MAIN ACHIEVEMENTS OF THE MOBILITY PARTNERSHIP

(November 2011 - May 2012)

I. MIGRATION AND DEVELOPMENT

The Joint Pilot Programme “Mainstreaming of Migration into Development in Moldova (MOMID)” was launched on 9 November 2011, with the support of the UNDP, IOM Mission to Moldova, UN Women, the United Nations Country Team and Global Migration Group (GMG).Funded by the Swiss Agency for Development and Cooperation (SDC), this two-year project is designed to help the Government of Moldova to develop efficient migration policies, particularly in the context of the Moldova 2020 National Development Strategy. The Republic of Moldova is one of four pilot countries to start such work on mainstreaming migration into national development policies. The project will build upon the Extended Migration Profile (EMP) exercise, by channelling the established evidence base into policy making. Currently an assessment of policy/institutional setup is taking place within the initial stage of the project in view of making recommendations on migration management institutional and policy framework.

Work on establishing the country's Extended Migration Profile (EMP) continued in the framework of the project “Supporting the implementation of the migration and development component of the EU Moldova Mobility Partnership” (SIMP), implemented by IOM and funded by the European Union. Important work to support the national ownership of the instrument took place in close collaboration with the relevant ministries, authorities and the National Commission for Population and Development. A draft Government Decision approving the EMP Template, EMP list of Indicators and a set of definitions was developed and submitted to the Government for approval. The draft Government Decision also designates BMA as the coordinating authority responsible for the future development and annual update of the Moldovan EMP. Currently, a team of national and international experts is set up in the framework of the project and is responsible for compilation of the first EMP Report for Moldova. This EMP template will be used as a tool for update and background for mainstreaming migration into development strategies being a “best practice” example for other countries signatories of Mobility Partnerships with the EU. It is envisaged that the EMP will be finalised in autumn 2012.

- Moldova's channels of communication with the Diaspora were enhanced through launching in December 2011 a new web-site www.diaspora.md, managed by the Bureau of Interethnic Relations. The site includes additional modules of diaspora-diaspora and diaspora-country communication. The website contains useful information for Moldovan citizens abroad related to legal acts, initiatives aimed at supporting Diaspora, news and events from Moldova, as well as a contact list of Moldovan

Diaspora associations. To facilitate the Diaspora's communication with the homeland, an online Diaspora associations' registration module was developed to allow the online creation of a database for each migrants' destination country.Additionally, the was improved through the establishment of a portal, where each Diaspora siteassociation, registered on the site, shall have the unique possibility to create and administrate their own subpages.

- The implementation of the Small Grants Mechanism for 10 selected diaspora associations continued. Amongst the 10 grants, an important, unique and innovative initiative was the development of the Guide for Social Orientation and Integration of Moldovans in Italy, produced by the Diaspora association AssoMoldave, published in 5000 copies in November 2011. The

guide includes relevant legal provisions, recommendations, references to sources of information, including on public assistance, the list of Moldovan associations in Italy, suggestions about usual meeting venues and, concrete solutions to problems faced by Moldovan migrants in Italy. The guide was distributed in most of the Italian regions, with the support of Moldovan diplomatic and consular missions in Rome and Bologna. Given the high interest manifested by the target group towards the publication, the production of the second edition of the publication in April 2012 was supported by the project. The guide will be distributed as part of the informational materials within the “Nobody is alone on the Earth” information and awareness raising campaign for Moldovan migrants concentrated in nine cities within five Italian regions.

- The Information Consultancy and Assistance Centre in Paris was also opened with the support of the small grants mechanism for diaspora, with the efforts of the diaspora association Pro Diaspora France. Following the launch of the Centre in Paris in October 2011, it served as a responsive and dynamic environment for information mobilization, by offering full information about local and international opportunities for Moldovan citizens in France. Given the important functions assumed by the Centre and the positive feedback received from stakeholders, it was decided to offer a supplementary smaller grant to fund the purchase of technical equipment.

- The Festival of Moldovans in the UK was organized in autumn 2011 with support of Moldovan Embassy in the United Kingdom. Gathering more than 300 Moldovans residing in the UK, it provided a platform to promote the Moldovan culture, traditions and music abroad. To facilitate communication and cooperation of Moldovan migrants from Great Britain a web portal www.vatra.org.uk was developed and launched during the festival.

