I. Proposal
Proposal is invited from bidders for providing the services of experienced technical manpower
(Graduate Engineers) for various pipeline projects of M/s BPCL on contract basis for a period of 3
years( tentatively Oct 2019- March 2022). Presently services of Contract graduate Engineers will be
utilized in following pipelines:
Group-A:
1. Mumbai-Manmad Pipeline rerouting Project (Mumbai-SV5 Section) in Mumbai suburban area (ongoing)
2. Mumbai Refinery to Rasayni pipeline in the state of Maharashtra (Upcoming) 3. Manmad –Hazira Pipeline in the state of Maharashtra and Gujarat (Upcoming)
Group-B:
1. Irugur Devangonthi (Bangalore) POL in the state of Tamil Nadu & Karnataka (Ongoing). 2. Krishnapatnam- Ongole Hyderabad Pipeline in the state of Telangana and Hyderabad
(Upcoming)
Group-C:
1. Bina-Panki (Kanpur) POL Pipeline in the state of Madhya Pradesh & Uttar Pradesh
(Ongoing).
2. Piyala- Merrut Pipeline in the state of Harayana and U.P.(Upcoming)

Background:
BPCL Pipeline Projects Dept., under the aegis of Pipelines (Ops & Projects) presently is in process of
executing various pipeline projects in BPCL as mentioned above
Pipeline Projects dept. is an arm of BPCL to manage pipeline projects spread all over India and it
control, supervises all projects. Currently, all pipeline projects is managed by this dept. with its
manpower based at its office at Sewree, Mumbai and Site offices at respective pipeline execution
locations such as Mumbai, Bina, Kanpur, Irugur, Devnagonthi, Hyderabad, Krishnapattanam,
Manmad, Hazira, Piyala, Siliguri, Patna, Bokaro etc. With this Contract experienced technical
manpower (graduate Engineers) for Pipeline Project sites will operate with the hybrid structure
wherein both in house and outsourced resources work together in the project field.
II. SCOPE OF WORK
1.0 The scope of AGENCY'S SERVICES shall be to provide qualified and experienced Graduate
Engineers on contract basis as and when requested by BPCL, to assist BPCL in its Pipeline Projects
construction activities in different Project sites/ offices anywhere in India. An indicative list of
pipeline projects, Presently wherein the Agency will be required to deploy manpower is given below:-

a) The Schedule of Quantity for the services may be increased or decreased by BPCL at any time
in accordance with the provisions of this Contract.
b) AGENCY understands that BPCL is not bound or committed to utilise any specific number of
the AGENCY'S Graduate Engineers during the contract period, the requirements being purely
on as and when required basis.
c) The tentative requirement of manpower in different categories is indicative only and the
actual manpower to be deployed may vary from time to time.
2.0 Contract Graduate Roles & Responsibility :
Contract Graduate site engineers having full-time bachelor degree in Civil
Engineering/Mechanical Engineering from a recognized Indian University / Institute with minimum three (3) years’ experience in hydrocarbon sector preferably in Project Execution
works of Oil & Gas Pipeline will be deployed for executing following project activities.
a) Construction supervision of SV/IP stations etc. Each Project leader will have two (2) nos. contract Engineer for supervising works at SV & IP stations and DT/RT.
b) Supervision of Pre- project activities such as Reconnaissance survey, Detailed Engineering survey, Cadastral survey, field verification of Land statement / Maps for ROU acquisition etc. One (1) no. contract Engineer will be deployed for every 100-120 Km.
General Roles & Responsibilities applicable:-
The activities of scope mentioned in above clauses are only indicative and not exhaustive.
Provide timely and accurate information/reports as and when requested
Provide MIS to Management as and when needed
Attend training sessions as per the training plan of BPCL if required. During the training
period, the attendance of concerned person will be considered
Proactively seek guidance, clarification and feedback
Provide guidance, clarification and feedback to less experienced staff
Support both internal and external audits to ensure complete, timely and accurate
responses to information requests
Identify, communicate and work on opportunities for improvement on an ongoing basis;
Add to the knowledge management repository, particularly regarding resolution of issues
Contribute to a positive working environment by building relationships within the team.
Update self with the latest OISD, API and other applicable standards and use of same while
execution of the job.
