The 133rd meeting of the Executive Committee /Board of Directors, of

Federal Government Employees Housing Foundation, was held on 17-06-2015 at

10:00 am, in the Committee Room of the Federal Government Employees Housing

Foundation, Islamabad. The meeting was chaired by Mr. Shahrukh Arbab, Secretary

Housing & Works / Chief Executive, FGE Housing Foundation, Islamabad. List of

participants is annexed.

2. Proceedings of the meeting commenced with the recitation from the

Holy Ouran. Chairman and Director General, FGEHF welcomed the participants.

The Chief Executive briefed the Members of the Executive Committee/BoD that

FGEHF was expanding its activities manifold and in very near future some mega

projects were going to be launched for which the FGEHF required advice and

.support of the esteemed Members of the Committee. The Chair encouraged the

participants to provide meaningful insight and constructive input in all aspects ..

Agenda Item No - 1:

-CONFIRMATION OF THE MINUTES OF 132nd MEETING OF THE EXECUTIVECOMMITTEE I BOARD OF DIRECTORS OF FGE HOUSING FOUNDATION HELDON 08-01-2015

4. Director General, FG Employees Housing Foundation briefed and

updated the participants about proceedings in the erstwhile 132nd meeting of the

Executive Committee and status of implementation in respect of each.

5. in the light of decisions of the Executive Committee taken in 132nd

meeting, Director General laid particular emphasis on the following:

I. To take up the case with CDA on priority, for change in land use of Mauve

Area of Sectors' G-13 & G-14, being exclusive property of the Housing

Foundation. Member (Planning) COA clarified that certain changes in

Islamabad Master Plan may be required. Executive Committee observed that

. dynamics of the urban planning of the Islamabad had changed considerably

on account of New isiamabad International Airport, therefore, the land use of

Mauve Area also required to be revisited.

II. To re-negotiate with COA for purchase of land in Park Road and Sector H-16,

, Islamabad for launching of housing schemes for FG Employees, as earlier

offered by COA. Thereupon, it was briefed by the Member (Planning) CDA

- that H Sectors had been reserved exclusively for -education institutes and

open spaces, therefore, no Housing Project could be envisaged therein and

the earlier proposal in respect of H sectors may be deemed as withdrawn.

o6. It was further briefed by DG, Housing Foundation that Departmental

Working Party (DWP) of FGEHF had been notified on 26-05-2008, yet no PC-I was

ever presented before the DWP. The Executive Committee took a serious notice on

account thereof and desired to immediately convene a meeting of DWP.

7. . The Executive Committee meticulously examined contents of the

Minutes and unanimously confirmed Minutes of 132nd Executive Committee I Board

of Directors meeting. The Executive Committee expressed satisfaction on the

aggregate progress made by the FGEHFin respect of decisions taken in 132nd EC

meeting.

Decisions:

i) Minutes of 132nd meeting of Executive Committee, were

unanimously endorsed and approved by the ExecutiveCommittee.

ii) A Summary to be moved to the Prime Minister for change of land

use of Mauve Area - G-13 & G-14, through CDA recommendingchanges in Islamabad Master Plan.

iii) CFAO may be included as member in the DWP of FGEHF.

ISSUANCE OF BROCHURES TO THE REGISTERED MEMBERS OF HOUSINGSCHEME (PHASE-VI (BHARA KAHU) AND ADVERTISMENT OF REMAININGQUOTAS

8. The Director General, FGEHF briefed the Executive Committee that

registration of Membership Drive (Phase-I) for F.G. Employees started in August,

2009. About 32636 F.G. Employees had been registered so far under various

categories and quotas. Tentative number of workable plots communicated by the

Consultant MIS NESPAK stood at 2469 in respect of (Phase VI) Bhara kahu.Category/Quota-wise break up stood as under:

dailies in 2009, eligibility criteria for Membership Registration Drive (Phase-I), wereas follows:

a. Federal government employees who were in service on or after01-07-2009.

b. One time registration is required for all upcoming schemes(ploUapartment) of Housing Foundation.

c. "First Come First Serve" will be criteria for seniority, if tie on date ofdeposit arise then date of birth shall be taken for preparing ofseniority between them.

It was further briefed notwithstanding the fact that no specific reference was

ever made in the "Advertisement" issued in the national dailies in 2009, to

employees of constitutional and professional bodies as well as widow quota, so far

1500 employees of Constitutional bodies ~nd 221 under the Widow Quota, had got

themselves registered, on their own accord, under the Membership DriveRegistration (Phase-I), as per following breakup.

o11. It was informed that the following quotas which were not advertised in

the previous advertisements, have now been advertised on24-05-2015in national dailies.

12. Approval of Executive Committee was solicited:

i) for the advertisement released in national dailies on 24-05-2015.ii) For placement/consideration of employees registered on their own

accord under Constitutional/professional and widow quotas, on top ofemployees who are now registering under the same quotas.

OR50% quota for both categories be reserved.

13. On the above situation, due deliberation was .done and one view was

. held that since the quota was not advertised earlier. The legal aspects were

examined. It was. argued that the earlier registered members had deposited

membership fee for as long as six years. It was further deliberated that valuable

rights had been accrued against the said quotas and it may not be advisable toreview their registration status at this stage in the light of above situation.

Decisions:

i) The Executive Committee approved. the advertisement. dated 24-05-2015released in the national dailies for quotas not advertisedearlier.

ii) It was decided that As the earlier scheme(Phase-l) was based onFirst come First base, therefore the employees who got registeredthemselves under constitutional/professional and widow quota,be placed on top of employees who are now registeringthemselves under the same quotas. ~

VAMENDMENTS REQUIRED IN BROCHURE

14. The Executive Committee was briefed that in pursuance to the

approval of Prime Minister of Pakistan, dated 19-08-2009 Membership Drive for

future Schemes for the Federal Government Employees Housing Foundation waslaunched in August 2009 on "First Come First Serve Basis",

15. On 30-12-2009, then Secretary for Housing & Works moved another

summary for the approval of Prime Minister of Pakistan and proposed distribution /

allocation of plots in different quotas. The summary was seen by the PM on 01-01-

2010with the direction to Executive Committee to ensure transparency. The

Brochure of the scheme was finalized and transmitted to prospective aJlottees.

During process of issuance of consent letters/brochures, following anomalies werenoted.

16. Approval of Executive Committee was solicited of the

recommendations contained vide column 4 titled "Recommendations", of the abovetable.

17. The Executive Committee observed that the proposed amendments in

the brochure were necessary keeping in view the ground realities lest a substantial

number of government employees may be deprived of their due right. It was furthernoted that it was mentioned in the summary sent to the Prime Minister for

membership drive that the allotment of the plot is a recognition of government

service and it accrues as every individual government employee's right to avail this

obenefit; therefore a plot allotted to one spouse should not de-bar the other of this

benefit. It was also observed by the Executive Committee that the flats/grey

structures/apartments from other bodies such as PHAF in particular, does not de-bar

a government employee from his entitlement to plot by FGEHF. It was agreed that

the affidavit required in the Membership Form from the allottee be amended

accordingly. As regards matter of seniority/priority under the Widow Quota, the

entitlement of widows should correspond to the seniority/priority criteria of the entirePhaseVI Bhara kahu scheme i.e. first come first serve.

Decision:

i) The Executive Committee accorded approval for amendments as

suggested in Column 4 of Para 15/ante, to made in the brochure to make

it compatible with the ground realities/situation.

ii) As it was mentioned in the summary sent to the Prime Minister for.

membership drive that the allotment of the plot is a recognition ofservice to the nation, therefore, plot allotted to a spouse should

not de-bar the other from this benefit. Similarly, a widow can

exercise her right to avail this benefit irrespective of the fact that

being a government employee she has been allotted a plot She is

just required to furnish an affidavit accordingly to avail widow

quota to the effect that her late husband was not allotted any plot.

iii) Allotment of flat/grey structure/apartment from any agency should

not de-bar from entitlement to plot by FGEHF; being not of thesame category.

iv) Widows quota under Phase VI Bhara kahu Scheme be distributed

on "first come first serve II basis to make it compatible .with the .

whole idea of the Phase VI Bhara kahu scheme. However, this

would be one time dispensation and scheme specific.

v) Necessary amendments be made in all relevant

documents/brochures keeping in view the above approvals.

oAgenda Item No - 3:

VAPPROVAL OF HOUSING SCHEME FEDERAL GOVERNMENT EMPLOYEESHOUSING FOUNDATION ENCLAVE PARK ROAD ISLAMABAD.

18. The Executive Committee was briefed that a petition was filed by the

members of Supreme Court Bar Association in the Honourable Supreme Court

regarding implementation of the then Prime Minister Directive for launching a

housing scheme for the members of SCBA. In this regard a series of meetings were

held in the Law Ministry and office of Attorney General of Pakistan for

implementation of the said directive. Finally with the consent of CDA it was agreed

amongst all concerned to acquire 8200 kanals of land in village Mohriayan and

Tumma, Zone-IV, Islamabad. Notification under section 4 of Land Acquisition Act

1894 has been issued in those villages. The said land is being acquired on parity

basis Le. 50% share of residential plots shall go to the members of SCBAP andbalance 50% shall be for the Federal Government Employees.

19. The case was fixed in the Supreme Court of Pakistan on 30-04-2015

and aforesaid notification was produced in the Court. The Honourable Supreme '

Court of Pakistan passed an order on the said petition and operative part of thesame is as under:

"A fresh Notification dated 29-04-2015 has been issued by the LandAcquisition Collector Islamabad Capital Territory for acquiring land fordevelopment of the housing accommodation for the FederalGovernment Employees and members of the Supreme court BarAssociation (SCBA) in villages Tamma and Mohriyan Tehsil & DistrictIslamabad. The Director General Federal. Government EmployeesHousing Foundation (FGEHF) present in court states that the schemefor the residential portion would be developed by the FGEHF on paritybasis for the employees of the Federal Government and Members ofthe ,SCBA; that according to its' policy the proceeds '••from the,commercial area would be utilized for subsidizing cost of residi:mtialplots".

20. In this regard a meeting was held on 07.05.2015 between the FederalGovernment Employees Housing Foundation and office bearers of Supreme Court

Bar Association of Pakistan in the Housing Foundation to settle modalities forallotment of plots to the members of Supreme Court Bar Association of the land

situated at Mouza Tamma and Mohriyan, Tehsil and District Islamabad. The

oExecutive Committee was briefed about the Minutes of the meeting and thereservations conveyed by SCBA in writing.

21. The representatives of the SCBA inter-alia including present and

previous Presidents and Secretary General of SCBA alongwith the members of

SCBA Executive Committee were invited to explain their point of view before theExecutive Committee.

