HISTORICAL NOTE

The first paroles act in Nebraska bears the date April 10, 1893 and empowers the Governor to parole any prisoner who has served the minimum term provided by law for his first offense (except 1st or 2nd degree murder), and anyone serving time for murder in the first or second degree who has served 25 full years.

The Legislature of 1911 created the State Prison Board and the Advisory Board of Pardons. This board of three members appointed by the Governor, had power to establish rules and regulations for parole of prisoners in the penitentiary who had served minimum sentences fixed by law. This act repealed the first Parole Law of 1893. The functions of these boards were merged in the Department of Public Welfare in 1919.

A Nebraska Constitutional amendment adopted in 1920 created a Board of Pardons and designated the Governor, Secretary of State, and Attorney General as its members. The Legislature of 1937 passed the uniform act for the supervision of Nebraska prisoners paroled in other states.

In 1969 the Nebraska Legislature created a separate Board of Parole. The duties of this board are to review the status of every committed offender; determine the time of release on parole of committed offenders; fix the conditions of parole, revoking paroles, and issuing warrants for violators; determine the time of release from parole supervision; visiting and inspecting any facility (state or local) designed for detention of prisoners; and recommending parole legislation to the governor.

The Board of Pardons retained authority to pardon offenders. It has the power to remit fines and forfeitures and to grant respites, reprieves, pardons and commutations after conviction and judgement. The board received and considers applications for pardons, reprieves, commutations of sentence, and remission of fines and forfeitures.

SCOPE AND CONTENT NOTE

This record group consists of the records of the pardoning and parole authority of Nebraska throughout the state's history. Included are records under the Governor's administration, 1870-1911; the Prison Board, 1911-1920; the Board of Pardons, 1920-current; and the Board of Paroles, 1969-current.

The collection is arranged into nine subgroups: 1) Minutes of the Boards of Pardons, 1921-current; 2) Minutes of the Board of Parole, 1969-current; 3) Inmate Records, 1870-1948; 4) Pardon and Parole Applications and Inmate Files, 1888-1981; 5) Parole and Commutation Registers, 1879-1972; 6) Inmate Records of Paroles, Commutations, Pardons, etc., 1902-1963; 7) Discharges, Respites, Pardons, etc., 1875-1969; 8) Criminal History Files, 1911-1930; 9) Fiscal Records, 1913-1929.

Subgroup One, Minutes of the Board of Pardons, 1921-current, record official minutes of the Board of Pardons regarding actions by the Board on fiscal and official matters, and hearings of prisoners before the board, 1921-1934 & 1940. Official minutes of the Board of Pardons after this period are on security microfilm only and have been restricted from patron use. This also applies to the minutes of the Board of Parole, 1969-current. The briefs contained in this subgroup relate to cases coming before the board listing prisoners by name and number and giving background, biographical data, criminal history, and voting record of the board.

The inmate registers of Subgroup Three, 1870-1963 are descriptive registers of inmates of the Penitentiary, Men's Reformatory, and Women's Reformatory. These volumes contain name of prisoner, vital statistics and physical description, residence at time of arrest, crime, sentence, and disposition of prisoner by convict number. There is no index to these registers. Additional descriptive records of inmates of the Nebraska State Prison system can be found in RG86, Nebraska. Dept of Correctional Services.

Subgroup Four consists of two volumes of pardon and parole applications, 1891-1897 and 1907-1910. These volume record actions taken by the board regarding each application. Also included in this subgroup are 36 boxes of confidential inmate case file papers regarding certain applications or parole violations, and supplemental papers filed in conjunction with parole or pardon requests, 1888-1947. The last box of this Subgroup contains the inmate file for State of Nebraska vs. Carol Ann Fugate, 1958-1981. These boxes are restricted from use by patrons unless they receive prior written approval from the Chair of the Board of Parole or Records Manager of the Board of Parole. This file was received by the Archives in 1991.

Subgroup Five contains Registers relating to Pardons, Paroles, Commutations for penitentiary inmates, inmates of the Mens Reformatory, inmates of the Woman’s Reformatory, and detainees at the State Industrial School at Kearney, 1879-1972. The parole registers give the number, name of prisoner, sentence, information on parole, and date of discharge.

Subgroup Six are volumes arranged by inmate number. These volumes seem to be a continuation of the volumes of Subgroup One. However, they do not contain descriptions of prisoners. They contain the same information as the volumes of Subgroups Four and Five combined.

The volumes of Subgroup Seven record all actions taken regarding time served by prisoners of all facilities. Reduction of time served by respite, commutation, and pardons is recorded. Also recorded are discharges by time expiration, escapes and returns, and transfers to another facility. Box one of this subgroup contains warden's conduct reports with requests for reduction of time due to good conduct, 1887, 1889-1891. Also included in box one is a list of pardons granted 1875-1877.

Subgroup Eight, Criminal History Files, 1911-1928, contain volumes which register background of prisoners and history of the offense for which the prisoner is incarcerated. Also included in the Subgroup are Descriptive and Bertillion Sheets for the Nebraska Penitentiary, c.1914-1930. Mug Shots and photographs are available from the Photograph Department of the Historical Society. Additional descriptive information on Nebraska Prisoners can be found in RG86, Nebraska. Dept of Correctional Services.

Subgroup Nine, Fiscal Records, contains a single volume recording Appropriations and expenses of the State Prison Board, April 1913 thru July 1921 labeled, "Charities, Corrections, and Prison Board.

For further materials relating to the Nebraska Prison system or persons detained in prison facilities, see the various Governors collections (RG1) and the Nebraska. Department of Correctional Services collection (RG086). For administrative reports and correspondence of the Nebraska State Penitentiary, 1891-1955, see RG39, SG2 Nebraska. Dept. of Public Institutions. Included are some conduct reports and prisoners lists. Other records pertaining to the pentitentiary and industrial schools as well as the records of the Board of Control can be found in RG39, Dept of FPublic Institutions.

The bulk of the collection was transferred to the Archives in February of 1983. The inmate files were transferred to the Archives on November 30, 1979. The descriptive sheets and some miscellaneous case files were received in 1980. The last accession included parole registers, 1902-1972, and the Carol Fugate file transferred to the Archives in February 1991.
