Save at the weekend with a stay at a first class hotel – at our first class weekend rate (see note in the “first class WE” price ta-bles). This rate covers arrival on Friday at the earliest and departure on Monday at the latest; public holidays are treated as weekends.

You can find our partner hotels from page 19 onwards. They can be booked upon request and subject to availability, up to a maximum of 14 people. Prices may change if the desired hotel category or your de-sired hotel is no longer available.

Fall under the spell of the many facets of Heidelberg – get to know the cultural, romantic, cu-

linary, sporting or scientific side of the town. The Neckar, which winds picturesquely through

the green valley, and the romantic Castle Ruins, which tower over the roofs of the scenic Old

Town, attract several million visitors to the town every year. The Castle was home to Electors

on the Palatinate for almost five centuries. Heidelberg is linked as inextricably to the Castle as

it is to the over 600-year old University. The history of the town is omnipresent.

In our new “Accommodation + Packages” brochure, we have compiled a selection of the best

short breaks – visit the popular Castle festival, immerse yourself in the magical Castle Illumi-

nation nights or discover Heidelberg and its outlying areas by bike. Treat your taste buds while

getting to know the traditional bars in a foray through the alleyways of the Old Town – and,

while on an exclusive tour, you may even fall in love with Heidelberg.

You will receive a HeidelbergCARD with each trip – this allows you to travel on all public trans-

port for free. The Castle ticket and a ride on the funicular are also included (return ride up to

Molkenkur station, including a stop at the Castle). This gives you free admission to the Cas-

tle courtyard, as well as a visit to the Great Wine Barrel and the German Pharmacy Museum.

What is more, you are entitled to a number of discounts for tours, museums, leisure activities,

restaurants and shops during your stay.

To commemorate the destruction of the Castle by the French, Ben-gali lights blaze three times every summer on the walls of the ruins in a picturesque and eerie man-ner. The illumination of the beau-tiful facade of the Castle is com-plemented by festive fireworks which bathe the whole of the Old Town an impressive brilliance. You can gain a particularly extraordi-nary view of the spectacle from the water. After a ride in the Neckar Valley (approx. 1.5 hours) the boats with the best view of the fireworks dock in front of the Alte Brücke (Old Bridge).

3. The University in the Old TownIt is the oldest University in Germany: the Ru-perto Carola, founded in 1386 by Rupert I, Elector Palatine. The walking tour leads to the University Library, which houses the world-fa-mous Medieval song collection “Codex Ma-nesse” and to the opposing Peterskirche (St. Peter’s Church), the oldest church in the Old Town. The Alte Aula (Old Auditorium) and the Karzer, the historic students’ prison, are other stops along the way. Students were punished for trivial offenses in the Karzer between 1778 and 1914. TERMS AND CONDITIONS OF TRAVEL FOR PACK‐AGE TRIPS OF HEIDELBERG MARKETING GMBH

