DETAILED TENDER NOTICE NO. 18 (HQ) OF 2013-2014 (IInd. Call)

Sealed tender in B-2 form are invited by the M.I.D.C. from the registered contractors in appropriate class with PWD Govt. of Maharashtra, MJP/ CIDCO/MES/Railways and CPWD. The contractor as registered above are eligible to quote after fulfilling the eligible criteria. The Earnest Money deposit shall be paid by Demand Draft drawn in favour of the Executive Engineer, M.I.D.C. Division, Alibag on any National Bank /Schedule Bank payable at Alibag only or submit the copy of E.M.D. exemption letter issued by MIDC in separate Ist sealed cover, without which no tender will be opened. The tender shall be received in two envelops, first envelop contained E.M.D as stated above, second envelope contained price bid in B-2 form downloaded from M.I.D.C.‟s website. The tender should be submitted through registered post A.D. or through reputed courier service or by hand delivery only.

in this tender and point out the discrepancy/ difficulty, if any to the

notice of competent authority before quoting and submitting the tender

offer. If nothing is brought to the notice by them, it will be presumed

that the contractors have understood the tender conditions and

will be entertained later on by M.I.D.C. The reply to the

discrepancy/difficulty if any should be taken in writing from the

DIRECTION TO THE TENDERER FOR FILLING TENDER

IMPORTANT NOTE

A) The information regarding the tender & PQ form(if applicable) & the facility to

download it, will be available on MIDC website www.midcindia.org. The downloaded &

duly completed tender form shall be submitted without making any change in the script

of tender document. If after submission of tender, it is noticed that the tender script is

modified in any manner whatsoever, the tender will be summarily rejected. All queries

regarding the tender shall be submitted to the Executive Engineer on website. The

replies to the queries received before the due date, will be published on the website

which should be downloaded by the tenderer. The document of reply to the queries of

the contractor will form part & parcel of the tender document & the clarifications given in

the document will supercede the provisions of the tender. This document shall be

downloaded, signed on each & every page & submitted along with the tender in

Envelope No.1 by the tenderer. After the tender is accepted & offer letter is issued to the

contractor, agreement shall be executed with the contractor on the tender copy

prepared/printed by MIDC.

1. The tenderer will duly seal, sign & complete the tender form.

2. Every page of the tender and contract documents including specifications, every correction, deletion or addition and every slip pasted etc. will be signed by the tenderer.

3. The tenderer should quote the percentage in words and figures.

4. The rates shall be quoted including all taxes, duties, octroi and transportation.

5. The tenderer(bidder) should carefully note the unit of each item. No change in this unit is to be made. In case of any doubt, the intending tenderer should refer the matter to the Executive Engineer, and get necessary clarification in writing. Details of work of a similar nature carried out during last (Three) years and currently being carried out.

6. The names and address of reference who would be prepared to give an opinion as to the quality of work.

7. Each tender proposed should be signed by the bidder giving the name and a exact address of the firm to whom the contract is to be issued.

8. The Tender can only be submitted in the name of the Tenderer in whose name the Tendered documents were downloaded from MIDC‟s website. The tender, shall be valid for acceptance for a minimum period of 180 days from the date of opening of tender. If any Tenderer desires to offer a longer validity period, it should specifically be mentioned in the tender.

9. Each tender shall be complete and free from alteration or ambiguity.

10. The contractor should submit the tender in two envelopes.

Following documents be enclosed to the tender as Envelope No.1 & 2.

1 st Envelope. (duly sealed) :-

1) Earnest money of Rs. 47,200.00 cost of blank tender forms Rs.1,000.00 in the form of demand draft / pay order only of any Nationalized Bank and in favour of Executive Engineer, MIDC, Alibag, Payable at Alibag only.

2) Attested copy of of current certificate of registration as approved Contractor in the appropriate class.

3) Attested copy of of registration under work contract Act under Value Added Tax Act 2002 with current clearance certificate.

5) Attested copy of IT Clearance Certificate/IT challan filed with IT dept/PAN no.

6) Attested copy of P.F. Registration Certificate

7) Attested copy of Service Tax registration Certificate

8) Attested copy of Professional tax Registration/Clearance Certificate

09) Experience Certificate having experience of satisfactorily completed single similar work of costing not less than Rs.23.56 Lakhs in Govt./ semi Govt. Department/ Local bodies such as MIDC/ CIDCO/ MJP etc. during last 3 years.

10) All the requirements such as registration with electrical Dept. of PWD shall be fulfilled by the contractor, if necessary.

11) Reply queries (if any) downloaded from website duly signed and sealed.

All the above documents shall be attested by gazeted officer or special Executive Magistrate

After opening envelop No.1, item No.1 to 11 as above will be seen & checked chronologically & if they are found in order then only sealed envelope No.2 will be opened & percentage will be read out.

2nd Envelope :

1. Main tender form duly downloaded, signed & sealed.

NOTE :If the contents of Envelope No.1 are not found as per the requirements of MIDC, the Envelope No.2 will not be opened at all & the tender shall be summarily rejected.

Tender shall be with clear offer without any condition. Any conditional offer would be rejected out right. Contractor should submit the sealed tender by Registered Post or Reputed Courier Services Only. Tender submitted by hand delivery shall not be accepted.

The envelope No.2 will be opened only if the contents of envelope No.1 are found to be correct.

1)Initial Security Deposit: -

i) The contractor is required to pay 8 % security deposit of tendered cost or estimated cost which ever is more if his offer is accepted and he is called for execution of agreement as explained below.

ii) 3 % initial security deposit shall be paid at the time of execution of agreement in the form of D.D. Bank Guarantee. However, if the contractor desires to submit initial S.D. in the from of B.G. he must mention the same at the time of submission of offer in 1st envelope only. The request of contractor received after opening of the tender for payment of initial security deposit in the form of Bank Guarantee shall not be accepted.

iii) The acceptance of Bank Guarantee shall be at the discretion of competent authority. The mention of payment of initial security in the form of Bank Guarantee at the time of submission of offer will not be treated as a condition.

The Balance 5 % security deposit shall be recovered through running account bill only. No Bank Guarantee or fixed deposit shall be accepted for the same.

The Bank Guarantee shall be from one of the Nationalized/Schedule Banks only.

3 % Initial S.D. shall be released along with payment of final bill & remaining balance 5 % S.D. to be recovered through R.A. bill in cash shall be released after N.O.C. from concerned Deputy Engineer.

2)Stamp Duty :-

The contractor, whose offer is proposed for acceptance and called for execution of agreement, shall have to pay the stamp duty as communicated by Stamp Duty Office. All necessary help shall be extended to the contractor for procuring the adhesive stamps from Stamp Duty Office.

AGREEMENT

This Agreement is made and entered into at ________________________

Between

Executive Engineer, MIDC,_ALIBAG Division. on behalf of Maharashtra Industrial

Development Corporation, having its Head Office at Udyog Sarathi, Marol Industrial

estate, Andheri, Mumbai 400 093 (hereinafter referred to as the „Corporation‟) of the

ONE PART.

AND

______________________________________________________________________

___________________________ (Contractor) the PARTY OF THE SECOND PART.

WHERE AS the Corporation has established __________ Division, Sub

Divisional offices and full fledged Engineering & maintenance Department at

_____________ alongwith other Supporting Department.

AND WHEREAS for Operation & Maintenance of water supply scheme

@______Industrial Area., the corporation has agreed to award this work to the Party of

second part.

AND WHEREAS for M&R to W/S/S for Pen-Alibag Region & Nagothane

Industrial Area. Day to day Maintenance of 1300 mm dia M.S. pipelines laid for M/s RCF

Thal & M/s IPCL Nagothane, the corporation has decided to hire various Operation &

Maintenance Services, through Contractors for MIDC‟s Alibag Division on contract

basis.

AND WHEREAS ________________________________________________

(Contractor) party of the Second part has offered to provide M&R to W/S/S for Pen-

Alibag Region & Nagothane Industrial Area. Day to day Maintenance of 1300 mm dia

M.S. pipelines laid for M/s RCF Thal & M/s IPCL Nagothane for Sub Divisions under

Alibag Division , Office on contract basis on the terms and conditions set forth here in

below.

AND WHEREAS the Corporation has agreed for the same;

AND WHEREAS both the parties desire to reduce the terms and conditions into writing;

NOW THEREFORE THIS AGREEMENT WITNESS AS FOLLOWS:

1. That the Contractor shall undertake to provide Day to Day Maitenance

Services purely on contract basis and temporary basis and for that purpose,

would engage sufficient competent personnel for patrolling, 5 M.T. capacity

tempo equivalent to utility vehicle with driver and fuel, gas cylinder, welding

machine, welding rods, dewatering set, all the labours, materials required for

the patrolling and maintenance of 1300 mm dia RWRM and PWGM at its

own cost and responsibility. The agency shall have to engage required

number of welding machines, labours, materials at different locations where

shut down / break down is to be attended. The agency shall have to

complete the shut down/ break down in time.

2. The contractor shall be responsible for the corporate and personnel taxes, &

service tax levied by the Government of India and State Government for the

work done under this contract, if any.

3. That personnel shall be deployed by the Contractor on the job of the

Corporation, subject to fulfillment of the standard of Physical Fitness &

minimum qualification as specified in specification.

4. That no employee of the Contractor shall be at the place of his work except

during his duty hours.

5. That the Contractor shall be responsible for the security and safety of the

installations including and other moveable and immovable properties of the

Corporation and shall ensure that strict vigil is maintained by the personnel

so as not to cause loss or damage to the Corporation, whatsoever.

6. That the personnel engaged/employed by the Contractor in relation to this

contract shall be under direct control of the Contractor and there shall not

exist any employer-employee relationship between the Corporation and the

Contractor his personnel in any way.

7. On satisfactory fulfillment of the Contract, the Corporation shall pay to the

Contractor, charges at the rates agreed for job. That the Contractor shall be

responsible for the payment of salary/wages and other remuneration or

allowances if any, to the personnel so employed by them and the corporation

shall not be responsible for any such payment/liability. Moreover, the

services of such personnel shall be governed by the service conditions

extended to them by the Contractor, in accordance with the statutory

provisions applicable to them, if any.

8. The Contractor shall maintain muster roll of his personnel and other statutory

records and make payment and submit authentic proof of such disbursement

to the corporation in respect of payment to his personnel in accordance with

the statutory provisions applicable if any.

9. The Corporation will not be responsible to make any payment in respect of

the personnel of the Contractor under any statutory obligation and/or any

statutes such as Contract Labour (Regulation and Abolition) Act, 1970,

Employee‟s Provident Fund Act, 1952, Workmen‟s Compensation Act, 1923,

Payment of Gratuity Act, 1972 or any other statutes in force and/or which will

be in force, or any other act as applicable. It will be sole responsible of the

the Contractor to make the payments as applicable.

10. The Contractor should make if applicable regular contribution of personnel‟s

provident fund and ESIC of the concerned Personnel and give regular

receipts to them and submit a consolidated report of the above said

transactions to this office.

11. The Contractor should submit if applicable the proof of the previous

contributions of employee‟s provident fund and ESIC within a period of three

months from the date of given work order to the Contractor.

12. The Contractor shall undertake to comply with all other statutory

provisions/obligations in respect of the personnel engaged by them for the

said contract work.

13. The Contractor shall be responsible for any loss or damage caused to the

Corporation properties on account of any act of commission or commission

on the part of its personnel and Supervisors / representatives and the same

will be make good from the payment payable to the Contractor to the extent

of the loss or damages so caused.

14. In case the contractor fails to comply with any of his obligations in the

contract and/or in respect of any amount due from the contractor to MIDC,

the security deposit shall be forfeited/adjusted towards such amount due

form the contractor. The decision of MIDC will be final in this regard.

15. The contractor should make his own arrangement to allow weekly

holiday/public holiday to the personnel but alternative arrangement must be

made so that contractor‟s personnel are available round the clock without

affecting the Day to day patrolling and the routine maintenance work of 1300

mm dia RWRM, PWPM, PWGM etc. No extra payment will be made on this

account.

16. The Contractor shall be fully responsible against all claims, costs, charges

arising out of personal injury or death to the employees. No accident risk of

contractor‟s employee will be covered by MIDC. It is the entire responsibility

of the contractor to bring the labour force covered under the Employee State

Insurance Scheme. MIDC shall not be liable to pay any compensation.