- Following the pilot testing of PARE 1+1 matching grants, the Government allocated 11 million MDL from public budget funds for 2012. The allocation of financial support is decided for the applications received during 15 February - 15 March 2012. Three educational seminars for the heads of the economic departments of the regional councils will be organized at the next stage of the programme and the procurement of necessary equipment for the activities of the councils is envisaged.

- The SIMP project also supported the organization of a seminar on “Development policy for SMEs in the Republic of Moldova – practice of the Czech Republic” and “Elaboration and promotion of regulation policy in the sphere of SMEs development” (November 2011). Participants of the event - the representatives of the economic units of the local councils - were informed on the EU practices on business clusters, a model which can be replicated in the Republic of Moldova. Also, there was a public consultation on the Strategy for the development of SMEs for 2012-2020 and respectively on the Action Plan for the development of SMEs for 2012-2014.

- Training courses aimed at supporting the young entrepreneurs and women-entrepreneurs are continuing to be provided within the SIMP project. Over 60 persons were trained during the period of November 2011 - January 2012, the total number of beneficiaries of the training reaching 540 persons, way above the initially planned 200. During the training courses young people had a possibility to enhance their entrepreneurship abilities.

- A round table taking stock of the intermediary trainings results of implementation of the National Economic Empowerment Program for Youth was organized on 22 December 2011. The event brought together over 50 participants: beneficiaries of the trainings, mayors of the localities where the trainings were held, trainers, representatives of the line ministries and partners, and mass-media. The organization of such activities that foster the economic development in the rural areas was highly appreciated by the participants.

For a better access to quality information and services for rural women and potential or returned migrants in Moldova, the introduction of Joint Information and Services Bureaus (JISBs) based

on “one-window” approach was supported through the UN Women Programme “Women's Economic Empowerment through Increasing Employability in the Republic of Moldova” implemented in partnership with the MLSPF and the Ministry of Economy. The support for the programme is provided by the Government of Sweden.

Functioning of the bureaus enabled the beneficiaries to receive information and services in a coordinated way from around nine service providers on employment, labour market, social protection, business, agriculture development, legal, and land related issues and improve their economic conditions. Up-to-date more than 2500 people received guidance and support. Today JISBs are functional in districts of Singerei, Telenesti, Nisporeni, Cantemir and Ungheni and can be used as a platform to assist potential migrants and reintegration of return migrants especially when migration affects mostly women and men residing in rural areas. JISB concept is unique and cost effective both for rural women and public administration.

The European Training Foundation (ETF) Country Project in Moldova continued to be implemented in partnership with the Ministry of Education of the Republic of Moldova. The

project's activities are based on the analysis of the main policy priorities which should be tackled for improving the quality of the VET system in the country, namely: the governance of the system, the lifelong learning dimension of VET, and the financing aspects. On the previous stages of the project the format of occupational standards was approved by the Tripartite Commission on National

Bargaining. The group of stakeholders involved in the ETF project has furthermore elaborated a Concept for validation of non-formal and informal learning.

- On 8 May 2012 ETF organised a workshop ”The use of learning outcomes in the Republic of Moldova in the framework of the NQF for lifelong learning” with the participation of the stakeholders and international experts. For the upcoming period policy advice workshops, contributions to EC project formulation, new expert input on formulation of outcome-based qualifications, capacity building of social partners in playing their role, dialogue and coordination with other donors, and work on evidence-informed policy making are embedded in the ETF activity plan in the Republic of Moldova.

In the last quarter of 2011 the work on the evaluation of the MP was initiated. To this end, a set of benchmarks was developed by a research fellow hosted by the IOM, in close cooperation with Moldovan implementing institutions and the EC. Consequently, a comprehensive MP Evaluation questionnaire including both quantitative and qualitative indicators was developed and released in February 2012 to a number of Moldovan and EU institutions and bodies, EU MS participating in the MP, international organisations, representatives of academia and civil society organizations. Based on the received feedback, the Evaluation Report will be finalised this year.

