INTRODUCTIONTermsandConditions/DefinitionsfortheNetSpendVisaPrepaidCardThis document constitutes the agreement (“Agreement”) outlining the terms andconditionsunderwhichtheNetSpendVisaPrepaidCardandtheNetSpendVisaVirtualAccounthavebeenissuedbyBofIFederalBank,SanDiego,California(“BofIFederalBank”or“Issuer”).TheIssuerisanFDICinsuredmemberinstitution.“CardAccount”meanstherecords wemaintain to account for the transactionsmade with your Card or VirtualAccount.“AccountNumber”meansthe10-or16-digitnumberusedtoidentifyyourCardAccount. “Card”meanstheNetSpendVisaPrepaidCardissuedtoyoubyBofIFederalBank.“CardNumber”isthe16-digitnumberembossedonyourCard.“VirtualAccount”meansatemporaryaccessdeviceissuedtoyoubyBofIFederalBankthatyoumayelectto obtain to access your Card Account for telephone or online transactions, withoutneedingtopresentyourCard.“We,”“us,”and“our”meantheIssuer,oursuccessors,affiliatesorassignees.“NetSpend”referstoNetSpendCorporation,theservicerfortheNetSpendVisaPrepaidCardprogramandNetSpendVisaVirtualAccountprogram,anditssuccessors, affiliates, or assignees. Any request for a Card or Virtual Account will beprocessedbyNetSpend,actingonbehalfof the Issuer,at itsoffices located inAustin,Texas.NetSpend isaregisteredagentofthe Issuer. “You,”“your,”“Cardholder,”and“PrimaryCardholder,”referstothepersonwhosubmitsaninitialrequestfortheCardand is authorized to use the Card as provided for in this Agreement. “SecondaryCardholder”referstothepersonorpersonswhohavereceivedtheCardattherequestof the Primary Cardholder and are authorized to use the Card as provided for in thisAgreement.InordertobecomeaCardholder,youmustbeanindividualwhocanlawfullyenterintoandformcontractsunderapplicablelawinthestateinwhichyoureside.Unlessitwouldbeinconsistenttodoso,wordsandphrasesusedinthisAgreementshouldbeconstruedsothatthesingularincludesthepluralandthepluralincludesthesingular.YouacknowledgeandagreethatthevalueavailableinyourCardAccountislimitedtothefundsthatyouhaveloadedintoyourCardAccountorhavebeenloadedintoyourCardAccount on your behalf. By accepting and using your Card, Card Account, or VirtualAccount,youagreetobeboundbythetermsandconditionscontainedinthisAgreement.YouandanySecondaryCardholder(s)agreetosignthebackofeachrespectiveCard(s)immediatelyuponreceipt.TheexpirationdateofyourCardisidentifiedonthefrontoftheCard.Theexpirationdateof any Virtual Account you have requested is described below in the section labeled“VirtualAccount.”TheCardisaprepaidcard.TheCardisnotagiftcard,norisitintendedtobeusedforgiftingpurposes.TheCardisnotacreditcard.TheCardisnotforresale.YouarethedirectbeneficiaryofthefundsloadedtoyourCardAccount. ThefundsinyourCardAccountwillbeFDICinsureduponreceiptbytheIssuer,providedyourCardisregistered with us (for more information, see the section labeled“Activation/Registration”).YouwillnotreceiveanyinterestonyourfundsinyourCardAccount.TheCardwillremainthepropertyoftheIssuerandmustbesurrenderedupon

