The mandate of the Department ofCommerce is regulation anddevelopment of India’s internationaltrade and commerce.

I. International Trade

1. International Trade andCommercial Policy including tariff andnon-tariff barriers.1A. Trade Remedies includingrecommendation of safeguardmeasures.2. International Agenciesconnected with Trade Policy (e.g.UNCTAD, ESCAP, ECA, ECLA, EEC,EFTA, GATT/WTO, ITC and CFC)**.All issues relating to the WTOincluding interpretation of WTO rulesand its dispute settlement mechanism.3. ORGANISATIONAL SET-UP

The Department of Commerceis headed by a Secretary who isassisted by one Officer on SpecialDuty(OSD), one Special Secretary,one Special Secretary & FinancialAdvisor, three Additional Secretaries,two Additional Secretary rank officers,thirteen Joint Secretaries and JointSecretary level Officers and a numberof other senior officers. ThisDepartment is responsible for thecountry's external trade and all mattersconnected with it, such as commercialrelations with other countries, statetrading, export promotional measuresand the promotion, development andregulation of certain export orientedindustries and commodities. TheDepartment of Commerce formulatespolicies in the sphere of foreign trade,in particular, the foreign trade policy ofthe country.

The Department of Commerceconsists of ten principal functionalDivisions as mentioned below:-

A BRIEF HISTORY OF THE MINISTRY OF COMMERCE

A separate Department ofCommerce was first created in theGovernment of India in 1921. Earlier,the subject under the Department weredealt with by the Department ofCommerce and Industry (set-up in1905). In 1937, when the Department ofIndustries and Labour was bifurcatedinto the Department of Communicationsand the Department of Labour, theDepartment of Commerce also took overcertain subjects pertaining to Industries.These subjects were, however,transferred in 1943 to the newly createdDepartment of Industries and CivilSupplies.

2. After independence, theDepartment of Commerce wasredesignated as the Ministry ofCommerce and was placed along withthe Ministry of Industries and Suppliesunder the charge of a Cabinet Minister.The two Ministries were amalgamated inFebruary, 1951 to form the Ministry ofCommerce and Industry. Thisarrangement continued for about fiveyears when in September, 1956, theMinistry of Commerce and Industry wassplit into two separate Ministries, viz. theMinistry of Commerce and ConsumerIndustries and the Ministry of HeavyIndustries. The two Ministries wereagain merged in April, 1957 to form theMinistry of Commerce and Industry. Thenew Ministry also took over the workconnected with most of the publicundertakings previously dealt with in theMinistry of Production, which wasabolished in 1957. In 1958, theDepartment of Company LawAdministration was transferred from theMinistry of Finance to the Ministry of

Commerce and Industry which wassubsequently reorganised into threeDepartments, viz. Industry,Commerce and Company LawAdministration.

3. With the formation of newCentral Cabinet in April, 1962, someof the Ministries of Government ofIndia were reorganised. The subject'Heavy Industries' was taken awayfrom the Ministry of Commerce andIndustry and the Ministry wasreconstituted into the following threeDepartments:-

(a) Department of InternationalTrade;

(b) Department of Industry; and(c) Department of Company Law

Administration.

4. In July, 1963, the Ministry ofCommerce and Industry wasbifurcated into the Ministry ofInternational Trade and the Ministryof Industry (Department of Industryand Department of Company LawAdministration). The Ministry ofInternational Trade took over allsubjects under the Department ofInternational Trade. In June, 1964,the Ministry was redesignated asMinistry of Commerce.

5. In February,1969, theMinistry's designation was changedas 'Ministry of Foreign Trade andSupply' with two Departments,namely:-(a) Department of Foreign

Trade; and(b) Department of Supply.

6. In November, 1969, theDepartment of Supply was separatedand the Department of Foreign Tradewas redesignated as Ministry of ForeignTrade.

7. In February, 1973, the Ministrywas again redesignated as Ministry ofCommerce and the Department ofInternal Trade added to it. The Ministryhad two Departments under its control atthat time, namely:-

(a) Department of Foreign Trade;and

(b) Department of Internal Trade.

