INSTRUCTIONS TO CONTRACTORS TENDERING 1. General

1.1. These instructions do not form part of the contract. 1.2. Failure to comply with these instructions may result in the rejection of the Tender. 1.3. The Contract is being carried out on behalf of Her Majesty’s Government of Gibraltar

and payments will be made, direct to the Contractor, by them on the authorisation of the Contract Administrator.

2. Alterations or Qualifications

2.1. No unauthorised alteration or addition is to be made to the Tender Documents. 2.2. Any qualifications by a Tenderer of the terms of the Tender may invalidate his Tender.

3. Execution of Works

3.1. Tenders shall be submitted on the Form of Tender provided for the execution of the

Works in accordance with the Tender Documents.

4. Submission of Documents

4.1. Tenderers are supplied with one complete set of Contract Documents in electronic format that comprise:

4.1.1. Volume A: Instructions to Tenderers (this document). 4.1.2. Volume A1: Form of Tender. 4.1.3. Volume A2: Conditions of Contract and Preliminaries. 4.1.4. Volume B: Bills of Quantities (including Preambles). 4.1.5. Volume C: Specification. 4.1.6. Volume D: Pre-Tender Health and Safety Information. 4.1.7. Volume E: Environmental Considerations. 4.1.8. All drawings listed at Volume A: A11/110.

4.2. No claim can be accepted as a result of any of the documents not having been received. 4.3. Tenders are to be priced in Pounds Sterling. 4.4. The original electronic copy of the Bills of Quantities and Form of Tender are to be

completed electronically and returned complete as part of the Tender. These documents are to be submitted as follows: 4.4.1. Form of Tender – document completed and signed and submitted scanned as a

.pdf file with file name as “Vol A Form of Tender Road Resurfacing Contract name of contractor”.

4.4.2. Bills of Quantities – document completed and submitted in same Excel format

as issued saved with the file name as “Vol B BQ Road Resurfacing Contract name of contractor”.

4.5. Failure to submit the Tender as per these instructions will result in the Tender NOT being considered.

4.6. Contractors may submit additional documentation in support of the Tender. All documentation submitted in support of the Tender submission is to be in English. Were original literature is in another language a translation, in English, of all text shall be affixed to the original.

4.7. The completed electronic Contract Documents shall be returned to the email address indicated in the Invitation to Tender no later than 12 noon, local time, on the date stated in the Invitation to Tender. Tenders received after this time shall NOT be entertained.

5. Queries

5.1. All queries arising from the documents should in the first instance be directed to the Procurement Office by email, and should be submitted as soon as possible and not later than 10 working days before the date for the submission of Tenders. Queries received after the deadline for submission of queries will NOT be entertained.

6. Agenda or Corrigenda

6.1. Prior to the date for the submission of Tenders the Contract Administrator may issue Addenda or Corrigenda to clarify, modify, add or omit to the Tender documents. One copy of each Addendum or Corrigendum will be issued to every Tenderer and shall become part of the Tender documents; and, receipt thereof, shall be acknowledged promptly, in writing, by the Tenderer.

7. Tenders Confidentiality

7.1. Tenderers shall treat the Tender documents and all details contained therein as private and confidential.

8. Return of Documents & Drawings

8.1. All Tender documents, whether a Tender is submitted or not, remain the property of Her Majesty’s Government of Gibraltar.

8.2. Contractors who have not submitted a Tender or those who have been unsuccessful with their Tenders are to return all hard copy documents and drawings within seven days of notification that their Tender has not been accepted. Any electronic copies retained are to be deleted.

9. Sub-Contractors

9.1. The Tenderer shall take note of the Conditions of Contract in respect of allocating work to sub-contractors Contract Section 8 and relevant amendments in Volume A Conditions of Contract.

10. Acceptance of tender

10.1. Her Majesty’s Government of Gibraltar does not bind itself to accepting the lowest or any tender received.

11. Award Criteria

11.1. The Tender shall be evaluated against the following criteria:

FORM OF TENDER SHORT TITLE OF WORKS: Road Resurfacing Contract FORM OF TENDER INCORPORATING COLLUSIVE TENDERING CERTIFICATE To: Her Majesty’s Government of Gibraltar Technical Services Department Joshua Hassan House Secretary’s Lane Gibraltar Having examined the several tender documents including, the Contract, the Conditions of Contract, the Specification and the Schedule of Rates hereinafter referred to as the “Contract Documents” for the execution of the above-mentioned Works and having obtained all necessary information and authority to enable us to make this offer, we offer to execute and complete and maintain the above-mentioned works in conformity with the Contract Documents for such work as may be ascertained in accordance with the Contract Documents. We undertake to execute and complete the Works comprised in the Contract for the duration stated in the Appendix to the Contract. We agree that if appointed we will enter into the Agreement substantially in the form contained in the Standard Form of Contract. We understand that you are not bound to accept the lowest or any tender you may receive. We accept that Her Majesty’s Government of Gibraltar accepts no liability for any statement or representation made orally unless that statement or representation is also confirmed in writing and signed by a duly authorised representative of the Government. In submitting this tender we confirm that we have relied exclusively upon our own skill and judgement and inspections and enquiries concerning the several matters to which our tender relates. The Employer reserves the right to reduce or increase the scope of the works under the terms

190 ACCESS TO THE SITE:

210 PARKING of the Contractor's and employees' vehicles will be NOT be permitted anywhere

outside the Contractor’s site boundary and in any case vehicles are not to cause obstruction to the free flow of other vehicles on the Public Highway.

220 USE OF THE SITE:

- Do not use the site for any purpose other than carrying out the Works. - Do not display or permit advertisements to be displayed on site without consent of the

240 RISKS TO HEALTH AND SAFETY: The nature and condition of the site/building cannot be fully and certainly ascertained before

The Employer or the CA does not guarantee the accuracy and sufficiency of this information

and the Contractor must ascertain for himself any information he may require to ensure the safety of all persons and the Works.

A20 THE CONTRACT FORM OF CONTRACT: The form of contract shall be the Infrastructure Conditions of Contact (ICC) Minor Works version, August 2011 incorporating the amendments as hereinafter included. A30 TENDERING/SUBLETTING/SUPPLY STATUTORY REQUIREMENTS 100 EMPLOYMENT AND TRAINING BOARD: The Contractor must note and allow for the facts

that all persons employed in Gibraltar must be registered with the Employment and Training Board.

101 SOCIAL CONSIDERATIONS AND EMPLOYMENT OPPORTUNITIES: During the discharge of this Contract, the Contractor shall use its best endeavours to assist the Department of Employment in finding employment for persons registered as long term unemployed and seeking employment (the “Registered Unemployed”). In the event that as a direct result of being awarded this Contract, employment opportunities arise for persons who are Registered Unemployed, the Contractor shall not advertise the employment opportunity without obtaining the prior written consent of the Director of Employment or an officer from the Ministry of Business and Employment and, if so requested by the Director or official, the Contractor shall first consider the employment of Registered Unemployed persons as shall be provided by the Department of Employment or the Ministry of Business and Employment. In the event that the Contractor terminates the employment of a person who was Registered Unemployed prior to or during the discharge of this Contract, the Contractor shall use its best endeavours to liaise with the Department of Employment or Ministry of Business and Employment to replace that person with another person who is Registered Unemployed.

A30 TENDERING/SUBLETTING/SUPPLY cont… MAIN CONTRACT TENDERING 110 SCOPE: These conditions are supplementary to those stated in the invitation to tender and

on the Form of Tender.

Attention is particularly drawn to the requirement that one copy of the original digital copy version as issued of the Bills of Quantities (and all other components of the tender documents) duly completed to be returned with the tender, and that acceptance of these tender documents creates a commitment on your part to do so. Tenders not so submitted shall not be considered. Contractors ignoring this requirement could prejudice their selection for future tender lists.

120 TENDERING PROCEDURE will be generally in accordance with the principles of the 'NBS

Guide to Tendering for Construction Projects’ 2011 and the procurement regulations of H.M. Government of Gibraltar.

160 EXCLUSIONS: If the Contractor cannot tender for any part(s) of the work as defined in the

tender documents he must inform the Procurement Office, as soon as possible, defining the relevant part(s) and stating the reason(s) for his inability to tender.

170 ACCEPTANCE OF TENDER: The Employer and his representatives:

- Offer no guarantee that the lowest or any tender will be recommended for acceptance or accepted.

- Will not be responsible for any costs incurred in the preparation of any tender. 190 PERIOD OF VALIDITY: Tenders must remain open for consideration (unless previously

A30 TENDERING/SUBLETTING/SUPPLY cont… 320 PRICING OF SPECIFICATION: Alterations and qualifications to the specification or the

Contract Documents must not be made without the written consent of the Quantity Surveyor. Tenders containing unauthorised alterations or qualifications may be rejected. Costs relating to items in the specification, which are not priced, will be deemed to have been included elsewhere in the tender.

