The following is g e m l information relating to the requirement for reporting quantities of coal combustion byproducts that were managed in the State of Maryland during calendar yeor 2008, Please answer the questions on the form provided, attaching additional information and any requested supplemental information to the back of the form.

t I, h c h a n d , This requirement that g ~'&tiib'ustion byproducts (CCBs) submit an annual report was instituted in the Code of Maryland Regulations COMAR 26,04.10.08, h t was promulgated effective December 1, 2008, The regulation requires that m y non-residentid generator of CCBs submit a report to th Department by March 1 of each year describing the manner in which CCBs generated w i t h the State were managed during the preceding calendar year, In addition, for this first report, information concerning CCB activity during the past 5 years is required to be submitted, to the extent that this is known. A. Definitions, CoaI combustion byproducts are defined in COMAR 26.04.1.0.02B as:

"(3) Coal Combustion Byproducts. (a) ''Coal combwion bpruduets" means the residue generated by or resultimg~om the burning of coal, @) "Coal combustion byprdwts" includes fly ash, bottom ash, boiler slag pouolan, and other solid residuals removed by air pollu f ion control devices porn t h flue gas and combustion ckamhrs of &ktwip~g furnaces -and boilers, fnclarding flue gas desd'rization slardge and other solid residuals recovered porn flue gar by wet or ldty methods. "

A generator of CCBs is defined in COMAR 26.04.1 0.02B as:

" (9) Generutor. (01) "Generator" means a person whose operations, activities, processes, or uclions create coal combust ion byprvduct.~. a) "Ciunerutor" does nor include a person who on& generules cod combuslion hyproduc fs by Burning coal at u private residence. "
