Matt’s Guide to the Holiday Luxury Auction

Let me be the frst to introduce you to the third Heritage Luxury Auction. Although I, of course, love all

of the Luxury Auctions equally and could never pick a favorite, there is something about this one that –how shall I say – sparkles?

My favorite pieces this time of year are usually neutral matte crocodiles; the rich skin in subtle tones

just seems perfect in the winter. Just about nothing can top the classic Hermes Havana Matte Crocodile

Birkin paired with Gold Hardware (Lot 56068) or the more contemporary, but equally stunning, Chanel

Matte Black Crocodile Paris-Baritz Tote with Silver hardware (Lot 56120). Two of the rarest, nest, and

most sought after bags ever made, it’s pieces like this that make the category exciting. Most people

never saw these bags at their respective boutiques because the brands make only two or three a year

that never make it to the shelves because when your sales associate calls with a bag like this, it’s not

something that you – or anyone – turns down.

But, this winter it’s the sparkle that’s catching my eye. Just take a moment and ip through lots 56238

– 56271 and you’ll see what I’m talking about. Maybe those are what got me in the mood, but they are

still not what really has my heart racing. The twinkle in my eye is, of course, the Diamond Birkin. The

Diamond Birkin is the be-all, end-all of the luxury market. It is the Solid 18K White Gold Hardware set

with awless diamonds that radiate against the rich Rouge Hermes Crocodile (what better color to have

the bag in than the signature color of the brand?) that has me seeing red. In Pristine Condition, the

winner of this bag will be the owner of one of the nest pieces of luxury ever created. Whether it sells for

under the retail price at Hermes or it sells for double, the high bidder will be investing in something truly

spectacular.

So, my recommendation this year is: go red . If you are the broken-hearted under-bidder on the Diamond

Birkin, rst pick up Lot 56254 to replace that heart, then take a look at the 35cm Shiny Rouge Hermes

Crocodile Birkin (sans diamonds), in pristine condition (Lot 56066) for another stunning red. Or, for a

true show-stopper, a bag that will turn heads from a mile away – the other red that I can’t keep my eyes

off is the 35cm Shiny Braise Crocodile Birkin, also in pristine condition (Lot 56089). Braise is Hermes’

brightest red, only done in exotics, and only made once or twice a year, it could be the most desirable

color there is.

If, however, you’re like me and this season means muted colors and neutrals, at least consider going for

a shiny nish this year. Go for a shiny black crocodile, like the Chanel Jumbo Shiny Black Crocodile Flap

Bag with Gold Hardware (Lot 56116) or a rich, deep brown with a nice glaze like the Hermes 35cm ShinyChocolate Crocodile Kelly with Gold Hardware (Lot 56067) and add some glisten. These bags certainly

have sparkle, in their own understated way, and maybe next year you’ll be ready to paint the town red!

Credit may be granted at the discretion o Auctioneer.Additionally Bidders who have not previously established credit or who wish to bid in excess of theirestablished credit history may be required to provide their social s ecurity number or the last four digitsthereo to us so a credit check may be perormed prior to Auctioneer’s acceptance o a bid.

10. Auctioneer’s Execution of Certain Bids. Auctioneer cannot be responsible for your errors in bidding,so carefully check that every bid is entered correctly. 11. Caveat as to Bid Increments. Bid increments (over the current bid level) determine the lowest amountyou may bid on a particular lot. Bids greater than one increment over the current bid can be anywhole dollar amount. It is possible under several circumstances for winning bids to be betweenincrements, sometimes only $1 above the previous increment. 12. I Auctioneer calls or a ull increment, a bidder may request Auctioneer to accept a bid at hal o theincrement (“Cut Bid”) only once per lot. Aer ofering a Cut Bid, bidders may continue to participateonly at full increments. O-increment bids may be accepted by the Auctioneer at Signature® Auctionsand Grand Format Auctions. If the Auctioneer solicits bids other than the expected increment, thesebids will not be considered Cut Bids.

