Navigate a complicated process. Buying or selling a home usually requires disclosure forms, inspection reports,mortgage documents, insurance policies, deeds, and multipage settlement statements. A knowledgeable expert will helpyou prepare the best deal, and avoid delays or costly mistakes.
Information and opinions. REALTORS® can provide local community information on utilities, zoning, schools, andmore. They’ll also be able to provide objective information about each property. A professional will be able to help youanswer these two important questions: Will the property provide the environment I want for a home or investment?Second, will the property have resale value when I am ready to sell?
Help finding the best property out there. Sometimes the property you are seeking is available but not activelyadvertised in the market, and it will take some investigation by your REALTOR® to find all available properties.
Negotiating skills. There are many negotiating factors, including but not limited to price, financing, terms, date ofpossession, and inclusion or exclusion of repairs, furnishings, or equipment. In addition, the purchase agreementshould provide a period of time for you to complete appropriate inspections and investigations of the property beforeyou are bound to complete the purchase. QUESTION: I’m rent-ing my home to tenantswhose lease doesn’t ex-pire until next spring.With the housing marketturning around, I think Ican get a good price if Iwere to sell now. But howdo I get the tenants out?
ANSWER: You don’t,unless they agree toleave. When you rentyour home to tenants, youallow them to occupy it aslong as they follow therules set out in the leaseagreement, such as pay-ing rent and not destroy-ing your property.
Some people in yourposition have used uneth-
ical tactics to try to forcethe tenants to leave, suchas changing the locks orturning off the utilities.But these tactics havestiff consequences, and ifyou try this, you will endup with the tenants still inthe house with a pile ofyour money. Or they willbe out of the house witheven more of your money.
I have seen landlords“buy” the tenants out ofthe lease by negotiating alump sum payment. Youmay want to try to offeryour tenants severalmonths’ rent to leave andsee if they agree.
Another option for youis to leave them in placeand still try to sell thehome. A property with
paying tenants can bevery attractive to somebuyers who are lookingfor investment proper-ties.
The final choice maybe to wait a few moremonths, then list yourproperty for sale, withthe closing date set to beshortly after the end ofyour lease agreement.

A common problem forowners of multi-storyhomes is uneven heatingand cooling among thefloors.
Reasons for temper-ature variances amongfloors can include re-stricted air flow from thefurnace to the registers,inadequate or improperlysized and sealed duct-work or a heating-and-cooling system that’s notsufficient for the size ofthe home.
Homeowners don’tneed to sweat it out,though. Solutions canrange from making ad-justments that are negli-gible in cost to investing afew thousand dollars inequipment to better bal-ance your home’s temper-ature.
Heating-and-coolingprofessionals recom-mend owners of multi-sto-ry homes switch theirthermostat fan to the “on”position.
“What that does is con-tinuously mix all the air inthe house,” Mejean said.“It helps keep the upstairsand downstairs a little bitmore of an even temper-ature. The other thing youwould do is, for examplein the summer months,you would damper downthe downstairs registers.You don’t want to turn
them off, just damperthem down halfway or so.If you shut them all theway, you’ll restrict the air-flow, which can cause oth-er problems. Then, makesure the upstairs regis-ters are wide open.”
Zoning systems allow ahomeowner to control thetemperature indepen-dently from a thermostatplaced on each floor.
Most zoning systemsrange in price from $2,500to $3,500.
Improperly sized andleaky ducts are often theculprits. Ultimately,homeowners with tem-perature variance issuesshouldconsultareputableheating-and-cooling con-tractor to diagnose the is-sue.