22. After a detailed deliberation and discussion between the SCBA and the

Executive Committee of FGEHF, following with mutual consensus was agreed upon:

i. Residential area shall be shared b/w SCBA and FGEHF members

on parity basis whereas ownership of commercial area shall rest

exclusively with the HF. However, as per policy of HF, proceeds

from commercial area shall be used to subsidize the cost ofresidential plots.

ii. SCBA shall forward the names of its members for membership ofHF.

iii. It was agreed that planning parameters of COA shall be observed in

letter and spirit & layout plan shall be approved by COA. A

consultant according to PPRA rules shall be engaged, for detailed

planning, design and construction supervision of the scheme. All

available residential plots shall be shared between FGEHF &

members of SCBA on parity basis The useable residential land

shall be equally apportioned. SCBA members would be provided

plots of one kanal each from the share of residential landapportioned to SCBA. It was agreed that the layout plan would be in

conformity with the parameters laid down by the COA. One kanal

plots shall be decided through balloting between FG Employeesand Members of SCBA

iv. It was also agreed that if the dues of the plot are not deposited by

any member of any particular category i.e. members of SCBA,

within stipulated periods, the Housing Foundation shall reserve the

right to cancel the plot and same may be placed at the pool of plots

maintained by FGEHF for SCBA, for subsequent allotment to next

oprospective allottee in same respective category, by SCBA within

90 days, upon lump sum payment of all outstanding dues.

v. It was confirmed that plots may be transferable after clearance of

25% dues, at par with other FG employees, as per schedule of

payment of developed plot given by the Housing Foundation and

remaining amount of plot will be charged from transferee of the plot.

Other terms and conditions of the scheme will be implemented as

per brochure for other FG employees in the said scheme.

vi. It was also discussed that SCBA will jointly handle with FGEHF, any

litigation pertaining to acquisition of land or swift execution of

scheme. It was further agreed that in case of internal litigation

between members of the SCBA regarding allocation of plots

pertaining to their share, the matter shall be referred to SCBA for

decision and communication within 60 days whose decision shall be

final. In case of inability of SCBA to decide the matter shall be

referred to Executive Committee of the Housing Foundation.

vii. NOCs Transfers, possession letters, approval of building plans etc.

shall remain responsibility of Foundation on payment of prescribed

.fee, according to standard terms and conditions.

viii. Incumbent & previous Presidents and Secretaries of SCBA shall be

invited as co-opted members of Executive Committee in the next

scheduled meeting.

Decision:

The Executive Committee approved the points agreed with mutual

consensus between the SCBAand the Executive Committee.

VACQUISITION OF lAND IN SECTOR F-14 & F-15 ZONE-I ISLAMABAD, PARKROAD AND BARAKAHU

23. DG, Housing Foundation apprised the Executive Committee the

FGEHF was trying since long for allocation of land in zone-I, from the CDA. In this

regard a few summaries were also submitted to the Prime Minister of Pakistan.

However, presently on 01-05-2015, the Prime Minister of Pakistan was pleased to

allocate sector F-:-14and contiguous area of sector F-15, Islamabad, prior to GT

Road, falling in Zone 1 toFGEHF to be acquired through District Administration for

launching a housing scheme for Federal Government employees and other specifiedgroups.

24. - In pursuance to the approval of the Prime Minister, a request by the

Housing Foundation was made to the District Administration for issuance a

notification under land acquisition act 1894 in those sectors and relevant notification

under section 4 has been issued thereon.

25. Moreover, FGEHF has acquired 8200 kanals of land in Mauza Tamma

and Mohrian, Park Road Islamabad for members of Supreme Court Bar and Federal

Govt. employees and Section 4 under Land Acquisition Act 1894 has also been

issued. Similarly, process is ongoing for acquisition of further 3000 kanals of land inMauza Mohrian.

26. In addition, FGEHF has acquired 6900 kanals of land at Bhara kahu in

Mauza Sakrilla and Section 4 under Land Acquisition Act 1894 has also been issued.

Request for additional 3000 kanals of land is already lying with the leT. Similarly

process is ongoing for acquisition of further 10000 kanals of land upto MurreeExpressWay in the concerned mauzas.

27. It was further briefed that the past experience of the Housing Foundation is

that to avoid multiple litigation a consent award may be approved. Similarly, a joint

single award of land and SUPs should be issued. Approval of the Executive

Committee was solicited regarding Consent Award as well as Single Award of

SUP/Land. ~

Agenda Item No - 5:

VAWARD OF DEVELOPMENT WORK OF SECTOR F.14/15 TO FWO THROUGHNEGOTIATIONS

28. DG, Housing Foundation apprised that so far FGEHF has launched five

housing schemes and provided approximately 23000 houses, apartments and plots

to the Federal Government employees and other specified groups, in Islamabad,

Peshawar and Karachi. Initially, in the projects launched by FGEHF in Islamabad,

the development work was carried out by the Capital Development Authority (CDA)

as deposit work which includes Sector 1-8, G-13 and 0-12. Gradually, the FGEHF

shifted towards engaging private or public sector organizations instead of CDA for

the development work through competitive bidding process under PublicProcurement Regulatory Authority (PPRA),Rules, 2004.

29. The contract for development of Sector G-14 was awarded to MIs

National Construction Limited (NCL) through a competitive bidding. Sector G-14 was

allocated in 2002 and launched in January, 2004, however, despite lapse of a

considerable period of 11 years, the sector has yet not been developed and handed

over to theallottees. Similarly, the old and genuine affecteesalso complain. about

their legitimate grievances. There is hue and cry both from the allottees as well asfrom the affectees due to delay in implementation of the project.

30. Earlier at the time of development of Sector G-13, on a summary

moved by the CDA through Mlo Interior, the Prime Minister was pleased to accord

approval to the proposal to exempt FWO from participating in the bids and to award

work to the Organization on the basis of negotiations only.The Frontier Works

years. On the other side the development work of Sector G-14 could not be

completed even passing a period of 11 years. Infact, the time is basic essence in

implementation of each development project. It is worth mentioning that due to this

since 2005, the FGEHF has not been able to hand over even a single dwelling unit toits members.

31. Recently the Prime Minister was pleased to allocate Sector F-14 and

contiguous area of Sector F-15 prior to GT Road to FGEHF. FGEHF is also going to

acquire more than 8200 kanals of land at Park Road (Zone-IV) for which Notificationunder Section 4 of LandAcquisition Act, 1894 has been issued

32. It was focused that development of Approx 10628 Kanals of land in

Sector F-14 and F-15 in villages Tamol, Jhangi Syedan, Thalia Suyedan, Mara

Sumbal Akku and Mara Sumbal Jaffar, prior to GT road, falling in 40ne 1, IslamabadCapital Territory, for establishment of residential housing scheme for Federal Govt.

Employees and other specified groups has to be prioritized. The entire work of

infrastructure development of Sector F-14 and F-15,prior to GT. road ,measuring

10628 Kanals , including road works sewerage ,structure work ,water supply

electrification etc., has to been done on urgent basis in order to avoid the previous

experience of Sector G-14 ,in the best public interest ,as per relevant rules.

33. The Executive Committee was apprised that as per Rule 42 (d) of the

PPRA Rules, 2004, the procuring agency can adopt alternative method of'

procurement and may engage one or more suppliers or contractors with or without

publication of a procurement notification. and shall. record its reasons andjustifications in writing for resorting to negotiated tendering and shall place on therecord.

34. It was further submitted that FWO is a reputed organization and has

the material resources .andcapable to undertake development work of Sector F-14/15 may be in public interest on the following grounds:

d. For prevention of illegal Built-up Property, the

Contingents/personnel of FWO shall be stationed at the project

site.

e. Time is the essence of the completion of a project, as it

increases the project cost many folds if delayed.

f. To address the grievances of both the affectees as well as the

allottees, timely completion of the project is a must.

g. Organizational strength of the FWO is comparatively

advantageous for the FGEHF

35. The executive Committee had the threadbare examination of the case

and agreed with the proposal of to award the development work of Sectors F-14 & F-

15 to FWO. However, the EC was of the view that while the previous bad experience

of G-14 etc. must not be repeated wherein the development work has not been

completed even after lapse of 11 years, yet at the same time, relevant provisions as

contained in PPRA Rules must be strictly followed. As regards award of

development work contract to FWO, the Executive Committee desired to consult the

relevant authorities and submit back to Executive Committee on urgent basis.

RATIONALIZATION IN DISTRIBUTION OF VARIOUS QUOTAS AND PREREQUISITE/ELIGIBILITY CRITERIA FOR SOME QUOTAS

36. The Executive Committee was apprised that the Senate Standing

Committee on Housing & Works in its meeting held on 20-01-2014 and 15th May,

2015 inter-alia had recommended inter alia that the quota for employees of

constitutional bodies should be increased from 4% to 15 % by revising the quota list.

Moreover, additional 3% quota reserved for the employees of Ministry of Housing &Works and Housing Foundation may be reconsidered. It was also recommended that

Ministry may prepare a fresh summary for the Prime Minister to enhance the quota

for employees of Constitutional bodies, specifically for employees of the National

Assembly and the Senate Secretariats. Further, preference may also be given to the

employeesof constitutional bodies in the forthcoming schemes ofFGEHF.

37. Director Estate, FGEHF pointed out that different quotas which were

recommended / approved by the Executive Committee and seen by the Prime

Minister through a Summary on 01.01.2010, required to be reviewed/rationalized. It

was informed that Journalist and Media Workers who had been allocated 4% quota.

It was argued that media persons had their own housing societies and were given a

sufficient share in other housing schemes of the Federal Government as well as the

Provincial Governments whereas employees of Constitutional and professional

bodies were under-represented by allocation of 4% quota only. Director Estate

further informed that 10% quota had been reserved for employees. retiring before

1.7.2009 (old retirees) and 10% for those who retired between 1.7.2009 to

31.12.2010'(new retirees). It was suggested that now was henceforth, there should

be single 20% quota for all retirees irrespective of their date of retirement, under theMembershipDrive Phase 2, on account of "Age Wise Seniority Criteria",

38. Director Estate further briefed that in the light of above, quota of

Constitutional/Professional Bodies, Media Workers, Journalists and M/o Housing &

Works had been reworked internally by FGEHF and revised quotas were proposedbefore the Executive Committee.

39. Executive Committee agreed that there is need to review the quota ofdifferent organizations/categories keeping in view the present ground

40. The Executive Committee was apprised that a certain criteria were in

vogue including seniority, verification of antecedents, conduct, nature of employment

etc. for the FG employees, whereas no such eligibility criteria for Journalists/Media

Workers, lawyers and other professionals is available. Director Law, FGEHF pointed

out that in Phase-IV G-14/1,2,3 42 plots were reserved for Islamabad Bar

Association (ISA) quota but due to non-existence of eligibility criteria for the

members of ISA, cases are still pending in court of law. It was apprised that the

judgments by the Supreme Court dated 18-01-2011 and Islamabad High Courtjudgment dated 22nd May 2015 speak as under:

Leave to appeal by Supreme Court "what should be the criteria to be

followed by the Bar Association" for making recommendations to theHQusingFoundation.

Recent Decision by High Court "Direction to respondent Foundation to

finalize the process of allotment to lawyers of District Bar Association,

in accordance with relevant quota. . Subject to any adjudicationby competent forum.

41. It was found relevant to inform that on account of inordinate delays due

Therefore, FGEHF had proposed certain eligibility criteria as under:

d. Within the same category, seniority of the member would be

Age Wise Seniority based Membership. However, in case of First. .

Come First Serve based Membership Criteria, the seniority shall be

based on First Come First Serve basis in the relevant Category

e. Satisfactory Conduct to be certified by the Islamabad Bar Council

It was suggested that the aforesaid proposed eligibility criteria should be conveyed to

ISA for their input and the final proposed criteria may be placed in next meeting of

ExecutiveCommittee.

ELIGIBILITY CRITERIA FOR JOURNALISTS/MEDIA WORKERS

42. The EC was further briefed that all Federal Govt. employees

subscribed to membership drive and contribute financially in terms of Membership

Fee serving as seed money..Howeverj exemption of media 'vV0r~ers/journalistsfrom

the. membership drive had caused substantial financial loss to the Foundation in

Sector G 14. Besides such dispensation is discriminatory in nature between FederalGovt. employees vis-a-vis the media workers/journalists.

