NEBOSH Exam Rules...Candidates can face extreme pressure to succeed in exams, not least because no-one likes to fail. Jobs or promotion may also depend on it. Even if this is not the case, if you are not fully prepared or confident, you may be tempted to cheat as a shortcut. But that can seriously backfire. Here’s a very recent case of how cheating during an exam can have far bigger consequences than you might imagine.

A candidate was caught copying off another candidate during an exam. This second candidate complained to the invigilator (this was purely because he found it extremely distracting, rather than a desire to report them). The accused candidate admitted copying when challenged by the invigilator and was asked to leave the exam. NEBOSH has since investigated and has taken the following action:

• Voided his exam result for this sitting - that means, a big fat ZERO.

• Banned him from taking ANY NEBOSH exams for a period of three years.

• If he decides to move his studies to another training company, that new company will also be told about the incident.

Thankfully, cheating in exams is very rare. The vast majority of candidates want to succeed under their own efforts, supported by their chosen training company.

NEBOSH Revised SyllabusesAs you are aware, NEBOSH revised the November 2014 specifications for the NGC, NFC, NCC, IGC, IFC, ICC and NDip Unit C courses earlier this year, so we’ve been working hard to update your course materials. If you’re sitting the exam in any of these courses in September, you need not panic - your current course materials are still examinable. The syllabus changes will affect any exam taken from October onwards, by which time your materials will be up to date.

Don’t forget to read through the Student Focus section of this Newsletter for any relevant changes to your materials. And best of luck in your upcoming exams!

RRC Health and Safety Law and Case Law GuideWe have amended two entries in the Health and Safety Law and Case Law Guide to bring them up to date. If you are studying a national (UK) course, please note the changes below.

Health and Safety at Work, etc. Act 1974

In this entry, at the end of the subsection entitled Section 3: General Duties of Employers and Self-Employed to Persons other than Employees, the following new paragraph has been added:

“Note that the Deregulation Act 2015 makes amendments to Section 3 to limit the scope of this duty to self-employed persons who conduct an ‘undertaking of a prescribed description’, i.e. one specifically prescribed by regulations made by the Secretary of State.”

Health and Safety (Offences) Act 2008

In the second paragraph of this entry, the first bullet point now reads:

• “raise the maximum fine which may be imposed in the lower courts to £20,000* for most health and safety offences;”

and the following footnote has been added:

“*Note: Schedule 4 to the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (Fines on Summary Conviction) Regulations 2015 has the effect of increasing this to an unlimited fine.”

Under the subheading Section 1: Health and Safety Offences: Mode of Trial and Maximum Penalty, the third column of the table (Penalty on Summary Conviction) has been updated to substitute “fine” for “fine not exceeding £20,000”, “fine not exceeding the statutory maximum” and “fine not exceeding level 5 on the standard scale”.

Unit FC1Element 1We have made a small amendment to this element in respect of fines in the magistrates’ court.

In the main section on Roles and Powers of Enforcement Agencies and Other External Agencies, under the subheading ENFORCEMENT OF THE REGULATORY REFORM (FIRE SAFETY) ORDER 2005, the second bullet point in the second paragraph now reads:

• “Prosecute in the criminal courts, where there has been:

– Failure to comply with an enforcement/prohibition notice.

– A serious infringement of the requirements of the RRFSO.Maximum penalties:

– On summary conviction in the Magistrates’ Court: a fine.

– On conviction on indictment in the Crown Court: a fine (unlimited), up to two years’ imprisonment, or both.”Note: this change has been made to your online material.

Element 2We have made a small amendment to this element as the CLP Regulation has now finally replaced the CHIP Regulations. In the main section on Ignition of Solids, Liquids and Gases, under the subheading DEFINITIONS, the GLOSSARY box definition of “Flammable, Highly Flammable and Extremely Flammable” now reads:“These are useful classifications under the EU CLP Regulation (No. 1272/2008 on classification, labelling and packaging of substances and mixtures) as follows:

• Flammable liquid - flash point of at least 21°C but less than 55°C (i.e. around ambient temperature).• Highly flammable - liquids with a flash point of less than 21°C (i.e. below ambient temperature) and certain
