AN ACT Relating to the capital budget; making appropriations and1authorizing expenditures for capital improvements; amending RCW270.340.130, 28B.10.027, and 28B.50.360; amending 2015 3rd sp.s. c 33ss 1002, 1026, 1028, 6005, 3118, 3101, 3198, 3200, 3202, 3204, 3197,43188, 3187, and 5034 (uncodified); amending 2016 sp.s. c 35 ss 1008,51015, 1016, 2011, 3018, 3026, and 5004 (uncodified); reenacting and6amending RCW 43.19.501; adding new sections to 2015 3rd sp.s. c 37(uncodified); creating new sections; making appropriations; providing8an expiration date; and declaring an emergency.9

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:10

NEW SECTION. Sec. 1. (1) A capital budget is hereby adopted11and, subject to the provisions set forth in this act, the several12dollar amounts hereinafter specified, or so much thereof as shall be13sufficient to accomplish the purposes designated, are hereby14appropriated and authorized to be incurred for capital projects15during the period beginning with the effective date of this act and16ending June 30, 2019, out of the several funds specified in this act.17

(2) The definitions in this subsection apply throughout this act18unless the context clearly requires otherwise.19

(a) "Fiscal year 2018" or "FY 2018" means the period beginning20July 1, 2017, and ending June 30, 2018.21

(b) "Fiscal year 2019" or "FY 2019" means the period beginning1July 1, 2018, and ending June 30, 2019.2

(c) "Lapse" or "revert" means the amount shall return to an3unappropriated status.4

(d) "Provided solely" means the specified amount may be spent5only for the specified purpose.6

(3) Unless otherwise specifically authorized in this act, any7portion of an amount provided solely for a specified purpose that is8not expended subject to the specified conditions and limitations to9fulfill the specified purpose shall lapse.10

(4) The amounts shown under the headings "Prior Biennia," "Future11Biennia," and "Total" in this act are for informational purposes only12and do not constitute legislative approval of these amounts. "Prior13biennia" typically refers to the immediate prior biennium for14reappropriations, but may refer to multiple biennia in the case of15specific projects. A "future biennia" amount is an estimate of what16may be appropriated for the project or program in the 2019-202117biennium and the following three biennia; an amount of zero does not18necessarily constitute legislative intent to not provide funding for19the project or program in the future.20

(5) "Reappropriations" in this act are appropriations and, unless21the context clearly provides otherwise, are subject to the relevant22conditions and limitations applicable to appropriations.23Reappropriations shall be limited to the unexpended balances24remaining on June 30, 2017, from previous biennial appropriations for25each project.26

NEW SECTION. Sec. 1028. FOR THE DEPARTMENT OF COMMERCE9Behavioral Health Community Capacity (40000018)10The appropriation in this section is subject to the following11

conditions and limitations:12(1) The appropriation in this section is provided solely for the13

department of commerce, in collaboration with the department of14social and health services, to issue grants to community hospitals or15other community entities to expand and establish new capacity for16behavioral health services in communities. Amounts provided in this17section may be used for construction and equipment costs associated18with establishment of the facilities. Amounts provided in this19section may not be used for operating costs associated with the20treatment of patients using these services. The department shall21establish criteria for the issuance of the grants, which must22include:23

(a) Evidence that the application was developed in collaboration24with one or more behavioral health organizations, as defined in RCW2571.24.025;26

(b) Evidence that the applicant has assessed and would meet gaps27in geographical behavioral health services needs in their region;28

(c) A commitment by applicants to serve persons who are publicly29funded and persons detained under the involuntary treatment act under30chapter 71.05 RCW;31

(d) A commitment by the applicant to maintain the beds or32facility for at least a ten-year period;33

(e) The date upon which structural modifications or construction34would begin and the anticipated date of completion of the project;35

(f) A detailed estimate of the costs associated with opening the36beds; and37

(g) The applicant's commitment to work with local courts and1prosecutors to ensure that prosecutors and courts in the area served2by the hospital or facility will be available to conduct involuntary3commitment hearings and proceedings under chapter 71.05 RCW.4

