Background:This manual is prepared & published under section 4(1)(b) of Right to Information

Act, 2005 relating to Industries Directorate, Orissa, Cuttack.

Objective / Purpose:The objective / purpose of this hand-book is to provide various information on

functioning of this Directorate, organisation setup, employees - their duties & salary, budgetallocation, etc. for general information of public.

Intended Users:Industries Associations, Existing & Prospective Entrepreneurs and general public.

Definition used in the Handbook:In this Information hand book, unless the context otherwise requires;

a) ‘Act’ means the Right to Information Act, 2005.b) ‘Appellate Authority’ means the Appellate Authority designated under sub-section (1)

of section 19.c) ‘BPL card’ means a card issued to any citizen who is below the poverty line.d) ‘Current basic’ means the current basic pay of the officer/ employee concerned.e) ‘Designation’ means the designation of the post held by the officer/ employee of the

organization.f) ‘Fees’ means amount payable by the applicant for obtaining any information.g) ‘Gross pay’ means the gross pay of the officer/ employee concerned.h) ‘Public Information Officer’ means the Public Information Officer designated under

sub-section (1) of section 5.i) ‘Prescribed format’ means the from prescribed by Government.

Objective purpose of Public Authority :

Directorate of Industries, Orissa looks after promotion & facilitates the growthof Small Scale Industries in the state of Orissa.

Mission / Vision Statement of the Public AuthorityFor making Orissa as number one Industrial state in the industries map of the

country. Which will contribute economic development and generate employment forthe people of the state.

Brief History of the Public Authority:

Industrial Development in Orissa was looked after by Directorate ofDevelopment, which was also taking care of the activities of other sectors likeAgriculture, Fisheries, Irrigation & Endowment. In 1946 Directorate of Industries hadbeen created to exclusively look after the Industrial Development of the State.Subsequently, in 1956 (2nd Five year Plan), 8 District Industries Offices (DIO) hadbeen created namely in Ganjam, Cuttack, Puri, Balasore, Mayurbhanj, Sundargarh,Sambalpur & Bolangir. From 1960, DIO offices were established in all the erstwhile13 Districts. DIC pattern was introduced since 1979-80 and 4 Project Offices wereadded namely in Jagatpur, Rourkela, Bhubaneswar & Rayagada to strengthenIndustrial Activities. After creation of 30 districts, 14 new DICs were created.

Duties / Functions of the Public Authority

Promotion of Small Scale Industries:

i) Survey of Investment opportunities.ii) Guidance to entrepreneurs.iii) Preparation of Project Profiles.iv) Issue of EM-I and EM-II certificates.v) Co-ordination with other agencies.vi) Identification & promotion of Ancillary & Downstream industries.vii) Allotment of Raw materials to Micro & Small.viii) Industrial cluster development.ix) Implementation of Single window system.

Implementation of PMRY programme:

i) Counseling & Guidanceii) Receiving applicationiii) Preparation of Project Profiles.iv) Evaluation of proposals.v) Selection and sponsoring to Banks.vi) Follow up with Banks.vii) Training of beneficiaries.viii) Recovery measures.

Various industries associations and people concerned with policy making areinformed by letter and the same is placed in the website for knowledge of generalpublic.

Mechanism available for monitoring the service delivery and publicgrievance resolution:

Various services are delivered at the District Level by the DICs. Grievances ofpublic are taken care by the General Managers, DICs at District Level and byDirector of Industries, Orissa at Directorate level.

Procedure followed to take decision on various matters:

As per the Record Manual based on Policies, Operational Guidelines, Rules &Regulations, Executive Instructions, Guidelines issued by Govt. from time to time,etc. decisions are taken on various matters.

Documented Procedures / Laid Down Procedures / Defined Criteria /Rules to arrive at a particular decision and different level through whichdecision process moves:

Procedures are based on various Rules, Regulations indicated in Chapter – 4.All matters are processed in the concerned section and routed to the Directorthrough the Sectional Head for decision making based on procedures. In case ofambiguity or in the absence of a procedure the matter is referred to Government.

Arrangements to communicate the decision to public:

Case based decisions are communicated to the individuals by letter.Important circulars and policies, amendments are placed in the website forinformation of general public.

