In the course of performing duties, some of our brethren have lost their lives and in spite of such tragedies, the wheels were kept moving. The inner strength of rail workforce is a great contributory factor for the Indian Railways to sustain itself as a dynamic infrastructure even though the political leadership has not hiked the rail fares matching with the cost of inputs during the previous years except marginal hike made in the recent past. So far as Railway employees issues are concerned there have been a few satisfactory decisions by the Government and Railway Ministry, particularly additional increment benefit on promotion to identical Grade Pay shouldering higher responsibilities, abolition of written test for appointment of wards of safety staff under LARSGESS, payment of Productivity Linked Bonus (PLB) equivalent to 78 days wages at the notional calculation of Rs.3500/- per month in spite of attempted reduction of Bonus days, cadre restructuring orders benefiting over 3-1/2 lakh employees with stipulation of matching surrender of posts and merger of Senior P. Way Supervisor with JE P. Way with New Year Challenges spread effect which may result promotion of seniors as SSE (P. Way). It is however sad to note that several proposals pertaining to Grade Pay, Allowances of staff after bilateral agreement with Federation sent to the Finance Ministry by Railway Ministry are continued unresolved leading to serious staff discontentment. Such vital proposals pending are – Merger of Technicians Grade II with Grade I – with Pay, Grant of Interim Relief and Guaranteed Pension/Family Pension to the employees are yet to be satisfactorily finalized. However the announcement made by Government for constitu- ting 7 th Central Pay Commission in September, 2013 can be construed as a positive step. But the Railway employees as well as Central Government employees are greatly disappointed over procrastination of genuine issues at the higher level of the Government. In August, 2013 a separate meeting was held between the Railway Board (CRB, MS, FC) and NFIR. In the meeting 34 issues contained in NFIR’s Charter were discussed but unfortunately many are continued unresolved. During the year 2013, theRailway employees of variouscategories have worked withdedication and commitment whichpaved the way for improvedefficiency of the Railways. In thecourse of performing duties, some ofour brethren have lost their lives andin spite of such tragedies, the wheelswere kept moving. The National Convention ofNFIR held at Visakhapatnam was agrand success. Over 20,000 railwayemployees which included delega-tes, activists, women representativesand young cadre of NFIR Unionshave participated in the NationalConvention i.e. inaugural sessionand open session etc. on 11th and 12th

December, 2013. The delegates andparticipants reached Visakhapat-nam on 10th December 2013 by 10Special Trains and Special Coachesworked from different parts of theCountry.

On 10th December, 2013, theWorking Committee of NFIR met atSrinivasa KalyanamandapamVisakhapatnam, under thePresidentship of Shri Guman Singh,President/NFIR. The WorkingCommittee has considered the draftresolutions as well as GeneralSecretary’s report and decided to beplaced before the General Counciland Delegate Session for consi-deration. Earlier Shri KS Murty,Chairman Reception Committee andVice President/NFIR has warmlywelcomed the NFIR Leaders andWorking Committee Members andsought their co-operation for thesuccessful conclusion of theNational Convention.

Earlier on December 9, 2013, thecadre of ECoRSC led by KS Murtyand RC Sahoo have given warmreception to Shri M.Raghavaiah,General Secretary/NFIR and Mrs.Raghavaiah on their arrival atVisakhapatnam on 9th December,2013 by Godavari Express. TheReception Counter at Visakhapat-nam was inaugurated by theGeneral Secretary NFIR on 9th

December, 2013. He also addressedPress Conference on the same dayand briefed the Media on variousprogrammes for three days from 10th

December, 2013 onwards.On 11th December, 2013, the

organized by West Central RailwayMazdoor Sangh (WCRMS). Thedignitaries and participants of theGeneral Council appreciated theexemplary work done by theWCRMS.

Shri Guman Singh, President/NFIR in his presidential addressmentioned about the victoriessecured by the affiliates in April2013 secret ballot elections andspecifically complimented SECRMC,NCRES, NFREU, SERMC, WRMS &SCRES for their spectacular victorieswith special mention of NCRES,NFREU and SECRMC who wereable to bag above 50% of total votespolled. NFIR in its history of over60 years, has been able to achievemany demand the President said.Citing further the achievements ofNFIR, the President said that:-

Constitution of Railway LabourTribunal (RLT) and its award forrailway employees,

Participation of railwayemployees in PREM,

Formulation of DA policy,

award of Justice MiabhoyTribunal, payment of over time,

Railway Workers’ Classificationand upgradation of TechnicalStaff in higher grades,

Upgradation of Gangmen fromunskilled to semi-skilled,

Cogent presentation of allcategories of railway employeesbefore the successive paycommissions for increase in payand allowances of railwayemployees,

Payment of PL Bonus to railwayemployees,

Revision of entitlement forprivilege and complementarypasses etc. are some of the keyachievements secured by NFIRfor all railway employees onIndian Railways.

Further Shri Guman Singh said

that the issues which weredeliberated in the 26th NationalConvention of NFIR held at Kolkatafrom 11th to 13th December, 2010,have been dealt with satisfactorilyby the Federation during this periodand some such noteworthy achieve-ments secured by the Federationwere highlighted by the President/NFIR which are as follows:-

For the first time introduction ofGrade Pay of Rs. 2400/- and Rs2800/- in the category of TrackMaintainers,

Payment of Shoe allowance @Rs. 900/- to Track Maintainers,

Special Allowance @ Rs. 375/-to Engineering Gatemen, qualityimprovement in their uniform,

Abolition of PET, written testand relaxation for 2nd Aptitudetest for appointment of wards ofrailway employees underLARSGESS,

Merger of Senior P. WaySupervisors with JE/P. Way,

Implementation of CadreRestructuring in Group ‘C’posts,

Payment of Overtime allowanceto railway employees at 6th CPCrates between the periods 01/01/2006 to 01/09/2008,

RELHS-97 declared open-endedscheme facilitating joining byretired employees,

Grant of one additionalincrement in the pre-revisedscale of pay in fixation of pay inrespect of staff whose annualincrement was due betweenFebruary, 2006 and June, 2006,

Mounted pressure on Adminis-tration and got 1.3 lakhvacancies filled up,

Payment of PL Bonus to Railwayemployees similar to last year (78days) against attempted reduc-tion in number of days of wages.

President/NFIR further statedthat apart from above, NFIR has alsoreached agreement with the RailwayMinistry on the following vitalissues pertaining to Railwayemployees. He however, expressed

disappointment over negativeattitude of Finance Ministry,Government of India, resulting non-finalization of proposals -

Replacement of GP Rs. 4600/-with Grade Pay Rs. 4800 (PB-2),

Merger of Technician Grade IIwith Grade I in Grade Pay Rs.2800/-,

Allotment of entry Grade Pay ofRs. 4200/- to Station Masters,

Provision of Grade Pay Rs.4600/- in the category of LocoPilots and Train Guards,

Grant of parity in the Paystructure of Railway Stenogra-phers with that of those Steno-graphers working in RBSS/CSS

Grant of Special allowance torunning staff.

Shri Guman Singh further statedthat the NFIR has always beenopposing privatization/ outsourc-ing of all jobs including jobs ofregular nature and will continue infuture with same stand.

The General Secretary Reportwas considered and after delibera-tions adopted by the delegatesSession.