(2) In awarding funding for projects in subsection (3) of this5section, the department, in consultation with the department of6social and health services and behavioral health organizations, must7strive for geographic distribution and allocate funding based on8population and service needs of an area. The department must consider9current services available, anticipated services available based on10projects underway, and the service delivery needs of an area.11

(a) $4,000,000 is provided solely for crisis diversion beds that12are not subject to federal funding restrictions that apply to13institutions of mental diseases; and14

(b) $4,000,000 is provided solely for the department to provide15grants to community hospitals or freestanding evaluation and16treatment providers to develop capacity for beds to serve individuals17on ninety or one hundred eighty-day civil commitments as an18alternative to treatment in the state hospitals. In awarding this19funding, the department must coordinate with the department of social20and health services and the department of health and must only select21facilities that meet the following conditions:22

(i) The funding must be used to increase capacity related to23serving individuals who will be transitioned from or diverted from24the state hospitals;25

(ii) The facility is not subject to federal funding restrictions26that apply to institutions of mental diseases;27

(iii) The provider has submitted a proposal for operating the28facility to the department of social and health services;29

(iv) The provider has demonstrated to the department of health30and the department of social and health services that it is able to31meet applicable licensing and certification requirements in the32facility that will be used to provide services; and33

(v) The department of social and health services has confirmed34that it intends to contract with the facility for operating costs35within funds provided in the operating budget for these purposes.36

(6) The department of commerce shall notify all applicants that37they may be required to have a construction review performed by the38department of health.39

(7) To accommodate the emergent need for behavioral health1services, the department of health and the department of commerce, in2collaboration with the department of social and health services,3shall establish a concurrent and expedited process to assist grant4applicants in meeting any applicable regulatory requirements5necessary to operate inpatient psychiatric beds, free-standing6evaluation and treatment facilities, enhanced services facilities,7triage facilities, crisis stabilization facilities, detox, or secure8detox.9Appropriation:10

Clean Energy and Energy Freedom Program (30000726)15The appropriations in this section are subject to the following16

conditions and limitations:17(1) The appropriations are provided solely for projects that18

provide a benefit to the public through development, demonstration,19and deployment of clean energy technologies that save energy and20reduce energy costs, reduce harmful air emissions or otherwise21increase energy independence for the state.22

(2) In soliciting and evaluating proposals, awarding contracts,23and monitoring projects under this section, the department must:24

(a) Ensure that competitive bidding processes, rather than sole25source contracting processes, are used to select all projects;26

(b) Require that all expenditures be used for projects that27develop and acquire asset that have a useful life of at least28thirteen years; and29

(c) Conduct due diligence activities associated with the use of30public funds including, but not limited to, oversight of the project31selection process, project monitoring and ensuring that all32applications and contracts fully comply with all applicable laws33including disclosure and conflict of interest statutes.34

(3)(a) Pursuant to chapter 42.52 RCW, the ethics in public35service act, the department must require an applicant to identify in36application materials any state of Washington employees or former37

state employees employed or on the firm's governing board during the1past twenty-four months. Application materials must identify the2individual by name, the agency previously or currently employed by,3job title or position held, and separation date. If it is determined4by the department that a conflict of interest exists, the applicant5may be disqualified from further consideration for award of a6contract.7

(b) If the department finds, after due notice and examination,8that there is a violation of chapter 42.52 RCW, or any similar9statute involving a contractor either in procuring or performing10under the contract, the department in its sole discretion may11terminate the contract by written notice. If the contract is12terminated, the department must be entitled to pursue the same13remedies against the contractor as it could pursue in the event of a14breach of the contract by the contractor.15

(4) The requirements in subsections (2) and (3) of this section16must be specified in funding agreements issued by the department.17

(5) The department may not obligate or expend any of the amounts18provided in this section on new projects that involve the Snohomish19county public utilities district or its subcontractors until the20executive ethics board responds to the department's June 17, 2015,21request for an advisory opinion on poststate employment.22

