6. "he home occupation does not change the outside appearance of the residential

d#elling!

&. "he home occupation does not change the primary use of the home from

residential;

&. "he home occupation does not generate traffic! par0ing! se#erage! refuse! #ater

use! noise! dust! odors! or ibrations in e2cess of #hat is normal in a residential neighborhood;

7. "he home occupation does not create a ha/ard to person or property! result in

electrical interference! inole the storage of flammable or ha/ardous materials! or become a

 public or priate nuisance! and the home is not classified by the city as a nuisance property;

8. "he home occupation does not hae outside storage or display any occupation$

related e3uipment! including ehicles that openly display occupation$related e3uipment! outside

the home;

5. "he home occupation does not regularly and routinely employ anyone #ho is not

also a resident of the home to perform #or0 inside the home;

'. "he applicant of the home occupation resides at the home;

. "he home occupation does not display a sign outside the home;

(. "he home occupation does not regularly and routinely accept customers! clients!

or the general public into the home;

9. "he home occupation does not adertise! solicit or inite customers! clients! or the

general public to the home;

6). "he home occupation is #ithin a property #ith a alid Occupancy Permit;

66. "he home occupation and the property remain in compliance #ith all city la#s!

rules! and regulations.

SECTION TWO. Re$*-(#*%n *n +*eu %& #4.

Sections (.).)8&*A+ and (.).)8&*,+ of the -eised Code of the City of St. Louis are hereby

repealed and replaced #ith the follo#ing4

Section (.).)8&*A+.

Any person or ta2payer operating a home occupation that is permitted by and meets the

re3uirements of the Zoning Code of the City of St. Louis may apply to the License Collector for

designation and registration as a home occupation operator. Such designation and registration

shall be granted for a one year period and be rene#able each year on an annual basis if and only

if the person or payer meets the follo#ing conditions4 *6+ "he application is accompanied by4 *a+

a copy of a home occupation permit issued by the Zoning Administrator! *b+ a copy of the $&78

,usiness arnings "a2 :orm filed by the ta2payer #ith the Collector of -eenue for the

 preceding calendar year! *c+ a #ritten statement of clearance certifying that no current or past

earnings andor personal property ta2es are due and payable to the City; and *&+ said :orm $&78

demonstrates that the ta2payer1s gross earnings attributable to such home occupation for said

 preceding calendar year are less than one hundred thousand dollars *<6))!)))+; proided!

ho#eer! that ta2payers #ho #ere not re3uired to file :orm $&78 for the preceding calendar

year due to the fact that their business did not then e2ist shall be eligible for designation as home

occupation operators #ithout filing the $&78 form for that calendar year only.

=pon designation as a home occupation operator! the operator shall pay! in lieu of the graduated

 business license ta2! a home occupation registration fee in the amount of t#enty$fie dollars

registration by the License Collector that shall be maintained at the home occupation premises.

"he proisions of this ordinance are seerable. >n the eent any proision of this ordinance is

determined to be inalid! the remaining proisions shall not be affected thereby.