43. It was informed that Advertisement had been published in the

newspapers on 25-05-2015, for the left over groups including Journalist/Media

Workers, in respect of whom initially in 2009 the quotas were not advertised by

to the grant of Special Allowance @ 20% of running basic pay w.eJ. 01st March,

2013 to all the officers and staff workingih "the Federal Ministries I Divisions only. In

this context, the other Federal Government Employees filed a write petition No.

12/12/2013 before the Honorable Islamabad High Court, Islamabad regarding the

above said allowance, wherein the petitioners claimed along with other employees

that they are entitled and eligible for all benefits Le. salary, facility, allowance, special

allowance and retiring benefits etc., which are already extended to the employees of

the other departments in similar pay scale and requested to pass an order to the

respondent to pay @ 20% special allowance w.eJ. March, 2013.

115. In this regard, the Honorable Islamabad" High Court passed an order

which is reproduced as under:

"The grant of special allowance @ 20% to the employees working in

the Federal Ministnes / Divisions and withholding of the same from

Federal Secretariats, Departments and Statutory Bodies where

Government Scales"are applicable is discriminatory in nature as such "

offensive to the constitutionally guaranteed rights of the those

employees. All the Federal Government Employees are therefore,

held entitled to Special Allowance @ 20% w.e.f. the date the

employees working in the Federal Ministries / Divisions have beenallowed".

116. It was further informed that Finance Committee of the Housing

Foundation had recommended to place the matter for approval of the Executive

Committee."

117. It was found pertinent to mention t~at CDA had already accorded

118. The Executive Committee was also informed that PHAF Employees

had also been granted 20% Special Allowance on the advice of Finance Division. It

was argued that since PHAF and FGEHF enjoyed similar/same status, therefore,

119. The Executive Committee was briefed by the Director Finance, FGEHF

.that Clause-8 of Constitution of Welfare Fund provided as under:

"An account shall be opened'in a scheduled b.ank in the name of

Welfare Fund to be operated upon under the joint signatures of the

Secretary of Welfare Fund and anyone of the Director (Administration)

and Director (Technical)."

120. It was informed that notwithstanding above, as per practice in vogue,

Bank accounts of Welfare Fund are being jointly operated by Director (Finance) !Secretary, Welfare Fund, and Treasurer as co-signatory.

121. It was requested that in order to ensure smooth working/operation of

Welfare Fund, the Treasurer may kindly be allowed to continue as co-signatory with

Director Finance for signatures of cheques of Welfare Accounts and for this purpose,

Executive Committee may accord approval of change in relevant clause of .constitution of the welfare fund.

122. The Executive Committee was informed that in the 3rd meeting of Board

of Trustees of Welfare Fund held on 10th June, 2009, it was decided that all

employees of Housing Foundation would get a lump sum amount on monthly basis

w.e.f. 01.06.2009 to encourage them in getting higher education themselves as well

as to provide incentive for acquiring. quality education for their children for a brightfuture.

123. In the light of above decision, education fee I scholarship was paid to all

employees upto March 2014. Subsequently, the Federal Audit (Works) raised

observation in the Special Audit Report 2012. This observation came. under

discussion in the DAC meeting, which recommended that

"we may direct the FGEHF that in future payments regarding children

education fee/scholarship may only be paid to those employees of

FGEHF who submit any documentary proof of the school, college and

educational institution where they and their children are studying. "

124. In the 10th meeting of the Board of Trustees of Welfare Fund held on 6th

May 2014, Education Allowance was approved for those employees whose children

were getting education as per proposed Rules and Regulations according to

previous slab in respect of each category. Accordingly, payment of Education

Allowance was stopped to those employees w.e.f. 1/3/2014 who were getting self-

education. ~

127. Director Finance, FGEHF apprised the Executive Committee that MIS

S.M. Sohail & Co, Chartered Accountants audited the accounts of FGE Housing

Foundation for the Financial Year 2010-11 in October, 2011. In 129th meeting of

Executive Committee of Housing Foundation, the FGHEF was directed to start

process for selection of new auditors for Housing Foundation to audit the accounts of

Housing Foundation for Islamabad and Karachi offices and Welfare Fund of Housing

Foundation for the year 2011-12 to 2013-14 (Three years) and 2008-09 to 2013-14

(Six years) respectively. The Finance Wing of Housing Foundation has completed

the process of selection of auditors / chartered accountants as per PPRA rules and

also solicited approval from the Competent Authority. MIS lIyas Saeed & Co.

129. The Finance Committee has gone through the balance sheet, the

income statement and notes thereof and examined them. The Finance Committee

raised several queries on different heads of accounts of Housing Foundation and its

details. The Director Finance, Housing Foundation explained them thoroughly and

replied the queries. Various directives were issued by the Finance Committee to the

Director Finance of Housing Foundation with regard to the ~dvances, income tax

,payments, investments etc. The Finance, Committee extended their valuable

guidance and extensive experience so that the corrective measures be taken in the

light of the directives issued by the Finance Committee from time to time. Finally,

The Finance Committee made the following recommendations.

The Director Law, Housing Foundation is directed to submit a brief having

complete details of the following two matters alongwith the legal action taken. so far.

a. An Advance for RS.37.8 Million paid to MIS Universal Enterprises,Lahore for purchase of land for the proposed Housing Scheme ofHousing Foundation at Rai wind road Lahore in the year 1995-96

b. An amount of Rs.4.5 Million was embezzled by Mr. MuhammadYaqoob, Accounts Officer. Housing Foundation in the year 1993-94.

c. The Finance Committee has directed that the matter of loss ofRS.373 million showing' in the Income Statement of HousingFoundation may be taken to the Executive Committee of HousingFoundation, which is related to 1189 apartments constructed byHousing Foundation in G-1113&G-1114(Phase-V).

130. The Director Law furnished the requisite report on points a and bmentionedabove.

131. Furthermore, the honorable members of Executive Committee were

also informed that Housing Foundation has declared an amount of RS.373 million as

loss to Housing Foundation on account of estimated receipts and payments of

Phase-V which is being depicted in the Income statement of the Annual accounts.

Furthermore, the 96 apartments earlier allotted to CDA at nominal prices, are nowbeing put to open auction, in order to cover the losses incurred.

132. It was also submitted that.the accounts of Housing Foundation are updated

and completed in all respects and ready for audit. Federal Government Employees

Housing Foundation is facing several notices received from Income Tax and Security

and Exchange Commission of Pakistan (SECP) since 2011-12 for non-submission of

audited accounts alongwith penalties under the relevant laws are being imposed

133. Further, As per Companies Act 1984, the audited accounts are to be

finally approved in the Annual General Meeting. As per Article-II (sub-clause-d);

permanent member means the subscriber to the Memo and Articles of Association or

as admitted, subsequently as permanent members by the Executive Committee. It is

pertinent that as per Article-IV-A original subscribers are 7 and 6 members were

subsequently approved by the Executive Committee. Therefore at present 13

members of are permanent members of Executive Committee.

134. In view of actions taken/proposed by Housing Foundation vide para 5

and 6 ante, regarding recommendations of Finance Committee mentioned in para 3

ante, Board of Directors may like to accord its consent for:

a. The Executive Committee is req~ested to approve the auditedaccounts of FGEHF for the year 2010-11.

b. The placement of Audited Accounts for the period 2010-11 before themembers of A.G.M for final approval.

Less expenditure was incurred in allthe Development Schemesl Phases due to inevitable reasons andcertain lags in the initiation of newprojects.

o Budget Estimate (Development 2015-16)'137. Budget Estimate for the year 2015-16 is proposed at Rs.

20,510,492,5001- with an approximate increase of 217%. Development Budget with

this huge increase is demanded in the light of work plan for ongoing and future

schemes by the Technical and Project Wing for the next Financial Year and

proposed projects in Lahore, Karachi, Rawalpindi and Islamabad including

maintenancework of ongoing schemes particularly G-13 and G-14/4.

138. . '. The Budget Estimates for the FY 2015-16 were placed before theExecutiveCommittee for Approval.

139. The Executive Committee appreciated the efforts of the Finance Wing

of FGEHF for timely preparation and submission of the Budget for approval.

RESTORATION OF 37 PLOTS IN SECTOR G-13/3, ISLAMABAD.

140. Director Law briefed the Executive Committee that 65 plots were

created in 2009 with the approval of CDA in sector G-13 for allotment to FG

employees and B5-22 officer under Prime Minister Assistance Package. Those plots

were challenged in the High Court by the Resident Welfare Society on the plea that

those plots are carved out from the utility area i.e. Parks and School. The High Court

declared the said creation as void ab-initio.

141. During litigation before the Supreme Court in CP filed by Housing

Foundation, the COA categorically owned/defended creation of 37 plots in sectorG-'

13/3 and stated that those plots had been carved out on unused land of the Housing

Foundation and those plots were not part of Public Park. The %age of green area in

the sector was pointed out as 9.53 which was much higher than the planning

standard mentioned in the Modalities and Procedures i.e. 8%. Unfortunately, during

proceeding of review petition No. 27 of 2013 in Civil Petition No. 2192 of 2010, when

the Honourable Court confronted Director Urban Planning COA about those 37 plots,

he staged a volte face and stated instead that 37 plots which were subject matter of

the petition, had been carved out from the public park and to the said extent, the

area of Public Park was r~duced. Notwithstanding above, Hon. Supreme Court of

Pakistan upheld the decision of the High Court regarding. cancellation of

aforementioned plots and review petition was also dismissed.

142. The affectees of those plots have fHeda writ petition in.Islamabad High .'.

Court Islamabad for restoration of their plots. The aforesaid facts have been

mentioned in the reply of the said writ petition by the Housing Foundation. During

hearing the Director Law, FGEHF apprised to the court about the aforesaid facts andthe Honourable court has directed to place the issue before the forthcoming Board of

Directors meeting of the Housing Foundation for resolving the matter regarding

availability of 37 plots in sector G-13/3. The case has been adjourned for28-5-20 15.- 62 -

As per report of Technical Wing, FGEHF those 37 plots are not part of the Public

Park,.therefore,.,-those plots should be restored. On restoration'of-,those.plots the

affectees I allottees of those plots shall be accommodated accordingly.

143. Member (Planning), CDA pointed out that creation of these plots

needed further examination both from CDA as well as from the FGEHFside,

therefore, it may be appropriate that a committee comprising representative of COA

and FGEHF may be constituted to deliberate/examine the issue and submit its

recommendations to the Executive Committee.

144. The matter was placed before the Executive Committee / Board of

Directors for Restoration of 37 plots in sector G-13/3, that do not fall within the Public

Park, subject to endorsement of CDA as well as subject to satisfaction of High Court.

Decision:

Executive Committee deferred any conclusive decision on the proposal

contained in para 144 ante and Constituted a Committee comprising of

following:

ii) Director (Law), FGEHF

145. Director Law, Housing Foundation briefed the Executive Committee

that in pursuance to the last meeting of Board of Directors a legal notice was served

to MIs Green Tree for cancellation of their agreement, imposition of penalty upto the

tune of Rs.1.2 billion and completion of the project on the risk and cost of MIs Green

........ , T;:,~.a.M/S Green Tree challenged the said litigaiion 'iitrough Civil Suit in the

Islamabad High Court Islamabad with the prayer for grant of stay order and. to

restrain the Housing Foundation to not issue allotment letter to their prospective

allottees and do not start the development work.

