Preamble Prior to the ADB Review Mission from March 25 to April 7, 2015 progress of activities of FDERP

and FDERP-AF under MPWT were reported on a monthly basis.

In accordance with ADB's April 2015's MOU/Section H (Project Reporting); this was changed to

quarterly progress reports from April 1 onwards in order to streamline the reporting.

This report is prepared as a summary of activities, both in planning, design, construction and

financial issues during the period of October through December 2015.

To simplify reading the report is split in two parts: Part A: projects under FDERP (No. Loan

2852) where the loan is already closed and Part B: FDERP -AF (Loan No. 3125).

Executive Summary

1. A reconnaissance mission was conducted by ADB to Cambodia in December 2011,

which was initiated after severe typhoons, devastated 18 of the country’s 24 Provinces in

September and October 2011.The subsequent MOU which was issued by ADB in

February 2012, initiated the “Flood Damage Emergency Reconstruction Project”

(FDERP). FDERP was approved on 27 March 2012. The loan became effective on 14 May 2012, and was scheduled for closure on 30 September 2015;

2. FDERP costs USD 67.18 Mill, of which Asian Development Bank (ADB) financed USD 55Mill, the Government of Australia provided a grant of USD 5.25 Mill and the Royal Government of Cambodia contribution was USD 6.93 Mill.

3. FDERP was guided by the Project Administration Manual (PAM) dated March 2012, updated January 2013. The PAM requires the FDERP Implementing Agencies (IAs) to submit monthly progress reports to the Executing Agency (EA)/ Project Coordination and Monitoring Unit (PCMU) to submit Quarterly Progress Reports to ADB;

4. Final Joint review Mission for FDERP was conducted from 29 June to 16 July 2015. 5. This Quarterly Progress Report cover the period from October through December 2015. 6. Loan Closing was 30 September 2015 as planned. Three subprojects (CW7, CW6b and

CW8) are under Defect Liability Period after this loan closing date.

Executive Summary

i. General 1. FDERP-AF was approved on 11 April 2014. Loan and Grant Agreement was signed on

23 April 2014 and became effective on 30 May 2014 with a loan closing date of 30 September 2017.

2. FDERP-AF is financed through ADF loan of SDR48,545,000 Mill (equivalent to 67.6 Million at time of loan signing in April 2014) and a grant from the Government of Australia of USD A$7.6 Mill (equivalent to $6.68Mill). The Royal Government of Cambodia contributes USD 9.0 Mill;

3. MPWT receives a loan of SDR14.563 (equivalent to $22.5 Mill at the time of loan signing) and a grant of $1.5 Mill to rehabilitate/improve flood damaged national and provincial roads and bridges in 5 provinces: Battambang, Banteay Meanchey, Siem Reap, Kampong Thom, Battambang and Kampong Cham.

4. Last Joint review Mission was conducted from 21 September to 7 October 2015. 5. Due to lack of progress of CWs 16, 9a, 10b and 10c, Employer issued warning letters

per Clause 50.2 of Contract Documents after Consultant had issued several warning letters.

6. This Quarterly Progress Report covers the period from October to December 2015.

ii. Loan Progress

Last ADB and Australian Aid Joint Review Mission

7. A review mission for the project was undertaken from 21 March to 2 October 2015 to review implementation progress of the project, identify key implementation issue and propose action to improve implementation. The mission undertook field visits to subproject areas from 21 to 25 September 2015. A kick-off and wrap up meetings is proposed on 2 October 2015. It was reported that Project implementation as of end of Q3 was well on track.

iii. Overall Project Progress

9. Overall Progress is slightly behind schedule. The actual progress for last quarter was on

track due to progress made in CW13, however the overall progress at the end of this quarter is estimated to be 60.5% compared to a forecasted 66.7% (Figure 1B). This is because stagnant progress for CW16, 9a, 10b and CW10c and CW14 was just awarded. Under Stage 2 civil works, two civil work contracts were completed (CW9b and CW11/12) while CW10a was expected to be completed by October but is extended to 10 June 2016 due to still outstanding issues observed at completion (re-appearance of cracks#2 and 3). Under Stage 3, CW13 was completed on 9 December 2015 which is within the contract period. Contractors CW16, CW10b, CW10c and CW9a cannot catch up due to lack of equipment and manpower.

10. Several warning letters have been issued by the Engineer in an attempt to improve the situation. However, the Contractors had not taken serious actions. Therefore, the Employer issued first warning letters per Clause 50.2 of the Contract Documents on 9 December 2015 to CW10b and CW10c, and on 11 December 2015 to CW16 and CW9a,

giving Contractors 14 days to act. Follow-up site visits were held on 18, 25 and 26 to the projects concerned. Still no significant progress was observed. Therefore the Employer issued last warning letters to CW10b, 10c and CW9a on 30 and 31 December 2015 giving Contractors 21 days to act to catch up.

