I.OVERVIEW

The Committee on Education, Public Library and Women's Affairs convened a public hearing on August 7. 2014 at 4:00 pm in I Liheslatura's Public Hearing Room. On the agenda was the consideration of Bill No. 300-32 (COR) An act to amend § 151004 of Chapter 15 of Title 17, Guam Code Annotated; relative to allowing trainees under 1he Nursing Training Program to agree to accept employment with a private hospital on Guam as a condition of selection and enrollment in the program.

Public Notice Requirements

All legal requirements for public notices were met, with requests for publication sent to all media and all Senators on July 30, 2014, (5-Day Notice) and August 4, 2014 (48-Hour Notice) via email. Copies of the hearing notices are appended to the committee report.

II. SUMMARY OF TESTI'VIONY AND DISCUSSION

- Speaker Won Pat Ed.D announced that Bill No. 300-32 will be heard and asked Mr. Alan Funtanilla and Mrs. ,\fargaret Hattori-Uchima to testify before the committee. The speaker mentioned that before Mr. Funtanilla and Mrs. Hattori-Uchima provide testimony, Vice Speaker B.J.F Croz, sponsor of the bill, will give a briefing of Bill 300-32.

- Vice Speaker B.J.F Cruz mentioned that Ilill No.300-32 is probably the shortest bill he has ever written in which it amends the current statute with 3 words "or private hospitals."' He also reiterated that Bill 300-32 allowing trainees under the Nursing Training Program to agree to accept employment with a private hospital on Guam as a condition of selection and enrollment in the program.

- Mr. Alan Funtanilla is in full support of Bill 300-32. His written testimony is appended to the conunittec report. - ~lrs. Margaret Hattori-Uchima is in full support ofBill 300-32. Her written testimony is appended to the committee report.

- Speaker Won Pat Ed.D asked her rnlleagues if they have any questions or comments.

- Vice Speaker B.J.F Cruz mentioned !hat he could not have said it any better than Mrs. Margaret Hattori-Uchima and that he will not ask any questions.

- Speaker Won Pat Ed.D brought forth the question," in your closing remarks, in your testimony in which you desire to have a formal arrangement for both of our educational institutions ( University of Guam/Guam Community College), do you have that or start these negotiations to have these conversations?"

- ~Ir. Alan Fontanilla responded that he did have the opportunity to meet with both representatives from - G.C.C and U.O.G and that a job fair was conducted at both institutions.

- '.\fr. Carlos Pangelinan recognized that he is the conununity relations officer with the Guam Regional Medical City. He added that he is looking at the MOU of GMHA and the University of Guam as a siarting point of discussion. He also mentioned that they're putting together a recent nurse graduate program modeled after Sharp Hospitals in San Diego.

- Speaker Won Pat Ed.D mentioned that there was a time and difficulty in accepting more students interested in the nursing program where students would have to wait the following year for courses to be offered. She asked Mrs. Hattori if this is a way to supplement some of the faculty at the L'niversity that it would not affect the slatus or the accreditation with any one teaching as a part time. Mrs. Margaret Hattori-Uchima responded that with the legislative support, with the UOG budget that they were able to build up their faculty ranks. So they are not as short, and a lot of that has to deal with GMHA, a lot of their nurses are adjunct faculty. That is what we are trying to work out with GMRC, from obstetrics, maternal child health areas, and there are not enough nurses with a master's degree which is one severe shortage area. Accreditation requires faculty with a master's degree in Nursing. The problem with being able to increase the number of students we accept, it is not tire matter of not enough nurses; a large part of it is facility.

- Speaker Won Pat Ed.D thanked Mrs. Margaret Hattori-Uchima for clarifying and asked if it is the hospitals hope to he able to at least hire our graduates (UOG/GCC) and giving them preference instead of hiring elsewhere.

- Mr. Allan Funtanilla responded that they have made a strong conunitment to do so and that through their HR department and nursing recruitments that we afford all the students at the institutions to work with us.

- Speaker \Von Pat, Ed.D. mentioned that the govertm1ent has been helpful in getting nurses scholarships to grow our own professionals so that we do not have to hire off island.

- Mr. Allan Fontanilla replied that they had an opportunity to attend the university graduation to commit to them that GRMC has open anns for their expertise that UOG!GCC has provided them and he looks forward in the partnership with both UOG/GCC.

- Speaker Won Pat, Ed.D. also mentioned to Mr. Carlos Pangelinan to keep the Committee updated with the progress with GRMC.