(6)(a) (($10,000,000)) $13,250,000 of the state taxable building23construction account is provided solely to create a revolving loan24fund to support the widespread use of proven energy efficiency and25renewable energy, and transportation electrification technologies now26inhibited by lack of access to capital.27

(b) The department shall provide grant funds to one or more28competitively selected nonprofit lenders that will provide matching29private capital and will administer the loan fund. The department30must select the loan fund administrator or administrators through a31competitive process, with scoring conducted by a group of qualified32experts, applying criteria specified by the department.33

(c) The department must establish guidelines that specify34applicant eligibility, the screening process, and evaluation and35selection criteria. The guidelines must be used by the nonprofit36lenders.37

(d) Loan applications must disclose all sources of public funds38invested in the project. The nonprofit lender must make loans39available to the following types of projects that include, but are40

not limited to: Residential, commercial, industrial, and agricultural1energy retrofits((,)); residential and community-scale solar2installations((,)); anaerobic digesters to treat dairy and organic3waste((, and)); combined heat and power projects using woody biomass4as a fuel source; electric vehicle charging infrastructure and5equipment for cars, trucks, and buses; upgrades to facilitate such6equipment and infrastructure; and acquisition of zero-emission buses7and class 4-8 vehicles, including but not limited to trucks and8passenger shuttles.9

(e) State funds may not exceed fifty percent of the estimated10cost of a project, and funding preference must be provided to11projects that offer a higher percentage of nonstate match funds.12

(7) (($6,600,000)) $100,000 of the state taxable building13construction account is provided solely for credit enhancements of14advanced solar and renewable energy manufacturing within Washington15state. The department shall develop an application process to16competitively select projects.17

(8)(a) $13,000,000 of the state building construction account is18provided solely for grants to advance clean and renewable energy19technologies and advance transmission and distribution control system20improvements for increased reliability, resiliency, and enabling21integration of distributed and renewable resources and technology by22public and private electrical utilities that serve retail customers23in the state. Eligible utilities may partner with other public and24private sector research organizations and businesses in applying for25funding.26

(b) The department shall develop a grant application process to27competitively select projects for grant awards, to include scoring28conducted by a group of qualified experts with application of29criteria specified by the department. In development of the30application criteria, the department shall, to the extent possible,31allow smaller utilities or consortia of small utilities to apply for32funding.33

(c) The department shall convene an advisory panel of electric34utility representatives to identify program objectives, near term35priorities and long term goals.36

(d) Applications for grants must disclose all sources of public37funds invested in a project.38

(e) Grant funds must be used for research, development, or39demonstration projects that integrate intermittent renewables through40

energy storage, information technology or other smart grid1technologies, dispatch energy storage resources from utility control2rooms, use demand response, transactive control, or the thermal3properties and electric load of commercial buildings and district4energy systems to store energy, reduce transmission congestion or5otherwise improve system reliability and resiliency and enable6integration of distributed and renewable energy sources.7

(9)(a) $10,000,000 of the state building construction account is8provided solely for grants to match federal funds or other nonstate9funding sources used to research, develop, and demonstrate clean10energy technologies.11

(b) The department shall consult with the University of12Washington, Washington State University, the Pacific Northwest13national laboratory and other clean energy organizations to design14the program. The program shall offer matching funds for competitively15selected clean energy projects including, but not limited to:16Advancing energy storage and solar technologies, advancing bioenergy,17developing new lightweight materials, and advancing renewable energy18and energy efficiency technologies.19

(10) $400,000 of the state building construction account—state is20provided solely for capital funding of competitively selected wood21energy conversion projects at public facilities.22

(11) The department must report on number and results of projects23that receive grants or loans through the clean energy fund, including24the number of job hours created and the number of jobs maintained and25created, to the governor and the legislature, by November 1, 2016.26

(12) The department shall develop metrics that indicate the27performance of energy efficiency efforts and provide a report of the28metrics, including at a minimum the current energy used by the29building, the energy use after efficiencies are completed, and cost30of energy saved, to the house of representatives technology &31economic development committee and the senate energy, environment &32telecommunications committee. The report must include these metrics33from other states.34