Any cost the Contractor considers dependent on the Contract Sum must be identified and

the calculation shown on submission of tender. If identification and calculation of such costs are not on tender documents, it shall be deemed that no such costs exist.

It will be deemed that the cost allowed for the Preliminaries will be to provide the services,

plant and items of work specified for the full Contract period stated in these documents.

No unauthorised alteration, addition, condition or note is to be made to the text of this Specification or any documents issued by the Employer as part of the tender process. If any alteration, addition, condition or note is made, it will not be recognised and the text will be rigidly adhered to.

340 ERRORS IN THE PRICED SPECIFICATION will be dealt with generally in accordance with the

'NBS Guide to Tendering for Construction Projects’ 2011 (the word 'specification' being substituted for 'bills of quantities') and the procurement regulations of H.M. Government of Gibraltar.

350 GOVERNMENT AND LOCAL AUTHORITYS’ FEES AND CHARGES: Include for all fees,

charges, rates and taxes legally demandable, including those in connection with temporary buildings. Obtain the directions of the Contract Administrator before submitting any information on the scheme to the relevant Government Departments or Local Authorities, and also before carrying out instructions which may be given by a local authority or conforming to particular points of The Building Regulations, either of which would cause a variation from the Contract Work.

480 PROGRAMME: The Contractor's proposed programme as specified in Section A32 or a

summary thereof showing the sequence and timing of the principal parts of the Works, periods for planning and design, and itemising any work which is excluded must be submitted no later than 7 days before start on site.

500 TENDER STAGE METHOD STATEMENTS must be submitted with the tender describing how

and when the Contractor proposes and undertakes to carry out the following: - All ground works - Traffic/pedestrian management - Lifting operations - Works involving existing manholes

The Contractor may, at his discretion and at the same time, submit method statements for

other parts of the Works.

540 QUALITY CONTROL RESOURCES: A statement must be submitted with the tender

describing the organisation and resources which the Contractor proposes and undertakes to provide to control the quality of the Works, including the work of subcontractors. The statement must include the number and type of staff responsible for quality control, with details of their qualifications and duties.

551 HEALTH AND SAFETY INFORMATION: A statement must be submitted with the tender

describing the organisation and resources which the Contractor proposes and undertakes to provide to safeguard the health and safety of operatives, including those of subcontractors and of any person who may be affected by the works, including: - A copy of the Contractor’s health and safety policy document, including risk assessment

procedures. - Accident and illness records for the past five years. - Records of previous Factories Inspectorate enforcement action or where applicable to

previous enforcement action under other equivalent European, National or International bodies.

- Records of training and training policy. - The number and type of staff responsible for health and safety on this project with

details of their qualifications and duties. The Contractor must name the person responsible for compliance with Health and Safety

Regulations. The person so named must be competent, qualified and experienced in the enforcement of these regulations.

with the tender and is to include the following: - Method statements related to the construction hazards identified in the pre-tender

health and safety plan and/or statements on how the hazards will be addressed and other significant hazards identified by the Contractor.

- Details of the management structure and responsibilities. - Arrangements for issuing health and safety directions. - Procedures for informing other contractors and employees of health and safety hazards. - Selection procedures for ensuring competency of other contractors, the self-employed

and designers. - Procedures for communications between the project team, other contractors and site

operatives. - Arrangements for co-operation and co-ordination between contractors. - Procedures for carrying out risk assessment and for managing and controlling the risk. - Emergency procedures including those for fire prevention and escape. - Arrangements for ensuring that all accidents, illness and dangerous occurrences are

recorded. - Arrangements for welfare facilities. - Procedures for ensuring that all persons on site have received relevant health and safety

information and any training. - Arrangements for consulting with and taking the views of people on site. - Arrangements for preparing site rules and drawing them to the attention of those

affected and ensuring their compliance. - Monitoring procedures to ensure compliance with site rules, selection and management

procedures, health and safety standards and statutory requirements. - Review procedures to obtain feedback.

SUBLETTING/SUPPLY 633 DOMESTIC SUBCONTRACTS: The Contractor shall NOT sub-contract or sub-let any portion

of the demolition works other than for specific specialist portions of the works. In the event that the Contractor intends to utilise any such sub-contractors it shall make this known as part of the Tender submission. The Contractor is required to submit with its Tender the following information for each and every one of its sub-contractors: - Full trading name and relevant licensing information and contact details. - A copy of the sub-contractor’s health and safety policy document, including risk

assessment procedures. - Accident and illness records for the past five years. - Records of previous Health and Safety Executive enforcement action or where

applicable to previous enforcement action under other equivalent European, National or International bodies.

- Records of training and training policy. - The number and type of staff responsible for health and safety on this project with

details of their qualifications and duties.

Sub-contractors so engaged shall not be permitted to sub-contract any portion of their works. The Employer reserves the right to refuse the Contractor the use of any or all proposed sub-contractors and the Employer shall not be held liable for any costs associated with this refusal.

preliminaries/general conditions and specification is as defined below or in the appropriate EN British Standard or British Standard glossary.

120 CA means the person nominated in the Contract as Architect, Engineer or Contract

Administrator or his authorised representative. 130 IN WRITING: When required to advise, notify, inform, instruct, agree, confirm, obtain

information, obtain approval or obtain instructions do so in writing. 140 APPROVAL (and words derived therefrom) means the approval in writing of the CA unless

specified otherwise. 150 PRODUCTS means materials (including naturally occurring materials) and goods (including

components, equipment and accessories) intended for permanent incorporation in the Works.

180 CROSS-REFERENCES TO THE SPECIFICATION:

- Where a numerical cross-reference to a specification section or clause is given on drawings or in any other document the Contractor must verify its accuracy by checking the remainder of the annotation or item description against the terminology used in the referred to section or clause.

- Where a numerical cross-reference is not given the relevant section(s) and clause(s) of the specification will apply, cross-reference thereto being by means of related terminology.

- Where a cross-reference for a particular type of work, feature, material or product is given, relevant clause(s) elsewhere in the referred to specification section dealing with general matters, ancillary products and workmanship also apply.

- The Contractor must, before proceeding, obtain clarification or instructions in relation to any discrepancy or ambiguity which he may discover.

200 EQUIVALENT PRODUCTS:

- Where the specification permits substitution of a product of different manufacture to that specified and such substitution is desired, before ordering the product notify the CA and, when requested, submit for verification documentary evidence that the alternative product is equivalent in respect of material, safety, reliability, function, compatibility with adjacent construction, availability of compatible accessories and, where relevant, appearance. Submit certified English translations of any foreign-language documents.

- Any proposal for use of an alternative product must also include proposals for substitution of compatible accessory products and variation of details as necessary, with evidence of equivalent durability, function and appearance of the construction as a whole. If such substitution is sanctioned, and before ordering products, provide revised drawings, specification and manufacturer's guarantees as required by CA.

- Any proposal for use of an alternative product must be accompanied by details of the environmental specifications.

Standard for which there is no equivalent European Standard it may be substituted by a product complying with a grade or category within a national standard of another Member State of the European Union or an international standard recognised in the UK specifying equivalent requirements and assurances in respect of material, safety, reliability, function, compatibility with adjacent construction, availability of compatible accessories and, where relevant, appearance. 220 REFERENCES TO BSI DOCUMENTS are to the versions and amendments listed in the BSI

Standards Catalogue current at the date of tender. 230 MANUFACTURER AND REFERENCE: Where used in this combination:

- 'Manufacturer' means the firm under whose name the particular product is marketed. - 'Reference' means the proprietary brand name and/or reference by which the particular

product is identified. TERMS USED IN REFURBISHMENT/ALTERATION 311 REMOVE means disconnect, dismantle as necessary and remove the stated element, work or

component and all associated accessories, fastenings, supports, linings and bedding materials, and dispose of unwanted materials. It does not include removing associated pipework, wiring, ductwork or other services.

321 KEEP FOR REUSE means:

- During removal prevent damage to the stated components or materials, and clean off bedding and jointing materials.

- Stack neatly, adequately protect and store until required by the Employer or for use in the Works as instructed.

331 REPLACE means:

- Remove the stated existing components, features and finishes. - Provide and fit in lieu new components, features or finishes which, unless specified

otherwise, must match those which have been removed. - Make good as necessary.

341 REPAIR means carry out local remedial work to components, features and finishes as found in

361 EASE means make minor adjustments to moving parts of the stated component to achieve

good fit in both open and closed positions and ensure free movement in relation to fixed surrounds. Make good as necessary.

371 TO MATCH EXISTING means use products, materials and methods to match closely all visual

characteristics and features of the existing work, with joints between existing and new work as inconspicuous as possible, all to approval of appearance.