11. Bid opening for CW14 was held on 18 September 2015 and contract signing is on 11 December 2015 after receipt of ADB’s NOL dated 30 November 2015.

12. Physical progress of civil works is slipping behind schedule, is estimated to be 46% vs a target of 52% (Figure 2B). This is due to late progress for stage 3 contracts.

iv. Financial Progress

13. Cumulative contract awarded is shown in Table 1B. One contract award, CW14, is made

during this period. Two contract amendments for CW10a and CW13 are issued. No variation on consultant service is issued during this period.

14. Comparison of actual contract award vs projection per PAM 2014 is shown in Figure 3B. Note that the latter is the cost shown in the PAM. All civil work contracts were awarded in this Quarter. It is observed that the total contract award up to this quarter is $23.37 Mill compared to a projection of $25.9 Mill. This difference is due to the late procurement for CW14, and the contractually awarded contract amounts are less than the estimated contract amount.

15. The variation of budget allocation against time is also plotted in Figure 3B. It is observed that the allocation budget for MPWT is reduced due fluctuation of SDR against US Dollars. It appears that there is no sufficient of fund to implement CW14 (with estimate cost of $3.750 Mill in Procurement plan dated 7 August 2015) unless more re-allocation is made. 16. Actual cumulative disbursement of civil works is estimated to $8.12 Mill compared to actual cumulative contract award of $23.3 Mill as of 30 November 2015 (Figure 4B). The Disbursement is far behind the contract award since the contractors under FDERP-AF are slow in issuing their IPCs due to slow physical progress of CW15, CW16, CW10b, CW10c and CW9a. The consultant is pushing for this to improve.

17. A comparison between a planned disbursement and actual disbursement is shown in Figure 5B. A planned disbursement is computed as proportion to cumulative disbursement in Section IV. Costs and Financing (“F. Contract Disbursement S-Curve of PAM 2014). Based on this calculation, it appears that actual disbursement is behind the target.

vi. Construction Progress

Stage 2 Subprojects:

Three Direct Contracts were awarded in Q3/2014 and two of which were completed.

CW10a is extended to 10 June 2016 due to some added works of mainly repair of cracks.

CW9b:

Emergency Reconstruction of Prek Chiek Bridge on provincial road (PR) 270 in Kampong Cham

Province (contract amount: $938,000). Completion certificate was issued on 15 June 2015. A

final cost of the project is $706,595.93. A saving of $231,404.07 is recorded. Defect Liability

Period is until 15 June 2016.

CW10a:

Emergency Reconstruction of Provincial Road PR156D in Banteay Meanchey (contract amount: $2,126,833.7). The works per original scope was completed. However, the project has experienced delays mainly due to added works such as repairs of deep cracks in 4 locations along the riverbank and added side drains at the beginning Section of the road. The cracks were repaired based on special designs by the consultant’s geotechnical specialist. Contract variation orders are compiled into proposed CA#1 which were obtained in ADB’s NOL on 14 December 2015 and the CA#1 was signed on 23 December 2015. In December 2015, Cracks #2 and #3 re-appeared followed by settlement. Consultant and Contractor are working together to have this issue resolved.

CW11/12:

CW11&12: Emergency Reconstruction of 8.15 km of PR 264E and 7.375 km of PR 264D in

Kampong Thom (contract amount: $2,799,980.19). Contract amendment #1 for using part of

Contingencies was approved and signed on 18 August 2015. The Completion Certificate was

issued on 3 September 2015 and the project is now under Defect Liability Period until 3

September 2016.

Stage 3 Subprojects

CW13:

Emergency Reconstruction of 18.75 km of Laterite Road on PR 1570 in Battambang Province

(Contract: $1,792,390). The project has been substantially completed per scope under CA#1.

However, it was observed during ADB’s Mission that the end of part of the road, which is low

due to tempering with existing access road, was inundated and caused some damage to laterite

surface. Therefore, concrete slab acting like drift where water can overflow. The concrete road

surface was proposed and treated as additional work (variation). The construction of concrete

slab has been done. CA#2 was prepared using remaining amount in contingencies and was

submitted for PRC for review and approval on 7 November 2015 and Contract Amendment#2

(CA#2) was signed on 25 November 2015. Completion Certificate is issued on 9 December

2015. The Project now is now under Defect Liability Period.

CW15:

CW15: Emergency Reconstruction of 6 km Concrete Pavement on National Road (NR) 63 in

Siem Reap Province (Contract amount: $2,334,526.33). This sub-project had experienced slight

delays at the start-up and slow progress. During ADB’s Mission in October, the donor expressed

their concern on accidents which may result from different levels between concrete slab and

shoulder, and the adding berms along the concrete slab adjacent to river. These concerns have

been addressed to minimize the accident as Contractor is raising the levels of shoulder and is

making proposal for construction berms.

