-------------------------------------------------------------------------------------------------------------------------- As Railway administrations are aware, in terms of extant rules/instructions every event in a Government servants’ official life must be recorded in his Service Book and each entry is to be attested by the Head of Office. 2. An extract of Paras 1234 and 1235 of the ‘ Indian Railway Administration and Finance Code’ which provides that the Heads of offices are to obtain signatures of the Railway servants in token of them having inspected their Service Books annually is reproduced below:- “1234. 1235. The scrutiny of his Service Book by the railway servant concerned must be made in the presence of a responsible official. As a token of his scrutiny and acceptance of entries in the Service Book, the railway servant should sign in the relevant column of the Service Book and the official who supervised the scrutiny will also endorse his signature as evidence that scrutiny was conducted under proper supervision and the supervising officer is satisfied that it was bona fide and no unauthorized changes were made in the entries in the Service Book in the course of such scrutiny.” 3. Furthermore, Rule 47 of the Railway Services (Pension) Rules, 1993 provides for issuing a communication on completion of 18 years of service and five years before retirement, as part of preparatory work for sanctioning pensionary benefits. 4. Besides aforesaid directives, pursuant to Government of India’s instructions, it has also been decided that Aadhaar numbers of all Railway Servants should be included in their Service Book. 5. Therefore, all Zonal Railways/Production Units etc. are directed to ensure that the Service Book of all the employees have an entry of the employee’s Aadhaar number. Immediate necessary action in this regard may please be taken and the number of employees whose Service Books have been seeded with their respective Aadhaar number may be intimated to Board’s office within a month’s time. 6. In this connection, attention of Zonal Railways is invited to Board’s letter No.2015/ED/ERP/UIDAI/01 dated 21-07-2016 wherein Railways/Production Units were directed to arrange for Aadhaar numbers and field units are expected to have taken action already. 7. This issues with the concurrence of the Finance Dte.

-------------------------------------------------------------------------------------------------------------------------- Sub: Aadhar Enrolment Scheme. Ref: D.O.letter No.2015/ED/ERP/UIDAI/01 dated 20-05-2016 -------------------------------------------------------------------------- Please call for Member Staff’s D.O. letter under reference vide which Railways were asked to expedite the process of Aadhar enrolment of Railway employees and their dependants and to collect the details for office record. From the information furnished by the Railways for May 2016, it is seen that we have collected over 5 lakh Aadhar numbers for the employees and a similar number for their family members/dependants. For the retired employees and their dependants, another 1.5 lakh Aadhar numbers have been collected. In this regard while some Railways such as CR, NWR, NR, SCR, WCR and WR have performed well, remaining Railways need to activate their machinery for achieving the target. Simultaneously, in order to update the employees’ records, Railways may start seeding the employee database in ComPTran portal with Aadhar Nos. of the employees and their dependants so that these figures can be ported to Centralised Employee Database to be created under HRMS. In case of any technical difficulty in updating the data in ComPTran portal, CPO/S.E.Rly. who is the Administrator of the portal, may be contacted.

Sub: Seeding of Aadhaar number in Employees’ Master Data. --------------------------------------------------------------------------- It has been decided by Railway Board to have the aadhaar number of the Railway

employees seeded in the employees’ Master data in order to maintain a better quality in the disbursement of payments made to the employees. In this regard, Member Staff has already directed all the Railways to expedite the process of Aadhaar enrolment of Railway employees and their dependants vide his D.O. letter no. 2015/ED/ERP/UIDAI/01 dated 20-05-2016. This was followed up by AM/Staff to update the employees records in ComPTran Portal vide letter No. 2015/ED/ERP/UIDAI/01 dated 21-07-2016 (copy enclosed).

It is, therefore, requested to make necessary arrangements to obtain the aadhaar number

of the employees on roll on your Railway and ensure that Aadhaar number is seeded in the Employees’ Master (database) available on your Railway by 31-03-2017. This may be got entered in the employees data base being maintained in IPAS.

During the recently held meeting, it was brought to the notice of Board by some of the

Railway pension disbursing banks that Aadhaar number is not being indicated in many of the PPOs being generated currently. It is requested that special emphasis may be given to indicate this information in all the PPOs generated invariably. Data so collected from Banks may also be progressively transmitted to Western Railway so that the aadhaar number may be seeded in ARPAN portal in respect of pensioners.