DOCUMENTS PROVIDED ON BEHALF OF EMPLOYER 440 DIMENSIONS: The accuracy of dimensions scaled from the drawings is not guaranteed.

445 DRAWINGS AND DIMENSIONS: Do not obtain dimensions by scaling from drawings. All dimensions are to be checked on site. Detail and large-scale drawings take precedence over small-scale drawings. Figured dimensions are to be followed in preference to the scale of the drawings and where

possible dimensions are to be taken from the building. Report the discovery of any discrepancies in figured dimensions and other information

together with divergences between documentation to the CA as soon as they are discovered for his instruction.

450 THE MEASURED QUANTITIES: For purposes of ordering products and constructing the

Works: - The accuracy and sufficiency of the measured quantities is not guaranteed. - The specification and drawings shall take precedence over the measured quantities.

A32 MANAGEMENT OF THE WORKS GENERALLY 110 SUPERVISION: Accept responsibility for co-ordination, supervision and administration of the

Works, including all subcontracts and other outside agencies/statutory undertakers. Arrange and monitor a programme with each subcontractor, supplier, local authority and statutory undertaker, and obtain and supply information as necessary for co-ordination of the work.

120 INSURANCE: Before starting work on site submit documentary evidence and/or policies and

receipts for the insurance required by the Conditions of Contract. 130 INSURANCE CLAIMS: If any event occurs which may give rise to any claim or proceeding in

respect of loss or damage to the Works or injury or damage to persons or property arising out of the Works, forthwith give notice in writing to the Employer, the CA and the Insurers. Indemnify the Employer against any loss which may be caused by failure to give such notice.

140 CLIMATIC CONDITIONS: Keep an accurate record of:

- Daily maximum and minimum air temperatures (including overnight). - Delays due to adverse weather, including description of the weather, type(s) of work

affected and number of hours lost. 150 OWNERSHIP: Materials arising from the works are to become the property of the Contractor

except where otherwise stated. Remove from site as work proceeds. 170 SOIL AND EXCAVATED MATERIAL: Selected excavated material arising from the works is to

be reused as necessary, subject to compliance with specification. PROGRAMME/PROGRESS 210 PROGRAMME: The master programme for the Works must make allowance for:

- Traffic Management. - Specific sequencing of the various sections of the works based on the Employer’s

requirements as identified on award of Contract. - Design, production information and proposals provided by the

Contractor/Subcontractors/Suppliers, including inspection and checking (see section A31).

- Planning and mobilisation by the Contractor. - Running in, adjustment, commissioning and testing of all services and installations. - Work resulting from instructions issued in regard to the expenditure of provisional sums. - Work by or on behalf of the Employer and concurrent with the Contract the nature and

scope of which, the relationship with preceding and following work and any relevant limitations are suitably defined in the Contract Documents.

- Where and to the extent that the programme implications for work which is not so defined are impossible to assess the Contractor should exclude it from his programme and confirm this when submitting the programme.

220 THE PROGRAMME must show earliest and latest start and finish dates for each activity, and

identify all critical activities. It must be of the bar chart type, unless agreed otherwise and must be for the full Contract period as stated in section A20. Submission of the programme is to be as A30.480.

apply in writing for drawings, details or instructions in accordance with the Conditions of Contract.

240 COMMENCEMENT OF WORK: Inform the CA at least 7 working days before the proposed

date for commencement of work on site. 250 MONITORING: Record progress on a copy of the programme kept on site. If any

circumstances arise which may affect the progress of the Works put forward proposals or take other action as appropriate to minimise any delay and to recover any lost time.

260 CA'S SITE MEETINGS:

- The CA will hold regular site meetings to review progress and other matters arising from the administration of the Contract.

- Ensure the availability of accommodation at the time of such meetings (A36/210). - Attend all meetings and inform subcontractors and suppliers when their presence is

required. - The CA will chair the meetings and take and distribute minutes.

264 CONTRACTOR'S PROGRESS REPORT: Submit a progress report to the CA 2 days prior to

each CA's site meeting. Notwithstanding the Contractor's obligations under the Contract the report must include: - A progress statement by reference to the master programme for the Works. - Details of any matters materially affecting the regular progress of the Works. - Any requirements for further drawings or details or instructions to enable the CA to

fulfill his obligations under the Conditions of Contract. 270 CONTRACTOR'S SITE MEETINGS: Hold meetings with appropriate subcontractors and

suppliers shortly before main site meetings to facilitate accurate reporting of progress. 280 PHOTOGRAPHS: Provide record photographs of existing structures not having any work

carried out upon them prior to commencement of works, hand to CA. Provide progress photographs from agreed points at monthly intervals and submit, in electronic format, as soon as possible to the CA.

290 NOTICE OF COMPLETION: Give CA at least 2 weeks notice of the anticipated dates of

Practical Completion of the whole or parts of the Works. 300 ADVERSE WEATHER: Use all reasonable and suitable building aids and methods to prevent

or minimise delays during adverse weather conditions. CONTROL OF COST 420 EXISTING WORK: The extent and location of renewal of existing work must be agreed, at

least on a provisional basis, with the CA before the work is started. Remove existing work in ways which will reasonably minimise the amount of removal and renewal.

440 MEASUREMENTS: Give reasonable notice to the Quantity Surveyor before covering up work

which the Quantity Surveyor requires to be measured.

commencement of any work for which daywork vouchers are to be submitted. Before being delivered, each voucher must be: - Referenced to the instruction under which the work is authorised, and - Signed by the person in charge as evidence that the workmen's names, the time spent by

each, the plant and materials shown are correct. 455 DAYWORK VOUCHERS: Originals of the daywork vouchers, signed by the person in charge

and countersigned (for record purposes only) by the Clerk of Works, are to be submitted with the Interim Valuation covering the period in which the daywork was undertaken.

460 INTERIM VALUATIONS: At least 7 days before the end of each established period for interim

valuations submit to the Quantity Surveyor details of amounts due under the Contract together with all necessary supporting information.

470 UNFIXED MATERIALS: At the time of each valuation disclose to the Quantity Surveyor which

of the unfixed materials and goods on site are free from, and which are subject to, any reservation of title inconsistent with passing of property as required by the Conditions of Contract, together with their respective values. When requested provide evidence of freedom from reservation of title.

480 LABOUR AND PLANT RETURNS: At the beginning of each week provide for verification by

the Clerk of Works records showing, for each day of the previous week: - The number and description of craftsmen, labourers and other persons employed on or

in connection with the Works, including those employed by subcontractors. - The number, type and capacity of all mechanical and power-operated plant employed on

the Works. - A copy of the verified record is to be given to the Quantity Surveyor on a weekly basis.

not fully detailed or specified they are to be: - Of a standard appropriate to the Works and suitable for the functions stated in or

reasonably to be inferred from the project documents, and, - In accordance with relevant good building practice.

120 GENERAL QUALITY OF PRODUCTS:

- Products to be new unless otherwise specified. - For products specified to a British or European Standard obtain certificates of

compliance from manufacturers when requested by CA. - Where a choice of manufacturer or source of supply is allowed for any particular

product, the whole quantity required to complete the work must be of the same type, manufacture and/or source unless otherwise approved. Produce written evidence of sources of supply when requested by CA.

- Ensure that the whole quantity of each product required to complete the work is of consistent kind, size, quality and overall appearance.

- Where consistency of appearance is desirable ensure consistency of supply from the same source. Unless otherwise approved do not use different colour batches where they can be seen together.

- If products are prone to deterioration or have a limited shelf life, order in suitable quantities to a programme and use in appropriate sequence. Do not use if there are any signs of deterioration, setting or other unsatisfactory condition.

130 PROPRIETARY PRODUCTS:

- Handle, store, prepare and use or fix each product in accordance with its manufacturer's current printed or written recommendations/instructions. Inform CA if these conflict with any other specified requirement. Submit copies to CA when requested.

- The tender will be deemed to be based on the products specified and recommendations on their use as described in the manufacturer's literature current at the date of tender

- Obtain confirmation from manufacturers that the products specified and recommendations on their use have not been changed since that time. Where such change has occurred, inform CA and do not place orders for or use the affected products without further instructions.

- Where British Board of Agrement certified products are used, comply with the limitations, recommendations and requirements of the relevant valid certificates.

marks and, where appropriate, the products themselves to ensure that all products comply with the project documents. Where different types of any product are specified, check to ensure that the correct type is being used in each location. In particular, check that: - The sources, types, qualities, finishes and colours are correct, and match any approved

samples. - All accessories and fixings, which should be supplied with the goods, have been supplied. - Sizes and dimensions are correct. Where tolerances of components are critical, measure

a sufficient quantity to ensure compliance. - The delivered quantities are correct, to ensure that shortages do not cause delays in the

work. - The products are clean, undamaged and otherwise in good condition. - Products, which have a limited shelf life, are not out of date.