146. The instant case is of an extremely important nature as a huge stake of

Housing Foundation as well as 32636 registered members is involved. Therefore, it

was decided to engage senior lawyers for defending the instant suit in the court of

law on payment of special fee. In view of this Mr. Abdur Rehman Siddiqui, Advocate

Supreme Court of Pakistan and Mr. Sardar Ali Raza, Advocate were engaged on

payment of fee amounting to RS.100,OOO/- for each to defend the same, with the

commitment that the remuneration shall be increased to RS.500,OOO/- each in the

event of successful outcome only. They are vigorously pursuing the said case and at

yet the court has not issued stay order. The Housing Foundation has also proceeded

with allotment of plots to its prospective allottees and so far 1392 offer letters have

been issued in accordance with the decision taken in the 132nd EC meeting.

147. As per Memorandum and Article of Associations clause-VIII (h) which

is reproduced as under the Executive Committee is competent to accord the

approval of fee for the aforesaid purpose.

To appoint and, at their discretion remove or suspend managers,

secretaries, engineers, officers, legal advisers, clerKs arid servants

etc., for permanent, determine their powers and duties and fix their

salaries or emoluments and to acquire security in such instances and

for such amount as they think fit, and to send such persons to foreign

countries for technical education and pay all expenses thereof on such

terms as the Executive Committee may think fit.

148. The case was placed before the Board of Directors meeting for one

time approval of Rs500,OOO/-each as legal/professional fee/remuneration, for the.

above named legal counsels subject to successful outcome in favor of HF, in the

Civil Suit pending in the High Court., titled "MIS Green Tree vs Secretary Housing et

al".

ENHANCEMENT OF COUNSEL'S FEE

149. Director Law briefed the Executive Committee that the panel lawyers of

Federal Government Employees Housing Foundation have constantly been

requesting the HF regarding enhancement of court fees for District Court and High

Court. The Housing Foundation since 2009 is paying the following professional fee

based on the then Standard Rate fixed by the Ministry of Law & Justice and othersister organizations such as COA, NHA etc.;

a. Retainership fee of RS.15,OOOI-per month to the legal advisor ...b. High Court cases fee of RS.14,4001- including Misc. expenses.c. Lower Court cases fee of RS.9,6001-including Misc. expenses.

150. The Ministry of Law & Justice as well as CDA and other organizations

has enhanced their fees structure since 2012. The Executive Committee of HF in its

132ndmeeting enhanced the fee recovered from the allottees in shape-of litigation

charges. The said recovery charges are based on the actual cost the HF incur on

each case excluding the processing fee. So far nothing is outstanding in so far as

recovery of litigation charges is concerned and the DAC has already reconciled thefinancial accounts in this regard.

amenity plots in Sectors G-13 and Mauve area Islamabad and Karachi, without

involving public exchequer, certain EOls have been floated indicating specific termsand conditions, in national dailies as per following detail.

. a. An Expression of Interest was invited through leading Newspapers Le. The

Daily Jang, The Dawn, Daily Public Eye, and PPRA website for Joint Venture

for new Housing 1 apartments Schemes for Federal Government Employees

inProvincial Capital and major cities of Pakistan on 22-03-2015.The last date

for submission of proposal of Joint Venture was 21-04-2015. In response the

Housing Foundation received proposals of 11 firmsl companiesl individuals.

The proposals have been presented before the Evaluation Committee to be

followed by referral before Steering Committee. .The first meeting of.' . . .

prepared which is under scrutiny with the direction from the CEO FGEHF to

at Islamabad in Sector G-13 1 G-14/4 Mauve Area, Sector G-13 Markaz,

Sector G-13 Parks, Play Grounds, Schools, Community Centers, Hospitals,

Hostels etc., Sector G-13 Shopping Centre. The last date for submission ofproposals is 04-07-2015.

c. An Expression of Interest was invited through leading Newspapers Le.

Express tribune, Daily Jang and PPRA website on 22-05-2015 with the

approval of Chief Executive of FGEHF for land located at Karachi at followingsites:

i. Scheme-33, Gulzar-e-Hijri Karachi

ii. Mono Goth, Old Sabzi Mandi Karachi

The last date for submission of proposals is 21-07-2015.

153. It was further informed that a high level Steering Committee had been

notified vide notification dated2"dJanuary 2003, to examine the strategy for disposal

of commercial assets in Sector G 13, G 14 including the Mauve Area and

recommendations of Steering Committee, shall be placed before the ExecutiveCommittee for final approval.

154. The Executive deliberated upon the proposals submitted by the

FGEHF regarding joint ventures with the private sector. The EC was of the view that

the there should be certain standardized criteria for' evaluation of each proposal in

order to safeguard the interest of the allottees/government and to ensure

transparency. The Executive Committee agreed with the observation of the CEO on

file that the constitution of the Evaluation Committee should be enhanced by

including representatives from the Planning Commission and the Law Division.

ExecutiveCommittee further observed that FGEHF should examine such JV models

with private sector adopted by other government organizations. In this. regard,

Member (Planning) CDA pointed out certain features of a successful model recently

adopted by LOA Lahore and offered to provide requisite documentation. A copy of

MoU developed by the FGEHF and examined by Evaluation Committee, was alsohandedover to Member (Planning) COA for his valuable inputs.

155. Approval of Executive Committee was solicited for the strategy adopted

vide para 152 and 153 ante and the draft MOU referred to vide para 152 (a) ante.

DISPOSAL OF ADDITIONAL 122 C, D & E - tyPE APARTMENTS AND 37 NOS.SHOPS AT FL & SBSITE IN SECTOR 24-B, (PHASE-Il.KDA SCHEME-33,GULZAR-E-HIJRI, KARACHI

156. PO Karachi briefed that in Phase-I of the Housing scheme for FGEHF

at Scheme-33, Gulzar-e-Hijri, Karachi, two plots each measuring 200' x 250' were

reserved for flats as FL and commercial site as S8 (sector 24-8). It was further

informed that Apartment Scheme at Karachi for low paid Federal Government

Employeeswas announced on pt May, 2007 planned on these plots.

157. PO Karachi briefed the participants that originally the project was

planned as G+4 with the provision of 278 Apartments for Govt. Servants. (100 C-

Type, 118O-Type & 60 E-Type). The scheme was approved in 88th meeting and was

launched in Feb. 2007. All 278 apartments were booked to Federal Government

Employees. Subsequently on the instruction of Ministry of Housing & works the

project was re-planned with G+7 (Package-I) and G+8 (Package-II) increasing the

total number of apartments from 278 to 400. In addition, on S8 Plot there are 37

out. The total area of these shops is about 9400 Sq.ft. ".,

158. It was informed that remaining 122 apartments (28 C-type, 84 0-Type

and 10 E-Type) were proposed to be sold to General Public at the rate of

RS.3.5Million, RS.2.9 Million and RS.2.2 Million subsequently for C, 0 and E type.

These additional apartments were advertised in 2010 but only 4 Nos. of applications

were received which later on returned back.

159. It was further informed that applications were again invited from the low

paid Federal Govt. Employees (BPS 1-16) in March-2015 for the apartments located

at FIVE (5) + above stories of the Project in Phase-I of the Scheme-33, Gulzar-e~

Hijri, Karachi. However, despite relatively wider publication in the print media and

posting of the advertisement on the websites of PPRA and FGEHF, yet again a poor

response was received at the end of the deadline Le. 31st March, 2015.The total

applications received in the 3 categories available are as under:

1. C type --18 Nos.. 2. 0 type - 1 Nos.3. E type - 4 Nos.

23 Nos.

160. It was clarified that the poor response has been mainly due to the

worsening law & order situation in general and in Scheme-33, and adjoining areas in. ,

particular, during the last few years as well as on account of unavailability of services

e.g. water, electricity, sewerage, road infrastructure, gas and security.

161. A financial statement of expected loss in the project was presented

before the Executive Committee indicating therein that Housing Foundation is

expected to incur a loss of about RS.200/- Million in Phase if the apartments are to

be offered to Federal Govt. employees at the earlier approved rates i.e. It was found

relevant to point out that audit authorities are expected to raise an objection in case

project is closed at a loss, as has,'been the case in the.past '.' " ..... 162. It was recalled that an EOI has also been floated on 22-05-2015, in the

national dailies inviting Joint Ventures for FGEHF land in KOA Scheme-33 and Mono

Goth, Old Sabzi Mandi, Karachi, to explore multiple options, referred to in para 152(c) ante.

163. On a query by the Executive Committee, it was briefed by the POKarachi that recently, in the wake of Safoora Goth incident, provincial govt. had

road 'Passingin front of FGEHF Flats had been started. FlJrther,'a Police Post had

also been established near the flats. Keeping in view the recent developments, it is

expected that the price/response against such flats will increase if properlyadvertised.

164. It was further informed that for evaluation of 37 shops, an

advertisement was floated in national dailies. However, M/S Anjum Adil Associates

who were declared successful as a consequence of their lowest bid had expressed

their inability to undertake the assignment. It was suggested that MIS NESPAK who

had quoted second lowest bid amounting to RS.9 million, may be considered for the

assignment, in order to prevent further loss of time and to ensure quality of finaloutput.

165. Foregoing in view and with the aim to offseUmitigate the losses to a

considerable extent, it was proposed as under:

a. In the interest of low paid Federal Govt. Employees, applicationsmay again be invited from the low paid Federal Govt. Employees(BPS 1-16) for one last time, for the apartments located at FIVE (5)+ above stories of the Project in PhasEr-1of the Scheme-33, Gulzar-e-Hijri, Karachi, after wider/better publicity/marketing and underdirect supervision of Director Finance FGEHF.& PO Karachi, fromFGEHF office Islamabad. Fate of 23 applications referred to in para159 ante, may be deferred for the time being and be decidedaccordingly, consequent upon nature of response received this.

ORb. To mitigate the loss accruing to the Foundation, remaining 122

apartments and 37 nos. shops may be auctioned in the openmarket for fetching the optimal price of these assets, consequentupon report of evaluator.

ORc. To eliminate entirely the loss accruing to the Foundation, a Joint

Venture agreement be contemplated with a sound investor /developer/firm with the understanding that if the aforementionedfinancii3lloss. i~entirely recovered from the JV partner, all -remainingapartments and shops shall be offered in lieu thereof, with theproviso that the JV partner shall be obligated to ensure provision ofservices e.g. water, gas, electricity, security etc.

conditions, which needed to be reviewed due to certain obvious

168. It was further apprised that on the above endorsement, _~meeting was

others. It was briefed that Chairman COA had agreed to withdraw the condition of

allocation of 5% residential plots for COA as well as development work to be done by

CDA at deposit work. However, Chairman COA had suggested that allocation of

commercial area exclusively in favor of COA required to rationalized and a sharing

formula be preferred. It was agreed that COA and FGEHF will sit together to bring

the workable formula for sharing of commercial area as Mauve Area does not exist in

case of Sector G 1513.

169. Approval of the Executive Committee was solicited on the clarification

offered by FGEHF in para 167 ante, with the proposal to acquiesce in the formula

presented by Chairman COA to share commercial area of Sector G 1513 on mutually

beneficial terms and conditions.

170. The Executive. Committee agreed in principle with the endorsement

sent by the FGEHF. It was however desired that the sharing of Commercial Area

may be further negotiated with the COA to extract maximum out of this so that

unnecessary burden may not be transferred to the allottees.