17. This agreement shall remain in force initially for a period of 12 months from

date of work order _________to____________ and/or it will automatically

come to an end on the expiry of the above contractual period however the

said contract is liable to be terminated by giving 1 Month Notice by either

party.

18. The Corporation reserves its right to deduct an amount @ billing amount of

the wages payable to the party of the second part as security deposit and

towards the effective performance of the said Agreement and the same will

be returned after the expiry of the agreement.

19. During the contract period, if any employee of Contractor is injured in any

mishap, the Contractor shall be responsible for taking necessary action

directly without involving MIDC in this behalf.

20. The Contractor shall also directly deal with any complaints or disputes or

notices given by any Govt. Organizations without involving MIDC.

Nothing contained in this agreement shall be construed to give any right to

any of the personnel of the contractor to claim any benefits from the Corporation and

that the said personnel shall have nothing to do with the affairs of the Corporation or

“Work Contract Act under Maharashtra Value Added Tax Act , 2002”

1. The tendered rates shall be inclusive of all taxes, rates duties, octroi & cesses

shall also be inclusive of the tax leviable in respect of works contract under the

provision of the Maharashtra Value Added Tax Act,2002.

2. The contractors who submit the tenders should necessarily be a Registered

Dealer under Maharashtra Value Added Tax Act,2002.

3. The contractor shall submit the Registration Certificate as a registered dealer

under the Maharashtra Value Added Tax Act,2002 at the time of submission of

tenders or at the time of issuing the work order.

4. MIDC will be deduct this tax at source at 2% (for registered dealer) & 4% (in any

other case) of the value of work done as per Section 31 of Maharashtra Value

Added Tax Act,2002 & Notification No. VAT-1505/CR-123/ Taxation-1 Dt.

1/4/2005. TDS Certificate to this effect will be issued by MIDC.

REGISTRATION UNDER CONTRACT LABOUR ACT - 1970

While submitting the tender the tenderer should note that he should

produce the certified xerox copy of Registration in prescribed form issued by Labour

Commissioner under Contract Labour Act, 1970, as an employer, as much as they are

directly employing the workers for execution of the contract works awarded to them by

MIDC & comply with the provision of the Act. After acceptance of tender by MIDC the

contractor has to give intimation about work order & get this particular work registered

within a period of 15 days from the date of issue of work order from labour

commissioner under Contract Labour Act, 1970 failing which no permission will be

granted to continue further work under the agreement.

SUBMISSION OF MULTIPLE BIDS

1. The bidder may submit more than one bid, each consisting of Envelope No.1 &

Envelope No.2 for the same work provided that:

a) The DDs for EMD & cost of blank tender form & other technical requirements &

financial criteria have to be fulfilled by the bidder, complete in all respects in at least one

of the bids of same work & this envelope containing DDs for EMD & cost of blank tender

form along with technical requirements & financial criteria shall be considered for further

action about the bid. Part/incomplete submission of technical & financial documents in

this envelope will amount to disqualification.

b) Out of multiple bids submitted by a bidder, the best in the interest of MIDC, amongst

these bids shall be considered for evaluation of offer.

GENERAL TERMS AND CONDITIONS

1) Security Deposit -

The corporation shall be entitled to withhold the cash, security deposit, if any furnished

as the case may be and also have a lien over the same, pending finalization or

adjudication of any claim. In the event of security deposit being insufficient to cover the

claimed amount or amounts or if so security has been taken from the contractor, the

corporation shall be entitled to withhold and have a lien to the extent of sum or sums

found payable to the contractor under the same contract or any other contract with the

corporation or Government or any person contracting through the corporation pending

finalization or adjudication of any such claim..

It is agreed under the contract that the sum/sums of money so withheld or retained

under the lien referred to above by the corporation will be withheld or retained as such

by the corporation till the claim arising out of or under the contract is determined by the

competent court and that the contractor will have no claim for interest or damages,

whatsoever, on any account in respect of such withholding or retention under the lien

referred to duly notified as such to the contractor, for the purpose of this clause. Where

the contractor is a partnership firm, the Corporation will withhold and also have lien in

respect of such claims in whole or in parts from any sum found payable to any

partners/limited company, as the case may be whether in his individual capacity or

otherwise. The corporation is not liable to pay any interest on the amounts so withheld.

Lien in respect of claims in other contracts :

Any sum of money due and payable to the contractor (including the security deposit

returnable to him under the contract may be withheld or retained by way of lien by the

corporation or Government against any claim of the corporation or Government with

such other person or persons. It is agreed under the contract that the sum of money so

withheld or retained under this clause will be duly notified to the contractor.

2. Alternations to be Authorised :

No alterations in or additions to or omission or abandonment of or variation in the

contract of any part of the contract shall be deemed authorized except under

instructions from the Addl. Chief Engineer of the corporation. Otherwise the contractor

shall be liable for any consequences that may arise.

3. Jurisdictions :

All question, disputes and differences arising under, out of or in connection with the

contract, shall be subject to the exclusive jurisdiction of the court within local, limits of

courts of Mumbai.

Subletting and Assignments :

The contractor shall comply with all statues/laws or the local authorities state and

Central Govts and shall indemnify the corporation from any default on their part.

The whole of the work included in the contract shall be executed by the contractor and

the contractor shall not directly or indirectly transfer, assign or underlet the contract of

any part, share or interest there in nor shall taken a new partner without the written

consent of the Addl. Chief Engineer and no subletting shall relieve the contractor from

the full and entire responsibilities obligations under the contract or from active

superintendence of the work during the progress.

No. variation i.e. addition or substitution shall vitiate the contract. The contractor shall

be responsible for all injury to persons, animal or things and for all damages to the

structural and or decorative part of property, which may arise from the operations and

on neglect or fault of himself or of any sub/contractors employee, whether such injury or

damage raised from carelessness. Theft, accident and other cause whatever in any

way connected with the carrying out this contract.

The corporation shall be at liberty and is hereby empowered to deduct from the security

deposit the amount of any damages, compensation costs charges and expenses arising

or occurring from or in respect of any claim or damage from any sum or sums due or

any become due to the contractor.

The contractor shall observe all the safety and security rules and regulations of the

Maharashtra/Central Govt. which at present in force and which may come into force

during the tendency of the contract any violation of any rule and regulation will lead to

termination of the contract.

The contractor shall execute this work in such a way as not be interfere with functioning

of the office and also without any disturbance or damage into the structures and

installations etc. within the campus.

No property of the corporation shall be tempered with. In case of default, the damages

as assessed by the authorized offer of the corporation, whose assessment shall be final

and binding on the contractor, shall be payable by the contractor, who will have to pay

the amount of damages within 7 days failing which the contract will be terminated and

the damages shall be recovered from the running bill to the contractor are liable to be

forfeited.

Payment of corporate tax, personal tax provident fund of employees etc. of any

Government or other bodies should be borne by the contractor.

4. Failure & Termination :

The corporation will be entitled to reject the work executed, cancel the contract and

procure the services from other contractors/partners at the risk and cost of the

contractor reserving always to itself the right to forfeit the security deposit furnished by

the contractor for the due fulfillment of the contract.

Breach of the conditions laid down by the Corporation shall entail termination of

contract, the remainder of the work of the contractor will be got done through another

agency/agencies at the risk and cost of the contractor and all amounts which may be

due to the contractor are liable to be forfeited.

Since the job completed under this contract will be logged and measured on daily basis

the contractor is liable to forfeit the entire charges for the job completed in the full day in

case it is found that the proportion of the job completed on that day is in complete due to

shortage or incompetence of man power associated with job.

In case the contractor fails to perform the contract work in any day. He shall not be paid

for the work not performed for that day besides the contractor shall be liable to pay

damages to the corporation on prorate basis.

If the contractor fails to perform the duties as per the scope of work given to the

satisfaction of the corporation, the corporation without prejudice to any other right or

remedy available to it, may in addition recover damage for breach of the contract.

If the corporation finds that the job executed is not of the requisite quality or according to

specification or otherwise not satisfactory due to any reason (on which the decision of

the corporation shall be final and binding on the contractor).

The corporation shall be entitled to recover damages on account of procuring services

from elsewhere or getting the remaining work executed departmentally after servicing

notice on the contractor, such work shall be procured from outside or executed

departmentally at the sole risk, and cost of the contractor for completing the work, which

may be lift unexecuted by the contractor after canceling the contract for a portion thereof

in respect of the unexpected work.

5. Indemnity

The contractor shall indemnify corporation and hold it harmless in respect of any and all

cost, expenses arising from any such injury or damage to persons or property as

aforesaid and also in respect of any claim or proceedings at law and also in respect of

any award of compensation or damage arising there from.

The contractor shall indemnify the corporation against all claims which may be made

against the corporation by any member of the public or other third party in respect of any

thing which may arise in respect of the work or in consequence thereof and caused by

the negligence of the contractor or his representative employees.

6. Force Majeure:

In the event of either party being rendered unable due to force majeure to perform any

obligation required to be performed by them under the contract, the relative obligation of

the party affected by such force majeure shall upon notification to the other party be

suspended for the period of delay which is directly caused by such force majeure event.

The term “Force Majeure” means any delay or default caused by the conditions beyond

the control of the parties including, but not limited to acts of God, Government,

restrictions, wars, insurrections and/or any other cause beyond the reasonable control of

the parties. Upon the occurrence of such event the party alleging the it has been

rendered unable as aforesaid thereby, shall notify the other party (the Corporation) in

writing within 18 hours of the alleged beginning and ending of such an event thereof

giving full particulars & satisfactorily evidence in support of the claim. Time for

performance of the relative obligations rendered suspended by the force majored and

shall then be extended by the period of delay, which is directly caused by the majeure

event. If deliveries of bought out items and/or works to be executed by the contractor

remain suspended due to force majeure condition lasting for more than two months the

corporation shall have option of terminating the contract in whole or part thereof, at

corporation‟s discretion.

Terms and conditions for issue of material under Schedule „A‟

1. Material required in excess of the quantity may or may not be supplied by the Department, if not supplied, the contractor should make his own arrangements to provide the same for which to extra claims will be entertained.

2. All materials remaining unused after the completion of the works should be returned to the Department at the Departmental store. For the materials remaining unused and not returned, recovery will be effective at twice the issued rate of the materials or the prevailing market rate at the time of completion of work, whichever is higher.

3. Considerable delay is likely to occur in getting the materials required to be conveyed by Rail, whether such materials are to be supplied by the MIDC or by the contractor himself. The Contractor, therefore should submit indent for his requirement sufficiently in advance to allow for the period usually taken for supply of such material. No responsibility can be accepted for such delays in regard to supply of these materials. Every assistance will be given to obtain the supplies as quickly as possible.

4. Contractor should check the materials before they are issued to him. Any complaint after the material is accepted by him will not be entertained.

5. The contractor should made his own arrangement for storing the material issued to him, by constructing a pucca shed which should be leakproof and should protect against moist climates.

6. All other materials not included in the above schedule will have to be procured by the contractor from the open market at their own cost.

7. The contractor shall maintain a regular account of consumption of the materials issued to him by the Department, either at cost or free of cost and shall be produced when asked for.

8. All conveyance charges including loading and unloading operations for bringing the materials issued from the place of delivery to the site of work should be borne by the Contractor.

9. Weight of MS rounds that will be issued under Schedule “A” will be computed on the basis of following table.

10. In case of dispute or delegations in diameters, computation of weights shall be

made at a rate of 0.785 Kg / Sq.cm. of cross sectional area.

11. The issue of steel from the stores stipulated in Schedule “A” shall be on the basis of lengths of MS rounds measured in metric system to the nearest 10 mm. length. The surplus steel after completion of work shall also be taken back and measured on the same basis. The MS rounds returned to the departmental store shall be in the form of cut pieces of whole lengths remaining unutilised and will be accepted as such. Pieces of length one meter and above shall accepted. The percentage waste in the form of pieces of length below of length one meter shall not be more than 1% of the tonnage actually used in work. Any additional loss beyond 1% stipulated above, shall be treated as used in an unauthorised and wasteful manner, and recovery at double the issue rate or market rate, whichever is more, shall be effected for such wasteful use of steel.

SCOPE OF WORK

NAME OF WORK : M&R to W/S/S for Pen-Alibag Region & Nagothane Industrial Area. Day to day Maintenance of 1300 mm dia M.S. pipelines laid for M/s RCF Thal & M/s IPCL Nagothane.