150 PROTECTION OF PRODUCTS:

- Prevent over-stressing, distortion and any other type of physical damage. - Keep clean and free from contamination. Prevent staining, chipping, scratching or other

disfigurement, particularly of products exposed to view in the finished work. - Keep dry and in a suitably low humidity atmosphere to prevent premature setting,

moisture movement and similar defects. Where appropriate store off the ground and allow free air movement around and between stored products.

- Prevent excessively high or low temperatures and rapid changes of temperature in the products.

- Protect adequately from rain, damp, frost, sun and other elements as appropriate. Ensure that products are at a suitable temperature and moisture content at time of use.

- Ensure that sheds and covers are of ample size, in good weatherproof condition and well secured.

- Keep different types and grades of products separately and adequately identified. - So far as possible keep products in their original wrappings, packings or containers, until

immediately before they are used. - Wherever possible retain protective wrappings after fixing and until shortly before

Practical Completion. - Ensure that protective measures are fully compatible with and not prejudicial to the

products/materials. - On completion of the works, disinfect and reinstate the grounds occupied by temporary

buildings. 160 SUITABILITY OF RELATED WORK AND CONDITIONS: Ensure that all trades are provided

with necessary details of related types of work. Before starting each new type or section of work, ensure that: - Previous, related work is appropriately complete, in accordance with the project

documents, to a suitable standard and in a suitable condition to receive the new work. - All necessary preparatory work has been carried out, including provision for services,

openings, supports, fixings, damp proofing, priming and sealing. - The environmental conditions are suitable, particularly that the building is suitably

weathertight when internal components, services and finishes are installed.

- Operatives must be appropriately skilled and experienced for the type and quality of work.

- Take all necessary precautions to prevent damage to the work from frost, rain and other hazards.

- Inspect components and products carefully before fixing or using and reject any which are defective.

- Fix or lay securely, accurately and in alignment. - Where not specified otherwise, select fixing and jointing methods and types, sizes and

spacings of fastenings in compliance with relevant British Standards. - Provide suitable, tight packings at screwed and bolted fixing points to take up tolerances

and prevent distortion. Do not overtighten fixings. - Adjust location and fixing of components and products so that joints, which are to be

finished with mortar or sealant or otherwise left open to view, are even and regular. - Ensure that all moving parts operate properly and freely. Do not cut, grind or plane pre-

finished components and products to remedy binding or poor fit without approval. 180 BS 8000: BASIC WORKMANSHIP:

- Where compliance with BS 8000 is specified, this is only to the extent that the recommendations therein define the quality of the finished work.

- Where BS 8000 gives recommendations on particular working methods or other matters which are properly within the province and responsibility of the Contractor, compliance therewith will be deemed to be a matter of general industry good practice and not a specific requirement of the CA under the Contract.

- If there is any conflict or discrepancy between the recommendations of BS 8000 on the one hand and the project documents on the other, the latter will prevail.

190 WATER FOR THE WORKS: Clean and uncontaminated. If other than mains supply is

proposed provide evidence of suitability. Test to BS 3148 if instructed. SAMPLES/APPROVALS 210 APPROVAL OF PRODUCTS: Where approval of a product is specified the requirement for

approval relates to a sample of the product and not to the product as used in the Works. Submit a sample or other evidence of suitability. Do not confirm orders or use the product until approval of the sample has been obtained. Retain approved sample in good, clean condition on site. Ensure that the product used in the Works matches the approved sample.

220 SAMPLES OF FINISHED WORK: Where a sample of finished work is specified for approval,

the requirement for approval relates to the sample itself (if approval of the finished work as a whole is required this is specified separately). Obtain approval of the stated characteristic(s) of the sample before proceeding with the Works. Retain approved sample in good, clean condition on site. Ensure that the relevant characteristic(s) of the Works match the approved characteristic(s) of the sample. Remove samples which are not part of the finished Works when no longer required.

240 APPROVALS: Inspection or any other action by the CA must not be taken as approval of

products or work unless the CA so confirms in writing in express terms referring to: - Date of inspection - Part of the work inspected - Respects or characteristics which are approved - Extent and purpose of the approval - Any associated conditions.

ACCURACY/SETTING OUT GENERALLY 321 SETTING OUT: Check the levels and dimensions of the site against those shown on the

drawings, and record the results on a copy of the drawings. Notify CA in writing of any discrepancies and obtain instructions before proceeding.

340 APPEARANCE AND FIT:

- Arrange the setting out, erection, juxtaposition of components and application of finishes (working within the practical limits of the design and the specification) to ensure that there is satisfactory fit at junctions, that there are no practically or visually unacceptable changes in plane, line or level and that the finished work has a true and regular appearance.

- Wherever satisfactory accuracy, fit and/or appearance of the work are likely to be critical or difficult to achieve, obtain approval of proposals or of the appearance of the relevant aspects of the partially finished work as early as possible.

- Without prejudice to the above and unless specified otherwise, tolerances will (where applicable) be not greater than those given in BS 5606, Tables 1 and 2.

380 RECORD DRAWINGS: Record details of all grid lines, setting-out stations, bench marks and

profiles on the site setting-out drawing. Retain on site throughout the Contract and hand to CA on Completion.

SERVICES GENERALLY 410 SERVICES REGULATIONS: Any work carried out to or which affects new or existing services

must be in accordance with the Bye Laws or Regulations of the relevant Statutory Authority or Government Department.

SUPERVISION/INSPECTION/DEFECTIVE WORK 510 SUPERVISION: In addition to the constant management and supervision of the works

provided by the Contractor's person in charge, all significant types of work must be under the close control of competent trade supervisors to ensure maintenance of satisfactory quality and progress.

520 PERSON-IN-CHARGE: Give maximum possible notice to CA before changing the person-in-

charge. 540 OVERTIME WORKING: Whenever overtime is to be worked, give CA not less than 3 working

days notice, specifying times, types and locations of work to be done. Concealed work executed during overtime for which notice has not been given may be required to be opened up for inspection and reinstated at the Contractor's expense. Claims for payment of non-productive time in connection with overtime will not be allowed except when the CA has specifically requested and/or authorised overtime.

550 DEFECTS IN EXISTING CONSTRUCTION to be reported to CA without delay. Obtain

instructions before proceeding with work which may: - Cover up or otherwise hinder access to the defective construction, or - Be rendered abortive by the carrying out of remedial work.

555 ACCESS FOR INSPECTION: Give CA not less than 3 working days notice before removing

scaffolding or other facilities for access. 560 TIMING OF TESTS AND INSPECTIONS: Agree dates and times of tests ad inspections with

CA several days in advance, to enable the CA and other affected parties to be present. On the previous working day to each such test or inspection confirm that the work or sample in question will be ready or, if not ready, agree a new date and time.

565 TEST CERTIFICATES: Submit a copy of each certificate to CA as soon as practicable and keep

copies of all certificates on site. 570 PROPOSALS FOR RECTIFICATION OF DEFECTIVE WORK/PRODUCTS:

- As soon as possible after any part(s) of the work or any products are known to be not in accordance with the Contract or appear that they may not be in accordance submit proposals to CA for opening up, inspection, testing, making good, adjustment of the Contract Sum, or removal and re-execution.

- Such proposals may be unacceptable to the CA and he may issue contrary instructions. 580 MEASURES TO ESTABLISH ACCEPTABILITY: Wherever inspection or testing shows that the

work, materials or goods are not in accordance with the Contract and measures (e.g. testing, opening up, experimental making good) are taken to help in establishing whether or not the work is acceptable, such measures: - will be at the expense of the Contractor, and - will not be considered as grounds for extension of time.

590 QUALITY CONTROL: Establish and maintain procedures to ensure that the Works, including

the work of all subcontractors, comply with specified requirements. Maintain full records, keep copies on site for inspection by the CA, and submit copies of particular parts of the records on request. The records must include: - Identification of the element, item, batch or lot including location in the Works. - The nature and dates of inspections by the Contractor or CA, tests and approvals. - The nature and extent of any nonconforming work found. - Details of any corrective action.

- Make good all damage consequent upon the work. - Remove all temporary markings, coverings and protective wrappings unless otherwise

instructed. - Clean the works thoroughly inside and out including all accessible ducts and voids,

remove all splashes, deposits, efflorescence, rubbish and surplus materials consequent upon the execution of the work.

- Cleaning materials and methods to be as recommended by manufacturers of products being cleaned, and to be such that there is no damage or disfigurement to other materials or construction.

- Obtain COSHH dated data sheets for all materials used for cleaning and ensure they are used only as recommended by their manufacturers.

- Touch up minor faults in newly painted/repainted work, carefully matching colour, and brushing out edges. Repaint badly marked areas back to suitable breaks or junctions.

- Adjust, ease and lubricate moving parts of new work as necessary to ensure easy and efficient operation, including doors, windows, drawers, ironmongery, appliances, valves and controls.

