WARRANTY

Tektronix warrants that this product will be free from defects in materials and workmanship for a period ofthree (3) months from the date of shipment and that the cathode-ray tubes (CRTs) in such products will be freefrom defects in materials and workmanship for an additional period of nine (9) months. If any such product provesdefective during the initial three-month period, Tektronix, at its option, either will repair the defective productwithout charge for parts and labor, or will provide a replacement in exchange for the defective product. If, duringthe succeeding nine-month period, the CRT proves defective, Tektronix will replace the defective CRT withoutcharge for parts and labor.

In order to obtain service under this warranty, Customer must notify Tektronix of the defect before the expirationof the respective warranty period and make suitable arrangements for the performance of service. Tektronix willprovide such service at Customer’s site without charge during the warranty period, if the service is performedwithin the normal on-site service area. Tektronix will provide on-site service outside the normal on-site servicearea only upon prior agreement and subject to payment of all travel expenses by Customer. When or where on-siteservice is not available, Customer shall be responsible for packaging and shipping the defective product to theservice center designated by Tektronix, with shipping charges prepaid. Tektronix shall pay for the return of theproduct to Customer if the shipment is to a location within the country in which the Tektronix service center islocated. Customer shall be responsible for paying all shipping charges, duties, taxes, and any other charges forproducts returned to any other locations.

This warranty shall not apply to any defect, failure or damage caused by improper use or improper or inadequatemaintenance and care. Tektronix shall not be obligated to furnish service under this warranty a) to repair damageresulting from attempts by personnel other than Tektronix representatives to install, repair or service the product;b) to repair damage resulting from improper use or connection to incompatible equipment; or c) to service aproduct that has been modified or integrated with other products when the effect of such modification orintegration increases the time or difficulty of servicing the product.

THIS WARRANTY IS GIVEN BY TEKTRONIX WITH RESPECT TO THIS PRODUCT IN LIEU OFANY OTHER WARRANTIES, EXPRESSED OR IMPLIED. TEKTRONIX AND ITS VENDORSDISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR APARTICULAR PURPOSE. TEKTRONIX’ RESPONSIBILITY TO REPAIR OR REPLACE DEFECTIVEPRODUCTS IS THE SOLE AND EXCLUSIVE REMEDY PROVIDED TO THE CUSTOMER FORBREACH OF THIS WARRANTY. TEKTRONIX AND ITS VENDORS WILL NOT BE LIABLE FOR ANYINDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES IRRESPECTIVE OFWHETHER TEKTRONIX OR THE VENDOR HAS ADVANCE NOTICE OF THE POSSIBILITY OFSUCH DAMAGES.

WARRANTY

Tektronix warrants that the media on which this software product is furnished and the encoding of the programs onthe media will be free from defects in materials and workmanship for a period of three (3) months from date ofshipment. If any such medium or encoding proves defective during the warranty period, Tektronix will provide areplacement in exchange for the defective medium. Except as to the media on which this software product isfurnished, this software product is provided “as is” without warranty of any kind, either express or implied.Tektronix does not warrant that the functions contained in this software product will meet Customer’srequirements or that the operation of the programs will be uninterrupted or error-free.

In order to obtain service under this warranty, Customer must notify Tektronix of the defect before the expirationof the warranty period. If Tektronix is unable to provide a replacement that is free from defects in materials andworkmanship within a reasonable time thereafter, Customer may terminate the license for this software productand return this software product and any associated materials for credit or refund.

THIS WARRANTY IS GIVEN BY TEKTRONIX WITH RESPECT TO THIS PRODUCT IN LIEU OFANY OTHER WARRANTIES, EXPRESS OR IMPLIED. TEKTRONIX AND ITS VENDORS DISCLAIMANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULARPURPOSE. TEKTRONIX’ RESPONSIBILITY TO REPLACE DEFECTIVE MEDIA OR REFUNDCUSTOMER’S PAYMENT IS THE SOLE AND EXCLUSIVE REMEDY PROVIDED TO THECUSTOMER FOR BREACH OF THIS WARRANTY. TEKTRONIX AND ITS VENDORS WILL NOT BELIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGESIRRESPECTIVE OF WHETHER TEKTRONIX OR THE VENDOR HAS ADVANCE NOTICE OF THEPOSSIBILITY OF SUCH DAMAGES.