MIDC has commissioned 120 MLD capacity Water Supply Scheme for M/s R.C.F., Thal in the year 1981. The Raw water works has been constructed on the bank of Amba river at Nagothane and Pure water works consists of 120 MLD WTP at Poynad. MIDC has laid 1300 mm M.S. Pipe line from Nagothane to Poynad as a Raw water Pumping Main, having length of 26.60 Km and 1300 mm dia M.S. pipe line as a gravity main up to M/s R.C.F., having length of 14.610 Km. The present utilization of the scheme is to the tune of 70.00 MLD. The main consumers of this scheme are M/s RCF, M/s GAIL, M/s HPCL, Alibag municipal Council and en route villages etc.

In addition to this MIDC has developed 81 MLD capacity water supply scheme for M/s IPCL in the year 1988. MIDC has laid 1300 mm dia raw water pipeline of 1.20 Km in length and 4.50 Km length Pure water pipe line. MIDC has developed Raw water works on the bank of Amba River and pure water works at Nagothane.

The scope of work includes daily patrolling of above said pipe lines, maintenance of 1300 mm dia M. S. pipe line raw water and pure water of both the schemes, maintenance of Sluice valves, air valves etc., attending shut/break down, attending minor/major leakages etc. The agency shall have to engage the tempo equivalent to utility vehicle (5 MT capacity) with driver and fuel arrangement, welding machine/machines, welding rods, gas cylinder, dewatering set, labours (skilled/unskilled) required for patrolling, attending leakages.

A) Scope of Contract:

1. Award of contract against the tender shall not entitle the contractor the exclusive right to carry out MIDC‟s job covered under this contract.

1. MIDC also reserves the right to get the services from outside or execute departmentally at its discretion the unexpected job of the contractor at the cost and risk of the contractor.

2. MIDC reserves the right to award the contract simultaneously to more than one contractor and also to award only a part of this contract against this tender at its discretion.

3. The contract is liable to be terminated in case it is observed that the persons provided under the contract are not of required qualification or contractor is not fulfilling the terms & conditions of the contract. In such cases MIDC reserves the right to forfeit the earnest money deposit/security deposit etc.

B) Type of Work:

1. Day to day maintenance of 1300 mm dia MS pipe lines of M/s RCF and M/s IPCL schemes.

2. Day to day maintenance and repairs Air valves, Sluice valves etc.

3. Maintaining the day to day record of various Levels viz. raw water level, number of pumps in operation at raw water works at Nagothane and pure water works at Poynad etc., level at Jalpada etc. The agency shall have to daily monitor both the schemes and shall have to report the same immediate to concerned MIDC engineer.

4. Maintaining record of consumable material supplied by MIDC from time to time.

5. Taking care of day-to-day used material supplied by MIDC.

6. Routine maintenance of both the water supply schemes by opening and closing of valves of said lines as and when required, attending leakages with the required labour material etc.

7. The agency shall have to supply the labours to MIDC officers as and when required for the work of taking measurements of tender works

C) Qualification & Experience:

1. The identity cards will be issued by contractor to his employee and same shall have to be kept with them.

2. Persons employed by the contractor, shall have to be capable for reading & understanding & practicing safety/accident/caution signboards.

3. The requirement of qualification, age and experience may be relayed at discretion of MIDC.

4. The contractor should produce proof of age, qualifications and experience of his personnel to MIDC. No delay on this account will be acceptable.

5. The contractor would be responsible for providing character and antecedent certificate from the police authorities in respect of selected candidates prior to there posting on MIDC jobs.

6. The contractor shall discontinue its personnel if such personnel shown no alertness while on duty. In such cases, the contractor shall have to provide a replacement immediately.

D) Working Day & Hour :

1. The service of the personnel for carrying out the job work would be required on seven days a week and as per direction of Engineer in charge.

E) Execution of Work:

1. The contractor shall execute the work with professional competence and in efficient workmen like manner.

2. Information Confidential: All information obtained by the contractor in the conduct of operation here under shall be confidential and shall not be divulged by the contractor or its employees to any person, firm or company other than the Corporations designated representatives. The contractor should mention the number of personnel per each shift available at the site. The contractor shall at all times, permit the corporation and its

authorized employees and representatives to inspect all works performed and to witness and check all measurements and test made in connection with the said work.

3. Variation in Job Requirements: The contractor shall arrange manpower for the job requirement, which will vary from time to time depending on the Corporation‟s requirements.

F) Obligations

1. For carrying out the work, the contractor shall:

a)Engage 5 M.T. tempo equivalent utility vehicles with fuel and driver arrangement, labours and materials required for Day to Day patrolling, attending major/minor leakages.

b)Make his own arrangement, at his own cost, for providing residential accommodation, traveling, meals, tea etc. to the staff engaged by him.

2.It is further agreed by the contractor that :-

b)His personnel shall observe security and safety rules of the corporation while at site.

3.It is further agreed by the contractor that :-

a)The contractor and the corporation shall maintain strict discipline and maintain good order among their respective employees and shall abide by and conform to all rules and regulations promulgated by the corporation. Should the corporation feel that the conduct of any of the contractor‟s personnel is against corporation‟s interest, the corporation shall notify the contractors in writing the reasons for requesting removal of such contractor‟s personnel. The contractor shall remove and replace such employees at contractor‟s expense within 24 hours from the time of the notice by the corporation in this regard. The corporation‟s decision on the performance or behavior of an individual shall be final and shall be binding on the contractor.

b)In the event of the corporation finds that the workmen/personnel deployed by the contractor are not of the required caliber or otherwise not satisfactory, owing to any reason of which the corporation shall be sole judge. The corporation will be entitled to reject such jobs, cancel the contract at the risk and cost of the contractor reserving always to itself the right to forfeit the security deposit furnished by the contractor for the fulfillment of the contract. If the services rendered by the contractor are found unsatisfactory, the corporation reserves the right to terminate the contract without notice and in such case the security deposit will be forfeited.

c) The contractors personnel are liable for physical check up by competent authority as decided by the corporation from time to time.

d)The contractors shall provide documentary evidence in respect of qualifications, age, and experience of the personnel he indents to post at the corporation against this contract. The corporation reserves the right to accept/reject any person being sent for the corporation‟s approval.

ADDITIONAL CONTRACT CONDITIONS-II

1. COMMON CONDITIONS :-

1.1 Extra charges for any item of work shall not be allowed unless the work to which it relates is clearly without the spirits & meaning of the specification or unless such work ordered in writing by the Engineer-in-charge & are claimed for in the specified manner before the work is taken in hand.

1.2 The contractor shall be his own expenses make all necessary provisions for housing, water supply & sanitary arrangements for his employees & shall pay directly to the concerned authorities, all rates, taxes, royalties and other charges to the Health Department of the concerned Municipality.

2. MATERIALS:-

2.1 Unless otherwise specifically provided for whether in the item or in the Schedule “A” or in specifications for supply of the materials by the Department, all item in the tender are inclusive of the cost of all material as are not stipulated to be supplied by department as per Schedule “A” shall be provided by the contractor of approved type and make.

2.2 All the materials used in the work shall be of quality as per samples got previously approved and any materials rejected shall be removed by the contractor from the site of work within 24 hours failing which the same will be got removed by the department at his cost.

2.3 The contractor shall have to use departmental material supplied at the rate mentioned in Schedule “A”. The materials so supplied shall be used for the work in questions only. The contractor shall maintain a regular account of the receipt & the use of such materials to the satisfaction of the Engineer-in-charge and submit monthly statement thereof. He shall keep the account of such material in suitable books which will be available for the inspection to the Engineer-in-charge whenever, demanded. The contractor will be responsible for a proper handling and safe custody of all materials delivered to him by the department.

He shall make a proper and economic use of all materials supplied by the department whether free of cost or on payment for utilization in the execution of the contract.

All the surplus materials from those supplied by the department to the contractor free of charges will be returned to the department at places as directed and if any shortage are noticed of materials or found in damaged or unserviceable condition the cost thereof as fixed by the Executive Engineer will be recovered from the contractor. All the surplus materials from those supplied by department on payment shall neither be disposed of nor removed by the contractor obtaining permission of the department to that effect as the department shall have the option to take over of such surplus materials at the issue rates.

2.4 The contractor shall give at the time of taking delivery receipts for all the materials, pipes and specials etc. issued to him when those issued free of cost to the safeguard specially against wrong debit being raised by the contractor.

2.5 The contractor should not be entitled to claim compensation from the department on account of delay by the department in supply of materials entered in Schedule “A”.

In case of such delay the department shall however, grant such extension of time limit for the completion of work as may appear reasonable to the Engineer-in-charge & his decision shall be final and shall be accepted by the contractor.

3. WORKS:-

The contractor shall have no claim for compensation on account of reasonable variation in the depth of foundations for trenches.

3.1 Any item not covered in the Schedule “B” of this tender but required to be executed shall be carried out by the contractor at the divisional schedule of rates or the rate approved by the competent authority if the item are not found included in the schedule.

3.2 The layout of all the work will be marked by the contractor on site with permanent pillars as directed. The necessary levels will be given by the department. The contractor must however provide the necessary labour and materials for making out the ground and keep all the references levels and lining pegs sealed in cement concrete and execute the work in accordance with those levels for which he will be responsible through out the whole period of the contract.

4. CARTING:-

4.1 The contractor shall provide his mode and conveyance for carrying for pipes, specials and other sundry materials required for the execution of the work.

4.2 The contractor shall provide diversion to the affected existing road, if required, as directed by the Engineer-in-charge at his own cost.

5. TIME LIMIT:-

The time limit for the completion of work covered shall be 12 calendar months from the date of work order inclusive of Monsoon.

6. GENERAL:-

6.1 The contractor shall be deemed to be thoroughly conversant with the local conditions such as the availability of all construction materials, skilled and unskilled labour and to have based his rates accordingly for this work. He shall also be deemed to have carefully studied all the specifications & drawings and followed them before the submission of the tender.

6.2 In case of any discrepancy between the type of working drawings on one hand and the working of the corresponding items and specifications, thereof, as per the contract, the letter will be deciding for the purpose of actual execution of items. However the Executive Engineer‟s decision should be obtained in the matter before hand, for a composite item any higher specification are to be adopted for any component as a result than specified in the item and specifications therefore, extra rate will be payable. No major deviation involving substantial extra outlay will be made without the prior approval of the superintending Engineer.

CEMENT VARIATION CLAUSE

The rates in Schedule are based on the above stated rate of cement consumption. The

permissible variation in the cement consumption for cement concrete item shall be as

given in Standard Cement Consumption Statement. For the item permissible variation

should be 5% of figures given above. If the actual consumption of any work is beyond

these limits, reduced rates shall be paid for any item of work on which less cement has

been used below limit of 5%.

The rate of recoveries from the Contractor should be at Rs. 12,000.00 per tonne or the

prevailing market rate on the date of completion of work, whichever is higher per tone of

cement saved by him.

For cement saved due to adoption of poorer mix when so specifically directed by the

Department, a reduced rate will be paid. For excess / less cement used on work as per

cement variation clause the Standard consumption for cement shall be as per table

given above.

SPECIAL NOTE FOR CEMENT 1) The cement should be brought by the contractor. The cement should be of OPC

43-Grade / 53 Grade and shall be as per ISI 8112-1989. The cement procured

should be of standard make of approved manufacturers like Birla, L & T,

Ultratech, Ambuja, Vasavdatta or approved make by Engineer-In-Charge before

procurement. The sample of cement from each consignment should be tested

before use in work. It is responsibility of the contractor to give test certificate

from Govt. laboratories or approved laboratories. The payment for the cement

will be made through the items involving cement. No direct payment will be

made for procurement of cement. However, secured advance may be

considered by the Executive Engineer, after executing necessary indemnity

bonds as per rules.

2) Contractor should supply cement in bulk as per the necessity of the work

suitable for two month‟s consumption only. Department will test cement at

random. If the test results are unsatisfactory the entire cement brought by the

contractor will be rejected and contractor will have to procure fresh cement.

1) The cement brought by the contractor should be stored in a Pukka godown with

double locking arrangement. One set of keys should be given to the Engineer-

In-Charge of the work. Record of the cement consumption shall be maintained

by the contractor and it should be got approved daily by the Engineer-In-Charge.

4) Cement shall be got tested by collecting random samples from stock from Govt.

laboratory or any Engineering College, Polytechnic nearby. No cement should

be used unless satisfactory test results are obtained.

