On March26, 2003,the PostalService initiated a dispute concerning whethera custodial vacancyresulting from an employee's voluntary transfer is "a vacancy as a resultof anemployee's voluntaryattrition," as referenced in the Memorandum of Understanding (MOU) for SUbcontracting CleaningServices.

On June24, 2003, I discussed the issuein dispute withSteve Raymer, Director, Maintenance Division.However, wewere unable to reachagreement. The parties agreed that the Article 15.4.0 issuestatements wouldbe submitted by October 31,2003. The foUowing is the PostalService'sunderstanding of the issuesmvolved andthe factsgiving riseto suchissues.

The facts givingrise to trus disputeare:

Two custodians requested and received voluntary transfers to otherfacilities. The resulting vacancieswereconsidered as being a resultof anemployee's voluntary attrition and handled in accordance withthe MOUon Subcontracting cleaning services. TheAPWU fileda grievance and arguedthat avoluntary transferis not an employee's voluntary attrition within themeaning of the MOU

Forexample. Article 38.5.B.3 refers to lateraltransfers, and statesthat, 'trenster in thesamelevel, but to a different occupationa' group shallbedetermined in thesamemanner8S promotions."

Furthermore, past practice. negotiation history, case law, handbooks andmanuals and a reading of thecontract as a whole supportmanagement's position in thiscase.

The meeting on the above referenced dispute was held between the parties on inaccordance with Article 15 of the Collective Bargaining Agreement.

Article 15, Section 2 (Step 4) provides that if the parties have not reachedagreement within fifteen days of their meeting that each party shall provide theother with a statement in writing of its understanding of the issues involved, andthe facts giving rise to the dispute.

The following is the APWU's statement of issues and facts concerning thisdispute.

The i in this dispute is whether the voluntary transfer of a custodialem from one installation to another is defined as being IIvoluntaryattrition" under the Memorandum ofUnderstanding on Subcontracting ofCleaning Services.

The parties agreed to extend the time limit for filing of the 15 day response untilOctober 31,2003.

It is the position of the APWU that 'transfer' is not one of the specified items thatwere specifically negotiated by the parties when the January 12, 1999 Article 38Questions and Answers were completed. The specific Q&A at issue is under thesection CUSTODIAL and states: What is the definition of"voluntary attrition"?Answer: If the employee bids out, is promoted, quits, retires or dies.If the parties had intended other actions, such as an employee's transfer from oneinstallation to another, that could have been easily accomplished.

The Postal Service'relianceon Article38.S.B.3 to support their position ismisplaced as the provisionthat is referenced is an action within a specificinstallationand involves a promotion. Promotion is listed in the definitionofvoluntary attritionbut a transferbetween installations is not.

The specific questionand equallyspecific answer does include any languagethat leaves the definition open ended or ambiguous. Employees who leavetheirduty assignments for reasonsnot specifiedin the definition are not consideredvoluntary attrition and the Postal Servicecannot then invoke the MODoncleaning services to contractout the bargainingunit's work.

In accordance with theprovisionsof Article 15, the Postal Service is initiating a dispute at Step 4 of the grievanceprocedure on the following interpretive issue.

The issues and facts giving rise to this dispute are:

Two custodians requested and received voluntary transfers to other facilities. Theresulting vacancies were considered as being a result of an employee's voluntaryattrition and handled in accordance with the MOU on Subcontracting CleaningServices. The APWU filed a grievance and argued that a voluntary transfer is not anemployee's voluntary attrition within the meaning of the MOU.

The Postal Service's position is that when an employee's request to transfer is approved, theresulting vacancy is as a result of an employee's voluntary attrition. The Postal Service andthe American Postal Workers Union stated in the January 12, 1999 Article 38 Questions andAnswers that "voluntaryattrition" is when an "employee bids out, is promoted, quits, retires, ordies." It is the Postal Service's position that a voluntary transfer is tantamount to anemployee bidding out, being promoted, or quitting. Just as with bidding, promotions orquitting, a vacancy resultingfrom a transfer is due to an employee's request or decision toleave their current position. For example, Article 38.5.8.3 refers to lateral transfers, andstates that, "transfer in the same level, but to a different occupational group shallbedeterminedin the same manner as promotions. "

In accordance with Article 15, Section 2, of the National Agreement, "[T]he parties shall meetat the National level promptly, but in no event later than thirty (30) days after initiating suchdispute in an effort to define the precise issues involved, develop all necessary facts andreach agreement." The U.S. Postal Servtce is prepared to meet as required.

Grievances E98T-4E-C 99224762 and E98T-4E-C 99267859, and other cases with similarissues should be held at their current step pending the outcome of this national dispute.

.26 Cleaning Services

.261 Authorizationa. In a new facility or when a vacancy as a result of

an employee’s voluntary attrition is identifiedin an independent installation or in a stationand/or branch of an independent installation,the following sequential steps will be taken todetermine whether or not a contract cleaningservice may be utilized:

(1) Measure the square footage of the interiorarea, using procedures identified inhandbook MS-47, Housekeeping-PostalFacilities. Then divide that measurementby 18,000 and round off the resultingnumber to four (4) decimal places;

(2) Measure the squarefootage of the exteriorpaved and unpaved area, to be servicedusing the procedures identified in theMS-47 handbook. Then divide thatmeasurement by 500,000 and round offthe resulting number to four (4) decimalplaces;

(3) Add the numbers obtained in steps 1 and 2together. If the resulting number is lessthan ONE (1), a contract cleaning servicemay be used to perform the required work.

b. If the determination is made to utilize a contractcleaning service, the local APWU Presidentwill be provided a copy of the abovecomputations.

c. The formula applies to replacement facilities orexisting facilities with extensions ormodifications.

d. Post Offices, or stations/branches whichcontract cleaning services under previouscriteria may continue to do so.
