Item 1 Welcome and formalities

Mr Stephen Davies opened the meeting at 9:06am, delivered an Acknowledgment of Country and welcomed attendees.

Apologies were accepted, and it was noted that quorum had been met.

Members were asked to raise any conflicts of interest with items on the agenda.

Item 2 Presentations

Item 2.1 Parramatta Aquatic Leisure Centre – Parramatta Park and Old Government House (SHR 00596)

The Heritage Council of NSW received a paper on the Parramatta Aquatic Leisure Centre – Parramatta Park and Old Government House and a presentation from Mr Joshua French (Parramatta Park Trust (PPT)), Ms Wendy Thorp, Ms Caryn Lim and Mr Jim Stefan (City of Parramatta Council (CoP)).

The Heritage Council of NSW discussed:

1. Mays Hill Master Plan

a. The Plan identifies the landscape setting and views as important

b. Pool is currently the only funded item in this plan

c. Car parking is a necessity to the operation of the Aquatic centre.

2. Governance of the site

a. Master planning process determined proposed location of structures and established design principles to guide the form, scale, height, colours and textures of the Aquatic Centre site development.

b. Heritage and planning controls identified

3. Design Competition for the Conceptual Design of the site

a. Competition is closed and currently undergoing review from technical advisors.

b. Design Completion is governed by design guidelines for excellence.

c. The jury for the Design Competition includes a member from each of the following: the proponent, Property Development Group, CoP the consent authority, CoP, NSW Government Architect the landowner PPT, (a

landscape architect) as well as a client side representative with sports and leisure experience.

4. Delivery of design excellence timeframe

a. Heritage Council expressed concern about their ability to make constructive comments with the limited timeframe and proposed program.

b. Heritage Council requested the opportunity to have input prior to the lodgement of the DA.

c. Design competition winning entry will need further work before DA submission.

5. Pending excavation approval from Heritage Division.

a. City of Parramatta Council is yet to submit adequate documentation for an archaeology assessment to occur. It was noted that CoP’s project forecast for S60 approval may expire before a complete application is submitted to the Heritage Division.

b. The Heritage Division archaeology team are ready to assess the application when the information is provided.

7. Aboriginal Cultural Heritage and Country should be acknowledged within the design of the site.

8. Communicate to City of Parramatta Council that an adequate delivery timeframe is essential for a good heritage outcome in this highly significant landscape.

a. Concept design and what is built often differs because of tight timeframes.

b. Heritage Council requests opportunities to guide the project team during the design phase of the project.

2. REQUESTED an ongoing engagement and an opportunity to comment through the design

excellence process.

Item 2.2 Proposed ARC Linkage Project with Western Sydney University

The Heritage Council of NSW received a paper on the Proposed ARC Linkage Project with Western Sydney University and a presentation from Dr Denis Byrne (Western Sydney University) and Ms Sally MacLennan (OEH).

a. Workshops to develop applications for funding, in the first instance through Heritage Near Me and then through wider Heritage programmes

b. Funding for recording how recent migrants relate to existing heritage and reshape the heritage landscape.

2. The importance of recording Parramatta migrant community’s heritage.

3. The ‘Heritage Near Me Research Narrative’ attachment to the report and commended this.

4. Future opportunity for Heritage Council to support research.

a. Research funding process needs to be developed.

b. Key focus areas could include: Aboriginal heritage, migrant heritage, heritage landscapes and intangible heritage.

Resolution 2018 ‐ 38

After discussion, the Heritage Council of NSW:

1. NOTED the Australian Research Council Linkage project proposal by Western Sydney University;

2. NOTED the approval of the partnership and first year funding allocation from Heritage Near Me’s Heritage Roadshow Team budget;

3. APPROVED the Heritage Council as a project partner on the proposed Linkage project with Western Sydney University and the Heritage Division; and

4. APPROVED partnership funding allocation for Years 2 and 3 from the Heritage Council ($25,000 cash total and $75,000 in‐kind contribution).

Item 3 Conservation Matters

Item 3.1 Catherine Hill Bay ‐ update

The Heritage Council of NSW received a paper on the Catherine Hill Bay ‐ update and a verbal report from Mr Tim Smith (OEH).

1. Catherine Hill Bay is one of a few townships listed on the SHR

a. Listed in 2010 as a remnant quintessential mining town.

3. Inviting Lake Macquarie Council to a Heritage Council meeting to work with them to ensure good heritage outcomes.

a. The Heritage Council noted that it’s not just the built form that is important, but the spaces in between the key structures and how they relate to the wider landscape that makes the Place of State heritage significance.

Item 4 Legislation, Policy and Administrative Matters

Item 4.1 Financial report

The Heritage Council of NSW received a paper on the Financial report – Heritage Council underspend and a verbal report from Mr Anthony Dann, Mr Nikesh Nag and Ms Tanya Harper (OEH).