5) This clause supersedes all other clauses as far as supply of cement is

concerned. If any where in the tender papers cement supply by department is

mentioned, the same will stand deleted. No other claims regarding increase in

taxes, material price will be entertained.

QUALITY AUDIT CLAUSE

The MIDC shall conduct the Quality Audit of this project when work is

nearly 80% complete, considering the value of work. MIDC will nominate it‟s representative to conduct the Quality Audit. The Quality Audit shall be done on the

basis of verification of records in the office and also by physical inspection of site of

work. It is obligatory on the part of the contractor to co-operate with the Quality Auditor

of MIDC. The contractor shall present before the Quality Auditor, all relevant records

and reports, provide free access to audit the site of work and also provide all labour

and equipment to assist the auditor to carry out physical inspection of site, without any

extra cost / claim.

The contractor has to make all necessary rectifications, alteration to the

work executed, as suggested by the Quality Auditor without extra cost / claim. If the

contractor fails to do so or does not intend to do so, the amount payable from the bills

and other dues payable to the contractor will be withheld and contractor shall be liable

to pay compensation as directed by the competent authority.

CLAUSE FOR RECOVERY OF ROYALTY CHARGES

Clause regarding recovery of royalty charges through the bills of contractor towards Minor Minerals such as murum, excavation,

sand, metal etc work done by the contractor

1) It shall be noted by the contractor that the amount of royalty charges towards the

minor minerals (Excavation, murum, metal, sand etc) consumed/used by the

contractor for the work will be deducted from his bills and will be paid to the

concerned Revenue Dept. by MIDC.

2) The contractors shall obtain above types of minor minerals from Govt. approved

quarries or from the private land after obtaining legal permission from the concerned

authorities. However, in case the contractor brings the material from unauthorized

quarries or in illegal manner, he shall be fully responsible for any legal action taken

by the Revenue or any Govt authorities against him for such unathorised or illegal

act, even though the royalty charges are recovered from his bills and paid to the

Revenue Dept. He shall also indemnify MIDC officers from any legal action so taken

by the Govt authorities for default on his part.

3) The contractor shall give an undertaking on court fee stamp of Rs.100/- for

indemnifying MIDC officers from any legal action taken by Govt. as detailed above.

DEFECT LIABILITY AND MAINTENANCE GUARANTEE CLAUSE

1) The contractor will have to give guarantee on stamp paper worth Rs. 100/- for the

item no 5,6,7,10,11,13,14,15,16,17,19 executed under the agreement for a

period of Six Months from the date of completion of work. During this period

of Six Months the contractor will have to execute all repairs / damages caused

due to any reason for the work executed by him under the agreement without

charging any extra cost.

2) The list of defect to be observed for defect liability period:

a) Cement concrete: Cracks developed. 3) The contractor will have to carry out repairing work within 8 days from the date

concerned authority inform the damages / repairs to the contractor. 4) During the guarantee period, if the company, contractor‟s, firms gets dissolved or

some new partners are introduced then the responsibility of the guarantee period will have to be borne by the new company / contractor‟s, firm.

5) The Security Deposit 8% paid by the agency shall be released as under.

i) Initial Security Deposit 3% paid in the form of bank guarantee shall be released alongwith final bill.

ii) The remaining 5% Security Deposit recovered in cash through R.A. bills

shall be released after the expiry of defect liability period of Six Months for items as above and only after the joint inspection of Executive Engineer and the representative of the contractor and if the work is found to be satisfactory and ensuring, the recovery of cost of any defects covered during the period.

6) If certain repairs / damages of work are neglected by the contractor, the same

shall be carried out by the department at the risk and cost of the contractor and

cost of the same will be recovered from the amount of Security Deposit.

7) Considering the guarantee demanded, the contractor is requested to thoroughly

inspect the site of work and study the site conditions before quoting for the work.

GENERAL SPECIFICATIONS FOR MATERIALS

1. MATERIALS:

A) CEMENT:- Unless specified all cement shall be Portland cement of 43 / 53 Grade

of slow setting quality and shall be in accordance with Indian Standard

Specifications revised from time to time. The brand of cement shall be approved

by the Executive Engineer and shall be tested before it is used on the work.

B) SAND:- Sand shall be clean and gritty composed of hard siliceous grains and

shall be free from clay or any organic materials. All sand shall pass through a

mesh 3 mm. If there is any trace of earthly matter, sand must be washed.

C) AGGREGATE:- The aggregate shall consist of graded broken stone, sound, hard

and durable, so as to pass through a 25 mm. mesh. The size shall not vary as

far as possible. All aggregate must be perfectly cleaned and should be washed

if necessary and free from sulphur. No lime stone shall be used.

2. CENTERING:- The term centering shall include all forms, moulds, shuttering

plates, poles, shores, strutting and uprights and all other temporary supports for

the concrete to be laid. The centering shall be of such dimensions and so

constructed as to remain rigid during the process of laying, curing, tamping and

setting of the concrete. Joints must be watertight so as to prevent the leakage of

liquid cement. Centering must be so arranged that the portion below the slab

can be removed first then sides of beams and finally those below the beams. All

faces which will come in contact with concrete in beam must be plained or

smoothened sides.

3. MIXING OF CONCRETE:- Unless otherwise stated concrete should be batched

in a mixer. Concrete shall be mixed in proportion as specified in the item or

detailed itemwise specification. If allowed in writing in case of hand mix 5 %

extra cement is to be used and the concrete must be thoroughly mixed at least

3 times in dry state, before water is added as far as possible. The mixture shall

always be brought to the same degree of wetness. A fairly wet mixture must be

used, particularly, for beams. Concrete must be mixed on water tight platforms,

sufficiently large to allow two heaps being mixed simultaneously. The crushing

strength of concrete at 28 days shall be as per IS:456 for various grades of

concrete. If the work tests fail to show the required strength then necessary

deduction shall be made in the rate for that quantity proportionately.

WATER CEMENT RATION:- The proportion of water should be as per IS:456-

1957, Clause – 7.

4. PLACING OF CONCRETE:- Before any concrete is put in position centering

must be well watered to prevent it sucking up too much moisture from the

concrete. The Concrete shall be placed in its final position in work as soon as

possible after mixing and care must be taken to place it gently in position and not

to drop it from a height. It must be well tamped and vibrated with mechanical

vibrator till the cement creams the surface, care being taken to see that steel

reinforcement is thoroughly surrounded by the liquid concrete and that no voids

or cavities are left. The concrete shall be continuously watered and kept damp

for 21 days after placing in position.

5. STOPPING AND RECOMMENCING WORK:- As far as possible when

concreting in once commenced, it must be carried out without stoppage until the

jobs is completed. If however stopping of concrete placing is unavoidable the

break should be at right angles to direction of the span. On no account must a

joint be made towards the end of the beam of slab. Wherever a stop has been

made in laying the concrete the surface of the existing concrete must be

carefully brushed with a stiff brush before recommencing the work to remove

loose particles and dust a thick grout of neat cement just to poured over the

edge before the new concrete is tamped against it. Where the concrete work

should be stopped shall be decided in advance by the Executive Engineer and

shown properly on plan.

6. STRIKING CENTERING:- Under the ordinary circumstances the centering of

the sides of beams and under the slab may be removed as per following

conditions.

a) Vertical sides of slabs, beams and columns. : 48 hours.

b) Bottom of slabs below 4.6 M. span. : 7 days.

c) Bottom of slabs above 4.6 M. span. : 14 days.

b) Bottom of beams upto 6.6 M. span

And arch bottom upto 20 ft. span. : 18 days.

e)Bottom of beams over 6.6 M. span. : 21 days.

For paid hardening cement 5/7 th. Of the above period will be sufficient in all

cases except vertical sides of slabs, beams and columns which should be

retained atleast for 24 hrs.

7. FINISH OF FLOOR AND ROOFS:- The soffits of all slabs and soffit and sides of

all beams shall be finished with neeru plaster and whitewash of two coats.

Plaster and whitewash shall be paid under relevant item.

8. GENERAL WORKMANSHIP:- This should comply with Cl. No. 7 of IS:250-1965.

SPECIAL CONDITION

The contractor is hereby requested to note scrupulously that the responsibility of careful

storage and safe custody of any type of material supplied by him a worksite vide the

scheduled items for supply of material in item Schedule „B‟, solely rests with him upto

the satisfactory laying, jointing, erecting or fixing of materials or whatever may be the

use as per job requirements, upto the completing / commissioning of the work as a

whole. Contractor is to specially note that all materials required for a job is to be

supplied and used at work site only and not a departmental store.

The contractor will be held responsible for any structural damage and theft of the

materials supplied by him at work site upto the completion of job and commissioning of

the job. Any loss due to damage / theft of material supplied etc. will be made good by

recovering the amount to that extent from contractors next bills or from any dues

payable to him by MIDC or as a Revenue Recovery.

SPECIAL TERMS AND CONDITIONS

1) The Contractor should make his own arrangement to allow weekly off / Holiday /

Public Holiday to the personnel engaged but alternative arrangement must be

made so that the Contractor‟s personnel can be available round the clock without affecting the operations.

2) The contract will be valid for the period of 12 months from the date of the

contract made effective by M.I.D.C. or upto a period decided by Engineer-In-

Charge whichever is earlier.

3) M.I.D.C. will have right to terminate the contract at any time without assigning

any reasons by giving 15 days notice in normal situation and in extra ordinary

emergency situation within 24 hours to the Contractor without assuming any

liability whatsoever.

4) Award of contract against the agreement does not entitle the Contractor the

exclusive right to carry out M.I.D.C. job covered under this contract.

5) The Contractor‟s personnel who will be posted to provide services as mentioned in agreement shall have following qualifications and experience and capacity of

performing the duties specified.

5.1 Pump operator who are required to carry day to day operations of pumps,

L.T. Panell, periodical records of functions involved, etc. should be S.S.C.

and have passed Wireman Certificate Examination.

5.2 A Fitter who will be looking after day to day work such as attending minor

leakage of line, Jobs connected with routine operation of sluice valves,

Air Valves, etc. shall preferably have two years minimum experience in

similar kind of work with reputed company.

6) WORKING DAY AND HOURS

6.1 The services and the personnel shall be required on (seven) days a week

and will be required to work on a morning, afternoon and night shifts

basis depending on the working of shift.

6.2 Insurance cover of all contract personnel during commuting and working

at sites will be the responsibility of Contractor and M.I.D.C. shall not

entertain any claim in this regard.

7) GENERAL TERMS AND CONDITIONS

7.1 The services are required at M.I.D.C.‟s following site :

I) Along Raw water rising main, Pure water pumping main, Pure

water Gravity main laid for M/s RCF and M/s IPCL.

7.2 The job requirement will vary from time to time depending on M.I.D.C.‟s requirements.

7.3 The Contractor should make his own arrangement for his personnel‟s food, tea, transportation and accommodation, etc. at the sites, M.I.D.C.

has no concern in this regard.

7.4 The Contractor shall provide proper identification card to technical,

operational, supervisory, skilled, semiskilled and unskilled personnel to

be deputed by him for the work, duly signed by the Contractor or an

authorised persons on behalf of the Contractor.

7.5 Due to disruption of public transport, if contract personnel are not relieved

in time, M.I.D.C.‟s will not be held responsible and the contract personnel will have to continue on duly till a reliever reaches the site.

7.6 The personnel deputed by the Contractor for the job should also meet the

following requirement.

I) He should be medically fit to work at sites.

II) He should posses good conduct and discipline.

7.7 The personnels to be deputed by the Contractor shall observe security

and rules of M.I.D.C. while at sites.

8) IDEMINITY

8.1 The Contractor will be responsible for any loss or damage to M.I.D.C.

due to negligence etc. of the persons supplied by him. He shall

indemnify against any such case.

9) If the services rendered by the Contractor are found unsatisfactory, M.I.D.C. can

terminate the contract without giving any notice. The security deposit shall be

forfeited in such case.

10) Decision at Superintending Engineer on the dispute arising in the contract is

binding and final.

11) The Contractor shall bear all taxes, statutory. Contributions, including but not

limited to corporate and personnel taxes that may be levied on in and its

personnel under the Income Tax Act 1961 and Companies (profit) surtax Act,

1961 and / or any amendment thereof. It shall be the responsibility of the

Contractor to submit returns and other relevant documents to the tax authorities

in time and in case any penalty interest is levied either on the Contractor‟s personnel or on the M.I.D.C. because of the Contractor‟s failure to submit the returns / documents in time the same shall be payable by the Contractor. If it is

so required by the applicable laws at the time of making the payments, M.I.D.C.

shall have the right to deduct any amount towards such taxes from amounts due

to the Contractors and paid to the tax authorities directly.