650 MAKING GOOD DEFECTS: Make arrangements with the CA and give reasonable notice of

the precise dates for access to the various parts of the Works for purposes of making good defects. Inform CA when remedial works to the various parts of the Works are completed.

660 HIGHWAY/SEWER ADOPTION: The following are to be adopted by the Highway Authorities:

The whole of the asphalting and related works. The above work must therefore be:

- Completed by the Contractor to the satisfaction of the Highway Authorities, acting through the CA, before the certificate of Practical Completion is issued.

- Maintained by the Contractor during the Defects Liability Period including making good of damage due to reasonable wear and tear occurring during the Period and cleaning at the end of the Period, all to the satisfaction of the Highway Authorities, acting through the CA.

Do not start construction work until the Employer has confirmed in writing that in his view the Construction Phase Health and Safety Plan includes the procedures and arrangements required by CDM Regulation 15(4) and all other Acts and regulations listed in these documents.

125 HSE APPROVED CODES OF PRACTICE: Comply with the following:

- Management of health and safety at work. - Managing construction for health and safety. - Health and Safety in Construction. - And any other relevant regulation or byelaw during the execution of the Contract. - The Contractor shall ensure that all relevant certificates are available for inspection as

per Factories Act and all other relevant regulations which apply. - Dust – Best Practice Guide, HM Government of Gibraltar

128 SAFETY, HEALTH AND WELFARE: Comply in all respects with the requirements of all

current safety, health and welfare regulations relating to the construction industry. 130 SECURITY: Adequately safeguard the site, the Works, products, materials, plant, and any

existing buildings affected by the Works from damage and theft. Take all reasonable precautions to prevent unauthorised access to the site, the Works and adjoining property.

140 STABILITY: Accept responsibility for the stability and structural integrity of the Works during

the Contract, and support as necessary.

as follows: - Residential and business properties situated in, and adjacent to, the areas of the works. Carry out the Works without undue inconvenience and nuisance and without danger to occupants and users. If it transpires that compliance with this clause requires certain operations to be carried out during overtime, and such overtime is not required for any other reason, the extra cost will be paid to the Contractor, provided that such overtime is authorised by the CA in advance.

170 EMPLOYER’S REPRESENTATIVES SITE VISITS: Inform the CA in advance of all safety provisions and procedures (including those relating to

materials which may be deleterious) which will require the compliance of the Employer or his representatives when visiting the site. Provide protective clothing and/or equipment for the Employer and his representatives as appropriate.

185 LICENCES AND PERMIT to work procedures will operate for all work carried out in the

following area(s): - Closure of Public Highway. - Changes to traffic flows on Public Highway. - Waste disposal.

The Contractor shall be responsible for applying for all such permits as and when necessary all in conjunction with its programme.

PROTECT AGAINST THE FOLLOWING: 221 NOISE:

- Comply generally with the recommendations of BS 5228 and all statutory obligations. - Noise levels from the works are to be kept to a minimum. - Fit all compressors, percussion tools and vehicles with effective silencers of a type

recommended by manufacturers of the compressors, tools or vehicles. - Do not use pneumatic drills and other noisy appliances without consent of the CA. - Do not use or permit employees to use radios or other audio equipment in ways or at

times which may cause nuisance. 230 POLLUTION: Take all reasonable precautions to prevent pollution of the site, the Works and

the general environment including flora, fauna, the air and aquatic environment. If pollution occurs, inform the appropriate Authorities and the CA without delay and provide them with all relevant information.

239 ENVIRONMENT (CONTROL OF DUST) REGULATIONS 2010: The Contractor shall comply

with the Regulations. 240 NUISANCE: Take all necessary precautions to prevent nuisance from smoke, dust, rubbish,

vermin and other causes.

damage to the Works or other property from fire. Comply with Joint Code of Practice ‘Fire Prevention on Construction Sites’ published by the Building Employers Confederation and the Loss Prevention Council.

265 BURNING ON SITE of materials arising from the work will not be permitted. 270 WATER: Prevent damage from storm and surface water. (Items for keeping the site and

excavations free of water are given elsewhere). Actions must comply with the requirements of: - Public Health (Pollution to the Aquatic Environment) Rules, 1994. - Environment Act 2007, Environment (Abstraction of Groundwater) Regulations 2007.

290 WASTE:

- Remove rubbish, debris, surplus material and spoil regularly and keep the site and Works clean and tidy.

- Remove all rubbish, dirt and residues from voids and cavities in the construction before closing in.

- Ensure that non-hazardous material is disposed of at a tip approved by a Waste Regulation Authority.

- Remove all surplus hazardous materials and their containers regularly for disposal off site in a safe and competent manner as approved by the appropriate authority and in accordance with relevant regulations.

- Retain waste transfer documentation on site. - Comply with all relevant legislation (it is an offence to give waste to a non-authorised

waste handler). PROTECT THE FOLLOWING: 410 WORK IN ALL SECTIONS: Adequately protect all types of work and all parts of the Works,

including work carried out by others, throughout the Contract. Wherever work is of an especially vulnerable nature or is exposed to abnormal risks provide special protection to ensure that damage does not occur.

415 ESPECIALLY VULNERABLE WORK: Submit a method statement prior to commencing works

describing the special protection to be provided to ensure that damage does not occur to any heritage structures in the area

420 EXISTING SERVICES:

- Notify all service authorities and/or adjacent owners of the proposed works not less than one week before commencing site operations.

- Before starting work check positions of existing mains/services, including using CAT scanning devices. Where positions are not shown on drawings obtain relevant details from service authorities or other owners.

- The Contractor is to make its own investigations, including contacting service authorities and/or adjacent owners, to ensure that any information on existing services, which has been made available by the Employer, is accurate and up to date.

- Observe service authority’s recommendations for work adjacent to existing services. - Adequately protect, and prevent damage to all services. Do not interfere with their

operation without consent of the service authorities or other owners.

appropriate service authority without delay. Make arrangements for the work to be made good without delay to the satisfaction of the service authority or other owner as appropriate. Any measures taken by the CA to deal with an emergency will not affect the extent of the Contractor’s liability.

- Replace any marker tapes or protective covers disturbed during site operations to the service authority’s recommendations.

- No mechanical excavation is to be carried out within 1 metre of existing services. 430 ROADS AND FOOTPATHS: Adequately maintain roads and footpaths within and adjacent to

the site and keep clear of mud and debris. Any damage to roads and footpaths caused by site traffic or otherwise consequent upon the Works must be made good to the satisfaction of the Local Authority or other owner. Bear any costs arising.

440 RETAINED TREES/HEDGES/SHRUBS/GRASSED AREAS:

- Adequately protect and preserve, except those, which are to be removed. - The removal of any trees, shrubs or planted areas must be authorised by the Department

of the Environment. - Replace to approval or treat as instructed any species or areas damaged or removed

without approval. - Mature trees and shrubs which, due to the Contractor’s negligence, are uprooted,

destroyed, or in the opinion of the CA, damaged beyond reasonable chance of survival in their original shape, must be replaced with those of a similar type and age at the Contractor’s expense.

445 TREES TO BE RETAINED: Unless agreed otherwise by the CA, do not:

- Dump spoil or rubbish, excavate or disturb topsoil, park vehicles or plant, store materials or place temporary accommodation within the branch spread.

- Sever roots exceeding 25 mm in diameter. - Change level of ground within area 3 m beyond the branch spread.

450 EXISTING FEATURES: Prevent damage to existing buildings, fences, gates, walls, roads,

paved areas and other site features which are to remain in position during the execution of the Works.

480 ADJOINING PROPERTY: Access to/use of adjoining property has been agreed with adjacent

owners as follows: - GENERALLY CONTINUED AND UNIMPEDED PEDESTRIAN AND VEHICULAR

ACCESS TO ALL RESIDENTIAL, RETAIL AND OTHER PROPERTIES IN THE AREA WITH THE EXCEPTION OF THOSE CATERED FOR IN ACCORDANCE WITH THE PROVISIONS OF THE TRAFFIC MANAGEMENT PLANS.

481 ADJOINING PROPERTY: Prevent trespass of workpeople. Take all reasonable precautions to

A35 SPECIFIC LIMITATIONS ON METHOD/SEQUENCE/TIMING 110 SCOPE: The limitations described in this section are supplementary to limitations described

or implicit in information given in other sections or on the drawings. 130 METHOD/SEQUENCE OF WORK: Generally as agreed Main Contractor’s master programme however, the Contractor is to take

note that pedestrian and vehicular access is to be maintained through the area of the works for the duration of the Contract as identified in the Traffic Management requirements of the Contract. The Contractor is to allow in his programming and rates for such access to be maintained.