Carry out the work execution plan as per ITP of the tender.
All other activities as required by BPCL management related to the project execution in time
bound & quality manner
Above is the minimum requirement mentioned for contract engineers deployed at project site.

6.0 NOTES FOR DETAILS OF WORK
i) The contractor shall act as an independent operating agency not as an agent/ employee of
BPCL. The contractor shall not appoint any sub-contractor to carry any obligations under
this Contract.
ii) The wages to be paid to the Contract Engineers should not be less than the minimum wages
for highly skilled manpower as per minimum wages published by Office of Labour
Commissioner which will be including Employers Contribution towards Provident Fund, ESIC, Bonus and as per the current applicable rate, Leave with wages, etc) and suitable documentary evidence on payments to the Contract Engineer to be submitted along with
monthly bill by vendor. Cost towards Lodging and boarding arrangement of the Engineers at the place of posting, incidental expenses etc. shall be included in the monthly payment
charges.
iii) In online price bid; The vendor has to quote two rates for each line item of all three Groups (Group-A,B &C) in the following manner :
a) Monthly wages to be paid to Contract Engineer (In INR); this should be equal or more
than minimum wages considered in this tender and has to be paid for each Contract Engineer.
b) Service charges per contract Engineer
For Monthly wages; In case any increase due to statutory hike in the minimum Wages
mentioned in this tender then the same shall be brought to notice of BPCL duly supported with documentary evidence of Notification issued by the Office of Labour Commissioner (central) for revising Minimum wages for payment. In case of variation in minimum wages rates, the increase
in minimum wages will be paid to vendor i.e (Revised Minimum wages amount-Minimum wages considered in this tender)
iv) All required stationery, computer, printer, office space required by these appointed Staffs will be provided by BPCL.
v) Contractor will arrange for graduate engineer as specified above. The contractor do all necessary procedure like obtaining of full bio-data / Copy of Educational Certificates, service record, credentials etc. duly verified.
vi) The hired staff will be interviewed / selected by BPCL for each location. The Contractor shall submit the eligible candidates/ nominations along with Curriculum Vitae and other supporting documents relating to educational qualifications, if required.
vii) The hired staff needs to move from place to place along pipeline route / ROU during the process of construction / execution / ROU Acquisition. Necessary conveyance will be provided by us for the movement of the staff. In case the person has to travel of his own, the actual fare will be reimbursed for traveling by train (max 3rd AC) / bus on production of receipts of travel. Outstation DA shall be payable extra to the contractor if staff is on outstation tour as mentioned in tender document.
viii) Requirement of manpower will be advised to the contractor at least 15 days in advance and service provider shall arrange the required manpower for interview within 7 days and placement of the manpower in maximum15 days.
7.0 WORKING HOURS OF HIRED STAFF :
The working hours for the hired staff shall be for 8 hours a day for 6 days a week. The timings
for the same would be generally from 9 A.M. to 06 P.M. from Monday to Saturday with suitable
lunch break. However, these timings may be changed without any overall impact on the period
of duty as per convenience or requirement of operation.
The personnel would get a day off every week (normally Sunday) along with National Holidays.
Working hours should be regulated so that there is no requirement of overtime. However, BPCL
reserves right to call the personnel on National / Gazetted holiday / Sunday depending upon the
work exigencies. .
A compensatory off will be provided to the individual in the succeeding weeks in lieu of the same
or proportionate additional payment will be made for attending office on Sundays / National
holidays, if compensatory off is not provided. Punctuality of staff is of very high important.
8.0 LEAVE :
The weekly off / holidays will be as per the offices of the BPCL. Personal provided will be entitled
for leave in line with BPCL leave.
One day’s leave shall be permissible to the hired personnel in a month. If a personnel remains
absent beyond the period of one day in a month, pay may be deducted on pro rata basis, if a
substitute is not provided for that period of absence. The facilities including leave etc. are
required under various legal provisions shall be adjusted by the outsourcing agency for
compliance.
9.0 SALARY PAYMENT DAY :
The period for the month of calculate salary will be 1st to last working day of the month. The
monthly payment to the outsourced personnel shall be made by the Contractor as per agreed
rates by 7th day of every month. In case, the 7th day happens to be a holiday or subsequent
days happen to be holiday, payment shall be made on the next working day.
