rrollo de los nios;b) El mejoramiento en todos sus aspectos de la higiene del trabajo y del medio

ambiente;c) La prevencin y el tratamiento de las enfermedades epidmicas, endmicas, profe-

siotiales y de otra ndole, y la lucha contra ellas;d) La creacin de condiciones que aseguren a todos asistencia mdica y servicios

mdicos en caso de enfermedad." Artculo 13

1. Los Estados Partes en el presente Pacto reconocen el derecho de toda persona ala educacin. Convienen en que la educacin debe orientarse hacia el pleno desarrollo dela personalidad humana y del sentido de su dignidad, y debe fortalecer el respeto por losderechos humanos y las libertades fundamentales. Convienen asimismo en que la educacindebe capacitar a todas las personas para participar efectivamente en una sociedad libre,favorecer la comprensin, la tolerancia y la amistad entre todas las naciones y entre todoslos grupos raciales, tnicos o religiosos, y promover las actividades de las Naciones Unidasen pro del mantenimiento de la paz.

2. Los Estados Partes en el presente Pacto reconocen que, con objeto de lograr elpleno ejercicio de este derecho:

a) La enseanza primaria debe ser obligatoria y asequible a todos gratuitamente;

b) La enseanza secundaria, en sus diferentes formas, incluso la enseanza secundariatcnica y profesional, debe ser generalizada y hacerse accesible a todos, por cuantos mediossean apropiados y, en particular, por la implantacin progresiva de la enseanza gratuita;

c) La ensea nza superior debe hace rse igualmente accesible a todos, sobre la base dela capacidad de cada uno, por cuantos medios sean apropiados, y en particular, por la implan-tacidn progresiva de la enseanza gratuita;

d) Debe fomentarse o intensificarse, en la medida de lo posible, la educacin funda-mental para aquellas personas que no hayan recibido o terminado el ciclo completo deinstruccin primaria;

e) 3e debe proseguir activame nte el desarr ollo del sistema escol ar en todos losciclos de la enseanza, implantar un sistema adecuado de becas, y mejorar continuamente lascondiciones materiales del cuerpo docente.

5. Los Estado s Partes en el presen te Pacto se comprom eten a respet ar la libertad delos padres y, en su caso, de los tutores legales, de escoger para sus hijos o pupilosescuelas distintas de las creadas por las autoridades piblicas, siempre que aqullas satis-fagan las normas mnimas que el Estado prescriba o apruebe en materia de enseanza, y dehacer que sus hijos o pupilos reciban la educacin religiosa o moral que est de acuerdo consus propias convicciones.

h. Nada de lo dispues to en este artculo se inter preta r como una restri ccin de lalibertad de los particulares y entidades para establecer y dirigir instituciones de ense-anza, a condicin de que se respeten los prin cipios enunci ados en el prrafo 1 y de que laeducacin dada en esas instituciones se ajuste a las normas mnimas que prescriba el Estado.

Artculo lUTodo Estado Parte en el presente Pacto que, en el momento de hacerse parte en l, ad n

no haya podido instituir en su territorio metropolitano o en otros territorios sometidosa su jurisdiccin la obligatoriedad y la gratuidad de la enseanza primaria, se comprometea elaborar y adoptar, dentro de un plazo de dos aos, un plan detallado de accin para laaplicacin progresiva, dentro de un mmero razonable de aos fijado en el plan, del prin-cipio de la enseanza obligatoria y gratuita para todos.

Artculo 131. Lo3 Estados Partes en el present e Pact o reconoc en el derec ho de toda person a a:a) Participar en la vida cultural;b) Gozar de los beneficios del progreso cientfico y de sus aplicaciones;c) Benefi ciarse de la protec cin de los intereses morales y mater iales que le

correspondan por razn de las producciones cientficas, literarias o artsticas de quesea autora.

2. Entre las medidas que los Esta dos Partes en el presente Pacto deber n adopta rpara asegurar el pleno ejercicio de este derecho, figurarn las necesarias para la conser-vacin, el desarrollo y la difusin de la ciencia y de la cultura.

5. Los Estados Partes en el presente Pacto se comprometen a respetar la indispen-sable libertad para la investigacidn cientfica y para la actividad creadora-

1+. Los Estados Partes en el presente Pacto reconocen los beneficios que derivan delfomento y desarrollo de la cooperacin y de las relaciones internacionales en cuestionescientficas y culturales.