In respect of this, the Contractor is to submit with the Tender details and breakdowns of labour and gang sizes to be used on the various portions of the Works. Failure to submit this information shall result in the Tender not being considered. The Contractor is also to refer to specific clauses in relation to the PRODUCTION and

delivery of asphalt occurring outside the time range weekdays 08:00 to 18:00 contained in Volume B, Bills of Quantities Preambles and Class R.

advertisements will not be permitted. SERVICES AND FACILITIES 420 LIGHTING AND POWER: The temporary supply of electric to the site must be all in

accordance with the “Conditions for the temporary supply of electricity“ (revised to take into account the requirements of the latest edition of the current I.E.E Regulations).

It is emphasised that under no circumstances will a temporary site supply be afforded unless

these conditions are observed. Provided all artificial lighting and power for use on the Works, pay and bear all charges in

connection therewith, provide all temporary connections, leads, fittings, etc., and clear away and make good on completion.

In the event of the Contractor taking a supply of electricity from the Employer’s mains, he is

to arrange with the Employer for permission to use this supply and for it to be separately metered. Pay and bear all charges.

The Employer will not be held responsible for the effects of any failure or restriction in

supply. 430 WATER: Provide, clean, fresh metered water supply for use on the works, pay and bear all

charges in connection therewith, provide all temporary storage, plumbing services, connections etc., and clear away and make good on completion.

441 TELEPHONES: The Contractor’s Person in Charge and the Contractor’s on-site foreman (if

different to the Person in Charge) shall each be in possession of mobile telephones and shall ensure that they can be contacted at all times (A40/120).

section A36. 105 TEMPORARY WORKS IN GENERAL: All temporary works road, huts etc, are to be placed on

site in positions to be agreed by the CA. Allowance shall be made to alter, and shift same as necessary from time to time.

110 TEMPORARY ROADS: Provide any temporary sleeper or other temporary roads, and

crossovers from the existing roads or adjoining properties and obtain any wayleaves that may be required including those in connection with cranes where jibs enter the air space over adjoining property, and reinstate surfaces to that original state on completion of the Works.

150 HOARDINGS, FANS, FENCING, ETC: Provide all necessary fans, hoardings, tarpaulins, flying

scaffolds or other protection that may be required for the protection of adjoining property, the public, tenants, staff and persons employed on the works, also for protection of low level roofs or skylights during the execution of the works.

160 HARDSTANDING: Provide all necessary hardstanding for the proper execution of the Works 170 TRAFFIC REGULATIONS: Ascertain and comply with the Royal Gibraltar Police and other

Government Departments’ and/or Agencies’ regulations including those having regard to access to and egress from the site and to any works that may be executed in public thoroughfares adjacent to the site. If necessary, temporary traffic signs, lighting and road markings to existing highways shall be provided, erected, maintained, repositioned and finally removed as progress of the works dictate. Access to and egress from the site and surrounding properties roads must be maintained at all times.

S1 PREAMBLE 1. The Contractor shall make reference to the following documents:

1.1. Infrastructure Conditions of Contact (ICC) Minor Works version, August 2011

incorporating the amendments as included in Volume A of the Contract. 1.2. Manual of contract documents for highway works: Vol. 1 Specification for highway

works (as published by The Stationery Office, United Kingdom).

2. Any references to the “Specification” referred to in the Contract and associated documents shall be the “Manual of contract documents for highway works: Vol. 1 Specification for highway works” including any amendments all as published by The Stationery Office as modified and extended by the Numbered Appendices contained in this Outline Specification.

3. Any references to the “Outline Specification” shall be the “Road Resurfacing – Contract NR 04/17-S23-6: Vol. C – Specification”.

4. When carrying out any works as part of the Contract, the Contractor shall have regard to the requirements of the document at clause 2 above and any additional requirements as identified by the Contract Administrator and/or contained in this Outline Specification.

5. Insofar as any of the Numbered Appendices may conflict or be inconsistent with any provision of the Specification for Highway Works the Numbered Appendices shall always prevail.

APPENDIX 2 – FULL AND PARTIAL RECONSTRUCTION 1. As part of the works there may be a need to undertake full or partial re-construction of the

base layers. The need for this shall be determined by the Contract Administrator once existing surfaces have been planned. Should there be a need for full or partial reconstruction then the following specification shall be implemented:

APPENDIX 3 – MANHOLES, VALVE PITS AND SURFACE WATER GULLIES 1. As part of the works there may be a requirement to adjust levels and falls of various

components so as to follow the level and falls of the final wearing surface. These components include: 1.1. Manhole covers and frames.

1.2. Valve pit covers and frames.

1.3. Surface water gully grates and frames.

2. The Contractor shall allow for lifting all existing components in such a manner as to avoid

causing any damage and shall subsequently re-set the components to revised level and falls as indicated on site by the nature of the surfacing.

3. Components so treated shall be set so as to be flush with surrounding wearing course surfaces.

4. If considered necessary by the Employer some of the components listed at ‘1’ above might be replaced with new. When such is instructed then the Employer shall, at no expense to the Contractor, deliver the said components to the site and shall also arrange for disposal of the existing components once lifted by the Contractor. Therefore, the Contractor’s rates for the adjusting of levels and falls shall be deemed to include for doing so with the existing or new components.

APPENDIX 4 – KERBS AND CHANNELS 1. As part of the works there is a need to replace and/or repair some existing kerbs and/or

channel blocks. The extent of the replacement or repair shall be determined by the Contract Administrator once the Contract is underway.

Replacement

2. The Contractor shall allow for breaking out the kerbs and/or channels, so identified, including

removing any associated bedding, bases, haunching or other associated materials; all without damaging other areas and components which are to remain in place.

3. Subsequently the components so removed shall be replaced, with new components and associated bedding, bases, haunching and the like, all to suit road and footpath line and levels.

4. New precast concrete kerbs and channels to be to BS EN1340:2003, Marshalls or equal and approved. Kerbs and channels to be laid on a C20 concrete bed, including any haunching and the like.

Repair

5. Localised repairs to in-situ concrete channels. For these repairs the Contractor shall allow

for; 5.1. Cutting out defective sections of concrete to a depth of 200 mm; including straight

edge cutting against any adjacent channel sections, kerb face and asphalt surfacing.

5.2. Reinstatement shall be with in-situ concrete CP20 compacted, level and to falls and, finished to match existing (typically steel float finish).

5.3. Works to include disposal of all materials arising and all plant and equipment provisions to undertake the works.

6. Localised repairs to existing kerbs. For these repairs the Contractor shall allow for;

6.1. Clean surface of damaged area by removing any loose material such as dirt, oil, or

grease and unsound or flaking concrete. Unsound or flaking concrete can be removed by using a hammer and chisel or with a masonry grinding disk and or portable drill.

6.2. Scrub and clean the surface of the repair area with a stiff bristle brush.

6.3. Thoroughly rinse the repair area after cleaning.

6.4. Use an epoxy rapid hardening cement repair product ”Sika” or equal and approved material, mixed and applied in accordance with the manufacturer’s instructions.

6.5. Finish off repair to match adjacent kerb surfaces.

6.6. Provide surface protection to repaired surfaces until repair material has achieved full strength.

1.4 Principal Contractor

The Main Contractor will be expected as part of his duties for this project to take on the role as the PC with regards to The Factory Act – Construction (Design, Management Health and Safety and Welfare) Regulations 1998.

These duties are detailed in Appendix B.

1.5 Location of Work

The works will take place along the Gibraltar Public Highway at the following location: - (i) Rosia Road - from the junction with Scud Hill to Cumberland Road (ii) St Bernard’s Road - from junction Engineer’s Road to area adjacent Mount Alvernia. (iii) Europa Road - from the new Dementia Day Care Centre to south of the junction with the Europa Pass.

1.6 Scope of the Works

The works will entail the resurfacing of the public highways and any other areas designated by CA and are fully detailed within the Tender Documents – Volumes A, B & C.

1.7 Time scale

The total duration of the works is 9 weeks. 1.8 Associated Documentation

The Pre-Tender Health and Safety plan has been produced in accordance with: 1. Tender Documents

2.0 The Site 2.1 Location

The works will take place along Public Highway at the location listed in 1.5 above. The contractor will be required to manage both pedestrian and vehicular traffic in accordance to the Traffic Manual Chapter 8 and Guidance provided by the Safety at Street Works and Road Works (A Code of Practice). For all work activities, specific Method Statements, Risk Assessments, Traffic Management Plans as well as a Programme of the Works for the specific work location shall be submitted to the Contract Administrator and Planning Supervisor (PS) for approval.