demand. The Card and Virtual Account are nontransferable and may be canceled,repossessed,orrevokedatanytimewithoutpriornoticesubjecttoapplicablelaw.TheCardandVirtualAccountarenotdesignedforbusinessuse,andwemaycloseyourCardAccountifwedeterminethatitisbeingusedforbusinesspurposes.Wemayrefusetoprocess any transaction that we believemay violate the terms of this Agreement orapplicablelaw.YourCardAccountdoesnotconstituteacheckingorsavingsaccountandisnotconnectedin anyway to any other account, except as described in the section labeled “VirtualAccount”orasmayotherwisebeindicatedinanyotheraccountagreementsyouhaveenteredintowithus.WritedownyourCardNumberandtheCustomerServicephonenumberprovidedinthisAgreementonaseparatepieceofpaperincaseyourCardislost,stolen,ordestroyed.Keepthepaperinasafeplace.PleasereadthisAgreementcarefullyandkeepitforfuturereference.OPENINGACARDACCOUNT(IDENTIFICATIONVERIFICATION)Tohelpthegovernmentfightthefundingofterrorismandmoneylaunderingactivities,theUSAPATRIOTAct,aFederallaw,requiresallfinancialinstitutionstoobtain,verify,andrecordinformationthatidentifieseachpersonwhoopensaCardAccount.Whatthismeansforyou:WhenyouopenaCardAccount,wewillaskforyourname,address,dateofbirth,andotherinformationthatwillallowustoidentifyyou.Wemayalso ask to see your driver’s license or other identifying documents. The sameidentificationverificationrequirementsapplytoeachSecondaryCardholder, ifanyaredesignatedbyyou.BUSINESSDAYSOurbusinessdaysareMondaythroughFriday,excludingfederalholidays,evenifweareopen. Any references to “days” found in this Agreement are calendar days unlessindicatedotherwise.ADDRESSORNAMECHANGESYouareresponsiblefornotifyingusofanychangeinyourphysicaladdress,mailingaddress,emailaddress,textmessageaddress,oryourname,nolaterthantwo(2)weeksaftersaidchange.AnynoticeofchangeofaddressornamerequiredbythisAgreementmaybeprovidedtousviaemailatcustomerservice@netspend.com,bytelephoneat1-86-NETSPEND/1-866-387-7363,orbymailto:NetSpend,P.O.Box2136,Austin,TX78768-2136.

Wewillattempttocommunicatewithyouonlybyuseofthemostrecentcontactinformationyouhaveprovidedtous.Youagreethatanynoticeorcommunicationsenttoyouatanaddressnotedinourrecordsshallbeeffectiveunlesswehavereceivedanaddresschangenoticefromyou.AUTHORIZEDUSERSYouareresponsibleforallauthorizedtransactionsinitiatedandfeesincurredbyuseofyourCardAccount. IfyoupermitanotherpersontohaveaccesstoyourCard,VirtualAccount,CardNumberorPersonalIdentificationNumber(“PIN”),wewilltreatthisasifyouhaveauthorizedsuchuseandyouwillbeliableforalltransactionsandfeesincurredbythosepersons.YoumustnotifyustorevokepermissionforanypersonyoupreviouslyauthorizedtouseyourCard,VirtualAccount,CardNumberorPIN. Ifyounotifyustocancelanotherperson’suseofyourCard,VirtualAccount,CardNumberorPIN,wemaycloseyourCardAccountandissueanewCardtoyouwithadifferentnumber.YouarewhollyresponsiblefortheuseoftheCardAccountaccordingtothetermsandconditionsofthisAgreement.SECONDARYCARDHOLDERYoumayrequestanadditionalCardforaSecondaryCardholder.ThereisanAdditionalCard Feeof $9.95 for anadditionalCard for a SecondaryCardholder. For informationabout the fee, see the section labeled “FeeSchedule.” Themaximumnumberof suchadditionalCardsistwo(2).YoumustnotifyustorevokepermissionforanySecondaryCardholder youpreviously authorized touse theCard. If younotify us to revoke theSecondaryCardholder’suseoftheCard,wemaycloseyourCardAccountandissueanewCard to you with a different number. You remain liable for any and all use of