General Secretary/NFIR Shri M.Raghavaiah, in his address heartilygreeted all the dignitaries who wereon the Dias. They were felicitatedwith Mementous by the ReceptionCommittee. The General Secretary/NFIR briefly explained theimportant achievements of the NFIRbenefitting lakhs of employeesduring the period from December2010, Kolkata Convention till now.He specifically mentioned to theaudience the historic achievementsof NFIR in January 2011 forensuring Air Conditioned Passentitlement to all categories ofemployees. He further said that theScheme for employment of wards ofthe safety categories employees(LARSGESS) got improved by NFIRcovering the safety staff in GP Rs.1900 also. He specifically mentionedthe historic achievement of NFIR inensuring introduction of highergrades pay for Track Maintainers’category thereby the TrackMaintainers will be in a position to

reach the Grade Pay Rs. 2800/-. Hefurther assured that the agreementreached with the Railway Board fordistribution of 10:20:20:50 in GP2800, 2400, 1900, 1800 respectivelywill be achieved in course of time.He also cited the NFIR’s achieve-ment of additional increment onpromotion of staff to identical GradePay shouldering higher responsi-bilities benefitting Technicians,Running Staff, para medical staff etc.He said that merger of Sr. P.WaySupervisors with JE/P.Way w.e.f.July 3, 2013 consequent to NFIR’sPNM demand with spread effect asSSE (P.Way), abolition of written testfor appointment of wards underLARSGESS are also significantachievements. He expressedconfidence that good number ofApex level Group ‘C’ posts will getupgraded to Group ‘B’ Gazetted asthe proposal is with the FinanceMinistry.

General Secretary/NFIR M.Raghavaiah has, however, criticizedthe Government’s negative attitudeon various 6th CPC related proposalssent by Railway Ministry to FinanceMinistry which are lying uncleared.He appealed to the rank and file ofNFIR to get ready to launchsustained struggle including that ofindustrial action if the Governmentcontinues its adamant attitude. Heexpresses serious concern overprocrastination on issues such asGrade Pay parity to RailwaysStenographers, revision ofkilomertrage rates for Running staff,rectification of MACPS aberrationsand deficiencies of LARSGESS andcautioned Railway Ministry thatfurther delay would lead to seriousunrest among working class.

He expressed confidence that theVisakhapatnam National Conven-tion would be a trend setter for NFIRto work with great determination forconsolidation of all workers underits banner not only for achieving thedemands but also for serving thecustomer with greater dedicationand providing greater support tothe Nation thereby Nation shouldprogress further.

He complimented Dr. T.Subbarami Reddy, Senior CongressLeader and Member of Parliamentfor his continued support to therailwaymen in general and NFIR inparticular. He expressed happinesswith the Leaders Shri US Jha,Secretary General/AIRPFA, Shri O.Sundararamaiah,Secretary General/All India OBC Railway EmployeesFederation and All India SC/STRailway Employee Associationrepresentative Shri Chand Babuwho have responded to theinvitation and associated them-selves with the NFIR leadership inthe inaugural session.

In his address, Shri US Jha,Secretary General/AIRPF Associa-tion thanked the Federation forextending invitation to him toparticipate in the National Conven-tion at Visakhapatnam. He pointedout that Safety, Security andPunctuality are the main motto ofIndian Railways but unfortunately,Security is ignored by the RailwayMinistry. He sought that theSecurity policy of Railways shouldbe reviewed and all vacant postsshould be filled. Shri Jha furtherpointed out that all the vacancies inthe RPF right from Group ‘C’ toGroup ‘A’ should be filled soon.

Shri O. Sundararamaiah,Secretary General/All India OBCRailway Employees’ Associationthanked NFIR for extendinginvitation to him to participate in theOpen Session of NationalConvention. He said that he wasOffice Bearer of SCRES (an affiliateof NFIR) and he gained lot ofexperience from Shri M.Raghavaiah, General Secretary/NFIR. He was thankful to theFederation for getting all facilities toOBC Federation.

Dr. T. Subbarami Reddy, M.P. inhis address thanked NFIR forextending invitation to him to takepart in the Open Session of NationalConvention of NFIR. He said thathe is over-whelmed with joy tostand among the ocean of Railwayemployees who are assembled atVisakhapatnam to participate in theNational Convention. He, however,

assured that since the Federationhas given a lot of affection to him,he will reciprocate the same and heis always ready to participate anddiscuss any issue that is brought tohis notice and see that the same isresolved satisfactorily. His doorsare always open for Railwayemployees to solve their problems.He prayed Almighty Lord Shivaand Balaji to shower their blessingsto all Railway employees.

In his address, Dr. G. SanjeevaReddy, President/INTUC dealt onthe policies of the Government ofIndia on privatization andoutsourcing. Nearly 50% of the jobshave been outsourced, he said. If weallow to continue the same, TradeUnion movement in India will beruined in the next five years andthere will not be any Union in theindustries, Dr Reddy lamented. Hefurther said that the presentleadership should fight thischallenge very seriously and shouldassociate with unorganized sectorworkers to bring them under theumbrella of registered Trade Union.The Government flouted manybeneficial clauses in the ILOdeclaration for which organizedlabour should fight, Dr Reddy said.He gave a call to the Trade UnionLeaders to fight against the anti-labour policies of the Government.He assured full support and co-operation of INTUC in this regard.

Shri Rajiv Vishnoi, GeneralManager, East Coast Railway,thanked the Federation for exten-ding the invitation for participatingin the National Convention. Heassured full cooperation in solvingthe labour problems on East CoastRailway and wanted to maintaincordial relations with the organizedlabour.

Draft resolutions were read andplaced before the Open Session byS/Shri Guman Singh, R.P.Bhatnagar, M. Raghavaiah, B.C.Sharma, Ashok Sharma, R.P. Singh,Vinod Mehta read the draftresolutions.

In the After Noon on 11th

December, 2013, a colourful Paradewas taken out via Railway Colonyto the venue of Open Session i.e. Rly.Exhibition Ground, MahendraPratap Nagar, Visakhapatnam,covering a distance of over 3Kms bynearly 20000 Railway employees. Inthe proces-sion, Banners & Placardswere exhibited throughout themarch, raising slogans consequentlythe city of Visakhapatnam came toa standstill, till the processionreached the venue. The Leadersstanding in the open Jeepsencouraged the participants.

On reaching the venue abeautiful display of fireworks wasorganized by the hosts in theRailway Exhibition Ground whichwas appreciated by thousands ofparticipants.

Responding to the points raisedby the delegates, General Secretary,M. Raghavaiah, said that the issuesbrought out will be dealt with by theFederation and the amendmentswill be incorporated in theResolutions.

He further saidthat he would love to stay in thesession and participate fully but toAP Assembly session being openedon 12th December, 2013, he beingsummoned on 12th December 2013,he was compelled to rush toHyderabad.

ResolutionsThe following Resolutions were

adopted unanimously in the 27th

National Convention of NFIR:-

1. Abolish Notional salarycalculation ceiling for payment ofProductivity Linked Bonus.

The Twenty Seventh AnnualConvention of NFIR in session atVisakhapatnam on 11th and 12th

December, 2013 takes note of NFIR’sconsistent struggle since the year1969 for introduction of the conceptof “Productivity Linked Bonus”(PLB) to Railwaymen.

Due to the persuasion, initiativeand relentless struggle of NFIR, theGovernment had agreed for evolvingthe Scheme of PLB to the Railwayemployees in the year 1979 andconsequently an agreement wasreached between the Federationsand the Railway Ministry forintroduction of PLB Scheme in theRailways. The NFIR had from timeto time pleaded for bringing positivechanges in the scheme more particu-larly relating to salary eligibilitylimit and calculation ceiling limit.The continuous efforts of the NFIRhas yielded satisfactory results, somuch so, the Railway employees inall categories become entitled forProductivity Linked Bonus (PLB) @Rs. 3500/- p.m. (on the basis ofnumber of days of wages). Thisrevised calculation limit was giveneffect from 2006-07 onwards asapproved by the Union Cabinet on03/10/2008.

Though the railway employeesare presently entitled for P.L. Bonusin terms of number of days wagessubject to the calculation of the same@ Rs. 3500/- p.m., the National

Convention strongly demands thatthe notional calculation systempresently followed should bedispensed with and the Bonus paidon the actual wages of the employees.

The National Conventiontherefore, demands that the existingcalculation ceiling for payment ofPL Bonus should be reviewed tofacilitate employees to receive theirlegitimate P.L. Bonus on the basis ofactual wages drawn.