(13) $3,250,000 of the state building construction account—state35appropriation is provided for the Pacific Northwest national36laboratory to use demand side management and analyze electricity use37by the department of corrections. After the analysis is performed any38remaining funds may be used for reducing energy use of the department39of corrections. The department must make energy records available.40

The6multipurpose facility will serve as a needed cultural resource for7Washington's Asian and Pacific Islander community; provide affordable8housing and educational opportunities; strengthen relations with our9Asia-Pacific trading partners; and deliver economic growth as a10commercial and tourist destination. The legislature intends to11support the development of the project through a grant to be used for12project coordination and development of a sustainable financial plan,13which the legislature intends as a prerequisite to consideration of14any further state capital commitment.15

2015-17 School Construction Assistance Program (30000169)5The appropriations in this section are subject to the following6

conditions and limitations:7(1) $990,000 of the common school construction account—state is8

(2) $675,000 of the common school construction account—state is11provided solely for study and survey grants. In calculating study and12survey grants, for the 2015-2017 fiscal biennium, the office of the13superintendent of public instruction shall award no more than fifty14percent of the dollar amount for the minimum grants and square15footage allocations. School districts receiving these grants in the162015-2017 fiscal biennium must use data collected or validated by the17Washington State University extension energy office for the inventory18and condition of existing school facilities.19

(3) School districts receiving funding through the 2015-17 school20construction assistance program must map the design of new facilities21and remap the design of facilities to be remodeled.22

(4) The office of the superintendent of public instruction must23weight and prioritize grant requests on the following criteria and in24the following order: (a) Will provide facility capacity needs to25reduce kindergarten through third grade class sizes at high poverty26schools; (b) will provide facility capacity needs to reduce27kindergarten through third grade class sizes in remaining schools.28

(5) The office of the superintendent of public instruction must29expedite allocation and distribution of any eligible funds under the30school construction assistance grant program for the appropriations31provided to the superintendent of public instruction in this act for32distressed schools, STEM pilot projects, or skill centers. For33purposes of determining state funding assistance, eligible area must34be calculated as follows: (a) Eligible area for STEM pilot projects35is 1,440 square feet per science lab or classroom combination, or36both; and 1,040 square feet per science classroom. Total eligible37area per STEM pilot project must not exceed 15,840 square feet, and38

PART 71MISCELLANEOUS PROVISIONS2

NEW SECTION. Sec. 7001. To ensure that major construction3projects are carried out in accordance with legislative and executive4intent, appropriations in this act in excess of $5,000,000, or5$10,000,000 for higher education institutions, may not be expended or6encumbered until the office of financial management has reviewed and7approved the agency's predesign. The predesign document must include,8but not be limited to, program, site, and cost analysis, and an9analysis of the life-cycle costs of the alternatives explored, in10accordance with the predesign manual adopted by the office of11financial management. The results of life-cycle cost analysis must be12a primary consideration in the selection of a building design.13Construction may proceed only upon providing to the office of14financial management the life-cycle costs. To improve monitoring of15major construction projects, progress reports must be submitted by16the agency administering the project to the office of financial17management and to the fiscal committees of the house of18representatives and senate. Reports must be submitted on July 1st and19December 31st each year in a format to be developed by the office of20financial management.21

NEW SECTION. Sec. 7002. (1) The legislature finds that use of22life-cycle cost analysis will aid public entities, architects,23engineers, and contractors in making design and construction24decisions that positively impact both the initial construction cost25and the ongoing operating and maintenance cost of a project. To26ensure that the total cost of a project is accounted for and the most27reasonable and cost efficient design is used, agencies shall develop28life-cycle costs for any construction project over $10,000,000. The29life-cycle costs must represent the present value sum of capital30costs, installation costs, operating costs, and maintenance costs31over the life expectancy of the project. The legislature further32finds the most effective approach to the life-cycle cost analysis is33to integrate it into the early part of the design process.34

(2) Agencies shall develop a minimum of three project35alternatives for use in the life-cycle cost analysis. These36alternatives must be both distinctly different and viable solutions37to the issue being addressed. The chosen alternative must be the most38

reasonable and cost-effective solution. A brief description of each1project alternative and why it was chosen must be included in the2life-cycle cost analysis section of the predesign.3