anyadditionalCard(s)youauthorize.ACTIVATION/REGISTRATIONBoththePrimaryCardholderandSecondaryCardholdermustactivateandregisteraCardbefore it can be used. Your Card Accountmay not have full functionality (e.g., noAutomated Teller Machine (“ATM”) access, no international transactions, and noAccount-to-Account transfers), nor will you be able to access Card Account fundsexceedingthedollarvalueestablishedbyeitherfederalregulationsand/ortheIssuer(the“ExcessFunds”)orreloadyourCardAccountuntilyourCardhasbeensuccessfullyregistered. YoumayactivateandregisteryourCardbycalling1-86-NETSPEND/1-866-387-7363 or by visiting www.netspend.com. You will need to provide personalinformation in order for us to verify your identity and the identity of any SecondaryCardholder.Ifwecannotsuccessfullycompletetheactivation/registrationprocess,youwillbeentitledtoreceiptofanyExcessFundsremainingintheCardAccountbywayofacheck,forwhichtheCheckRequestFee,disclosedinthesectionlabeled,“FeeSchedule,”

willbewaived.Wemay,fromtime-to-timeofferotherno-costmethodsthroughwhichExcessFundscanbemadeavailabletoyou.PERSONALIDENTIFICATIONNUMBERYouwillreceiveaPINonceyouhaveregisteredyourCardwithyourpersonalinformation.A PIN canbeused toobtain cash (see the section labeled “CashAccess”) or tomakepurchases at any Point-of-Sale (“POS”) device that bears the Visa®, Plus®, or PULSE®AcceptanceMark.YoushouldnotwriteorkeepyourPINwithyourCard.NevershareyourPINwithanyone.WhenenteringyourPIN,besureitcannotbeobservedbyothersanddonotenteryourPINintoanyterminalthatappearstobemodifiedorsuspicious.Ifyou believe that anyone has gained unauthorized access to your PIN, including aSecondaryCardholder, you shouldadviseus immediatelyby following theproceduresdescribedinthesectionlabeled“YourLiabilityforUnauthorizedTransfers.”ToregisteryourCard,seethesectionlabeled“Activation/Registration.”CASHACCESS

WithyourPIN,youmayuseyourCardtoobtaincashfromanyATMoranyPOSdevice,aspermissiblebyaMerchant,bearingtheVisa®,Plus®,orPULSE®AcceptanceMark.ATMtransactionsaretreatedascashwithdrawaltransactions.AnycashwithdrawnfromanATMterminal,POSdeviceorthroughaparticipatingbankorNetSpendReloadNetworklocation(an“Over-the-CounterCashWithdrawal”)willbesubjecttothelimitationssetforthinthesectionbelowlabeled“UsingYourCardandVirtualAccount/Limitations”).ATMwithdrawalsmayalsobesubjecttovaryingdailylimitsattheATMowner’sdiscretion.AfeemaybeassociatedwiththeuseofyourCardtoobtaincash.Forinformationaboutthefee,seethesectionlabeled“FeeSchedule.”LOADINGYOURCARDACCOUNTYou may add funds to your Card Account, called “value loading,” at any time. TheminimumrequiredamountofyourinitialvalueloadwillbedeterminedbythelocationwhereyoupurchasetheCard,nottoexceed$20.00.Theminimumdollarvalueofanysubsequentvalueloadswillbesubjecttothetermsestablishedbytheindividualreloadlocation(see(a)inthefollowingparagraph).Themaximumcumulativeamountofvalueloads isdescribedinthe“Limitationsondollaramountsoftransfers”paragraphofthesectionlabeled,“UsingYourCardandVirtualAccount/Limitations.”Whenwecalculatethemaximumamounts for value loads,we take into consideration all similar loadsmadewithanyotherCardAccount(s)youmayhavewithusorwithNetSpend,whetheryouareaPrimaryCardholderoraSecondaryCardholder,andregardlessofissuingbank.