2. Merge DA with Pay and grantinterim relief.

The revision of wage structure forCentral Government employees hadbeen undertaken by the successivePay Commissions appointed by theGovernment of India during the pastdecades and gave their reports.These reports have been imple-mented by the Government withsome modifications and improve-ments. However, anomalies andaberrations continue to persist.

Previous Pay Commissions (3rd,4th, 5th & 6th) have by and largecovered the aspects of the principlesof wage determination. But,however, the job contents,remuneration commensurating withthe nature of duties and responsi-bilities have not been taken intoconsideration by the Pay Commi-ssions while determining the revisedpay structure, consequently theRailwaymen have been put todisadvantage.

The 5th CPC had recommendedthat the DA must be merged withpay and treated as pay for compu-ting all allowances as and when thepercentage of Dearness compensa-tion exceeds 50%. Accordingly, evenbefore the setting up of 6th CPC, theDA of 50% was merged with pay inthe year 2004.

Presently, the Dearness Allow-ance is 90% of pay as on 01/07/2013 and is likely to touch/cross100% of pay as on 01/01/2014. Therecommendation for merger of DA topartially compensate the erosion inthe real wages was first mooted bythe Gadgil Committee in the post 2nd

Pay Commission period. The 3rd

CPC recommended such mergerwhen the Cost of Living Index

crosses over 272 points i.e. 72 pointsover and above the base indexadopted for the pay revision. Inother words, the recommendation ofthe 3rd CPC was to merge the DAwhen it crossed 36%. The Govern-ment in the National Council JCM atthe time of negotiations had initiallyagreed to merge 60% DA. The 5th

CPC had merged 98% of DA withPay.

As the DA already stood at 90%of pay and further revision is due on01/01/2014 when DA is likely totouch/cross 100%, it is thereforenecessary that the Governmenttakes steps to merge 50% with payfor all purposes w.e.f. 01/01/2011for ensuring compensation to theerosion of the value of real wage ofGovernment employee.

The 27th National Convention,therefore, urges upon the Govern-ment of India to consider thedemand and accord sanction formerging DA component of 50% ofpay with the Pay for all purposeswith effect from 01-01-2011.

The National Convention alsoappeals to the Central Governmentto grant Interim Relief to theemployees as well as retiredemployees to sustain in the light ofcontinued price rise of variouscommodities.

3. Seventh Central PayCommission

In the NFIR’s Election Manifesto-2013, Federation has committed tothe Railway employees that theNFIR shall struggle for achievementof 7th Central Pay Commission. AfterSecret Ballot Elections resultsdeclared on 2nd May 2013, the NFIRWorking Committee met at NewDelhi on 30th /31st May 2013 andpassed resolution for preparingRailway employees for launchingindefinite strike if the demands, moreimportantly appointment of 7th CPC,are not redressed by the Governmentof India and the Ministry ofRailways. The Charter of Demandsalong with NFIR’s communicationwas sent to Hon’ble Prime Ministerof India, Finance Minister, RailwayMinister, Labour Minister etc.

It is a matter of satisfaction that

the pressure and consistent strugglesince Feb 2013, launched by theNFIR and Railway employees onthe Government, has yielded result,wherein the Government has madeannouncement on September 25,2013 for constituting 7th Central PayCommission.

The 27th National Conventionnow in session in Visakhapatnamunanimously resolves to convey itsthanks to the Hon’ble PrimeMinister for his decision to set up 7th

Central Pay Commission. TheNational Convention, however,demands inclusion of one ofSecretary level Officers of RailwayMinistry as member of 7th CPCwhich may facilitate realisticexamination of the issues ofRailway employees.

The National Convention alsoappeals to the Government toinclude a Labour Representative asone of the Members of theCommission.

4. Ensure time-bound negotia-tions for settlement of pendingissues

The National Conventionreviewed the labour situation vis-à-vis pending issues relating toCentral Government employeesincluding that of Rail Workforce.After lengthy deliberations, theNational Convention listed theissues placed below:-

Guaranteed pension to thoseappointed on or after 01/01/2004.

Merger of DA with pay withretrospective effect.

Grant Interim Relief to CentralGovernment employees (servingand retired).

Increase contribution to GroupInsurance Scheme (GIS) for allGovernment employees.

Enhance Fixed Medical Allow-ance of Rs.300/- p.m. to not lessthan Rs.1000/- for all retiredGovernment employees.

Extend special privileges andfacilities for Women employeesfor their empowerment.

Productivity Linked Bonus (PLB)

on actual wages without enfor-cing any ceiling.

Count Temporary status CasualLabour Service in full asqualifying service for retirementand other purposes.

Transport Allowance should beexempted from the purview ofIncome Tax.

Merge Technician–II withTechnician – I with Grade PayRs. 2800/- (PB-I) in Railways.

Enhance Night Patrolling Allow-ance for Track Maintainers andadequate compensation shouldbe given to Night Patrolmen.

The 27th National Conventionresolves to urge upon the CentralGovernment and Railway Ministryto take Steps for ensuring time-bound negotiations with NFIR forsatisfactorily settling the issueslisted above to generate satisfactionamong all categories of Railwayemployees.

The National Convention alsodecides to direct NFIR affiliates toorganize mass meetings, confere-nces, demonstrations, rallies at alllevels during the next five monthsperiod to mobilize all categories of

employees for mounting pressure onthe Government to resolve issuesthrough sustained dialogue.

Resolution on Strike BallotThis National Convention of

NFIR now in Session (11th & 12th

December, 2013) took note of thestatus on various pending issuesand after lengthy deliberations cameto firm conclusion that theGovernment of India (Ministry ofFinance) has been procrastinatingon the proposals approved by theRailway Ministry relating tofollowing:-

(i) Merger of Technicians-II withTechnician-I Grade Pay Rs.2800/-.

(ii) Revision of entry GP asRs.4200/- to Station Masterscategory.

(iii)Replacement of GP of Rs.4600/- with GP Rs.4800/- (PB-2).

(iv) Revision of GP of Loco Pilots(Mail/Exp) as Rs.4600/- (PB-2)– Revision of Grade Pay ofGuards.

(v) Upgradation of apex level Group‘C’ posts to Group ‘B’ Gazetted.

(vi) Additional Allowance forRunning Staff.

(vii)Revision of entry Grade Pay asRs.5400/- to Group ‘B’ Gazettedstaff in Railways.

While the Railway Ministry afterdetailed examination had approvedabove proposals for rectifying theanomalies/aberrations and sentproposals to the Finance Ministry,the National Convention feels sadto note that the Ministry of Financefailed to clear the proposals thoughover three years have passed. Theseapart, the demand for grant ofguaranteed pension and familymention to those employees appoin-ted on or after January 1, 2004 hasbeen ignored with the passing ofNational Pension System bill by theParliament. The National Conven-tion also expressed concern overnon-redressal of pending issues byRailway Ministry even though NFIRhas been eager for negotiatedsettlement.

The National Convention feltthat the Railwaymen should getready to launch sustained struggleforcing the Government to clear thepending issues.

The National Convention at thesame time resolves to direct itsaffiliates to conduct “Strike Ballot”on 17th/18th January, 2014 on thedemands for seeking the mandate ofRailway employees to take steps forlaunching serious agitation andeventually “Indefinite Strike”.

Committee constituted to Study the Existing HMISMinistry of Railways (Railway Board) constituted a Committee

to study the existing Hospital Management Information System(HMIS) and suggest most suitable HMIS for adoption over IndianRailways. The Committee will consist of the following:

i) Executive Director/Health (General), Railway Board -Convener

ii) Executive Director/Finance (Expenditure), Rly. Board -Member

iii) Group General Manager/General Manager from CRIS -Member

iv) Additional CHD from Northern Railway Central Hospital -MemberDr. Praval Pant, Director (IH)/Rly. Board will act as Member

Secretary of the Committee.