(3) The office of financial management shall: (a) Make available4a life-cycle cost model to be used for analysis; (b) in consultation5with the department of enterprise services, provide assistance in6using the life-cycle cost model; and (c) update the life-cycle cost7model annually including assumptions for inflation rates, discount8rates, and energy rates.9

(4) Agencies shall consider architectural and engineering firms'10and general contractors' experience using life-cycle costs, operating11costs, and energy efficiency measures when selecting an architectural12and engineering firm, or when selecting contractors using alternative13contracting methods.14

NEW SECTION. Sec. 7003. To improve monitoring of major15construction projects, progress reports must be submitted by the16agency administering the project to the office of financial17management and to the fiscal committees of the house of18representatives and senate. Reports must be submitted on July 1st and19December 31st each year in a format to be determined by the office of20financial management.21

NEW SECTION. Sec. 7004. (1) Allotments for appropriations in22this act shall be provided in accordance with the capital project23review requirements adopted by the office of financial management and24in compliance with RCW 43.88.110. Projects that will be employing25alternative public works construction procedures under chapter 39.1026RCW are subject to the allotment procedures defined in this section27and RCW 43.88.110.28

(2) Each project is defined as proposed in the legislative budget29notes or in the governor's budget document.30

NEW SECTION. Sec. 7005. (1) The office of financial management31may authorize a transfer of appropriation authority provided for a32capital project that is in excess of the amount required for the33completion of such project to another capital project for which the34appropriation is insufficient. No such transfer may be used to expand35the capacity of any facility beyond that intended in making the36appropriation. Such transfers may be effected only between capital37

appropriations to a specific department, commission, agency, or1institution of higher education and only between capital projects2that are funded from the same fund or account. No transfers may occur3between projects to local government agencies except where the grants4are provided within a single omnibus appropriation and where such5transfers are specifically authorized by the implementing statutes6that govern the grants.7

(2) The office of financial management may find that an amount is8in excess of the amount required for the completion of a project only9if: (a) The project as defined in the notes to the budget document is10substantially complete and there are funds remaining; or (b) bids11have been let on a project and it appears to a substantial certainty12that the project as defined in the notes to the budget document can13be completed within the biennium for less than the amount14appropriated in this act.15

(3) For the purposes of this section, the intent is that each16project be defined as proposed to the legislature in the governor's17budget document, unless it clearly appears from the legislative18history that the legislature intended to define the scope of a19project in a different way.20

(4) A report of any transfer effected under this section, except21emergency projects or any transfer under $250,000, shall be filed22with the legislative fiscal committees of the senate and house of23representatives by the office of financial management at least thirty24days before the date the transfer is effected. The office of25financial management shall report all emergency or smaller transfers26within thirty days from the date of transfer.27

(5) The transfer authority granted in this section does not apply28to appropriations for projects for the state parks and recreation29commission. Appropriations for commission projects may be spent only30for the specified projects, and funding may not be transferred from31one commission project to another or from other sources to a32commission project.33

NEW SECTION. Sec. 7006. (1) It is expected that projects be34ready to proceed in a timely manner depending on the type or phase of35the project or program that is the subject of the appropriation in36this act. Except for major projects that customarily may take more37than two biennia to complete from predesign to the end of38construction, or large infrastructure grant or loan programs39

supporting projects that often take more than two biennia to1complete, the legislature generally does not intend to reappropriate2funds more than once, particularly for smaller grant programs, local/3community projects, and minor works.4

(2) Agencies shall expedite the expenditure of reappropriations5and appropriations in this act in order to: (a) Rehabilitate6infrastructure resources; (b) accelerate environmental rehabilitation7and restoration projects for the improvement of the state's natural8environment; (c) reduce additional costs associated with acquisition9and construction inflationary pressures; and (d) provide additional10employment opportunities associated with capital expenditures.11

(3) To the extent feasible, agencies are directed to accelerate12expenditure rates at their current level of permanent employees and13shall use contracted design and construction services wherever14necessary to meet the goals of this section.15