II. PROMOTION OF LEGAL MIGRATION

The final conference of the project „Strengthening Moldova's Capacity to Manage Labour and Return Migration”, funded by the European Union and implemented by the Swedish Public Employment Agency in cooperation with the Ministry of Labour, Social Protection and Family of the

Republic of Moldova (MLSPF) and several EU MS took place on 23 February 2012.The project was launched in February 2009 in the framework of the MP, for a period of 38 months, with the main objective to facilitate the Government's capacity to manage labour migration between Moldova and the EU. The project with a total budget of more than 3 million EUR targeted its efforts at public information and awareness about the risks of illegal migration, labour shortage in Moldova and promoting

legal labour migration of Moldovan citizens to the EU countries. The results achieved within the project were highly appreciated by the stake-holders as positive and the continuation of the project is foreseen for the next years.

In �April �2012� the modernization and re-launching of the www.migratie.md website was supported within the project „Supporting the implementation of the migration and development component of the EU-Moldova Mobility Partnership” (SIMP). The website allows citizens of the Republic of Moldova who have decided to go abroad to easily access comprehensive information about the possibilities and opportunities to migrate to over 20 countries around the world. Furthermore, foreign citizens who would like to visit or stay in Moldova can find information about legal stay requirements, job and business opportunities. - In order to strengthen the capacities of Moldovan national institutions to promote legal migration and reintegration, the project supported the organization of a study visit of the representatives of MFAEI to Germany in order to learn the EU best practices and experience in developing an electronic system for visa management. Moreover, the work continued to finalise the on-line registration module/facility for Moldovan nationals abroad, allowing for on-line consular registration and the on-line programming for consular services.

- The development of a unified system of return and reintegration to all Moldovan migrants, including those returning without assistance continued. The concept of a mechanism was created for outreach to potential beneficiaries, their identification and selection for reintegration assistance support. Information leaflets for promotion of the project support were developed and distributed.

- The programme for organizing temporary career placements for Moldovan graduates of education institutions from abroad proved to be popular, managing to place a number of 8 beneficiaries during the period of November 2011- February 2012. Given the popularity of the program amongst the target group it was decided to expand the program to an additional 10 beneficiaries. Additional outreach to the respective target group was ensured during the period of March - April 2012, and additional applications were collected.

- In January 2012 the negotiations by the Moldovan Government Delegation of the administrative arrangements for implementation of the bilateral social security agreement with Luxemburg were supported in the framework of the SIMP project in order to further strengthen the social protection system of the Moldovan nationals abroad.

III. FIGHT AGAINST ILLEGAL MIGRATION

The project “Support to the implementation of EU Readmission Agreements with the Republic of Moldova, the Russian Federation and Ukraine: Facilitation of assisted voluntary return and reintegration (SIREADA)” funded by the EU and implemented by the IOM continued. In the framework of the project there was a research on voluntary return norms set in the legislation of the Republic of Moldova analysing the results and proposing suggestions for further improvements of the legislation in place and its harmonization with the EU standards. The project supported the voluntary return of circa 40 foreigners from the Russian Federation, Kazakhstan, Ukraine, Columbia, Armenia, Tajikistan, Egypt, Kyrgyzstan etc.

- On 20 March 2012 the Meeting of the Project Regional Coordination Council took place with the participation of the project partners from the Russian Federation, Ukraine, Moldova, EC, UNHCR and ICMPD which adopted a joint statement on phasing out of the project assistance to migrants in state custody and taking over of these responsibilities by the Government.

The project “Supporting the Implementation of the EC visa facilitation and readmission agreements in Moldova and Georgia”" (REVIS) funded by the EU and implemented by the International Centre for Migration Policy Development (ICMPD) supported number of activities

since its inception, such as the organization in Chisinau of a workshop focusing on negotiating of readmission agreements with the participation of experts from the Finish Migration Service and Hungarian MoI; organization of a study visit to Switzerland in November 2011 for 6 Moldovan delegates; a training seminar on readmission organized for MoI officers in April 2012, which presented the mechanisms and practices of inland detection of illegal foreigners in EU

MS and norms existing for return and expulsion procedures. The project also envisages the procurement of technical equipment and the beneficiary institutions' needs assessment currently takes place.