8. In January, 1974, the Departmentof Foreign Trade under the Ministry ofCommerce was bifurcated into twoseparate Departments, namely:-

(a) Department of Foreign Trade;and

(b) Department of ExportProduction.

The third Department viz., theDepartment of Internal Trade remainedunchanged.

9. In accordance with the change inthe Government of India (Allocation ofBusiness) Rules, made effective from11thOctober, 1974, the Department ofInternal Trade which was a part of thisMinistry was transferred to the charge ofreorganised Ministry of Industry andCivil Supplies consequently structuringthe Ministry consisting of the followingtwo Departments:-

(a) Department of Foreign Trade;and

(b) Department of ExportProduction.

10. In March, 1976, this Ministrywas further reorganised and onemore Department, namely, theDepartment of Textiles was added tothe charge of this Ministry. Inpursuance of a further change to theGovernment of India (Allocation ofBusiness) Rules, in June, 1977, thisMinistry consisting of threeDepartments at that time wasrestructured as a singleorganisational entity as Ministry ofCommerce with a Department ofTextiles within the Ministry.

11. Consequent upon furtherchange to the Government of India(Allocation of Business) Rules, inNovember, 1977, all functions beingdealt with in the Department ofTextiles were transferred to thecharge of Ministry of Industry(Department of IndustrialDevelopment) and from out of textileitems, only the export activities inrespect of textiles, jute, handicrafts,etc. remained under the charge ofthis Ministry.

12. As a result of change in theGovernment of India (Allocation ofBusiness) Rules made effective from9thFebruary, 1978 this Ministry wasreorganised with the nomenclature"Ministry of Commerce, CivilSupplies and Cooperation"consisting of the following twoDepartments:-

(a) Department of Commerce;and

(b) Department of Civil Supplies& Cooperation.

13. As mentioned in para 11 above,the work relating to the TextileDepartment, with the exception ofexports, continued to remain under thecharge of the Department of IndustrialDevelopment till a full-fledgedDepartment of Textiles was revived inApril, 1980 in the Ministry of Commerce.In accordance with the Government ofIndia (Allocation of Business - 141stAmendment) Rules, dated 24th April,1980, the work relating to thedevelopment of textile industry wasretransferred from the Ministry ofIndustry to the newly createdDepartment of Textiles in the Ministry ofCommerce and the organisationalstructure of this Ministry at that timeconsisted of the following threedepartments:-

(a) Department of Commerce;(b) Department of Civil Supplies;

and(c) Department of Textiles.

14. In July, 1980, the erstwhileMinistry of Commerce and Civil Supplieswas further restructured organisationallyvide Government of India (Allocation ofBusiness - 144th Amendment) Rules,with the nomenclature of "Ministry ofCommerce' consisting of the followingtwo Departments:-

(a) Department of Commerce; and(b) Department of Textiles.

15. In accordance with the change inthe Government of India (Allocation ofBusiness) Rules, made effective from4thJanuary, 1985, the Department ofSupply was also brought under thisMinistry. The Ministry of Commercethen comprised of the following threeDepartments:-(a) Department of Commerce;

(b) Department of Textiles; and(c) Department of Supply.

16. In accordance with thechange in the Government of India(Allocation of Business) Rules madeeffective from 15thNovember, 1985,an independent Ministry of Textileswas created. The Ministry ofCommerce then consisted of thefollowing Departments:-

(a) Department of Commerce;and

(b) Department of Supply.

17. In accordance with thechange in the Government of India(Allocation of Business) Rules madeeffective from 15th October, 1999 thisMinistry was reorganised with thenomenclature of "Ministry ofCommerce& Industry" consisting ofthe following four Departments:-

(a) Department of Commerce;(b) Department of Industrial

Development;(c) Department of Industrial

Policy & Promotion; and(d) Department of Supply.

18. In accordance with thechange in the Government of India(Allocation of Business) Rules, madeeffective from 3rdApril, 2000 Ministryof Commerce & Industry consisted ofthe following three Departments:-

20. The Union Cabinet chaired byHon’ble Prime Minister on 12th April2017 gave its approval for closure of