Conducting the Auction:13. Notice o the consignor’s liberty to place bids on his lots in the Auction is hereby made in ac

with Article 2 of the Texas Business and Commercial Code. A “Minimum Bid” is an amouwhich the lot will not sell. HE CONSIGNOR OF PROPERY MAY PLACE WRIEN ”MBids” ON HIS LOS IN ADVANCE OF HE AUCION; ON SUCH LOS, IF HE HAMMEDOES NO MEE HE “Minimum Bid”, HE CONSIGNOR MAY PAY A REDUCED COMMON THOSE LOTS. ”Minimum Bids” are generally posted online several days prior to theclosing. For any successul bid placed by a consignor on his Property on the Auction oor, means during the live session, or aer the ”Minimum Bid” for an Auction have been postedrequire the consignor to pay ull Buyer’s Premium and Seller’s Commissions on such lot.

14. e highest qualied Bidder recognized by the Auctioneer shall be the Buyer. In the event ofthe earliest bid received or recognized wins. In the event of any dispute between any BiddAuction, Auctioneer may at his sole discretion reofer the lot. Auctioneer’s decision and deo the winning Bidder shall be nal and binding upon all Bidders. Bids properly ofered, whoor Bidder or other means o bidding, may on occasion be missed or go unrecognized; in suthe Auctioneer may declare the recognized bid accepted as the winning bid, regardless o wcompeting bid may have been higher.

15. Auctioneer reserves the right to refuse to honor any bid or to limit the amount of any bid, discretion. A bid is considered not made in “Good Faith” when made by an insolvent or irreperson, a person under the age o eighteen, or is not supported by satisactory credit, coreerences, or otherwise. Regardless o the disclosure o his identity, any bid by a consignagent on a lot consigned by him is deemed to be made in “Good Faith.” Any person apappearing on the OFAC list is not eligible to bid.

16. Nominal Bids. Te Auctioneer in its sole discretion may reject nominal bids, small openinvery nominal advances. If a lot bearing estimates fails to open for 40–60% of the low estimAuctioneer may pass the item or may place a protective bid on behalf of the consignor.

17. Lots bearing bidding estimates shall open at Auctioneer’s discretion (approximately 50%-6low estimate). In the event that no bid meets or exceeds that opening amount, the lot shaunsold.

18. All items are to be purchased per lot as numerically indicated and no lots will be broken. Areserves the right to withdraw, prior to the close, any lots from the Auction.

19. Auctioneer reserves the right to rescind the sale in the event of nonpayment, breach of a wdisputed ownership, auctioneer’s clerical error or omission in exercising bids and reserves, oother reason and in Auctioneer’s sole discretion. In cases of nonpayment, Auctioneer’s electioa sale does not relieve the Bidder from their obligation to pay Auctioneer its fees (seller’s anpremium) and any other damages or expenses pertaining to the lot.

20. Auctioneer occasionally experiences Internet and/or Server service outages, and Auperiodically schedules system downtime or maintenance and other purposes, during whichcannot participate or place bids. If such outages occur, we may at our discretion extend bithe Auction. Bidders unable to place their Bids through the Internet are directed to contaServices at 1-800-872-6467.

21. Te Auctioneer, its aliates, or their employees consign items to be sold in the Auction, andon those lots or any other lots. Auctioneer or aliates expressly reserve the right to modif ybids at any time prior to the hammer based upon data mad e known to the Auctioneer or itse Auctioneer may extend advances, guarantees, or loans to certain consignors.

22. Te Auctioneer has the right to sell certain unsold items aer the close o the Auction. Suchbe considered sold during the Auction and all these erms and Conditions shall apply to sincluding but not limited to the Buyer’s Premium, return rights, and disclaimers.