The above instructions should be scrupulously followed.

5. Hydraulics & Hydrology (a) Hydraulics -

Elements of hydraulics – Open Channel flow; flow in pipes; frictional loss, empirical formulae.

(b) Hydrology Rainfall and run-off; rainfall statistics; rain gauges, run-off calculations by empirical

methods, flood discharge estimation; measurement of flood discharge –current meter.

(c) Hydraulics structures

Design of bridges – alignment, number of spans; economic spans; waterway calculations; scour depth afflux; clearance; depth afflux; clearance; depth of foundations; BOX and Pipe Culverts, river training works-spurs, groynes, aprons, levees. Water way calculations (i.e. estimation of design discharge based on para 4.3.4 of sub structure code namely using RDSO report RBF-16 for catchment size less than 25 sqkm and using flood estimation report (Synthetic unit hydrograph concept) for catchment size 25 sqkm to 2500 sqkm). In the sub topic river training works the following should be added. Guide bunds including launching aprons & protection works “ drop wall & curtain wall i.e. protection measures for minor bridges).

6. PUBLIC HEALTH ENGINEERING a) Water Supply i) Standards of Quality of drinking water-physical, chemical and bacteriological standards of

water; water-born diseases; water demand – methods of forecasting; sources of water; Method of treatment of water – aeration, sedimentation, filtration (slow and rapid sand filters); disinfection, hardness – methods of removal.

ii) Conveyance and Distribution:- Preparation of Schemes for New Water Supply/Augmentation of Existing Water Supply;

Estimating Requirements of Water; Types, Selection & Installation of Pumps; Capacity of Pumping, Conveyance of Water; rising mains; systems of distribution, residual pressure; different types of pipes and fittings; testing of pipes, Pipe Laying and Fitting of Valves and Meters. The undersigned is directed to say that in pursuance of Government’s decision on the recommendations of Seventh Central Pay Commission, orders have been issued for revision of pension and disability pension of pre 2016 pensioners/disability pensioners, vide this Department’s OM No. 38/37/2016-P&PW(A)(ii) dated 04-08-2016. As per para 4.1. of the OM dated 04-08-2016, the existing pension/family pension is to be multiplied by 2.57 and the amount of revised pension/family pension so arrived at shall be rounded off to the next higher rupee. As per para 4.4 of the OM, it was indicated that the upper ceiling of pension and family pension will be 50% and 30% respectively of the highest pay in the Government, i.e. Rs.2,50,000/-. 2. A doubt has been raised whether the above ceiling would also be applicable to disability pension/family pension under CCS(EOP) Rules. Pension/family pension under CCS(Pension) Rules is calculated @ 50% / 30% of the last pay drawn or average emoluments for last 10 months, whichever is more beneficial to the pensioner/family pensioner. Disability pension and family pension, under CCS(EOP)Rules is more than 50% / 30% of last pay / average emoluments on account of the disability element. Therefore, it is clarified that the ceiling of pension/family pension indicated in para 4.4 of Department of Pension and Pensioners Welfare OM dated 04-08-2016 referred to above is applicable only in the case of pension/family pension under CCS(Pension) Rules and will not apply in the case of disability pension/family pension under CCS(EOP) Rules.

To make the Direct Benefit Transfer on Cash Awards implemented in Railways the Zonal Railways/Production Units. Etc the following may be ensured:

(i) The award amount should be transferred to the employees Bank Account linked to Aadhar or cheque.

(ii) The maximum upper limit for any type of Cash Award to an individual would be

restricted to Rs.5,000/- only and there should be a gap of at least three years before another Cash Award is granted to the same employee as laid down in Office Order No.31 of 2004 (copy enclosed).

2.1 This will however not be applicable in the case of:

(i) Awards given to: Sports persons, Scouts, Innovations/Inventions, Acts of Bravery, Averting accidents, Security and Safety measures.

(ii) Any other exceptional case to be decided by the General Manager.