The opinion of concerned Sectional Heads are normally taken for the purpose ofdecision-making based on rules and procedures.

Final Authority that wets the Decision:

Director of Industries, Orissa vets the decision. In case of non-availability ofprocedure or rules, Government provides the decision when referred.

13.1 Scheme details:

i) Name of programme / scheme

a) PMRY – Candidates, fulfilling following criteria, are eligible for subsidy to the tuneof 15% of the project cost limited to Rs. 12,500/-.

i) Age : Between 18 to 35 years for General Category candidates. However,10 years age relaxation is given to SC/ST, Ex-Servicemen,Physically Handicapped and Women.

ii) Qualification : The candidate should at least be a pass of Class-VIII. Preference isgiven to those who have been trained for any trade in Governmentrecognised /approved institution.

iii) Residency : Permanent resident of the area for at least the last 3 years.iv) Family

Income: Neither income of the beneficiary along with the spouse, income of

parent nor the in-laws (for married women) of the beneficiary shallexceed Rs.1,00,000/- per annum.

v) Default toBank/FinancialInstitutions

: The beneficiary should not be a defaulter to any NationalisedBank/Financial Institution/Cooperative Bank. Further a personalready assisted under other subsidy linked Government schemewould not be eligible under the scheme.

16 Marketing Syndication OSIC / NSIC will act as Syndicate Leader for marketing of products & service of Micro and Small

Enterprises on service charge of 1% of sale value Bulk orders of the Govt. may be routed through OSIC as a consortium leader for Micro and

Small Enterprises and organize raw material supply at reasonable rate.17 Film Industry

Employment of one lakh people in Film industry can be doubled through appropriateincentives for film production & film studios, multiplexes.

All Oriya feature films produced in Orissa shall be exempted from Entertainment Tax. Multiplexes are eligible to get allotment of government / IDCO land at concessional indl.rate. Soft loan assistance at a nominal rate of interest will be available to producers of films in the

State Producers of films will be eligible to get subsidy as determined by OFDC for utilization of

facilities of Kalinga Studio Limited (KSL), Film & Television Institute of Orissa and KalingaPrasad Colour Processing Laboratory.

vi) Procedure to avail the benefits of the programme

a) PMRY – Candidates apply in prescribed format to the DIC / Bank for selection.b) Incentives under IPR – Applications in prescribed format for availing incentives

are to be submitted to the General Managers of DIC/ authorities as mentioned inoperational guidelines.

vii) Detail of the benefits given in the programme (also mention the amount of subsidy orother help given)

The details of benefits given under PMRY is available with banks. The benefits extendedunder IPR is available with the DICs/ authorities as mentioned in the operational guidelines.viii) Procedure for the distribution of the subsidy:

a) PMRY – Banks claim subsidy in prescribed format through Reserve Bank ofIndia after disbursement of loan to the beneficiaries.

b) Incentives under IPR – Applications in prescribed format for availing incentivesare to be submitted to the General Managers of DIC, who recommends the caseto the concerned committee / agencies for necessary action at their end.

1. What is the Project Cost ondifferent sectors both forindividual & partnership?

Industries/Service Business.For Individual Rs. 5.00 lakh Rs. 2.00 lakhFor partnership Rs. 10.00 lakhFor Self Help Groups (comprising of 5-20 educatedunemployed youth), there is no upper ceiling.

2. What is the difference betweenproject cost & financing limit?

Project cost is the sum total of loan and margin moneywhereas financing limit is project cost less Marginmoney.

3. Why the financing will not bemade to the extent of full limit?

Maximum project cost is Rs.2.00 lakh for business &Rs.5.00 lakh for service & Industries sector. Projectcost will vary from place to place and scheme toscheme. Margin and subsidy should be equal to 20%of the project cost. (Project cost – Margin) is the loan.

4. Whether collateral security orequitable mortgage isapplicable for financing underland based scheme & activitieswhere project cost is more thanone lakh?

No Collateral security is required for project cost of Rs.5 lakh for industries sector and upto Rs. 2 lakh forbusiness & service sector. In case of Partnershipprojects / SHGs, the exemption limit for no collateralwill be Rs. 5.00 Lakh and Rs.2.00 per borrowal account/ member for Industries Sector and Service & BusinessSector respectively. Under land based scheme, for loanamount exceeding Rs.10,000/-, mortgage must becreated on the same piece of land where the unit isfunctioning. (p.121).