Dear guests,Please read carefully the following Terms and Condi-tions of Travel for package trips. These Terms and Con-ditions of Travel, insofar as they are legally applicable, form part of the Travel Agreement that you – herein-after “the Traveler” - conclude with Heidelberg Mar-keting GmbH – hereinafter abbreviated to “HDM” - as the tour operator. These Terms and Conditions of Trav-el apply exclusively to the package trips and support-ing programs of HDM. They do not apply to package trips for groups from 15 people and to the provision of third-party services nor to contracts concerning ac-commodation services. 1. CONCLUSION OF CONTRACT1.1. By making a booking (travel reservation), which can be made verbally, by telephone, in writing, by fax or by e-mail, the Traveler agrees to enter into a bind-ing Travel Agreement with HDM. The offer made by HDM is based on the travel description, these Terms and Conditions of Travel and all additional information in the booking materials (catalog, directory of accom-modation providers, internet), insofar as they are avail-able to the Traveler.1.2. The Travel Agreement comes into force on receipt by the Traveler of the booking confirmation from HDM. This does not require a specific form. The Traveler is sent the booking confirmation in writing upon or im-mediately after concluding the agreement. A written booking confirmation may not be provided if the Trav-eler makes the booking less than 7 working days be-fore departure.1.3. A booking confirmation from HDM that differs from the Traveler’s booking is deemed a new offer from HDM, to which HDM is committed for a period of 10 days from the booking confirmation date. The Agree-ment becomes effective on the basis of this changed offer provided that the Traveler accepts it by an ex-press declaration of consent, payment of a deposit or the outstanding amount. The same shall apply if HDM has submitted a written offer to the Traveler for an all-inclusive price.1.4. The Traveler making the booking is responsible for the contractual obliga-tions of fellow travelers on whose behalf he has made the booking, just as he is for his own obligations, provided that he has made a sep-arate declaration expressly agreeing to this obligation.1.5. HDM points out that, in accordance with the re-spective legislation (article 312g, paragraph 2, sentence 1, no. 9 BGB (German Civil Code)), there is no right of withdrawal for package travel contracts, even if these were concluded through distance marketing means (telephone, online, by fax, or e-mail). Only the statu-tory rights to cancel and terminate a contract apply, in particular the right of withdrawal as per article 651i BGB (see section 4 of these Terms and Conditions of Travel).

2. SERVICES, TRAVEL AGENTS2.1. The services to be provided by HDM are derived exclusively from the content of the booking confirma-tion in conjunction with the description for the respec-tive package trip on which said confirmation is based and in accordance with all the notes and explanations provided in the booking materials.2.2. Travel agents and service providers, especially ac-commodation providers, are not authorized by HDM to make assurances or enter into agreements that either contradict or extend beyond the travel description or booking confirmati-on, or that change the confirmed content of the Travel Agreement.

3. ADVANCE PAYMENT/FINAL PAYMENT3.1. Upon conclusion of the Agreement (receipt of booking confirmation) and after delivery of the se-cured payment certificate as per article 651k of the BGB (German Civil Code), the payment must be made at least 4 weeks before day of arrival. This sum shall be 20% of the price of the trip, unless a different figure has been agreed and indicated in the booking confir-mation. Upon conclusion of the Agreement (receipt of the booking confirmation) and after delivery of the se-cured payment as per article 651k BGB (German Civil Code),the full price of the trip must be paid to HDM at least 4 weeks before the day of travel, unless agreed otherwise in the booking confirmation/invoice. The full price of the trip must be paid immediately for bookings made less than 4 weeks before the start of the trip.If HDM is prepared to provide the contractual services and is in the position to do so and the Traveler fails to make payment by the agreed due dates, without the existence of any contractual or legal right on the part of the Traveler to withhold payment, HDM is en-titled, after sending a reminder with a fixed dead-line, to withdraw from the Agreement and impose cancella-tion charges on the Traveler as per paragraph 4 of these Terms and Conditions of Travel.

4. CANCELLATION BY THE TRAVELER, CHANGES TO RESERVATIONS4.1. The Traveler may cancel his booking at any time prior to departure. We recommend that cancellations are made in writing to avoid misunderstandings. The cancellation date is the date on which HDM receives the notice of cancella-tion.4.2. HDM is entitled to compensation for any cancella-tion by the Traveler for the travel arrangements already made and the expenses incurred by HDM as outlined below, whereby typically saved expenses and other possible conventi-onal uses of the travel services are taken into account:a) 20% of the price of the trip from 27 to 21 days prior to departureb) 40 % of the price of the trip from 20 to 12 days prior to departurec) 60 % of the price of the trip from 11 to 03 days prior to departured) 90% of the price of the trip from 3 days prior to departure and in the event of a no-show4.3. The purchase of suitable travel insurance to cover cancellation costs is strongly recommended.4.4. The Traveler is reserved the right to demonstrate to HDM that it has not incurred any costs or that the costs incurred have been considerably lower than the flat-rates set out above. In this case the Traveler is only liable for payment of the lower costs. 4.5. HDM reserves the right to claim sums higher than those specified above as compensation for specific damages, provided that HDM proves that it has incurred expenses considerably higher than the standard cancel-lation charge that would otherwise be applied. Should HDM assert such a claim, HDM must place a concrete value on the compensation being claimed, accounting for any saved expenses and any other use of the travel services, and justify that value.4.6. The legal right of the Traveler to provide a substi-tute under Article 651b BGB remains unaffected by the above provisions.4.7. For any changes to the travel date, accommoda-tion, level of catering or other services (changes to res-ervations) made at the request of the Traveler after the contract has been concluded, HDM may charge an administration fee of €15.00. This does not give the Traveler a legal right to have the change of reservation implemented. Insofar as the change of reservation is possible, it should be submitted up to 28 days prior to