The Terms of reference of the Committee will be as under:“To study the available Hospital Management Information

System (HMIS) over Indian Railways and suggest most suitableHMIS that can be adopted for all Zones.”

The President/NFIR whileinitiating the proceedings welcomedthe Central Office Bearers and theMembers of the Working Committeeand at the same time informed thatthe AIRF has fixed 20th December2013, seeking opinion of theRailway employees for Strike Ballotfor the call of Strike in the IndianRailways. He, however, expresseddoubt on the sincerity of the otherFederation who have neverhonoured railway employees’opinion. It was further informed bythe President that the call of Strikeby the other Federation in 1974 waspolitically motivated, therefore, hadled to victimization of the Railwayemployees. Cases of the employeesvictimized in 1974 strike were foughtby NFIR and consequently, theywere re-instated.

Shri Guman Singh, in his addressmentioned following achievementssecured by NFIR recently for thebenefit of Central Governmentemployees including Railwayemployees:-

Benefit of erstwhile FR22C (RuleS-1313) in case of promotion ofstaff to the identical GradeGrade Pay shouldering higherresponsibilities,

While highlighting the achieve-ments secured by NFIR for thebenefit of Railway employees, theGS/NFIR expressed the need topursue remaining issues whichhave been taken up already by theFederation at apex level:-

i) The General Secretary said thatthe NFIR has been protestingagainst implementation of cadrerestructuring orders with effect from01/11/2013 with matchingsurrender because of the fact thatstrength of cadres has already beendepleted and further reduction inrespective cadre by way of matchingsurrender of posts will adverselyaffect not only the efficiency but alsothe productivity of the system.

Shri Raghavaiah stated that ithas been made clear to the RailwayBoard by NFIR that the unrealisticconditions imposed by the RailwayBoard in the process of implemen-tation of cadre restructuring, shouldbe withdrawn.

ii) The General Secretary furtheradvised that the Federation hasalready invited attention of thePrime Minister vide its letter dated18th Sept. 2013, the need for mergerof 50% DA with Pay w.e.f. 01/01/2011 & 80% on 01/01/2013 as DAis mostly likely to touch or cross100% of pay on 01/01/2014 withthe present trend of inflation and theprice index. At the same time, theFederation has also demanded grantof interim relief to the serving andretired Central Governmentemployees to compensate with thehigher rate of inflation, ShriRaghavaiah stated.

iii) Shri Raghavaiah, furtherstated that though the RailwayBoard had reached an agreement inthe past with NFIR on 27th Jan. 2006,and 17th February, 2006 for“counting of casual labour servicein full”, unfortunately approval hasnot been conveyed by theGovernment of India with the resultthat a number of employeescontinue to suffer specially at thetime of retirement. This has resultedinto filing of a number of court caseswhere even the Supreme Court hasheld the views expressed by theNFIR, he said.

iv) The General Secretary drewattention of the Members of theWorking Committee to the Chartercontaining 25 demands relating tovarious issues and informed thatthese are being pursued with theGovernment of India/RailwayBoard. Shri Raghavaiah furtherhighlighted following importantitems which are yet to be resolved at

In his address further, GeneralSecretary/NFIR further briefed theWorking Committee Members aboutthe Resolutions to be considered inthe General Council meeting on 11th

Coverage of staff appointed priorto 01/01/2004 but acquiredtemporary status after 01/01/2004 under liberalized pensionscheme.

7.2 Shri Rajesh Pandey,WCRMS raised following issues:-

Poor condition of RailwayHospitals due to shortage ofDoctors, Super Specialists, Para-medical Staff, substandardmedicines and non availability ofessential health check -ups andtest facilities,

Extension of benefit ofLARSGESS to Safety Categorystaff in Grade Pay Rs. 1900/-,

Grant 2 sets of PTOs to RetiredRailway employees,

Zonal Railways are taking policydecisions without consulting therecognized Unions, for examplecase of extension of duty hours ofE&RCs on the Counters,

There is no maintenance ofRailway Quarters, condition ofapproach roads and sanitationin the Railway Colonies is verypoor mainly due to non-allocation of sufficient funds forthe purpose,

Doctors appointed throughWalk-in-Interview on contractdo not have accountability,therefore, vacancies of Doctors inRailway Hospitals and HealthUnits should be filled quickly.

7.6 Shri G. Mohan Rao, SCRESraised following issues for urgentattention:-

There are not enough websitesat Zonal, Divisional and Branchlevel with the result inter-communication is at the lowestlevel,

Zonal Unions should explorethe possibility of openingwebsites through ‘Advertise-ments’ from Outside agencies tohave self-sufficiency withoutincurring expenditure for bettercommunication and coordina-tion.

Safety of Track Maintainers dueto higher rate of death on dutyas a result of working underconditions such as withouttaking block,

Wards of Safety Category staffbeing appointed underLARSGESS should be offeredappointment in alternativecategory depending upon theireducational qualification,

Instructions issued by theRailway Board vide letter dated6th January 2011 for determiningthe eligibility of Privilege/Complimentary passes aredefective where persons earlierdrawing pay of Rs. 5375 (as per5th CPC/pre-revised) whohitherto were drawing 1st ClassPass have been denied samebenefit on the plea that they arein Grade Pay Rs. 2800/- . Thussolved.

7.9 Shri Pradeep Kumar,URMU raised following issues:-

Inclusion of safety categoriesstaff like TRD, Bridge, TrainLighting etc in the scope ofLARSGESS.

Strength of Engineering Depart-ment is less and needs revision.

7.10 Shri S.A. Siddiqui, CRMSraised following issues:-

12 hours duty of Gateman needsto be reduced to 8 hours,

Difference of rates of Kilometrageof running staff due to be paidfrom 01/01/2006 not paid.

Grade Pay of Loco Pilots andGuards need to be improved,

Ernakulam Bench of CAT hassince decided the case forgranting 3rd MACP in Grade Payof Rs. 4800 & 5400 respectively,need to be implemented.

Separate funds need to beearmarked for maintenance ofRailway Quarters and Colonies.

7.11 Shri V.K. Samadhiya,CRMS highlighted followingitems:-

The strength of Staff is beingreduced in phased manner andnumber of Officers increasingcausing serious imbalancebetween the workers and theOfficers with the result the workhas been suffering badly at thecost of safety.

The condition of Railwayquarters allotted to TrackMaintainers’ category is verypoor and needs special attention.

Posts of staff are beingsurrendered indiscriminately,adversely affecting the workingon the Zone.

7.12 Shri Tapan Chatterjee,SECRMC invited attention on thefollowing issues:-

The single Union on South EastCentral Railway is not beinggiven due importance and thereis no consultation while takingpolicy decision on all staffmatters,

The branches of SECRMCexisting prior to 2007 secretballot elections have not beenrestored along with accommo-dation causing serious resent-ment among the cadre,

There is shortage of staff in everycategory,

There is no coordinationbetween the CCM and CPO.

CCM is taking arbitrarydecisions and is transferringposts without consultingSECRMC and CPO.

7.13 Shri Ashok Sharma,General Secretary/WCRMSmentioned following issues:-

Working hours of PRS countersgot increased arbitrarily

Merger of Technicians Gr II andGr III in Grade Pay Rs. 2800,

Issue relating to upgradation of3335 apex level Group ‘C’ poststo Group ‘B’ Gazetted andallotment of Grade Pay Rs.4200/- to Station Masters’category have been pending fora long time,

Posts are being surrendered forproviding matching surrenderfor implementation of cadrerestructuring causing seriousshortage in the staff strength.

Dates for conducting strikeballot should be finalized,

Unwanted conditions imposedby the Railway Board on themedically decategorised railwayemployees need to be removed.