Payment:23. All sales are strictly or cash in United States dollars (including U.S. currency, bank wire

checks, travelers checks, eChecks, and bank money orders, all subject to reporting requirAll are subject to clearing and funds being received in Auctioneer’s account before delivepurchases. Auctioneer reserves the right to determine if a check constitutes “good funds” whon a U.S. bank or ten days, and thirty days when drawn on an international bank. Credit Cor Master Card only) and PayPal payments may be accepted up to $10,000 rom non-dealers adiscretion o the Auctioneer, subject to the ollowing limitations: a) sales are only to the car

b) purchases are shipped to the cardholder’s registered and veried address, c) Auctioneer approve the cardholder’s credit line, d) a credit card transaction may not be used in conjuncany other nancing or extended terms oered by the Auctioneer, and must transact immediainvoice presentation, e) rights of return are governed by these Terms and Conditions, which sthose conditions promulgated by the card issuer, ) oor Bidders must present their card.

24. Payment is due upon closing of the Auction session, or upon presentment of an invoice. Aureserves the right to void an invoice if payment in full is not received within 7 days aer ththe Auction. In cases of nonpayment, Auctioneer’s election to void a sale does not relieve throm their obligation to pay Auctioneer its ees (seller’s and buyer’s premium) on the lot and damages pertaining to the lot.

25. Lots delivered to you, or your representative in the States of Texas, California, New York,states where the Auction may be held, are subject to all applicable state and local taxeappropriate permits are on le with Auctioneer. (Note: Coins are only subject to sa les tax in Con invoices under $1500 and in Texas on invoices under $1000. Check the Web site at: httha.com/c/ref/sales-tax.zx for more details.) Bidder agrees to pay Auctioneer the actual amodue in the event that sales ta x is not properly collected due to: 1) an expired, inaccurate, inaptax certicate or declaration, 2) an incorrect interpretation of the applicable statute, 3) or areason. e appropriate form or certicate must be on le at and veried by Auctioneer prior to Auction or tax must be paid; only if such form or certicate is received by Auctione4 days aer the Auction can a refund of tax paid be made. 26. In the event that a Bidder’s payment is dishonored upon presentment(s), Bidder shalmaximum statutory processing fee set by applicable state law. If you attempt to pay via eCyour nancial institution denies this transer rom your bank account, or the payment cacompleted using the selected unding source, you agree to complete payment using your cron le.

27. If any Auction invoice submitted by Auctioneer is not paid in fu ll when due, the unpaid balbear interest at the highest rate permitted by law from the date of invoice until paid. Any inpaid when due will bear a three percent (3%) late fee on the invoice amount or three percenany installment that is past due. If the Auctioneer refers any invoice to an attorney for collebuyer agrees to pay attorney’s ees, court costs, and other collection costs incurred by AuctAuctioneer assigns collection to its in-house legal sta, such attorney’s time expended on thshall be compensated at a rate comparable to the hourly rate o independent attorneys.

28. In the event a successful Bidder fails to pay any amounts due, Auctioneer reserves the right tlot(s) securing the invoice to any underbidders in the Auction that the lot(s) appeared, or at suprivate or public sale, or relist the lot(s) in a future auction conducted by Auctioneer. A defaultinagrees to pay or the reasonable costs o resale (including a 10% seller’s commission, i consigauction conducted by Auctioneer). Te deaulting Bidder is liable to pay any diference betweeoriginal invoice for the lot(s), plus any applicable interest, and the net proceeds for the lot(s)private sale or the subsequent hammer price of the lot(s) less the 10% seller’s commissions, if Auctioneer’s auction.



Terms and Conditions o Auction29. Auctioneer reserves the right to require payment in full in good funds before delivery of the

merchandise.30. Auctioneer shall have a lien against the merchandise purchased by the buyer to secure payment of

the Auction invoice. Auctioneer is further granted a lien and the right to retain possession of anyother property o the buyer then held by the Auctioneer or its aliates to secure payment o anyAuction invoice or any other amounts due the Auctioneer or aliates from the buyer. With respect tothese lien rights, Auctioneer shall have all the rights of a secu red creditor under Article 9 of the TexasUniorm Commercial Code, including but not limited to the right o sale. In addition, with respect topayment of the Auction invoice(s), the buyer waives any and all rig hts of oset he might otherwisehave against the Auctioneer and the consignor of the merchandise included on the invoice. If aBidder owes Auctioneer or its aliates on any account, Auctioneer and its aliates shall have theright to ofset such unpaid account by any credit balance due Bidder, and it may secure by possessorylien any unpaid amount by any o the Bidder’s property in their possession.