Copy of Railway Board’s Office Order No.31 of 2004 (endorsement No.2004/O&M/12/1 dated 16-07-2004) is as under: -------------------------------------------------------------------------------------------------------------------------------- The guidelines for grant of individual awards to officers/staff of Board’s office have already been issued vide Office Order No.44 of 2000 (copy enclosed). However, the issue of guidelines for grant of Group Cash Award(s) to the officers/staff of Board’s office has been under consideration for sometime. After detailed consideration it has now been decided that henceforth the following guidelines should be followed while sanctioning Group Cash Award(s):

(a) The maximum upper limit for any type of Cash Award to an individual would be restricted to Rs.5,000/- only.

(b) The Group Award should be recommended/sanctioned only in case of some

exceptional/exemplary work having been done by a group of officials. The details of such exceptional/exemplary work should also be mentioned while sanctioning the award.

(c) While recommending the names for Group Cash Awards, the specific amount to

be given to an individual should invariably be indicated. In the case of Group Awards announced on the spot by the Board Members and Ministers, a list containing the name of each awardee along with the amount of the award to be given to him/her should be submitted to the concerned authority at the time of seeking formal approval.

(d) There should be a gap of at least three years before another Cash Award is granted

to the same employee. This condition of three years ‘gap would henceforth be applicable for all types of Cash Awards viz. Monthly Award, Group Award, Award recommended by Board Members, CRB and Ministers. However, in the case of awards sanctioned by AMs, DGs, Secretary, Railway Board, Board Members and CRB at the time of their retirement and by the Ministers at the time of their demitting office the condition of three years gap would be relaxed to one year.

(e) Henceforth, it should be ensured that each Awardee in a Group Award is clear from

DAR/Vigilance angle and that there is no adverse entry in the last two years ACRs. (f) The details of the specific activity for which the award has been sanctioned would

be indicated in the Merit Certificate to be given to the Awardees.

Consequent upon acceptance of the recommendations of the Seventh Central Pay Commission by the Government, M/o Railways vide letter No.PC-VII/2016/1/7/2/1 dated 11-11-2016 (RBE No.131/2016) had issued orders on rate of Dearness Allowance (DA) payable to Railway employees based on the revised pay structure (7th CPC) that came into effect from 01-01-2016. 2. The above rate, however, is not applicable to those Railway employees who had exercised an option to continue in the pre-revised scale of pay based on 6th CPC’s recommendations or to those whose pay and allowances had not been revised, for different reasons. 3. The rate of DA w.e.f. 01-01-2016 for Railway employees in pre-revised scale of pay, were issued by M/o Railways vide letter PC-VI/2008/1/7/2/1 dated 08-04-2016 (S.no. PC-VI/364, RBE No. 32/2016) 4. Accordingly, the rate of DA admissible to Railway employees who continue to draw their pay in the pre-revised pay band/grade pay as per 6th CPC recommendations, shall be enhanced from the existing 125% to 132% w.e.f. 01-07-2016. 5. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Ref: Board’s letter No.2012/H-1/12/1/Dental/Policy dated 13-10-2014 ------------------------------------------------------------------------------------------- Sanction of the Ministry of Railways has been accorded for the arrangement relating to provision of reimbursement of expenditure incurred on the Dental treatment by Railway beneficiaries and the last sanction was for a period upto 11-09-2016 vide this office letter of even no. dated 13-10-2014 on the same terms and conditions. Ministry of Railways have now decided to extend the aforesaid arrangement, further for a period of one year from 12-09-2016 till 11-09-2017. “However, this facility would stand withdrawn automatically in case any Railway hospital/health unit is provided with part time/ full time dental surgeon and infrastructure facilities. “ It may be ensured that re-imbursement may be made to CGHS approved dental procedures and rates only and Zonal Railway may reimburse the expenditure incurred on other dental procedures which are not included in CGHS list, if done at the nearest Government Dental College/Hospital as per the charges levied by such institutions (this should not include material and lab charges from outsourced private agencies). In all cases whose re-imbursement has been sanctioned beyond the prescribed condition, responsibility may be fixed at railway’s level, without fail, in each case. This issues with the concurrence of the Finance Dte. of the Ministry of Railways.

Sub: Fixation of pay of re-employed pensioners – Treatment of Military service Pay

The undersigned is directed to refer to the orders issued vide OM dated 5.4.2010 on fixation of pay of re-employed pensioners.

