With a promise of ‘Staying Ahead of the Curve’ property managers and directors benefited from top-notch speakers and topics, an excellent trade show featuring a wide variety of trades and management compa- nies, and the chance to share stories from the front lines of condominium management. ous Acts. A first priority should be to seek professional advice from a safety professional to ensure you and the condo board are better protected. Then establish a de-tailed safety plan for the work to be done.

Presenter David MacKenzie of Rooney, Irving & Associates Ltd. discussed the specifics of elevator main-tenance and safety while emphasizing elevator machine guarding. He stressed the importance of monthly report-ing and sign-offs and annual inspections as well as two-year and five-year testing.

Third panelist Roger Tickner of Tickner & Associates Inc. relayed recent news items that resulted in workers’ deaths. He then explained the details for a road map to due diligence and the steps required before implementing a safety plan. He stressed that safety doesn’t just happen. It needs to be planned and managed by competent people. Know that talent and ability will make a difference.

Finances are always a hot topic for the condo com-munity. In the session Managing Reserve Fund Planning: Is There Room for Improvement? three panelists and moderator Michael E. Le Page, president, Maple Ridge Community Management discussed new financing mod-els for reserve funds. For example, the Social Housing Investment Program was presented as a possible model for enhanced investment choices for condominiums. Presenters from the Social Housing Services Corpora-tion discussed the background of the program and its history springing from the Social Housing Reform Act in the late 1990s. The program offers three different funds providing short- to long-term investment options.

Peter Leong of Genivar Consultants LLP covered the regulations pertaining to reserve fund studies, some best practices and what constitutes the ‘ideal’ reserve fund study. John Warren of Adams & Miles LLP covered the distinction between alterations and improvements by citing case law examples. He concluded by addressing practical considerations when considering new invest-ment options.

Moderator Mark Arnold, Gardiner Miller Arnold LLP introduced the Saturday panel session on Mediation and Arbitration – Condominiums and Human Rights.

Christian Vernon of Pinto Wray James LLP talked about the top ten things condo managers and boards should know about human rights in Ontario. Point #8 – Did you know there are only three factors relevant to proving undue hardship?

When unit owners complain that the provision or rule they are alleged to have violated infringes their human rights, this may result in parallel and possibly conflicting proceedings between the condominium corporation and the unit owner under different statutes. Mark Arnold and Syed Ali Ahmed covered these and other parallel court proceedings.

In closing, the recent case of Tinkerbell the dog was discussed, and the ramifications of this decision to allow a 6-pound chihuahua in a condominium whose declara-tion states no pets allowed.

Informative and practical, panelists provided their insight into timely subject areas that left delegates feeling Ahead of the Curve. One of the many panel sessions.

Keynote speaker Major-General (ret’d) Lewis MacKenzie had the Sat-urday morning audience on the edge of their seats with tales of Canada’s troops overseas. Speaking for more than one hour, MacKenzie dem-onstrated the similarities between managing troops and managing em-ployees. “Managing is doing things right. Leading is doing the right thing.”

His list of ten management tips was a definite highlight and hit home for many of those in the audience.

“Pulling in Major-General (ret’d) MacKenzie was genius,” said Mi-chael Clifton a partner in Clifton Kok LLP. ”Not only was he a terrific speaker, but I think that it works well when keynote speakers are not necessarily condo-focused but share “big” principles that apply to our situations.”

Plan to attend the joint ACMO/ CCI-T 2011 Conference to be held November 3–5 in the GTA’s west end at the Congress Centre on Dixon Road. ■