2.2 Existing Services

PC is to ensure that for every location in which excavation is involved he is aware of existing services, which could affect the works prior to carrying out associated works. Hence he shall request service clearance drawings from all the utilities and establish an active liaison with utilities in order to prevent accidents as result of interference with services. Likewise he shall make use of electronic service detection equipment and site evidence (exiting manhole, lighting columns, feeder pillars etc.) Any exposing of services or excavation in the suspected proximity of services (within 1 metre) shall be carried out by hand. Where contractor requires adjusting in level and/or replacing manhole covers pertaining to the pubic main sewer culvert flowing along works areas identified for these works, they shall contact Technical Services Department Infrastructure Section prior to these works and obtain the required site specific permit to work. All other utilities will need to be contacted as required where alteration to their manhole covers or infrastructure is required.

2.3 Site Welfare Facilities

The PC is to submit proposals to the CA for approval with regard to welfare facilities to be provided for the workforce during the works.

2.4 Weather Conditions

During adverse weather conditions the PC is to take adequate precautions with regards to general conditions of work areas to ensure these are kept safe and clean. The contractor will be required to nominate a 24-hour contact person to enable access to sites as well as implement any remedial/emergency works required.

3.0 The Works 3.1 Method Statements and Hazards Identified

The Principle Contractors will need to provide for pre-award assessment a detailed outline method statement and risk assessments to cater for the foreseeable risks outlined within this Pre-tender Health and Safety Information Pack. The PC shall assess the nature of the works and submit method statements and risk assessments for the main items of work. These procedures are to be approved prior to commencement of the works. If the site conditions require deviations from the approved procedures this must be supported by new method statements for approval by the CA, prior to commencement of revised method of working.

3.2 COSHH Assessment of Hazardous Materials

A list of specified hazardous materials is contained within Appendix D of this Plan. The PC shall ensure that their supervisors and contractors take the necessary precautions to ensure the health of the installer and workers in the area when these products are used. The PC is to check and ensure that all non-specific materials used by any persons on the contract fulfil the performance specification of the project and are non-hazardous in the use to which they are put to. The PC shall approve or refute the use of hazardous chemicals before any work is put at hand, COSHH data sheets to be provided before decision can be made. All COSHH data sheets for materials used in the project shall be passed to the PS to form part of the Health and Safety File.

3.3 Provision of Ear Defenders

Any work sequence to be carried out by a contractor or sub-contractor that might lead to excessive noise levels shall be discussed and approved by the PC (in consultation with CA & PS) before any work is put in hand. PC is to actively seek to reduce all noise levels to which operatives are exposed to below First Action Level (80dB (A)) as described in Noise at Work Regulation. Upon this level being exceeded PC is to ensure that the relevant Noise Assessment has been carried out and that Ear Protection is provided to all operatives who request it. Upon exceeding Second Action Level (85dB (A)) as described in Noise at Work Regulation PC is to ensure that the relevant Noise Assessment has been carried out, that control measures are in place to reduce noise to first action level. These measures

should reduce exposure to noise by means other than the provision of ear protection i.e. engineering controls and isolation procedures. Upon establishing a zone where the second action level is exceeded and noise cannot be reduced to first action level PC is to ensure that adequate signs declaring the area as an “Ear Protection Zone” are displayed. Within the Ear Protection Zone, the compulsory use of ear protection is to be enforced at all times. All ear protection provided, weather earplugs or muffs shall comply with BS5228.

3.4 Other Protective Equipment

The PC shall detail the need for protective equipment in his site rules and enforce them. The PC shall ensure that all contractors on site involved in the work sequences, which are at risk from falling objects or where they might hit their head are provided with suitable Head Protection that is to comply with EN 397 or EN 812. Footwear with suitable toecap and sole protection shall be worn where there is a risk of injury from materials being dropped on feet or from puncture injury as result of sharp debris. All Safety Footwear is to comply with EN 345. The PC shall ensure that High Visibility Clothing is provided and worn by his employees. All High Visibility Clothing must comply with EN 471. Goggles or face shields shall be worn at all times when site operative is in danger of receiving injury to eyes or face e.g. as result of employing angle grinders and disc cutters and the like. All contractors handling paints, detergents, degreasing agents’ solvents or any chemical/biological agent shall wear suitable protection, which protects against dermatitis or other associated risk related to the substance. Specific recommendation issued by manufacture contained in the Safety Data Sheet shall be strictly adhered to.

3.5 Fire Extinguishers

All contractors working on the project shall take all necessary precautions to prevent personal injury, death or damage to the works or other property from fire. The PC is to ensure that sufficient numbers and types of extinguishers appropriate to the hazard are provided close to work areas which could give rise to risk of fire, especially any hot working or disc cutting activity. All fire extinguishers to be manufactured and labelled to current British or equivalent European standards and carry a current certificate of test and service. The location of the fire extinguishers shall be clearly marked and made known to all contractors and sub-contractors. All construction staff shall be trained in the selection and operation of the extinguishers on the site.

3.6 Use of Power Tools

All power tools, unless detailed otherwise, in the main specification and agreed with the PC, shall be pneumatic, cordless portable tools or 110V max centre trapped to earth, so that the maximum voltage to earth does not exceed 55V. Power tools are to be regularly inspected/tested according to the requirements of the Electricity at Work Regulations and are only to be employed by suitably trained and qualified personnel.

3.7 Portable Air Compressors

All portable air compressors provided for the operation of air-powered tools shall be fitted with the manufacturers approved silencer and a catalyst converter or oxidation catalyst throughout the project. The type of compressor selected for use shall be the type, which allows for the covers to be kept closed during normal operation. No compressor shall be operated in an enclosed space where other site personnel will be affected by the air requirement, exhaust gas or high ambient temperature. The PC shall approve the siting and type of portable compressors on the site before being put to use. Evidence of current test and maintenance certificates shall be submitted to the CA for his approval before any portable air compressor equipment is put to work.

3.8 Removal of Material and General Site Clearance.

The PC is to establish a method of disposal for different types of material for all its sites. If required, proposed storage areas are to be agreed prior to commencement of works with CA. Access routes for general traffic are to be maintained during the loading/unloading of material. The PC shall ensure that laid down procedures regarding the removal of demolition debris and material. The removal of these materials together with general rubbish accumulated during the works shall follow set procedures and secured to avoid spillage during transportation. The site shall be kept clean to reduce risk of hazards from tripping, injury or damage to the works. Should the material removed be contaminated in any way, then this removal shall be carried out according to the specific requirements of the Environmental Agency and Technical Services Department – Highways Division.

3.9 Dust and Spillage Control

The Principle Contractor is required to abide by the Environmental (Dust Control) Regulations 2010; via which they must develop and implement a suitable Dust Control Plan approved by the Environmental Agency. The PC shall provide a copy of their Dust Control Plan as well as any relevant and current certificate issued by the Environmental Agency in relation to the Environmental (Dust Control) Regulations 2010. The Principle Contractor shall ensure that adequate methods for the control and suppression of dust forming as result of the excavation/construction are employed

during the works. This will take the form of the dampening of excavated material with water and sheeting of disposal lorries. The Principle Contractor shall also consider restricting the speed of vehicles, regular cleaning of road area adjacent to site (by means of hosing down), the provision of a wheel wash at site exist as well as designating specific vehicle routes to disposal site. Additionally the provision of drain filters and/or protective plates in order to prevent the silting up of site drains/sewers during the works will have to be considered.

3.10 Protecting the Public

The PC shall identify both pedestrian and vehicular traffic routes for safe access/transits of vehicles for all the works in accordance with the guideline provided by the Safety at Street Works and Road Works (A Code of Practice) Traffic management plan is to be submitted prior to commencement of the works with proposed access routes and protective measures to be taken to ensure work areas remain safe throughout the duration of the works. The PC shall ensure that as far as is reasonably practicable, members of the Public are deterred from accessing the work sites. Suitable signs and barriers are to be placed to acknowledge the location of the work area. The demarcation of the works is to be clearly visible and suitable signs shall to be provided. Adequate precautions to be taken to ensure that these signs are stable and will not create an obstruction to access routes. PC is to nominate a person who is to be responsible for the upkeep of the different site perimeters and traffic control measures after normal working hours. Due to the interaction with pedestrians, one of the main concerns is the possibility of persons gaining access to site during or after working hours. To this effect the boundary of the site or part thereof are to be demarcated/secured using appropriate guarding, lighting and signing of road works which are to be specifically designed to match site conditions. The PC is requested to exercise extreme caution in the setting up and maintenance of the pedestrian control measure throughout the duration of the works. The PC will be required to manage both pedestrian and vehicular traffic in accordance to the Traffic Manual Chapter 8 and Guidance provided by the Safety at Street Works and Road Works (A Code of Practice).

3.11 Monitoring and Auditing of Safety during the Construction Works

The PC is to submit to the PS prior to commencement of any works, comprehensive details of the method of the monitoring and auditing procedures that will be used in order to ensure compliance with the requirements of the fully developed Health and Safety Plan.

4.0 Client Requirements 4.1 Site Conditions During the Works

The Site must be maintained in a tidy and safe manner during the works. Areas in which works are in progress and which are in a temporarily unstable condition to be cordoned off as necessary and adequately identified.