departure. Changes to reservations after this date are only possible by canceling the Travel Agreement and making a fresh booking in line with the above cancel-lation provisions. This does not apply to requests for changes to reservations that incur only minimal costs.A reduction in the number of booked trip participants is deemed as a partial withdrawal, to which sections 4.1 to 4.5 apply.

5. OBLIGATIONS OF THE TRAVELER (Notification of Deficiency, Termination, Term of Limitation)5.1. The Traveler undertakes to notify HDM immedi-ately of any deficiencies and to request a remedy. In the event of the Traveler not giving immediate notification of a deficiency, any claims on the part of the Travel-er will be enter-tained only if the Traveler through no fault of his own was unable to fulfill his obligation to give immediate notification. It is not sufficient just to notify the service provider, in particular the provider of accommodation.5.2. If the trip is significantly impaired by a deficiency or the Traveler cannot be expected to make the trip due to the deficiency for a compelling reason that is recognized by HDM, the Traveler may terminate the Travel Agreement accord-ing to the applicable legisla-tion (Article 651e BGB). Termination is only permit-ted if HDM or its representatives have failed to remedy the situation within a reasonable timeframe determined by the Traveler. A timeframe does not have to be specified if a remedy is impossible or if HDM or its representa-tives refuse to seek a remedy or if immediate termina-tion of the Agreement is justified in the specific inter-ests of the Traveler. 5.3. The Traveler should assert a claim against HDM at the below address for non-performance of travel ser-vices in violation of the Agreement within one month of the return date stated in the Agreement. If the deadline falls on a Saturday, Sunday, or an officially recognized public holiday in the place of declaration, the deadline shall be automatically extended to the next working day. Claims submitted to service providers, in particular the accommodation provider, do not qualify as claims sub-mitted within the deadline. We strongly recommend that claims are asserted in writing.

6. LIABILITY6.1. The contractual liability of HDM for losses that do not arise from loss of life, physical injury or damage to health is limited to three times the price of the trip, provided that the loss incurred by the Traveler was nei-ther intentional nor the result of gross negligence, or if HDM is solely responsible for the loss incurred by the Traveler due to the culpability of a service provider. 6.2. HDM accepts no liability for the particulars of ser-vices and disruptions to servicesa) a) that are not contractually agreed primary services and are not part of the HDM package trip and are ap-parent to the Traveler and specified in the travel de-scription or the booking confirmation as third-party services, orb) are only arranged as third-party services during the stay (e.g., health and fitness services, sporting events, theater trips, exhibitions, excursions, etc.)

7. UNUSED SERVICESThe Traveler has no right to pro-rata refunds for indi-vidual travel services that the Traveler does not use due to returning early, illness or any other reasons not attributable to Heidelberg Marketing GmbH. Howev-er, assuming the sums involved are not wholly insignif-icant, HDM will seek a refund from the service provid-er and return the respective sums to the Traveler as soon as HDM receives the refunds from the individual service providers.