7.14 Shri B.C. Sharma, GeneralSecretary/URMU, raised followingissues:-

A number of issues have beenpending as mentioned in thecharter of demands for a longtime without any solution,therefore, there is immediateneed to conduct Strike Ballot,

No category of staff is satisfiedwith the allotment of Grade Payby the 6th CPC and a number ofanomalies have been pendingun-resolved,

There is immediate need formerger of 50% DA with payw.e.f. 01/01/2011,

New instructions need to beissued to assure pension/familypension to railway employeesappointed on or after 01/01/2004,

Contribution towards RELHS-97has been made compulsory inrespect of husband and wiferailway employees, This needsreview.

There are no clear cut instruc-tions for sanctioning SpecialCasual Leave of 2 days forconducting Branch CouncilMeeting, To be looked into.

Consequent to implementation ofthe recommendations of 6th CPC,every employee has beenpermitted yearly increment inJuly. The employees retiring on30th June though completingmore than 06 months a qualifiedperiod for awarding incrementare being denied incrementwrongly.

7.15 Shri J.G. Mahurkar,General Secretary/WRMS broughtfollowing issues:-

Dates for holding Strike Ballotshould be finalized soon andNFIR should play its role,

Non-payment of Runningallowance to the medicallydecategorised running staff withaddition of 55% pay element inthe retirement benefits. The caseshould be made out citing logic& relevant rules for the benefitof railway employees.

Implementation of Cadrerestructuring should be donewithout surrender of posts,

Posts are not being created onthe Zone taking into account theincreased activities, increase intrain services leading to over-work by the existing staff.

Merger of DA with pay isinescapable as DA will be morethan pay in the year 2014.

7.16 Shri R.P. Bhatnagar,Working President/NFIR men-tioned following items:-

Maintenance of RailwayQuarters and Railway Coloniesrequire more attention,

Condition of Running Rooms forRunning and Ticket CheckingStaff is grossly unsatisfactoryand requires more attention,

The Railway Schools are beingdiscontinued and cancelledarbitrarily and the SchoolTeachers are being declaredsurplus arbitrarily without

having discussions with theUnions,

Railways are grossly violatingthe provisions of ContractLabour Act and have been outsourcing and privatising jobs ofregular nature and notconsulting Unions,

There is no real participation ofRailway employees in PREM.

8. Response of GeneralSecretary/NFIR:-

The General Secretary/NFIRstated about the role of the WorkingCommittee and the Role of the cadre.He said that the Union Officials arenot meeting the Railway employeesat grass root level to know abouttheir problems and make efforts toresolve. Shri Raghavaiah urged allthe affiliates, more particularly thoseUnions who could not secureenough votes for recognition, to domore hard work for winning theconfidence of workers.

While summing up, the GeneralSecretary stated that the issuesraised by the Members of theWorking Committee have been takenup at the level of Railway Board invarious foras are at different stagesof negotiations.

The General Secretary stated thatthe recommendations of Dr AnilKakodar’s Committee recommen-ding entry qualification of Diplomain the category of Asstt Loco Pilothas already been brought toRailway Board’s notice seekingdecision for allotment of Grade Payof Rs.4200/- (PB-2) to ALP category.

The GS/NFIR felt concern overthe high incidences of run over ofTrack Maintainers over ZonalRailways, more particularly on WestCentral Railway, Central Railwaywhich are the example of ignoranceof safety of staff who are forced toperform duties without followingrules and procedure.

Rental Ceilings for Railway Officers posted inZones and Board’s offices

Ministry of Railways (Railway Board) have revised the rentalceilings prescribed vide Board’s letter No. 2009/LMB/12/1 dated23.11.2010 for hiring private residential accommodation for RailwayOfficers of various grades posted in various classes of cities in all thezonal railways/units. The following are the revised rental ceilings.

In the course of 27th NationalConvention of NFIR, NationalWomen’s Conference was held on12th December, 2013. The conferencewas inaugurated by Smt M.Raghavaiah, a roaring lady whochaired, who is behind the successof M. Raghavaiah.

NFIR proudly staged thosewomen veterans who shaped tradeunions at local levels and changedthe course of history. They raisedbabies, but they also raised voicesagainst the systems of discrimina-tion harassment.

“Life is not easy for any of us. Butwhat of that? We must haveperseverance and above allconfidence in ourselves. We mustbelieve that we are gifted forsomething and that this thing mustbe attained.” Life to women is not atall easy in these present days, butstill they made up confidence andmoving to attain their goals with allstruggles. And these women havealso inspired many of those womenemployees who are present in theconvention with their thunderingspeeches.

“We want to be strong andempowered. We want to shockeverybody.” With this strong oathwomen conference was started witha song of “Itni shakti hame denadata “ so that we can change theviolence into peace, sung by SmtAruna Jaipal in the conference. Afterthe song, with the permission of theChair, the women conferenceproceedings were commenced.

Smt D.P.Naidu, in her speechstated that, the most common waywomen are giving up their hopes isby thinking that they don’t have anypower. Every women have thesetwo elements of power and strength.These two tools to be used in theright time and right way. Thewomen are blessed with Child careleave, at the same time it turned tobe a trouble to them to avail it. Manywomen are facing problems with

this leave, since it is at the discretionof officer, and every time whoeverneeds it are to approach officer withgifts or in any other form, for itssanction. She requested GS/ NFIRto look into this matter. She alsoraised her demand to GS/NFIR toaccommodate 2 women from eachzone in the NFIR leadership.

“LADIES!!!! You are not aSEXUAL OBJECT! - not aPUNCHING BAG _ not a target forEMOTIONAL ABUSE! You werecreated by God to be a Partner toMEN not a SLAVE, to provideStrength and support to them not tobe used and manipulated by them,to submit to them not to become foolsin that process. You have yourDignity and Self Worth. Neversacrifice those!” stated by Smt.Hemalatha, from Jhansi divisionnicely explained the womenhoodand how women are to be loved.

Thundering speaker Smt. GeethaPandey, from Bhopal division,stated that , the employees who areenjoying all benefits and facilitiesare the result of struggles and fightsmade by NFIR and not by any otherUnion. No Union has stamina tostand before of NFIR , since NFIR isled by a roaring lion like Shri M.Raghavaiah and others.

Smt. Petsi Massy, from Amjerdivision was honoured for theaward received from President ofIndia for “best Nursing”. She said,unless women raise their voicesnothing can be done, all womenshould come united to raise voicesagainst common problems ofwomen.

Smt. Manjulika Mukhopadhayfrom Metro Rail has raised manyissues in metro rail and strugglesthey faced to overcome thoseproblems.

“Women should empower eachother instead of being so hateful andenvious of each another “ this wasstated by Smt. Simi Lal Singh, from

SRES, she further came up with avery valid point, that any womanshould not think another woman asenemy. Unless women are unitedand felt as one, violence or any otherproblem of women cannot be solved.If women are not united, there isevery chance of taking advantage ofit. So, she stated women to be unitedto fight together.

Smt. Satyavaani from SCRESstated that, the famous proverb of“there is a Woman behind everysuccessful Man”, but today behindso many successful women in tradeunions as leaders there is a MANbehind and he is none other thanShri M Raghavaiah. The women folkof SCRES are proud to be part ofmother organization. The SCRESwomen wing is constantly workingsince 2 decades with all kinds ofactivities and encouraging womenemployees by giving themawareness programmes to “whystrong unions need women”. Shealso stated that, Woman itself is avast subject and cannot beconcluded or discussed within timeframe of 40 minutes, and with thepermission of chair from nextconventions, women need half dayto conduct women conferences. Shealso proudly stated that under theguidance of GS/SCRES and ShriMohan Rao, Jt GS/SCRES , themonthly magazine “RAILSANDESH” is run by two womeneditors one herself and another SmtRama Pallavi. A website for NFIRWomen Forum is coming up as“Rail Naari” to share women viewsand raise voice commonly oncommon issues Smt. Satya Vani. Shestated that SCRES demand for 15years voluntary retirement with fullbenefits and employment to wardsof women employees should bepursued since, women from 40 yearsof age faces many physiological,physical, mental stress and naturalhealth problems.