Decision:

The Executive Committee approved the proposal made by FGEHF vide

para 187 and 189 ante, with the direction to FGEHF to further negotiate

with the CDA in the best interest of prospective allottees of G 15/3.

171. OG, Housing Foundation apprised the Executive Committee that a

constructed structures. Therefore, it may not be possible to develop the sector F-12

while remaining within the above approval of the Prime Minister. Following

clarifications/recommendations were therefore made in respect of original summaryapproved by PM:

Initially, in the projects launched by FGEHFin Islamabad, the development, wOfk wascarried out by the Capital DevelopmentAuthority (COA) as deposit work.Gradually, the FGEHF shifted towardsengaging private or public sectororganizations instead of COA for thedevelopment work through competitivebidding process under Public ProcurementRe ulato Authorit PPRA Rules, 2004.No specific approval for acquisition of landthrough LAC has been conveyednotwithstanding the fact that the originalsummary moved by Housing Foundationdid provide. for such a mechanism.Subsequently, the matter remained underneglect and consequently a large numberof built up properties have cropped up.Under the circumstances, whereasacquisition cost under Land Acquisition Acthas become prohibitive at the same time. itis also feared that the Sector shall soontransform into something like Sector G 12and shall become a home to all criminalelements of the city. Relevant to mentionthat the Sector shall pose a major securityrisk for the proposed GHQ in closeproximity.In view of insurmountable challenges, itwas considered expedient that in such likecases, possibility of a joint venture with apublic or private sector company may beexplored. Recently EOIs have been soughtthrough national press to provide servicesin all matters related to land acquisition,litigation, holding peaceful possession andto clear and maintain possession ofdisputed lands of FGEHF on Joint Venturebasis. This arrangement shall enable theHousing Foundation to outsource the entireactivity of management of the. landacquired/procured/leased/granted/allocated to FGEHF and toextract benefit out of the sector for FederalGovt. 173. In response to the EOI floated in national dailies in March 2015, asingle proposal had been received by M/S Alawal indicating therein that they shall

present a workable proposal free of charge with the undertaking that the

arecommendations made by M/S Alawal, shall not be binding upon the Housing

Foundation and may only be placed before the ExecutiveCommiHeewithin 30 daysof submission, for final decision.

174. It was further briefed that FWO had also indicated interest in

development of the Sector in view of close proximity with proposed GHQ due to

apprehension that if the Sector is not organized and developed at this stage, it shall

constitute security hazard of immense proportion in foreseeable future, keeping in

view the experience of Sector G 12. In view thereof, it was recommended that a

summary is required to be submitted before the Prime Minister for revision of

erstwhile approved criteria for F 12 i.e. FGEHF shall retain all commercial area

instead of COA alongwith the recommendation that FGEHF may be allowed to enter

into a JV with a private/public land developer in the best interest of Federal Govt.

Employees and the Sector may be developed through a JV agreement instead ofCOA.

175. The above recommendations were submitted before Executive

Committee for consideration and approval.

Decisions

Executive Committee approved following:

I. A Summary may be moved to the. Prime Minister requesting him for

revision of his earlier decision dated 26-07-2005 to make the F-12

scheme viable, in the light of recommendations made vide para 172and 174 ante.

II. Option of JV or any other arrangement with FWO may be explored in

consultation with relevant authorities.

III. As regards receipt of only one proposal of TIllisAlawal Group, for

Sector F-12, it was decided that the same may be re-advertised in the

national pressiPPRA website and fresh bids/applications be invited.

176. Director General FGEHF briefed the Executive Committee that

consequent upon approval of the Prime Minister of Pakistan, notification under

Section 4 of Land Acquisition Act 1894 has been issued by LAC for 10628 kanals of

land in mauza tarnol, jhangi syedan, thalia syedan,. mera sunbul akku and mera

sunbul jafar etc. Similarly, another notification under Section 4 of Land Acquisition

Act 1894 has been issued by LAC for 8200 kanals of land in mauza Tamma and

Maurian. Moreover, another notification under Section 4 of Land Acquisition Act

1894 has been issued by LAC for 6900 kanals of land in mauza sakrilla.

177. In order to ensure that Housing Foundation maintains an accurate

record of Built Up Properties in the notified areas, it is. imperative that satellite

imagery of high resolution alongwith digital certificates indicating the specific date

and time of notifications under Section 4, is procured. The Punjab Urban Unit is

prepared to provide the relevant services at market rates, for which they have

already been requested to first provide the satellite imagery in respect of Sectors F-

14 and F-15, where the issue of BUPs is more pronounced.

178. Approval of Executive Committee was solicited for the strategyrecommended vide para 177 ante.

Executive Committee accorded approval to the strategy adopted by the

APPROVAL OF WATER FEASIBILITY REPORT FOR LIFE STYLE RESIDENCYPROJECTSECTOR G-13

179. Director Technical apprised the Executive Committee that the Housing

Foundation planned High Rise Apartment scheme for Federal Government

Employees on land owned by FGE Housing Foundation in sector G-13/1 & 4,

Islamabadon joint venture basis. Land measuring 10.10 acres and 5.27 acres in two

pocketswas reserved for construction of apartments.

180. FGE Housing Foundation forwarded the layout plan of the project to

CDA for approval. The CDA raised certain issues inter-alia including that the

Housing Foundation to come up with complete water feasibility report for provision of

water on sustainable basis. In addition to this the residents of sector G-13 are also

facing water shortage. Further, development work in sector G-14/1 ,2,3 is on-going,

and in near future, the possession will be handed over to the allottees. It is also

worth mentioning that recently the Prime Minister has been pleased to allocate

Sector F-14 & F-15 to the Housing Foundation to develop housing scheme for

Federal Government Employees. In the light of the above and to meet the water

requirements, Dr. A.D. Khan was selected as Hydrologist Consultant with the TORs

to submit water feasibility report. In this regard Dr. AD Khan Research Hydrologisthas submitted its report.

182. . The table indicated that an appropriate potential of surface water exists

if stream flow lrunoff during rainy season is harvested and conserved properly by

constructing a small retaining structure of storage. The stored stream flow can fulfill

water' requirement even after meeting the operation losses like evaporation ad

seepage during storage period of one year. However, to avoid any emergency

situation, Installation of reasonable number of Tube wells may not be completely

excluded from the planning as well. Such arrangement should be sufficient to cater

at least 5-days' water needs of housing scheme, which may be required for

necessary maintenance of the existing water supply system. '

183. ' The proposed activity will cost amounting to RS.132.09 million. The PC-

I reqUiresto be submitted to the competent forum for the approval.

Decision:

The Executive Committee approved the proposal in principle to goahead to tap water resourcesin the light of the subject Water Feasibility

184. Director General, Housing Foundation briefed the Executive Committee

that BoD in its 1oath meeting dated 09-09-2009 approved 2% quota for employees of

Ministry of Housing & Works and its attached departments in all future schemes of

F.G. Housing Foundation as per following distribution;

i. Ministry of Housing & Works 1%

ii. Pak PWD 0.5%

iii. Estate Office 0.3%

iv. NHA 0.2%

185. It was further apprised that eligibility criteria of the said quota as

approved by the Executive Committee is as under;

a. 10 year~ regular Federal Government Service.

b. 1% years continuous stay in Mlo Housing & Works

c. Affidavit for non-allotment of plot by FGE Housing Foundation' CDA in the

past Housing Schemes.

186. It was further apprised that the matter again came under discussion of the

Executive Committee in its 109th meeting dated 10-12-2009. The Executive

Committee approved allotments to the employees working in Mlo Housing & Works

in existing I current schemes of the" Housing Foundation subject to the extent of

availability of plots. It was" further decided that the remaining employees should be

accommodated in future schemes. In pursuance to the decision of the Executive

Committee dated 10-12-2009 allotments had been "made in different phases against

this quota as per detail given below;

187. The Executive Committee was briefed about tentative category wise

plot position available in Green Enclave, Shara Kahu.lt was pointed o.ut that Mlo

Housing & Works had sent list of its employees for allotment which was also

presented before the Executive Committee. A sub-committee comprising of Director

(Finance), Director (Technical) and Director (Estate) was already constituted on

February 2010, to examine the cases for allotment of plots in Phase IV, to the

employees of Mlo Housing &Works and its sister organizations.

188. The EC was further apprised that an inquiry is ongoing by the orders of

PM, to look into alleged irregularities in all allotments in different categories. The

inquiry team was headed by Special Secretary Law, Justice and Human Rights

Division. The said inquiry report has reportedly been furnished to the PM Secretariat

on 14-5-2014. The operative part of the inquiry report pertaining to quota for Ministry

of Housingand Works and attached Departments was reproduce~ as under:

II The employees of Ministry of Housing and Works and its attached

departments are federal govt. employees and there is already a quota, .

for Federal Govt. employees in the schemes, of the Housing

Foundation. Allocation of separate quotas for Ministry employees has

given them undue advantage over other federal govt. employees

posted in various other Ministries/Divisions/Departments. Hence the

principle of equality was compromised. "

It was stated that the said report is pending with the Prime Minister Secretariatfor final decision.

189. It is found pertinent to recail that whereas Ministry of Housing and

Works has already forwarded a list of prospective allottees under the Ministry quota

and these officers are clamoring hard for allotments in their favor, any further delay

in issuance of POLs against the Ministry quota may also contribute towards financial. .

quotas including 2% Ministry Quota in the summary moved by Ministry of Housing,

and instead hardship quota be abolished in previous phases. However, FA Yvorks

objected that the extract of report of Ministry of Law, is without any signatures from

any competent authority and hence could not be relied upon without due verification.

191. It was reiterated by DG Housing Foundation that Housing Foundation

was of the considered aggregate view that Ministry quota should not be done away

with. However, in order to avoid any complication, Executive Committee may

consider it appropriate to await final outcome of inquiry from the PM office. It was

recommended that it may even be advisable to formally request the PM office along

with the decisionlrecommendation of Executive Committee and a representation

from employees of Ministry of Housing and Works to the effect that the Ministry

Quota should be continued as per spirit of erstwhile decisions of Executive

Committee, being a competent forum, at least to the extent of Bhara Kahu Schemein order to avoid any legal complications,.

192. The Executive Committee has a detailed discussion on the issue. One

view was held and supported by majority of the members that since the decision on

summary forwarded to the Prime Minister has not been received, the allotments

against the Ministry of H&W quota may be kept pending, however, the plots against

2% quota of the Ministry may be kept in reserve and not allotted to anyone else. The

other view was that since the final report has also reportedly been submitted to the

Prime Minister, which inter-alia recommends that the Ministry quota may be kept

intact, therefore, allotment letters may be issued against the Ministry quota. The

Executive Committee desired to examine that report by Ministry of Law, Justice and

Human Rights Division; however, only last two pages of the report were shown in the

meetingwhich were found without signatures by any competent authority..Decision:

Executive Committee directed Director Estate, FGEHF, to obtain the

authenticated copy of the final report of Law Division and present it

~CASE OF DR. ASLAM KHAN. KHATTAK

193. Director Law, FGEHF briefed the Executive Committee that that

Phase-IV housing scheme was launched in January 2004. In the said phase 8%

quota was reserved for the employees of autonomous bodies control by the Federal

Government. Dr. Aslam Khan Khattak applied for allotment of Cat-I plot under the

said quota. He was allotted a Cat-I plot No. 54, Street No. 117, Sector G-14/3, and

he deposited the cost of land of the said plo~. After that during the scrutiny of the

application it came in the knowledge of the Housing Foundation that he was an

employee of autonomous body of Provincial Government. Therefore, his allotment

was cancelledI withdrawn.