8. STATUTE OF LIMITATIONS 8.1. Claims asserted by the Traveler in accordance with Articles 651c to f BGB for losses resulting from loss of life, physical injury or damage to health caused by an intentional or grossly negligent breach of duty on the part of HDM or one of its vicarious agents lapse ac-cording to the statute of limitations after two years. This also applies to claims for compensation for other damages that arise from an intentional or grossly neg-ligent breach of duty on the part of the HDM or one of its legal representatives or vicarious agents. 8.2. All other claims asserted in accordance with Ar-ticles 651c to f BGB lapse according to the statute of limitations after one year.8.3. The statute of limitations in the sense of paragraphs 8.1 and 8.2 starts on the day on which the trip should have ended according to the contractual agreements. If the deadline falls on a Saturday, Sunday, or an offi-cially recog-nized public holiday in the place of decla-ration, the deadline shall be automati-cally extended to the next working day.8.4. While negotiations between the Traveler and HDM regarding the claim or the circumstances surrounding the claim remain unresolved, then the statute of lim-itations will be suspended until the Traveler or HDM refuses to continue the negotiations. The statute of limitations shall begin at the earliest three months af-ter the end of the suspension.9. APPLICABLE LAW AND JURISDICTION AGREEMENT 9.1. In the case of Travelers who are not citizens of Member States of the European Union or Switzerland, German law shall apply exclusively to the entire legal and contractual relationship between the Traveler and HDM. These Travelers may only bring a lawsuit against HDM in its registered domicile.9.2. 1. ROLE OF HDMHDM’s role is purely that of an agent, unless otherwise expressly agreed. It is not liable for information provid-ed by the Host or for services or disruptions affecting services provided by the Host. The foregoing is with-out prejudice to any liability of HDM arising from the agency contract.

2. CONCLUSION OF CONTRACT2.1. The following applies to all types of booking:a) The offer of accommodation by the Host and the booking made by the Guest are based on the descrip-tion of the accommodation and the supple-mentary in-formation given in the materials on the basis of which the booking is made (e.g., description of the locality, explanation of classification), insofar as these are avail-able to the Guest at the time of booking.b) Travel agents and booking offices, with the excep-tion of HDM itself, are not authorized by the Host to conclude agreements, give information or provide as-surances that alter the agreed content of the contract, exceed the scope of services promised by the Host un-der the contract or are inconsistent with the descrip-tion of the accommodation and the Host’s services.c) Information in hotel guides and similar directories not published by HDM or the Host are not binding on the Host and its service obligation, unless they have been made part of the service obligation of the Host through explicit agreement with the Guest.d) If the content of the booking confirmation differs from the content of the booking, this shall constitute a new offer by the Host. The contract is concluded on the basis of this new offer when the Guest accepts it by an express declara-tion of consent, payment of a deposit or the outstanding amount or by using the ac-commodation. e) HDM points out that, in accordance with the re-spective legislation (article 312g, paragraph 2, sen-tence 1, no. 9 BGB (German Civil Code)), there is no right of withdrawal for guest accommodation contracts (contracts for accom-modation with and without addi-tional services), even if these were concluded through distance marketing means (telephone, online, by fax, or e-mail). Only the statutory provisions of the rental contract law (article 537 BGB) apply (see section 6 of these Guest Accommodation and Agency Conditions).2.2. For bookings made verbally, by telephone, in writ-ing, by e-mail or by fax, the following applies:a) By making a booking, the Guest makes a binding offer to the Host to conclude a contract for accommodation. b) The contract comes into effect on receipt of the booking confirmation, which need not be made in any particular form. As a result, verbal and telephone con-firmations are also legally binding on the Guest. As a rule, the Host or HDM will also send the Guest a writ-ten copy of the booking confirmation. If the Guest has made a verbal or telephone booking and received cor-responding binding confirmation either verbally or by telephone, the contract is binding, even if the Guest does not receive a corresponding written copy of the book-ing confirmation. 2.3. For bookings made via the Internet, the following applies with regard to the concluding of the contract: notwithstanding 2.2a) The online booking process is explained to the Guest in the corresponding Internet portal. The Guest is given the opportunity to correct or delete his input or reset the entire online booking form by means of a suitable correc-tion facility with instructions on how to use it. The contract languages in which the online booking can be made are indicated. b) If the text of the contract is saved by the Host or in the online booking system, the Guest is informed of this and advised that he can access the text of the con-tract at a later time.c) By pressing the “Book and commit to pay” button, the Guest makes a binding offer to the Host to con-clude a contract for accommodation. The Guest re-

