WHAT IS LOSS ADJUSTERS

Private Investigators" of the Insurance Industry.

Independent professional or appointed by the insurance company.

Duties are to investigate, assess/adjust and estimate the total cost of a loss

or damage.

Recommendations and settlement amount.

Must be corporation and licensed by the Insurance Regulator (BNM).

Charge professional fees/services.

Member of the Association of Malaysian Loss Adjusters (AMLA).

Adjusters must be qualified, experienced, good character (integrity), fair and

impartial.

Minimum Paid Up Capital - RM150,000.

AMLA BACKGROUNDThe AMLA (1981) is the association of loss adjusters

approved by the Minister and is registered as a society

under the new Section II of the Societies Act 1966.

Section 20C (1) of the Insurance Act 1963 requires that

no person shall act or hold himself out as an adjuster

unless he is the holder of a license granted by the DGI

and is a member of an association of adjusters approved

by the Minister of Finance.

The exempt from the ruling :

Advocates and solicitors and other professionals

who act or assist in adjusting insurance claims

incidental to the practice of their professions.

Adjusters of maritime losses.

Employees of insurance companies who, in the

course of their employment, act or assist in adjusting

insurance claims but who do not hold themselves out

as adjusters.

MAIN OBJECTIVEThe promotion of the establishment of a sound loss

adjusting structure in Malaysia in co-operation and

consultation with the DGI,

The promotion and representation of the interests of

members in or connected with Malaysia by all means

and methods consistent with the laws and Constitution

of Malaysia,

Co-operation with other similar associations elsewhere

in the world,

Circulation of information likely to be of interest to

members and to collate and publish statistics and any

other relevant information relating to loss adjusting,

and

Work in conjunction with any legal body or association

or any similar body appointed or to be appointed for

the consideration, framing, amendment or alteration of

any law relating to loss adjusting.

DUTIES AND ROLESTo contact the insured immediately and to advise the insured

that he has been appointed to deal with the loss.

To arrange for appointment to discuss the loss with insured.

To be at the scene of the loss as quickly as possible.

To take photographs of all affected properties or scene of

loss/accident.

To interview the manager, supervisor and all relevant parties.

To establish the circumstances and nature of loss/accident.

To establish whether the loss falls within the scope of coverage in the policy

contract.

To inspect the damage properties or loss and appraise its extent.

If the adjusters suspect the validity of the claim and/or its extent of damage,

notes and statement from relevant parties should be properly taken. The

adjusters should then notify his principle accordingly.

Claimant should be advised to take reasonable action and proper measures to

prevent further damages and losses.

To give accurate immediate advice on the quantum of loss to the insurers so

that they can create a reserve amount for the claim.

To keep the principles informed of the progress of the claim, by phone and/or

by preliminary reports.

Finally, to give a full report of the claim to the insurers for their consideration.