5. Whether a candidate will beeligible for Govt. services afteravailing PMRY loan?

There is no bar for a candidate to enter intoGovernment service if he has availed PMRY loanprovided the loan taken by him is fully repaid.

6. What is the extent of marginmoney?

As per new parameters of PMRY, Banks are allowed totake margin money varying from 5% to 16.25%depending upon the project cost.

When the Block-wise target are being fixed, the TaskForce would not agree with the proposal though aperson is eligible for setting up of a venture at anyplace in the district where he is residing for last 3 years.District is the boundary for the purpose of disbursementof loan subject to convenience of the bank for followup/monitoring/supervision. (P.36 of booklet).

15. Whether a candidate residingwithin the service area of abank will be eligible to set uphis activities within the servicearea of other bank of the sameblock? If yes, which bank willfinance?

Yes he is eligible provided the Dist. Task Force Agrees.Both the bank can finance. However, the financingbank should obtain No Objection Certificate from theother bank.

16. When a Committee comprisingof number of members isselecting a candidate, why thenthe case is being rejectedsubsequently by the bank?

The criteria of income ceiling for determining theeligibility under PMRY is applicable whether thebeneficiary is staying separately or with parents. RBICircular P. 110.

19. How can a candidate maintainhis C/C accounts regularlywhen the distance of thebusiness site is far away fromthe bank? Why the RRBs arenot included under the schemeto avoid such problems?

RRB, Co-operative Bank and Urban Banks have beenexcluded from implementation of PMRY. (Ref. Page170 of PMRY book-let and P.41 - Letter of DC SSI).

23. In case of dissolution ofpartnership and one of thepartners is willing to carry outthe activity individually, whetherthe entire loan component willbe repaid by the partnerinterested to carry out thebusiness?

No. it is not permissible as the liability of each partnerhas been fixed as per the share of each person in theproject.

24. Whether the income of parent-in-laws should be taken in toaccount for assessing thefamily income of a marriedcandidate?

Yes, in case of married woman the income of parent-in-law should be taken into account.

25. Is a candidate who has alreadyavailed and repaid loan, eligibleunder PMRY?

No, if he has availed loan under any subsidy linkedscheme run by central or State Government (P.61 ofPMRY booklet).

26. Should the financing bankretain the original qualificationcertificate before disbursementof loan?

The financing bank should not retain the originalcertificate, they should return the same after affixingtheir seal on the back of certificate as per instruction ofRBI.

27. Are the candidates required tofurnish income certificates fromthe Tahasildar to banks prior todisbursement of loan?

As per DC SSI letter the Banks should not insist forincome certificate of candidates sponsored by DistrictTask Force unless they have concrete and objectiveevidence to the contrary (P.40).

28. Banks are unilaterally notsanctioning/disbursing loanunder PMRY on the plea thatthe recovery position is notgood. Is this justified?

It is not justified.

29. What are the actions takenagainst the borrowers who arenot repaying the dues of thebank willfully and those whohave left the place after availingthe loan?

Repayment schedule would range from 3-7 years afteran initial moratorium of 6 to 18 months as decided byBank (P.7).

Yes

36. Whether two brothers livingseparately, will be eligible underPMRY.

Both the brothers are eligible.

Cash credit facilities are being allowed by the banks asper the scheme.

43. Why some banks are insistingfor term deposit beforesanctioning the case?

This is not permissible under the scheme. Specificcases to be brought to the notice for further action.

44. Is there any reservation underPMRY for physicallyhandicapped persons andwomen?

Preference is given to women beneficiaries &physically handicapped persons. 10 years of agerelaxation up to 45 years is allowed for them.

48. How can government assist abeneficiary for shop/ businesspremises on rent/lease

Where ever business premises are available, thePMRY beneficiaries are allotted with the same onpriority basis.

49. What is the requisiteeducational qualification forfinancial assistance underPMRY?

VIIIth passed. Preference will be given to those whohave been trained for any trade in Governmentrecognised/approved institution for a duration of atleast six months.