These orders inter-alia lay down that on re-employment in civilian organizations, Military

Service Pay shall not be admissible. However, the benefit of MSP given to all retired Defence Forces officers/personnel by reckoning it at the time of calculation of their pension (notionally in the case of pre-1.1.2006 pensioners) should not be withdrawn.

Accordingly, while the pension of such re-employed pensioners will include the element of

MSP, they will not be granted MSP while working in civilian organizations.

In the instructions issued by the Ministry of Defence vide their letter No. 1/69/2008/D(Pay/Service) dated 24th July 2009, Pre-retirement pay has been defined as under:

(i) In respect of re-employment taking place on/or after 1.1.2006 pre-retirement pay for those who retired after 1.1.2006 means the pay in the pay band plus grade pay but inclusive of Non-Practicing Allowance (NPA) if any, last drawn before retirement.

(ii) In case of officers who retired before 1.1.2006 and also those who retired after

1.1.2006 in the pre-revised pay scales without opting for the revised pay scales promulgated on or after 1.1.2006 the pay will be basic pay including stagnating increment and Rank pay plus the Dearness pay and Dearness allowance drawn at the time of retirement.

As per these orders, for pre-2006 retirees rank pay is included as a part of pay but for post

-2006 retirees, the MSP is not reckoned in the pre-retirement pay for the purposes of pay fixation on re-employment. However, for pension purposes the reckonable emoluments are – basic pay + grade pay + MSP + NPA wherever admissible.

Therefore, while MSP is not taken into consideration for the purposes of pay fixation on re-

employment, the element of MSP in pension is deducted.

It has been decided in consultation with the Department of Expenditure, that since the element of MSP is not reckoned in the pay fixation on re-employment, it need not be reduced from the pension either.

Hence, In respect of all those Defence officers/personnel, whose pension contains an

element of MSP, that need not be deducted from the pay fixed on re-employment.

-------------------------------------------------------------------------------------------- The undersigned is directed to say that subsequent to implementation of the decision taken by the Government on the recommendation of the 7th Central Pay Commission, the President is pleased to decide that the Dearness Relief admissible to Central Government pensioners/family pensioners shall be as follows:

Note:- Dearness Relief at the rates indicated in the above table will also be admissible on the additional basic pension/additional family pension available to older pensioners/family pensioners based on their age as indicated in this Department’s OMs 38/37/2016-P&PW(A)(i) dated 04-08-2016 and 38/37/2016-P&PW(A)(ii) dated 04-08-2016. 2. These orders apply to (i) Civilian Central Government Pensioners/Family Pensioners (ii) The Armed Forces Pensioners, Civilian Pensioners paid out of the Defence Service Estimates, (iii) All India Service Pensioners (iv) Railway Pensioners/family pensioners. 3. These orders will not be applicable on following categories:-

(i) The Burma Civilian pensioners/family pensioners and pensioners/families of displaced Government Pensioners from Pakistan, who are Indian Nationals but receiving pension on behalf of Government of Pakistan and are in receipt of adhoc ex-gratia allowance. (ii) Central Government Employees who had drawn lump sum amount on absorption in a PSU/Autonomous body and are in receipt of 1/3rd restored commuted portion of pension. (iii) Pensioners who are in receipt of provisional pension in the pre-2016 pay scales/pay. (iv) CPF beneficiaries, their widows and eligible children who are in receipt of ex-gratia payment in terms of this Department’s OM No. 45/52/97-P&PW(E) dated 16-12-1997 and revised vide this Department’s OM 1/10/2012-P&PW(E) dated 27-06-2013.

Separate orders will be issued in respect of the above categories. 4. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee. 5. Other provisions governing grant of DR in respect of employed family pensioners and re-employed Central Government Pensioners will be regulated in accordance with the provisions contained in this Department’s OM No. 45/73/97-P&PW(G) dated 2-7-1999 as amended vide this Department’s OM No.F.No. 38/88/2008-P&PW(G) dated 9th July, 2009. The provisions relating to regulation of DR where a pensioner is in receipt of more than one pension will remain unchanged.