The Heritage Council of NSW discussed:

1. 2017‐18 Financial Year

a. Expecting revenues

b. Expected expenditures

2. Planning for 2018‐19 Financial Year

a. Budget to be brought to June Heritage Council meeting

b. Roll over unspent money to next Financial Year

3. Any underspend could be used at a later time to go towards strategic projects.

4. Business Planning Workshop to occur in July to consider strategic projects.

c. Session on Communication and Engagement Strategy to map out the next 3‐5 years

1. NOTED the two proposed locations for the Regional Program; and

Item 4.3 System Outline for an Intangible and Celebratory Heritage Category

The Heritage Council of NSW received a paper on the System Outline for an Intangible and Celebratory Heritage Category and a verbal report from Ms Lucy Albani (OEH).

1. Proposal for Intangible and Celebratory Heritage Category

2. Potential examples for listing under the proposed category

3. Proposed nomination and approval process

Decision

After discussion, the Heritage Council of NSW:

1. NOTED the paper and verbal report.

2. APPROVED the proposed broad approach and system outline subject to amendment of

nomination timeframe and process.

3. NOTED forthcoming consultation in relation to the development of listing criteria and an

initial shortlist.

Item 5 Listing Matters

Item 5.1 Hunter Region SHR Listings Project

1. The Heritage Council of NSW received a paper on the Hunter Region SHR Listings Project and a verbal report from Ms Alexandra Boukouvalas (OEH).

2. The Heritage Council of NSW discussed:

3. The Aim of this project is to meet the intended outcomes of sub‐programs 5c and 5d of the 2011‐2013 Hunter Region Heritage Grants program which was derived from mining offset levies in 2010.

4. The intended outcomes included:

a. SHR listing of ten Hunter homestead properties captured in an earlier 2013 Heritage Council Hunter Homestead’s study

b. SHR listing of an unspecified number of Aboriginal themed items

c. Completion of two Aboriginal oral history/story “projects”

5. The funding has not been fully expended.

6. To meet the intended outcomes an additional internal resource will be funded to progress the listing of 10 items located in the Hunter Region on the State Heritage Register.

7. The 10 items will be drawn from a list of 25 items previously identified in the homestead study, those identified by the Northern Region team including Aboriginal themed listings, and 3 existing SHR items which can be updated to include Aboriginal Cultural Heritage Values.

8. As historic research has been substantially undertaken for most of the items, the project will be primarily focused on stakeholder engagement and facilitation of the listings process.

9. Site visits will also be a focus for confirming the condition of the proposed items.

10. It is anticipated that the project will be of one year duration and recruitment will commence in the next few months.

11. Mining continues to pose a significant threat to cultural landscapes in the Hunter Region.

12. Public expectations that heritage in the hunter valley will be protected reflected in contentious IHO requests

13. In 2017 the State Heritage Register Committee recognised public expectations that heritage in Newcastle would be protected by prioritising a list of deferred nominations in Newcastle. The potential inclusion of these items in the Hunter SHR Project should be investigated.

Decisions

After discussion, the Heritage Council of NSW:

1. NOTED the verbal report.

2. REQUESTED a further report at the 06 June Heritage Council meeting outlining the status of previous deferred nominations in Newcastle and a case for why these nominations can or cannot be included in the Hunter Regional SHR Listings Project.

Item 5.2 Mt Gilead Estate, Gilead

The Heritage Council of NSW received a paper on the Mt Gilead Estate, Gilead and a verbal report from Ms Emma Dortins and Mr Stuart Read (OEH).

The Heritage Council of NSW discussed:

1. Owner objects the proposed listing area but accepts the importance of protecting the area.

2. Lendlease objects to the listing.

3. Recommending and supporting listing the whole, wider curtilage

4. Requests further information on the risks of not listing:

a. One Tree Hill and other areas

Resolution 2018 ‐ 40

After discussion, the Heritage Council of NSW:

1. ADVISED the Heritage Division on the preferred curtilage option A for Notice of Intention

for Mt Gilead Estate from among the two options presented at TAB 5.2B;

2. CONSIDERED that the item known as “Mt Gilead Estate” at 901 Appin Road, Gilead,

defined in accordance with the preferred curtilage, may be of state heritage significance;

3. In accordance with section 33(1)(a) of the Heritage Act 1977, will give each person that it

considers to be an affected owner or occupier written notice that it is going to consider

whether or not to recommend the listing of the item concerned (a Notice of Intention to

Consider Listing); and

4. in accordance with section 33(1)(b) and section 33(1)(c) of the Heritage Act 1977, within

14 days after notice of intention to consider listing is given, will cause a notice of

intention to consider listing to be published in a newspaper circulating in the area in

which the item is situated, inviting submissions on the listing, specifying a date as the

closing date for the receipt of submissions of 28 days after the publication of the

newspaper notice and the manner in which submissions may be made.

Item 6 Reports

Item 6.1 Executive Director, Heritage Division’s monthly update

The Heritage Council of NSW received a paper on the Executive Director, Heritage Division’s monthly update and a verbal report from Ms Pauline McKenzie (OEH).

Calga Aboriginal Cultural Landscape.

1. Aboriginal stakeholders had invited Heritage Council members to attend a site visit to demonstrate the cultural and spiritual values of the landscape, however this invitation was withdrawn by Aboriginal stakeholders before logistics could be fully investigated.