12) The Contractor shall be solely and exclusively responsible for engaging or

employing persons for the execution of the contract. All employees engaged by

the Contractor shall be on his pay roll and be paid by him. The M.I.D.C., will not

take any liability whatsoever concerning the employees of the Contractor.

13) The Contractor shall comply, observe and maintain all the provisions of labour

laws or Regulations and any other laws applicable to the area with the

performance of the work including that of minimum wages, Act 1948, the

Industrial Disputes Acts 1947, the shop and Establishments Act 1948, the

Employees State Insurance ACT, 1948 the Employee‟s Provident Fund Act 1952, the payment of Gratuity Act 1948, the payment of Bonus Act 1965 the

workmen‟s compensation Act 1923, the Equal Reminerations Act 1975, and other industrial and labour laws as may be deemed necessary in this regard.

The Contractor shall be directly and independently responsible and liable for any

disputes arising between him and his employees. The Contractor shall at his

own expenses carry and maintain such insurance with reputed Insurance

Company / Companies as may be required under the law & regulations.

INSURANCE CLAUSE OF CONTRACT WORKS

The contractor shall take out necessary Insurance Policy / Policies so as to

provide adequate insurance cover for execution of the awarded contract work

for total contract value and complete contract period from the “Directorate of

Insurance, Maharashtra State, Mumbai” only. Its postal address for

correspondence is “264,MHADA, 1st Floor, Opp. Kalanagar, Bandra (E),

Mumbai - 400051. (Tel. No, 26438690 / 26438746 and Fax No. 26438461).

Similarly, all workmen appointed to complete the contract work are required to

be insured under workmen‟s Compensation Insurance Policy. Insurance policy

/ policies taken out from any other company will not be accepted. If any

contractors have effected insurance with any Insurance Company, the same

will not be accepted and the amount of premium calculated by the Directorate

of Insurance will be recovered directly from the amount payable to the

contractor for the executed contract work.

GENERAL SPECIFICATION AND ADDL. CONTRACT CONDITION

1. The contractor shall provide adequate experienced persons / services as specified category at different location for the works of maintenance in the direction of engineer in charge .

2. Orders issued by department from time to time shall be binding on the contractor.

3. It will be the contractors responsibility to investigate specifications thoroughly so as to arrive at the rates quoted in the tender.

4. It shall be the responsibility of the contractor to see that the services are made available immediately in case of requirement. If such services are not made available within given time the work shall be got executed by the department at the risk and cost of the agency.

5. If the labourer does not attend the work the deduction shall be as per prevailing labour rates or as per the circular of MIDC.

6. MATERIALS: -

6.1 MIDC shall supply the materials as per schedule A, if and when required. The material so supplied shall be used for work in question only. The contractor shall maintain regular account of the receipts, the use of such materials to the satisfaction of the Engineer-in-charge and submit monthly statement there of. He shall keep the account of such materials in suitable books, which would be available for inspection to the Engineer-in-charge, whenever demanded. The contractor will be responsible for proper handling and safe custody of all materials delivered to him by the department.

6.2 He shall make proper and economic use of all materials supplied by the department whether free of cost or on payment for utilization in the execution of the contract.

6.3 All the surplus materials from those supplied by the Department to the contractor free of charge will be returned to the Department and delivered at places as directed and if any shortages are noticed in the materials or found in damaged or unserviceable condition, the cost there of as fixed by the Deputy Engineer will be recovered from the Contractor. All the surplus materials from those supplied by Department on payment shall neither be disposed off nor removed by the contractor without obtaining written permission of the Department to that effect as the Department shall have the option to take over such surplus materials at the issue rates.

6.4 The contractor shall give at the time of taking delivery, receipts for all materials, pipes and specials etc. issued to him when those are issued free of cost to safe guard specially against wrong debit being raised by the contractor.

7. WORKS: -

7.1 The contractor shall not claim for compensation on account of reasonable variation in the depth of foundation or trenches.

8. GENERAL: -

8.1. The contractor shall make his own arrangement for water supply to the laborers for drinking purpose.

Terms and Conditions for the reimbursement of taxes/duties

While submitting the tender, the contractor shall consider

prevailing taxes and duties on the date of submission. In case there is

statutory increase in the taxes/duties, the contractor shall submit

documentary evidence for the payment of the same. On verification of

the documents, the reimbursement will be made if there is increase. In

case there is reduction in the statutory taxes, duties, deduction will be

effected. It may also be noted that, this clause is not applicable if there

is increase in the octroi during execution of the work.

Special Contract conditions

1. Location: -The services are to be provided along pipe line as per the

direction of Engineer in charge.

2. Authorized Representative: - The Contractor shall depute authorized

representative to monitor the man powers, at least once in a day, to take the

instructions, from engineer in-charge.

3. Disputes if any :- If any disputes are found with man power, those will be

informed to authorized representative. He shall co-ordinate the issues with

Staff and shall see that the man power is working properly.

4. Right to discontinue service :- The Executive Engineer has right to remove

or reduce any man power by giving 7 days notice in writing in case of-

i) The man power provided is in efficient, not able to understand the

work, creating any nuisance, has committed any misconduct,

misbehavior, finds any reasonable cause, discontinuation,

irregular in duties etc.

5. Quantum of Services :–

i) The quantum of Services mentioned is indicative and may either

increase or decrease. The Contractor shall have no claim for

additional rate for increase or decreased requirement of Services.

ii) Considering the work load, additional man power may found

necessary, in such case, the additional man power shall be

provided after, issuing the letter from the Executive Engineer.

Within 15 days.

6. Leave period for man power:-

i) If any manpower is taking leave more than a day, the same shall

be informed through authorized representative. In such case, the

Contractor shall arrange for the substitute of equal qualification.

7. Taxes, duties, Insurance to be paid by Contractor: - All the taxes duties,

insurance, transport expenses etc. towards supply of manpower shall be

paid by the Contractor. MIDC shall not take any responsibility and / or any

liability on any account and in any way.

8. Confidentiality :-

The Contractor, his authorized representative, and the manpower provided

should not disclose any proprietary, confidential information relating to the

project, Services, Office work and Operations to any other outsider. It found

so the same will be viewed serious, and will be liable for discontinuation.

9. The personnel appointed by Contractor shall make proper & careful use of supplied material etc.

10. It shall be the responsibility of the Contractor to pay the monthly salary to the

personnel on or before 5th day of Every month, irrespectively of Payment

from MIDC.

11. MIDC will not take any responsibility & liability of any personnel on any account.

12. No price escalation payable.

CLAUSE FOR RECOVERY OF LABOUR CESS

The Govt.of Maharashtra vide its decision dated.17/06/2010 has decided to

recover Labour cess on all the construction works undertaken by Govt. Public sector

undertaking and Municipal Corporation, Municipal Council, Gram Panchyat etc. The

contractors are therefore requested to note that labour cess at 1% of the cost of

construction (excluding land cost) arrived at after deducting amount of compensation if

any paid to the workers or their relatives under workers compensation Act 1923 will be

recovered from them. The recovery of labour cess at 1% shall be made from the

payment due for each bill to be paid to the contractor.

THIRD PARTY INSPECTION

Material such as all types of pipes (all sizes) R.C.C./ R.S.C./ M.S./

D.I./ C.I./ A.C./HDPE/ PVC/ GRP and other, all type of valves (of all sizes), any

materials as perrequirements which are supplied by the contractor under this contract

are subject to third party inspection. The charges for third party inspection shall be

0.25% on the actual cost of materials, excluding excise and freight of materials. The

charges for such inspection shall be paid by the contractor. All the arrangements for

inspection i.e. measuring tools, testing equipments and tools, labour required for

handling materials during testing etc., shall be made available / arranged by the

manufacturer/ Vendor / contractor in their premises at their own costs. If any particular

testing facility is not available at the premises / location of Factory, then the test shall be

arranged by the factory owner / Vendor at his own cost at other locations / test

laboratory. All expenses in this regards shall also have to be borne by the manufacturer

/ vendor / contractor only.

If the material inspected fails during test on no fault of the inspection

agency, fees are payable to the inspecting agency for the said inspection and for any

further reinspection of the same material.

Third party inspection shall be done from one of the following

agencies. The name of the agency for third party inspection shall be informed by

Engineer-in-charge.

b. M/s. Iteng Engineering Pvt., Ltd., Mumbai-

c. M/s. Wapcos Ltd., Kalayan (W) ,

If, it is subsequently observed that there are defect in the quality of

material, the agency shall replace the material without any extra cost.

In addition to third party inspection, the Engineer-in-charge or his

representative may conduct inspection intermittently.

Third Party Inspection Report :- The third party inspection report merely in the

certificate from stating that pipes/valves/specials or any other material inspected are

found satisfactory will not be accepted, but it should be in the form of detailed report

stating the parameters checked and observations made with comments of the

Inspecting Officer in accordance with the respective IS specifications/detailed item wise

specifications / as per Tender Notice.

CLAUSE FOR RECOVERY OF ADDITONAL SECURITY DEPOSIT A) Clause for Recovery of Additional Security Deposit in case tenders ACCEPTED

15% below then the additional security deposit shall be recovered in the form of cash at

the time of execution of agreement.

DETAILED ITEMWISE SPECIFICATION.

NAME OF WORK : M&R to W/S/S for Pen-Alibag Region & Nagothane

Industrial Area.... Day to day Maintenance of 1300 mm dia M.S. pipelines laid for M/s RCF Thal & M/s IPCL Nagothane.

Item No.1:- Daily patrolling and inspecting of 1300 mm dia M.S. water supply pipelines including attending minor leakages, air valves, expansion joints, valves etc with all labour including proper operation of valves along 1300 mm dia RWRM, PWPM & PWGM of water supply pipelines to M/S RCF & IPCL etc.complete.

Specification:- The item includes:

1) The agency shall have to engage skilled/unskilled labours for inspection and patrolling of pipe lines laid for M/s RCF and M/s IPCL as per the direction of engineer in charge.

2) Every day, the agency shall have to engage 5 MT capacity tempo equivalent to utility vehicle with fuel, driver, operator, welding machine with fuel, with fuel, gas cylinder, welding rods etc. for attending minor leakages.

3) The agency shall have to engage labour, material, machineries as mentioned earlier at all the locations as per direction of engineer in charge, where the major/minor leakage is observed.

4) The agency shall have to monitor and maintain daily register of the various levels viz. raw water level at jack well, number of pumps in operation at raw and pure water works, pure water level in sump at WTP poynad, welshet , Jalpada etc. and same shall be report to engineer in charge in the morning every day.

5) The agency shall have to keep all the valves like A.V., S.V. in operation. Agency shall have to carry out the oiling, greasing of said valves for easy operation of said valves.

6) MIDC will issue the material which is on stock for the maintenance of the said pipe lines.

7) The agency shall have carry out oiling and greasing of the A.V., S.V., Ex. Jt., Nut bolts etc. at his own risk and cost.

8) The agency shall have to attend the minor leakage observed during patrolling.

9) The agency shall have to take safety precautions during execution of work. MIDC will not be responsible for any mishaps/accident happened on site to labours.

Mode of M‟ment and Payment:- The tender rate shall be per Job basis.

1) The agency shall have to engage 5 MT capacity tempo equivalent to utility vehicle with fuel, driver, operator, welding machine with fuel, dewatering set with fuel, gas cylinder, welding rods etc. for attending breakdown / shutdown on water supply line laid for M/s RCF and M/s IPCL.

2) It is the responsibility of the contractor to attend all leakages if observed at multiple locations by engaging additional labour, material, machineries etc. and complete the work as early as possible. Any claim regarding additional engagement of labour, machineries, material will not be entertained by MIDC.

3) The agency shall keep the machineries, labours, materials in ready position so that the work of attending shut down/ break down can get started immediately without causing extra time.

4) MIDC will issue material at free of cost if available on stock.

5) It is the responsibility of the agency to keep the material issued by MIDC in good condition.

The item includes all labour, material, all taxes, duties, octroi, loading, unloading, transportation etc.

Mode of Measurement and Payment:- The tender rate shall be per Job basis.

