How Does GST Impact on Employee Benefits?

pril 2015 has indeed created a significant impact in Malaysia tax system. Not only does it influence our lifestyles, it has created and is still creating quite a commotion in all areas of

businesses, including accounting, procurement, legal, IT, sales and marketing, and yes, even in Human Resources. This brief article is to provide a bird’s eye view of how GST impact on Employee Benefits.

Employee BenefitsAccording to Royal Malaysian Customs Department (abbreviated as RMC from here henceforth), employee benefits are any goods or services provided free to employees, (this include any right, privilege, service or facility provided free of charge to employees), given or provided by employer to employee, or by another person on behalf of the employer to the employee. However monetary granted to employees in cash form are not subject to GST as it is neither good nor service.

Now, one might be pondering, how does this effect employee benefits? Different type of supply will lead to different tax treatment based on GST rule, hence this might change how employees are rewarded by employers from April 2015 onwards. As for free services provided to employees there will be no GST implication as it is not regarded as a supply.

To avoid paying penalties in future audit by RMC, it is considered crucial for businesses to review employee benefits given currently or for the future. Few keywords to take into consideration:

Output TaxOutput tax refers to tax charged on the supply of goods or services, this is subject to the gift rule of RM500. Any goods worth RM500.00 given to the same person in the same year is not a supply and hence is not subject to GST. There is no restriction on the series of gift as long as the total value on the series of gift given to same person in the same year does not exceed RM500.00. In a nutshell, according to RMC, output tax needs to be accounted for on goods given free except on the following:

i. Goods given free to employees as stated in the contract of employment.

ii. Exempt supply iii. Zero rated supply iv. Supply of goods under the RM500 gift rule.v. Supplies where the recovery of input tax were disallowed

under the GST Regulations (Examples: medical and personal insurance, family benefits, car rental, club membership subscriptions etc.)

Input TaxInput tax refers to goods or services paid for purchases or expenses for business activities, and this is claimable.

RMC stated that any input tax for goods or services incurred are claimable based on the following:

i. Input tax has been incurredii. Input tax is allowableiii. He is a taxable person, i. e .a person who is or is liable to

be registerediv. Goods or services acquired in the course or furtherance

of his business andv. Goods or services made in Malaysia or any supply if

made in Malaysia

Employer can recover the input tax as such benefits are regarded as used for the purpose of the business except where the supply to the employee is an exempt supply or where the input tax has been blocked as stated above or where the goods or services have been acquired from suppliers who have not registered for GST. Business goods say for example an office van, is provided free of charge to an employee but is also used by the employee for his private use, such use by the employee will be deemed to be a supply of services and hence subject to GST.

This brief article is merely a basic GST principles applicable for taxable businesses. To have a proper review of GST impact, businesses must seek professional tax advices in accordance of the implication of GST from 1st April 2015.