4.2 Client Requirements

The Client requires that the PC is to ensure their employees or sub-contractors do not cause hazards by their actions during the project that could lead to injury or death to themselves or others. The PC to ensure that the existing services that remain in use during the works are adequately protected. The PC is to obtain all the necessary clearances (up dated as necessary) prior to commencing the works. The Contractor is to ensure there is good liaison between Royal Gibraltar Police and City Fire Brigade prior and other emergency services during the works. Access routes for essential services are to be maintained at all times.

5.0 Site Rules 5.1 Health and Safety Issues

The PC shall be responsible for and ensure a suitable accident report structure is in place during the works on site. The PC shall ensure that all his employees, sub-contractors and self-employed or any other person engaged on the project are fully trained in health and safety and are fully aware of the hazards involved in the project. All sub-contractors shall inform the PC of any hazardous task to be undertaken so that due regard to the health and safety of the operator and others may be given. The PC shall act accordingly offering a less hazardous method of working where possible, or, as a last resort to issue of Personal Protective Equipment (PPE) to other workers and the placing of notices as required. The PC shall agree the site rules and welfare facilities, i.e. WC are, washing facilities, special working hours with the CA and PS before any work commences. PC shall prepare (in consultation with CA and PS) and ensure that Site Rules are issued to all sub-contractors and persons employed on the site and are enforced at all times.

5.2 First Aid

The PC is to ensure that First Aid facilities on the site meet the requirements of the Factories Act – First Aid at Work Regulations. This will include a suitable numbers of qualified first aiders, a box with sufficient first aid equipment to cope with the number of workers on the site and an appointed person to contact the accident and emergency services.

Note that the nearest accident and emergency department is located at St Bernard’s General Hospital at Europort. The phone numbers of all emergency services should be clearly visible in site accommodation and fixed at a suitably visible location on site.

5.3 Health and Safety File

The contents of the Health and Safety Files, as required under the Factory Act - Construction (Design, Management of Health, Safety, and Welfare) Regulations 1998 are detailed within Appendix C. It is the PC’s duty under the CDM Regulations and this contract to ensure that this information is put together and then passed to the PS for approval. The PS will then issue the satisfactorily completed and checked files to the client for retention.

The Factories Act – Construction (Design, Management, Health and Safety and Welfare) Regulations 1998 The PC must be appointed as Health and Safety Co-ordinator during the demolition and preparatory construction phase. This will normally be the Main Contractors Site Manager. The PC’s major duties include: Developing the Health and Safety Plan produced by the PS for the Contract. Including the developed Health and Safety Plan rules for management of the

construction work for health and safety purposes, such rules must be in writing and be brought to the attention of the persons affected by the rules. These rules must be constantly monitored and up-dated by the PC’s Health and Safety Officer; ensuring co-operation between all contractors on site.

Ensuring as far as is reasonably practicable that every contractor and every employee

complies with the rules in the developed Health and Safety Plan. Ensuring that reasonable steps are taken to allow only authorised persons to enter the

construction work premises. Promptly provide the PS with information which:

Is in his possession or which he could ascertain after reasonable enquiries of a contractor It is reasonable to believe the PS would include in the Health and Safety File

Giving directions to contractors to enable him to comply with his duties Ensuring that so far as is reasonably practicable that each contractor is given clear and

comprehensive information on health and safety risks to their employees or others under their control, arising out of the construction works including:

preventive or protective measures required emergency procedures Health and Safety Training on: being transferred to the project change of work system new equipment or method of working introduced

Ensuring that all persons employed in relation to the contract, whether directly or self-employed, can discuss and offer advice to the PC on project matters which may foreseeable affect their or other employees health and safety. To comply with the minimum requirements as detailed in the Factories Act – Construction (Design, Management Health and Safety and Welfare) Regulations 1998 as specified in regulation 16. (1-3).

THE HEALTH AND SAFETY FILE When putting together the Health and Safety file, the PC should consider including information about each of the following, where they are relevant to the health and safety of any future construction work on the structure, building or site. The level of detail should allow the likely risks to be identified and addressed by those carrying out any future work: a) A brief description of the work carried out; b) Any residual hazards which remain and how they have been dealt with (e.g. surveys or

other information concerning asbestos; contaminated land; buried services etc); c) Key structural principles (e.g. bracing, sources of substantial stored energy – including

prior post-tensioned members) and safe working loads for floors and roofs, particularly where these may preclude placing scaffolding or heavy machinery there;

d) Hazardous materials used and/or retained within the structure (e.g. lead paint;

pesticides; special coatings which should not be burnt off etc); e) Information regarding the removal or dismantling of installed plant and equipment (e.g.

any special arrangements for lifting, order or other special instructions for dismantling etc) as may be applicable to the project;

f) Health and safety information about equipment provided for cleaning or maintaining

the structure; g) The nature, location and markings of significant services, including underground cables;

as supply equipment; fire-fighting services etc;

h) Information and as-built drawings of the structure, its plant and equipment (e.g. the means of safe access to and from service voids fire doors and compartmentalisation etc.)

i) Maintenance Manuals that assist in the future maintenance and repair of the building or structure, for presentation to the Client on completion of the works. Detailed information reference materials employed on site i.e. manufacturers and supplier

Method Statement and Risk Assessment Apart from describing the sequential execution of the works the method statement for the non-routine works is to make specific reference to the following issue, which will no doubt arise out of the execution of the works. 1. Due to the nature of the works and their location some of the works are to be

approached in a phased fashion. The phasing of the works is to tally with the requirement laid down by the CA and a Traffic Management Plan shall be produced prior to the commencement of the works.

Hence the PC is to take account of this fact and submit for the approval of CA and PS detailed method statement in relation to traffic management plans for the various distinctive phases of the works. It is important to note that both vehicle and pedestrian are to be catered for at all times during the works. The method statement provided must reflect this requirement.

2. The method to be employed for the removal of surplus material as well as the supply of

materials to site. Access routes for general traffic are to remain opened in accordance with traffic management arrangements (taking into account point 1) especially so during loading and unloading of materials.

3. The Principle Contractor is to provide specific information within the method

statement, relate to the main aspects of the works. Hence the following hazards are to be assessed and proposed control measure submitted for consideration by CA and PS: -

Excavation. Construction Works Planing of Asphalt surfacing Hot Asphalt Works Manual Handling. Underground Services. Confined Space (manhole and manhole cover works, as required) Exposure to dust, noise and vibration Traffic Management Issue Storage of materials on site

4. The Principle Contractor will have to provide Risk Assessment to cover all planned

activities to be carried out as part of the works, before the commencement of work on site. Additionally the Principle Contractor will be required to provide any assessment to cover any other activities, which arise out of extra or unforeseen works.

ENVIRONMENTAL CONSIDERATIONS S23-6 2

Environmental Policy

1.1. In accordance with the Government’s Environmental Policy, as stated in the Government’s Environmental Action and Management Plan, the Contractor should make all reasonable efforts to conserve energy, water and other resources, to reduce waste, recycle and re-use materials where possible and phase out any ozone depleting substances.

1.2. Favourable consideration will be given to submissions which include the use of environmentally friendly products or services, sustainably sourced or recycled materials, waste minimisation initiatives, use of least hazardous products, equipment efficiency and measures to minimise the release of greenhouse gases, volatile organic compounds and other substances damaging to health and the environment, etc.

1.3. Favourable consideration will also be given to contractors who demonstrate the company’s environmental principles; for example the company’s environmental policy statement, waste management plans, environmental accreditations, employee training, environmental management systems etc.

2. Environmental Requirements

2.1. Environmental Requirements; Contractors should provide proof of any environmental accreditation awarded to them (e.g. ISO 14001 or equivalent) and/or a Company Environmental Policy including evidence of implementation.

2.2. Contractors must produce, and submit with the Tender, an Environmental Management Plan for the Works. The purpose of the plan should be to demonstrate what control measures will be implemented during the Works so as to avoid or reduce any negative impacts onto the surrounding environment as a result of the planned Works. Of particular emphasis, the plan should consider and propose control measures to mitigate: 2.2.1. Odour issues.

2.2.2. Waste arising from the Works (the area should remain clear of any waste or soil

arisings once the Works are finalised).

2.2.3. Disposal of Contaminated Material.

2.2.4. Accidental spills or leaks from equipment, plant or other sources during the Works.

2.2.5. Noise.

2.2.6. Dust & Air quality.

Rosia Road Traffic Management

1. Road will be resurfaced in two halves. Traffic flow will be allowed to flow along one side of

the road whilst works proceed along the other side.

2. On-street parking will be suspended for the duration of the works which is estimated at 3

weeks including final resurfacing of the wearing course layer.

3. Planning of surface will be done from one end to the other and subsequently resurfaced

before moving on to the other side of the road.