- Under the project's Visa module a joint workshop on the implementation of the Visa Facilitation Agreement with the EU was carried out in Tbilisi in December 2011. 15 delegates from Moldovan national institutions were invited to share their experience with their colleagues from Georgia and other participants of the event.

- A study visit to Budapest took place in November 2011 for 6 delegates from Moldovan institutions dealing with migration. The delegates had the chance to meet representatives of the Minister of Foreign Affairs of Hungary and Hungarian Office for Immigration and Nationality, and learn about Ferenc Liszt International Airport procedures and policies. - On 2 -3 February 2012 a workshop on Moldova's future visa policy was organized together with MFAEI, with the participation of experts from Hungary, Romania and Common Visa Application Centre in Chisinau. As a result of the workshop a first draft of the Moldovan Consular Handbook was handed over by ICMPD to the MFAEI.

- The study visit to the National Visa Centre in Bucharest, Romania took place in March 2012 with the participation of seven delegates from the MFAEI, MoI and the Border Guard Service (BGS). The purpose of the visit was to gain first-hand experience with the set-up of such a visa centre, the division of tasks between the centre and consular posts and the processing of visas.

- A training seminar “Practices and procedures on visa issuing at the border” took place in April 2012 in Chisinau. The event brought together EU experts, representatives of Moldovan institutions and relevant international organizations in order to make an exchange of opinions and experiences/procedures on issuing visa at the border and impact of visa policies for border management strategies and security issues.

The project “Building training and analytical capacities on migration in Moldova and Georgia” (GOVAC), which is also implemented by the ICMPD since 2011, supported the organisation of knowledge transfer workshops in Georgia and Moldova. The workshops aimed at presenting various EU migration training models; undertaking the first activities on the mapping of the migration curricula; discussing possible future cooperation between government and academia. These results were followed by the knowledge transfer study visits for the representatives of the national institutions and academia from the countries concerned.

– Study visits in Netherlands, to the Hague University for Applied Sciences (for the academia module) and in Portugal (for the government module) took place in March 2012. The purpose of the study visits was to finalize the academia migration curricula and elaborate the content of the training

manual according to the already developed and agreed professional migration curricula. Cooperation between the officials and the academia will be strengthened by Memorandum of Understanding between the competent institutions from Moldova and Georgia, which was drafted in cooperation with the directors of the Project Task Forces. At this stage of the project the drafts are examined by the parties concerned.

In � the� context �of � implementation �of � the objectives �set � in � the �MP �Declaration, �Visa Liberalisation Action Plan and Integrated Border Management �Strategy �the �BGS �continued �to strengthen the cooperation with the European Agency for the Management of Operational Cooperation at the External Borders (Frontex). The main features of cooperation with Frontex are exchange of best practices, joint operations, risk analysis, research and cooperation on border related activities, inter alia, by using modern technologies and biometrics.

- In this regard, the representatives of the BGS take part in the activities organised by the Agency, such as the National Training Coordinators Conference which was held in Romania in November 2011. The event was attended by experts dealing with border management issues from the EU MS as well as the representatives of the Frontex Partnership Academies. Another meeting dedicated to the Systems of Integrated Border Management took place in Malta in December 2011 and was also attended by the representatives of the BGS.

- The training of future border security specialists from the Police Academy "Stefan cel Mare" of MoI continued following the implementation of the Frontex Curriculum for Border Guard within the plan developed by the BGS and approved by the Ministry of Education of the Republic of Moldova. Total of 410 officers of the BGS were trained during 2011within a range of external training activities organized by the EU and international partners.

In�line�with�the�implementation�of�the�project “Biometric passport for Moldova”, MITC jointly with Chisinau International Airport and the BGS launched the „e-Gate” project in April 2012. The "e-Gate" is a technical programme of a type of "green corridor", which checks the biometric passports by using biometric technologies, without involvement of employees of the BGS in this process. Moldovan citizens aged over 18, who hold biometric passports, are now able to benefit from the "e-Gate" system when entering Moldova. The system ensures a rapid access to information systems of control and evidence in accordance with security requirements, providing automated biometric data verification. Owing to the specialized equipment the system streamlines passport verification procedure by reducing the time spent in the border control zone. At the same time, this system is integrated with the Informational System of the BGS.