NEW SECTION. Sec. 7007. State agencies, including institutions16of higher education, shall allot and report full-time equivalent17staff for capital projects in a manner comparable to staff reporting18for operating expenditures.19

NEW SECTION. Sec. 7008. Executive Order No. 05-05,20archaeological and cultural resources, was issued effective November2110, 2005. Agencies shall comply with the requirements set forth in22this executive order.23

NEW SECTION. Sec. 7009. FOR THE ARTS COMMISSION—ART WORK24ALLOWANCE. (1) One-half of one percent of moneys appropriated in this25act for original construction of school plant facilities is provided26solely for the purposes of RCW 28A.335.210.27

(2) One-half of one percent of moneys appropriated in this act28for original construction or any major renovation or remodel work29exceeding $200,000 by colleges or universities is provided solely for30the purposes of RCW 28B.10.027.31

(3) One-half of one percent of moneys appropriated in this act32for original construction of any public building by a state agency33identified in RCW 43.17.020 is provided solely for the purposes of34RCW 43.17.200.35

(4) At least eighty-five percent of the moneys spent by the36Washington state arts commission during the 2017-2019 biennium for37

the purposes of RCW 28A.335.210, 28B.10.027, and 43.17.200 must be1expended solely for direct acquisition of works of art. Art2allocations not expended within the ensuing two biennia will lapse.3The commission may use up to $150,000 of this amount to conserve or4maintain existing pieces in the state art collection pursuant to RCW528A.335.210.6

(5) The executive director of the arts commission shall appoint a7study group to review the operations of the one-half of one percent8for works of art purchased or commissioned as required by RCW928A.335.210, 28B.10.027, and 43.17.200. The findings of the review10must be reported annually to the office of financial management and11the fiscal committees of the legislature by September 15th. The12review must include, but is not limited to, the following: (a)13Projects purchased or commissioned per biennium; (b) partner14agencies; (c) funding sources by fiscal year; (d) artwork costs; (e)15administrative costs; (f) collection care costs; and (g) project16status.17

Sec. 7010. RCW 28B.10.027 and 2016 sp.s. c 35 s 6008 are each18amended to read as follows:19

(1) All universities and colleges shall allocate as a20nondeductible item, out of any moneys appropriated for the original21construction or any major renovation or remodel work exceeding two22hundred thousand dollars of any building, an amount of one-half of23one percent of the appropriation to be expended by the Washington24state arts commission with the approval of the board of regents or25trustees for the acquisition of works of art.26

(2) For projects funded in the 2015-2017 capital budget and the272017-2019 capital budget, an institution of higher education, working28with the Washington arts commission, may expend up to ten percent of29the projected art allocation for a project during the design phase in30order to select an artist and design art to be integrated in the31building design. The one-half of one percent to be expended by the32Washington arts commission must be adjusted downward by the amount33expended by a university or college during the design phase of the34capital project.35

(3) The works of art may be placed on public lands of36institutions of higher education, integral to or attached to a public37building or structure of institutions of higher education, detached38within or outside a public building or structure of institutions of39

higher education, part of a portable exhibition or collection, part1of a temporary exhibition, or loaned or exhibited in other public2facilities.3

(4) In addition to the cost of the works of art, the one-half of4one percent of the appropriation shall be used to provide for the5administration of the visual arts program, including conservation of6the state art collection, by the Washington state arts commission and7all costs for installation of the work of art. For the purpose of8this section building shall not include sheds, warehouses, and other9buildings of a temporary nature.10

Sec. 7011. RCW 28B.50.360 and 2015 3rd sp.s. c 3 s 7030 are each11amended to read as follows:12

Within thirty-five days from the date of start of each quarter13all collected building fees of each such community and technical14college shall be paid into the state treasury, and shall be credited15as follows:16