Everywoman in NFIR is being respectedat all other forums too. They allstated that the entire women folk ofNFIR will be with GeneralSecretary/NFIR M Raghavaiah inhis future agenda and support himin all aspects.

The conference was concludedwith the motivational, inspirationaland demanding speech of theChairperson M Raghavaiah. Shestated, that in, every meeting whereshe has attended she has beenrepeatedly telling about separatewomen branch exclusively forwomen employees in each division,so that they can fight for their ownproblems and issues. So, far twoRailways have come forward andhave declared that they are creatingwomen branches. On the same lines,she demanded President, andGeneral Secretary NFIR and otherZonal General Secretaries topromise from this women forumthat in every zonal railway, they willencourage one women branch. She

also demanded that, 40 minutes timeis not sufficient to hold womenconference and it has to be atleasthalf a day programme. She said “Awoman is the full circle, within heris the power to create, nurture, andtransform.” All the powers in worldare made by woman and all powersare within her. Only thing womanhas to understand how to fight. Shealso reminded the women about thefamous proverb “ The hand that rocksthe cradle rules the world” so thewomen of NFIR shall roar themselvesand rule the trade unions for theirfuture. She added that women shouldcome forward, prepare themselves forthat. She also told to increase thewomen membership, so that we canhave our own union and which willbe supportive to NFIR and worksunder NFIR.

As a closing remark, the GeneralSecretary of NFIR Shri MRaghavaiah, has explained theproblems and difficulties faced bywomen employees. Slowly one afterone are resolved but yet there aremany pending issues, he said. Asdemanded by the Chairperson ofwomen forum, efforts will be madeto form Mahila Sakha, MahilaBranches as and when the member-ship of the women is increased. Healso stated that, the InternationalWoman’s Day and Un day forelimination of violence againstwomen are celebrated every year byall the zonal unions of NFIR. Toobserve these days, on South CentralRailway, SCRES has beensuccessful in providing fundsthrough Staff Benefit Fund and thesame efforts will be made in otherzonal railways also he saidMr.Raghavaiah has assured thathence forth, half day for womenconference will be held asdemanded. NFIR will move forwardto raise and work for upliftment ofwomen employees of Railways, hedeclared. If women are more, NFIRwill fight with Rly. Board andarrange special AC 3 tier coachesand special trains for Nationalconventions, he said.

Career Progression of Track MaintainersExtract of Record Note of discussion held on 27.09.2013 BETWEEN Railway Board (MS & FC) and the

Staff Side (NFIR) on recommendations of the Joint Committee constituted to study the Career Progressionand Package for Trackmen – percentage distribution of posts of Track Maintainers, is given below: NFIRGeneral Secretary, M. Raghavaiah participated.

“General Secretaries of the Federations mentioned that there is acute stagnation amongst the Trackmencadre. There are cases where a Trackman is superannuating without any promotion. The Federations stressedthat it is absolutely necessary that the cadre is revised in the ratio of 10:20:20:50 as was unanimously agreedand recommended by the Joint Committee.

Board (FC) stated that the cadre structure as recommended by the Committee if agreed and implementedwill result in double or even triple jump in certain cases which may not be administratively desirable.However, considering the Federations’ contention about the hardships being faced by the Trackmen category,revision in the percentage distribution in Track Maintainer-III & Track Maintainer-IV categories may beconsidered. The General Secretaries of the Federations however raised strong objection on this suggestionand insisted that revision is very essential in the higher grades of the cadre i.e. Track Maintainer-I & TrackMaintainer-II.

Addl. Member (Staff) intervened and stated that as was suggested in the CRC meeting, a viable solutionat this juncture would be to consider revising the percentage distribution of the cadre of Track Maintainersin the ratio of 6:12:22:60 in lieu of the existing 3:6:20:71. Board (FC) agreed to this suggestion.

Although the Federations insisted for the percentage of distribution as per recommendation of the JointCommittee especially for 10% to Track Maintainer Grade-I, but finally it was agreed that presently 6% (sixpercent) may be given to Track Maintainer – I category and after 2 (two) years to date of approvalcommunicated by Board (17.08.2012), this percentage would again be reviewed upwardly.

It was agreed to process the matter accordingly.”

Sangh (SRES) conducted Massprotest against the incident,harassment of public and death ofCTI/GTL B. Sanjiva Rao on 10th/11th

December, 2013.

The incident took place whenpublic agitated because there wasno water in the train and harassedthe Ticket Checking Staff. Shri B.Sanjiva Rao had a massive Cardioarrest and died while on dutyduring public agitation.

SRES observed condolence andas a mark of respect all the CentralOffice Bearers and Divisional OfficeBearers of Workshop Division andChennai division participated inthe protest and spoke about thecondemning the inaction of railwayadministration. They said that inSouthern Railway 125 vacancieshave not yet been filled for the lastmore than one year. Though 68trains were introduced/extended/increased the trips but so far no staffwere sanctioned, they said. It wasalso highlighted by the speakersthat many TTEs manning theadditional coaches which resultedin mental agony, stress and strain.

Large number of Ticket Checkingstaff attended the protest with blackbadges. All the staff demanded toprovide adequate safety for theticket checking staff and to fill upvacancies immediately to avoid suchtype of incidents. They alsodemanded fair and quick justice tothe family of late B. Sanjiva Rao.

staff under the banner of South EastCentral Railway Mazdoor Congress(SECRMC) took out a massivepeaceful silent rally and conductedgate meeting before the DivisionalHeadquarters on 17th December,2013.

A delegation of the SECRMC metDivisional Railway Manager, AjayPratap Singh and handed over amemorandum to him demandingsecurity for the ticket checking staffafter an on duty Train TicketExaminer (TTE) Sanjiva Rao wasbrutally hacked to death by sometraveling passengers in GuntakalDivision of South Eastern Railway,the other day.

Ticket Checking staff expressedtheir condolence to the departedsoul of Sanjiva Rao condemning theact as barbaric. SECRMC President,Tapan Chatterjee said that the ticketchecking staff while on duty had toface lot of problems from themiscreants and ticketless travelers.But despite repeated reminders, theRailway Adminis-tration failed toextend any security to the TicketChecking Staff putting their life injeopardy during duty hours. Healso said that they have demandedfrom the Railway Administration toensure that such incidents do notoccur in future not only with theticket checking staff but also withany other Railway employees.

SECRMC senior members includingAssistant General Secretary, RaviDhal, Assistant General Secretaryand former Divisional CoordinatorB. Krishna Kumar were present inthe rally.

The sorry state of affairs asabove may lead to turbulentsituation in the new year 2014 andemployees’ confrontation with theGovernment may become inevitable.While the negotiated settlementwould be the preferred option, thefailure on the part of the Governmentin meeting the genuine aspirationsof the workers may disturbindustrial peace.

It is hoped that the Governmentwould be prudent enough toseriously take note of thedisappointment and frustrationamong the employees and take pro-active step for working towardssorting out issues through dialoguebefore it is too late. Every one reallywants that Indian Railways shouldprosper to ensure qualitative serviceto the Nation but, however, muchdepends upon the attitude of theGovernment.

The 34th Biennial Convention ofCentral Railway Mazdoor Sangh(CRMS) was held at Solapur from20th to 22nd November, 2013.

The Minutes of last Workingcommittee Meeting were placedbefore the house by GeneralSecretary K.V. Vichare which werepassed unanimously. The Statementof Accounts from August to October,2013 was placed before the house bythe Treasurer Shri R.G. Nimbalkarand the same was passedunanimously.

Shri R.P. Bhatnagar, CRMSPresident addressed and apprecia-ted the arrangements made by theteam of CRMS Solapur Division. Hethanked to the Railway employeesand CRMS cadre for collecting thefund of Rs.10 lakh which washanded over to the Chief Minister ofUttarakhand for the relief of floodvictims of Uttarakhand. He said thatthe privatization in Railwaysactivities is damaging the standardsand working of Railways. He alsoexplained on Resolutions onvarious demands of Railwayemployees.