ceives electronic confirmation immediately on receipt of his booking.d) The sending of the offer to conclude a contract by pressing the “Book and commit to pay” button does not entitle the Guest to demand that a contract for accom-modation be concluded in accordance with his booking details. Rather, the Host is free to decide whether or not to accept the Guest’s offer to conclude a contract.e) The contract comes into being when the Guest re-ceives the booking confirmation from the Host or from HDM as its agent.2.4. If the booking confirmation appears on the screen immediately after the Guest has made the booking by pressing the “Book and commit to pay” button (real-time booking), the contract for accommodation comes into being when this booking confirmation is received and displayed on the Guest’s screen, without requiring any interim confirmation of receipt of the booking. In this case, the Client is offered the option of saving and print-ing the booking confir-mation. However, the contract for accommodation is binding, regardless of whether or not the Guest makes use of the option to save or print the booking confirmation. As a rule, the Host or HDM will also send the Guest a copy of the booking confir-mation by e-mail, e-mail attachment, post or fax. The contract for accommodation is legally binding, howev-er, regardless of whether or not such additional confir-mation is received.

3. RESERVATIONS3.1. Non-binding reservations that allow for cancella-tion free of charge are only possible if the Guest has an explicit agreement to this effect with HDM or the Host.3.2. If no reservation has been expressly agreed, the booking automatically results in a contract that is le-gally binding on the Host and on the Guest/Client in accordance with paragraph 2 (Conclusion of Contract) of these Terms and Conditions.3.3. If a non-binding reservation has been agreed with private guests, the Guest must inform HDM within the agreed period if the reservation is to be treated as binding. If this is not done, the booking shall lapse without HDM or the Host having any further duty to notify the Guest. If the Guest/Client informs the Host in good time, the booking shall become binding regard-less of whether HDM or the Host sends a booking con-firmation.

4. PRICES AND SERVICES, PRICE INCREASES4.1. The prices indicated in the brochure are final prices and include statutory value added tax and all incidental expenses, unless otherwise indicated in the case of in-cidental expenses. Items such as tourist tax or fees for services charged according to consumption (e.g., elec-tricity, gas, water, firewood) and for optional or addi-tional services may be charged and itemized separately.4.2. All services to be provided by the Host are exclu-sively those indicated in the booking confirmation to-gether with the valid brochure or property descrip-tion as well as any supplementary agreements expressly concluded with the Guest/Client. The Guest/Client is advised to make supplementary agreements in writing.4.3. After the contract has been concluded, if the pe-riod between the conclud-ing of the contract and the start of occupation is more than four months, the Host may increase the price by up to 5% for the following material reasons that were not foreseeable at the time the contract was concluded: tax increases, changes in exchange rates in the case of agreements made in for-eign curren-cies, increased material or personnel costs, increased utility charges.4.4. Prices may also be adjusted by the Host if the Client subsequently re-quires changes to the number of rooms booked, the services to be provided by the Host or the duration of the stay and the Host agrees.4.5. For changes to reservations (changes to the arriv-al and departure date, length of stay, level of catering, where additional services and other supple-mentary

services are booked) to which the Guest is not legally entitled, the Host may demand an administration fee of € 15 per change. This does not apply to changes that are only minor.