To highlight homeownership’s vital importance to families and to the economy, morethan 600 Floridians participated in a Rally for Homeownership last week in downtownTampa.
Speakers at the rally included TampaMayor BobBuckhorn; State Representatives DanaYoung and Janet Cruz; Chairman of the Hillsborough County Board of CommissionersKenHagan; and Sylvia Alvarez, executive director of the Housing and Education Alliance.
“Today, we are demanding that policymakers in Washington fix housing in America,”said County Commissioner Hagan. “Don’t even think about doing away with themortgage interest deduction. Washington, please protect homeownership.”
The rally was held in Joe Chillura Courthouse Square Park in downtown Tampa, andwas sponsored by the Tampa Bay Builders Association (TBBA), the Florida HomeBuilders Association (FHBA) and the National Association of Home Builders (NAHB).
The home builder groups joined with consumer advocates, civil rights groups,Realtors®, local Chambers of Commerce, politicians, church groups and others tohighlight the importance of homeownership.
“Homeownership is the fabric that our country was founded on,” said State Rep. Young.“People came to America looking for a better opportunity, and the opportunity to own aplace of their own.We need to protect homeownership because it represents freedom.”
Rally participants represented a broad range of interests including home owners, smallbusiness owners, civil rights organizations, church groups, home builders and realestate agents, consumers, business leaders, politicians, merchants andmanufacturers,bankers, students and many others.
“Homeownership is the foundation of the American Dream,” said NAHB ChairmanBarry Rutenberg, a home builder from Gainesville, who served as emcee for theevent. “Homeownership helps families build wealth, it strengthens communities, andit provides millions of jobs across America. Mortgage rates haveplunged to record lows,below 4 percent. That’sgreat — but only if youcan actually qualify for aloan, and that’s not easy.After giving away thestore during the housingboom with disastrous re-
sults, lenders have tight-ened their underwritingstandards, leaving manywould-be home buyersout of luck.
But there are steps ho-mebuyers can take to findthe right mortgage, andqualify for it.
Improve your creditscore: A credit score be-low 620, as measured by
the Minneapolis companyFICO, will knock most po-tential buyers out of therunning for a mortgage.And even if you can qual-ify for a loan, lenders re-serve their best interestrates for borrowers withthe highest credit scores— typically 740 andabove. If a bad creditscore pushes up your in-
terest rate by even onepercentage point, youcould end up paying$85,000 more over the lifeof a $400,000 loan, accord-ing to Tracy Becker,president of North ShoreAdvisory, a credit repaircompany in New Yorkstate.
To see where youstand, start by checking
your credit report, whichis available free at annu-alcreditreport.com, pref-erably at least six monthsbefore you’re ready toshop for a home. You canget a free report once ev-ery 12 months from eachof the three credit report-ing companies — Experi-an, TransUnion and Equi-fax. Make sure there areno mistakes on the report— for example, if you seeincorrect reports of out-standing balances or latepayments, you should dis-pute them with the creditreporting company.
If your credit profile isugly, there are ways tobeautify it, though it maytake some time. One keystep is to make sure to payyour bills on time. Set upemail or text remindersfrom the credit card com-pany to let you know whena payment is due. Paydown your debt as muchas you can. Don’t close un-used credit cards, butdon’t open new cards, ei-ther.
Decide which type ofloan is best for you:Fixed mortgages offerthe security of knowingyour rate will never rise;since rates are near or atrecord lows, there’s apretty good argument tobe made for locking themin now. On the other hand,an adjustable-rate mort-gage offers even lowerrates and might work ifyou expect to move withina few years.
A 30-year loan willkeep monthly paymentslower, but if you canswing it, a 15-year willhave a lower interest rateand will save you tens ofthousands of dollars overthe life of the mortgage.For example, a $300,000loan at 3.7 percent for 30years adds up to about$497,000. Choose a 15-year loan at 3 percent in-stead, and you’ll savemore than $120,000.
Shop around: Checkwith several lenders, notjust the one recommend-
ed by your real estateagent. Compare interestrates and closing costslike fees for the applica-tion, appraisals and so on.These costs generally runaround 2 percent of theloan amount, according toGumbinger.
Michael Moskowitz,president of Equity Now,a mortgage lender, en-courages home buyers toask mortgage companiesfor the names of previouscustomers and check ontheir experience. “Youneed to make sure you’redealing with someonereputable,” he said.
Get a preapproval:Lenders will give pre-qualification letters — in-formal estimates of howmuch house you can af-ford. But you should gofurther and get a preap-proval letter, which is atentative commitmentfrom a lender. To get one,you’ll have to show thelender documentation ofyour income, assets anddebts. Though a preap-proval is not binding on ei-ther the lender or thehome buyer, it’s a way ofshowing sellers and realestate agents that you’re aserious buyer.
Be prepared to showlots of paperwork: Fan-nie Mae and Freddie Mac,the government entitiesthat guarantee loans, areforcing lenders to de-mand much more docu-mentation these days, in-cluding pay stubs, tax re-turns and bank state-ments.
And they will ask forfresh documents, like paystubs, just before the clos-ing, to make sure nothinghas changed.
Because of these tight-er documentation stan-dards, Gratalo recom-mends that you start sav-ing pay stubs, bank state-ments, canceled rentchecks and other paper-work several months be-fore you even start shop-ping for a house or a mort-gage.