Item No.4:- Dismantling and removing lime or plain cement concrete including stacking the spoils as directed with all leads, & lifts etc. complete.

b) Upto M - 20 Grade

Specification:- The work shall be done as per item wording and as per the direction of engineer in charge. The agency shall have to take due care while dismantling the concrete. The agency shall be responsible for any damage occurred during execution of work and same shall be rectify at his own cost and risk. No extra charges will be paid by MIDC and the claim for the same will not be entertained.

Mode of Measurement and Payment:- The tender rate shall be per Cum basis.

c) In 1:2:4 proportion.

5.1 General : The item pertains to providing and laying in position Plain Cement Concrete (PCC) of specified proportion. The work includes providing all material, mixing, compacting, curing, shuttering, dewatering etc. complete up to lift of ± 5 m.

5.2 Material:

1. Cement : Ordinary Portland Cement (OPC) as specified at item Gen/C/0.2.1 of MIDC specification book.

2. Fine Aggregate (Sand) : specifications shall conform to item Gen/C/0.2.2 of MIDC specification book.

3. Coarse Aggregate : specifications shall conform to item Gen/C/0.2.3 of MIDC specification book. Grading and maximum size of coarse aggregate shall be as specified in the drawing. Normally the maximum size should not be more than 40 mm or 25 % of the minimum dimension of the member, whichever is less.

4. Water : specifications shall conform to item Gen/C/0.2.4 of MIDC specification book.

5.3 Mix Proportion and Mixing : The mix proportion as specified on the drawing, separately for each component shall be provided. For detailed specifications refer to item No.Gen/C/0.5. For mixing without mechanical mixer, prior permission from the Engineer-in-charge shall be obtained. Specifications for mixing shall conform to item Gen/C/0.7.

5.4 Formwork and Scaffolding : Formwork shall be provided for giving the desired shape and sizes for the PCC as per the drawings. The specifications shall conform to item Gen/C/0.19.7 of MIDC specification book. The striping time also shall be as specified in the item. The scaffolding shall be normally provided of steel tubes. The specifications for scaffolding also shall conform to item Gen/C/0.19.8 of MIDC specification book.

5.5 Transportation, Placing and Compaction : Specifications shall conform to item Gen/C/0.8.

5.6 Field Tests : The appropriate field tests as directed by the Engineer-in-charge shall be carried out as explained in item Gen/C/0.15 of MIDC specification book.

5.7 Inspection & Testing of Structure : As per the contract conditions inspection & testing of a structure shall be carried out in accordance with item Gen/C/0.16 of MIDC specification book

5.8 Finishing of Concrete : The finishing of concrete surface shall be as per item Gen/C/0.17 of MIDC specification book.

5.9 Special Features : Special requirements such as Architectural shapes/ finishes, Expansion joints, Construction joints, Water stops, grouting, etc. shall be provided as shown on drawing/s and as directed by Engineer in Charge. For specifications for these the appropriate clauses of item Gen/C/0 of MIDC specification book shall be referred.

5.10 Curing : As per item Gen/C/0.14 of MIDC specification book.

5.11 Item to Include : This item for providing Plain Cement Concrete (PCC) with specified mix proportion at specified locations with initial lift of + 5 m above or below ground level includes all ingredients of concrete i.e. water, cement, fine and coarse aggregates, all transportation, dewatering, tools and plants, all taxes, royalties, labour, formwork, testing, curing etc. complete.

Mode of Measurement and Payment : The measurements of the concrete laid shall be taken on volumetric basis in cum. The openings shall be deducted. The unit rate of concrete per cum of specified proportion includes all the items as explained in Gen/C/0.25 of MIDC specification book.

Item No.6:- Providing and laying in position Cement Concrete for RCC work using granite/black trap metal including mixing in mechanically operated mixers, compacting by mechanical or manual means as may be required and directed by Engineer-In-Charge, including steel or plywood shuttering, centring, formwork, dewatering, for all elements in foundation, plinths of building works where reinforced cement concrete is proposed to be used upto + 5 m from the average ground level including all labour and material complete, finishing the surface with 1:3 cement mortar.

c) In 1:1.5:3 proportion by volume

6.1 General : The item pertains to providing and laying in position Cement Concrete of specified proportion or by in design mix grade for Reinforced concrete works in foundation or plinth. The work includes providing all material, mixing, compacting, curing, shuttering, dewatering, etc. complete upto lift of ± 5 m. Providing the reinforcement steel shall be carried out by item No. Gen/C/0.2.5 of MIDC specification book.

6.2 Material : As per item Gen/C/0.2 of MIDC specification book.

6.3 Mix Proportion and Mixing : As per item Gen/C/0.5 of MIDC specification book.

For providing Concrete of specified grade by designing the mix of concrete, please refer to specifications as per item Gen/C/0.4 and 0.5. The design mix shall be got done from the approved laboratories and got approved by the Engineer-in-charge.

6.4 Formwork and Scaffolding : As per item Gen/C/0.19 of MIDC specification book.

6.5 Transportation, Placing and Compaction : Specifications shall conform to item Gen/C/0.8 of MIDC specification book.

6.11 Item to Include : This item for providing Cement Concrete with specified mix proportion or specified grade, at specified locations with initial lift of ± 5 m above or below ground level includes all ingredients of concrete i.e. water, cement, fine and coarse aggregates, all transportation, dewatering, tools and plants, all taxes, loyalties, labour, formwork, testing, curing etc. complete. The provision of reinforcement steel is not included in this item.

Mode of Measurement and Payment: The measurements of the concrete laid shall be taken on volumetric basis in cum. The openings shall be deducted. The unit rate of concrete per cum of specified proportion includes all the items.

b) Tor Steel Bars

7.1 General : The item pertains to providing and fixing in position reinforcement of all dia for RCC piles, pile caps, footings, foundations, slabs, columns, beams, canopies, staircase, newels, chajjas, lintels pardis, copings, fins, arches etc..

7.2 Material : The reinforcement shall be of Mild Steel or Tor Steel bars as indicated on the drawings. The material shall conform to item Gen/C/0.2.5 of MIDC specification book.

7.3 Construction : Contractor shall provide the reinforcement bars of tor steel or mild steel of specified dia. at locations in numbers or at spacings, as per detailed designs, drawings and schedules including cutting, bending, hooking the bars, binding with wires or tack welding and supporting as required at all locations and height. The work shall be carried out as specified in Gen/C/0.2.5 of MIDC specification book.

The reinforcement shall be got checked by the Engineer-in-charge or his representative before concreting. The contractor shall provide and fix in position any additional reinforcement, if directed, in addition to the reinforcement shown on drawing.

7.4 Item to Include : The item includes all the material of reinforcement bars, binding wires, welding rods and labour and tools and equipment for cutting, bending welding, testing charges etc. complete as per drawings and as directed by the Engineer-in-charge.

7.5 Mode of Measurement and Payment : The measurement of the reinforcement bars shall be taken in metric tons. The measurement shall be taken according to item Gen/C/0.25.2 of MIDC specification book.

8.2 Material : Required for fabrication of pipes, bends and specials etc. The steel plates of required size and thickness shall be procured at contractor‟s cost conforming to BIS - 3589-2001 (or latest revision) of grade FE-410. Where as the other structural steel such as channels, angles, nuts bolts etc. shall confirm to IS : 2062-1992 (or latest revision) of grade FE-410.

8.3 Fabrication of Pipes : Pipes shall be fabricated from the M.S. Plates and other structural components etc. shall be fabricated from steel plates and other steel material procured by the Contractors as mentioned in Clause 2.2. The welded joints shall be tested in accordance with the procedure laid down in I.S. 3600 (Part I) : 1985. Minimum length of pipe shall be 5.40 metre to 7.50 metre.

8.3.1 Cutting Plates to Sizes :

The Contractors shall procure the plates in such a length so as to have minimum wastage and make the pipes only with one longitudinal joint. Before cutting, all the edges of the plate shall be cleaned by brushing/grinding on both the sides.

The plates shall be cut on all four sides to the exact dimensions and shape required, by a suitable plate cutting machine such as Oxy-acetylene cutting machine or a guillotine. Plates shall be cut accurately to the required length with a tolerance of not more than plus or minus 3 mm in length and width. The plates shall be given a bevel at the edges wherever necessary, depending upon the type of welding machine to be used by the contractors. The ends of the finished pipe in the factory shall necessarily have bevel edge or V edge with or without shoulder cut/root face to facilitate hand-welding in the field. As field welding is to be carried out from inside in the case of bigger diameter pipes i.e. 1200 mm (48”) dia and above, the bevel for them shall usually be from the inside. For pipes of smaller diameters, field welding has to be done from outside and the edges shall as a rule have bevels to suit welding from outside. The Engineer may at his discretion, make changes, in this respect and order external beveling for bigger pipes (i.e. pipes of 1200 mm dia and above) and internal beveling for smaller pipes (i.e. pipes less than 1200 mm dia). Under exceptional circumstances, either types of bevels may be required and the pipes shall be manufactured accordingly if so ordered by the Engineer. Where the automatic welding machines in the factory have sufficient penetration, the edges of the plates should have a square cut. The type of joint to be adopted in the factory shall depend upon the type of welding machines and the method of welding to be adopted. Details such as current, voltage, flux, etc. shall be decided after carrying out experimental welding and testing the samples, cut out of it. The entire cost of all such preliminary experiments shall be borne by the contractors. After the plates are cut, the edges shall be made smooth and even by polishing with an electrical or pneumatic grinder to remove all inequalities. Care shall be taken to see that the cut edges of the plate are perfectly straight. Jigs to be used for this purpose shall depend upon the type of cutting machine used. The plates cut to the required shape shall be checked for correctness before they are rolled into pipe drums. If any corrections are

required, the contractors shall do the same by re-cutting if necessary, if in doing so, there is any unnecessary wastage of plates, the same shall be borne by the contractors. If any plate or flat is found to be warped to have corrugations, the defects shall be removed by putting the plate or flat into a roller press and no extra payment for this rectification work shall be made. If, during cutting, any plates are found to be laminated, the same shall not be allowed to use. Such plates shall be stacked separately in the yard and the Contractors shall make arrangements to remove the same immediately. The contractors are not entitled to claim any compensation for handling and cutting such laminated plates. Similarly, if any badly corroded steel plates, are detected at the time of cutting, the same shall be rejected by the Engineer, and such plates should be removed immediately.

Marginal cuttings as well as left-over pieces of plates and of other steel sections shall be collected by the Contractors and stacked in the separate heap in their yard. All such scrap resulting from the work of fabrication of various items of work under this contract shall be the property of the Contractors.

No claim whatsoever against any wastage and/or scrap shall be considered.

8.3.2 Rolling of Plates :

The plates cut to the exact size as described above shall be put into a rolling machine to form a pipe of the required diameter. The contractors shall adjust the rolling machine so as to give a uniform curvature to the pipe throughout its circumference. The curvature obtained shall be checked by the contractors foreman during the process of rolling and if proper curvature is not obtained at any place including the ends the rolling operation shall be repeated at this stage or even after its longitudinal welding of the drum where directed. Heating of plates to obtain desired curvature shall not be permitted.

8.3.3 Tacking the Drums :

The rolled drums shall be kept on an assembly platform for tacking, care being taken to ensure that the tacked drums have their end faces at right angles to the axis of the pipe. While tacking the drum, the uniform gap of about 2 to 4 mm, shall be maintained, where hand welding is permitted. However, where the welding is to be done on automatic welding machine, there is not need of maintaining such a gap depending on the penetration through complete thickness of the welding required. To achieve this objective, clamp spiders, tightening rings and/or any other approved gadgets shall be used. Each such drums, before being taken to the assembly platform, shall be numbered on the inside with oil paint, stating the plate thickness as well.

8.3.4 Assembly of Drums into Pipes :

The tacked drums shall then be transported to an assembly platform where they shall be tack-welded together to form suitable pipe-lengths. Plate shall be bent in the maximum possible width to reduce the number of circumferential joints. The longitudinal joints shall be staggered at 90 deg. The drums when tacked together shall have no circumferential gap when the welding is done on automatic welding machine. But when hand welding is adopted as gap of 2 mm to 4 mm shall be maintained to obtain a good butt welded joint.

The assembly shall be truly cylindrical and without any kinks. The faces shall be at right angles to the axis of the cylinder. A suitable arrangement for testing the correctness of the face shall be provided by the Contractor at the assembly platform.

