Many students in Bangladesh dream that they will be starting their legal profession as a barrister. But most of them have lack of knowledge that how to become a barrister, where to study bar-at-law course and what are the requirements for becoming a barrister. This article is basically for them who are interested to become barrister and I hope this article will meet their all possible queries. There are many people found to ask the differences between advocate and barrister, Is he a barrister who gets degree from Britain, etc. To answer these questions in one sentence that barrister doesn’t mean advocate or a lawyer. After passing bar-at-law, he does not become a lawyer. According to the Bangladesh Legal Practitioners and Bar Council Order, 1972 , a barrister needs to obtain the certificate of ‘advocate’ or ‘lawyer’ from Bangladesh bar council. Then he will be an advocate. That means advocate is one kind of profession and barrister is a prestigious degree which is acquired from Britain. In British India, to remove the difference between barrister and advocate the bar council act of 1926 was passed and according to this act all barristers would be known as advocate. Even now barristers need to get enrolled as an advocate in the bar council of Bangladesh including a further enrollment in list of a local bar association list or of Supreme Court as well in order to practice in Bangladesh. How to be Bar At Law?

Law profession is a glorious profession in any country of the world including Bangladesh.

There are many well known lawyers who are not barrister in Bangladesh. To become a barrister a student must complete the two stages of study namely academic stage and the vocational stage.

The Academic Stage is usually completed either by undertaking a recognised Qualifying Law Degree (“QLD”) or a Graduate Diploma in Law (“GDL”) from any university of England and Wales. We should keep it in our mind that LLB under a Bangladeshi University is not a QLD, as such students having an LLB from Bangladesh must obtain further LLB or GDL (for graduate in a discipline other than the law) under any recognised University of England and Wales in order to complete the academic stage and to be eligible for the BPTC (second stage). To know about the QLD student may explore the general council of bar website. It should be stated that there are few institutions in Bangladesh also providing the tuition of an external LLB under British Universities. Another easiest way to know about QLD is by seeing the course contents of a law degree. A QLD must contain the following seven mandatory courses along with other elective courses. These are:

i) Public Law (including Constitutional Law, Administrative Law)ii) Law of Contractiii) Law of the European Unioniv) Criminal Lawv) Law of Tortvi) Land Lawvii) Equity and the Law of Trusts

Vocational stageBar Professional Training Course (BPTC) was previously known as Bar Vocational Course (BVC). On successful competition of QLD a student must take a BPTC (usually one year fulltime) at one of the institutions authorized by the Bar Council of England and Wales to

Page 2: How to Be Bar at Law

offer the BPTC and be a member of one of the four law societies (inns). On successful completion of the BPTC student barristers are "called" to the bar by their respective inns and are elevated to the degree of "Barrister". However, before they can practice independently in England they must first undertake twelve months of pupilage, but this is not mandatory for those who wish to practice their own countries like Bangladesh.

To get admitted into BPTC one must meet the following requirements.

(1) Completion of Academic Stage. Usually requires 2:2 in qualifying law degree (QLD) or 2:2 equivalents in another degree plus CPE/Diploma in Law pass.

(2) Inn membership

(3) All students must have achieved or be equivalent to IELTS 7.5 in written and spoken English

A student wishing to practice in Bangladesh after getting the degree of barrister he may get enrolled after a competitive examination conducted by the Bangladesh bar council. Then he has to commence a pupilage ship for a period of one year. Then, on a successful competition of pupilage under a senior lawyer having minimum ten years of experience as a lawyer of the Supreme Court of Bangladesh, he has to sit for exam to get permission to practice in the SCB. If he passes the exam duly, then he will be certified to practice in the SCB as well as the subordinate court of which bar he belongs to.

These programmes of study have been designed as distance and open learning programmes with no attendance requirements therefore allowing students the opportunity to study for these awards from anywhere in the world. Increasingly, we are receiving enquiries in relation to “links” with these Colleges. Northumbria University is not the awarding body for any of these Colleges.