The contractor must submit the monthly bill, complete in all respect by 10th day of subsequent
month along with certified details (by BPCL concerned staff) of the payment of salary made to
each employee as per quoted rate by contractor. Along with this bill, vendor shall also submit
the proof of statutory payments eg. PF/ESIC/Gratuity etc. for the previous month, E.g.: Bill for
the month of January 2020 to be submitted by (say) 10th February 2020 along with attested
copy of challans of EPF ,ESI etc. for contributions of the month of Dec 2019, which were
deposited in Jan 2020).
However the delay in payment to contractor due to deficiency in bill submission shall not affect
the salary payment on 7th of every month. A penalty of Rs. 500/- per day or as deemed fit by
employer may be imposed for non-payment of salary to the staff by due date.
10.0 COMPLIANCE BY THE AGENCY & AGENCY GRADUATE ENGINEERS:
10.1 All drawings, documents, data, specifications, standards, manuals etc. issued or made available to AGENCY's Graduate Engineers shall be used only for the performance of SERVICES as
explained to the AGENCY's Graduate Engineers and shall be returned by AGENCY's Graduate
Engineers to BPCL without retaining any copies thereof.
10.2 AGENCY'S Graduate Engineers shall follow the applicable safety rules of BPCL and be responsible
for the security and protection of any of BPCL's materials and equipment being used by AGENCY or its Graduate Engineers in the performance of the SERVICES and shall take all reasonable
precautions to protect such materials and equipment from loss or damage. AGENCY shall be held accountable for all such materials and equipment not consumed or used in providing the
SERVICES.
10.3 AGENCY and its GRADUATE ENGINEERS shall comply with the health, safety & security rules and
regulations of BPCL including any subsequent changes or instructions whenever applicable as
may be issued from time to time.
10.4 Unless otherwise specified in the Contract or agreed between the parties, AGENCY shall be solely
responsible for and, where applicable, shall provide at its own cost and expense all facilities as may be required for its Graduate Engineers to perform the SERVICES. Without prejudice to
AGENCY's responsibility to ensure that each of its employees satisfies all statutory and other
requirements to perform SERVICES assigned by BPCL. BPCL will, upon written request, provide
such assistance to AGENCY's Graduate Engineers deployed in BPCL as may be reasonably
required by them for arranging such facilities.
10.5 AGENCY shall have no claim for extra payment nor shall be relieved from its obligation under
the Contract as a result of any lack of knowledge as to the nature of the work site, local facilities, labour conditions and practices or similar matters affecting performance of the SERVICES.
10.6 If BPCL so demands in writing, AGENCY shall promptly remove from the performance of
SERVICES, at AGENCY's own cost, any of its Graduate Engineers who are not cooperative, are
careless or are not qualified to perform the work assigned to them or for any other reasonable
cause. AGENCY shall, at its own cost, provide acceptable substitutes, if so requested by BPCL. If
AGENCY desires to remove any of its Graduate Engineers for any reason whatsoever, he shall do
so only with prior consent of BPCL, at its own cost and only after providing suitable substitute
acceptable to BPCL.
10.7 If it is desired to discontinue the SERVICES of any of Graduate Engineers deployed by the AGENCY in BPCL, it will be so by giving 30 days’ notice on either side or by mutual consent. If, however,
discontinuance of any of AGENCY Graduate Engineers is considered necessary for reasons of unsatisfactory performance/ misconduct, no notice shall be required. BPCL may require his
replacement by a competent person at the cost of the AGENCY. No payment for travel for going
back, etc. shall be payable.
10.8 AGENCY shall keep full and detailed accounts and records of costs and charges relating to the
Contract. BPCL shall have the right to examine during business hours at all places where SERVICES are performed or relevant information is maintained, any document, accounts,
records, reports etc., which pertain to SERVICES in order to satisfy itself that:-
a) The charges made by AGENCY are properly computed in accordance with the provisions of
Contract.
b) AGENCY has complied with all agreed procedures.
III. SPECIAL CONDITIONS OF CONTRACT (SCC)
1.0 GENERAL
1.1 The contractors personnel deployed at BPCL premises shall be the employees of contractor for
all legal purposes and consequences.
1.2 The contractor shall nominate one coordinator in their office for this contract to coordinate with
the contract staff on regular basis.