5. PAYMENT5.1. The date by which the amount must be paid is that agreed with the Guest or Client and stated in the booking confirmation. In the absence of any special agreement, the whole price of the accommodation in-cluding charges for inci-dental expenses and addition-al services is due and payable to the Host at the end of the stay.5.2. Payments are not accepted in foreign currency or by check. Payments can only be made by credit card if this has been agreed or is generally accepted and ad-vertised by the Host. Payments on the day of depar-ture cannot be made by bank transfer.5.3. If payment after invoicing has been agreed with the Guest or Client, the entire invoice amount is due 10 days after the invoice date, unless agreed otherwise.5.4. The Guest and Client are in default if due invoice amounts are not settled within 30 days of receipt of the invoice. Claims of the Host bear interest at 8% above the base interest rate in the case of companies and 5% above the base interest rate in the case of consumers. The Host reserves the right to seek further damages.

6. CANCELLATION AND NO‐SHOWUnless agreed otherwise in individual cases and stated in the booking confir-mation, the following applies for withdrawals and no-shows: 6.1. For bookings of up to three rooms may be canceled without charge up to two days before arrival.6.2. For bookings of more than three rooms, charge-free cancellation of any or all rooms is only permitted up to seven working days before arrival.6.3. In case of no-show or if charge-free cancellation is no longer possible, the following rules apply: a) In the case of cancellation or no-show, the Host re-mains entitled to payment of the agreed price of ac-commodation including board and additional services. b) The Host shall endeavor to find alternative occupan-cy for the accommoda-tion within the normal scope of its business operations, without any obligation to make special efforts and taking into consideration the partic-ular character of the accommodation (e.g., non-smoking room, family room).c) The Host shall adjust any cancellation charges to re-flect such other occu-pancy or, if this is not possible, any savings on expenses. d) In accordance with the legally recognized percentage rates for calculating savings on expenses, the Guest/Client shall pay the following sums to the accommoda-tion provider, based on the total price of the accommo-dation (including all incidental expenses): • For holiday apartments/accommodation without board 90% • For overnight stay/breakfast 80% • For half board 70% • For full board 60%e) The Guest/Client expressly reserves the right to prove to the Host that its savings on expenses are substantially higher than the deductions mentioned above, or that a different use of the accommodation or other services did occur. If such proof is furnished, the Guest or Client is only obliged to pay the corre-spondingly lower sum.6.4. The purchase of suitable travel insurance to cover cancellation costs is strongly recommended. 6.5. For accounting reasons, notice of cancellation should be addressed to HDM (not to the accommo-dation provider) and in the Guest’s interest should be made in writing.

7. ARRIVAL AND DEPARTURE7.1. Guests shall arrive by the agreed time or, if not agreed otherwise, no later than 6 pm.

7.2. The following applies in the event of late arrival:a) The Guest shall notify the Host no later than the agreed day of arrival if he is going to arrive late or, where the booking is for more than one night, if he will not arrive until a subsequent day. b) If notification is not made in good time, the Host shall be entitled to release the accommodation to another guest. For the period that the accommodation is not occupied, the terms of paragraph 6.3 apply. c) Where the Guest indicates a later time of arrival, he shall pay the agreed amount, less any saved expenses of the Host pursuant to paragraph 6.3, for the period including the time during which the accommodation is not used, unless the Host is contractually or legally responsible for the delayed occupa-tion.7.3. Guests shall vacate the accommodation by the agreed time or, if not agreed otherwise, by no later than 12 noon on the day of departure. The Host may demand an appropriate additional fee if the accommo-dation is not vacated in good time. The Host reserves the right to seek further damages.

