Sample Motion to Change Venue
RESPONDENT’S MOTION TO CHANGE VENUE
Now comes Respondents, , and moves this Honorable Court to change the venue of
their removal proceedings from: Bloomington, Minnesota to: Arlington, Virginia.
I seek this change of venue pursuant to 8 CFR § 1003.20.
In support of this motion, I state as follows:
When we first left the detention center, my daughter and I moved in with my sister,
her address . We lived with her
for two months, but I felt that there was not enough space for us to continue living there. My
friend in Virginia offered to let us live with her, so we moved and now live at
. I have attached a letter from the Virginia Prescription Assistance
Program as proof of my residence.
Before I moved to Virginia, I made sure to report the change in address to the ICE office in
Minnesota. I filed all the paperwork, and my ICE check-ins were transferred to Virginia. I thought
I had filed a change in address with the immigration court as well, but I now understand that I had
to file this separately. I did not understand this until I spoke to representatives at ASAP, the
organization that is now helping me file my motion to change venue.
I concede the allegations in the Notice to Appear: We are not U.S. citizens. We are natives and
citizens of El Salvador. We applied for admission to the United States on as
asylum seekers and did not have valid entry documents.
