Scaramucci, known by me to be a credible person who after being duly sworn, upon oath deposes and says that he has good reason to believe and does believe that Tammy T. Polk, WIF, DOB 12/13/1974 heretofore on or about the 9 TH day of, October AD 2008, in the County of Mcl.ennan, and State of Texas, did then and there, intentionally and knowingly, hold herself out as a lawyer, while her law license was suspended by the State Bar of Texas. . Affiant bases his belief on the following facts: My personal observations of a Certified records check through the Supreme Court of Texas, pertaining to dates in which.,Tammy Polk was suspended from practicing law in the State of Texas. I did note that Tammy Polk was suspended from practicing law between September 2, 2008 and October 15, 2008 for non-payment of dues. She was further suspended from practicing law between the dates of September 2, 2008 and November 14, 2008 for non-payment of the Texas Attorney Occupational Tax. After reviewing documents maintained by McLennan County District Clerk, I further . discovered that on October 9, 2008 Tammy Polk signed a Waiver of Jury Trial, Stipulation of Evidence and Judicial Confession, and Felony Plea of Guilty document. She also signed a Disclosure of Plea Recommendation, a Waiver of Appeal, a Trial Court's Certification of Defendant's Right of Appeal, as well as an Attorney Requisition, all of which bear Cause Number 2007-1912-C2.
