Suspended jail termfor weight loss scamA MAN whose business involvedselling ‘revolutionary’ weight lossdevices that were both misleading andunsafe has been given a nine-monthprison sentence.

Warwickshire Trading Standardslaunched an investigation into claimsmade by 34-year-old Aaron Nickolsfollowing a string of complaints.

In advertisements in national news-papers, Nickols, who used the namePaul Jones to hide his identity, claimed that the ultrasonic liposuctiondevice would enable the user to loseweight without dieting, exercise orsurgery. Users were instructed toapply a jelly to their fatty areas beforerubbing the electrical device across tomelt the fat away.

Nickols advert’s stated that userscould ‘Get the body you’ve alwayswanted with no gym and no diets!’and that the product was a ‘revolu-tionary treatment’ that ‘shifts stub-born fat fast!’. In reality, the claimsmade about the product were falseand misleading, and there was no sci-entific evidence to back the claims hewas making. The products were alsoelectrically unsafe.

The court heard he bought 400devices from a Chinese manufactureron eBay at a cost of £170 each beforerenting them out for £199 per monthto consumers across the UK.

Nickols, who was described as a‘snake oil salesman’ by a judge atCoventry Crown Court, traded as UK

WeightLoss Network from twooffices in Warwickshire.

The judge also ordered him to com-plete 150 hours unpaid work and pay£5,000 costs.

Simon Coupe, team manager atWarwickshire Trading Standards, said: “We began to receive complaintsafter the business refused to refund itscustomers when they complained thatthe device didn’t work and, in somecases, had begun to smoke and givethem electrical shocks! In one casethe device being rented was supplieddirectly from the manufacturer inChina to the consumer and the importdocument described it as a metal pol-ishing machine!”

Nicholas Finer, Clinical Professor,Endocrinologist and Bariatric Physi-

cian at University College HospitalLondon, was asked to look at thedevices and said that there was no evi-dence to support the weight lossclaims made, and no published scien-tific evidence to support low intensityultrasound as effective for weightloss. It was also found that the deviceshad not been safety checked whenthey had been imported.

Nickols had pleaded guilty at anearlier hearing to placing advertswhich misled consumers, supplyingan unsafe appliance, and carrying onhis business contrary to the require-ments of professional diligence.

Tim Pole, defending, said Nickolswas a man of previously good char-acter and had now shut the businessdown.

Exam chiefs left red-faced afterRomeo and Juliet GCSE error EXAMboard OCR has apologised ‘whole-heartedly’ after amistake in an English Lit-erature GCSE question about one ofWilliam Shakespeare’s most famous plays.

The error confused the two warring fam-ilies – the Capulets and the Montagues – inthe tragedy about two star-crossed lovers,Romeo and Juliet.

Candidates sitting the paper on Friday,26th May, were asked: How does Shake-speare present the ways in which Tybalt’shatred of the Capulets influences the out-come of the play?

But Tybalt is Juliet’s short-tempered

cousin and therefore a Capulet, so the ques-tion should have referred to his hatred of theMontagues.

The question is one of two that studentscould choose to answer as part of the paper.

It isunderstood that around 14,000 weresitting the paper and could have beenaffected.

OCR describes itself as a leading UK

awarding body. A spokesperson said in astatement: “We apologise wholeheartedlyfor an error on Friday’s OCR GCSE EnglishLiterature paper.

“To ensure all students are treated fairly,we will put things right when the exam ismarked and graded.

“To do this, we combine feedback fromour examiners with statistics to measure thepotential impact on students.

“We are then able to make appropriateadjustments – including to the grade bound-aries if necessary – to ensure no-one is dis-advantaged.

“Once again, we are sorry for this erroron one of our exam papers and we areinvestigating how it got through our assur-ance processes as a matter of urgency.

“We are liaising directly with schools, and advise students and families to talk totheir teachers for further information.”

Romeo and Juliet is one of Shakespeare’smost performed plays.

It has also been adapted for the big screenby George Cukor in 1935, Franco Zef-firelli in 1968, and Baz Luhrmann’s 1996MTV-inspired version, starring a youngLeonardo DiCaprio.

Car seat confusion isputting kids at riskMORE than eight in tendrivers are putting chil-dren’s safety at risk byfailing to correctly fitchild car seats, accordingto a new study by WhatCar?.

A roadside investiga-tion carried out in con-junction withLeicestershire Police andChild Seat Safety Ltd,found that only 15 percent of the child car seatsassessed were fitted cor-rectly and were appro-priate to the childrenbeing carried in them.

Of 85 seats analysed atrandom, in 51 cars, only31 (36 per cent) werefitted correctly and, whenthe suitability and fittingof the child were takeninto account, that figuredropped to just 13.

Three quarters (74 percent) of the incorrectlyfitted seats inspected wereable to be rectified on sitebut four seats — five percent of the sample —were condemned, withtwo being removed imme-diately and replacedbefore onward travel waspermitted.

Whereas car seats withISOFIX attachments wereall correctly installed, those that used the seat-belt as a restraint caused

the most problems. The mostcommon problem, accounting for a quarter (24per cent) of issues, was withthe harness or seatbeltrestraining the seat being tooloose, twisted or incorrectlypositioned.

More than one in six (16per cent) required the seatbelt to be re-routed and afurther 11 per cent neededadjustments to be made tothe headrest to ensureoptimum protection.

Up to the age of 12 yearsold, when it is assumed thatchildren will be able to usethe seatbelts fitted in a car,the driver is responsible forensuring that an appropriatechild restraint is fitted andthat it is being used cor-

rectly. Steve Huntingford,What Car? editor, said: “It’sclear that the overwhelmingmajority of drivers are awareof their responsibilitieswhen carrying a child in thecar.

“At best, drivers couldland themselves with a £100Fixed Penalty Notice, but atworst they are significantly

increasing the risk of deathor serious injury to theirchildren. It’s a form ofRussian roulette that driversare playing.”