(1) On or before June 30th of each year the college board if17issuing bonds payable out of building fees shall certify to the state18treasurer the amounts required in the ensuing twelve-month period to19pay and secure the payment of the principal of and interest on such20bonds. The state treasurer shall thereupon deposit the amounts so21certified in the community and technical college capital projects22account. Such amounts of the funds deposited in the community and23technical college capital projects account as are necessary to pay24and secure the payment of the principal of and interest on the25building bonds issued by the college board as authorized by this26chapter shall be devoted to that purpose. If in any twelve-month27period it shall appear that the amount certified by the college board28is insufficient to pay and secure the payment of the principal of and29interest on the outstanding building bonds, the state treasurer shall30notify the college board and such board shall adjust its certificate31so that all requirements of moneys to pay and secure the payment of32the principal and interest on all such bonds then outstanding shall33be fully met at all times.34

(2) The community and technical college capital projects account35is hereby created in the state treasury. The sums deposited in the36capital projects account shall be appropriated and expended to pay37and secure the payment of the principal of and interest on bonds38payable out of the building fees and for the construction,39

reconstruction, erection, equipping, maintenance, demolition and1major alteration of buildings and other capital assets owned by the2state board for community and technical colleges in the name of the3state of Washington, and the acquisition of sites, rights-of-way,4easements, improvements or appurtenances in relation thereto,5engineering and architectural services provided by the department of6enterprise services, and for the payment of principal of and interest7on any bonds issued for such purposes. ((However, during the82013-2015 biennium, sums in the capital projects account shall also9be used for routine facility maintenance and utility costs.))10However, during the 2015-2017 biennium, sums in the capital projects11account shall also be used for routine facility maintenance and12utility costs. However, during the 2017-2019 biennium, sums in the13capital products account may also be used for project management14staff.15

(3) Funds available in the community and technical college16capital projects account may also be used for certificates of17participation under chapter 39.94 RCW.18

NEW SECTION. Sec. 7012. To carry out the provisions of this19act, the governor may assign responsibility for predesign, design,20construction, and other related activities to any appropriate agency.21

NEW SECTION. Sec. 7013. If any federal moneys appropriated by22this act for capital projects are not received by the state, the23department or agency to which the moneys were appropriated may24replace the federal moneys with funds available from private or local25sources. No replacement may occur under this section without the26prior approval of the director of financial management in27consultation with the senate ways and means committee and the house28of representatives capital budget committee.29

NEW SECTION. Sec. 7014. (1) Unless otherwise stated, for all30appropriations under this act that require a match of nonstate money31or in-kind contributions, the following requirement, consistent with32RCW 43.88.150, shall apply: Expenditures of state money shall be33timed so that the state share of project expenditures never exceeds34the intended state share of total project costs.35

(2) Provision of the full amount of required matching funds is36not required to permit the expenditure of capital budget37

appropriations for phased projects if a proportional amount of the1required matching funds is provided for each distinct, identifiable2phase of the project.3

NEW SECTION. Sec. 7015. NONTAXABLE AND TAXABLE BOND PROCEEDS.4Portions of the appropriation authority granted by this act from the5state building construction account, or any other account receiving6bond proceeds, may be transferred to the state taxable building7construction account as deemed necessary by the state finance8committee to comply with the federal internal revenue service rules9and regulations pertaining to the use of nontaxable bond proceeds.10Portions of prior authorized general obligation bond proceeds for11deposit into the state taxable building construction account that are12in excess of amounts required to comply with the federal internal13revenue service rules and regulations shall be deposited into the14state building construction account. The state treasurer shall submit15written notification to the director of financial management if it is16determined that a shift of appropriation authority between the state17building construction account, or any other account receiving bond18proceeds, and the state taxable building construction account is19necessary, or that a shift of appropriation authority from the state20taxable building construction account to the state building21construction account may be made.22

NEW SECTION. Sec. 7016. COLUMBIA RIVER BASIN NONTAXABLE AND23TAXABLE BOND PROCEEDS. Portions of the appropriation authority24granted by this act from the Columbia river basin water supply25development account may be transferred to the Columbia river basin26taxable bond water supply development account as deemed necessary by27the state finance committee to comply with the federal internal28revenue service rules and regulations pertaining to the use of29nontaxable bond proceeds. The state treasurer shall submit written30notification to the director of financial management if it is31determined that a shift of appropriation authority between the32Columbia river basin water supply development account and the33Columbia river basin taxable bond water supply development account is34necessary, or that a shift of appropriation authority from the35Columbia river basin taxable bond water supply development account to36the Columbia river basin water supply development account may be37made.38

