Schools Nelson from into contracts with text book firms whose books were adopted by the convention of the Utah Text Book league was up before Judge Hall yes rday When court adjourned for the afternoon only two witnesses had been heard Professor W M Stewart of the state normal school and Mrs Jessie Tanner wife of the plaintiff The testimony of Professor Stewart was in effect that the sealed proposals- were opened before the convention ac- cording to law and read that is to say the names of the competing firms were read only the itemized list of books and prices were omitted On crossex animation Professor Stewart admitted that the details were omitted only to save time as it would have taken sev eral hours to read each item The complaint alleges that the bids for the books were not publicly opened and read as advertised and hence the work of the convention was illegal and without authority of law If such pro posals are accepted the complaint al- leges it will necessitate a change in all but three out of the thirtyseven books now in use This it is claimed will en- tail to the taxpayers an enormous ex- pense In answer to the complaint State Su- perintendent Nelson claims the bids v Te opened and read according to law aivi no effort was made at concealment- or fraud The plaintiff in the case is represent- ed by Attorneys Richards and Varian ith Attorneys Vhittemore and The injunction suit brought by StewTanner to restrain State

of Schools Nelson frominto contracts with text book firms

whose books were adopted by theconvention of the Utah Text Book

league was up before Judge Hall yesrday When court adjourned for theafternoon only two witnesses had beenheard Professor W M Stewart of thestate normal school and Mrs JessieTanner wife of the plaintiff

The testimony of Professor Stewartwas in effect that the sealed proposals-were opened before the convention ac-cording to law and read that is to saythe names of the competing firms wereread only the itemized list of booksand prices were omitted On crossexanimation Professor Stewart admittedthat the details were omitted only tosave time as it would have taken several hours to read each item

The complaint alleges that the bidsfor the books were not publicly openedand read as advertised and hence thework of the convention was illegal andwithout authority of law If such proposals are accepted the complaint al-leges it will necessitate a change in allbut three out of the thirtyseven booksnow in use This it is claimed will en-

tail to the taxpayers an enormous ex-pense

In answer to the complaint State Su-