BE IT ENACTED BY THE PEOPLE OF GUAM:

Section l. § 151004 of Chapter 15 of Title l 7, Guam Code Annotated is

hereby amended to read:

1 "§ 151004. Employment of Trainees: Reimbursement.

2 (a) As a condition of selection and enrollment in the program, each trainee

3 shall agree lo accept employment as a nurse, either professional or practical, in the

4 public health system of Guam, including the Guam Memorial Hospital Authority,

5 the Department of Public Health and Social Services, and the Department of

6 Mental Health and Substance Abuse, as school health counselors in the

7 Department of Education or tbe Guam Community College, or in private clinics or

8 Rrivate_ hospitals licensed to do business on Guam, and to continue in such

9 employment for a period of time equal lo the period of training under the program.

10 (b) Tbe recipient shall further agree that in the event of the recipient's failure

l l or refusal to fulfill the obligation set forth in Subsection (a), the recipient shall then

12 repay the government of Guam an amount equal to the total monthly allowances

BE IT ENACTED BY THE PEOPLE OF GUA!\1:

Section 1. § 151004 of Chapter 15 of Title 17, Guam Code Annotated is

hereby amended to read:

Testimony on:

Bill No: 300-32: An Act to Amend §15004 of Chapter 15 of Title 17, Guam Code Annotated;

Relative to Allowing Trainees Under the Nursing Training Program to Agree to Accept

Employment With a Private Hospital on Guam as a Condition of Selection and Enrollment in

the Program.

The University of Guam School of Nursing and Health Sciences Nursing Program provides

education for nursing students to obtain their baccalaureate degree. Upon earning their BSN,

and successfully passing the National Council Licensure Examination for Registered Nurses

(NCLEX·RN), our graduates are eager to become employed. The Guam Memorial Hospital

Authority has been the main source of both clinical experience and employment for our

graduates, We are appreciative of their ongoing support for our Nursing students, However,

with the large number of graduates, it is impractical to expect that one agency would employ all

the graduates of our program. It is important to consider the skill mix and experience levels of

nursing staff providing care to patients in the acute care setting. Health care providers are

cognizant of the importance of a balance between experienced and novice nurses,

UOG graduates have also obtained employment at private agencies such as clinics, and home

health agencies, However, for the vast majority of new graduates, employment in an acute care

setting such as GMHA is the preferred choice. Working in the acute care setting provides an

excellent foundation for skill development and exposes graduates to a broad range of patients.

In the past several years, it has become more difficult for our graduates to find employment.

This follows a nationwide trend for new graduate nursing employment. According to the

American Association of Colleges of Nursing (AACN), in 2011, for new BSN graduates, the

average rate of employment 4 to 6 months after graduation is 88% nationwide, with a 77% rate

in the Western states (AACN Research Brief, Oct. 2012),

In 2013 our program graduated 30 students. To date, 26 are licensed RNs. By March 2014, 11

had been hired by the Guam Memorial Hospital (with a graduate employment rate of only

47%). An additional 4 were hired by the end of May 2014. The other licensed nurse graduates

were hired in private clinics and home health settings (raising the employment rate to 89%). All

30 of our 2013 graduates remain on island. The delayed employment and difficulty obtaining a

job causes hardship to our graduates and is a concern for the program.

The UOG Nursing Program is in support of this legislation. The legislation currently allows for a

broad range of employment options including private clinics. It would be reasonable and

practical to allow the Nursing Training Program graduates to consider employment with a

private hospital on Guam. Graduates would welcome the additional source of potential

employment. The majority of our graduates remain on island and want to become productive

members of the health care workforce. They have a strong desire to serve the people of Guam

and to give back to the community. Passing this legislation would allow the Nurse Training

Program recipients greater job opportunities and will help them to achieve their goal.

Hafa Adai and good evening. Speaker Won Pat and members of the Committee. My name is

Alan Funtanilla and I am the Chief Nurse of the Guam Regional Medical City. On behalf of the Guam Regional Medical City. thank you Madame Chair for the opportunity to participate in this hearing and thank you Vice Speaker Benjamin Cruz for introducing Bill No. 300-32 (COR).