1.3 Award of the Contract does not confer any right to any of the individuals involved in this contract
either directly or indirectly for a perpetual employment in BPCL in any capacity. The
agency/service provider/contractor shall be entirely responsible for the employment of its
labour/personnel and shall be liable for observance of all statutory provisions of Govt. No claim
of employment by the manpower engaged on the BPCL on whatsoever ground shall be
entertained.
1.4 The agency should fulfil all statutory provisions as per relevant laws.
1.5 The engagement of hired staff through the agency shall be purely on temporary basis. The
engagement of hired staff shall be based on the contract between BPCL and THE AGENCY.
1.6 No letter of appointment shall be issued by BPCL to any staff hired through the outsourcing
agency. The Contractor shall issue appointment letter at the time of initial appointment as well
as engagement letter on the contractor letter head to the deployed staff.
1.7 The staff hired through the agency in BPCL shall not have claim to any regular employment in
BPCL whatsoever. The staff employed by the agency are required to furnish an appropriate
affidavit non judicial paper to the effect that they will have no claim over BPCL regarding
extended / or consequential employment in the BPCL. No claim of employment by the
manpower engaged on the BPCL on whatsoever ground shall be entertained.
1.8 It shall be responsibility of the Contractor to issue the employment card with the Contractor
Company name/ photo identity card to the workers as per the prescribed format and maintain
the muster oil, the wage register and other registers as provided in the Contract Labour
(Regulation & Abolition) Act. Service Provider will ensure that all its employees invariably wear
ID card during office hours.
1.9 It shall be the responsibility of the agency to get the qualification, character and antecedents of
the staff verified including police verification before their induction. The agency must furnish
proof of such verification as and when demanded by BPCL but not later than two months, failure
to do so such is not acceptable and person will not be allow to work and proper replacement
has to be arranged with in a week. Failure to do so will invite penalty of Rs. 500 per staff per
week.
1.10 In case, any of the persons so deployed by the contractor is not up to the mark or does not
perform his duties properly or indulges in any unlawful riots or disorderly conduct, the
contractor shall immediately withdraw on the information of BPCL and take suitable action
against such person on the report of BPCL in this respect. Further, the agency will have to provide
suitable replacement within three days’ time with the intimation to the BPCL Authorities/
representatives.
1.11 The agency shall be responsible to verify the qualification and experience indicated by hired staff
in their profile. If during the course of engagement of any hired staff, it comes to the notice that
he/she has misrepresented the fact about his/her qualification/ experience etc., the concerned
staff shall be immediately discharged from the service. The agency will have to provide suitable
replacement within three days’ time.
1.12 It will be the responsibility of the outsourcing agency to ensure that the staff hired through the
agency shall at all-time maintain absolute integrity and devotion to duty and conduct himself in
a manner conductive to the best interests, credits and prestige of BPCL.
1.13 By virtue of the services with the BPCL, the agency and the staff hired through the agency will
come in possession of certain information and secrets related to BPCL which shall not be
divulged to any organization or individual. The agency shall ensure that complete confidentiality
is maintained by it and all the staff hired by BPCL with regard to all information relating to BPCL,
its premises, clients, business, assets, affairs and employees. Neither the agency nor its persons
shall at any time divulge or make known to any third party and trust, accounts, matters or
transactions whatsoever any information pertaining to BPCL and its associates entities which
may in any way come to their knowledge or attention.
1.14 The agency shall ensure that the staff should be in neat and clean uniform/dress. They should
be in good health, punctual, honest and well behaved. The agency will be responsible for
ensuring good conduct on the part of persons deployed. The person once engaged and is
working satisfactorily will not be substituted/replaced intermittently without permission of
competent authority /BPCL.
1.15 Persons suffering from contagious or infectious diseases shall not be deployed or permitted to
work in the BPCL premises. If the person deputed by agency/service provider/contractor
contract or develops any such disease during the currency of the contract, the
agency/contractor(s) / service provider may be asked by the BPCL to replace such person by
another suitable person. No extra charge for such replacement to be done by the agency
forthwith, shall however, be payable.
1.16 The work executed shall be to the satisfaction of BPCL representatives. Rate shall include all
incidental & contingent work, which although not specifically mentioned in the scope are
necessary for its completion in a sound and efficient manner.