NATIONAL DIMENSION

The final version of the Third Progress Report of the Republic of Moldova on the implementation of the EU-Moldova Action Plan on Visa Liberalization was presented by the Republic of Moldova on 25 May 2012 to the European Commission, indicating that all the required benchmarks of the first phase (legislative and policy framework) were implemented. Moreover, the Republic of Moldova has already unilaterally initiated the implementation of the conditionalities of the second phase of the Plan and adopted the Annotated Agenda to the National Programme for the implementation of the EU- Moldova Visa Liberalisation.

The implementation of the Integrated Border Management Strategy 2011-2013 continued, followed by the new Law on State Border of the Republic of Moldova adopted by the Parliament on 4 November 2011. The new law describes the competences of the Border Guards Service of the Republic of Moldova (BGS), specifies the conditions for authorization of border crossing, refers to the necessary documents for such authorization, sets the procedure for the refusal of border crossing, as well as establishes the minimal, thorough and second line control - all according to the Schengen Borders Code. The regime of border crossing points enshrined in the new law includes expressly the rights and obligations of the travellers and the establishment of border crossing corridor, which are regulated in order to prevent illegal migration and to facilitate the movement of persons across the border.

The Law on Border Police was approved by the Parliament in December 2011. The Law envisages the demilitarization and improved professionalization of the BGS. Starting with July 2012 the Border Police will be public administration authority within the Ministry of Interior and will be in charge of promoting policies in the field of integrated state border management. Border Police will be empowered with competences in investigation of border crimes, trafficking in human beings, forgery of travel documents, examination and application of penalties for offences related to state border regime, as well competences for conduct of legal expertise of travel documents.

In December 2011 the Parliament of the Republic of Moldova approved the Law on accession to the Convention on the Status of Stateless Persons and the draft Law on the accession to the Convention on the Reduction of Statelessness. The properly spread of information on the new procedure in regions where stateless persons reside is ensured by the Bureau for Migration and Asylum (BMA) with the assistance of the UNHCR Office in Moldova. In this context, UNHCR has already launched pilot projects in Mihaileni, Ochiul Alb, Tirnova, Otaci, Nicoreni, Comrat, Basarabeasca, Hincesti, Vulcanesti and Ciocilteni.

REGIONAL DIMENSION

The International Roundtable “The Eastern Partners' contribution to the Stockholm Programme” was organized in Chişinău on 28 February 2012 as a follow up to the last year's International Conference "The Eastern Partners' contribution to the Stockholm Program: Synergies to Improve Mobility and Strengthen Security". The event took place with the participation of Moldovan and EU officials, representatives of national and international organizations, experts and representatives of the civil society from EU Member States and Eastern Partnership countries. The participants of the event shared experiences, discussed past and ongoing initiatives and developments, set future priorities for cooperation between the Eastern Partners and the EU in the area of Justice, Freedom and Security and consolidation of bi- and multilateral platforms for cooperation. In the context of increased attention on irregular immigration, the idea of mobility based on partnership was reiterated by the participants at the event. The Roundtable contributed to a better exploring of the opportunities for cooperation between the EaP countries and EU Member States.

GLOBAL DIMENSION

The Republic of Moldova continues to actively participate in the activities of the Global Forum on Migration and Development (GFMD) - an initiative of the Member States of the United Nations launched in 2007 in order to identify practical ways of addressing interlinkages between migration and development in all the regions of the world.

- The GFMD 2011 Concluding Debate “Taking Action on Migration and Development – Coherence, Capacity and Cooperation” was held on 1-2 December 2011 in Geneva, Switzerland. The event featured simultaneous working sessions on different cluster themes that were discussed in 14 thematic meetings around the world from January to October 2011. The Republic of Moldova co-chaired jointly with Philippines the Working Session on Mainstreaming Migration into Development Planning/Migration Profiles. The aim of the Session was to deepen the understanding of Mainstreaming Migration into Development Planning and discuss current government plans and practices in implementing this tool. It simultaneously addressed the issue of Migration Profiles and Extended Migration Profiles, including concrete experiences and challenges, and examined the synergetic use of Migration Profiles and Migration and Development Mainstreaming aimed at factoring migration into development planning and vice versa.