Minister of State for Railways,Shri Adhir Ranjan Chowdhury in areply to a question in Rajya Sabhaon 13th December, 2013 informed thatthe Ministry of Railways havesigned a Memorandum of Under-standing (MoU) with the Ministry ofHuman Resource Development(HRD) for setting up of 50 newKendriya Vidyalayas during 11th

and 12th Plan periods. Pursuantthereto, Ministry of HRD hassanctioned seven new KendriyaVidyalayas at Carriage RepairWorkshop (Bihar), RailwayCampus, Nanded (Maharashtra),Railway Campus, Rangiya (Assam),Freeland Ganj Railway Colony,Dahod (Gujarat), KrishnarajapuramDiesel Loco Shed Colony, Bangalore(Karnataka), and Shakurbasti, WestPunjabi Bagh (Delhi).

He also informed that a list ofanother 43 locations has beenforwarded to Ministry of HRD foropening of Kendriya Vidyalayas.However, five Kendriya Vidyalayasare already running on Railwayland in Andhra Pradesh, theMinister said.

Mahurkar fortheir efforts to get implemented theprovision of Child Care leave andthe increase of maternity leave to sixmonths. Smt. Kavita Menon, OfficeBearer suggested that a Rest Roomshould be made available for thewomen working in traffic andoperating departments. She alsosuggested for hostel accommodationfor working women at all theDivisions.

Ms. Niladevi Zala, Coordinator,Women Wing strongly emphasizedthe need of Women Branch ofWRMS in each Division like that ofBhavnagar Division. She also feltthat there should not bediscrimination of rights for women.Ms. Anandiben Dhamdhere Barodaexpressed her concern on sexualharassment at workplace andsuggested that the names ofMembers with their telephonenumbers should be displaced on theBoards in all the offices to enable thedistressed women to seek the help.Smt. Deepti Shukla briefed theaudience on the functioning of ITFand explained the hard working ofITF on promotion of womenempowerment and elimination ofviolence against women. Smt. AvniOza, Matron, Divisional Hospital,Rajkot said that women shouldcome forward with their problemsand work together for theelimination of violence againstwomen. She strongly expressed thatwomen should unite to achieve theempowerment in real sense. She alsosuggested that Gang Ladies shouldbe deputed on light jobs at the ageof 45 years & above because they arehaving serious health problems atthis juncture of age. Smt. Leena Paul,Matron, Mahu of Ratlam Divisionsuggested that the provision of

health care leave should be made forthe women beyond 40 years and thePatient Care Allowance should alsobe granted to the lady peon workingin hospitals where safaiwala andHA are not provided.

Smt. Kamini Mahurkar expressedher concern that problems ofwomen are not being resolvedwithin time frame and they continueto suffer because of this. Remedialaction should be faster. Wheneverthe problems of working women arediscussed by trade unions withofficers, the concerned womenshould also be present.

Smt. M. Raghavaiah, whilespeaking felt that the problems ofwomen employees should beproperly looked into and resolved byNFIR & WRMS. She drew attentionof the participants to the fact thatdecision was taken in the Women’sConference held at Bhavnagar thateach Division will have a Women’sBranch but the same has not beenmaterialized so far. NFIR, sheobserved will have to work moreassertively to mitigate the problemsof 90,000 women working on IndianRailways.

The Government had challengedbefore the Supreme Court thedecision of the Delhi High Court forallowing correct pension from 1st

January, 2006 instead from 24th

September, 2012.

The issue had arisen when thedemand was made for fixation ofcorrect pension from 1st January,2006, the date from which the 6th

Central Pay Commission recommen-dations were implemented insteadof from later period.

The Supreme Court haddismissed the SLP filed by theGovernment in July this year. TheGovernment has again filed ReviewPetition urging the Supreme Court toreview its order of dismissal of SLP.

The Supreme Court has sincedismissed the Review Petition filedby the Government.

Shri Karri had joinedRailway service in the year 1961and retired after rendering fivedecades of service in the Railway.He was given Railway Minister’sAward besides GM & DRM Awardsin recognition of his dedicatedservices.

Shri Y. Chandru Naidu, TrackMaintainer, Tenali while on duty ofnight patrolling of track noticed ataround 03.20 hrs. on 15th December,2013 between Tsunduru and TenaliStations a flash butt weld failurehaving a gap of 8 mm which led toa level difference of 60 mm betweenthe separated rails. He immediatelyalerted the Divisional control officeat Vijayawada and promptly relayedthe information about this weldfailure to senior officials. In the meantime, Train No. 12621 Chennai –New Delhi Tamilnadu Express hadalready left Tsunduru Stationtowards Tenali. The Train waspromptly stopped short of the spotin time by the night patrolman byflashing a red lamp signal.

Shri M. Sambasiva Rao, SeniorSupervisor/Permanent Way/Tenali,rushed to the spot with additionalstaff by about 04.05 hrs. The staffhave physically lifted the track,brought both the rails to an evenlevel, fish plated and clamped themin the night hours quickly.

After carefully ensuring thesafety, they allowed the train to passat 04.40 hrs. with a restricted speedof 20 kmph. The alertness and thetimely action of the trackmanaverted a possible train mishap.

Career growth of Chemicaland Metallurgical AssistantGrade I & II-reg.

This issue of career growth ofChemical and Metallurgical Assis-tants Gr I&II has since been raisedby NFIR in the PNM for a at RailwayBoard’s level under Item No. 1/2011for over two years for getting justiceimparted to CMAs. There hasvirtually been no progress on theissue despite writing three letters bythe Federation quoted underreference. The issue has also beendiscussed by GS/NFIR with ED/EPC-II more than once but withoutpositive results and the PNM itemcontinues to be pending for overtwo years.

NFIR therefore, once againrequests the Railway Board tokindly see that suitable instructionsare issued to redress the grievanceof CMT staff. Federation may beadvised of the action taken.

Non-grant of ConsolidatedTravelling Allowance to theTicket Checking Staff on EastCoast Railway-reg.

As per extant instructionscontained in India RailwayEstablishment Code-Vol-II [(SectionIII/para 1605 (1) (2) & (3) ] Railwayemployees whose duties require himto travel extensively and are awayfrom Headquarters for performingRailway duties for 20 days or morein a month are eligible to receiveConsolidated Travelling Allowancewith the sanction of GeneralManager.

ECoRSC an affiliate of NFIR has

reported to the Federation that theseinstruction are not being adhered toon East Coast Railway. Federationfurther wishes to state that theECoRSC has raised the issue in theZonal PNM for payment ofconsolidated Travelling Allowanceto Ticket Checking Staff unfortuna-tely General Manager did not agree.

NFIR therefore, requests theRailway Board to issue instructionsto General Manager/Eco Railway tofollow codal provision and ensurepayment of ConsolidatedTravelling Allowance to the staff. Acopy of communication may beendorsed to Federation.

Placement of erstwshileGroup ‘D’ staff in PB-1+GP Rs.1800/- reg.

There have been cases ofRailway employees who were non-matriculates and while working inerstwhile Group ‘D’ categoriesduring the period from 5-9-2008 tothe date of completion ofappropriate training, have eitherretired/died in harness beforecompleting the formality of trainingfor placing them in GP Rs. 1800/-(PB-1). These former employeeshave not been extended the benefitof PB-1 with GP Rs. 1800/- with theresult they have been deprived ofpensionary benefits.

South Central Railway inparticular has instead of extendingbenefit to these former Group ‘D’employees pursuant to RailwayBoard’s instructions vide RBE No.162/10 and letter No. PC-VI/2008/I/3/1 dated 08/11/2010 has madea reference to Railway Board videletter No.P[R]/531/1 dated 8-03-2013 (copy enclosed), seekingclarification, the same is stillpending for over six months andthe former employees have beenmade to suffer.