PARTE IVArtculo 16

1. Los Estados Partes en el presente Pacto se comprometen a presentar, en confor-midad con esta parte del Pacto, informes sobre las medidas que hayan adoptado, y losprogresos realizados, con el fin de asegurar el respeto a los derechos reconocidos en elmismo.

2. a) Todos los informes sern presentados al Secretario General de las NacionesUnidas, quien transmitir copias al Consejo Econmico y Social para que las examineconforme a lo dispuesto en el presente Pacto.

b) El Secretario General de las Naciones Unidas transmitir tambin a los orga-nismos especializados copias de los informes, o de las partes pertinentes de stos,enviados por los Estados Partes en el presente Pacto que adems sean miembros de esosorganismos especializados, en la medida en que tales informes o partes de ellos tenganrelacin con materias que de la competencia de dichos organismos conforme a susinstrumentos constitutivos.

Artculo 171. Los Estados Partes en el presente Pacto presentarn sus informes por etapas, con

arreglo al programa que establecer el Consejo Econmico y Social en el plazo de un aodesde la entrada en vigor del presente Pacto, previa consulta con los Estados Partes y conlos organismos especializados interesados.

2. Los informes podrn sealar las circunstancias y dificultades que afecten el gradode cumplimiento de las obligaciones previstas en este Pacto.

3. Cuando la informacin pertinente hubiera sido ya proporcionada a las NacionesUnidas o a algxln organismo especializado por un Estado Parte, no ser necesario repetirdicha informacin, sino que bastar hacer referencia concreta a la misma.

Artculo 18En virtud de las atribuciones que la Carta de las Naciones Unidas le confiere en

materia de derechos humanos y libertades fundamentales, el Consejo Econmico y Social podrconcluir acuerdos con los organismos especializados sobre la presentacin por tales orga-nismos de informes relativos al cumplimiento de las disposiciones de este Pacto que corres-ponden a su campo de actividades. Estos informes podrn contener detalles sobre las deci-siones y recomendaciones que en relacin con ese cumplimiento hayan aprobado los rganoscompetentes de dichos organismos.

Ajrtfculo 19El Consejo !con6raico y Social podr transmitii* a la Comisin de Derechos Humanos, para

su eistudio y recc?mendacin de carcter generl, o para informatidn, segn procteda, losinfoibmes sobre derechos humanos que presenten los stados onforme a los arttulos 1 6 y I7,y los informes relativos a los derechos humanos que presenten los organismos especializadosconforme al artculo 1 8 .

t-faculo 20Los Estados partes en el presente Pacto y los organismos especializados interesados

podrn presentar al Consejo Econmico y Social observaciones sobre toda recomendacin decarcter general hecha en virt.ud del artculo I9 o toda referencia a tal recomendacingeneral que const'5 en un infoime de la Comisin de berechos Humanos o en un documento allmencionado.

Aytculo 21El Consejo Econmico y Social podr presentar de vez en cando a la Asamblea General

informes que contngan recomendaciones de carcter general as como un resumen de la infor-macin recibida delos Estados Partes en el presente Pacto y de los organismos especiali-zados acerca de Kis medidas adoptadas y los progress realizados para lograr el respetogeneral de los derechos reconocidos en el ptesente Pacto.

Artculo 221 Consejo Edonmico y Social podr sealar a la atencin de otros rganos de las

Naciones Unidas, us rganos subsidiarios y los orgnismos especializados interesados quese ocupen de prestar asistencia tcnica, tba cuestin surgida de los informes a que serefieip esta part^ del Pacto qi;ie pueda servir para ^ue dichas entidades se prouncien,cada una dentro de su esfera de competencia, sobre la conveniencia de las medidas inter-nacionales que puedan contribuir a la aplicacin efectiva y progresiva del presente Pacto.

Artculo 2?Los Estados Partes en el presente Pacto convienen en que las medidas de orden inter-

nacional destinadas a asegurar el respeto de los derechos que se reconocen en el presentePacto comprenden procedimientos tales como la conclusin de convenciones, la aprobacin derecomendaciones, la prestacin de asistencia tcnica y la celebracin de reuniones regio-nales y tcnicas, para efectuar consultas y realizar estudios, organizadas en coo)eracincon los gobiernos interesados.

Artculo 2KNinguna disposicin del presente Pacto deber interpretarse en menoscabo de las dispo-

siciones de la Carta de las Naciones Unidas o de las constituciones de los organismos espe-cializados que definen las atribuciones de los diversos rganos de las Naciones Unidas y delos organismos especializados en cuanto a las materias a que se refiere el presente Pacto.