2. Hanson (land owner) also invited Heritage Council to attend a site visit to demonstrate the economic value of the site. Heritage Division advised that such a site visit would be too logistically difficult for the Heritage Council.

3. Should Hanson wish, the Heritage Division would be able to undertake a site visit and or further meetings and report back to the Heritage Council.

Item 6.2 Chair of the Heritage Council of NSW monthly update

The Heritage Council of NSW received a verbal Chair of the Heritage Council of NSW monthly update from Mr Stephen Davies.

The Heritage Council of NSW discussed:

1. Outer Sydney Orbital

a. Proposed route would cut through Clydesdale SHR item and skirt Denbigh and Camden Park estates and the St Paul’s Church and Heber Chapel, Cobbitty SHR listed sites, adversely impacting the visual and cultural landscape settings of these sites.

b. Mr Stephen Davies and Mr Gary Escort (OEH) with Chairs of the National Trust of Australia (NSW), Historical Houses Association, the local member and local mayor visited Denbigh (SHR No. 01691) one of the effected properties.

c. Matter of concern. The Heritage Council request to be consulted on any decisions and formally involved in the strategic planning of this area.

d. Outer Sydney Orbital Route is currently on public exhibition until 1 June 2018. Heritage Division and Heritage Council to prepare and lodge formal submission to Transport for NSW.

e. Invite Transport for NSW to present at 06 June 2018 Heritage Council Meeting to hear the route options.

Item 9.1 Visit to Heritage Council, Victoria

The Heritage Council of NSW received a verbal report from Ms Jane Irwin on her visit to Heritage Council of Victoria (VHC) and Heritage Victoria.

The Heritage Council of NSW discussed:

1. Strengths of the Victorian planning system and heritage listings achieved

2. VHC activity in developing policy guidance on the Victorian Heritage Register listing of cultural landscapes, and opportunities for NSW to draw from this guidance.

3. Listing of cultural landscapes

a. Large and complex landscapes can be listed

b. Significant Landscape Overlay is a planning mechanism not available in NSW

c. Difference between NSW and Victorian planning system.

4. Strategic Planning workshop to include discussion about the Victorian approach. Jane Irwin thanked the Heritage Division for facilitating the briefings and support.

Item 9.2 Windsor Bridge – Parliamentary inquiry

The Heritage Council of NSW received a verbal report on Windsor Bridge – Parliamentary inquiry from Ms Jenny Davis.

The Heritage Council of NSW discussed:

1. Ms Jenny Davis recently attended the Upper House Committee of Inquiry for the Windsor Bridge Project, representing the Chair.

2. Ms Jenny Davis expressed confidence that the Heritage Division is delivering the Heritage Council’s recommendations under the Secretary’s requirements.

3. Requested regular updates on the issue:

a. Heritage Division to prepare an update for the 06 June 2018 Heritage Council meeting.

b. Invite RMS to attend July meeting to share most recent design plans.

1. Heritage Council becoming the second respondent in the subject Land and Environment Court appeal.

After discussion, the Heritage Council of NSW:

1. NOTED a verbal report provided by the Heritage Division;

2. NOTED that an appeal has been lodged against conditions of approval issued by City of

Sydney for a proposed development at 51 Lower Fort Street, Dawes Point and that these

conditions relate to General Terms of Approval issued by the Heritage Division under

delegation from the Heritage Council;

3. AGREED to become the second respondent in the subject Land and Environment Court appeal.

b. Heritage Council advised RMS of their determination of an ‘away from the wall’ approval at the February meeting. Heritage Council’s position on the issue was reiterated at the April meeting.

2. Heritage Division met with North Sydney Council.

3. Minister for Roads has escalated the issue to the Minister for Heritage and RMS are seeking an appeal against the Heritage Council’s decision.

Resolution 2018 ‐ 42

After discussion, the Heritage Council of NSW:

1. AGREED to seek the Minister’s consent for the Heritage Council to delegate its

determination role under the Heritage Act for exemption notifications and s60

applications below the Material Affect threshold to the City of Sydney for its operational

area;

2. INSTRUCTED Heritage Division to prepare and process the necessary briefing note and

the instrument of delegation in consultation with the Chair to seek such consent from the

Minister;

3. AGREED to the Chair, Heritage Council issuing the abovementioned delegations to the

City of Sydney upon receipt of such consent from the Minister;

4. INSTRUCTED the Heritage Division to prepare an information package and provide

training necessary for the City of Sydney to exercise such delegations;

5. NOTED that further work will need to be done to clarify the Material Affect threshold for

the proposed delegations to be exercised correctly; and

6. AGREED to provide funding for an officer to assist the Heritage Division and City of Sydney for a period of up to 3 months in achieving the delegations and supporting information and training.

Item 9.5 Portraits of NSW

The Heritage Council of NSW received a verbal report on the Portraits of NSW publication from Ms Jane Holden (OEH).

The Heritage Council of NSW discussed:

1. ‘Portraits of NSW’ to be launched on Friday, 5 May by the Minister for Heritage at the National Trust Heritage Awards.