8.3.5 Full Welding of the Pipes :

The assembly as described above shall be transferred to an automatic welding machine for full welding. The circumferential as well as longitudinal joints shall be welded on this machine. hand welding shall not be permitted except for sealing runs and such other minor works at the discretion of the Engineer. The strength of the joint shall be atleast equal to that of the parent metal. The automatic welding machine shall be of approved make. The Engineer shall from time to time during the progress of work, supply working drawings or instructions specifying details of welded joints for different elements of the fabrication work.

The contractors shall use electrodes of approved make and size, the size depending on the thickness of plate and the type of joint. They shall also use standard current and arc voltage required for the machine in use with such modifications as may be found necessary after experimental welding. For this purpose, samples of welded joints shall be prepared and tested in the presence of the Engineer-in-Charge. The value once determined shall be maintained throughout the work and if any modifications are to be made, a written permission of the Engineer-in-Charge shall be obtained. In the case of thin sheets, electric arc welding may not give satisfactory results, the gas welding shall be resorted to. Gas welding shall be subject to the same Specifications and tests as those for electric welds.

In order to maintain a good standard in welding, welder‟s skill shall be tested by the contractors before they are entrusted with the job. A periodical test as regards their efficiency shall also be taken at intervals of about 6 months and those found inefficient shall be removed from the job. Those who pass the test only shall be posted on the job.

A record shall be maintained showing the names of welders and operators who have worked on each individual joint. Hand welding shall preferably be carried out by a pair of welders so that, by observing proper sequence, distortion can be avoided. A joint entrusted to a particular individual or a pair shall be as far as possible completed by them in all respects, including sealing run. No helper or other unauthorised person shall be permitted to do any welding whatsoever. In case of infringement of above, the persons shall be punished as directed by the Engineer-in-Charge.

8.3.6 Welding Joints :

(a) Electrodes :

The contractors shall use standard electrodes depending on the thickness of plate and the type of joint. They shall also use standard current and voltage required for the machine in use as per Manufacturer‟s directions. Welding electrodes shall conform to I.S.S. No.814 of 1967/1974 “Specifications for covered electrodes for metal arc welding of mild steel (second or latest revision)”. Indian made or equivalent foreign made electrodes of the required quality approved by the Engineer, shall be used wherever possible.

8.3.8 Workmanship :

All Pipes and Specials shall be manufactured out of steel plates which shall be free from any cracks, surface flaws, laminations, excessive pittings or any other defects. The pipes shall be truly cylindrical and straight in axis. The ends shall be accurately cut and shaped for field welding. The external circumference of the pipe particularly at the ends, shall not deviate from the theoretical one by more than plus or minus 5 mm for shell thickness of 12 mm and above and not more than plus or minus 3 mm for thinner plates less than 12 mm. The external circumference of pipe pieces which are to be fixed adjacent to flange adopter with fixed outer diameter shall not deviate from theoretical one by more than 1 mm. To obtain this accuracy the pipe shall be rolled several times, if

necessary, as pipe pieces should be truly cylindrical. The external longitudinal welding of this pipe shall be ground smooth in flush with surface to the satisfaction of the Engineer, for a length of 200 mm. No extra cost shall be charged by the contractors for this grinding work.

Minor repairs by welding or otherwise shall be permitted at the discretion of the Engineer, but such repairs shall be done only after obtaining the previous permission of the Engineer. Any pipe or part thereof which develops injurious defects during shop welding or other operations shall be rejected and the same will not be allowed to transport it to the site and use on the pipe laying work.

8.4 Hydraulic Test : If any sweat or leak observed after welding of joints, the agency shall have to redone the work of welding. Due care shall be taken during the work of welding joints.

8.5 After the tests the pipe shall be painted inside and outside with one coat of red oxide paint.

8.6 Storing & Stacking :

8.6.1 The pipes shall be checked by the consignee for any visible damage (such as broken edges, cracking or spalling of pipe) while unloading and shall be sorted out for reclamation. Any pipe, which shows sufficient damage used, shall be discarded.

8.6.2 Stacking : The pipes specials shall be stacked separately for each type and diameter at the location as directed. If required the stacking pile of pipes may be supported by wooden bullies.

8.7 Item to Include : providing and manufacturing at specified site or departmental store, the Mild Steel Pipes and Specials of various diameter/s as per the agreement, including manufacturing with all tools & plants, transporting, loading, unloading, stacking etc. as directed with all leads, labour, taxes and levies and octroi etc. complete.

Mode of Measurement and Payment : The providing and manufacturing of pipes and specials shall be measured by weight in kg. The defective pipes and specials shall be rejected and shall not be measured unless replaced by the new ones of acceptable standard. The payment shall be made at the rate per kg, as per agreement. The payment shall be made if the acceptable test certificate is produced along with the supply. Minimum of actual and theoretical weight will be paid. For actual weight, weighing charges shall be borne by the contractor.

Item No. 9:- Cutting M.S. Pipes & Specials by Gas Cutting of any class and thickness wherever necessary.

9.1 The item pertains to any gas cutting of Steel pipes & Specials, required to be done over and above that covered by respective items.

9.2 Cutting :

In the case of field work, it may require to cut steel plates, pipes and specials etc. in order to get an exact fit for welding. Such cutting shall be done by using gas cutting, equipment or mechanically got done along with the special jig. The cutting would be taken along the required end so as to obtain a correct fit for a welding. After cutting is made, the cut joint shall be beveled and made even and smooth by using mechanical or electrical grinder or any other means approved by the Engineer-in-charge. After cutting, the edges shall be made smooth and even by using electrical or pneumatic grinder, so as to remove all inequalities. Care shall be taken to see that, the shape of the material

cut is not defaced in any way at the time of cutting. The ends of the pipe shall have bevel edge or „V‟ edge to facilitate hand welding. As field welding is to be carried out from inside in the case of pipes of diameter 900 mm and above, the bevel shall be from outside only, the edges of pipe cut shall have bevels to suit the above.

9.3 Item to Include : Furnishing of equipment, such as gas cylenders, gas cutters with required size nozzles labour, tools, and materials required for the work mentioned in the description of item and incidental thereto in order to achieve conformity is included in this item.

Mode of Measurement & Payment : The item shall be paid per running meter of cutting length measured correct up to centimeter.

Item No 10 :- Fitting in position M.S. plate of size 1382 x 300 mm, 8 mm thick at site of work including bending fitting, in position for strengthening of 1300 mm dia M.S. pipeline with all loading, unloading, all taxes, transportation etc complete.

10.1 General:- The item pertains to fitting of 1382 mm x 300 mm wide and 8 mm thick or as directed by the engineer in charge M.S. wearing plate cut from the pipe supplied under relevant items including heating with gas burner if required as per site conditions.

10.2 Cutting :

In the case of field work, it may require to bend the steel plates in order to get an exact fit for welding. Such fitting shall be done by using gas heating, hammering or mechanically got done along with the special jig. The fitting would be taken along the true alignment of existing pipe surface as required and so as to obtain a correct fit for a welding the plate. After fitting is made, the edges shall be champhered and made even and smooth by using mechanical or electrical grinder or any other means approved by the Engineer-in-charge., so as to remove all inequalities.

10.3 Item to Include: Furnishing of equipment, such as gas cylinders, gas heaters with required size nozzles labour, tools, and materials required for the work mentioned in the description of item and incidental thereto in order to achieve conformity is included in this item.

Mode of Measurement and Payment: The item shall be paid per number of fitting of the specified plate satisfactorily as per directions of engineer-in-charge.

Item No 11 :- Providing all materials, labour, machinery etc. for electric field welding at site for M.S. Pipes & Specials as per design (excluding circumferential joint), including all materials, labour & machinery.

11.1 General : The item provides Electric Field Welding at work site for M.S. pipes and specials as per design (excluding welded circumferential joints) including all materials labour and machinery etc. complete.

11.2 Material : For electric welding, welding rods conforming to IS : 814 -1974 shall be used.

11.3 Welding Procedure : Welding shall be done by providing all equipment tools, tackles, materials required for the work mentioned in the description of the item, and incidentals there to, is included in this item. The work will have to be carried out as per specifications detailed under item for welding the pipes for single run and double run. Payment shall be made on the basis of actual length of weld in running metre.

11.4 Item to Include : All labour tools, tackles, welding rods, electricity welding generator and materials required for the work as per the specifications are included in this item. The welding will be carried out precisely.

Mode of Measurement & Payment : Payment shall be made under the respective items of either single run or double run, per metre run at the tendered rates. Rate for welding shall be per meter of welded length, measured correct up to centimeter.

Item No 12 :- Excavation in trenches, pits, pipe lines, foundations, column footings, walls etc. in earth‟s soils of all types, gravel, sand, soft & hard murum, and boulders up to 0.03 cum size, including removing the excavated material up to a distance specified by the Engineer-in-charge including all leads and lifts, stacking or spreading as directed, bailing of sub-soil water if any preparing base for foundation etc., and backfilling the excavated pit or trench using the excavated material in layers including watering and ramming as required or as directed by Engineer-in-charge, including all labour and materials complete.

12.1 General : The item refers to the excavation, in earth, soils of all types, gravel, sand, soft and hard murum and boulders up to 0.03 cum size. The excavation shall be for trenches, pits, pipe lines, foundations, column footings, walls etc. and may be in wet or dry, in earth, and similar other soft or loose material.

12.2 Site Preparation : The site as directed by the Engineer-in-charge, on which the construction, as per the drawings, is to be started shall be first cleaned and cleared of all obstructions. The loose stones, bushes, rubbish, brushwood, trees along with roots, etc. shall be removed. The material shall be stacked or disposed off as directed. All the material shall be the property of MIDC. After clearing the site, the alignment or center lines or points shall be given by the Engineer-in-charge. The contractor shall establish the reference marks, benchmark pillars in masonry with M.S. Plate top of which shall be bench mark connected to GTS. The B.M. Pillars shall be maintained undisturbed by the contractor etc. and the widths for excavations shall be clearly marked by the contractor as directed, true to line, curve, level and slope. The contractor shall provide all labour and marking material such as wooden/steel pegs, white lime powder, oil paint, or any other suitable marking material at his own cost and he shall be fully responsible for the correctness of the line, curve and levels and slopes.

12.3 Excavation : Before starting actual excavation work, contractor shall notify the Engineer-in-charge for taking the necessary measurements of cross sectional levels along the alignment for measurement purposes. The levels recorded in the field book shall be signed by the Engineer-in-charge and authorised representative of the contractor in token of acceptance. The contractor shall remove all the material from the marked area of excavation by using labour, tools and equipments most suitable for excavation of soft material as enumerated in the item in wet or dry conditions. The excavation shall be true to line, curve, shape, level grade as per the drawings or as directed. The widths of excavations shall be as minimum to the widths required at the bottom and the vertical faces shall be as far as possible in plumb. Unless provided in the contract, no extra payment shall be made for the excavation on side slopes for stability of slopes.

12.4 Foundation Preparation : The foundation for column footing and for structural components such as wall shall not be provided on soft strata covered under this item of excavation. The foundations for rafts, embedment of pipelines for water supply or drainage or gas may be laid on the foundation prepared on soft strata. The foundation level even if is confined within the soft layer, the final layer of excavation watered and brought to the required level and slope by ramming. The contractor shall not excavate below the line shown in the drawing or as directed. No foundation of any sort shall be laid unless the Engineer-in-charge charge approves the strata on which foundations are to be laid and passes the depth of excavation to lay foundation and record the dimensions and elevations and types soils of the foundation pit, trench excavated, and shall be recorded in the field book adopting system already explained above.

12.5 Shoring and Strutting : The cost of shoring and strutting shall not be paid separately unless provided in the contract. The type and designing of shoring shall be decided by the contractor, and shall get approved from the Engineer in Charge.

Pay Slopes : In lieu of shoring and strutting pay slopes for excavation of trenches/pits shall be stipulated and paid accordingly.

12.6 Disposal of Excavated Material : All the material obtained from clearing the site or from excavation shall be the absolute property of MIDC. All materials obtained from clearing the site and excavation shall be disposed off as per direction of engineer-in-charge.

Surplus materials shall be used for levelling the ground around as directed by Engineer-in-charge including loading unloading, transportation conveyance etc.

12.7 Dewatering : It is the responsibility of the contractor to remove the water accumulated in the pit or trench, from sub-soil water or from rains or from any other natural source, by manually or by pumping out as required. Unless provided for in the contract separately, no payment shall be made for bailing out the water. The contractor may be required to provide temporary bunds, or provide byepass arrangements to avoid entering of water in the excavation at his own cost. The drained water shall be properly disposed off, so as not to cause any damages to the excavated area nor to the surrounding structures. The contractor shall keep the excavated area dry for measurements and for laying of foundation mortar or concrete.