Youmayvalue loadyourCardAccount: (a)using in-storecashvalue load transactionsconducted through anymember of the NetSpend Reload Network (see below in thissectionformoreinformationaboutthenetwork);(b)byarrangingtohavealloraportionofyourpaycheck,governmentbenefitspayment,taxrefundcheck,orotherelectronicfundstransferdirectdepositedtoyourCardAccountusingtheAutomatedClearingHouse(“ACH”)system(“ACHDeposit”).InordertoreceiveACHDepositvalueloadsyoumustprovideeachofyourpaymentproviderswithIssuer’sroutingnumberandyourassignedAccountNumber(seebelowfordetailsaboutroutinginformation);(c)byarrangingforthe transfer of funds originating from: (i) a financial institution located in the UnitedStates; (ii)anotherCardholder;and/or (iii)anotherCardAccount;and(d)viaamobilecheckloadnetworkmadeavailablethroughaneligiblethird-partyserviceprovider.Theremaybefeesassociatedwiththesemethodsofvalueloading.Forinformationaboutthefees,seethesectionlabeled“FeeSchedule.”OurpolicyistomakefundsloadedtoyourCardAccountavailabletoyouwithinone(1)hour from the time we receive the funds. Funds loaded by ACH or other applicableelectronic funds transfer methods will be available on or before the transaction orsettlementdate.AvailabilityoruseoffundsloadedtotheCardAccountmaybedelayedordeniedintheeventoftechnologymalfunctions,orpursuanttoourcompliancewithordischarge of legal or regulatory responsibilities, or as otherwise provided in thisAgreement.IMPORTANT:IfyouwishtoreceiveACHDepositstothisCardAccountfrom,forinstance,theemployerof anothermemberof yourhousehold, orU.S.Departmentof Treasurypayments(includingjointtaxrefunds),youmustaddaCardtothisCardAccountinthename of that household member. There is an Additional Card Fee of $9.95 for anadditional Card for a Secondary Cardholder. CardAccountAccess:SubjecttothelimitationssetforthinthisAgreement,youmayuseyour Card to (1) withdraw cash from your Card Account (see section labeled “CashAccess”);(2)loadfundstoyourCardAccount(seethesectionlabeled“LoadingYourCardAccount”); (3) transfer funds between your CardAccountswhenever you request; (4)transferfundsfromyourCardAccounttoanotherNetSpendcardholderaccount(both(3)and(4)maybereferredtoasan“Account-to-AccountTransfer”);(5)purchaseorleasegoodsorserviceswhereverVisadebitcardsareaccepted;and(6)paybillsdirectlyfromyourCardAccountintheamountsandonthedaysyourequest.Someoftheseservicesmaynotbeavailableatallterminals.YoumayalsouseyourVirtualAccounttopurchaseorleasegoodsorservicesormakepaymentsbytelephoneoronline,withoutpresentingyourCard(seethesectionlabeled“VirtualAccount”).Theremaybefeesassociatedwithsomeofthesetransactions.Forinformationaboutthefees,seethesectionlabeled“FeeSchedule.”Limitationsonfrequencyoftransfers:Forsecurityreasons,wemaylimittheamountornumberoftransactionsyoucanmakewithyourCardorVirtualAccount.Limitationsondollaramountsoftransfers:(1)WhenusingaregisteredCard,youmaymakenomorethansix(6)ATMwithdrawalsina24-hourperiod(referredtoasa“Day”)andmaymakeatotalof$940.00inATMwithdrawalsduringaDaybutanindividualATMwithdrawalmay not exceed $325.00, subject to any lower limit imposed by theATMowner operator. If you do not qualify for either the PurchaseCushionortheOverdraftProtectionService(eachdefinedinmoredetailbelow),andanytransaction(s)exceedsthebalanceofthefundsavailableinyourCardAccount,youshallremain fully liable to us for the amount of the transaction(s) and any applicabletransactionfee(s).Youagreetopayuspromptlyforthenegativebalance.IfyouhavenotaddedsufficientfundstoyourCardAccounttocoverthenegativebalancewithinsixty(60)daysofitscreation,wehavetherighttocancelyourCardAccount.Additionally,wehavetherighttopursuecollection,includingtherighttocollectfunds,equaltoorlessthanthenegativebalance,fromanyotherCardAccount(s)youmayhavewithus.Inallinstancesdescribedabove,loadstoyourCardAccountmaybemadeviadirectdepositoranyoftheotherloadmethodsdescribedinthisAgreement.If you do not have enough funds available