During the year 2012 Moldovan participation within the GFMD will concentrate on the mainstreaming migration into development, discussed primarily within Working Table nr. 2, co-chaired by the Republic of Moldova. Mainstreaming of migration into development will also

be the focus of preparations for the annual GFMD meeting in November 2012.

For the first time, the Republic of Moldova participated to the Global Meeting of Chairs and Secretariats of Regional Consultative Processes (RCPs) on Migration “Enhancing Cooperation on Migration through Dialogue and Capacity Building” hosted by the Government of Botswana in October 2011. The meeting underscored the importance of

increased exchanges and effective approaches to migration management within and amongst RCPs and highlighted the value of promoting regional dialogue, capacity development and international cooperation on migration through RCPs.

A Conference on the Mobility Partnerships with the EU was hosted by the Government of Armenia on 7 December 2011 in Yerevan. It aimed at sharing the experiences and lessons learned within the implementation of Mobility Partnerships with the Eastern Partnership countries in order to start the set up of the implementation of the EU-Armenia Mobility Partnership concluded in October 2011. The conference also gave the audience an opportunity to learn more about the EU Development Cooperation Strategy in the field of migration, highlighting the importance of practical cooperation and targeted initiative approach of the partners.

A European policy seminar on the topic of the EU Mobility Partnerships took place in Brussels, Belgium, on 18 January 2012. The seminar was organised jointly by the Dutch Ministry of Foreign Affairs and Maastricht University. The aim of the event was to assess the first four years of the implementation of the EU Mobility Partnerships with partner countries (Republic of Moldova, Cape Verde, Armenia and Georgia) and identify the added value of this migration policy instrument. The Republic of Moldova presented its own the experience in the implementation of the EU-Moldova Mobility Partnership (MP) and the country's future priorities in this respect.

Migration EU Expertise Event "MIEUX 2 in Action: The Way Forward" took place on 22 March 2012 in Brussels, Belgium. Taking into consideration that the Chisinau Conference “The Eastern Partners' contribution to the Stockholm Programme: Synergies to improve mobility and strengthen security” and the follow - up International Roundtable “The Eastern Partners' contribution to the Stockholm Programme” were organised on 23 – 24 January 2011 and on 28 February 2012, respectively, with the financial support of the European Commission – International Centre for Migration Policy Development (ICMPD) Joint Initiative “Migration EU Expertise” (MIEUX), the Republic of Moldova presented the main results and applicability of MIEUX in the realisation of the policy objectives in the migration field. The event brought together practitioners and policymakers from partner countries outside the EU, EU Member States, as well as the European Commission and other stakeholders. Nevertheless, it provided the opportunity to review and assess new mechanisms of technical assistance, such as MIEUX, within the wider framework of the EU Global Approach to Migration and Mobility (GAMM).

The Joint Migration and Development Initiative (JMDI)� North Africa Regional Conference held in Tunis on 27-28 March 2012 gathered over one hundred and thirty participants from over twenty countries, including representatives of the Government of the Republic of Moldova. The conference sought to define concrete ways in which civil society organizations – in partnership with other relevant actors - can contribute to maximizing the positive impact of migration on development, while limiting its possible negative consequences. The thematic sessions provided participants with the opportunity to exchange experiences and best practices and to consider new partnerships in order to better coordinate and implement joint actions. Furthermore, in the spirit of shared responsibilities, the conference laid ground for future platforms that aim at establishing an open dialogue between governments and the civil society.

On 7-8 May 2012 a two-day conference on Mainstreaming migration into development planning, convened by IOM and the Centre for Migration Studies in partnership with the Swiss Agency for Development and Cooperation (SDC) and United Nations Development Programme (UNDP), took place in New York, the USA, with the participation of a representative of the MFAEI. The conference explored the various benefits and impacts of migration on development while highlighting methods for integrating migration into development planning. The information about the project “Mainstreaming of Migration into Development in Moldova” was presented during the conference (more detailed data on it can be found under Migration and Development chapter of the current publication).