31. Title shall not pass to the successful Bidder until all invoices are paid in full. It is the responsibilityof the buyer to provide adequate insurance coverage for the items once they have been delivered to acommon carrier or third-party shipper.

Delivery; Shipping; and Handling Charges:32. Buyer is liable or shipping and handling. Please reer to Auctioneer’s website www.HA.com/

common/shipping.php or the latest charges or call Auctioneer. Auctioneer is unable to combinepurchases rom other auctions or aliates into one package or shipping purposes. Lots won will beshipped in a commercially reasonable time aer payment in good unds or the merchandise and theshipping fees is received or credit extended, except when third-party shipment occurs.

33. Successful international Bidders shall provide written shipping instructions, including speciedcustoms declarations, to the Auctioneer for any lots to be delivered outside of the United States.NOTE: Declaration value shall be the item’(s) hammer price together with its buyer’s premium andAuctioneer shall use the correct harmonized code or the lot. Domestic Buyers on lots designated orthird-party shipment must designate the common carrier, accept risk o loss, and prepay shippingcosts.

34. All shipping charges will be borne by the successul Bidder. On all domestic shipments, any risk o loss during shipment will be borne by Heritage until the shipping carrier’s conrmation of deliveryto the address of record in Auctioneer’s le (carrier’s conrmation is conclusive to prove deliveryto Bidder; i the client has a Signature release on le with the carrier, the package is considereddelivered without Signature) or delivery by Heritage to Bidder’s selected third-party shipper. Onall oreign shipments, any risk o loss during shipment will be borne by the Bidder ollowingAuctioneer’s delivery to the Bidder’s designated common carrier or third-party shipper.

35. Due to the nature o some items sold, it shall be the responsibility or the successul Bidder to arrange

pick-up and shipping through third-parties; as to such items Auctioneer shall have no liability.Failure to pick-up or arrange shipping in a timely ashion (within ten days) shall subject Lots tostorage and moving charges, including a $100 administration fee plus $10 daily storage for largeritems and $5.00 daily for smaller items (storage fee per item) aer 35 days. In the event the Lot isnot removed within ninety days, the Lot may be oered for sale to recover any past due storage ormoving fees, including a 10% Seller’s Commission.

36. e laws of various countries regulate the import or export of certain plant and animal properties,including (but not limited to) items made of (or including) ivory, whalebone, turtle shell, coral,crocodile, or other wildlife. Transport of such lots may require special l icenses for export, import, orboth. Bidder is responsible for: 1) obtaining all information on such restricted items for both exportand import; 2) obtaining all such licenses and/or permits. Delay or ailure to obtain any such licenseor permit does not relieve the buyer of timely compliance with standard payment terms. 37. Any request for shipping verication for undelivered packages must be made within 30 days of shipment by Auctioneer.

DESCRIPION CONAINED IN HIS AUCION OR ANY SECOND OPINE. Any description o theitems or second opine contained in this Auction is or the sole purpose o identiying the items orthose Bidders who do not have the opportunity to view the lots prior to bidding, and no descriptionof items has been made part of the basis of the bargain or has created any express warranty that the

goods would conform to any description made by Auctioneer. Color variations can be expected inany electronic or printed imaging, and are not grounds or the return o any lot. NOE: Auctioneer,in specied auction venues, for example, Fine Art, may have express written warranties and you arereerred to those specic terms and conditions. .

39. Dispute Resolution and Arbitration Provision:45. By placing a bid or otherwise participating in the auction, Bidder accepts these erms and Cond