194. He challenged the said cancellation in High Court and filed a writ

petition in Lahore High Court Rawalpindi Bench Rawalpindi. The High Court decided

the said writ in his favour and copy of judgment is at . The operative part of the

judgment is as under:

"In view of the foregoing discussion, the petitioner is declared tobe eligible to the allotment of the plot in question. Accordingly ,this writ petition is allowed and respondent No. 1's letter dated21-2-2009, cancelling the allotment of plot in favour of thepetitioner, is declared to be unlawful and without lawful authority.Parties are left to bear their own costs".

195. The said judgment was challenged by the Housing Foundation in the

Honourable Supreme. Court of Pakistan and the Court decided in principle that the .

employees of Provincial Government were not eligible under Phase-IV housing

scheme of the Housing Foundation. However, on the Principle of Locus Poenitentiae

it was decided to restore his allotment. The operative part of the judgment is

reproducedas under:-For the foregoing reasons the petition is converted into appeal

and partially allowed. The findings of the High Court on th~interpretation of para 1 :.1. (b.) of the General Clauses A~ts .ISset aside and it is held that the employees of the ProvincIalAutonomous / .Semi Autonomous Bodies are not entitled toallotment of plots under the said provision. However since theallotment of the plot to the respondent is upheld on theprinciple of locus poenitentiae, the operative part of theimpugned judgment allowing the constitution petition of therespondent is maintained.

196. The Housing Foundation filed a review petition against the said

judgment and the same was also dismissed. It will be relevant to mention that said

cancelled plot was allotted to one Mr. Javed Akhtar under hardship quota.

197. Dr. Aslam Khan Khattak filed a contempt petition in the Islamabad High

Court Islamabad for implementation of the judgment which had attained finality, The

honourable High Court was apprised that the said plot was allotted to next

successfulapplicant and at present there is no Cat-I plot is available and Mr. Khattak

shall be allotted first available plot in the said scheme. The Honourable court on 19-

5-2015 directed to restore the allotment of aforesaid plot of Dr. Aslam Khan Khattak

and operative part of the said order is as under:

"It transpires that judgment passed by this court was later onchallenged through CPLA No. 1206/2010 before the honourableSupreme Court and leamed apex court upheld same as such it~ttained finality. On the day of pronouncement of judgment, it wasIncumbent upon the respondents cited in the present petition toreverse al! the pr?ceedings initiated for allotment of plot to someoneelse, by v~rtueof Judgmentspassed by two respective higher forums,the plot In question (Plot No. 54, Street No. 117, Cat-A G-14,'Islamabad) was restored to the petitioner.Th~ above said off~cial(Director Law) of the Respondents seeks timeto Implement the Judgment ~assed by this court as well as by thelearned Apex Cou~~ resp~ctlvely, as they intend to further processthe matte: by appnsmg their:high ups.Request IS allowed and 1? days time is granted to the Respondentsto do th.enee~ful after which case is to be relisted".

of which such letter can be issued. It was further briefed that a fact finding inquiry is

ongoing in the Ministry of Housing and Works against alleged malpractices in the ...instant case.

199. Both Mr. Aslam Khan Khattak and Mr. Javed Akhtar were invited

formally to be heard in person. However, Mr. Aslam Khan Khattak did not turn up.

200. Matter was placed before Executive Committee for consideration I

advice and decision please with the recommendation to authorize a formal inquiryinto alleged malpractices.

201. The Executive Committee heard the grievances of Mr. Javed Akhtar in

detail and went through the case, especially the judgments passed by the Honorable

Superior courts and found that since the judgments had attained finality, hence there

is no other option left except to implement the orders of the courts.

Decision:

I. The Executive Committee directed'. to implement judgment ofHonorable Supreme Court of Pakistan dated 19-05-2015 in letter and

spirit for restoration of Plot No. 54, Street No. 117, Cat-A G-14,

Islamabad to Dr. Aslam Khan Khattak.

II. It was decided that the ongoing inquiry be concluded within 14 days

and findings of ongoing inquiry proceedings be presented before the

next Executive Committee Meeting.

202. The meeting ended with.a vote of thanks.

It was also informed Two advertisements had also been floated in the press by

Ministry of Information on its own accord, inviting applications for allotment of plots. It

was further informed that in this context two meetings have been held between

FGEHF and Ministry of Information alongwith representatives of Journalists and

Media Workers. The Minutes were presented before the EC.

44. EC was apprised that the Ministry of Information had shared certain

criteria for determination of eligibility /category for prospective Allottees. In addition,

FGEHF has recommended the following criteria to Ministry of Information, for

appropriate determination of eligibility/ category wise seniority of a prospective

allottee amongst Journalists/Media Workers, as under:

a. Membership of the Foundation should be a pre requisite for

eligibility under any scheme.

b. Membership with the relevant registered Media/Journalist body.

c. Seniority of the member to be based on Age wise

Experience/Seniority in the relevant registered body/employer, in

case of Age Wise Seniority based Membership. However, in case of

First Come First Serve based Membership Criteria, the seniority

shall be based on First Come First Serve basis in the relevantCategory

d. Satisfactory/Good Conduct to be certified by the following inter alia:

i) Employer Satisfaction Certificate

ii) Certificate of good conduct from PEMRA,.PCP, PID and Ministryof Information

iii) Declaration from prospective allottee alongwith certificate from

Employer that no litigation regarding contempt of court ordefamation or libel suit is pending.

45. . It was informed that the' aforementioned ".criterion had been

communicated to Ministry of Information for formal endorsement. It was reiterated

that the particulars mentioned by a prospective allottee in the Membership Form,

shall be subject to final verification of antecedents by the Ministry of Information

Agenda Item No - 8:

MAnERS PERTAINING TO SECTOR G-13 AND G-1411,2,3

a. HANDING OVER PHYSICAL POSSESSION TO THE ALLOTIEES OF PHASE-

IV, SECTOR G-1411.2.3 ISLAMABAD

46. DG, Housing Foundation apprised the Executive Committee that the

infrastructure development work in sector G-14/2 & G-14/3 was awarded to MIs

National Construction Limited (NCL) on 24-08-2012 for an amount of

RS.1,499,439,872. The contract period was initially for 24 months. However, physical

possession of the site could not be handed over to MIs NCL and .District

Administration and the law enforcement agencies along with the Housing foundation

were making all out efforts to get physical possession of sector G-14/1,2,3. In this

regard a grand operation for demolition of the Built-up Properties in the said areas

was launched by LAC and possession of more than 75% of G-14/3 had been handed

over to the contractor.

47. It was explained that under the circumstances, it was very difficult for

the Housing Foundation to keep watch and ward of all the vacated areas without full

support of Law Enforcement Agencies and the public at large. In this connection, it

was proposed that since the master plan of the said sector had already been

approved by the CDA, so Physical possession of all those plots where no

Is \I\fhere Is basis" with the condition that the prospective Allottees shall furnish an

undertaking to FGEHF to the effect that they shall remove the structure (if any)e.g.

perimeter wall, if and whenever contractor required the same to be removed, for

provision of services/infrastructure works. It was explained that such dispensation

shall be to the interest of the Housing Foundation and the owner of the said plot will

himself guard any further un-authorized occupation over his plot.

b. PROCESSING OF PC-I

48. Director Technical, FGEHF apprised the EC that the Federal

Ombudsman office had issued a recommendation/direction dated 11-3-2015 that

. henceforth maintenance and other allied matters including provision of services,

pertaining to Sectors G-13 and G-14 shall be performed by FGEHF instead of CDA.

49. It was further informed that as per clause-6.8 of Manual of

Development Projects issued by Planning Commission, DWP had been notified vide

notification dated 26-05-08 for approval of development projects/programmes

accordingto their approved financial limits.

50. It was stated that in view of above, following PC 1s had been prepared

accordingly, for referral to DWP by the Executive Committee.

a. G 14/1,2,3 amounting to Rs.7098.673 million

b. Maintenance of sector G-13 & G-14 amounting to Rs.979.637 M

i. Street Lights Rs.155.09 million

ii. Roads Rs.737.447 million

iii. Water Distribution Rs.87.19 million.

c. GENERAL AND CONSTRUCTION BYLAWS FOR HOUSING SCHEMES

LAUNCHED & DEVELOPED BY FGE HOUSING FOUNDATION

51. It was further briefed that since as per Wafaqi Mohtahsib's

recommendation/direction dated 11-3-2015, operation / maintenance of sectors G-13

and G-14/4 is responsibility of Housing Foundation i.nstead of COA, Housing

Foundation has to adopt some bylaws for construction of structures and regulation of

52. It was proposed that COA General and Construction Bylaws may beadopted mutatis mutandis by the FGEHF.

d. IMPOSITION OF SERVICE CHARGES/RENT FOR GARBAGE COLLECTIONAND OTHER SERVICES LIKE STREET LIGHTS. WATER SUPPLY.SEWERAGE. BILLBOARD FEE. CABLE OPERATOR CHARGES, MOBILETOWER CHARGES. INTERNET SERVICE PROVIDER CHARGES ETC.

53. It was suggested that in order to ensure smooth and uninterrupted

services regarding operation / maintenance of sectors G-13 and G-14/4 by Housing

Foundation instead of COA in the light of Wafaqi Mohtasib's recent

recommendation/direction dated 11-3-2015, FGEHF may kindly be allowed to collect

Service charges for Garbage Collection and other services like Street Lights, Water

Supply, Sewerage, bill board fee, cable operator charges, mobile tower charges,

.internetservice provider charges etc., which were being collected by COA.

Decision:

TheExecutive Committee unanimously accorded approval for:

a. Physical possession of all those plots in Sector G-1411,2&3

where no encroachment existed, to be handed over to bona-

fide Allottees on "as is where as basis" with the condition that

the prospective Allottees shall furnish an undertaking to

FGEHF to the effect that they shall remove the structure (if

any)e.g. perimeter wall, in case contractor requires the same tobe removed, for provision of services/infrastructure works.

b. PC-1s regarding G-1411,2&3, maintenance of G-13 & G-14 and

Development of G-13Markaz,tobereferred toDWP with the

direction to call a meeting within 15 days.

c. CDA General and Construction Bylaws to be adopted mutatis

mutandis by the FGEHFwith the direction to make necessary

amendments in CDA Codes, as per requirements of HousingFoundation ~

Agenda Item No - 9:

ENTRUSTMENT OF WORK TO MIS ASCO UNDER CLAUSE 3.1 FOR SECTORSG-14/3

54. DG, Housing Foundation briefed the Executive Committee that

infrastructure development work in sector G-14/2 and G-14/3 had been allotted to

MIs National Construction Limited on 24-08-2012 for an amount of RS.1,499,439,872

with a time limit of 24 month. It was explained that Mobilization Advance was offered

to MIs NCl to the tune of RS.105 million. Subsequently, MIs NCl sublet the works to

MIs Abdul Sattar& Co, under Clause 4.1 of the Contract agreement between

Housing Foundation and MIs NCL. It was further informed that eversince the start of

the project, the progress of work had remained very slow and as a consequence

thereof, a number of notices had been issued by the Consultant as well as by the

client for expediting the pace of work. It was explained that Work planslschedules

had io be revised accordingiy on numerous occasions but the required progress

could not be achieved due to unsatisfactory performance of the sub-contractor and

lack of interest by Mis NCL. It was recalled that the Executive Committee in its 132nd

meeting had granted extension to MIs NCl upto September, 2015 with the direction

to expedite the pace of work and in continuation thereof, a series of meetings were

held with MIs NCl, MIs ACE & Mis ASCO to enhance the progress of work but the

progress of work is still far behind the schedule provided by MIs NCL. .

