CLIENTS DO NOT KNOW WHAT IS POSSIBLE

The intense looking fellow on the cover is Dr. Kenneth Manges PhD. He is a Forensic Psychologist; meaning that he has a long career as a specialist, in psychological issues and cases, as they apply to a court of law. This includes getting inside the minds of mass-murders!

NEED FOR A BETTER WEBSITE:DDr. Manges came to me with a need for a much more extensive and pro-fessional website. He needed something that would show him involved, and help explain, the various activities and places of his unusual profes-sion. He naturally assumed this would require extensive location shoot-ing with all of the accompanying logistics and permissions. In other words; lots of time and money!

CONTEMPT OF COURTFortunately for Dr. Manges some of my least favorite places are court-rooms, municipal law buildings and jails. My contempt of court, together with my early background in photo-journalism and the wizardry of com-puter assembled images would provide a unique solution to his needs.

LOCATION IN THE STUDIO:I proposed to do all of the shooting in my studio. I would combine the action photos and dropped in backgrounds to produce an over-all, film-noir, photo-story feel. A mood reminiscent of a late 1950’s black and white tel-evision courtroom drama. After all; this was the core of the public’s col-lective imagination on the subject.

In the end we produced exactly what Dr. Manges needed and wanted; for a fraction of the time and cost he had originally expected.

Webster defines “forensic” as “belonging to, used in, or suitable to courts of law.” Because the term “forensic” is often used today in TV crime show investigations and dramas, there sometimes is confusion in the general population that “forensic” is a term that relates specifically to crimes, which is not the case. Instead,“forensic” should be understood to mean “helpful in court cases,” rather than pertaining to crime.

BasedBased on this definition, there are many types of professionals who may be considered “forensic professionals,” such as psychologists, economists, and pathologists. Forensic professionals with different specialties can be helpful to legal counsel when their area of expertise is required.

Although not every profession has a specialty in forensics, there are many expert witnesses in different professions who have been qualified to testify before a jury, thereby making them de facto forensic specialists.

TheThe psychology profession, however, has recognized forensics as a sub-specialty. As a consequence, standards of care and ethical guidelines have been adopted governing forensic psychology. For example, the Forensic Psychologist can be called upon to opine about etiology (disease causation), casualty, and or temporal relationships between a plaintiff’s as-sertions and the objective findings. Sometimes, as you might suspect, the Forensic Psychologist’s opinion may not support the plaintiff’s assertions.

In cases where the issue is of a criminal nature the focus may range from competency of the defendant to stand trial, influence of mitigating factors for the offense during the sentencing phase, not guilty by reason of insani-ty, personality assessment of the defendant, and prediction of violence and assessment of future risk to name a few areas.

Psychological experts must be licensed to practice. In most venues they are expected and demanded to have a clinical practice or to be an academi-cian teaching in the area they are testifying about and not have any thera-peutic relationship with the person they are evaluating. The psychologist will consider the person’s present condition and past conditions /learn-ing/trauma that may have influenced their condition.

TESTIMONY

Within the litigation arena there are multiple experts that are called upon to assist the trier of fact (the juror) or the judge. Typically a psy-chological expert is called based on their area of focus for the case being litigated. In civil cases some of the areas of focus are: emo-tional trauma (after an injury or attack by an assailant); ability to function after a head injury (cognitive or memory issues); evaluation of a child in a custody matter, and developmental issues (diagnoses related to abuse in children such as sexual trauma).

In cases where the issue is of a criminal nature the focus may range from competency of the defendant to stand trial, influence of mitigat-ing factors for the offense during the sentencing phase, not guilty by reason of insanity, personality assessment of the defendant, and pre-diction of violence and assessment of future risk to name a few areas.