in your Card Account, you can instruct amerchant,internetserviceorotherutilityprovider(“Merchant”)tochargeapartofthepurchasetotheCardandpaytheremainingamountwithcashoranothercard.Thesearecalled“splittransactions.”SomeMerchantsdonotallowcardholderstoconductsplittransactions. If you wish to conduct a split transaction and it is permitted by theMerchant,youmusttelltheMerchanttochargeonlytheexactamountoffundsavailablein yourCardAccount to theCard. Youmust thenarrange topay thedifferenceusinganother paymentmethod. SomeMerchantsmay require payment for the remainingbalanceincash.IfyoufailtoinformtheMerchantthatyouwouldliketocompleteasplittransactionpriortoswipingyourCard,yourCardislikelytobedeclined.IfyouuseyourCardatanautomatedfueldispenser(“payatthepump”),thepurchasemaybepreauthorizedforatransactionamountofupto$100.00,ormore.IfyourCardisdeclined,eventhoughyouhavesufficientfundsavailable,youshouldpayforyourpurchaseinsidewiththecashier.IfyouuseyourCardatarestaurant,ahotel,foracarrentalpurchase,orforsimilarpurchases,thepurchasemaybepreauthorizedforatransactionamountrepresentingthepurchaseamountplusupto20%moretoensuretherearesufficientfundsavailabletocovertipsorincidentalexpensesincurred.Anypreauthorizedamountwillresultintheplacementofa“hold”onyouravailablefundsuntiltheMerchanttellsusthefinalpaymentamountofyourpurchase.Onceweknowthefinalpaymentamount,thepreauthorizedamountonholdwillberemoved.IftheMerchantdoesnottellusthefinalpaymentamount,thepreauthorizedamountonholdwillremaininplaceforuptothirty(30)days.Duringaholdperiod,youwillnothaveaccesstothepreauthorizedamount.If youuse yourCardNumberwithoutpresenting yourCard (suchas for amail order,telephone,orInternetpurchase),thelegaleffectwillbethesameasifyouusedtheCarditself(seethesectionlabeled“VirtualAccount”foradditionalinformationabouthowtoobtainanduseaVirtualAccount).

YoumaynotuseyourCardNumberorthe Issuer’sroutingnumberandyourassignedAccount Number in connection with the creation and/or negotiation of any financialinstrumentssuchaschecks,whichwehavenotauthorized.YourCardcannotberedeemedforcash.YoumaynotuseyourCardorVirtualAccountforonlinegamblingoranyillegaltransaction.You do not have the right to stop payment on any purchase or payment transactionoriginatedbyuseofyourCardorVirtualAccount,exceptasotherwisepermittedinthisAgreement.Ifyouauthorizeatransactionandthenfailtomakeapurchaseofthatitemas planned, the approval may result in a hold (see the section labeled “Returns andRefunds,”inadditiontopreviousinformationaddressedinthissection). IfyoumakeatransactionthatcreatesanegativebalanceinyourCardAccount,youagreethat within thirty (30) days of its creation you will add sufficient funds to your CardAccounttocoverthenegativebalancesothatyourCardAccounthasazeroorpositivebalance,orthatyouwillotherwiseimmediatelypaysuchanamounttousinfullupondemand. If after thirty (30) days you have not added sufficient funds to cover yournegativebalance,yourCardAccountwillremainopentoreceivecreditsandloads,whichwillautomaticallybeappliedtoyournegativebalancebeforetheyareavailabletoyou;however,youwillnotbeabletomakeanytransactionsusingyourCardorVirtualAccountuntilyourCardAccounthasapositivebalance,i.e.,sufficientfundstocoverthenegativebalance.Further,wewillhavetherighttopursuecollection,includingtherighttocollectfunds,equaltoorlessthanthenegativebalance,fromanyotherCardAccount(s)youmayhavewithus.Inallinstancesdescribedabove,loadstoyourCardAccountmaybemadeviadirectdepositoranyoftheotherloadmethodsdescribedinthisAgreement.ShouldyouvoluntarilydiscontinueuseofyourCard,youshallremainresponsibleforthenegativebalanceinyourCardAccountandagreethatanycreditsorloadsmadetoyourCardwillbeusedtooffsetthevalueofthenegativebalance,ifany.Youacknowledge that anegativebalance in yourCardAccountdoesnot constitute acontractual open end line of credit. This Service is Not Available for Certain California Unemployment