NOTICE OF DELEGATION OF POWERS IN RELATION TO THE LANDADMINISTRATION ACT 1997 (WA)(CKI)

I, Barry Haase, Administrator of the Territory of Cocos (Keeling) Islands hereby give noticethat Senator the Hon Fiona Nash, Minister for Local Government and Territories hasdelegated certain vested powers in relation to the Land Administration Act 1997 (WA)(CKI) tothe persons specified in Column 4 of the Schedule to the Land Administration DelegationInstrument 2016.

I. Revoke all previous directions, delegations, vesting and empowerment that have beenmade in relation to the Land Administration Act 1997 (WA)(CI), the LandAdministration Act 1997 (WA)(CKX», the Land Administration Regulations 1998(WA)(CI), the Land Administration Regulations 1998 (WA)(CKJ), the LandAdministration (Land Management) Regulations 2006 (WA)(CJ), and the LandAdministration (Land Management) Regulations 2006 (WA)(CKI).

II. Delegate under paragraph 8G(3)(b) of the Christmas Island Act 7W (the CI Act) andpamgmph 8G(3)(b) of the Cocos (Keeling) Isiwds Act 1955 (the CKI Act) the powersvested iu me under subsections 80(1) and 8G(2) of the CI Act and subsections 8G(1)and 80(2) of the CKI Act, as identified m Cohnm 2 of the Schedule to the personsspecified m Colums 4 of that item.

2 Commencement

TJhis instrument commences on the date that it is signed.

3 Definittons

Inthisinstnunent;

Admimsfrator in relation to the Territory of CI means the persoa appomted wider theAdminisimtion Ordinance 1968 and includes an acting Admuustrator or the DeputyAdministrator;

Administmtor m relation to the Temtory of CKI means tlie Administrator of th^tterritory appointed under the Administration Ordinance 1975 and includes an actingAdministrator or the Deputy Admioistrator;

CEO WA Department of lands means the Chief Executive Officer of the WAdepartment assisting the WA Minister in the Administration oHand;

CEO CI Shire means the Chief Executive Officer of the Shire ofCI, employed underthe Local Government Act 1995 (\VA)(CI);

CEO CKI Shire means the Chief Executive Officer of the Shiie ofCKI, employedunder the Local Government Act 1995 (WA)(CKI).

CEO WA Lan4 Infffrmafiffn Authonty means the Chief Executive Officer of the WALand Information Authority;

CZ means the Territory of Christmas Isl^d;

CI Act means tfae Christmas Island Act 1958',

CKl means the Territory ofCocos (Keeling) Islands;

CSlAct means the Cocas (Keeling) Islands Act 1955;

Classification Rules means the mles issued under section 23 of the Public Service Act1999 (Oh);Department means the Commonwealth Department having portfolio responsibility foradministration of the Territories ofCI sad CKI;

Indian Ocean Territories means the Territories of CI and CKI collectively;

Secretary mea&s the Secretaiy of the Department;

SJSS means an APS employee who is classified as an SES employee under section 8of the Public Service Classification Rules 2000;

Shire Council of Cl means the local government body of CI estabHshed under theLocal Government Act 1995 (WA)(CI) and the Local Government C^^nsithn)Ordinance 1992 (CI);

Shire Council ofCSI means the local government body ofCKI established under theLocal Government Act 1995 (WA)(CKI) and the Local Government C^wsition)Ordinance 1992 (CKI);

Team leader of the AFP at the CI police stftffon means the Team leader of theAustralian Federal Police at fhe Cl police gtatioa, employed under the AustralianFederal Police Act l979\

WA Lands Department means the Department having portfolio responsibility foradministration ofWA lands,

WA Land Infwmstion Authority means the body established by section 5 of^ the LandInformation Authority Act 2006 (WA);

WA Minister means the WA Minister principally respojusible for the admmistTatiou ofland m WA.

4 References to section or regulation

(1) Unless a contraiy intention appears, a reference to a section (or subordinate partof a section) in an item in the Schedule is a reference to the section (or subordinatepart of a section) in the Act refenred to in the iieading immediately preceding thatitem.

(2) Unless a contrary intention appears, a reference to a regulation (or subordinate partof 8 regulation) in an item in the Schedule is a reference to the regulation (orsubordinate part of & regulation) in the Statutory Rule refenred to m the headingimmediately preceding that item.

5 References to business division, branch, office or centre

Unless the confrary intention appears, a reference in the Schedule to a business division,branch, office or centre is a reference to such an organisational stmcture within theDepartment.

6 Delegations

(1) The delegation in each item in the Schedule is made under the delegation powerreferred to m colmnn 1 of that item.

(2) The delegates in each item are;

(a) the persons specified in column 5 of that item of persons acting in a positionusually occupied by a person specified in column 5 of that item; and

(b) Ac persons for the time being holding, occupymg or performing the duties ofthe positions specified in column 5 of that item.

Note Delegations may be described in the Schedule by employee dsssifioation or by positiondescription. Section 34AA and subsectiort 46(1) (where &pp!icable) of die Acts Interpretation Act1901 permit delegations as set out in this fastnnne&t to pefsoos acting in positicais.

(3) The delegates in each item are delegated wifh the function or power oftheMimsterunder the section or Reguiatioa mentioned in column 3 of that item.

(4) However, each delegation or vesting is made only to the corresponding limit (ifany) or subject to the directions (if any) specified in columa 3 of the relevant item,

7. Arrangements with the Government of Western Australia

(1) Under section 8H of the CI Act and the CKJ Act a WA official, WA Authority oremployee of an WA Authority is vested with the Commonwealth Minister'spowers under paragraph 8G(3)(a) where the Commonwealfh has signed anagreement with WA.

8. Kevocations

(1) Subject to subsection (2) below, all previous directions, delegations, vesting andempowetmeat of the Ministers powers or fonctions under the Applied Laws of theIndian Ocean Territories land admmistration lastrm^nt made oa 16 April 2009are revoked.

(2) For the avoidance of doubt this instrument does not revoke any iBstrument wliicli:

(a) authorises or appoints a person to be an authorised person or authorised officeunder any Act or Statutory Rule described in the Schedule; or

(b) states that if authorises a person to do a thing under an Act or Statutory Rule.