12.8 Side Slips and Blows : Even after sufficient care of sides, slips or blows occur, they shall be removed at contractor‟s cost.

12.9 Backfilling : After excavation is completed, measurements recorded by the Engineer-in-charge and the foundation raft masonry above is constructed or the pipeline is laid, all the shoring shall have to be removed. The backfilling of the pit or trench to the original level or as shown in the drawing or as directed shall be made from the selected excavated material stacked separately for that purpose. The material shall be laid in layers of 15 to 20 cm in thickness, watered and then rammed properly. The backfilling shall only be done after receiving orders from the Engineer-in-charge and without damaging the foundation raft or the pipeline etc.

12.10 Protective Measures : All the excavated pits, trenches etc. shall be properly protected from any accidents by providing strong fencing around. At night red lantern and watchman shall be kept in proper position to indicate the danger zone. It is the responsibility of the contractor to take the adequate protective measures and safety of the excavation, people and workmen and surrounding properties and will have to bear the damages if caused. All the cost of protective measures shall be included in the item rate.

12.11 Item to Include : The rate for this item, as per the agreement includes all labour and tools for clearing the site, marking out the excavation line outs, shoring and strutting, excavation of pits or trenches, bailing or pumping out water if not provided separately, removal of excavated material including all leads and lifts and disposal of material as directed, refilling of pits or trenches, adequate protective measures etc. Contractor shall also make the necessary arrangements for taking measurements. The rate also includes the cost of repairs due to excess excavations or slips. The item also includes payment of the damages if any, by the contractor. The material shall be disposed off as per the direction of Engineer-in-charge.

Mode of Measurement and Payment : The measurements of the original ground profiles at selected locations shall be taken after clearing the site. The measurements of the final excavated profile shall be taken if the excavation is less or more as directed by the Engineer-in-charge or shall be measured as per drawings. Excess excavation shall be recorded but shall be paid to the limited quantity as explained above. The quantity shall be measured in cubic meters and paid at the rate as per the contract agreement.

Item No.13:- Providing M. S. Slipon Flanges at departmental store or work site, finished smoothly on one side including drilling of holes as per B.S. Table or IS: 1537-1976 including cost of MS plates.

13.1 Item includes to supply of M.S. Slip-on Flanges of specified thickness and weight at the specified departmental stores or work site. Including two coats of red oxide primer paint to non machine face.

13.2 Material : The Mild Steel plates to be used to manufacture the pipes shall conform to IS: 2062-1992.

13.3 Manufacturing : The IS: 1537 - 1976 shall be referred for manufacturing of M.S. Slipon Flanges. The flange rings below 40 mm thick including drilling holes machining of flange and grinding champhering wherever necessary shall be supplied to the departmental stores or work site as directed by the Engineer-in-charge.

Mode of Measurement and Payment : The measurement shall be recorded per number of M.S. slip-on flanges for specified diameter.

Item No. 14:- Providing and laying plain cement concrete 1:3:6 as per item Gen / C / 1 / (b) with plums consisting of black trap or other approved stones 200 to 300 mm in size, clean, without skin or adhering encrustation's shape being as cubical or round as possible laid in single or in alternate layers as per directions of Engineer-in-Charges including shuttering, all labour and materials complete.

c) With 20% plum

14.1 General : The item pertains to providing and laying in position Plain Cement Concrete (PCC) of 1:3:6 proportion with plums of black trap stones of 200 to 300 mm size. The addition of plums is for economy in mass concrete and to provided where more density of concrete is wherever required.

For providing the PCC of 1:3:6 proportion the specifications are as per item Gen/C/1/b of MIDC specification book.

14.2 Providing of Plums :

14.2.1 Material :

Plums : The plums are the rubble stones of 200 to 300 mm size. They may be of trap stone, granite or of approved quality as far as possible cubicle or spherical in shape. They should be free form any scaling or adhering with loose material, cracks etc. They shall be provided from approved quarries only. The sufficient quantity of plums shall be stacked near the site. The test report shall be submitted by the contractor before using of plums.

14.2.2 Method of Placing Plums : The plum stones shall be washed thoroughly to remove the dust etc. The concrete (PCC) shall be placed in position of specified depth as directed. The required percentage of plums as specified in the drawing or as directed shall be added to the PCC layer. The concrete shall be vibrated by mechanical vibrator or roded with steel bar as directed till all the plums are sunk in the PCC or some portion of plums are kept for bonding with the next layer of PCC. The same procedure shall be repeated till the required thickness is achieved. The addition of plums in each or in alternate layer shall be decided by the Engineer-in-charge.

14.3 Item to Include : This item for providing Plain Cement Concrete (PCC) with 1:3:6 mix proportion at specified locations and includes all ingredients of concrete i.e. water, cement, fine and coarse aggregates, plum stones, dewatering, all transportation, tools and plants, all taxes, loyalties, royalty, ocrtoi, labour, formwork, testing, curing etc. complete.

Mode of Measurement and Payment : The measurements of the concrete laid including added plums shall be taken on volumetric basis in cum. The openings shall be deducted. The unit rate of concrete per cum of specified proportion with specified percentage of plums, includes all the items.

For unsatisfactory test results, if the concrete placed can not be acceptable, contractor shall have to remove the concrete placed and redo the concrete at his own cost.

Specifications :- The item includes providing & fixing manually operated glandless sluice valves, resilient seated with straight pocket less body passage with inside stem screw, inside & outside epoxy powder coated (EP-P) with minimum thickness of 20 micrometer.

1. Providing of sluice valve with EPDM rubber, the sluice valves shall fonfirm to ISO-7005-2 series.

2. fixing of sluice valve at the location as decided by the engineer in charge during the execution.

3. Testing of sluice valves for water tigheness in the same manner as described in mains

4. Before fixing the valves, the base of valves chamber/ surface box shall be completed though these chambers are covered under separate items.

15.1 The item provides for supplying, fixing in position and jointing Sluice Valves, both end flanged (without hand wheel). The Sluice valves are designated according to Nominal Pressures (PN ) for the maximum working pressure in MPa. The designated pressures and the nominal sizes of valve recommended and the respective Indian Standards, to be used in the water works are as under:

15.2 Material : Sluice Valves preferably be of VAG or equivalent make.

The material for different components of sluice valves shall be according to specifications referred above.

15.3 Manufacturing : The sluice valves are used in a pipe line for controlling or stopping flow of water. These shall be of specified size and class and shall be of inside non-raising screw type up to 300mm size and raising or non-raising screw type above 300mm with either double flange. The manufacturing shall in all respects comply with the Indian Standard Specifications IS : 780 for valves up to and including 300 mm size and IS : 2906 for valves above 300 mm size. The bodies, spindles and other parts shall be truly machined with surface smoothly finished. The area of the water-way of the fittings shall be not less than the area equal to the nominal bore of the pipe.

15.4 Hydrostatic Tests :

Each valve shall be tested as described in the respective IS codes. The valve shall not show any sign of leakage and/or sweating under test. The valve shall be tested for closed end and open end. The stems shall also be tested for “flaw detection”.

15.5 Marking :

The sluice valve shall be marked with the following information in raised letters:

1. The manufacturer‟s name or trade mark,

2. The designated Nominal Pressure,

3. The nominal size of the valve,

4. Serial Number,

5. The arrow to show the direction of turn for closing of the valve,

15.6 Transportation & Storage :

The valve shall be properly packed to protect all parts from damages and also from rusting. Valves shall be stored near to the work site, in closed stores and protected against dust before it is actually placed in the position and jointed.

15.7 Jointing :

Exact location of the Sluice valve shall be got approved from the Engineer-in-charge.

15.7.1 The jointing material used between flanges of pipe shall be compressed fibre board or rubber of thickness between 3.5 mm to 6 mm. The fibre board shall be impregnated with chemically neutral mineral oil and shall have a smooth and hard surface. Its weight per m2 shall be not less than 112 gm/mm thicknesses.

15.7.2 Each bolt should be tightened a little at a time taking care to tighten diametrically opposite bolts alternately. The practice of full tightening the bolts one after another shall not be allowed.

15.8 Item to include:

1. Supply of Sluice valve of designated class and nominal size, at the site of work, including transporting and loading – unloading etc., manually or by engaging crane wherever required without any additional cost.

2. Fixing in position and Jointing the valve in the pipe line at the exact location as per drawing or as directed by the Engineer – in - charge including all stainless steel nuts & bolts, packings, labour, tools and equipments, including taxes & duties and octroi. Octroi will be reimbursed on production of documentary evidence.

Mode of Measurement and Payment : The contract rate shall be for one number of valve of the designated class and size and for supply and jointing etc. complete as specified, under.

a) On supply of Sluice Valve with all accessories - 80%

b) On Fixing and Jointing in position - 10%

c) On satisfactory testing on line - 10%

Item No.16 :- Providing and fixing in position and jointing high performance C.I. Material :- The material for manufacturer of air valve shall be new and as below :

1) Stainless steel floats.

2) Bigger orifice.

3) Kinetic Valve (aerodynamic type) with integral bucket to prevent premature closing of big orifice.

4) Temper proof of avoid water theft.

Item No. 17:- Providing, transporting, cutting, fabricating, welding, hoisting and erecting in position welded or bolted structural steel work consisting of column bases, columns, columns caps, roof legs trusses, portals, wind girders, gantry girders, plate girders, purlins, bracing etc. for structural steel work manufactured out of steel plates rolled sections like I beams, channels, angels, erection bolts as may be required, erecting using devices like derricks, cranes or any other suitable guys etc. and final bolting, welding, testing as may be required including two coat of red oxide zinc crome paint and two coats of synthetic super enamel paint of approved colour and shade. All materials and labour complete.

The item shall be carried out as per item wording and as per direction of engineer in charge.

Mode of measurement and payment:- The item rate shall be per MT basis.

Item No 18:- Providing and applying paints of approved make including all materials and labour complete and furnishing three years guarantee.

g) Two coats of Pure epoxy paint

18.1 General : The item pertains to providing and applying various types of paints including material and labour and furnishing three years guarantee.

18.2 Material : All the above materials shall be of approved manufacture as decided by Engineer-in-charge and brought to site in their original packing in sealed condition.

18.3 Preparation of Surface : The surface shall be thoroughly cleaned of all mortar dropping, dirt dust, algae, grease and other foreign matter by brushing and washing before painting is commenced. The painting shall not be started until the Engineer in Charge has inspected the items of work to be painted. The painting of external surface should not be done in adverse weather conditions like hail storm and dust storm.

18.4 Application : The special features for these various paints are given below for each paint.

c) Pure epoxy paint :- The item includes providing and applying epoxy paint in two coats including all materials and labour etc complete. The surface shall be painted with two coats of epoxy paint, which is also included in the item. Second coat shall be applied as the first coat dries. The paint before applying the paint in moist conditions.

2) Requirements : Before applying the paint it shall be got approved from engineer in-charge. The paint shall be as under.

1.3 Cement Mortar : Cement mortar of the specified proportion shall be prepared as per item Gen/E/0.2.

1.4 Staging/Scaffolding : Normally for foundation and plinth work no staging and scaffolding required. However if required it shall be as per item Gen/E/0.3 of MIDC specification book.

1.5 Embedment of Fixtures : All fixtures, pipes, conduits, holdfasts of doors and windows etc. required to be built in walls, shall be embedded in plain cement concrete of grade 1:3:6 at the required position as the work proceeds.

Embedments and fixtures as specified in the drawings shall be provided as per item Gen/E/0.4.

1.6 Construction of Masonry : Construction of UCR as per item Gen/E/0.5.1 of MIDC specification book. Stone dressing, laying, Hearting stones, bond stones, chips insertion, quoins, masonry joints etc shall also conform to the Item Gen/E/0.5.1 of MIDc specification book

1.7 Curing : As per item Gen/E/0.6 of MIDc specification book.

1.8 Item to Include : The item includes providing all materials for masonry construction, including transportation, royalty for material, all labour, tools and plants, machinery and equipments, staging, scaffolding, bailing out water, testing, curing and construction as per above specifications etc. complete.

Mode of Measurement and Payment : As per item Gen/E/0.7 of MIDC specification book and shall be made on cubic meter basis on the volume of work done, to be measured as per IS: 1200.