55. It was argued that in the light of situation above, following points.required attention:

a. Rs. 112 million were provided to Mis NCl as mobilization advancewithout any performance guarantee. The amount has reportedlybeen exhausted by NCl, leaving a balance of approximately RS.75million of work still to be executed at site.

b. As of now, it appears to be in the interest of MIS NCL to deliberatelydelay execution of work in order to avoid payment against themobilization advance which has already been exhausted by NCL.

c. MIs ASCO has raised the issues of double taxation under existingclause 4.1 of agreement executed blw FGEHF and NCL, whichimplies that MIS ASCO is effectively paying 15% tax instead ofusual 7.5%, on account of deduction at source, both from FGEHFand NCL.

d. Under clause 3.1, work can be awarded to MIS ASeO and 4%payable to NCt with each running bill can be withheld by FGEHFand can be adjusted against mobilization advance. Estimated costof project is about 2 billion, and 4% deduction comes out to beapproximately Rs 80 million approximately.

e. MIs NCL has not provided any performance guarantee to FGEHFwhereas MIs ASCO is ready to provide performance guarantee toFGEHF.

56. It was stated that Housing Foundation' is of the view to carry out work

through MIs ASCO under clause 3.1 of contract agreement between FGEHF and

MIS NCL, to avoid double taxation, to avoid extraordinary lapse of time between

three different agencies and to effect recovery of the outstanding amount of

mobilization advance from MIs NCL. It was argued that MIs ASCO be asked to

provide adequate performance guarantee to FGEHF to safeguard the public interest.

Furthermore, FGEHF may be at liberty to revoke clause 3.1 at any time if the

performance of the contractor remained unsatisfactory and may award work to

another firm in the best interest of public. Furthermore, services ~f Consultant MIs

ACE may be dispensed with for poor quality supervision and fresh consultant may behired to accelerate the progress of work.

Decision:

The Executive Committee accorded approval of the strategyadopted by the FGEHF as mentioned at Para 56 above.

57. Director General FGEHF briefed the Executive Committee that One

Window Cell, Admitting Section is expected to be the most important section of FGE

Housing Foundation where all major correspondence with the clients shall take

place. It was briefed that Online Verification of CNIC's of clients is even otherwise

mandatory for key every process of Estate wing like transfer, change of address,possessionetc.

58. It was briefed that the current environment/setup of existing One

Window Cell, Admitting" Section is relatively conventional, outdated and even

congested. The overall environment/ambience Le. Furniture, equipment and style of

process is to satisfaction of our end user/clients.

59. It was also recalled that according to the decision/recommendation

passed by the Honorable Wafaqi Mohtasib "Housing Foundation is responsible for

operations/maintenance of sectors/housing schemes launched by HF". Housing

Foundation already is planning to redesign of Admitting Section and renaming it as

One Window Cell wherein all major activities shall take place under one roof and

estimated clientage on daily basis shall be around 200 persons with 50-60 persons

in waiting hall at one time, for various types of activities. Hence'restructuring and

expansion of admitting/One Window Cell is imperative on urgent basis.

some operational staff shall be urgently required for maintenance of G-13 &

G-14/4 and for the approval of building plans, -possession of plots issuance of

NOC from the FGEHF, operation of tub wells, supply of water, maintenance of

sewerage lines, maintenance of electric items and attending the daily

complaints of the residents. It was apprised that on account thereof, the

Technical Wing, FGEHF had sent the requisition/demand of 223 technical/non

technical staff, including 25 Security Guards for Sector G-13,G-14/4, F-14 &F-15, 25 Security Guards for Park Road Officer Residencia and 25 Security

Guards for Bhara Kahu extension

67. It was apprised that the matter was referred to in para 66 (c), had been

referred to the HR committee by the CEO for examination and recommendations to

the Executive Committee, HR Committee ,recommended project based posts /

positions for th~ Technical Wing and creation of Planning, Design & Maintenance

with the, condition that running expenditure of the staff shall be met from the

revenues collected from Sector G-13 & G-14/4 as the work had been entrusted to

FGEHF instead of CDA, HR Committee proposed before the Executive Committee,

to forward these recommendations / requirements to Technical Wing FGEEH, with

the direction to incorporate .the same in PC-l's of relevant projects. Moreover, HR

Committee also endorsed and recommended creation of following positions for the

anti-encroachment cell

armed forces may be preferred. It was encouraged that Character certificates from

local police station and medical fitness report may be obtained from candidates and

maximum age limit may be up to 45 years. ~

a69. The Executive Committee agreed with the eroposals of the FGEHF in

the light of recommendations made by the HR Committee.

Decision:

i) Executive Committee accorded ex-post facto approval of 90 posts

created in the past by the order of Chief Executive(s). However, the EC

further directed that the appointments made against each post shall be

referred to the relevant Departmental Selection Committee by the

Competent Authority(ies) to scrutinize as to whether these

appointments were made in the prescribed manner as defined in the

ServIce Rules, by meeting each and every criteria and report to be

submitted to the Executive Committee in its next meeting

ii) The Executive Committee approved creation of 223 posts in order

to strengthen the Technical Wing to meet the additional worn entrusted

in Sector G-13 & G-1414and for future projects! It was decided that these

posts will be purely project based and will be paid out of the. relevant

project and will not be reflected on the payroll of the FGEHF. It was

further decided that these posts will be on lump-sum pay and not onBasic Scale base as other regular employees of FGEHF. It was further

decided that at the time of recruitment of project staff, they will be

required to submit an affidavit to the effect that they will not claim their

services to be regularized as regular employees of the FGEHF.

iii) Executive Committee also accorded approval for creation of one

post of AD (Security) and one post of DAD (Security) on contract basis.

iv) The Executive Committee accorded approval of creation of 8

posts on project based as was proposed by FGEHFin 132nd meeting-in

the light of recommendations of HR Committee.

v) It was decided that recruitment on all above posts shall be strictly

in the light of recruitment rules, qualification and other prescribedcriteria

70. OG, Housing Foundation urged that information technology within an

organization provides a wide range of services to support the main business. It was

suggested that typically, computer equipment, software and technical support are

required so that employees can do their jobs more efficiently since Information

management is closely related to, and overlaps, the management

of data, systems, technology, processes and - where the availability of information is

critical to organizational success - strategy. It was reminded that most

organizations in the whole world became successful by hiring 15-20% IT

professionals whereas in Pakistan organizations like NAORA, PTCl, Cellular

Companies, Atomic Energy etc. strengthen their Information Technology department

and are successful not only in the country but also working in various countries of theworld.

71. It was briefed that significance of Information Technology posts were

relatively ignored by Housing Foundation in the past and at present only 08 IT

professionals are working against the total sanctioned.strength of 422 i.e. 3%. It

was informed that existing IT professionals in FGEHF are as under:

announced and expected registered members strength could cross 50000.

76. It was stated that in the aftermath of launch of new projects i.e. Bhara .

Kahu extension, Life Style Residency in G-13 sector, FGEHF Enclave Park road and

F-14 and F-15 sectors, approximately 20000 new plots may be created forallotments.

Estate Wing:

77. Director Estate stated that to cater to all matters of previous 23000

allotments. Housing Foundation at present had 12 Assistant Directors (Estate) who

are supervised by two Deputy Directors (Estate) and they were already

overburdened with official responsibilities, resulting in delays and compromised in

quality of work. It was therefore, proposed that additional two posts I positions of

Deputy Director (Estate) may be created to cater to the anticipated immense

forthcoming workload of Estate Wing.

79. It was informed that Public Relations Officer, FGEHF is working in

Housing Foundation since 13.11.2012 on regular basis against the BPS-16. It was

further informed that the.post of PRO (BS-16) was created on 02-09-2009 in Housing

Foundationand at the time of creation of the said post, no service rules were framed

for promotion of PRO to the next scales. It was stated that the post of PRO in Mlo

Housing & Works and NCL etc. is against BPS-17 and therefore, it is recommended

that the post of PRO (BPS-16) in Housing Foundation may also be upgraded toBPS-17.

Law Wing:

80., Director Law stated that Law Wing of Housing Foundation is also being

supervised by the only Director and in view of huge workload of law wing, it required

one post I position of Deputy Director for better and smooth working of Law Wing.

Decision:

VALLOTMENT OF CATEGORY-III PLOT TO MR. MUHAMMAD MAJEED INPHASE-IV OF THE HOUSING SCHEME

86. Director Estate Briefed the Executive Committee that one Mr.

Muhammad Majeed, an employee of Pakistan Television Corporation applied for

allotment of a category-III plot under 10% autonomous quota in Phase-III housing

scheme. On the basis of criteria i.e. age-wise seniority he was issued a Provisional

Offer for allotment on 13-09-1999 with a schedule of payment of the plot. He did not

deposit his dues so he was issued a final legal notice on 10-10-2000.But he failed to

deposit his dues. So in pursuance to the decision of 66th Executive Committee

meeting dated 07-02-2001 provisional offer of Mr. Majeedalongwith507 other such

defaulters was cancelled I withdrawn on 17-04-2001.

87. He subsequently agitated against this cancellation on different forums.

His case was also placed before the Executive Committee in its 131st meeting as

Agenda Item No. 19 on the direction of Supreme Court of Pakistan. The Executive

Committee after affording him an opportunity of personal hearing decided that:

"The matter be inquired into by the Joint Secretary, Housing & Works,

who should put up his findings in the next meeting of Executive Committee"

88. Accordingly, the case of Mr. Majeed was referred to The Joint

Secretary, Housing & Works. Brief Note and Findings of the said inquiry with the

recommendation of re-allotment of Plot to Mr. Muhammad Majeed, has been

received by Housing Foundation are placed before the Executive Committee forconsideration I decision please.

RESTORATIONOF ALLOTMENT OF PLOT NO. 17. STREET NO. 146, SECTORG-13/4. ISLAMABAD.

90. Executive Committee was briefed that one Mr. Abdul Rehman 5/0

Khuda Bakhsh, an employee of PTCl, applied for allotment ofa Category-III plot in

Phase-III Housing scheme under Autonomous quota (10%). His case got matured

for allotment on the basis of age-wise seniority and Provisional Offer letter was

issued to him on 14-09-1999. Subsequently, on depositing cost of land, he was

issued FinalAllotment letter on 16-04-2002.

91. Development charges amounting to Rs. 163,200/- were levied after

issuance of Final Allotment Letter Almost 37% dues were outstanding against

Mr. Rehman, therefore, he was issued first notice on 18-11-2007 with theinstructions to clear the dues within one month from the date of issuance of the

notice. The issue relating to defaulting allottees was placed before the Executive

Committee of the Housing Foundation in its 99th meeting held on 29-05-2008. It was

categorically informed to the allottee vide Final Notice dated 07-07-2008 to clear the

outstanding dues on or before 31-12-2008 failing which, the allotment of plot was tobe cancelledwithout any further notice.

92. However, by taking a lenient view, Housing Foundation kept on waiting

his response till 16-04-2009 when the case was referred to Accounts Section for

undated dues position. The AlC section intimated that dues are still outstanding.