CompensationBenefit,PublicAssistanceorState-AdministeredChildSupportPaymentRecipients.TheStateofCaliforniaprohibits therepaymentofanoverdraftonaprepaidCardAccountfromaCaliforniaunemploymentcompensationbenefitorpublicassistancepayment.IfyouarereceivingaCaliforniaunemploymentcompensationbenefitorapublicassistancepayment,youwillnotbeeligible toopt-in. if youareopted-in to theServiceandyoureceiveadirectdepositofaCaliforniaunemploymentcompensationbenefitorpublicassistance payment, the Servicewill be deactivated. To becomeeligible forOverdraftProtection, you must wait one hundred eighty (180) days since your last Californiaunemployment compensation benefit or public assistance payment, opt-in again, andmeetalloftheeligibilityrequirements.TheStateofCaliforniaprohibitstherepaymentofanoverdraftonaprepaidCardAccountfromachildsupportpaymentdisbursedbytheCaliforniaDepartmentofChildSupportServices. If you are receiving a child support payment disbursed by the CaliforniaDepartmentofChildSupportServices,youwillnotbeeligibletoopt-in.Ifyouareopted-intotheServiceandyoureceiveadirectdepositofachildsupportpaymentdisbursedbytheCaliforniaDepartmentofChildSupport,theServicewillbedeactivated.TobecomeeligibleforOverdraftProtection,youmustwaitonehundredeighty(180)dayssinceyourlast California child support payment, opt-in again, and meet all of the eligibilityrequirements.A.ActivationandEligibilityToactivatetheServiceonyourCardAccountyoumusttakeeachofthefollowingsteps:(1)consenttotheelectroniccommunicationsandprovideavalidemailaddresssothatwecancontactyouifyouoverdrawyourCardAccount(seethesectionlabeled“ElectronicCommunications”formoreinformation);(2)reviewandacceptthetermspertainingtotheService;(3)enrollintheService(i.e.,opt-in);(4)haveapositiveCardbalanceatthetimeofactivation;and(5)receiveACHDepositstotalingat least$400.00toyourCardAccountwithinthirty-five(35)daysofenrollment.TheServicewillbeactivatedonyourCardAccountwithintwenty-four(24)hoursafteryousatisfyeachofthestepsdescribedin this paragraph. willbepermanentlydeactivated.Further,wehavetherighttopursuecollectionofanyamountsowedatoursoleandabsolutediscretion.Wewill send you email notificationswhenever (a) a transaction results in a negativebalance in your Card Account; (b) an Overdraft Protection Service Fee is assessed (ifapplicable) (see Section B, below, for details about the fee), and (c) the Service isactivatedordeactivatedforyourCardAccount.IfyoudeleteyouremailaddressfromourCardholderrecordsorwithdrawyourconsenttoreceiveelectroniccommunicationsfromus,theServicewillbeimmediatelydeactivated.Wecannotacceptresponsibilityforanyemailmessagesnotreceivedbyyou,orforanydelayinthereceiptordeliveryofanyemailnotifications.Ifyoumakeyouremailaddressavailabletoanyotherindividual,youagreethatyouareresponsibleforanyreleaseofanyCardAccountinformationtosuchindividual.Itisyoursoleresponsibilitytoensurethattheemailaddressyouprovidetous is current and accurate. We are not responsible for loss of messages and otherconsequencesifyoudonotprovideanaccurateandcurrentemailaddress.B.TermsofUseYourparticipationintheServiceissubjecttothetermsofthisAgreementandyoumayincurfees.ThefeesfortheServicearedescribedhere,andinthesectionlabeled“FeeSchedule.”TheOverdraftProtectionServiceFee(ifapplicable)isappliedtocertaintransactionsdescribedbelowthatresultinanegativebalance(“Overdraft(s)”)andisinadditiontoanyotherfeesordinarilyapplicabletoatransaction.TheOverdraftProtectionServiceFeeis$15.00foreachtransactionthatoverdrawsyourCardAccountbymorethan $10.00, up to a maximum of three (3) Overdraft Protection Service Fees percalendarmonth.MultipleOverdraftProtectionServiceFeesmaybechargedifmultipleoverdraft transactions are approved on the same day. It is important to keep track of the value in your Card Accountbecause it will be your responsibility to determine if you have overdrawn your CardAccount balance, the day and time the Overdraft occurred, and the amount of anyOverdraftthatisapproved.