The Contract is intended to be completed on 30 December 2015. But, the contractor cannot

completed the work per above date. Contractor is applying for time extension for review and

approval and time extension is endorsed and approved until 21 March 2016 by the Employer.

CW16:

Emergency Reconstruction of 11.20 km of Double Bituminous Surface Treatment (DBST) Road

on Provincial Road 265F in Siem Reap Province (contract amount: $2,233,310.02). CW16

experienced slight delays at the start-up due to slow mobilization of contractor, lack of

manpower and equipment. The Project is still slow, physical progress of 27% after 10 months

after start date. Contractor period is 14 months. Several meetings were arranged between

Contractor, Consultant and Engineer to improve work progress.

Consultant issued several warning letters, then after coordination meeting with PCMU, the

Employer issued first warning letter per Clause 50.2 of Contract Document on 11 December

2015 to the contractor (Banteay Srei) to take actions in order to rectify situation, if not default will

be resulted. After 14 days, follow up site visit was conducted and it was observed that some

progress was made. Still more effort needs to be done by Contractor in order to complete the

works on time and to avoid penalty.

Extraordinary meeting with all stakeholders (including Senor Officers from ADB, MEF, PCMU,

MPWT, Consultant, and Contractor) is planned on 13 January and joint follow up site visit is

planned on 21 January 2016.

Four ruin locations were discovered along the road, but impact of one ruin at PK10+200 is

notable according to joint site visit by APSARA and DPWT of Siem Reap on 2nd December

2015. It was decided to leave a section of road 200m undisturbed from PK10+100 to

PK10+300.

CW9a:

CW9a: Emergency Reconstruction of 16.19 km (PK.6+636 – PK.22+826) DBST Road on NR

No. 70 in Kampong Cham Province (Contract amount: $2,749,789.91). This subproject was

awarded on 24 June 2015 to Banteay Srei with conditional NOL from ADB on personnel and

equipment. After 6 months, only 25% of embankment was completed. Within remaining 12

months of contract period, the Contractor cannot even complete the embankment if with such

speed of progress.

Consultant issued several warning letters to the Contractor before Employer issued first warning

letter on 11 December 2015 per Clause 50.2 of the Contract Document giving 14 days for

Contractor to act. Follow up site visit was conducted on 26 December 2015, it was found that no

notable progress was made. Therefore, Employer issued last warning letter to Contractor giving

21 days to comply with specific items, mainly mobilization at least 3 teams for road works and at

least 3 teams for structure works.

Extraordinary meeting with all stakeholders (including Senor Officers from ADB, MEF, PCMU,

MPWT, Consultant, and Contractor) is planned on 13 January and joint follow up site visit is

planned on 21 January 2016.

$2,497,238.36). This subproject was awarded on 24 June 2015 to Visvakam Samnang with

conditional NOL from ADB on personnel.

After 6 months since start date, little progress has been made on road work or on bridge works

due to lack of equipment and manpower on site.

Consultant issued several warning letters to the Contractor before Employer issued first warning

letter on 9 December 2015 per Clause 50.2 of the Contract Document giving 14 days for

Contractor to act. Follow up site visit was conducted on 25 December 2015, it was found that no

notable progress was made. Therefore, Employer issued last warning letter to Contractor giving

21 days to comply with specific items, mainly mobilization at least 3 teams for road works and at

least 3 teams for drainage works, and have specialized teams to do bridge works.

Extraordinary meeting with all stakeholders (including Senor Officers from ADB, MEF, PCMU,

MPWT, Consultant, and Contractor) is planned on 13 January and joint follow up site visit is

planned on 21 January 2016.

CW10c:

CW10c: Emergency Reconstruction of 10.06 km (PK14+400 – PK24+460) DBST Road and

75m Concrete Bridge on PR No. 156D in Banteay Meanchey Province (Contract amount:

$3,045,589.37). This subproject was just awarded with conditional NOL from ADB on personnel.

After 6 months, notable progress has been made on earth work but no progress is made for

bridge work.

Consultant issued several warning letters to the Contractor before Employer issued first warning

letter on 9 December 2015 per Clause 50.2 of the Contract Document giving 14 days for

Contractor to act. Follow up site visit was conducted on 25 December 2015, it was found that no

Quarterly Labor and Gender Action Plans (LGAPs) from October to December

2015

1. Quarterly Labor and Gender Action Plans (LGAPs) are being prepared by MPWT. These

are based on monthly forms issued by MPWT for completion by contractors. Contractors are

reporting difficulties in meeting the 25% quota of unskilled female labor. Table 6B

summarizes quarterly information for Stage 2 and Stage 3 contracts.