FORT LAUDERDALE —Homebuyers trying to de-cide between new andused haven’t had manychoices in the past fewyears.
“Most of the new-homebuilders have been fish-ing and hunting becausethey couldn’t sell homes,”said Jack McCabe, a hous-ing analyst in DeerfieldBeach.
But the improvedhousing market meansbuyers have optionsagain.
A national index mea-suring builder sentimentrose in June to its highestlevel since May 2007.
New homes have theobvious advantages:They come with builderwarranties and allow buy-ers to select colors andfloor plans.
In some cases, thehomes are easier to in-sure.
But an existing proper-ty may offer more spacefor the money and a moreconvenient location.
The case for newhomes
Rebecca and JonathanBratter had every inten-tion of buying an existinghome, but all the proper-ties they toured hadflaws, such as green car-peting or the wronglayout.
So a friend suggestedthey consider new con-struction, and they endedup buying a five-bedroomhome in the Monterra de-velopment in Cooper City.
“I thought it would beso much easier to moveinto somebody else’shouse,” said RebeccaBratter, 34, an attorneywith two children. “Butwe found out that design-ing a house to our tastewas very appealing.”
Builders often havetheir own financing divi-sions, so getting a mort-
gage from the buildermay be easier than from alender, said McCabe, thehousing analyst.
Generally, privateproperty insurers aremore willing to covernewer homes — thosebuilt in 2005 or later —said Rick Bogani, an in-surance agent in RoyalPalm Beach.
“The new construc-tion, with the updatedbuilding codes and im-pact glass, is better, andthat’s what the insurersare targeting,” Boganisaid. “The carriers arecompeting for the newhomes, and that’s why youget better prices for in-surance.”
Finally, buyers of newhomes will have a signifi-cant resale advantage infive or 10 years, said KenH. Johnson, an economistand finance professor atFlorida InternationalUniversity in Miami.
Because of the lack ofconstruction recently, thenew homes bought todaywill be competing againstan older stock when itcomes time to sell, John-son said.
“I can’t tell you you’llget the price you wantwhen you do sell down theroad, but I’m deadly sureyour home will sell fast-er,” Johnson said.
The case forexisting homes
To survive the housingcrash, builders reducedthe size of homes and cutdown on amenities tomake the properties lessexpensive in hopes of at-tracting buyers consider-ing foreclosures andshort sales.
While custom buildersare seeing increased de-mand for larger luxuryhomes, the majority ofbuilders are sticking withmore modest-size proper-ties, McCabe said. So peo-ple who buy new may pay10 percent to 20 percentmore for comparablesquare footage.
In some cities, avail-able land is in the sub-urbs, which means buy-ers choosing new con-struction face longercommutes to work.
Some buyers preferthe charm of older homesin established neighbor-hoods rather than thesterile newness of cookie-cutter developments, realestate agents say.
In addition, building ahome takes severalmonths or longer — notideal for somebody whowants or needs to moveright away.
Steve Braverman andhis wife, Jen, are movingto South Florida from Chi-cago.
They decided againstbuying new and now arelooking at homes in theWoodfield Country Clubin Boca Raton.
Constantly having tomonitor the progress ofconstruction and coordi-nating other details of anew home is too much of ahassle, said Steve Braver-man, 43, who owns a tele-communications compa-ny.
“There’s always some-thing that goes wrong,”he said. “I think movinginto an existing home thathas the ‘guts’ you like isbetter than buying new. Itdoesn’t take as long asstarting from scratch.”

In most annual rentals, the tenant is responsible for paying the electric bill. In additionto being responsible for paying the bill, the tenant is often given instructions by thelandlord and agrees in the lease agreement to place the electric bill into their nameupon move-in. This requires the tenant to make a call into the electric company and/or go to the electric company office to give the relevant information and pay a utilitydeposit, which varies by company providing the electric. In a perfect world, the tenantdoes just that. Prior to move-in they get the electric placed into their name and paythe bill. What happens when they do not pay the bill? In many places, the electricity issimply shut off and the tenant is without electricity. This is the tenant’s problem, and noliability to the landlord occurs. The tenant may then pay the bill and have it reconnected,steal the electricity from an adjoining tenant, put jumper wires on the electric meter orcompletely live without electricity. In some areas of Florida and in many apartmentcommunities, the electric will revert back into to the name of the apartment community,and the apartment community will later be notified that this has occurred, sometimesweeks later. This is to prevent a unit from being without electricity. While we cannotcontrol what the tenant is “supposed” to do, we can take action, but must be carefulthat we do not fun afoul of the law.
Florida Law and Electric
Florida law specifically states that a landlord shall not directly or indirectly causeinterruption in the tenant’s electric service.