Artculo 25Ninguna disposicin del presente Pacto deer interpretarse en menoscabo del derecho

inherente de todos los pueblos a disfrutar y utilizar plena y libremente sus riquezas yrecursos naturales.

PARTE VArticulo 26

1. El presente Pacto estar abierto a la firma de todos los Estados Miembros de lasNaciones Unidas o miembros de algn organismo especializado, as como de todo Estado Parteen el Estatuto de la Corte Internacional de Justicia y de cualquier otro Estado invitadopor la Asamblea General de las Naciones Unidas a ser parte en el presente Pacto.

2. El presente Pacto est sujeto a ratificacin. Los instrumentos de ratificacinse depositarn en poder del Secretario General de las Naciones Unidas.

3- El presente Pacto quedar abierto a la adhesin de cualquiera de los Estadosmencionados en el prrafo 1 del presente artculo.La adhesin se efectuar mediante el depsito de un instrumento de adhesin eh

poder del Secretario General de las Naciones Unidas.5. El Secretario General de las Naciones Unidas informar a todos los Estados que

hayan firmado el presente Pacto, o se hayan adherido a l, del depsito de cada uno de losinstrumentos de ratificacin o de adhesin.

Artculo 271. El presente Pacto entrar en vigor transcurridos tres meses a partir de la fecha

en que haya sido depositado el trigsimo quinto instrumento de ratificacin o de adhesinen poder del Secretario General de las Naciones Unidas.

2. Para cada Estado que ratifique el presente Pacto o se adhiera a 1 despus dehaber sido depositado el trigsimo quinto instrumento de ratificacin o de adhesin, elPacto entrar en vigor transcurridos tres meses a partir de la fecha en que tal Estadohaya depositado su instrumento de ratificacin o de adhesin.

Artculo 28Las disposiciones del presente Pacto sern aplicables a todas las partes componentes

de los Estados federales, sin limitacin ni excepcin alguna.Artculo 29

1. Todo Estado Parte en el presente Pacto podr proponer enmiendas y depositarlasen poder del Secretario General de las Naciones Unidas. El Secretario General comunicarlas enmiendas propuestas a los Estados Partes en el presente Pacto, pidindoles que lenotifiquen si desean que se convoque una conferencia de Estados Partes con el fin de examinai

las propuestas y someterlas a votaci6n. Si un tercio al menos de los Estados se declara afavor de tal convocatoria, el Secretario General convocar una conferencia bajo los auspiciosde las Naciones Unidas. Toda enmienda adoptada por la mayorf a de Estados presentes y votantesen la conferencia se someter a la aprobacin de la Asamblea General de las Naciones Unidas.2. Tales enmiendas entrarn en vigor cuando hayan sido aprobadas por la AsambleaGeneral de las Naciones Unidas y aceptadas por una mayora de dos tercios de los EstadosPartes en el presente Pacto, de conformidad con sus respectivos procedimientosconstitucionales.

5. Cuando tales enmiendas entren en vigor sern obligatorias para los Estados Partesque las hayan aceptado, en tanto que los dems Estados Partes seguirn obligados por lasdisposiciones del presente Pacto y por toda enmienda anterior que hayan aceptado.

Artculo 30Independientemente de las notificaciones previstas en el prrafo 5 del artculo 26, elSecretario General de las Naciones Unidas comunicar a todos los Estados mencionados en el

prrafo 1 del mismo artculo:a) Las firmas, ratificaciones y adhesiones conformes con lo dispuesto en el

artculo 2 6 ;b) La fecha en que entre en vigor el presente Pacto conforme a lo dispuesto en el

artculo 2 7 , y la fecha en que entren en vigor las enmiendas a que hace referencia elartculo 29 .

Artculo 311. El presente Pacto, cuyos textos en chino, espaol, francs, ingls y ruso sonigualmente autnticos, ser depositado en los archivos de las Naciones Unidas.2. El Secretario General de las Naciones Unidas enviar copias certificadas del

presente Pacto a todos los Estados mencionados en el artculo 26.EW FE DE LO CUAL, los infrascritos, debidamente autorizados para ello por sus

respectivos Gobiernos, han firmado el presente Pacto, el cual ha sido abierto a la firmaen Nueva York, el decimonoveno da del raes de diciembre de mil novecientos sesenta y seis.