6. In the case of retired Judges of the Supreme Court and Higher Courts, necessary orders will be issued by the Department of Justice separately. 7. It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case. 8. The offices of Accountant General and authorized Pension Disbursing Banks are requested to arrange payment of relief to pensioners etc. on the basis of these instructions without waiting for any further instructions from the Comptroller and Auditor General of India and the Reserve Bank of India in view of letter No.528-TA, II/34-80-II dated 23-04-1981 of the Comptroller and Auditor General of India addressed to all Accountant Generals and Reserve Bank of India Circular No.GANB No.2958/GA-64 (ii) (CGL)/81 dated the 21st May, 1981 addressed to State Bank of India and its subsidiaries and all Nationalised Banks. 9. In their application to the pensioners/family pensioners belonging to Indian Audit and Accounts Department, these orders issue after consultation with the C&AG. 10. This issues in pursuance of instructions of Ministry of Finance, Department of Expenditure vide their OM No.1/2/2016-E.II(B) dated 4th Nov, 2016.

In partial modification to this office letter of even no. dated 25-11-2016 (RBA No.90/2016) copy of which is enclosed, it is clarified that payment of DA to Running Staff shall be admissible on the Basic Pay plus 30% add on pay element as per extant rules. An illustration of this is as shown below:- a) Basic Pay of running staff as per VII CPC pay matrix = Rs.1000/-

b) Add on pay element as per rule 904 & 924 (i) (i) of IREM-I (30% of Basic Pay) = Rs. 300/-

c) Total notional Basic Pay of running staff (a + b) = Rs.1300/-

d) DA admissible for running staff = prescribed percentage i.e. 2% per month w.e.f. 1-7-2016 on (c) above.

2. CRIS may incorporate the above rule in IPAS application, so that payroll of running staff could be drawn accordingly, Excess payment made, if any, as per RBA No.90/2016, may be recovered from the concerned staff. 3. This issues in consultation with Pay Commission Dte and concurrence of the Finance Dte of this Ministry.

The issue regarding admissibility of DA on Running Allowance paid to Running Staff has been examined in this Ministry and it has been decided that DA @ 2% shall be admissible to Running Staff on the Basic pay plus Running allowance drawn w.e.f. 1st July, 2016. 2. CRIS may incorporate the above rule in IPAS application, so that payroll of running staff for November, 2016 could be drawn accordingly. 3. It may please be ensured that Salary Advance of Rs.10000/- paid to Non-Gazetted employees in terms of Railway Board’s letter No.2016/E(LL)/APW/1 dated 17-11-2016 is recovered from the concerned staff in salary bill of November’ 2016. Detailed instructions for filling up the post of Crew Controllers/Power Controllers were

issued vide Board’s letters dated 09-01-1998 & 26-03-2009. These instructions were subsequently superseded vide Board’s letter dated 12-11-2012 read with corrigendum dated 28-01-2013.

Arising out of certain doubts in regard to the revised procedure to be followed it was

directed by Board vide the letters dated 27-03-2014 & 23-07-2014 that the instructions issued vide Board’s letter dated 12-11-2012 & 28-01-2013 should be kept in abeyance till final decision is communicated.

Therefore, Board have reiterated instructions that Loco Inspectors cannot be posted as

Chief Crew Controller and advised that the procedure enumerated in the letters dated 09-01-1998 & 26-03-2009 should be strictly followed.

Necessary action may please be taken immediately.

Some of the Zonal Railways had sought clarification on the issue of filling up the post of Loco Running Supervisors. 2. In terms of Railway Board’s letter of even no. dated 27-03-2014 & 23-07-2014, it was advised that the issue of filling up the posts of Crew Controllers/Power controllers etc. is under consideration in consultation with the Mechanical and Finance Directorate of Railway Board and as soon as the matter is finalized suitable instructions shall be issued from the Establishment Directorate of Railway Board. It was also advised to strictly follow the extant instructions contained in Board’s letter dated 09-01-1998 and 26-03-2009 in this regard. 3. It has come to notice that some of the Zonal railways have posted Loco Inspectors to the posts of Chief Crew Controller as per Board’s letter dated 12-11-2012 which has been kept in abeyance. Therefore, it is once again reiterated that instructions contained in Board’s letter dated 27-03-2014 and 23-07-2014 may be strictly followed.