1.17 BPCL, reserves the right to warrant services of lesser number of hired staff as per the situation
for which no claim shall be admissible. Pro – rata payment will be made if duration is less than
a month.
1.18 Each staff deployed shall maintain mobile phone for which no extra payment will be made.
1.19 For any employee leaving the service, agency will have to give a notice of at-least one month.
BPCL may at its discretion agree for a notice of similar duration in special circumstances. A no
dues certificate shall be taken from BPCL before the date of relieving, failing which any dues
shall be recovered from the agency
2.0 Validity :
2.1 The contract shall be valid for a period of three (3) years from the date of LOA of each Group-
A,B &C of this tender for job execution point of view. The quantities for contract graduate
engineer is tentative for three year contract period mentioned in SOR (Refer BOQ section of
tender) and these contract staff will be positioned progressively based on the requirement of
different projects at site & depending on the pace of project.
2.2 BPCL Administration also reserves the right to terminate the contract by giving one month’s
notice in case BPCL Administration desires to have its own arrangements.
2.3 BPCL Administration reserves the right of termination of the contract with immediate effect at
any stage of time in case service is not considered satisfactory. This will apply when the agency
fails to adhere by / comply with the special terms and condition(s) and / or the agency has not
been able to follow or comply the laws of statutory provisions of Central / State Government in
force or has / have breached any contract agreement condition.
2.4 In case of the termination of the contract on its expiry or otherwise, the person deployed by the
Service Provider shall not be entitled to any claim for absorption or any relaxation. The person
deployed by Service Provider shall be the employees of the Contractor for all purpose.
3.0 Liability against risks / claims:
3.1 Contractor shall be responsible to observe and comply with all applicable statutory
requirements including Contract Labor Act, Minimum Wages Act, applicable for the Central
Government PSU, ESIC Act, Bonus Act, etc. and rules as may be in force from time to time. BPCL
shall be kept indemnified against any action brought against it or any violation / noncompliance
of any Act / Acts. All expenses for compliance of above Acts & Regulations shall be borne by the
contractor. Contractor shall arrange for his personnel being deployed to cover sate accident risk
for his employee as per rules at his cost.
3.2 BPCL Administration shall not be responsible for any injury or loss of life or sickness of the
workmen or of any individual involved in the contract (deployed by the agency/service
provider/contractor) during the course of their duties or out of their duty hours. Any statutory
liabilities which may arise shall be to the agency / contractor(s) / service provider’s account. The
agency/service provider/ contractor shall take out and keep in force a policy and policies of
insurance against all liabilities and recognized risks in respect of accidents to persons employed
by the contractor for the purpose of carrying out the works of this contract. The agency / service
provider / contractor should note this provision especially in respect of staff deployed by him
and should take necessary insurance cover and safeguards against the recognized risks for his
worker / staff. Any compensation to the staff because of accidents in their duties will be payable
by the contractor to his workers / dependents.
3.3 The agency / service provider /contractor(s) shall be solely responsible for the compliance of
statutory regulations applicable to contractor labour as also other Central and State
Government Statutory regulations associated with works such as provision of Minimum Wages
Act, 1984, the Work Men Compensation Act, 1923 etc. No liability whatsoever shall attach to
the BPCL on account of or any failure on the part of the agency/service provider/contractor(s)
to observe these regulations.
3.4 PF & ESI of employers contribution, Bonus, Leave with wages will be paid to contractor as
minimum CTC (Minimum wages for each class) is inclusive of all these heads, but original
receipts/proof of PF & ESI of employer & employee contribution, Bonus, Leave with wages
should be submitted to BPCL office within 20 days of payment of original bill or due date of
payment as per prevailing labour Law’s, whichever is earlier. The contractor will submit the proof
of having deposited the entire due amount for EPF, ESI and payment of Bonus, Leave with wages
along with next bill.
3.5 Default in payment of these statutory requirements to the Statutory Authorities or submission
of proof to BPCL office then contractor is liable for penalty of Rs. 500/- per employee per month
for default period till the date of submission of proof to BPCL office in addition to penalties
mentioned in the labour Law’s. Further no payment regarding manpower services shall be paid
to agency.