The Guam Regional Medical City (GRMC) supports this legislation and recommends favorable consideration by the Committee and the Legislature. There are a number of practical reasons we support this measure. I will discuss each of them briefly.

l. The measure allows our local nursing graduates to gain the solid professional experience they need to be successful in their chosen careers. As we move fbrward to opening the new hospital in the coming months, I can personally attest to the fact that GRMC has been diligent in preparing the best possible care to the people of Guam and the region. Any graduate of the University of Guam employed at GRMC will be working with a cadre of highly competent and well-trained doctors, nurses and allied health professionals. Local nurse grads will work in an environment where their skills and training will be valued and the practical application of such skills and training will be supported with the latest in technology and management practice. Further, GRMC has already begun the process of bringing in many specialized medical professionals from throughout the mainland United States in order to address the needs of the community. As a result, our local grads will be exposed to a diverse workplace and become accustomed to values. norms. and traditions typical of hospitals in other parts of the country.

2. The measure will help to develop and maintain the local pool of qualified nurses thereby benefiting the local medical community. A skilled workforce is essential to

supporting the entire medical community. By allowing university graduates to repay service credit at the new hospital. they are afforded an option to develop their skills on Gllam. And by remaining on Guam they help to keep a robust pool of talent from which employers can recruit. While we arc all aware of the challenges Gllam has in competing for nurses nationally, it is even more challenging to recruit nurses with actual work experience. A cursory view of the Guam Memorial Hospital's stafling pattern will show that the vast majority of nurse vacancies are not for recent grads with no experience, but for nurse positions that nonnally require at least two to three years of professional experience.

3. The measure merely clarifies the existing policy of the government Prior to the passage of Public Law 26-22 in 2001. repayment for service credit under the nurse training program was limited to just the Guam Memorial HospitaL The law was changed so that service credit repayment could be covered through employment at all of Guam's public and private healthcare facilities, including private clinics. Bill 300-32 (COR) merely updates the law to reflect what few in 2001 imagined would happen today -the creation of a new hospital. ]11e measure simply clarifies existing policy.

For the reasons presented above GRMC reiterates its support of Bill No. 300-32 (COR), but would also like to include for the record GRMC's efforts lo develop our local workforce beyond

what this simple yet important legislation seeks to accomplish.

Through partnership with both the University and the Guan1 Community College we folly intend

to provide experiential opportunities to nurses and allied health students throughout the course of

their training, not just after. We desire fonnal arrangements v.ith both institutions to open our

facility to students and faculty to enhance the learning experience. Further. we are also looking

at ways to accommodate and encourage qualified professionals from GRMC to teach at the

University and GCC on a part-time basis. This v.ould allow each institution's programs to

expand.

The Bureau requests that Bill No(s). 300-32 (COR) be granted a waiver pursuant to Public Law 12-229 as amended for the following reason{s):

The Bill is an Act to amend § 151004 of Chapter 15 of Title 17, Guam Code Annotated relative to allowing trainees under the Nursing Training Program (Employment of Trainees: Reimbursement) to agree to accept employment with a private hospital on Guam as a condition of selection and emollment in the Program. Currently, such employment applies to the public health system of Guam, including the Guam Memorial Hospital Authority, the Department of Public Health and Social Services, and the Guam Behavioral Health and Wellness Center, as a school health counselor in the Department of Education or the Guam Community College, or in private clinics. This proposed legislation will extend such employment to include private hospitals licensed to do business on Guam. The intent is administrative in nature and does not have a funding impact on the Government of Guam.

AN ACT TO AMEND§ 151004 OF CHAPTER 15 OF TITLE 17, GUAM CODE ANNOTATED; RELATIVE TO ALLOWING TRAINEES UNDER THE NURSING TRAINING PROGRAM TO AGREE TO ACCEPT EMPLOYMENT WITH A PRIVATE HOSPITAL ON GUAM AS A CONDITION OF SELECTION AND ENROLLMENT IN THE PROGRAM.

BE IT ENACTED BY THE PEOPLE OF GUAM:

Section 1. § 151004 of Chapter l 5 of Title 17, Guam Code Annotated is

hereby amended to read:

1 "§ 151004. Employment of Trainees: Reimbursement.

2 (a) As a condition of selection and enrollment in the program, each trainee

3 shall agree to accept employment as a nurse, either professional or practical, in the

4 public health system of Guam, including the Guam Memorial Hospital Authority,

5 the Department of Public Health and Social Services, and the Department of

6 Mental Health and Substance Abuse, as school health counselors in the

7 Department of Education or the Guam Community College, or in private clinics or

8 private hospitals licensed to do business on Guam, and to continue in such

9 employment for a period of time equal to the period of training under the program.

10 (b) The recipient shall further agree that in the event of the recipient's failure

11 or refusal to fulfill the obligation set forth in Subsection (a), the recipient shall then

12 repay the government of Guam an amount equal to the total monthly allowances