(1) No landlord of any dwelling unit governed by this partshall cause, directly or indirectly, the termination or interruption of any utility servicefurnished the tenant, including, but not limited to, water, heat, light, electricity, gas,elevator, garbage collection, or refrigeration, whether or not the utility service is underthe control of, or payment is made by, the landlord.
Direct Interruption
Direct interruption would be when the landlord shuts the electric off by actuallydisconnecting it from the rental unit (this is rarely done but happens!), or more commonlyinstructs the electric company to shut the electric off. A landlord who discovers thatthe tenant has not placed the electric in the tenant’s name could easily feel that it iscorrect to tell the electric company that the electricity is not to be in the name of thelandlord, but rather that it must be in the name of the tenant. However, this can lead toa direct shut off. Further, the landlord may have had the electric bill revert back into thelandlord’s name, as is often the case in apartment communities; notifying the electriccompany that this is not proper and that it should be in the tenant’s name will result in adirect shut off to the tenant. In the single family home setting, sometimes the propertyowner who lives out of state receives an electric bill, is furious and calls the electriccompany for a shut off. Does it seem fair to the landlord who now is stuck paying thebill? No, but we never said the law was always fair.
Indirect Interruption
An example of indirect interruption occurs if the landlord receives an electric bill on anaccount that should have been in the tenant’s name, and the landlord simply fails topay it. Here the landlord has full knowledge that the tenant failed to place the accountin his or her name, and by the landlord not paying it, the account will get shut off. Again,this seems unfair to the landlord, but is the law.
Steps to take if it is discovered that the tenant is not paying the electric
Once it is discovered that the tenant is not paying the electric bill, the tenant needs to benotified immediately by the use of a 7 Day Notice of Noncompliance with Opportunityto Cure. The notice may state the following:
You have failed to place the electric utility service account into your nameas required by your lease agreement, and you owe the landlord the sum of$__________ at this time for outstanding electric bill(s).
Steps the Landlord can take
While it is beyond the landlord’s immediate control if the tenant steals electric, orin the event of reversion of the account back to the landlord, there is one thing thatoften occurs which is indeed completely in control of the landlord, but is often missed,because of the landlord’s forgetfulness or misplaced trust that the tenant will do whatthe tenant is “supposed” to do. Due to the need for electric to operate pools and a/cunits, most landlords do not wish to have a time period when the electric is off. Theresult is that the electric is in the landlord’s name until such time as either the landlorddirectly has it shut off, OR the tenant directly has it placed in the tenant’s name. Whena tenant moves into a rental unit and the electric is on, they will often happily sit thereuntil the electric is shut off. But wait. How can the landlord have it shut off? Did notwe just say that was illegal? The answer lies in timing. If the tenant is notified in writingthat the landlord will be taking the electric out of his or her name no later than a fixeddate, and the landlord does indeed do this, it is doubtful that a prohibited practiceor indirect termination as envisioned by the statute will occur. We recommend thefollowing wording in a notification to be given to the tenant prior to move-in. This canbe placed directly on the INFO SHEET that the tenant should receive from the landlord,stating the names, phone numbers and addresses of the utility company, garbage pickup days, etc. Here is some recommended wording:
Tenant understands and agrees that the electric service is currently on in theLandlord’s name. Tenant agrees that the Landlord shall order the electric servicebe taken out of the name of the Landlord within 3 days, and Tenant shall place theelectric service in Tenant’s name and pay all necessary deposits.
So you notified the tenant prior to move-in. Now, don’t forget to notify the electriccompany immediately in writing, and get a confirmation from them!! Propertymanagers who use checklists rarely, if ever, forget to do this. As a friendlyreminder, if you shut off someone’s electric after they have taken occupancy inviolation of the law, WE WILL NOT REPRESENT YOU!!TD

She flipped throughpictures: A picnic basketwith a chalkboard top forplayfully listing its con-tents. An old mirror con-verted into a messageboard. The fronts of a fewkitchen cabinets for mealplanning and writingquotes.
Sims finds pieces inthrift stores, garage salesand even the trash, thentransforms them withchalkboard paint intogifts and home-entertain-ing accessories.
Sims may be a kinder-garten teacher, but shewas a pupil that Thursdaynight in chalkboard paintclass.
The instructor wasMeredith Martin, an inte-rior designer who lec-tured on how to mix cus-tom colors and what youcan make with them.
Results included a ta-ble setting with a chalk-board-painted paper run-ner and flower pots withchalkboard labels. Next toher sat a chalkboard-painted desk, storage box-es and a child’s play table.She led the class in a craftproject, a large metalcharger with the decora-tive border taped off.With paint, the center ofthe charger became achalkboard.

Good gifts can be madewith chalkboard paint.Paint an empty wine bot-tle, et voila! A vase. Greatgift tags, too, can be craft-ed. The best part: they’rereusable.
How to mix your ownchalkboard paint: buyyour favorite color of la-tex paint, says interior de-signer Meredith Martin(she used a no-VOC varie-ty). Buy unsanded grout($3 from a hardwarestore). For a gallon ofpaint, mix in a quart ofgrout. (The ratio shouldbe two-thirds paint to one-third grout). Stir. Adddrops of water to make itthinner. After painting, al-low to dry an hour. Oftenonly one coat is needed.