( 93. The matter was referred to competent authority for decision which

approved the cancellation of plot in line with the decision of 99th meeting of E.C. on

20-04-2009 and accordingly cancellation letter was issued to him on 20-04-2009.

94. The widow of the ex-allottee submitted a representation. The Housing

Foundation by taking a lenient view placed her case before the Hardship Sub-

Committee. The Hardship Sub-Committee in its meeting held on 24-11-2011 made

the following recommendations:

..The Sub Committee examined the case of Mst. Zainab Bibi anddecided that this case does not come under the purview of Hardship.Therefore, said case may be separately put up before the Board ofDirectors /DG (HF) for consideration".

95. The case was referred to Competent Authority for restoration as full

payment was deposited in one month of notice I cancellation. However, the Chief

Executive directed to put up the case for Executive Committee. The matter has also

been referred by Chairman National Assembly Standing Committee for Housing andWorks, for consideration.

96. The case was placed before the Executive Committee in its 119th

meeting held on 29-02-2012 but the case was deferred. Case for restoration of plot

in favor of Mst. Zainab bibi, in the same category, subject to availability, was placed

before the Executive Committee for approval please.

97. The Executive Committee went through the whole record and previous

decisions of different fora and relevant recommendations. The Executive Committee

observed that since the deceased had already paid full cost of land as well as other

charges except 37% of development charges (Rs. 60,384). At the time of allotment

he was eligible in all respect and was also issued Final Allotment Letter, thereforewidow of the deceased should not be denied her right.

Decision:

Executive Committee decided approve the case for restoration of plot in

favor of Mst. Zainab bibi, in the same category, subject to availability

and payment of all dues, if any. ~

ALLOTMENT OF PLOT TO LAC leT

98. The Director General Housing Foundation briefed that FGEHF is

pursuing and striving hard to acquire land under relevant provisions of Land

Acquisition Act 1894, in various sectors/ areas of Islamabad to accommodate about

32,636 registered members, with the assistance and cooperation of ICT

administration. In the process Housing Foundation has so far succeeded in getting

approximately 25000 kanals of additional land in Bhara Kahu Extension (7000

kanals), Park Road (8200 kanals) as well as in Sector F-14 and F-15 (10200 kanals),

Islamabad whereas about 17000 kanals are in the process le. Bara Kahu Extension

(14000 kanaIs) and Park Road (3000 kanals). Hence, t~e role of LAC is of pivotal

importance for the success of the Housing Foundation. It was further stated that

names of the following officers in view ~f meritorious services rendered in acquisition

of Sectors 0-12, G-13, G-14 and F-14/F-15, had been reGQmmendedby the office of

the Chief Commissioner, Islamabad for allotment of plot out of ICT quota:-

I. Mr. Jawad Paul, former Assistant Commissioner/ LAC, ICT

II. Mr. Jawdat Ayaz, former Assistant Commissioner/ LAC, ICT

III. Miss. Rabia Aurangzeb, incumbent Assistant Commissioner/ LAC,ICT

99. It was further submitted that quota reserved for ICT Islamabad in

Housing Scheme Phase-IV had almost been exhausted and no plot is lying vacant in

the said quota. However, a category II plot no. 7, street 114, G 14/3, earlier allotted

to Mr. Tarik Mahmood Pirzada, former DG Housing Foundation/Commissioner ICT,

from the ICT quota, could be considered for allotment to incumbent LAC. It was

informed that subsequently, the officer (tv'lL Pirzadal was allotted -a category I plot

n01-A, Street 128, Sector G 13/4,as member of Executive Committee; however, on

the direction of PM Secretariat, all allotments made to members of Executive

Committee were cancel/ed/withdrawn. It was further informed that in continuationthereof, the officer preferred a writ petition in IHC for restoration of said al/otmentand

matter is sub-judice. It was however pertinent to recall that according to the Policy ofHousing Foundation, no officer can retain two plots at one time (except in the case of

Prime Minister Special Assistance Package). It was further clarified that in this

regard, the officer had also been communicated that he shall be well advised to

withdraw his petition pending in IHC regarding Category 1 plot, lest his allotment

against category II plot may stand cancelled automatically, in the event he desired to

pursue the petition and persist with his claim to Category 1 plot in Sector G 13.

100. It was further informed that 19 plots in Category-II, IV & V allocated

under quota of Islamabad Bar Association (IBA) had not been allotted due to

ongoing litigation in the Supreme Court as per following breakup, causing substantial

financial loss to FGEHF, as per following detail:

101. It was further clarified that notwithstanding the fact that the

aforementioned 42 plots were reserved for IBA, yet 23 plots oflBA quota had

already been utilized and allotted to the applicants of other quotas on the direction of

different forums as per following breakup.

~ 102. It was recalled that the Supreme Court vide order dated 18-01-2011

has observed on the subject that "Leave to appeaiis granted, inter-alia, to examine

that what should be the criteria required to be followed by the Sar Association for

making recommendations to the Housing Foundation for the allotment of plots

amongst the professionals (Advocates). As a short point is involved office is directed

to fix the appeal within one month". Chief Justice IHC desired early disposal of the

matteryet many years had elapsed without any meaningful outcome.

103. In view of the above position, it was proposed that the officers

mentioned at Sr# i and ii of para 98 ante may be accommodated against available

plots reflected in Table 1 of para 100 ante while the fate of ISA quota may be

determined at the time of eventual settlement of their dispute whereupon they may

be considered for allotment in any ongoing scheme of the Housing Foundation

accordingly. It was further recommended that officer mentioned at Sr # iii of para 98

ante, may be accommodated against category II plot no. 7, street 114, G 14/3

mentioned in para 99 ante.

104. Executive Committee acknowledgedlrecognized meritorious services of

the present and previous LACs. It was however questioned as to whether it may be

possible to allot plots to previous LACs at Sr.No. i & ii of para 98 ante, out of ISA

Quota. It was however argued by FA Works that at this stage allotment of plot

against any quota to any individuai is not appropriate as Ministry of Law, Justice &

Human Rights has submitted recommendations with regard to allotment of quota to

various categories to the Honorable Prime Minister of Pakistan and decision is

awaited. The Executive Committee was briefed that already 23 plots had been

allotted to the employees of different departments from ISA quota without any legal

complication. It was further briefed that delaying the case of allotment of plots to

bona fide officers of ICTin acknowledgement of their meritorious services, maybe to ..

the detriment of FGEHF interests as no meaningful progress can be achieved by the

FGEHF in upcoming sectors, without active support of ICT administration. It was

further argued that even from strictly financial perspective, FGEHF had not been

able to collect anything as Land Charges/SUP charges, from prospective allottees

under ISA quota, notwithstanding the fact that FGEHF has already paid entireamount of land acquisition cost in Sector G 14/1,2,3 and has even paid Rs 1.3

r billion for Award of SUPs in G 14/3. It was suggested that in view of above, it may be

advisable to accommodate the officers of ICT (LACs) mentioned at Sr.No. i & ii of

para 98 ante, against the available plots out of remaining ISA Quota. It was however

emphasized that the aggregate ISA quota must remain in tact and rolled over to

future schemes of FGEHF and finally decided consequent upon closure of ongoing

litigation. Moreover, plots allotted to ICT officers, may be booked against future ICT

Quota and adjusted accordingly.

Decision:

i) The Executive Committee while accorded in principle approval to

allotment of Category-II Plot no. 7, street 114, G 14/3 to Ms. Rabia

Aurangzeb, incumbent LAC, ICT, out of existing ICT quota, as

recommended by the ICT Administration.

ii) The"case of allotment of plot to Mr. Jawad Paul and Mr. JawdatAyaz,

former LACs was deferred for the time being.

Agenda Item No -15:

VREPORT OF SUB-COMMITTEE ON HARDSHIP CASES

105. Director Estate, FGEHF briefed the Executive Committee that in

Phase-IV of the Housing Scheme, 1% quota was reserved for Hardship cases. In

this regard. 2 cases under two categories were placed in the meeting of Sub-

Committee on Hardship cases held on 21-05-2015 for examination, The Sub-

Committee had favorably. recommended two cases. for consideration by the

Executive Committee one in favor of Mirza.Shakil Ahmad and another in favor of Mr.

Muhammad Shafi Mughal

Kahu) under 4% quota reserved for widows of Federal Government

Employees subject to approval of Executive Committee and subject to

completion of all legal & codal formalities as prescribed in the brochure

of Housing Scheme.Phase-VI.

b. Case of Mr. Muhammad Shafi Mughal, Advocate, Supreme Courtof Pakistan

Keeping in view circumstances of Mr. Muhammad Shafi Mughal and in

view of opinion of Director "(Law), the Hardship Sub-Committee

recommended allotment of Category-III Plot No. 27, Street No. 68,

Sector G-14/2, Islamabad, to ~r. Muhammad Shafi Mughal subject to

approval of Executive Committee regarding exchange of plot from

Retired to Hardship quota.

107. It was however argued that the final outcome of pending inquiry against

previous allotments made in hardship / constitutional/professional / ICT / Ministry

/FGEHF quota, pending in PM Secretariat may be awaited.

Decision:

The Executive Committee while ac.cording in principle approval to the

proposals of Hardship Committee regarding allotment of plots as

recommended in para 106 (a) and (b) ante, decided to defer the cases,

till final outcome ofpending inquiry in the PM Secretariat, em the subject

of alleged irregularities in previous allotments under Hardship 'quota. '.

DECLINE OF CONSENT / ACCEPTANCE OF PLOT IN PHASE-I MEMBERSHIPDRIVE

108. The Executive Committee was briefed that Phase-VI of the housing

scheme green enclave-I at Bhara Kahu had been launched and consent /

acceptance letters were being issued to the bonafide successful applicants on the

basis of first come first serve basis. It was informed that some of the successful

applicants were not interested in getting plot in green enclave Bhara Kahu and theyhad declined to accept the offer/consent letter.

109. It was recommended that in view of above, applicant should be

deemed to have forfeited his seniority as well as entitlement for instant scheme of

membership drive-I. However, he may be considered for fresh registration under the

Member ship Drive-II, under the age wise seniority criteria.

110. Proposal contained vide above para, was placed before the ExecutiveCommittee for approval.

Decision:

After detailed deliberation, the Executive Committee approved the

proposal at Para 109ante with the directions to specifically mention this

fact in the relevant acceptance/consent letter.

Agenda Item No -17( a ):

VREVISION OF URGENT TRANSFER FEE

111. Director Finance, FGEHF briefed the Executive Committee that

sources of revenue of Housing Foundation comprised of Revenue and Receipts. The

Revenues are used to finance the Expenses of the Foundation and Revenues

included Transfer Fees, Processing Fees, and Fees for NOC, NEC, NDC.

112. It was further briefed that urgent transfer fee on the same date transfer

is utilized in the Welfare Fund of the Housing Foundation created for the employees

of the Housing Foundation. The Welfare Fund is used for payment of the gratuity,

loans, education allowance and assistance grant. It was apprised that in order to

optimize welfare portfolio, a meeting of the Board of Trustees of the Welfare Fund

was held on 02104/2015, wherein, it was decided to enhance the source of Welfare

Fund by increasing the urgent transfer fees by 50%. It was further apprised that

urgent transfer fees were last revised in the year 2007 as per the Decision of the

Executive Committee held on 12109/2007.ln the context, the following details

indicating existing and the proposed rates under schedule of fee, were submitted forperusal.

113: Based on the above, the Executive Committee was requested to