OFFICE MEMORANDUM Sub: Declaration of Assets and Liabilities by public servants under amended Section 44 of the Lokpal and Lokayuktas Act, 2013 – reg. ---------------------------------------------------------------------------------------------- The undersigned is directed to refer to this Department’s O.M. of even number dated 29th July, 2016 (copy enclosed) regarding the furnishing of information relating to assets and liabilities by public servants under section 44 of the Lokpal and LokayuktaS Act, 2013 (the Act). 2. In this regard it is stated that with the passing of the Lokpal and Lokayuktas (Amendment) Act, 2016 (copy enclosed), the Public Servants (Furnishing of Information and Annual Return of Assets and Liabilities and the Limits for Exemption of Assets in filing Returns) Rules, 2014 and all the amendments made thereto have become redundant. 3. The Lokpal and Lokayuktas (Amendment) Act, 2016, as referred to above, substitutes the provision of Section 44 of the Principal Act by the following new provision:- “44. On and from the date of commencement of this Act, every public servant shall make a declaration of his assets and liabilities in such form and manner as may be prescribed.” 4. Thus, under the Public Servants (Furnishing of Information and Annual Return of Assets and Liabilities and the Limits of Exemption of Assets in Filing Returns) Rules, 2014, there is no requirement for filing of declarations of assets and liabilities by public servants now. The Government is in the process of finalizing a fresh set of rules. The said rules will be notified in due course to prescribe the form, manner and timelines for filing of declaration of assets and liabilities by the public servants under the revised provision of the said Act. All public servants will henceforth be required to file the declarations as may be prescribed by the fresh set of rules.

No.37 OF 2016 An Act to amend the Lokpal and Lokayuktas Act, 2013. Be it enacted by Parliament in the Sixty-seventh year of the Republic of India as follows:- 1. (1) This Act may be called the Lokpal and Lokayuktas (Amendment Act, 2016. (2) It shall be deemed to have come into force on the 16th day of January, 2014. 2. On and from the date of commencement of the Lokpal and Lokayuktas Act, 2013

(hereinafter referred to as the principal Act), for section 44, the following section shall be substituted, and shall be deemed to have been substituted, namely:-

“44. On and from the date of commencement of this Act, every public servant

The question of fixation of pay of medically decategorised running staff for the period from the date they are declared unfit till their final absorption in alternative appointment i.e the period during which they are kept on supernumerary posts for want of suitable alternative posts was addressed by Board vide instructions issued under Estt.Srl.No.161/2011. It was also stated therein that the instructions for fixation of pay of medically decategorised running staff on their absorption in suitable alternative posts will be issued separately. The matter has been considered by Railway Board and it has been decided that whenever a medically decategorised running staff governed by RS(RP) 1993, who has rendered the prescribed qualifying service, opts for Voluntary Retirement either on his own or within a period of one month from the date of offer of the first alternative post, his pension may be computed with additional 55% Pay Element. This 55% benefit will be reckoned after deducting the 30% Pay Element fixation benefit if granted already as per Board’s letter dated 05-10-2011 referred to above. The period of one month to opt for Voluntary Retirement for those medically decategorised running staff, who have already been offered the alternative posts, will start from the date of issue of this letter. and decide to take Voluntary Retirement instead of opting for redeployment in an alternative stationary post. 2. The issue has been examined in Board’s office, and it is observed that the issue is governed under the provisions contained in Board’s letter referred to above. To address the specific aspect brought out by Federations, it has been decided that whenever a medically decategorised running staff governed by RS(RP) 1993, who has rendered the prescribed qualifying service, opts for Voluntary Retirement either on his own or within a period of one month from the date of offer of the first alternative post, his pension may be computed with additional 55% Pay Element. This 55% benefit will be reckoned after deducting the 30% Pay Element fixation benefit if granted already as per Board’s letter dated 05-10-2011 referred to above. 3. In case such staff does not give option of Voluntary Retirement within the outer limit period of one month specified herein above, it will be deemed that the staff has accepted the alternative appointments offered and in this case, retirement benefits will be governed by extant instruction on the issue whenever he superannuates or opts for Voluntary Retirement thereafter. 4. The period of one month to opt for Voluntary Retirement for those medically decategorised running staff, who have already been offered the alternative posts, will start from the date of issue of this letter. 5. The above clarification shall take effect from the date of issue of this letter. 6. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.