8. OBLIGATIONS OF THE GUEST, CANCELLATION BY THE HOST8.1. Unless agreed otherwise, the accommodation can only be occupied by the Guest for whom it was booked. It is not permitted to use the accommodation in any other way, in particular to sub-let it or pass on accom-modation quotas in the case of commercial clients.8.2. The Guest is obliged to treat the accommodation, its furnishings and all facilities of the premises them-selves in accordance with their intended pur-pose, in compliance with any rules of use (e.g., for swimming pool and sauna), and carefully in all respects.8.3. The Guest is obliged to notify the Host immediate-ly of any deficiencies or faults and to request a remedy. It is not sufficient to inform only HDM of any defects. Failure to notify defects may render the Guest’s claims wholly or partially invalid.8.4. The Guest can only withdraw from the contract if the deficiencies or faults are significant. Having notified the defect, the Guest shall allow the Host a reasonable period of time in which to remedy it, unless remedy is impossible, the Host refuses to do so, or immediate cancellation by the Guest is objectively justified by a particular interest of the Guest that is recognized by the Host, or if the Guest cannot reasonably be expect-ed to continue his stay.8.5. Guests may only bring and keep pets in the ac-commodation subject to explicit agreement to this ef-fect and if the Host has provided for this in the offer of accommodation. When making such agreements, the Guest shall make truthful statements about the type and size of the pet. Violations of this rule entitle the Host to terminate the contract of accommodation with immediate effect.8.6. The Host is entitled to terminate the contract of accommodation without notice if the Guest, despite being warned, continues to seriously disrupt the Host’s business or disturb other guests, or if he breaches the terms of the contract to such an extent that immedi-ate termination of the contract is justi-fied. If the con-tract is terminated by the Host, the Host is entitled to payment in accordance with the above provisions concerning the Guest’s obligation to pay in the event of cancellation.

9. LIMITATION OF LIABILITY9.1. The Host’s liability under the contract of accom-modation in accordance with Article 536a of the Ger-man Civil Code for losses that do not arise from loss of life, physical injury or damage to health is excluded, provided they are not due to an intentional or gross-ly negligent breach of duty on the part of the Host or a legal representative or vicarious agent of the Host. 9.2. The Host’s liability for property brought into the accommodation pursuant to Article 701 ff. of the Ger-man Civil Code remains unaffected by this provision.

9.3. The Host shall not be liable for disruptions in con-nection with services that are only arranged during the stay and are recognizable to the Guest/Client as exter-nal services (e.g., sporting events, theater visits, exhibi-tions, etc.). The same applies to external services that are arranged at the time of booking the accommoda-tion, provided they are expressly identified as external services in the offer or booking confirmation.

10. STATUTE OF LIMITATIONS10.1. Contractual claims of the part of the Guest/Client against the Host or HDM for loss of life, physical injury or damage to health, including contractual claims for compensation for injury due to a negligent breach of duty on their part or an intentional or negligent breach of duty on the part of their legal representatives or vi-carious agents, shall lapse after three years. This also applies to claims for compensation for other damage due to a grossly negligent breach of duty on the part of the Host or HDM or due to an intentional or grossly negligent breach of duty on the part of its legal repre-sentatives or vicarious agents. 10.2. All other contractual claims shall lapse after one year.10.3. The statute of limitations period according to the above provisions shall, in each case, begin at the end of the year in which the claim arose and the Guest/Client became aware, or ought to have become aware unless acting with gross negligence, of the circumstanc-es giving rise to the claim and of the culpability of the Host or HDM. 10.4. While negotiations between the Guest and the Host or HDM with regard to claims asserted or the cir-cumstances underlying the claim remain unre-solved, then the statute of limitations will be suspended until the Guest or the Host or HDM refuses to continue the negotiations. The aforementioned statute of limitations period of one year shall begin at the earliest 3 months after the end of the suspension.

11. APPLICABLE LAW AND PLACE OF JURISDICTION11.1. The contractual relationship between the Guest or Client and the Host or HDM shall be governed ex-clusively by German law. This also applies to any other legal relationship.11.2. The Guest or Client may only institute legal pro-ceedings against the Host or HDM at their place of business.11.3. Lawsuits brought by the Host or HDM against the Guest or Client shall be referred to the court having jurisdiction over the Guest’s place of domicile. Lawsuits against Guests or Clients who are businesspeople, le-gal entities under public or private law or individuals having their place of domi-cile/business or normal res-idence abroad, or whose place of domicile/business or normal residence is unknown at the time the proceed-ings commence, shall be referred to the courts having jurisdiction over the Host’s place of business.11.4. The foregoing provisions do not apply if and inso-far as the contract is subject to mandatory provisions of the European Union or other international regulations.