WereservetherighttoblockorcancelyourCardAccountorVirtualAccountif,asaresultofourpoliciesandprocesseswedetectwhatwereasonablybelieve tobe fraudulent,suspiciousorcriminalactivityoranyactivitythatisinconsistentwiththisAgreement.Wewill incur no liability to you because of the unavailability of the funds that may beassociatedwithyourCardAccountand/orVirtualAccount.RETURNSANDREFUNDSIfyouareentitledtoarefundforanyreasonforgoodsorservicesobtainedwithyourCardorVirtualAccount,youagreetoacceptcreditstoyourCardAccountforsuchrefundsandagreetotherefundpolicyofthatMerchant.Ifyouhaveaproblemwithapurchasethat youmade with your Card or Virtual Account, or if you have a dispute with theMerchant,youmustattempttohandle itdirectlywiththeMerchant. Theremaybeadelayofuptofive(5)daysormorefromthedatetherefundtransactionoccursuntilthedatetherefundamountiscreditedtoyourCardAccount.CARDREPLACEMENTIfyouneedtoreplaceyourCardforanyreason,pleasecontactusat1-86-NETSPEND/1-866-387-7363torequestareplacementCard.Youwillberequiredtoprovidepersonalinformationwhichmay includeyourCardNumber, fullname, transactionhistory,andsimilarinformationtohelpusverifyyouridentity.ThereisafeeforreplacingyourCard.Forinformationaboutthefee,seethesectionlabeled“FeeSchedule.”TRANSACTIONSMADEINFOREIGNCURRENCIESAND/ORWITHMERCHANTSLOCATEDINFOREIGNCOUNTRIESA. Ifyouobtainfundsormakeapurchaseinacurrencyotherthanthecurrencyinwhich

your Card Account was issued, the amount deducted from your funds will beconvertedbyVisaintoanamountinthecurrencyofyourCardAccount.Theexchangeratebetweenthetransactioncurrencyandthebillingcurrencyusedforprocessinginternationaltransactionsiseither:(i)arateselectedbyVisafromtherangeofratesavailable inwholesale currencymarkets for the applicable central processingdate(thisratemayvaryfromtherateVisaU.S.A.Inc.itselfreceives),or(ii)thegovernment-mandatedrateineffectfortheapplicablecentralprocessingdate.Thispercentageamount is independentofanyamount takenby the Issuer inaccordancewith thisAgreement,and,

OURLIABILITYFORFAILURETOCOMPLETETRANSACTIONSIfwedonotproperlycompleteatransactiontoorfromyourCardAccountontimeorinthecorrectamountaccordingtoourAgreementwithyou,wewillbeliableforyourlossesordamages.However,therearesomeexceptions.Wewillnotbeliable,forinstance:

(1) Ifthroughnofaultofours,youdonothaveenoughfundsavailableinyourCardAccounttocompletethetransaction;

(2) IfaMerchantrefusestoacceptyourCardorVirtualAccount;

Purpose:ThisArbitrationProvisionsetsforththecircumstancesandproceduresunderwhichclaims(asdefinedbelow)maybearbitratedinsteadoflitigatedincourt.Definitions: As used in this Arbitration Provision the term “Claim” means any claim,disputeorcontroversybetweenyouandusarisingfromorrelatingtotheCardAccountorthisAgreementaswellasanyrelatedorprioragreementthatyoumayhavehadwithusortherelationshipsresultingfromthisAgreement,includingthevalidity,enforceabilityorscopeofthisArbitrationProvisionortheAgreements.“Claim”includesclaimsofeverykindandnature,includingbutnotlimitedtoinitialclaims,counterclaims,cross-claimsandthird-partyclaimsandclaimsbaseduponcontract,tort,fraudandotherintentionaltorts,statutes, regulations, common law and equity.