NEW SECTION. Sec. 7017. (1) Funds appropriated in this act for1minor works may not be allotted until final project lists are2submitted to the office of financial management. Revisions to the3project lists are allowed for projects not anticipated at the time of4budget development but must be submitted to the office of financial5management, the house of representatives capital budget committee,6and the senate ways and means committee for review and comment and7must include an explanation of variances from the prior lists before8funds may be expended on the revisions. Any project list revisions9must be approved by the office of financial management before funds10may be expended from the minor works appropriation.11

(2)(a) Minor works project lists are single line appropriations12that include multiple projects of a similar nature and that are13valued between $25,000 and $1,000,000 each, with the exception of14higher education minor works projects that may be valued up to15$2,000,000. All projects must meet the criteria included in this16subsection (2)(a). These projects should be completed within two17years of the appropriation with the funding provided. Agencies are18prohibited from including projects on their minor works lists that19are a phase of a larger project, and that if combined over a20continuous period of time, would exceed $1,000,000, or $2,000,000 for21higher education minor works projects. Improvements for accessibility22in compliance with the Americans with disabilities act may be23included in any of the minor works categories.24

(b) Minor works appropriations may not be used for the following:25Studies, except for technical or engineering reviews or designs that26lead directly to and support a project on the same minor works list;27planning; design outside the scope of work on a minor works list;28movable, temporary, and traditionally funded operating equipment not29in compliance with the equipment criteria established by the office30of financial management; software not dedicated to control of a31specialized system; moving expenses; land or facility acquisition;32rolling stock; computers; or to supplement funding for projects with33funding shortfalls unless expressly authorized. The office of34financial management may make an exception to the limitations35described in this subsection (2)(b) for exigent circumstances after36notifying the legislative fiscal committees and waiting ten days for37comments by the legislature regarding the proposed exception.38

(c) Minor works preservation projects may include program1improvements of no more than twenty-five percent of the individual2minor works preservation project cost.3

NEW SECTION. Sec. 7018. To the extent that any appropriation4authorizes expenditures of state funds from the state building5construction account, or from any other capital project account in6the state treasury, for a capital project or program that is7specified to be funded with proceeds from the sale of bonds, the8legislature declares that any such expenditures for that project or9program made prior to the issue date of the applicable bonds are10intended to be reimbursed from proceeds of those bonds in a maximum11amount equal to the amount of such appropriation.12

Sec. 7019. RCW 43.19.501 and 2016 c 202 s 58 are each reenacted13and amended to read as follows:14

The Thurston county capital facilities account is created in the15state treasury. The account is subject to the appropriation and16allotment procedures under chapter 43.88 RCW. Moneys in the account17may be expended for capital projects in facilities owned and managed18by the department in Thurston county. ((For the 2007-2009 biennium,19moneys in the account may be used for predesign identified in section201037, chapter 328, Laws of 2008.)) For the 2015-2017 biennium, moneys21in the account may be used for studies related to real estate.22

((During the 2009-2011 and 2011-2013 fiscal biennia, the23legislature may transfer from the Thurston county capital facilities24account to the state general fund such amounts as reflect the excess25fund balance of the account.)) During the 2017-2019 fiscal biennium,26the Thurston county capital facilities account may be used for costs27associated with staffing to support capital budget and project28activities and lease and facility oversight activities. During the292017-2019 fiscal biennium, the Thurston county capital facilities30account may be used for projects for community-based services.31

NEW SECTION. Sec. 7020. If any provision of this act or its32application to any person or circumstance is held invalid, the33remainder of the act or the application of the provision to other34persons or circumstances is not affected.35

NEW SECTION. Sec. 7021. This act is necessary for the immediate1preservation of the public peace, health, or safety, or support of2the state government and its existing public institutions, and takes3effect immediately.4