NFIR, therefore, requests theRailway Board to issue suitableclarificatory instructions for

granting Grade Pay of Rs. 1800/-(PB-1) in the above situations.Suitable clarification be sent to GM/S.C. Railway in reply to his referenceduly endorsing copy to thisFederation.

Gyan Chand CLI/CNB/NC RailwaySuicide due toTerrible Pressurefrom Officers

Federation feels sad onhearing that Gyan Chand, ChiefLoco Inspector/CNB, NCRailway committed suicide on24th December, 2013. Thepreliminary enquiry made fromNCRES indicate that late GyanChand was under terriblepressure from the Officers and hewas not sanctioned even leave.Unable to bear the pressure, lateGyan Chand took recourse ofcommitting suicide.

References have been receivedfrom various Railway establish-ments seeking clarification whetherrelaxation in prescribed qualificationpermissible vide Board's letter ofeven number dated 9-12-2011 (RBENo. 166/2011) is applicable orotherwise to engagement ofSubstitute Bungalow Peons/Telephone Attendant cum DakKhalasi (TADK) on the Railways.

The matter have been examinedand it is clarified that relaxation ofminimum educational qualificationstipulated in letter of even number9-12-2011 does not cover substituteBungalow Peons/TADK.

Qualification for recruit-ment of staff from open marketin Pay Band-1 (Grade Pay:`̀̀̀̀1800).

Attention is invited to thisMinistry's letter of even numberdated 9-12-2010 wherein minimumeducational qualification for allrecruitments against direct recruit-ment quota through all modes hasbeen prescribed as 10th pass or ITIor equivalent.

The issue whether candidateswith 8th pass qualification and inpossession of qualification of CourseCompleted Act Apprenticeship,who are granted National Appren-ticeship Certificate (NAC) byNational Council for VocationalTraining (NCVT) can be consideredfor appointment/engagement toposts in Pay Band-1 (Grade Pay :`1800).

The issue has been examined inconsultation with DirectorateGeneral of Employment & Training(DGFT), M/o Labour & Employ-ment, Man Power Planning

The Ministry of Railway havedecided that henceforth minimumeducational qualification forrecruitment in Pay Band-1 of `5200-20200 having Grade Pay of`̀̀̀̀1800/- will be 10th pass or ITI orequivalent or National Appren-ticeship Certificate (NAC) grantedby NCVT. Revision of 1/3rd commutedportion of pension in respect ofGovernment servants who haddrawn lump sum payment onabsorption in Central Public SectorUndertakings/Central AutonomousBodies - Implementation of Govern-ment's decision on the recom-mendations of the 6th Central PayCommission.

The undersigned is directed tosay that orders have been issuedvide this Department's OM of evennumber dated 11-7-2013 for revisionof 1/3rd restored pension ofabsorbees w.e.f. 1-1-2006 bymultiplying pre-revised 1/3rdpension by a factor of 2.26, if it ismore beneficial than the revised 1/3rd restored pension as per thisDepartment's O.M. No. 4/38/2008-P&PW(D) dated 15-9-2008. Theseorders have been issued incompliance of the order dated 27-9-2011 of the CAT Hyderabad Benchin OA No. 710/2010 read with theirorder dt. 22-4-2013 in C.P. 26/2012.

Representations have beenreceived from the absorbeespensioners, who had taken lump-sum payment in lieu of 100% pro-rata pension on absorption that thebenefit allowed to the absorbeepensioners in terms of O.M. dated11-7-2013 is not adequate. Theserepresentations have been examinedin this Department. The main thrustof these representation is that the 1/3rd restored pension may be revisedw.e.f. 1-1-2006 by adding dearness

pension and dearness relief as on 1-1-2006 alongwith 40% fitmentbenefit to the pre-revised 1/3rdrestored pension.

The matter has been examined inthis Department. The instructionsfor revision of 1/3rd pension wereissued by this Department's O.M.no. 4/38/2008-P&PW(D) dated 15-9-2008, keeping in view the formulalaid down by Hon'ble High Court ofAndhra Pradesh in its judgmentdated 29-11-2006 abd 24-7-2007.Hon'ble CAT, Hyderabad Bench inits order dated 27-9-2011 in OA710/2010 inter-alia observed thatthe O.M. dated 15-9-2008 waslegally sustainable. However, theHon'ble CAT directed to pass anorder so as to equalize the revised1/3rd restored pension of absorbeeswith the revised pension of otherCentral Government pensioners.

Keeping in view the abovedirection of Hon'ble CAT, Hydera-bad Bench, which was upheld byHigh Court of Andhra Pradesh andSupreme Court, orders were issuedvide this Department's O.M. of evennumber dated 11-7-2013 ti revise 1/3rd restored pension of absorbeepensioners to 2.26 time of the pre-revised 1/3rd restored pension. Thisis explained by the followingexample:

Pre-2006 full Pension : 4073Pre-2006 1/3rd restored pension

: 3173Revised full pension (for DR,

etc.) : 9207Revised 1/3rd restored pension

in terms of OM dated 15-9-2008 :6492

Revised 1/3rd restored pensionin terms of OM dated 11-7-2013 :7173.

The above formula for revision of1/3rd pension is also in conformitywith the demand made by the staffside in the meeting of NationalCouncil (JCM) held on 6-11-2012.

In view of the above position, no

further change in the 1/3rd restoredpension of the absorbee pensioners(who had drawn lump-sum pay-ment of absorption in Central PublicUndertaking/Central AutonomousBody) is required to be made. All therepresentations made by theabsorbee pensioners and theirAssociations in this regard standdisposed off accordingly. AllMinistries/All Departments arerequested to inform the aboveposition to the absorbee pensioners.

Hostel facilities for singlewomen Railway Employees atall Divisional headquarters.

Following declaration by thethen Hon'ble Railway Minister inhis Budget speech (2013-2014) inregard to provision of hostelfacilities for single women Railwayemployees at all Divisionalheadquarters, the issue has beenconsidered by the full Board.

The Board has decided that thesingle women Railway employeesmay be provided with hostel facili-ties at all the Divisional head-quarters by making appropriatearrangement without any pay scalerestrictions.

For this purpose the zonalRailways may earkmark appro-priate number of Staff quarterswithout resorting to new construc-tions at appropriate locations andfurnishing those units with basicnecessities such as bare essentialfurniture, skeletal kitchen set up etc.Further, whenever new quarters aresanctioned, the first priority shouldbe given to women hostel.

Grant of full sets of PostRetirement ComplimentaryPasses (PRCP) after 20 yearsof Railway Service.

A Clarification was sought byone of the Railway/unit as towhether weightage of 5 years inqualifying service in PRCP onvoluntary retirement is to becontinued or not.

After careful examination,President is pleased to decide thatthe weightage of 05 years inqualifying service for PRCP onvoluntary retirement shall bediscontinued. Further it has alsobeen decided that Railway employeehaving Railway service of 20 yearsor more shall be allowed to get fullsets of PRCP. Accordingly columns1, 2 and item (viii) under column 3of Schedule IV (Post RetirementComplimentary Passes) of RailwayServants (Pass) Rules, 1986 (revisededition-1993) shall be amended asper ACS-74.

The revised provisions will beeffective from the date of issue ofthis letter.

In all other respects, the extantprovisions of the Railway Servants(Pass) Rules, 1986 (revised edition1993) shall continue to apply.

Smart Card Scheme -Committee Tenureextended

Ministry of Railways (Rly.Board) have decided to extendthe tenure of the Committee towork out and finalize a JointProcedural Order (JPO) forimplementation of ‘Smart CardScheme’ for retired Railwaybeneficiaries uniformly over allthe Railways to take treatment inan emergency in recognizedprivate hospitals, for a furtherperiod up to 31.01.2014.