3.6 Any damage, deterioration, loss caused to BPCL property due to negligence, carelessness on the
part of the workmen employed by the contractor, shall be made good by the contractor at his
own cost. If he fails to do this, BPCL shall be within their rights to affect necessary recoveries
from the Contractor’s bill or through other means as per the law.
3.7 The service provider will be responsible for timely disbursement of monthly wages including
statutory contribution towards PF& ESI to all personnel. This will be irrespective of the
contractor getting the payment from the Principal Employer or not.
3.8 BPCL Administration will not provide any residential accommodation for any of the person
deployed by the agency/service provider.
4.0 Rates :
4.1 The rates quoted as monthly wages needs to be paid to the Contract Engineers. Cost towards Lodging and boarding arrangement of the Engineers at the place of posting, incidental expenses
etc. shall be included in the monthly payment charges. of the Engineers. This quoted rates shall
be more than minimum wages for highly skilled manpower considered in this tender & in future also minimum wages published by Office of Labour Commissioner shall be base rates which will be including Employers Contribution towards Provident Fund, ESIC, Bonus and as per the
applicable rate, Leave with wages, etc).
For Monthly wages; In case any increase due to statutory hike in the minimum Wages mentioned in this tender then the same shall be brought to notice of BPCL duly supported with documentary evidence of Notification issued by the Office of Labour Commissioner (central) for
revising Minimum wages for payment. In case of variation in minimum wages rates, the increase
in minimum wages will be paid to vendor i.e (Revised Minimum wages amount-Minimum wages considered in this tender)
4.2 Service charges per contract Engineer shall be quoted by bidder
4.3 Further quoted Service charges shall be firm and final during the tenure of contract.
4.4 No contingent charges will be admissible for city/town of the normal place of working. However, for out station movements, the actual fare of the bus/train (Max 3rd AC) shall be reimbursed on submission of required documents/proof.
4.5 Daily allowance will be drawn only when staff is out of headquarter and stays outstation for night. If there is night stay at out station, the hotel accommodation charges maximum Rs.1500/-
shall be paid extra for hotel stay of contract Graduate Engineer against documentary evidence. Further for outstation stay daily allowance Rs.500/- per person shall be reimbursed against
documentary proof eg. Payment remittance to contract Engineer.
4.6 Goods & Service Tax, as admissible shall be reimbursed on submission of proof of depositing
the same to concerned Govt. Authority.
5.0 Variation :
5.1 The quantities for graduate engineer as provided against each Group-A, B & C is tentative for
three year contract period and these contract staff shall be positioned progressively based on
the requirement of different projects at site & depending on the pace of project.
5.2 Payment will be made as per actual manpower deployed in any particular month and no claims
shall be admissible due to either reduction or increase in total quantity of any particular item
either in a particular month or in total contract period.
6.0 Payments :
6.1 Payment of the salary to the contract staff shall be made through NEFT only. The service provider
should submit payment receipt of staff for last month along with monthly bill, without which bill
will not be entertained.
6.2 Emoluments of man-power are inclusive of employer’s contribution of PF & ESI, Bonus & Leave
with wages hence original receipts/proof of PF & ESI of employer & employee contribution,
Bonus, Leave with wages should be submitted to BPCL. The contractor will submit the proof of
having deposited the entire due amount for EPF, ESI and payment of Bonus, Leave with wages
along with next bill, failing which payment of the bill shall not be done.
6.3 On completion of the work to the satisfaction of BPCL Authority, as verified by the BPCL
Authority where the person deployed have rendered the stipulated services, the agency/service
provider/contractor shall be entitled for getting the due payments, by submitting their bills in
prescribed form to the BPCL duly certified by the authorized representative of BPCL as per actual
work done after necessary adjustment.
6.4 Payment will be made within seven (7) days of submission of bill with all supporting documents,
this will be effected after making required deductions towards taxes to be deducted at sources
as per extant rules/law in force.
6.5 In case, the agency/service provider/contractor(s) fails/ fail to provide the proper service(s)
during the period of contract, necessary deduction from the bill/s shall be made as under.
6.6 Against item mentioned in the schedule, one and a half time deduction shall be made per day
on pro-rata basis in the event of any service not having been rendered.
6.7 In case of difference of opinion regarding interpretation of any clause, the decision of BPCL shall
be final and binding.
